No. 161 भाग IV PART IV राष्ट्रीय रािधानी राज्य क्षत्रे दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI दिल्ली जिधान सभा सजििालय अजधसिू ना दिल्ली, 10 अगस्ट् त, 2026 . 21/15DUSIB(A)/2026/LAS-VIII/Legn./5908.—जनम्नजलजित को सिवसाधारण की िानकारी के जलए प्रकाजित दकया िाता हा दिल्ली िहरी आश्रय सधु ार बोडव (सिं ोधन) जिधये क, 2026 2026 की जिधये क सख्ं या 10 (िस ादक राष्‍टर ीय रािधानी क्षत्रे दिल्ल ी की जिधान सभा म ेंदिनांक 10 अगस्ट्त , 2026 को परु :स्ट्थ ाजपत दकया गया) 6164 DG/2026 (1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] 2026 की जिधये क सख्ं या 10 दिल्ली िहरी आश्रय सधु ार बोडव अजधजनयम, 2010म ेंसिं ोधन करन ेहते ु एक जिधये क भारत गणराज्य के सतहत्तरिें िर्व म ेंराष्ट्रीय रािधानी क्षेत्र दिल्ली की जिधान सभा द्वारा जनम्नानुसार यह अजधजनयजमत हो:— 1. सजं क्षप्त िीर्कव एि ंप्रारंभ- (1) इस अजधजनयम को दिल्ली िहरी आश्रय सुधार बोड व (संिोधन) अजधजनयम, 2026 कहा िाए। (2) यह उस जतजथ से लाग ूहोगा जिसे सरकार आजधकाररक रािपत्र में प्रकाजित अजधसूिना द्वाराजनयत करे। 2. धारा 2 म ेंसिं ोधन दिल्ली िहरी आश्रय सुधार बोडव अजधजनयम, 2010 की धारा 2 म,ें िंड (छ) के उपिडं (iii) म,ें "दिनाकं 1 िनिरी, 2006 को इसम ें कम स े कम पिास पररिारजनिास कर रह े ह ैं ।"िब्िों और अंकों के स्ट्थान पर" दिनाकं 1 िनिरी, 2025को इसम ें कम स े कम पिास पररिारजनिास कर रह े हैं" िब्िों और अंकों को प्रजतस्ट्थाजपत दकया िाएगा। आिीर् सूि, िहरी जिकास मंत्री उद्देश्यों एि ंकारणों का जििरण दिल्ली िहरी आश्रय सुधार बोडव अजधजनयम, 2010 को िहरी आश्रय के सुधार, पुनिावस और जिकास तथा इससे संबंजधत मामलों के जलए अजधजनयजमत दकया गया था। अजधजनयम की धारा 2 के िडं (छ) म ें"झुग्गी-झोपडी बस्ट्ती" िब्ि को पररभाजर्त दकया गया ह और झुजग्गयों के समूह को झुग्गी-झोपडी बस्ट्ती घोजर्त करन े के जलए मानिंड जनधावररत दकए गए ह।ैं इसके उपिंड (iii) के अन् तगवत ऐस ेसमूह में दिनांक 01िनिरी, 2006 को कम से कम पिास पररिार जनिास कर रह ेहों। राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार न े झुग्गी-झोपडी बजस्ट्तयों के पात्र जनिाजसयों के पुनिावस एिंपुन:स्ट्थ ान जनधावरण हते ु एक आधुजनक रूपरेिा प्रिान करने के उद्दश्े य से दिल्ली स्ट्ल म तथा झुग्गी-झोपडी पुनिावस एिं पुन:स्ट्थ ान जनधावरण नीजत, 2026 त यार की ह। प्रस्ट्ताजित नीजत म ें झुग्गी-झोपडी बस्ट्ती के अजस्ट्तत्ि का जनधावरण करन े की अंजतम जतजथ को दिनांक 01िनिरी, 2006 स ेसंिोजधत करके 01िनिरी, 2025 कर दिया गया ह। यद्यजप अजधजनयम की धारा 2(छ)(iii) म ेंजनजहत ि धाजनक पररभार्ा पुनिावस एिं पुन:स्ट् थान जनधावरण के प्रयोिनाथव झुग्गी-झोपडी बजस्ट्तयों की पहिान का आधार ह, इसजलए अजधजनयम के प्रािधानों को प्रस्ट्ताजित नीजत के अनरूु प बनाना आिश्यक ह। प्रस्ट्ताजित संिोधन का अजभष्‍टट , दिल्ली िहरी आश्रय सुधार बोड व अजधजनयम, 2010 की धारा 2(छ)(iii) म ें "दिनांक 01िनिरी, 2006"िब्ि ों और अंकों को"दिनांक 01िनिरी, 2025" िब्िों और अंकों स ेप्रजतस्ट्थाजपत करने का ह। इस संिोधन का उद्देश्य प्रस्ट्ताजित नीजत के साथ ि धाजनक सगं जत सुजनजित करना, पात्र झुग्गी-झोपडी बजस्ट्तयों की पहिान म ें कानूनी जनजितता प्रिान करना और सिं ोजधत नीजतगत रूपरेिा के अनुसार पुनिावस और पुन:स्ट् थान जनधावरण उपायों के प्रभािी कायावन्ियन को सुगम बनाना ह। इस जिधेयक का अजभष्‍टट उपरोक्त उद्दश्े यों को प्राप्त करना ह। आिीर् सूि, िहरी जिकास मंत्री[PART IV DELHI GAZETTE : EXTRAORDINARY 3 जित्तीय ज्ञापन दिल्ली िहरी आश्रय सुधार बोडव अजधजनयम की धारा 10 के अनुसार, बोड व को झुग्गी-झोपडी बजस्ट्तयों को हटान े तथा जनिाजसयों के पुन:स्ट्थापन हते ु योिना त यार करने का अजधकार और िाजयत्ि प्राप्त ह। स्ट्पष्टतः, इस सम्पूणव प्रदिया के जलए पुन:स्ट्थान जनधावरण हते ु जनजध की आिश्यकता होती ह, जिसे दिल्ली सरकार/दिल्ली िहरी आश्रय सुधार बोडव द्वारा उपलब्ध कराया िाता ह तथा नए घरों की लागत म ेंभू-स्ट्िामी और झुग्गीिाजसयों द्वारा भी योगिान दिया िाता ह । दिल्ली िहरी आश्रय सधु ार बोडव अजधजनयम की धारा 11 के अनुसार, बोडव उक्त अजधजनयम की धारा 11(1) के परंतुक के अधीन िौिालय, स्नान सुजिधाएं, िल जनकासी, िल आपूर्त,व सडक पक्कीकरण आदि प्रिान करके दकसी भी झुग्गी- झोपडी बस्ट्ती म ेंसुधार करन े के जलए बाध्य ह। दिल्ली िहरी आश्रय सुधार बोडव अजधजनयम, 2010 की धारा 12 के अनुसार, बोड व उस भू-स्ट्िामी की सहमजत स,े जिस पर झुग्गी-झोपडी बस्ट्ती जस्ट्थत ह, सामूजहक सामुिाजयक पुनिावस, पनु :स्ट्थान जनधारव ण या यथास्ट्थान उन्नयन के जलए योिनाए ँबना सकता ह तथा पयाविरणीय सुधार और जनिाजसयों की रहन-सहन की जस्ट्थजतयों म ेंसुधार लान ेके िजृ ष्टगत बस्ट्ती के पुनर्िवकास के जलए जनिी क्षत्रे /झुग्गी सहकारी सजमजतयों को भी िाजमल कर सकता ह। तथाजप, अंजतम जतजथ दिनांक 01.01.2006 से संिोजधत करके दिनांक 01.01.2025 करने पर, स्ट्पष्ट रूप से इसका प्रभाि यह होगा दक धारा 2(छ)(iii) की पररभार्ा के अंतगवत आन ेिाल ेक्लस्ट्टरों की संख्या म ेंिृजि हो िाएगी। पररणामस्ट्िरूप, दिल्ली िहरी आश्रय सुधार बोडव अजधजनयम, 2010 के अनुसार उपरोक्त अनच्ु छेिों मे उजल्लजित अजनिायव गजतजिजधयों तथा कायों स े संबंजधत जित्तीय लागत म ें भी उसी अनुपात म ें िृजि हो िाएगी। आिीर् सूि, िहरी जिकास मंत्री डॉ. युमनाम अरूण कुमार, सजिि4 DELHI GAZETTE : EXTRAORDINARY PART IV] DELHI LEGISLATIVE ASSEMBLY SECRETARIAT NOTIFICATION Delhi, the 10th August, 2026 F. No. 21/15DUSIB(A)/2026/LAS-VIII/Legn./5908.—The Following is Published for General Information:— THE DELHI URBAN SHELTER IMPROVEMENT BOARD (AMENDMENT) BILL, 2026 Bill No. 10 of 2026 (As introduced in the Legislative Assembly of the National Capital Territory of Delhi on 10th August, 2026) Bill No. 10 of 2026 THE DELHI URBAN SHELTER IMPROVEMENT BOARD (AMENDMENT) BILL, 2026 A BILL to amend the Delhi Urban Shelter Improvement Board Act, 2010. Be it enacted by the Legislative Assembly of the National Capital Territory of Delhi in the Seventy-seventh Year of the Republic of India as follows:— 1. Short title and commencement.- (1) This Act may be called the Delhi Urban Shelter Improvement Board (Amendment) Act, 2026. (2) It shall come into force on such date as the Government may, by notification published in the Official Gazette, appoint. 2. Amendment of section 2. In section 2 of the Delhi Urban Shelter Improvement Board Act, 2010, in clause (g), in sub-clause (iii), for the words and figures— "It is inhabited at least by fifty households as existing on 1st January, 2006", the words and figures— "It is inhabited at least by fifty households as existing on 1st January, 2025", shall be substituted. ASHISH SOOD, Minister (Urban Development)[PART IV DELHI GAZETTE : EXTRAORDINARY 5 STATEMENT OF OBJECTS AND REASONS The Delhi Urban Shelter Improvement Board Act, 2010 was enacted to provide for the improvement, rehabilitation and development of urban shelter and for matters connected therewith. Clause (g) of section 2 of the Act defines the expression "jhuggi jhopribasti" and prescribes the criteria for declaration of a group of jhuggis as a jhuggi jhopribasti. Under sub-clause (iii) thereof, such group is required to be inhabited by at least fifty households existing on 1st January, 2006. The Government of the National Capital Territory of Delhi has formulated the Delhi Slum and Jhuggi Jhopri Rehabilitation and Relocation Policy, 2026 with a view to providing a contemporary framework for the rehabilitation and relocation of eligible residents of jhuggi jhopribastis. The proposed Policy revises the cut-off date for determining the existence of a jhuggi jhopribasti from 1st January, 2006 to 1st January, 2025. Since the statutory definition contained in section 2(g)(iii) of the Act forms the basis for identification of jhuggi jhopribastis for the purposes of rehabilitation and relocation, it is necessary to align the provisions of the Act with the proposed Policy. The proposed amendment seeks to substitute the words and figures "1st January, 2006" with the words and figures "1st January, 2025" in section 2(g)(iii) of the Delhi Urban Shelter Improvement Board Act, 2010. The amendment is intended to ensure statutory consistency with the proposed Policy, provide legal certainty in the identification of eligible jhuggi jhopribastis, and facilitate the effective implementation of rehabilitation and relocation measures in accordance with the revised policy framework. The Bill seeks to achieve the above objects. ASHISH SOOD, Minister (Urban Development) FINANCIAL MEMORANDUM As per Section 10 of Delhi Urban Shelter Improvement Board Act, the BOARD is empowered and under obligation to prepare a scheme for removal of any JhuggiJhopriBasti and resettlement of the residents. Evidently, the whole process requires funds for relocation, which is provided by Delhi Govt./ Delhi Urban Shelter Improvement Board and also contributed by the land owner and jhuggi dwellers towards the cost of the new houses. As per Section 11 of the DUSIB Act, the BOARD is under obligation for improvement of any Jhuggi JhopriBasti by way of providing toilets, bathing facilities, drainage, water supply, street paving etc. subject to the proviso of section 11(1) of the said Act. As per Section 12 of the Delhi Urban Shelter Improvement Board Act, 2010, the BOARD may, with the consent of the owner of the land on which jhuggi jhopribasti is situated, work out schemes for collective community rehabilitation, relocation or in-situ upgradation and involve private sector/slum cooperative for redevelopment of the basti with a view to bringing about environmental improvement and improvement in the living conditions of the residents. Hence, on amendment of the cut-off date from 01.01.2006 to 01.01.2025, the obvious implications would be the rise in number of clusters coming within the definition of Section 2(g) (iii). Consequently, the financial implications with respect to the activities and functions mandated as per the Delhi Urban Shelter Improvement Board Act, 2010 as given in the above paras, will also increase correspondingly.
