## Report on the High Court and Supreme Court Judges Salaries and Conditions of Service Amendment Act, 2021
**1. Executive Summary:**
This report analyzes the High Court and Supreme Court Judges Salaries and Conditions of Service Amendment Act, 2021 (No. 44 of 2021) based on the official gazette notification. The amendment clarifies the entitlement for additional quantum of pension or family pension for High Court and Supreme Court judges and family pensioners. Specifically, it establishes that the entitlement begins from the first day of the month in which the pensioner or family pensioner completes the age specified in the relevant pension scale. This report details the key provisions of this amendment, its rationale, target audience, and expected impact.
**2. Introduction:**
This report provides an overview of the High Court and Supreme Court Judges Salaries and Conditions of Service Amendment Act, 2021, as published in the Gazette of India. The analysis is based solely on the provided text of the amendment. The purpose of this report is to inform affected parties of the changes introduced by this amendment.
**3. Policy Overview:**
* **Original Policy:** The amendment modifies the High Court Judges Salaries and Conditions of Service Act, 1954 and the Supreme Court Judges Salaries and Conditions of Service Act, 1958.
* **Core Objective:** The primary objective of the amendment, as inferred from the text, is to clarify the commencement date for entitlement to additional pension benefits for judges and their families.
**4. Background and Rationale:**
This amendment appears designed to remove ambiguity regarding the specific date when additional pension or family pension benefits become effective. The inclusion of the "Explanation" suggests that there was prior uncertainty or differing interpretations concerning this commencement date. The amendment aims to provide a definitive and consistent rule for calculating these benefits.
**5. Key Provisions / Changes:**
This amendment introduces clarifying explanations to two existing Acts:
* **High Court Judges Salaries and Conditions of Service Act, 1954:** A new Explanation is inserted into Section 17B, clarifying that any entitlement for additional quantum of pension or family pension shall be, and shall be deemed always to have been, from the first day of the month in which the pensioner or family pensioner completes the age specified in the first column of the scale.
* **Supreme Court Judges Salaries and Conditions of Service Act, 1958:** A new Explanation is inserted into Section 16B, mirroring the clarification made to the High Court Act. It states that any entitlement for additional quantum of pension or family pension shall be, and shall be deemed always to have been, from the first day of the month in which the pensioner or family pensioner completes the age specified in the first column of the scale.
The *effect* of this change is to standardize and explicitly define the date of entitlement for additional pension benefits. It ensures that the benefit starts from the first day of the month the age threshold is met, rather than potentially being prorated from the exact date within the month or being delayed until the following month.
**6. Target Audience and Stakeholders:**
The direct target audience and stakeholders for this amendment are:
* High Court Judges and their families/pensioners.
* Supreme Court Judges and their families/pensioners.
* Government agencies responsible for administering and disbursing judicial pensions.
* Legal professionals specializing in pension law.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency:** The specific department responsible for implementation is not explicitly stated. However, it can be inferred that the Ministry of Law and Justice, specifically the Legislative Department, is responsible for enacting and publishing the amendment. The actual administration of the pension payments would likely fall under the purview of the relevant judicial administrative bodies or government financial departments.
* **Timelines/Procedures:** The amendment states that the clarification "shall be deemed always to have been" in effect. This suggests retroactive application, meaning that past and future pension calculations should adhere to the clarified commencement date. Specific procedures for recalculating past payments, if necessary, are not detailed in the provided text.
* **Amendment Specific Implementation:** The implementation will require pension calculation systems and processes to be updated to reflect the clarification that entitlement starts from the first day of the month in which the age is completed.
**8. Expected Outcomes / Impact of Changes:**
The intended outcome of these amendments is to:
* **Reduce ambiguity:** Provide a clear and unambiguous rule for determining the commencement date of additional pension benefits.
* **Ensure consistent application:** Promote uniform application of pension rules across all High Court and Supreme Court judges and their families.
* **Minimize disputes:** Reduce the potential for disputes or litigation related to pension commencement dates.
* **Retroactive Clarity:** Clarify the date retroactively, impacting both current and future pensioners.
**9. Conclusion:**
The High Court and Supreme Court Judges Salaries and Conditions of Service Amendment Act, 2021, offers a clarifying change to the High Court Judges Salaries and Conditions of Service Act, 1954 and the Supreme Court Judges Salaries and Conditions of Service Act, 1958 relating to the commencement date for additional pension benefits. This amendment is significant because it removes potential ambiguity and promotes consistency in the application of pension rules, thereby benefiting judges, their families, and the agencies responsible for administering these benefits.
