jkt/kkuh {ks= fnYyh ljdkj ds vkns'k ls rFkk muds uke ij] vkj- lh- dsljokuh] lgk;d funs'kd ¼ty½ URBAN DEVELOPMENT DEPARTMENT NOTIFICATION New Delhi, the 21st July, 2016 No. 16(524)/UD/W/2015/1225-26.— The following regulations made by the Delhi Water Board which in exercise of power conferred by clause (m) of sub-section (2) of section 109 read with sections 7 and 51 of the Delhi Water Board Act, 1998 (Delhi Act No. 4 of 1998) and in supersession of the Delhi Administration Notification No. F 16(349)/UD/W/2002/8093 dated the 10th September 2004 except as respects things done or omitted to be done before such supersession after approval of Competent Authority and Union Public Service Commission, for regulating the method of recruitment to the post of Junior Law Officer/Legal Superintendent in Delhi Water Board, are hereby published, namely:- 1. Short title and commencement – (I) These regulations may be called Delhi Jal Board Junior Law Officer/Legal Superintendent Recruitment Regulations, 2016. (II) They shall come into force on the date of their publication in the Delhi Gazette. 2. Number of posts, its Classification and pay band and grade pay/scale of pay - The number of posts, its classification and pay band and grade pay/scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these regulations. 3. Method of recruitment, age limit and other qualifications - The method of recruitment, to the said posts, age limit, qualifications and other matters connected therewith shall be as specified in columns 5 to 13 of the said Schedule. 4. Disqualification - No person,- (a) Who has entered into or contracted a marriage with a person having a spouse living; or (b) Who having a spouse living, has entered into or contracted marriage with any person, shall be eligible for appointment to any of the said posts: Provided that Delhi Water Board, may, if satisfied that such a marriage is permissible under the personal law applicable to such persons and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of these regulations. 5. Power to relax - Where the Government of National Capital Territory of Delhi is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to bePART IV] DELHI GAZETTE : EXTRAORDINARY 5 recorded in writing, and in consultation with Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons. 6. Saving - Nothing in these regulations shall affect reservations and other concessions required to be provided for the Scheduled Castes, Scheduled Tribes, Ex-servicemen, other backward classes and other special categories of persons in accordance with orders issued by the Government of India from time to time in this regard. Note: 2 For the purpose of computing minimum qualifying service for promotion, The Service rendered on a regular basis by an officer prior to 1st January, 2006 the date from which the revised pay structure based on the 6th CPC recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the pay commission. Deputation (Including Short Term Contract): Officers of the Central/State Government/U.TS/ Universities/Recognized Research Institutions/PSUs/Semi-Government OR Statutory OR /Autonomous Organizations:- (a) (i) Holding analogous posts on regular basis in the parent cadre/department; OR (ii) with six years service in the grade rendered after appointment thereto on regular basis in pay band-1 Rs. 5200-20200/- with grade pay of Rs. 2800/- or equivalent in the parent cadre/department; AND (B) Possessing the following educational qualifications and experience:- (i) Bachelor’s degree from a recognized university/institute; AND (ii) Bachelor’s degree in law from a recognized university/institute; AND (iii) Three year’s experience as legal practitioner or three years’ experience in legal work. OR (i) Five years’ integrated degree in law from a recognized university/institute; AND (ii) four years’ experience as legal practitioner or four years’ experience in legal work. Note 1: The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation similarly, deputationists shall not be eligible for consideration for appointment by promotion. Note 2: Period of deputation (ISTC) including period ofPART IV] DELHI GAZETTE : EXTRAORDINARY 7 deputation (ISTC) in another ex-cadre post held immediately preceding this appointment in the same or some other organization/department of the Central Government shall ordinarily not to exceed three years. The maximum age limit for appointment by deputations (ISTC) shall not be exceeding 56 years as on the closing date of receipt of applications) Note 3: For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 1st January, 2006 The date from which the revised pay structure based on the 6th CPC recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the pay commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay/pay scale, and where this benefit will extend only for the post (s) for which that grade pay/pay scale is the normal replacement grade without any upgradation.
