1. सजं क्षप्त नाम और प्रारंभ.- (1) इन जनर्मों का संजक्षप् त नाम राष्‍टर ीर् रािधानी क्षेत्र और जनकटवती क्षेत्रों में वार्ु क्व ाजलटी प्रबंध आर्ोग (आर्ोग के अजधकाररर्ों और कमाचाररव न्‍द ि के वेतन, भत् त े और सेवा की ितें) जनर्म, 2026 ह ै।

(2) र् ेरािपत्र में उनके प्रकािन की तारीख को प्रव त् त होंगे ।

2. पररभाषाएं.- (1) इन जनर्मों में, िब तक की संिभ ासे अन्‍द र्था अपेजक्षत ना हो, ,- (क) ‘’अजधजनर्म’’ स े राष्‍टर ीर् रािधानी क्षेत्र और जनकटवती क्षत्रे ों में वार् ु क्व ाजलटी प्रबंध आर्ोग अजधजनर्म, 2021 (2021 का 29) अजभप्रेत ह ै;

(ग) ‘’अनुसूची’’ से इन जनर्मों से उपाबद्ध अनुसूची अजभप्रेत ह ै;

(2) उन िब्ि ों और पिों के, िो इन जनर्मों में प्रर्ुक् त ह ैऔर पररभाजषत नहीं दकए गए ह ैदकन्‍द तु अजधजनर्म म ेंपररभाजषत दकए गए ह,ैं वही अथ ाहोंग,े िो उनके अजधजनर्म में ह ै।

3. आर्ोग के अजधकाररर्ों और कमचा ाररवन्‍द ि की सख्ं र् ा, वते न और भत्त .े- आर्ोग के अजधकाररर्ों और अन्‍द र् कमाचाररव न्‍द ि की संख् र्ा, वेतन और भत् त े तथा उनकी भती की पद्धजत अनुसूची में र्था जवजनर्िाष्‍ट ट होंगी ।

4. पिों की सख्ं र् ा, उनका वगीकरण और वते न मरै रक्स म ेंस्ट्त र.- पिों के नाम, उनकी संख् र्ा, वगीकरण और उनसे सलं ग्न वेतन मैररक् स में स्ट् तर उक्त अनुसूची के स्ट् तंभ (1) से स्ट् तंभ (4) में र्था जवजनर्िाष्‍ट ट होंगे ।

5. भती की पद्धजत, आर्-ु सीमा, अहता ाएं, आदि.- भती की पद्धजत, आर्-ु सीमा, अहता ाए ंऔर उससे संबंजधत अन्‍द र् मामल े उक्त अनुसूची के स्ट्त ंभ (5) से स्ट्त ंभ (13) म ेंर्था जवजनर्िाष्‍ट ट होंग े।

6. जनरहता ा : वह व् र्जक्त – (क) जिसन े ऐसे व् र्जक्त से, जिसका पजत र्ा जिसकी पत् नी िीजवत ह,ै जववाह दकर्ा ह ैर्ा जववाह की संजविा की है; र्ा (ख) जिसने अपन े पजत र्ा अपनी पत् नी के िीजवत रहत े हुए दकसी व् र्जक्त स े जववाह दकर्ा ह ै र्ा जववाह की संजविा की ह ै उक्त पि पर जनर्ुजक्त का पात्र नहीं होगा:

परन्‍द तु र्दि केन्‍द रीर् सरकार का र्ह समाधान हो िाता ह ै दक ऐसा जववाह ऐसे व् र्जक्त और जववाह के अन्‍द र् पक्षकार को लाग ू स्ट् वीर् जवजध के अधीन अनुज्ञेर् ह ै और ऐसा करन े के जलए अन्‍द र् आधार ह,ैं तो वह दकसी व् र्जक्त को इस जनर्म के प्रवतान से छूट ि ेसकेगी ।

7. जनर्जु क्त प्राजधकारी.- आर्ोग का अध् र्क्ष, आर्ोग के अजधकाररर्ों और कमाचाररव न्‍द ि के जलए जनर्ुजक्त प्राजधकारी होगा ।

8. सीधी भती दकए िान े वाल े व्र् जक्त र्ों की छानबीन के जलए प्रदक्रर्ा.- (1) सीधी भती दकर्े िाने वाले व् र्जक्त र्ों की छानबीन के जलए प्रदक्रर्ा जनम्न जलजखत होगी, अथाात ् :- (क) आर्ोग, जवज्ञापन के माध् र्म से पि के जलए आवेिन आमंजत्रत करेगा;

(ख) ऐस ेप्राप् त सभी आवेिनों की अध् र्क्ष द्वारा गरित छानबीन सजमजत द्वारा पात्रता के जलए छानबीन की िाएगी ; (ग) (i) वेतन मैररक्स में स्ट् तर – 9 (53100-167800 रु.) और उससे ऊपर के पिों के जलए छानबीन सजमजत जनम्न जलजखत से जमलकर बनेगी :

1. सिस्ट् र् सजचव (राष्‍टर ीर् रािधानी क्षेत्र और जनकटवती क्षेत्रों में वार्ु क् वाजलटी प्रबंध आर्ोग) – अध् र्क्ष;

2. जनििे क (राष्‍टर ीर् रािधानी क्षेत्र और जनकटवती क्षेत्रों में वार्ु क् वाजलटी प्रबंध आर्ोग) – सिस्ट् र्;

3. उपसजचव (राष्‍टर ीर् रािधानी क्षेत्र और जनकटवती क्षेत्रों में वार्ु क् वाजलटी प्रबंध आर्ोग) – सिस्ट् र्।

(ii) वेतन मैररक्स में स्ट् तर – 8 (47600-151100 रु.) और उससे नीचे के पिों के जलए छानबीन सजमजत जनम्न जलजखत से जमलकर बनेगी :

1. जनििे क (राष्‍टर ीर् रािधानी क्षेत्र और जनकटवती क्षेत्रों में वार्ु क् वाजलटी प्रबंध आर्ोग) – अध् र्क्ष;

2. उपसजचव (राष्‍टर ीर् रािधानी क्षेत्र और जनकटवती क्षेत्रों में वार्ु क् वाजलटी प्रबंध आर्ोग) – सिस्ट् र्;

3. अवर सजचव (राष्‍टर ीर् रािधानी क्षेत्र और जनकटवती क्षेत्रों में वार्ु क् वाजलटी प्रबंध आर्ोग) – सिस्ट् र्।

(2) छानबीन सजमजत के दकसी सिस्ट् र् की अनुपजस्ट् थजत से छानबीन सजमजत की कार्ावाजहर्ां अजवजधमान्‍द र् नहीं होगी ।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3

9. प्रजतजनर्जु क्त द्वारा जनर्जु क्त की ििा म ेंछानबीन के जलए प्रदक्रर्ा.- (1) प्रजतजनर्ुजक्त द्वारा जनर्ुजक्त की ििा में छानबीन के जलए प्रदक्रर्ा जनम्न जलजखत होगी, अथाात ् :- (क) आर्ोग ररक्त पिों के जलए अजखल भारतीर् आधार पर जवज्ञापन के माध् र्म से आवेिन आमंजत्रत करेगा ;

(ख) ऐस ेप्राप् त सभी आवेिनों की अध् र्क्ष द्वारा गरित छानबीन सजमजत द्वारा पात्रता के जलए छानबीन की िाएगी; (ग) (i) वेतन मैररक्स में स्ट् तर – 9 (53100-167800 रु.) और उससे ऊपर के पिों के जलए छानबीन सजमजत जनम्न जलजखत से जमलकर बनेगी:

(ii) स्ट् तर – 8 (47600-151100 रु.) और उससे नीचे के पिों के जलए छानबीन सजमजत जनम्न जलजखत से जमलकर बनेगी:

(2) छानबीन सजमजत के दकसी सिस्ट् र् की अनुपजस्ट् थजत से छानबीन सजमजत की कार्ावाजहर्ां अजवजधमान्‍द र् नहीं होगी ।

10. सीधी भती र्ा प्रजतजनर्जु क्त दकए िान ेवाल ेव्र् जक्त र्ों के चर्न के जलए प्रदक्रर्ा.- (1) सीधी भती दकर्े िान ेवाल ेव् र्जक्त र्ों के चर्न के जलए प्रदक्रर्ा जनम्न जलजखत होगी, अथाात ् :- (क) जनर्म 8 और 9 में र्था उजल्लजखत छानबीन सजमजत द्वारा आवेिनों की छानबीन के पश्चात् छांटे गए आवेिन अध्र्क्ष (राष्‍टर ीर् रािधानी क्षेत्र और जनकटवती क्षेत्रों में वार्ु क्व ाजलटी प्रबंध आर्ोग) द्वारा गरित चर्न सजमजत के समक्ष रखे िाएगं े ;

(ख) (i) वेतन मैररक्स म ेंस्ट्त र – 12 (78800-209200 रु.) और उससे ऊपर के पिों के जलए चर्न सजमजत जनम्न जलजखत से जमलकर बनेगी :

1. अध्र्क्ष (राष्‍टर ीर् रािधानी क्षेत्र और जनकटवती क्षेत्रों में वार्ु क् वाजलटी प्रबंध आर्ोग) – अध्र्क्ष ;

2. पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर्, भारत सरकार (पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर्) म ेंसंर्ुक्त सजचव र्ा उससे ऊपर के स्ट्तर का अजधकारी – सिस्ट्र् ;

3. सिस्ट् र् सजचव (राष्‍टर ीर् रािधानी क्षेत्र और जनकटवती क्षेत्रों में वार्ु क् वाजलटी प्रबंध आर्ोग) – सिस्ट्र् ;

(ii) वेतन मैररक्स म ें स्ट्त र – 10 (56100-177500 रु.) और वेतन मैररक्स म ें स्ट्त र – 11 (56100-177500 रु.) के पिों के जलए चर्न सजमजत जनम्न जलजखत से जमलकर बनेगी :

2. पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् में जनििे क र्ा उससे ऊपर के स्ट्तर का अजधकारी – सिस्ट्र् ;

3. जनिेिक र्ा उप सजचव (राष्‍टर ीर् रािधानी क्षेत्र और जनकटवती क्षेत्रों में वार्ु क्व ाजलटी प्रबंध आर्ोग) – सिस्ट्र् ;

(iii) वेतन मैररक्स म ें स्ट् तर – 9 (53100-167800 रु.) और उससे नीचे के पिों के जलए चर्न सजमजत जनम्न जलजखत स े जमलकर बनगे ी :

2. जनिेिक र्ा उप सजचव (राष्‍टर ीर् रािधानी क्षेत्र और जनकटवती क्षेत्रों में वार्ु क्व ाजलटी प्रबंध आर्ोग) – सिस्ट्र् ;

3. पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् में उप सजचव र्ा उससे ऊपर के स्ट्तर का अजधकारी – सिस्ट्र् ;

(2) चर्न सजमजत के दकसी सिस्ट् र् की अनुपजस्ट्थ जत से चर्न सजमजत की कार्ावाजहर्ां अजवजधमान्‍द र् नहीं होगी ।

11. जवभागीर् पिोन्नजत सजमजत की सरं चना जनम्नानसु ार होगी :-- (1) (i) वते न मैररक्स म ें स्ट्त र – 12 (78800-209200 रु.) और उससे ऊपर के पिों के जलए जवभागीर् पिोन्नजत सजमजत जनम्न जलजखत से जमलकर बनगे ी :

2. पर्ाावरण, वन और िलवार् ु पररवतना मंत्रालर्, भारत सरकार में संर्क्तु सजचव र्ा उससे ऊपर के स्ट्तर का अजधकारी – सिस्ट्र् ;

(ii) वेतन मैररक्स में स्ट् तर – 10 (56100-177500 रु.) और वते न मैररक्स में स्ट्त र – 11 (67700-208700 रु.) के पिों के जलए जवभागीर् पिोन्नजत सजमजत जनम्न जलजखत से जमलकर बनगे ी :

(iii) वेतन मैररक्स में स्ट् तर – 9 (53100-167800 रु.) और उससे नीचे के पिों के जलए जवभागीर् पिोन्नजत सजमजत जनम्न जलजखत से जमलकर बनेगी :

3. पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् में उप सजचव र्ा उससे ऊपर के स्ट्तर का अजधकारी – सिस्ट्र् ;

(2) जवभागीर् पिोन्नजत सजमजत के दकसी सिस्ट् र् की अनुपजस्ट् थजत स े चर्न सजमजत की कार्ावाजहर्ां अजवजधमान्‍द र् नहीं होगी ।

12. कार्माक और प्रजिक्षण जवभाग द्वारा समर्-समर् पर, िारी दकए गए प्रजतजनर्ुजक्त संबंधी जनिेि प्रजतजनर्ुजक्त के आधार पर सेवारत अजधकाररर्ों और कमाचाररर्ों को लाग ूहोंग े।

13. सवे ा की ित.ें- (1) आर्ोग के अजधकाररर्ों और कमाचाररव न्‍द ि के वेतन, कार्ाग्रहण की अवजध, कार्ाग्रहण अवजध वेतन, भत् ते, छुट्टी, भजवष्‍टर् जनजध, अजधवर्षाता की आर्,ु र्ात्रा भत् ता और छुट्टी र्ात्रा ररर्ार्त और सेवाजनव जत् त फार्िों, सरकारी आवास ग ह और सेवा की अन्‍द र् ितें ऐसे जनर्मों और जवजनर्मों के अनुसार जवजनर्जमत होगी िो वेतन मैररक् स में तत्स्ट् थानी स्ट् तर से संबंजधत केन्‍दर ीर् सरकार के कमाचाररर्ों के जलए तत्स मर् लागू ह ैं।

(2) उपजनर्म (1) म ें अतंर्वाष्‍टट दकसी बात के होत े हुए भी, आर्ोग के अजधकाररर्ों और कमचा ाररव न्‍द ि द्वारा िासकीर् जविेिी िौरे करन ेके जलए, आर्ोग के अध् र्क्ष र्ा इस संबंध में अध्र् क्ष द्वारा प्राजधक त दकसी अन्‍द र् सिस्ट् र् का पूवा अनुमोिन अपेजक्षत होगा ।

(3) आर्ोग के अजधकारी और कमाचाररव न्‍द ि जिन्‍द ह ें वास-सुजवधा आबंरटत नही की गई ह,ै वे केन्‍द रीर् सरकार के समान वेतन आहररत करन े वाले अजधकाररर्ों और कमाचाररर्ों को र्था अनुज्ञेर् मकान दकरार्ा भत् ते के जलए पात्र होंग े।

(4) आर्ोग के अजधकारी और कमाचाररव न्‍द ि िो प्रजतजनर्ुजक्त पर ह ैं और जिनके पास साधारण पलू के अधीन सरकारी आवासीर् वास-सुजवधा ह,ै वे सरकारी आवासीर् वास-सुजवधा बनाए रखन े के जलए पात्र होंग े।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5

(5) (i) आर्ोग के अजधकारी और कमाचाररव न्‍द ि िो प्रजतजनर्ुजक्त पर ह,ैं ऐसी भजवष्‍टर् जनजध स्ट्क ीमों द्वारा िाजसत होत ेरहगें ें िो उन पर उनके मूल मंत्रालर् र्ा जवभाग अथवा सगं िन में लागू होती ह ैं ;

(ii) आर्ोग ऐस े अजधकाररर्ों और कमाचाररव न्‍द ि स े भजवष्‍टर् जनजध के जलए अजभिार् वसूल करेगा और उधारिाता मंत्रालर् र्ा जवभाग र्ा सगं िन को तुरंत ऐसी रकम प्रेजषत करेगा;

(iii) जवलंब से प्रेजषत दकर्े िान ेपर ब् र्ाि की कोई हाजन आर्ोग द्वारा वहन की िाएगी ।

(6) आर्ोग के प्रजतजनर्ुजक्त स ेजभन्‍द न अजधकारी और कमाचाररव न्‍द ि आर्ोग द्वारा केन्‍दर ीर् सरकार के परामि ास ेजवरजचत की िाने वाली स्ट् कीम के अनुसार समूह बीमा के हकिार होंगे: परन्‍द त ु प्रजतजनर्ुजक्त पर जनर्ुक्त दकए गए आर्ोग के अजधकारी और कमाचाररव न्‍द ि की ििा म ें वे ऐसी समूह बीमा स्ट् कीम द्वारा िाजसत होना िारी रहगें े, िो उन पर उनके मलू मत्रं ालर् र्ा जवभाग र्ा सगं िन म ेंलागू होती ह ै।

(7) (i) आर्ोग ऐस े अजधकाररर्ों और कमाचाररव न्‍द ि से बीमा स्ट् कीमों के जलए अजभिार् वसलू करेगा और उधारिाता मंत्रालर् र्ा जवभाग र्ा सगं िन को तुरंत ऐसी रकम प्रेजषत करेगा;

(ii) जवलंब से प्रेजषत दकर्े िान ेपर ब् र्ाि की कोई हाजन आर्ोग द्वारा वहन की िाएगी ।

(8) आर्ोग के ऐसे अजधकारी और कमाचाररव न्‍द ि िो प्रजतजनर्ुजक्त पर नहीं ह,ैं राष्ट्रीर् पेंिन प्रणाली द्वारा िाजसत होंगे ।

(9) आर्ोग के ऐसे अजधकारी और कमाचाररव न्‍द ि िो प्रजतजनर्ुजक्त पर ह,ैं ऐस े पेंिन और सेवाजनव जत् त फार्िों, र्दि कोई हो, के जलए पात्र होंगे, िो उन्‍द ह ेंउनके मूल मंत्रालर् र्ा जवभाग अथवा संगिन म ेंउपलब् ध ह ैं।

(10) आर्ोग के अजधकाररर्ों और कमाचाररव न्‍द ि को केन्‍द रीर् सेवाएं (जचदकत् सा पररचर्ाा) जनर्म, 1944 लागू होंगे ।

14. अवजिष्‍टट उपबधं .- आर्ोग के अजधकाररर्ों और कमाचाररव न्‍द ि के सेवाओं के जनबंधनों और ितों स ेसंबंजधत मामल ेजिनके संबंध में इन जनर्मों के अधीन कोई अजभव् र्क्त उपबंध नहीं दकर्ा गर्ा ह ैर्ा केन्‍द रीर् सरकार द्वारा ऐसे उपबंध नहीं दकए गए ह,ैं आर्ोग द्वारा केन्‍द रीर् सरकार को उसके जवजनश् चर् के जलए जनर्िाष्‍ट ट दकए िाएंग े ।

15. व्र् ावज त्त .- इन जनर्मों की कोई बात, ऐसे आरक्षण, आर्-ु सीमा में छूट और अन्‍द र् ररर्ार्तों पर प्रभाव नहीं डालगे ी, जिनका केन्‍द रीर् सरकार द्वारा इस संबंध म ेंसमर्-समर् पर िारी दकए गए आिेिों के अनुसार अनुसूजचत िाजतर्ों, अनुसूजचत िनिाजतर्ों, भूतपूवा सैजनकों, अन्‍द र् जपछडे वगों और अन्‍द र् जविषे प्रवगों के व् र्जक्त र्ों के जलए उपबंध करना अपेजक्षत ह ै।

16. जिजथल करन ेकी िजक्त .- िहां केन्‍द रीर् सरकार की आर्ोग के परामि ासे र्ह रार् ह ैदक ऐसा करना आवश् र्क र्ा समीचीन ह,ै वहां वह उसके जलए िो कारण ह ैंउन्‍द ह ेंलेखबद्ध करके, इन जनर्मों के दकसी उपबंध को दकसी वगा र्ा प्रवगा के व् र्जक्त र्ों के संबंध म,ें आिेि द्वारा जिजथल कर सकेगी । अनसु चू ी पि का नाम पिों की संख्र्ा वगीकरण वेतन मैररक्स में स्ट्तर चर्न पि सीधी भती अथवा के जलए आर्ु अचर्न पि सीमा

NOTIFICATION New Delhi, the 31st August, 2026 G.S.R. 766(E).—In exercise of the powers conferred by sub-section (9) of section 11 read with the clause (f) of sub-section (2) of section 25 of the Commission for Air Quality Management in National Capital Region and Adjoining Areas Act, 2021 (29 of 2021) and in supersession of the Commission for Air Quality Management in National Capital Region and Adjoining Areas (salaries, allowances and conditions of service of the officers and staff of the Commission) Rules, 2022 except as respects things to be done or omitted to be done before such supersession, the Central Government, in consultation with the Commission for Air Quality Management in National Capital Region and Adjoining Areas, hereby makes the following rules,

namely:-

1. Short title and commencement - (1) These rules may be called the Commission for Air Quality Management in National Capital Region and Adjoining Areas (salaries, allowances and conditions of service of the officers and staff of the Commission) Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions- (1) In these rules, unless the context otherwise requires,-

(a) "Act" means the Commission for Air Quality Management in National Capital Region and Adjoining Areas Act, 2021 (29 of 2021);

(b) "Commission" means the Commission for Air Quality Management in National Capital Region and Adjoining Areas constituted under section 3 of the Act;

(2) Words and expressions used herein and not defined in these rules but defined in the Act shall have the same meanings as assigned to them in the Act.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

3. Number, salaries and allowances of the officers and staff of the Commission- The number, salaries and allowances of the officers and other staff of the Commission and their method of recruitment shall be as specified in the Schedule.

4. Number of posts, classification and level in pay matrix.- The name of the posts, their number, classification and level in the pay matrix attached thereto shall be as specified in columns (1) to (4) of the said Schedule.

5. Method of recruitment, age limit, qualifications, etc.- The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

6. Disqualification. - No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

7. Appointing authority.- The Chairperson of the Commission shall be the appointing authority for the officers and staff of the Commission.

8. Procedure for screening in case of direct recruitment.-(1) The procedure for screening in case of direct recruitment shall be following, namely:-

(a) the Commission shall invite applications for the post through an advertisement;

(b) all such applications received shall be screened for eligibility by a screening committee constituted by the Chairperson;

consist of:

1. Member-Secretary (Commission for Air Quality Management in National Capital Region and Adjoining Areas) - Chairman;

2. Director (Commission for Air Quality Management in National Capital Region and Adjoining Areas) - Member;

3. Deputy Secretary (Commission for Air Quality Management in National Capital Region and Adjoining Areas) - Member.

(ii) the screening committee for posts of level-8 (Rs. 47600-151100) in the pay matrix and below shall consist of:

1. Director (Commission for Air Quality Management in National Capital Region and Adjoining Areas) - Chairman;

2. Deputy Secretary (Commission for Air Quality Management in National Capital Region and Adjoining Areas) - Member;

3. Under Secretary (Commission for Air Quality Management in National Capital Region and Adjoining Areas) - Member.

(2) Absence of any of the member of the screening committee shall not invalidate the proceedings of the screening committee.

9. Procedure for screening in case of appointment by deputation.- (1) The procedure for screening in case of appointment by deputation shall be following, namely:-

10. Procedure for selection in case of direct recruitment for or deputation.- (1) The procedure for selection in case of direct recruitment shall be as follows, namely:-

(a) After the scrutiny of applications by the screening committee as mentioned at rules 8 and 9, short-listed applications shall be placed before the selection committee constituted by the Chairperson (Commission for Air Quality Management in National Capital Region and Adjoining Areas);

(b) (i) the selection committee for posts of level-12(Rs.78800- 209200) in the pay matrix and above shall

consist of:

1. Chairperson (Commission for Air Quality Management in National Capital Region and Adjoining Areas)- Chairman;

2. Joint Secretary or above level officer of Ministry of Environment, Forest and Climate Change, Government of India (Ministry of Environment, Forest and Climate Change.) –Member;

3.Member Secretary (Commission for Air Quality Management in National Capital Region and Adjoining Areas)- Member.

(ii) the selection committee for posts of level-10(Rs.56100- 177500) in the pay matrix and level- 11(Rs.67700- 208700) in the pay matrix shall consist of:

1. Member Secretary (Commission for Air Quality Management in National Capital Region and Adjoining Areas) - Chairman;

2. Director or above level officer of Ministry of Environment, Forest and Climate Change. - Member;

12. Period of deputation.- The instructions on deputation issued, from time to time, by the Department of Personnel and Training shall be applicable to officers and staff serving on deputation basis.

13. Conditions of service.- (1) The conditions of service of the officers and staff of the Commission in matters of pay, joining time, joining time pay, allowances, leave, provident fund, age of superannuation, travelling allowance and leave travel concession, and retirement benefits, Government residential accommodation and other conditions of service, shall be regulated in accordance with such rules and regulations as are for the time being applicable to the employees belonging to the corresponding level in the pay matrix of the Central Government.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 31

(2) Notwithstanding anything contained in sub-rule (1), prior approval of the Chairperson of the Commission or any other Member of the Commission authorised by the Chairperson in this behalf shall be required for official visits abroad to be undertaken by officers and staff of the Commission.

(3) The officers and staff of the Commission not allotted accommodation shall be eligible for house rent allowance as admissible to officers and employees of the Central Government drawing similar pay.

(4) The officers and staff of the Commission who are on deputation and having Government residential accommodation under general pool shall be eligible to retain Government residential accommodation.

(5) (i) the officers and staff of the Commission appointed on deputation, shall continue to be governed by

Provident Fund Schemes as are applicable to them in their parent Ministry or Department or Organisation:-

(ii) the Commission shall recover contribution towards provident fund from such officers and staff and remit the amount immediately to the lending Ministry or Department or organisation;

(iii) any loss of interest on account of late remittance shall be borne by the Commission.

(6) The officers and staff of the Commission other than those on deputation shall be entitled Group Insurance

as per the scheme to be formulated by the Commission in consultation with the Central Government:

Provided that in the case of the officers and staff of the Commission appointed on deputation shall continue to be governed by the Group Insurance Schemes as are applicable to them in their parent Ministry or Department or Organisation.

(7) (i) the Commission shall recover contribution towards the insurance schemes from such officers and staff and remit the amount immediately to the lending Ministry or Department or Organisation;

(ii) any loss of interest on account of late remittance shall be borne by the Commission.

(8) The officers and staff of the Commission who are not on deputation shall be governed by the National Pension System.

(9) The officers and staff of the Commission who are on deputation shall be eligible for pension and retirement benefits, if any, as are available to them in their parent Ministry or Department or Organisation.

(10) The Central Services (Medical Attendance) Rules, 1944 shall apply to the officers and staff of the Commission.

14. Residuary provision.- Matters relating to the terms and conditions of service of the officers and staff of the Commission with respect to which no express provision has been made in these rules or such provisions have not been made by the Central Government, shall be referred by the Commission to the Central Government for its decision.

15. Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the ex- servicemen, the Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time, in this regard.

16. Powers to relax.- Where the Central Government in consultation with the Commission, is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
