भारत गणराज्य के सतहत्तरव ें वर्ष म ें राष्ट्रीय राजिानी क्षत्रे दिल्ली की ग्नविानसभा द्वारा ग्ननम्नग्नलग्नित रूप म ें यह
अग्निग्ननयग्नमत हो: —
1. सग्नं क्षप्त नाम और प्रारंभ। — (1) इस अग्निग्ननयम का नाम दिल्ली अग्निशमन सवे ा (सशं ोिन) अग्निग्ननयम, 2026 ह।ै
(2) यह उस ग्नतग्नि स ेलाग ू होगा ग्नजसे सरकार, आग्निकाररक राजपत्र म ें अग्निसूचना द्वारा, ग्ननयत करे।
2. िारा 2 का सशं ोिन — दिल्ली अग्निशमन सेवा अग्निग्ननयम, 2007 (2009 का दिल्ली अग्निग्ननयम 2) की िारा 2 के िंड
(i) म,ें "भवन उप-ग्नवग्नि/भारत का राष्ट्रीय भवन कोड" (building bye-laws/National Building Code of India) शब्िों
के स्िान पर "भवन उप-ग्नवग्नि" (building bye-laws) शब्ि प्रग्नतस्िाग्नपत दकए जाएंगे।

उद्देश्यों और कारणों का कथन
दिल्ली अग्निशमन सेवा अग्निग्ननयम, 2007 (2009 का दिल्ली अग्निग्ननयम 2) राष्ट्रीय राजिानी क्षत्रे दिल्ली म ेंअग्निशमन सेवा
के रिरिाव और कुछ भवनों एव ं पररसरों म ें अग्नि ग्ननवारण तिा अग्नि सुरक्षा उपायों के ग्नलए अग्निक प्रभावी प्राविान करन े
और उससे संबंग्नित मामलों के ग्नलए अग्निग्ननयग्नमत दकया गया िा। उक्त अग्निग्ननयम को 17 जनवरी, 2009 को भारत के
राष्ट्रपग्नत की सहमग्नत प्राप्त हुई िी।
2. सशं ोिन की आवश्यकता
दिल्ली अग्निशमन सेवा अग्निग्ननयम, 2007 की िारा 2(i) म ें"भारत का राष्ट्रीय भवन कोड" (National Building Code of
India) का संिभष शाग्नमल ह।ै वैिाग्ननक ढांच ेम ेंशाग्नमल होन ेके कारण यह संिभष उक्त कोड के ग्नलए एक ग्नवग्नशष्ट ग्नविायी संिभ ष
के रूप म ें कायष करता ह।ै
भारत सरकार द्वारा चलाए जा रह े ग्नवननंयमन अभ्यास (Deregulation Exercise) के ग्नहस्स े के रूप म,ें दिल्ली अग्निशमन
सेवा ग्ननयम, 2010 म ें "भारत का राष्ट्रीय भवन कोड" के संिभष को हटान े का प्रस्ताव ह।ै इसग्नलए, अग्निग्ननयम और ग्ननयमों के
बीच ग्ननरंतरता बनाए रिने तिा एक अनावश्यक वैिाग्ननक संिभष को हटाने के ग्नलए मूल अग्निग्ननयम म ें तिनुरूपी संशोिन

3. प्रस्ताग्नवत सशं ोिन के उद्देश्य और प्रभाव
प्रस्ताग्नवत संशोिन का उद्देश्य दिल्ली अग्निशमन सेवा अग्निग्ननयम, 2007 की िारा 2(i) स े"भारत का राष्ट्रीय भवन कोड" के
संिभष को हटाना ह।ै
इस संशोिन का उद्देश्य एक ऐसे वैिाग्ननक संिभष को हटाना ह ै ग्नजसके पररणामस्वरूप राष्ट्रीय राजिानी क्षत्रे दिल्ली म ें अग्नि
ग्ननवारण और अग्नि सुरक्षा उपायों को ग्ननयंग्नत्रत करन े वाले ग्ननयामक ढांच े म ें िोहराव या अग्नतव्यापन (overlap) हो सकता
ह।ै
प्रस्ताग्नवत ग्नवलोपन दिल्ली म ें लाग ू मौजूिा आवश्यकताओं और मानकों के अनुसार, लाग ू भवन उप-ग्नवग्नियों के माध्यम स े
अग्नि ग्ननवारण और अग्नि सुरक्षा आवश्यकताओं के ग्ननिाषरण, सशं ोिन और अद्यतनीकरण को सगु म बनाएगा।
इस प्रकार, यह संशोिन हर ऐसे बिलाव के ग्नलए मलू अग्निग्ननयम म ें ग्नविायी संशोिन की आवश्यकता के ग्नबना, बिलत े
तकनीकी, प्रशासग्ननक और ग्ननयामक आवश्यकताओं के अनरूु प अग्नि ग्ननवारण और अग्नि सुरक्षा आवश्यकताओं को लचीला
बनाए रिन े के ग्नलए अग्निक ग्ननयामक लचीलापन प्रिान करेगा।
यह ग्नविेयक उपरोक्त उद्दश्े यों को प्राप्त करन े का प्रयास करता ह।ै

A BILL
further to amend the Delhi Fire Service Act, 2007.
BE it enacted by the Legislative Assembly of the National Capital Territory of Delhi in the Seventy-seventh Year
of the Republic of India as follows: —
1. Short title and commencement. —
(1) This Act may be called the Delhi Fire Service (Amendment) Act, 2026.
(2) It shall come into force on such date as the Government may, by notification in the Official Gazette, appoint.
2. Amendment of section 2 - In the Delhi Fire Service Act, 2007 (Delhi Act 2 of 2009), in section 2, in clause (i), for
the words “ building bye-laws/National Building Code of India”, the words “building bye-laws” shall be
substituted”.

STATEMENT OF OBJECTS AND REASONS
The Delhi Fire Service Act, 2007 (Delhi Act 2 of 2009) was enacted to provide for the maintenance of a fire service and
to make more effective provisions for fire prevention and fire safety measures in certain buildings and premises in the
National Capital Territory of Delhi and for matters connected therewith. The said Act received the assent of the President
of India on the 17th January, 2009.
2. Need for the amendment
Section 2(i) of the Delhi Fire Service Act, 2007 contains a reference to the “National Building Code of India”. The
reference, having been incorporated in the statutory framework, operates as a specific legislative reference to the said
Code.
As part of the Deregulation Exercise undertaken by the Government of India, the reference to the National Building
Code of India in the Delhi Fire Service Rules, 2010 is proposed to be omitted. It is, therefore, considered necessary and
expedient to make a corresponding amendment in the Principal Act so as to maintain consistency between the Act and
the Rules and to remove an unnecessary statutory reference.
3. Objects and effect of the proposed amendment
The proposed amendment seeks to omit the reference to the “National Building Code of India” from section 2(i) of
the Delhi Fire Service Act, 2007.
The amendment is intended to remove a statutory reference which may result in duplication or overlap with the
regulatory framework governing fire prevention and fire safety measures in the National Capital Territory of Delhi.[PART IV DELHI GAZETTE : EXTRAORDINARY 5
The proposed omission would facilitate the prescription, modification and updating of fire prevention and fire safety
requirements through the applicable Building Bye-Laws, in accordance with the prevailing requirements and standards
applicable in Delhi.
The amendment would thereby provide greater regulatory flexibility for keeping fire prevention and fire safety
requirements responsive to changing technical, administrative and regulatory requirements, without necessitating a
legislative amendment to the principal Act for every such change.
The Bill seeks to achieve the above objectives.

FINANCIAL MEMORANDUM
The Bill seeks to omit the reference to the “National Building Code of India” from section 2(i) of the Delhi Fire
Service Act, 2007.
The provisions of the Bill do not involve any expenditure, recurring or non-recurring, from the Consolidated Fund of
the National Capital Territory of Delhi.
