## Report on Amendment to Jute and Jute Textiles Control Order, 2016 **1. Executive Summary:** This report analyzes an amendment to the Jute and Jute Textiles Control Order, 2016, as indicated by the document dated April 7, 2022. The amendment focuses on modifying existing orders related to raw jute stock limits held by various categories of traders, dealers, agencies, stokists and Mills. The core purpose is to manage the quantity of raw jute held by different entities, aiming to regulate supply and potentially stabilize prices. Key findings include revised stock limits for different categories and enforcement measures for non-compliance. **2. Introduction:** This report aims to provide a comprehensive overview of an amendment to the Jute and Jute Textiles Control Order, 2016, based solely on the information provided in the given policy text, dated April 7, 2022. The report outlines the amendment's objectives, key changes, affected stakeholders, and potential implications. **3. Policy Overview:** * This document represents an amendment to the Jute and Jute Textiles Control Order, 2016. * **Core Objective(s):** The core objective, as inferred from the text, is to regulate the holding of raw jute stocks by various market participants. The intention appears to be to manage supply and potentially control prices within the jute market by setting maximum stock limits. **4. Background and Rationale:** * **Reason for Amendment:** The amendment appears to address concerns about excessive raw jute stockpiling by certain traders, dealers, agencies, stokists and mills. By modifying existing orders, the aim seems to be to ensure a more balanced distribution of raw jute and prevent market manipulation or artificial scarcity. The text references "partial modification of the Orders of even number dated 10112021 and 31012022," suggesting a refinement of previous attempts to control stock levels. **5. Key Provisions / Changes:** This section focuses specifically on the changes introduced by the amendment text: * **Specific Parts of Original Policy Changed:** The amendment partially modifies existing orders dated 10.11.2021 and 31.01.2022. The exact clauses of these earlier orders being modified aren't explicitly stated, but they pertain to the "Maximum quantity of raw jute to be held" by different categories of traders. * **New Rules/Provisions:** The amendment introduces the following changes to stock limits: * **Balers:** Balers with a raw jute baling press in the same premises who applied for registration by 31.10.2021 can hold a maximum of 500 Quintals of raw jute. * **Other Traders/Dealers/Agencies/Stockists:** All other traders, dealers, agencies, and stockists of raw jute who applied for registration by 31.10.2021 can hold a maximum of 50 Quintals of raw jute. * **Non-Registered Entities:** Existing stock limits of 500 Kilograms (5 Quintals) will continue to be enforced for those who did not apply for registration as per previous orders (S.O. 4696E dated 10.11.2021 and S.O. 481E dated 31.01.2022). * **Jute Mills:** Existing stock limits notified vide S.O. 4696E dated 10.11.2021 and S.O. 481E dated 31.01.2022 to continue for Jute Mills Manufacturing units of Jute Goods from raw jute. * **Difference/Effect of Changes:** The amendment alters the permissible stock limits for balers and other traders who applied for registration. This aims to reduce the amount of raw jute held by these entities. The deadline of 31.10.2021 for registration appears to be a crucial factor in determining the applicable stock limit. It also reaffirms the continued applicability of existing stock limits for both non-registered entities and jute mills. The amendment requires entities exceeding the revised limits to sell the excess quantity within 10 days and deliver it within 21st April, 2022. **6. Target Audience and Stakeholders:** Based on the provided text, the primary target audience and stakeholders are: * Raw jute traders (Balers, dealers, agencies, stokists) * Jute Mills Manufacturing units of Jute Goods from raw jute * The Jute Corporation of India Ltd. * Entities involved in the commercial stocking and transaction of raw jute. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Jute Commissioner, Ministry of Textiles, is the responsible authority. * **Timelines:** * The order is effective immediately (except for parts already in force). * Entities exceeding the stock limits must sell and deliver the excess jute within 10 days of the order date (April 7, 2022) and ensure physical delivery by April 21, 2022. * A compliance report with supporting documentation must be submitted via email to jcoffice.jutecomm.gov.in immediately after sale and delivery. * The order is valid until June 30, 2022, or until further orders. * **Enforcement:** Authorized representatives and law enforcement agencies are empowered to enter and search premises, inspect stocks and records, and seize jute stored or transacted in violation of the order. Failure to comply can result in imprisonment and/or fines under the Jute and Jute Textiles Control Order, 2016, and the Essential Commodities Act, 1955. **8. Expected Outcomes / Impact of Changes:** The likely intended outcomes of these specific changes introduced by the amendment include: * Reduced raw jute stockpiling by traders and dealers, especially those who have applied for registration * Increased availability of raw jute in the market. * Potentially stabilized raw jute prices. * Improved compliance with stock limit regulations. **9. Conclusion:** The amendment to the Jute and Jute Textiles Control Order, 2016, outlined in the document dated April 7, 2022, focuses on regulating raw jute stock levels held by various market participants. By modifying stock limits and implementing enforcement measures, the government aims to manage supply, potentially stabilize prices, and ensure a more equitable distribution of raw jute within the industry. Compliance with the revised regulations is crucial for all affected stakeholders to avoid penalties.
