L.-33004/99 सी.जी.-डी.एलxx.x-GअID.-H2x6x0x 22026-270529 CG-DLxx-xEG-I2D6E0x2x2x0 26-270529 असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 145] नई दिल्ली, बृहस्ट्प जतवार, फरवरी 26, 2026/फाल्ग नु 7, 1947 No. 145] NEW DELHI, THURSDAY, FEBRUARY 26, 2026/PHALGUNA 7, 1947 भारतीय खाद्य सरु क्षा और मानक प्राजधकरण अजधसचू ना नई दिल्ली, 26 फरवरी, 2026 फा. स.ं एसएस-टी0एफए(नोटट.)/7/2025-स्ट्टैंडडड-एफएसएसएआई.—खाद्य सुरक्षा और मानक (पैकेजिंग) जवजनयम, 2018 म ें और संिोधन करन े के जलए कजतपय जवजनयमों का जनम्नजलजखत प्रारूप, जिसे भारतीय खाद्य सुरक्षा और मानक प्राजधकरण केंद्र सरकार के पूवड अनुमोिन स,े खाद्य सुरक्षा और मानक अजधजनयम, 2006 (2006 का संखयांक 34) की धारा 23 के साथ पटित धारा 92 की उप-धारा (2) द्वारा प्रित्त िजियों का प्रयोग करत े हुए बनान े का प्रस्ट्ताव करता ह,ै एतिद्वारा प्रभाजवत होन े वाल े संभाजवत सभी व् यजियों को सचू ना िेन े के जलए उि अजधजनयम की धारा 92 की उप-धारा (1) की अपेक्षा के अनुसार प्रकाजित दकया िाता ह ैऔर यह नोटटस दिया िाता ह ैदक उक्त प्रारूप जवजनयमों पर उस तारीख स ेसाि दिनों की अवजध समाप् त होन ेके बाि जवचार दकया िाएगा, जिस तारीख को इस अजधसूचना को प्रकाजित करन ेवाल े रािपत्र की प्रजतया ाँ िनता को उपलब् ध कराई िाएगाँ ी; आपजत्त अथवा सुझाव, यदि कोई हो, मखु य कायडकारी अजधकारी, भारतीय खाद्य सुरक्षा और मानक प्राजधकरण, एफडीए भवन, कोटला रोड, नई दिल्ल ी - 110002 को अथवा ई मले द्वारा regulation@fssai.gov.in पर भेिा िा सकता ह ै। 1448 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] उपरोि जवजनर्िडष्ट अवजध के भीतर उि प्रारूप जवजनयमों के संबंध म ें प्राप्त होने वाली आपजत्तयों या सुझावों पर भारतीय खाद्य सुरक्षा और मानक प्राजधकरण द्वारा जवचार दकया िाएगा। प्रारूप जवजनयम 1. इन जवजनयमों को खाद्य सुरक्षा और मानक (पैकेजिंग) संिोधन जवजनयम, 2026 कहा िा सकता ह।ै 2. खाद्य सुरक्षा और मानक (पकै ेजिंग) जवजनयम, 2018 म,ें - (1) जवजनयम (2) म ेंपटरभाषाओं स ेसंबंजधत उप-जवजनयम (1) म,ें खंड (i) के बाि, जनम्नजलजखत खंड अतं ःस्ट्थाजपत दकए िाएाँग,े अथाडत;् (ञ) ““खाद्य संपकड सामग्री" स ेतात्पय डह ैसदिय और बुजिमत्तापूण डसामग्री सजहत कोई भी सामग्री, वस्ट्त ुऔर उत्पाि, िो भोिन के संपकड म ेंआन ेके जलए अजभप्रेत ह ैऔर जिसका भोिन तथा स्ट्वास्ट््य पर कोई अवांछनीय प्रभाव नहीं पड़ना चाजहए; (ट) "खाद्य श्रेणी संपकड सामग्री" स े तात्पय ड ह ै कोई भी ऐसी सामग्री(यााँ) िो खाद्य संपकड सामग्री के जनमाडण, प्रसंस्ट्करण, रखरखाव (रसोई के बतडन, मेि के बतडन, आदि सजहत), पैकेजिंग, भडं ारण और पटरवहन के जलए उपयोग की िाती ह,ैं िो जनधाडटरत ितों के तहत जवजिष्ट सुरक्षा मानकों के अनुरूप होनी चाजहए और जिनस ेमानव तथा पिु स्ट्वास्ट््य के जलए कोई खतरा उत्पन्न न हो और न ही इनके कारण अजभप्रेत उपयोग के िौरान भोिन की संरचना और जविेषताओं म ेंकोई अस्ट्वीकाय ड बिलाव आना चाजहए; (ि) "पटरवर्तडत वातावरण पैकेजिंग" स ेतात्पय डह ैदकसी ऐसे पैकेि म ेंभोिन को रखना जिसम ेंपैकेि के अंिर के वातावरण को भोिन की प्रयोगावजध को बढाने और गणु वत्ता को बनाए रखने के जलए एक इष्टतम वातावरण प्रिान करने हते ु संिोजधत या पटरवर्तडत दकया िाता ह;ै (ड) "खाद्य पैकेजिंग" स े तात्पय ड उस पैकेि स े ह ै जिसका उपयोग कच्चे माल स े लेकर प्रसंस्ट्कृत भोिन तक, भोिन के समावेिन, संरक्षण, रखरखाव, जवतरण, और भडं ारण, पटरवहन और प्रस्ट्तुजत के जलए उत्पािक स ेलेकर उपयोगकता ड या उपभोिा तक, जिसम ें प्रसंस्ट्करणकता,ड संयोिक या अन्य मध्यस्ट्थ िाजमल ह,ैं सबके द्वारा दकया िाना ह;ै (ढ) "अप्रयोजित रूप स े सजममजलत पिाथड (एनआईएएस)" अप्रयोजित रूप स ेसजममजलत पिाथ ड ऐसे रसायन ह ैंिो खाद्य संपकड सामग्री (एफसीएम) या खाद्य संपकड वस्ट्तु (एफसीए) म ेंमौिूि होते ह,ैं लेदकन उत्पािन प्रदिया के िौरान दकसी तकनीकी कारण स े नहीं िोड़ े िाते ह;ैं (ण) "रोगाणु रजहत पैकेजिंग" स ेतात्पय डउस प्रदिया से ह ैजिसम ेंसंिषू ण को रोकने के जलए रोगाणु रजहत उत्पाि को एक रोगाण ु रजहत कंटेनर म ें भरा िाता ह ैऔर रोगाणु रजहत वातावरण म ेंसील कर दिया िाता ह।ै " राजित पुनहानी, मुखय कायडकारी अजधकारी [जवज्ञापन-III/4/असा./722/2025-26] नोट - मूल जवजनयम भारत के रािपत्र, असाधारण, भाग III, खंड 4 म ें अजधसूचना संखया फाइल संखया 1-95/एसटीडीएस/ पैकेजिंग/एसपी(एलएंडसी/ए)/एफएसएसएआई-2017, दिनांक 24 दिसंबर, 2018 के तहत प्रकाजित दकए गए थ े और अंजतजमत बार अजधसूचना संखया फा.सं.एसटीडी/एसपी-20/टी(रीसाइदकल्ड-एन) दिनाकं 28 माच,ड 2025 के तहत संिोजधत दकए गए थे।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 FOOD SAFETY AND STANDARDS AUTHORITY OF INDIA NOTIFICATION New Delhi, the 26th February, 2026 F. No. SS-T0FA(NOTI)/7/2025-Standard-FSSAI.— The following draft of certain regulations further to amend the Food Safety and Standards (Packaging) Regulations, 2018, which the Food Safety and Standards Authority of India proposes to make with previous approval of the Central Government, in exercise of the powers conferred by sub- section (2) of section 92 read with section 23 of the Food Safety and Standards Act, 2006 (34 of 2006) is hereby published as required under sub-section (1) of section 92 of the said Act for the information of all persons likely to be affected thereby, and notice is hereby given that the said draft regulations shall be taken into consideration after the expiry of the period of sixty days from the date on which the copies of the Gazette containing this notification are made available to the public; Objections or suggestions, if any, may be addressed to the Chief Executive Officer, Food Safety and Standards Authority of India, Food and Drug Administration Bhawan, Kotla Road, New Delhi-110002 or may be sent by email at regulation@fssai.gov.in. Objections or suggestions which may be received with respect to the said draft regulations within the period specified above shall be considered by the Food Safety and Standards Authority of India. Draft Regulations 1. These regulations may be called the Food Safety and Standards (Packaging)Amendment Regulations, 2026. 2. In the Food Safety and Standards (Packaging) Regulations, 2018, - (1) In regulation (2)relating to definitions in sub regulation (1), after clause (i), the following clauses shall be inserted, namely; (j) ““food contact material’’means any material, including active and intelligent materials, article and product intended to come into contact with food and should not have any undesirable effect on the food and health; (k) “food grade contact material”meansany material(s) that are used for manufacturing, processing, handling (including kitchenware, tableware, etc.), packaging, storage and transportation of food contact material should have demonstrated their compliance with specific safety standards under prescribed conditions and shall not endanger human and animal health and result in an unacceptable change in the composition and characteristics of food during its intended use; (l) “modified atmosphere packaging” means enclosure of food in a package in which the atmosphere inside the package is modified or altered to provide an optimum atmosphere for increasing shelf life and maintaining food quality; (m) “food packaging”meanspackage to be used for the containment, protection, handling, delivery, and storage, transport and presentation of food, from raw materials to processed food, from the producer to the user or consumer, including processor, assembler or other intermediary; (n) “non-intentionally added substances (NIAS)” means non-intentionally added substances (NIAS) are chemicals that are present in a food contact material (FCM) or food contact article (FCA) but have not been added for a technical reason during the production process; (o) “aseptic packaging”meansprocess where a sterilized product is filled into a sterilized container and sealed in a sterile environment to prevent contamination.” RAJIT PUNHANI, Chief Executive Officer [ADVT.-III/4/Exty./722/2025-26] Note. - The principal regulations were published in the Gazette of India, Extraordinary, Part III, Section 4 vide notification number File No. 1-95/Stds/Packaging/SP(L&C/A)/FSSAI-2017, dated the 24th December, 2018 and last amended vide notification number F.No. STD/SP-20/T(Recycledplastics-N) dated the 28th March, 2025.
