L.-33004/99 vlk/kj.k EXTRAORDINARY Hkkx III—[k.M 4 PART III—Section 4 izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 04] ubZ fnYyh] eaxyokj] tuojh 5] 2016@ikS"k 15] 1937 No. 04] NEW DELHI, TUESDAY, JANUARY 5, 2016/ PAUSA 15 , 1937 ऊऊऊऊजजजजाााा (cid:4)(cid:4) (cid:4)(cid:4)दददद(cid:7)(cid:7)(cid:7)(cid:7)तततताााा (cid:9)(cid:9)(cid:9)(cid:9)यय यय ूूररूूररोोोो अअअअििििधधधधससससचचूूचचूू ननननाााा नई (cid:4)द(cid:6) ली, 4 जनवरी, 2016 ससससंं..ं.ं. बबबबीीीीईईईईईईईई ////एएएएसससस एएएए(cid:14)(cid:14)(cid:14)(cid:14)डड डड एएएएलललल////ववववॉॉॉॉटटटटरररर हहहहीीीीटटटटरररर////3333 - कितपय िविनयम(cid:16) का िन(cid:18) निलिखत (cid:20)ा(cid:21)प, िज(cid:23) ह(cid:25) (cid:26) यूरो के(cid:23) द सरकार के पूव अनुमोदन से ऊजा संर%ण अिधिनयम, 2001 (2001 का 52) क( धारा 58 क( उपधारा (2) के ख* ड (i) के साथ प-ठत धारा 14 के ख* ड (घ) और धारा 13 क( उपधारा (2) के ख*ड (ढ) /ारा (cid:20)द0 शि2य(cid:16) का (cid:20)योग करते 4ए बनाने का (cid:20)7 ताव करता ह,ै उ8 त अिधिनयम क( धारा 58 क( उपधारा (1) /ारा यथा: अपेि%त उन सभी :य ि2य(cid:16) क( जानकारी के िलए (cid:20)कािशत (cid:4)कया जाता ह;ै िजनके उससे (cid:20)भािवत होने क( संभावना ह ै और वह सूचना दी जाती ह ै (cid:4)क उ8 त (cid:20)(cid:21)प िविनयम(cid:16) पर उस तारीख से िजसको उस राजप> क( (cid:20)ितया,ं िजससे यह अिधसूचना (cid:20)कािशत क( जाती ह,ै जनता को उपल(cid:26) ध करा दी जाती ह,ै पैतालीस (cid:4)दन क( अविध क( समाि? के प@ चात् िवचार (cid:4)कया जाएगा; आ%ेप या सुझाव, य(cid:4)द कोई हो, महािनदशे क, ऊजा द%ता (cid:26) यरू ो, िवBुत मं>ालय, चौथा तल, सेवा भवन, रामकृष् ण पुरम, सैक्ट र-1, नई (cid:4)दलल ् ी-110066 को संबोिधत (cid:4)कए जा सक(cid:25)गे। ऐसे (cid:4)कसी आ%ेप या सुझाव पर, जो (cid:4)कसी : यि2 से उ8 त िविनयम(cid:16) के (cid:20)(cid:21)प क( बाबत उपयु 8 त अविध के अवसान से पूव (cid:20)ाG त हो, (cid:26)य ूरो /ारा िवचार (cid:4)कया जाएगा। ििििववववििििननननययययमममम(cid:20)(cid:20)(cid:20)(cid:20) ककककाााा (cid:22)(cid:22)(cid:22)(cid:22)ाााा(cid:23)(cid:23)(cid:23)(cid:23)पपपप 1111.... ललललघघघघु ु ु ु शशशशीीीीषषषष(cid:4)क(cid:4)क(cid:4)क(cid:4)क औऔऔऔरररर आआआआररररंंंंभभभभ:::: ----(1) इन िविनयम(cid:16) को ऊजा द%ता (cid:26) यूरो (पानी के हीटर के लेबल(cid:16) पर उनके सं(cid:20)दश न क( िविशिJयां और रीित), िविनयम, 2016 कहा ह।ै (2) ये राजप> म(cid:25) उनके अंितम (cid:20)काशन क( तारीख को (cid:20)वृत् त ह(cid:16)गे। 2222. पपपप$$$$ररररभभभभााााषषषषाााा ---- (1) इन िविनयम(cid:16) म(cid:25), जब तक संदभ म(cid:25) अ(cid:23) यथा अपेि%त न हो,- (क) ''अिधिनयम” से ऊजा संर%ण अिधिनयम, 2001 अिभ(cid:20)ेत ह;ै 49 GI/2016 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (ख) “(cid:20)(cid:21)प” से इन िविनयम(cid:16) के साथ प-रिशJ (cid:20)(cid:21)प अिभ(cid:20)ेत है; (ग) “लेबल” से पानी के हीटर पर िचपकाया गया अथवा (cid:20)दLशत िलिखत, मु(cid:4)Mत, िचिNनत, मुहर लगी या Oा(cid:4)फक सामOी अिभ(cid:20)ेत है; (घ) “लेबल अविध” से अिधिनयम क( धारा 14 के खण् ड (क) के अधीन क(cid:25)Mीय सरकार /ारा िविनQदष् ट ऊजा हािन मानक के अधीन 7थायी हािन क( िविधमा(cid:23)य ता अविध से ह ै और य(cid:4)द 7थायी हािन क( िविधमा(cid:23) यता क( अविध क( अंितम अविध िविनQदSट नहT क( गई ह,ै इस अविध को के(cid:23) Mीय सरकार /ारा िविनQदष् ट नए मू(cid:6) य(cid:16) तक िविधमा(cid:23) य मानी जाएगी; (ङ) “मॉडल अथवा मॉडल(cid:16) के प-रवार” से (cid:4)कसी िविशS ट Vाण् ड का मॉडल या मॉडल(cid:16) क( Wेणी ह ैिजसके संबंध म(cid:25) परी%ण -रपोटX का एकल समुYच य लागू ह ैऔर जहां (cid:20)Z यके मॉडल के समान भौितक ल%ण, 7थायी हािन, ऊजा कुशलता 7 तर और िनS पादन िविशJताएं समान अिभ(cid:20)ेत ह[; (च) “अनु\ाधारक” से ऐसे :य ि2 या ऐसी अिभकरण से ह ै िजसे िविनयम 7 के अधीन लेबल िचपकाने के िलए अनु\ा दी गई अिभ(cid:20)ेत है; (छ) “7ट ार रे]टग अथवा 7 टार 7त र” से अिभ(cid:20)ेत है जो पानी के हीटर क( 7थायी हािन को दशा ने के िलए अिधिनयम क( धारा 14 के खणड ् (क) के अधीन क(cid:25)Mीय सरकार /ारा अिधसूिचत िवBुत भंडार पानी के हीटर(cid:16) के लेबल पर (cid:20)दLशत 7 थायी हािन ((cid:4)क. वॉ. घं. / 24 घंटे / 45 िडOी से.) के Oेड से ह;ै (ज) लेबल लगे पानी के हीटर के संबंध म(cid:25) “: यापारी अथवा िव^ेता” से उस : यि2 से अिभ(cid:20)ेत ह ै जो ऐसे पानी के हीटर क( िब^( अथवा िवतरण करता ह ै और इसम(cid:25) ऐसे दकु ानदार, : यापारी, िविनमा ता और पानी के हीटर पर लेबल िचपकाने के िलए अनुमित (cid:20)ाप् त अनु\ाधारक सि(cid:18)मिलत ह।[ (झ) “पानी के हीटर” से अिभ(cid:20)ेत ह ैजो अिधिनयम क( धारा 14 के ख* ड (ख) के अधीन अिधसूचना म(cid:25) यथािविनQदS ट सािध> ह;ै (2) यहां इसम(cid:25) (cid:20)युक् त जो श(cid:26)द और अिभ: यि2या ं अप-रभािषत ह [ (cid:4)क(cid:23)तु अिधिनयम म(cid:25) प-रभािषत ह,[ उनका अिधिनयम म(cid:25) उ(cid:23)ह (cid:25)^मश: (cid:4)दया गया अथ ही होगा। 3333.... ललललेबेबेबेबलललल पपपपरररर (cid:22)(cid:22)(cid:22)(cid:22)दददद%%%%शशशशतततत &&&&ककककएएएए जजजजाााानननन ेे ेे ववववााााललललीीीी ििििववववििििशशशशिििि’’’’ययययाााा।।ंं।।ंं (1) (cid:20)Z यके पानी के हीटर पर, इसके लेबल पर िन(cid:18) निलिखत िविशिJयां (cid:20)दLशत क( जाएगी, अथा त्:- (क) ऊजा द%ता (cid:26)य ूरो का (cid:20)तीक िचNन; (ख) उपकरण; (ग) Vांड का नाम; (घ) िविनमा ण अथवा आयात का मॉडल का नाम / सं_ या / वष ; (ङ) रेटेड %मता (लीटर); (च) रेटेड इनपुट पावर ((cid:4)क. वॉ.) (वा7त िवक जांच) (छ) 7थ ायी हािन ((cid:4)क. वॉ. घं. / 24 घंटे / 45 िडOी से.) ; (ज) लेबल क( अविध; (झ) 7ट ार 7त र; और (ञ) िवशेष Wृंखला कोड;¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3 (2) लेबल का िडजाइन, रंग, आकार और अंतLवJ इन िविनयम(cid:16) के साथ उपांबध अनुसूची म(cid:25) यथा िविनQदष् ट होगा। 4444.... ललललेबेबेबेबलललल(cid:20)(cid:20)(cid:20)(cid:20) ककककेेेे सससस(cid:22)(cid:22)ंं(cid:22)(cid:22)ंं ददददशशशशनन(cid:4)(cid:4)नन(cid:4)(cid:4) ककककेेेे ििििललललएएएए ससससममममयययय----ससससीीीीममममाााा:::: (1) िविनयम 3 म(cid:25) िविनQदS ट सभी िविशिJय(cid:16) वाला लेबल इन िविनयमन(cid:16) के लागू होने क( तारीख से छह मास क( अविध के भीतर (cid:20)Zय ेक पानी के हीटर पर (cid:20)दLशत (cid:4)कया जाएगा। (2) अिधिनयम क( धारा 14 के खणड ् (क) के अधीन लागू संशोिधत ऊजा हािन मानक(cid:16) के (cid:20)ारंभ होने पर और (cid:20)ारंभ होने से, (cid:20)त् य ेक अनु\ाधारक या वय ् ापारी या िव^ेता सिु नि‘त करेगा (cid:4)क- – क) बाजार म(cid:25) स्टार स्तर को (cid:20)दLशत करन े वाले पूव -संशोिधत लेबल वाले पानी के हीटर का उपलब्ध भंडार पूरी तरह समाप्त हो गया ह ैअथवा इस पर पुन :संशोिधत लेबल लगाए गए ह [अथवा उस तारीख से पहले बाजार से वापस ले िलया गया ह ैिजस तारीख को संशोिधत स्टार स्तर लागू 4आ ह;ै ख) िब^( के िलए रखे गए पानी के हीटर संशोिधत ऊजा हािन मानक(cid:16) के साथ सम^मण कर संशोिधत 7 टार 7 तर और संशोिधत लेबल अविध भी (cid:20)दLशत कर(cid:25)ग ेऔर ऐसे (cid:20)ारंभ से तीन मास पूव संशोिधत लेबल शु(cid:21) (cid:4)कए जाएं। ग) aौहारी, खुदरा :य ापा-रय(cid:16) को जानकारी देने के िलए उनक( जाग(cid:21)कता के साथ ही उपभो8 ताc को िशि%त करने के िलए अपेि%त (cid:20)चार-(cid:20)सार सिहत सभी (cid:20)ारंिभक उपाय इन िविनयम(cid:16) के अधीन ऐसे (cid:20)ारंभ क( तारीख से छह माह पूव िनयोिजत (cid:4)कए जाएंगे। (3) जहां अनु\ाधारक उप िविनयम (2) के खंड (क) म(cid:25) िनQदS ट उपबधं (cid:16) का पालन सुिनि‘त करने के िलए, अपने िनयं>ण से परे बाजार क( पि7थितय(cid:16) के अनुसार, और जहां यह िव@ वास करने के पया G त आधार ह[ (cid:4)क उपभो8 ता के िलए उप िविनयम (2) के खंड (क) और (ख) म(cid:25) िनQदJ िबजली वाले पानी के हीटर के बीच होने वाली 7 थायी हािन के आधार पर िवक(cid:6) प चुनना क-ठन होगा, अनु\ाधारक ऊजा द%ता (cid:26)य ूरो के पूव अनुमोदन सिहत सुसंगत अनुसूची म(cid:25) (cid:4)दखाई गई िडजाइन के अनुसार हरे रंग म(cid:25) लेबल पर िविनयम 3 के उप िविनयम (1) खंड (छ) म (cid:25) िनQदJ 7 थायी हािन (cid:20)दLशत करेगा ता(cid:4)क उप िविनयम (2) के खंड (क) और (ख) म(cid:25) संदLभत लेखन सामOी भ*डारण (cid:20)कार इलेि8dक वॉटर हीटर के बीच सुिभe (cid:4)कया जा सके। 5. ललललेबेबेबेबलललल (cid:22)(cid:22)(cid:22)(cid:22)दददद%%%%शशशशतततत ककककररररनननन ेे ेेकककक++++ रीित ----(1) इकाई के सामने वाले स(cid:18)(cid:20)दश पर लेबल लगाया जाएगा और यह िविनयम 3 के उपिविनयम (2) म(cid:25) सरलता से (cid:4)दखाई दने ा चािहए और अनु\ाधारक सुिनि‘त करेगा (cid:4)क (cid:20)Z येक रिज7dीकृत इकाई या मॉडल पर पहचान के (cid:20)योजन के िलए स(cid:18)(cid:20)दश म(cid:25) लेबल िब^( या (cid:4)कराए के fबद ुपर (cid:4)दखाई दते ा ह ैऔर यह लेबल इकाई या मॉडल सिहत केfसग के बाहर मु(cid:4)Mत या िचपकाया गया होगा। (2) (cid:20)दLशत नहT क( गई इकाइय(cid:16) के िलए लेबल इकाई या मॉडल सिहत केfसग के बाहर मु(cid:4)Mत या िचपकाया जाए और यह लेबल इकाई या मॉडल पर लगाया जाए, जब इकाई या मॉडल को इसक( पैgकग से बाहर िनकाला जाता ह ै या लेबल को Oाहक या (cid:20)यो8त ा को (cid:4)दए जाने वाले द7त ावेज के भाग के (cid:21)प म(cid:25) सि(cid:18)मिलत (cid:4)कया जाए। 6. ललललेबेबेबेबलललल सससस(cid:22)(cid:22)ंं(cid:22)(cid:22)ंं दददद%%%%शशशशतततत ककककररररनननने े े े कककक++++ अअअअनननन--ुु--ुु ाााा-(1) बय ् ूरो क( पूव अनु\ा के िबना इलेि8dक पानी के हीटर पर कोई स् टार नहT िचपकाया जाएगा। (2) उप- िविनयम (1) के अधीन (cid:26)य ूरो क( अनु\ा लेने के (cid:20)योजन के िलए, आवेदन (cid:20)(cid:21)प - I म(cid:25) और इले8 dॉिनक (cid:20)(cid:21)प म(cid:25) (cid:4)कया जाएगा: परंतु पानी के हीटर के (cid:20)Zय ेक मॉडल के प-रवार के िलए पृथक आवेदन (cid:4)कया जाए; (3) उप- िविनयम (2) के अधीन (cid:20)तय ् ेक आवेदन- प> के साथ िनम् निलिखत संलग् न ह(cid:16)गे – (क) ऊजा द%ता बय ् ूरो, नई (cid:4)दल् ली के प% म(cid:25) दो हजार hपए का आवेदन फ(स अथवा भुगतान के (cid:4)कसी (cid:20)ितOाहय इलेक् dॉिनक ढंग म(cid:25) दये होगा; (ख) ऊजा द%ता बय ् ूरो, नई (cid:4)दल् ली के प% म(cid:25) दये एक लाख hपए क( लेबल जमानत रािश; मांग प> या भुगतान के (cid:4)कसी (cid:20)ितOाहय इलेक् dॉिनक ढंग म(cid:25): परंतु, लघु उBोग के मामले म(cid:25), जमानत रािश केवल पच् चीस हजार hपए होगी-; और4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (ग) यथा: िविनQदSट दसत ् ावेज; 7. अअअअनननन--ुु--ुु ाााा (cid:22)(cid:22)(cid:22)(cid:22)ददददाााानननन ककककररररननननाााा---- (1) िविनयम 6 के अधीन कोई आवेदन (cid:20)ाG त होने पर और इससे संतुS ट होने पर (cid:4)क इसम(cid:25) दी गई सभी अपे%ाc का पालन (cid:4)कया गया ह,ै (cid:26)य ूरो ऐसी (cid:20)ाि? क( तारीख से एक मास क( अविध के भीतर, िविनयम 8 म(cid:25) यथा: िविनQदS ट िनबंधन(cid:16) एवं शतX के अiय धीन सीधे ठंड े(cid:20)शीतक पर (cid:20)(cid:21)प-2 अथवा इले8 dॉिनक (cid:20)(cid:21)प म(cid:25) लेबल िचपकाने के िलए अनु\ा (cid:20)दान कर सकता ह।ै (2) (cid:26)य ूरो, (cid:20)(cid:21)प -3 म(cid:25) रिज7ट र बनाकर रखेगा और इसम(cid:25) अनु\ाधारक के नाम (cid:20)िवS ट करेगा; (3) (cid:26)य ूरो /ारा (cid:20)(cid:21)प -3 म(cid:25) एक डेटा बेस का अनुर%ण (cid:4)कया जाएगा और अपेि%त (cid:26)यौरे भी डाले जाएंगे। (4) उप- िविनयम (1) के अधीन इस (cid:20)कार (cid:20)द0 अनु\ा उस अविध तक िविधमा(cid:23) य होगी जो के(cid:23) Mीय सरकार /ारा धारा 14 के ख*ड (क) के अधीन यथा: अिधसूिचत ऊजा हािन मानक /ारा 7 टार 7 तर के िलए िविनQदष् ट क( गई है; (5) अनु\ाधारक /ारा अनु\ा के नवीकरण के िलए आवेदन छह मास के भीतर gकतु इस अविध क( समाि? Short title and commencement.—(1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Stationary Storage Type Electric Water Heater) Regulations, 2016. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. Definition. — (1) In these regulations, unless the context otherwise requires,- (a) “Act” means the Energy Conservation Act, 2001 (52 of 2001); (b) “Form” means a form appended to these regulations; (c) “label” means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon, Water Heater; (d) “label period” means the validity period of the standing loss under energy consumption standard specified by the Central Government under clause (a) of section 14 of the Act and in case the end period of the validity period of the standing loss is not specified, it shall be deemed to be valid until new values for the same are specified by the Central Government; (e) “models or family of models” means the model or range of models of one particular brand, to which a single set of test reports is applicable and where each of the models has the same physical characteristics, standing loss value, energy efficiency rating and performance characteristics; (f) “permitee” means a person or agency to whom permission has been granted to affix label under regulation 7;¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 23 (g) “Star rating or star level” means the grade of standing loss (KWH/24Hr/450C) displayed on the label of the electric storage water heaters notified under clause (a) of section 14 of the Act to denote the energy performance of water heater. (h) “trader or seller” in relation to any labeled water heater means a person who sells or distributes any such water heater and includes trader, manufacturer and permittee given permission to affix label on such water heater. (i) “water heater” means an appliance as specified in the notification under clause (b) of section 14 of the Act; (2) Words and expressions used herein and not defined, but defined in the Act, shall have the same meanings respectively as assigned to them in the Act. 3. Particulars to be displayed on the label. — (1) On every water heater the following particulars shall be displayed on its label, namely:- (a) the Logo of Bureau of Energy Efficiency; (b) equipment; (c) brand name; (d) model Name/number/year of manufacturing or import; (e) rated capacity (Litre); (f) rated input power (kW) (Actual Tested); (g) standing loss (kWh/24 hr/450C); (h) label period; (i) star level; and (j) unique series code. (2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations. 4. Time limit for display of labels.— (1) A label containing all the particulars specified in regulation 3 shall be displayed on every water heater within a period of six months from the date of coming into force of these regulations. (2) On and from commencement of the energy performance standards under clause (a) of section 14 of the Act, every permittee shall ensure that- (a) the stock of water heater available in the market with pre-revised label displaying the star level is fully exhausted or re-labeled or withdrawn from the market before the date of commencement; (b) the water heater put on sale shall also display revised star level and revised label period synchronizing with the higher energy consumption standards and introduce revised label period three months prior to such commencement; (c) all the preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers shall be well planned and taken six months in advance of the date of commencement under this regulations. (3) Where the permittee fails to ensure compliance of the provisions specified in clause (a) of sub-regulation (2), on account of market conditions beyond his control, and there are reasonable grounds to believe that the consumer would find it difficult to make a considered choice on the basis of standing loss between the electric water heater referred in clauses (a) and (b) of sub-regulation (2), the permittee, with the previous approval of the Bureau of Energy Efficiency shall display standing loss, referred to in clause (k) of sub-regulation (1) of regulation 3 on the label in green colour as per design shown in the relevant Schedule to make a distinction between the stationary storage type electric water heaters referred to in clauses (a) and (b) of sub-regulation (2). 5. Manner of display of label.—(1) The label shall be affixed at the front display of the unit and should be easily visible as referred in sub-regulation (2) of regulation 3 and the permittee shall ensure that the label appears on every registered unit or model on display for identification purpose, at point of sale or hire and the label shall also be printed or pasted to the exterior to the casing containing the unit or model. (2) For units not on display, the label may be printed or pasted to the exterior to the casing and this label may be attached to the unit or model when the unit or model is removed from its packaging or the label may be included as a part of the documentation given to the customer or user. 6. Permission for display of label.—(1) No star label shall be affixed on an electric water heater without obtaining the prior permission of the Bureau.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (2) For the purpose of obtaining permission of the Bureau under sub-regulation (1) an application shall be made in Form-I and in electronic form: Provided that separate application shall be made for each family of models of electric water heater. (3) Every application under sub-regulation (2) shall be accompanied by – (a) an application fee of rupees two thousand shall be payable by demand draft in favor of Bureau of Energy Efficiency, New Delhi or by any acceptable electronic mode of payment; (b) a label Security fee of one lakh rupees payable by demand draft in favor of the Bureau of Energy Efficiency, New Delhi; or by any acceptable electronic mode of payment: Provided that in case of small scale industry label security fee will be only twenty -five thousand rupees; and (c) documents specified therein. 7. Grant of permission.—(1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period of one month from the date of such receipt, grant, subject to terms and conditions as are specified in regulation 8, permission for affixing label on water heater in Form II or in electronic form. (2) The Bureau shall maintain a register in Form III and enter the name of permittee therein. (3) The Bureau shall also maintain a database in Form-III and enter the required details. (4) The permission so granted under sub-regulation (1) shall be valid for such period till which the Star level specified by the energy consumption standard as notified by the Central Government under clause (a) of section 14 from time to time. (5) An application for renewal of permission shall be made by the permittee from six months but not later than three months before its expiry of permission and such application shall be accompanied by a fee of one thousand rupees payable in the form of demand draft or electronic mode in favor of the Bureau of Energy Efficiency, New Delhi. (6) No application shall be renewed after expiry of validity period, in which case the permittee shall apply afresh for application. (7) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, shall renew permission in Form II. (8) The permittee who seeks permission for continuance to affix label on the existing model of the electric water heater from the date from which the revised star level comes into force shall submit only a declaration as per Form IV. (9) The permittee shall seek permission to affix label afresh, if new model of the electric water heater is planned to be launched to synchronise with the revised star level and application for such permission may be made six months in advance of coming into force of the revised star level. 8. Terms and conditions for display of particulars on label. —Every permittee, trader and seller shall comply with the following terms and conditions in displaying the particulars on label, namely:- (a) the star level displayed on the label of water heater shall conform to energy consumption standards for water heater notified by the Central Government under clause (a) of section 14 of the Act ; (b) the label shall be affixed only on such model of water heater for which permission has been granted; (c) the label shall be printed and affixed on the water heater at the cost of the permittee; (d) the permittee, trader and seller shall ensure that the star level displayed on the label of water heater shall be maintained at all time; (e) the permittee shall pay the label fee as specified in regulation 9; (f) the permittee shall furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labeling fee due for each quarter within the following month of the close of each quarter of the financial year; (g) the permittee shall furnish to the Bureau an updated list of authorized distributors, dealers, retailers, sellers appointed to sell their labeled products on or before the 30th day of April of every year; (h) the permittee, trader and seller shall comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau’s Manual on Standard and Labeling.¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 25 9. Label fee.—(1) Every permittee shall pay to the Bureau a label fee of two rupees on each label affixed on the electric water heater. (2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of closure of each financial year: Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten per cent. per annum from the label security deposit made under clause (b) of sub-regulation (3) of regulation 6, and if complete labeling fees are not recovered within one year of the last date of submission, Bureau may cancel all labels granted to the Permittee and publish the name of the permittee in the newspapers as a defaulter. 10. Refund of Label Security deposit.- Subject to the provisions of sub-regulation (2) of regulation 9, a permittee shall be entitled to a refund of the Label Security Fee, on ceasing to manufacture of that particular model of electric water heater. 11. Verification by the Bureau.- (1) The Bureau of Energy Efficiency or its designated agency may, either suo motu, or on a complaint received by it, carry out verification to ensure that the water heater conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission (2) For the purpose of verification, Bureau or its designated agency shall carry out randomized procurement of samples, from the manufacturing facility, warehouse or the retail outlet as it deems fit. (3) Where upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification, by challenge testing the water heater in an independent laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories (NABL), a notice shall be issued to the permittee for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to testing, transportation and other incidental expenses with the Bureau, within such time, as may be determined by Bureau; and if sample drawn under challenge testing fails, all expenses towards the cost of sample, transportation of sample and the testing charges, shall be reimbursed by the permittee to the Bureau and Bureau shall refund expenses to the complainant, the user of the label to the complainant; and where the sample passes the challenge test, then, the expenses deposited by the complainant shall stand forfeited. (4) Where samples of water heater used for testing fails the test during suo motu testing or challenge testing, the permittee shall be afforded another opportunity and the Bureau shall conduct a second test with twice the quantity of water heater used in the first test in an independent test laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories (NABL) at the cost of the permittee. (5)Where the second test fails, the Bureau shall,- (a) direct the permittee in Form V, under intimation to all the State Designated Agencies, that the permittee shall within a period of two months from the date of issuance of Form V,- (i) correct the star level displayed on the label of the electric water heater or remove the defects and deficiencies of the failed model, found during the verification conducted as per regulation 11; (ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and (iii) change the particulars displayed on advertising material; (b) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specifications in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit within two months from the date of receipt of test results from Bureau’s designated agency (c) intimate to the concerned State Designated Agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act. (6) The permittee shall within ten days of the conclusion of the period of two months referred to in sub-regulation (5),- (a) send the compliance report as per Form VI to the Bureau with respect to action taken in compliance with the direction; and (b) where the compliance report referred to in clause (a) is not received or received without complying to any of the direction within aforesaid specified period, it shall be deemed as non-compliance of the direction issued and necessary orders to that effect shall be passed by the Bureau. (7) The Bureau shall send a copy of the compliance report referred to in clause (a) and orders passed in clause (b) of sub- regulation (6) of regulation 11 to all the State Designated Agencies for the purpose of taking action under section 17 of Act and enforcement of the order passed under clause (b) of the said sub regulation. (8) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (5), the Bureau under intimation to all State Designated Agencies, shall,- (a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, the directions of the Bureau referred to in clause (a) of sub-regulation (5) of regulation 11 for consideration and taking action under clause (c) of section 14 of the Act by the Central Government; (c) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as deemed fit by the Bureau within two months of sending report to the central government as mentioned in clause (b); (d) intimate the concerned State Designated Agencies to initiate further legal proceedings against the permittee and the trader under section 27 of the Act. 12. Cancellation of permission.—The Bureau may cancel the permission granted under regulation 7, if the permittee – (a) fails to comply with any of the terms and conditions specified under regulation 8; (b) fails to pay label fee in accordance with production data, within the period specified under regulation 9; (c) fails to comply with the direction issued under regulation 11. Now, therefore in exercise of the power conferred clause (a) of sub-regulation (4) of Regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of display of Label on Stationary Storage Type Electric Water Heater) Regulations, 2016, the Bureau hereby directs to :- (i) correct the star level displayed on the label of the Electric Water Heater or remove the defects and deficiencies found during testing; (ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and (iii) change the particulars displayed on advertising material.36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] 8.
