Short title and commencement.-- (1) These rules may be called the Copyright Board Salaries and Allowances and the other terms and conditions of service of the Chairman and other Members Rules, 2014. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.—In these rules, unless the context otherwise requires __ (a) “Act” means the Copyright Act, 1957(14 of 1957); (b) “Copyright Board” means the Copyright Board established under section 11 of the Act. 3. Pay and other Allowances.-- (a) (1) (a) The Chairman shall be in Apex scale of Rs 80,000/- per month(fixed); (b) (b) The members shall be in the pay scale of Rs 37, 400-67, 000/- with Grade (c) pay of Rs. 10, 000/- per month. (d) (2) Where a serving judge of High Court is appointed as the Chairman, he shall be entitled to a monthly salary at the same rate as is admissible to a judge of the High Court: Provided that where a retired judge of the High Court is appointed as the Chairman, his monthly salary shall be reduced by the gross amount of pension or employer’s contribution to the contributory provident fund or any other form of retirement benefit, if any, drawn by him. (e) (3) A sitting or a retired judge of the High Court is appointed as the Chairman, he shall be entitled to such allowances and other benefits as is admissible to a judge of the High Court. (f) (4) In addition to the pay scale specified in sub-rule (1), a member shall be entitled to such allowances and other benefits as is admissible to the Central Government officers of the appropriate category and subject to conditions laid down in rules and orders of to the Central Government governing the grant of such allowances and other benefits in force from time to time. 4. Provident Fund.—(1) Subject to sub-rule (2) and sub-rule (3) of rule 3 the Chairman and other Members shall be governed by the provisions of the New Pension Scheme, 2004. (2) No additional pension and additional gratuity shall be admissible for service rendered in the Copyright Board. 5. Leave.—(1)Subject to sub-rule (2) and sub-rule (3) of rule 3 the Chairman and other Members shall be entitled to leave as follows: (a) Earned leave shall be credited to the leave account at the rate of 2 ½ days for each completed month of service which the Chairman and other Members are likely to render in half-year of the calendar year in which he is appointed. ; (b) The half pay leave shall be credited with half-pay leave in advance, in two instalments of ten days each on the first day of January and July of every calendar year on medical certificate or on private affairs, at the rate of twenty days in respect of each completed calendar year of service and the leave salary for half pay leave shall be equivalent to half of the leave salary admissible during earned leave. The leave shall be credited to the said leave account at the rate of 5/3 days for each completed calendar month of service which he is likely is appointed; (c) Leave on half pay can be commuted to full pay leave at the discretion of the Chairman or Other Member provided it is taken on medical grounds and is supported by a medical certificate from the competent medical authority; and (d) Extra ordinary leave shall be granted without pay and allowances up to a maximum of 180 days in one term of office. However, there shall be a reduction of earned leave at the rate of 1/10 on account of Extra ordinary leaves. (2) The payment of leave salary during leave shall be governed under the provisions of rule 40 of the Central Civil Services (Leave) Rules, 1972. (3) On expiry of the term of office in the Board, the Chairman and other Members shall be entitled to receive cash equivalent of leave salary in respect of earned leave standing to his credit subject to the condition that the¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5 maximum of leave encashed under this sub-rule and at the time of retirement from previous service taken together shall not in any case exceed three hundred days. 6. Leave sanctioning authority.—In case of Chairman, the Central government, and in case of other Members, the Chairman, shall be the leave sanctioning authority. 7. Travelling and Daily allowance.—If the Chairman is a serving or retired Judge of a High Court, the High Court Judges (Travelling Allowance) Rules, 1956, as amended from time to time, shall be applicable. If the Chairman is not a serving or retired Judge of a High Court, the Chairman and two other Members shall be governed by the provisions of Fundamental Rules and Supplementary Rules (Part II) Travelling Allowance Rules and their entitlement of Travelling Allowance on tour etc. would be as per the Department of Expenditure’s O.M 19030/3/2008-E.IV dated 23.09.2008. 8. Leave travel concession.—Subject to sub-rule (2) and sub-rule (3) of rule 3 the Chairman and other Members shall be entitled to Leave Travel Concession at the same scale and at the same rates as applicable to officers of the Central Government drawing equivalent pay. 9. Official visits abroad.—Official visits abroad by the Chairperson or Members shall be undertaken only in accordance with orders issued by the Central Government and they shall be entitled to draw such allowances in respect of such visits as are applicable to the officers of the Central Government drawing an equivalent pay. 10. Accommodation.—(1) Every person appointed to the Board as the Chairman or other Member shall be entitled to retain general pool accommodation which they are occupying at the time of appointment for a maximum period of five years. (2) Where the Chairman or other Member is not covered under the sub-rule (1) above, he shall be entitled to a house rent allowance as admissible to a Group ‘A’ officer of equivalent pay in the Central Government. 11. Transport.—The Chairman and Other Members shall be entitled to the facility of staff car for journeys for official and private purpose in accordance with the Staff Car Rules of the Government of India. 12. Medical facilities.—The Chairman and other Members shall be entitled to medical treatment and hospital facilities as provided in the Central Services (Medical Attendance) Rules, 1944. 13. Special provision.—Notwithstanding anything contained in rules 4 to 12 above, the conditions of service and other perquisites available to the Chairman shall be the same as admissible to a serving Judge of a High Court as contained in the High Court Judges (Conditions of Services) Act, 1954 and the High Court Judges (Travelling Allowance) Rules, 1956: 14. Other conditions of service.—Other conditions of service of the Chairman and other Members, with respect to which no express provision has been made in these rules, shall be such as are admissible to an officer of the Central Government drawing an equivalent pay. 15. Interpretation.—If any question arises relating to the interpretation of these rules the same shall be referred to the Central Government for its decision. 16. Residuary provision.—Matters relating to the terms and conditions of service of the Chairperson or a Member with respect to which no express provision has been made in these rules, shall be referred to the Central Government for its decision, and the decision of the Central Government thereon shall be applicable to the Chairperson or Member, as the case may be. 17.
