esa jktiqjk 140401 dh LFkkuh; lhekvksa rd foLrkfjr jgsxhA [Qk- la- 4¼33½@86&dos hvkbZ&I] ch- ,p- vfuy dqekj] la;qDr lfpo MINISTRY OF MICRO, SMALL AND MEDIUM ENTERPRISES NOTIFICATION New Delhi, the 21st November, 2014 S.O. 2952(E).—Whereas by a lease deed executed between the President of India and the Kasturba Seva Mandir Trust, Rajpura (hereinafter referred to as KSMT), the Government land with buildings constructed thereon by the Government, measuring in all 46.93 acres and situated at Rajpura-140401 in the State of Punjab described in the Scheduled to, and delineated on the plan annexed to, the said Agreement (hereinafter referred to as the leased land), was given on lease to KSMT on a nominal yearly rent of Rupee one in view of the public and charitable activities carried on by KSMT, with effect from the 17th January, 1959 for a period of thirty years; And whereas the said lease was extended from time to time and was last extended for a further period of four years with effect from 16th July, 2000 upto 15th July, 2004, subject to the conditions that KSMT shall- (i) make alternative arrangements for carrying out its activities and vacate the Government land before 16th July, 2004; or (ii) purchase the leased land at the prevailing market rate as fixed by the Central Public Works Department; or (iii) handover the leased land to the Government immediately. And whereas, KSMT failed to comply with the conditions stated above and to vacate the leased land on or before the 16th July, 2004;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 And whereas, the team headed by the Joint Secretary visited the leased land and it was observed that the trust is carrying on with private activities including ice factory, renting of godowns, sale of agricultural products and fodder instead of public and charitable activities and developmental activities under various schemes of Khadi and Village Industries Commission; And whereas, a legal notice was served to KSMT with the approval of Hon’ble Minister of Micro, Small and Medium Enterprises and in consultation with the Ministry of Law and Justice to vacate the leased land within a period to three months from the date of said notice i.e., 11th June, 2012; And whereas, the trust did not vacate the land within the stipulated period of three months as mentioned in the legal notice; And whereas, the Central Government had, vide notification number S.O. 14(E), dated 30th December, 2013, published in Part II, Section 3, Sub-section (ii) of the Gazette of India, Extraordinary, dated the 2nd January, 2014, appointed Shri L. Haokip, Director, Ministry of Micro, Small and Medium Enterprises, Udyog Bhawan, New Delhi-110011, as the Estate Officer for a period of three months in respect of the leased land within the local limits of Rajpura-140401 in the State of Punjab under Section 3 of the Public Premises (Eviction of Unauthorised Occupants) Act, 1971 ( 40 of 1971) for the purpose of eviction of unauthorized occupant, namely, KSMT; And whereas, the said period of three months has expired and the Estate Officer has not been able to complete the eviction process under the said Public Premises (Eviction of Unauthorised Occupants) Act, 1971; Now, in exercise of the powers conferred under section 3 of the Public Premises (Eviction of Unauthorised Occupants ) Act, 1971, the Central Government hereby appoints Shri L. Haokip, Director, Ministry of Micro, Small and Medium Enterprises, Udyog Bhawan, New Delhi-110011, as the Estate Officer for a further period upto 31st March, 2015, for the purpose of taking necessary action under the said Act to evict the illegal occupant, namely, the Kasturba Seva Mandir Trust, Rajpura, from the leased land, and the jurisdiction of the Estate Officer shall extend to the local limits of Rajpura-140401 in the State of Punjab.
