परीक्षण और पिु िि के जनपटारे की प्रदक्रया) जनयम, 2010 के अजधक्रमण म,ें जसिाय ऐसे मामलों के िो ऐसे अजधक्रमण स े पहले दकए गए या दकए िाने से छूटे हुए हैं, पिओंु म ें संक्रामक और सांसर्गकग रोगों का जनिारण और जनयंत्रण अजधजनयम, 2009 (2009 का 27) की धारा 42 द्वारा प्रित्त िजियों का प्रयोग करते हुए, एतिद्वारा जनम्नजलजखत प्ररूप जनयमों को,इनके द्वारा प्रभाजित होने िाले व्यजियों की िानकारी के जलए प्रकाजित करने का प्रस्ट्ताि करती ह;ैऔर एतिद्वारा यह नोटटस दिया िाता ह ैदक उि प्ररूप जनयमों पर उस तारीख से तीस दिन की अिजध की अिसान के बाि जिचार दकया िाएगा, जिस तारीख को रािपत्र में प्रकाजित इस अजधसूचना की प्रजतयां िनता को उपलब्ध कराई िाती ह;ैं इन प्ररूप जनयमों पर आक्षपे और सुझाि, यदि कोई हों, भारत सरकार के अपर सजचि, मत्सस्ट्यपालन, पिुपालन और डेयरी मंत्रालय, पिुपालन और डेयरी जिभाग, कृजि भिन, डॉ. रािेंद्र प्रसाि रोड, नई दिल्ली-110001 को या ईमेल jslh-dadf@nic.in पर भेिे िा सकते ह;ैं यदि ऊपर उजल्लजखत तीस दिनों की अिजध की अिसान स े पहल े उि प्ररूप जनयमों के संबंध में दकसी भी व्यजि स े कोई आपजत्त जनयमों का नाम पिओंु म ेंसंक्रामक और सांसर्गगक रोगों का जनिारण और जनयंत्रण जनयम, 2026 ह।ै (2) ि ेरािपत्र म ेंउनके अंजतम प्रकािन की जतजि से लाग ूहोंगे। 2. पटरभािाएँ। - (1) इन जनयमों में, िब तक दक संिभ गसे अन्यिा अपेजक्षत न हो, - (क) 'अजधजनयम' स ेपिओंु म ेंसक्रं ामक और सांसर्गगक रोगों का जनिारण और जनयंत्रण अजधजनयम, 2009 (2009 का 27) अजभप्रेत ह;ै (ख) 'अजधकृत अजधकारी' स ेकेंद्र सरकार, राज्य सरकार, संघ राज्यक्षेत्र प्रिासन, स्ट्िानीय प्राजधकरण या भारतीय पिु- कल्याण बोड गका िह अजधकारी अजभप्रेत ह ैिो अजधजनयम के उपबन् धों के कायागन्ियन स ेसंबद्ध ह;ै (ग) ‘बोडग' से पिुओं के प्रजत क्रूरता का जनिारण अजधजनयम, 1960 (1960 का 59) की धारा 4 की उप-धारा (1) के अधीन गटित भारतीय पिु-कल्याण बोडग अजभप्रेत ह;ै (घ) ‘प्ररूप' स ेइन जनयमों के साि संलग्न प्ररूप अजभप्रेत ह;ै और (ड.) ‘धारा' स ेअजधजनयम की धारा अजभप्रेत ह।ै (2) उन िब् िों और पिों के, िो इन जनयमों में प्रयिु ह,ैं और पटरभाजित नहीं ह ैं ककंतु अजधजनयम में पटरभाजित हैं, िही अि गहोंगे िो उस अजधजनयम में ह।ैं 3. अनुसूजचत रोग से संक्रजमत पिुओं की टरपोटग - (1) ग्राम अजधकारी अपन े अजधकार क्षेत्र म ें आने िाल े क्षेत्र में अनुसूजचत रोग के प्रकोप या ऐस े दकसी अनुसूजचत रोग स े संक्रजमत दकसी भी पिु के बारे में सूचना प्राप्त होन े पर पि ु जचदकत्ससक को यिासंभि िीघ्रता से प्ररूप-1 में तथ्यात्स मक टरपोटग प्रस्ट् तुत करेगा। (2) पिु जचदकत्ससक, ग्राम अजधकारी से उप-जनयम (1) के अधीन टरपोटग प्राप्त होन े पर या अपने स्ट्ियं की िानकारी से, अपन े अजधकार क्षेत्र म ें आने िाले क्षेत्र में अनुसूजचत रोग के प्रकोप या ऐसे दकसी अनुसूजचत रोग स े संक्रजमत पि ु के बारे म ें राज्य सरकार और केंद्र सरकार को यिािीघ्र प्ररूप-2 में भारत पिुधन पोटगल के माध्यम से एक टरपोटग प्रस्ट्तुत करेगा। 4. टीका लगान े और टीका लगाए गए पिओंु की टरपोटग – जनिेिक, टीका लगाने और टीका लगाए गए पिओंु के संबंध म ें प्ररूप-3 में भारत पिुधन पोटगल के माध्यम से एक टरपोटग प्रस्ट्तुत करेगा, जिसमें जनयंजत्रत क्षत्रे का जििरण, पि-ु माजलक का नाम और पता, जनयंत्रण और मुि क्षेत्र की घोिणा, टीका लगाए गए पिुओं की मार्किंग की प्रकृजत, धारा 8 की उप-धारा (3) म ेंउजल्लजखत टीकाकरण जिजनिेि, जिसमें टीका लगाए गए पिओंु का प्रमाणन िाजमल होगा। 5. टीकाकरण प्रमाणपत्र - धारा 8 की उप-धारा (1) के अधीन अजधकार-प्राप् त पि ु जचदकत्ससक प्ररूप-4 म ें कुक्क ट के अलािा अन्य पिओंु को टीकाकरण के जलए और प्ररूप-5 म ें कुक्क ट के जलए एक प्रमाण पत्र िारी करेगा, जिसमें टीका लगाने की प्रदक्रया, पि-ु माजलक का नाम और पता, पिओंु की प्रिाजत, टीकाकरण करन े िाले व्यजि का प्राजधकार और योग्यता तिा भारत पिधु न पोटगल के माध्यम से प्रमाण पत्र िारी करना िाजमल ह।ै 6. अनुसूजचत रोग से संक्रजमत पिु के िि का जनपटान (1) दकसी पिु का िि, िो दकसी अनुसूजचत रोग के संक्रमण के कारण मरा हो या जिसके बारे में संिेह हो दक िह अनुसूजचत रोग स े संक्रजमत िा या जिसे धारा 25 में जनर्िष्टग तरीके स े मार दिया गया िा, उसका जनपटान पिु-माजलक या प्रभारी व्यजि द्वारा िफनाने, भस्ट्मीकरण या उप-जनयम (2) म ें जनर्िष्टग तरीके से दकया िाएगा। (2) िहां िि का जनपटान उप-जनयम (1) म ें जनर्िष्टग दकसी भी तरीके से दकया िाता ह,ै पिु जचदकत्ससक यह सुजनजित करेगा दक,- (क) िहा ंजनपटान िफना कर दकया गया है, - (i) िफनान े के जलए दकए गए गड्ढे का आकार पि ु के िि के आकार से बडा बनाया िाए, जिससे िि के सभी जहस्ट्सों को गड्ढ े में िफनाया िा सके; (ii) िफनान े के जलए दकए गए गड्ढ े के तल पर पांच सेंटीमीटर चूने की एक परत डाली िाए और जमट्टी भरन े से पहल े िि के ऊपर दफर स ेचून े की एक परत डाली िाए;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (iii) िफनाने के जलए दकया गया गड्ढा िलमागग से कम से कम बीस मीटर और पीने के पानी के स्रोत के रूप में उपयोग दकए िाने िाले कुए,ं बोर-कुएं या पानी के झरन े से िो सौ पचास मीटर िरू बनाया िाए; (iv) िफनाने के जलए दकया गया गड्ढा मौसमी िल-िमाि या बाढ़ संभाजित क्षेत्र में नहीं बनाया िाए; (v) गड्ढे को ढकने के जलए कम से कम एक मीटर जमट्टी की परत डाली िाए; और (vi) सामूजहक िफन के जलए, स्ट्िल, मानि आिास से कम से कम िो सौ पचास मीटर िरू हो, (ख) िहा ंजनपटान भस्ट्मीकरण द्वारा दकया गया ह,ै - (i) यह तब तक दकया िाए िब तक दक पिु का िि राख में न बिल िाए; और (ii) भस्ट्मीकरण के जलए स्ट्िल मानि आिास से कम स ेकम िो सौ पचास मीटर िरू हो, (ग) िहां जनपटान रेंडररंग द्वारा दकया गया हो; (i) यह केिल साइट पर उस एिेंसी या संस्ट्िान द्वारा दकया िाए जिसके पास रेंडररंग संयंत्र के संचालन के जलए प्रजिजक्षत व् यजि हों। (ii) संक्रजमत पिु िि के जनपटान की प्रदक्रया के रूप में रेंडररंग का उपयोग करने िाली एिसें ी या संस्ट्िान प्रत्सयेक रेंडररंग चक्र का उजचत टरकॉड गरख रहा हो; और (iii) रेंडरड गउत्सपाि का उपयोग पिु आहार के घटक के रूप म ेंनहीं दकया िा रहा हो। (3) पिु जचदकत्ससक िफनाने या भस्ट् मीकरण या रेंडररंग की जनगरानी करेगा, िो हो सके तो पिु-माजलक या प्रभारी के पटरसर म ेंया जनकटतम स्ट्िान पर की िाएगी, िैसा दक िह उजचत समझता ह।ै (4) यदि अपेजक्षत हो तो पिु जचदकत्ससक संक्रजमत पिु के िि को सुरजक्षत िाहन में जनपटान स्ट्िल तक ले िाने की व्यिस्ट्िा करेगा और यह सुजनजित करेगा दक मृत पिु के पटरिहन के जलए उपयोग दकए िाने िाले िाहन को िाहन माजलक द्वारा िीक से साफ और कीटाणुरजहत दकया गया हो। (5) िाहन और उसकी सफाई और कीटाणुिोधन के जलए िल्ु क पिु के माजलक या प्रभारी द्वारा भुगतान दकया िाएगा। 7. पोस्ट् ट-माटगम करने की रीजत - (1) दकसी अनुसूजचत रोग के संक्रमण के कारण मरने िाले या अनुसूजचत रोग से संक्रजमत होने का संिेह होन े िाले पिु के िि का पोस्ट्टमाटगम करने के जलए, पिु जचदकत्ससक, - (क) यह सुजनजित करेगा दक पोस्ट्टमाटगम परीक्षण के उद्देश्य से पटरसर, उपकरण और सुजिधाएं स्ट् िस्ट् थ् यकर और पयागप्त ह;ैं (ख) माजलक के पटरसर म ें या जनकटतम स्ट्िान पर, िैसा दक िह उजचत समझे, दकसी एकातं िगह पर पोस्ट्टमाटगम िांच करेगा; (ग) प्रयोगिाला िांच के जलए प्रजतजनजध ऊतक और तरल नमनू े एकत्र करेगा; (घ) पोस्ट्टमाटगम िांच और जनरीक्षण के जलए अपेजक्षत िि के जसर, अंगों, आतं ों और अन्य भागों को ऐसी पहचान योग् य जस्ट्िजत म ेंरखगे ा तादक जनरीक्षण पूरा होन े तक िे उसी िि स ेमले खाएं जिससे उन्ह ेंहटाया गया िा; (ड.) पहल े िि की बाहरी रूप से िांच करेगा और उसके बाि िरीर की गुहाओं को खोलगे ा; (च) जनयम 6 में जनर्िष्टग दकसी भी तरीके से िि और कचरे के जनपटान की व् यिस्ट्ि ा करेगा; (छ) िहां िि और कचरा रखा गया िा और पोस्ट्टमाटगम करन ेके स्ट्िान का कीटाणुिोधन करने की व् यिस्ट्ि ा करेगा। (ि) िि के दकसी भी भाग या अंग या दकसी भी आतं को पोस्ट्टमाटगम िांच और जनरीक्षण क्षेत्र से हटाने की अनुमजत नहीं है; (झ) पोस्ट्टमाटगम और जनरीक्षण क्षेत्र के बाि औिारों, उपकरणों और क्षेत्र की पूरी तरह स े सफाई और जिसंक्रमण सुजनजित करेगा; और (ञ) प्रपत्र-6 में पोस्ट्टमाटगम परीक्षा के जनष्किग टरकॉडग करेगा। (2) उप-जनयम (1) म ेंसंिर्भगत पोस्ट्टमाटगम िांच के परू ा होने पर, पि ु जचदकत्ससक- (क) पोस्ट्टमाटगम िांच टरपोटग की एक प्रजत पिु के माजलक या प्रभारी को प्रिान करेगा; और4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) उि पोस्ट्टमाटगम िांच की टरपोटग उि प्ररूप-6 म ें केंद्र सरकार और राज्य सरकार को भारत पिुधन पोटगल के माध्यम स े यिािीघ्र और दकसी भी जस्ट्िजत में पोस्ट्टमाटगम िांच और जनरीक्षण स ेबारह घंटे के भीतर प्रस्ट्ततु करेगा। (3) पि ु जचदकत्ससक तब पोस्ट्टमाटगम नहीं करेगा िब िि के लक्षण एथ्रं ेक्स , या मृत्सयु का कारण एंथ्रेक्स होने का संिेह ह।ै (4) िहा ं पिुजचदकत्ससक उप-जनयम (3) में उजल्लजखत कारण के जलए पोस्ट्टमाटगम िांच नहीं करना उजचत समझता है, िह अपन ेप्रेक्षण की टरपोटग उि प्ररूप-6 म ें भारत पिुधन पोटगल के माध्यम से केंद्र सरकार और राज्य सरकार को प्रस्ट्ततु करेगा। 8. जिकायत करने की प्रदक्रया.- कोई भी व्यजि या उसका अजधकृत प्रजतजनजध या कोई अजधकृत अजधकारी अजधजनयम के प्रािधानों के उल्लंघन के जलए न् यायजनणगयन अजधकारी को जलजखत रूप में या इलेक्रॉजनक माध्यम से प्ररूप-7 में जिकायत कर सकता ह।ै 9. िांच करन े का तरीका - (1) न् यायजनणगयन अजधकारी, जनयम 8 के अधीन प्राप्त दकसी भी जिकायत पर जनणगय लेन े स े पहले, जिकायत प्राप्त होन े की तारीख से पंद्रह दिनों की अिजध के भीतर, उस व्यजि को जिसके जखलाफ ऐसी जिकायत की गई ह,ै प्रपत्र 8 में नोटटस िारी करेगा, जिसमें उससे नोटटस की तामील होने की तारीख से अजधकतम तीस दिनों की अिजध के भीतर कारण बतान ेको कहा िाएगा दक उसके जिरूद्ध िांच क्यों नहीं की िाए। (2) न् यायजनणगयन अजधकारी को जिकायत के तथ्यों और पटरजस्ट्िजतयों से पटरजचत दकसी भी ऐसे व्यजि की उपजस्ट्िजत को साक्ष्य िेने या कोई िस्ट्तािेि या टरपोटग प्रस्ट्ततु करने के जलए बाध् य करन े का अजधकारी होगा, िो उसकी राय म ें िांच के जलए उपयोगी और सुसंगत हो। (3) उप-जनयम (1) के अधीन िारी दकए गए नोटटस में, (क) कजित रूप से दकए गए उल्लघं न तिा अजधजनयम की कजित उल्लंघन की गई धारा का उल् लेख होगा; और (ख) जिकायत की एक प्रजत संलग् न होगी। (4) न् यायजनणगयन अजधकारी जलजखत म ें अजभजलजखत दकए िाने िाल े कारणों से उप-जनयम (1) के अधीन जनर्िगष्ट उत्तर िेन े की अिजध को पंद्रह दिनों की अजतटरक्त अिजध तक बढ़ा सकता ह,ै यदि िह व्यजि जिस े नोटटस िारी दकया गया है, न् यायजनणगयन अजधकारी को सतं ोििनक उत्स तर िें दक उसके पास ऐसी अिजध के भीतर नोटटस का पालन न करन े का पयागप्त कारण िा। (5) इन जनयमों के अधीन िारी दकया गया नोटटस जनम्नजलजखत में स ेदकसी भी रीजत से तामील दकया िाएगा; (i) इस ेउस व्यजि या उसके अजधकृत प्रजतजनजध को सौंपकर या िेकर; या (ii) इसे इलेक्रॉजनक माध्यम स े या त्स िटरत डाक द्वारा उस व् यजि के जनिास स्ट्िान या उसके अंजतम ज्ञात जनिास स्ट्िान या उस स्ट्िान के पते पर भेिकर िहां िह कारबार करता ह ैया अंजतम बार कारबार दकया िा; या (iii) यदि इसे खडं (i) या (ii) के अधीन जनर्िगष्ट रीजत स े तामील नहीं दकया िा सकता है, तो इसे उस पटरसर के बाहरी द्वार या दकसी अन्य प्रमुख भाग पर जचपकाकर, जिसमें िह व्यजि रहता ह ै या अंजतम बार रहा िा या कारबार करता ह ै या अंजतम बार कारबार दकया िा। (6) उप-जनयम (1) के अधीन िारी नोटटस का उत्तर प्राप्त होने पर, न् यायजनणगयन अजधकारी उस व्यजि को, जिसके जिरूद्ध ऐसी जिकायत की गई ह,ै नोटटस में जनधागटरत तारीख पर सुनिाई का नोटटस िारी करेगा, जिसमें उस व्यजि को स्ट् ियं या उसके द्वारा जिजधित अजधकृत जिजधक प्रजतजनजध के माध् यम से तिा जिकायतकताग या अजधकृत अजधकारी को, िैसा भी मामला हो, उपजस्ट्ित होने के जलए कहा िाएगा। (7) यदि उप-जनयम (1) के अधीन जिस व् यजि के जिरूद्ध नोटटस िारी दकया गया ह,ै िह ऐसे नोटटस के अनुसरण म ें जनधागटरत समयािजध के भीतर उत्तर िेने में जिफल रहता है, इनकार करता ह ै या लपारिाही बरतता है, तो न् यायजनणगयन अजधकारी इस प्रकार िांच परू ी होने के कारणों को उस रीजत से अजभजलजखत करत े हुए, िैसा भी िह उजचत समझे, उस व् यजि के अनुपजस्ट्िजत में सुनिाई कर सकता ह।ै (8) यदि जिस व्यजि के जिरुद्ध जिकायत की गई है, िह उप-जनयम (6) के अधीन प्राप्त उत्तर में उल्लंघन स्ट्िीकार करता है, तो न् यायजनणगयन अजधकारी इस स्ट्िीकारोजि को अजभजलजखत करेगा और अजधजनयम के उपबंधों के अनुसार आििे द्वारा िाजस्ट्त लगाएगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (9) यदि जिस व्यजि के जिरुद्ध जिकायत की गई ह ै िह उल्लघं न स्ट्िीकार नहीं करता है, तो न् यायजनणगयन अजधकारी सुनिाई के जलए जनधागटरत तारीख पर, संबंजधत व् यजि या उसके अजधकृत जिजधक प्रजतजनजध को, दकए गए उल्लघं न और उससे संबंजधत अजधजनयम के उपबंधों के बारे म ेंस्ट् पष्ट करेगा। (10) सुनिाई के जलए जनधागटरत तारीख पर, ऐसे व्यजि, जिकायतकताग या अजधकृत अजधकारी, िैसा भी मामला हो, को सुनिाई का उजचत अिसर िेन े के बाि, न् यायजनणगयन अजधकारी ऐसे अन् य मद्दु ों पर जलजखत प्रस्ट्तुजत फाइल करन े या अपने- अपन ेिािों के समिगन में जलजखत संजक्षप्त जििरण प्रस्ट्तुत करन ेका अिसर प्रिान कर सकेगा। (11) उल्लघं न करने के आरोपी व्यजि, जिकायतकताग या अजधकृत अजधकारी, िैसा भी मामला हो, अपने जलजखत उत्तर के अजतटरक्त गिाहों या िस्ट्तािेिों की सूची प्रस्ट्तुत कर सकता है, जिनकी िांच हो न् यायजनणगयन अजधकारी द्वारा करिाना चाहते ह।ैं (12) िहां न् यायजनणगयन अजधकारी, जलजखत प्रस्ट्तुजतयों, गिाहों या िस्ट्तािेिों, िैसा मामला हो की िांच करन े और उजचत समझे िाने िाल े तरीके से पछु ताछ करने के बाि संतष्टु हो िाता ह ै दक ऐस े व्यजि न े अजधजनयम के दकसी उपबंध का उल्लघं न दकया ह,ै तो िह जलजखत में कारण अजभजलजखत करते हुए एक आििे द्वारा अजधजनयम के उपबंधों के अनुसार िाजस्ट्त अजधजनर्णगत करेगा, जिसमें िाजस्ट्त िमा करन े की समय सीमा जनर्िगष्ट की हो: बिते दक ऐसी कोई भी िंडात्समक कारगिाई संबंजधत व्यजि को सुनिाई का उजचत अिसर दिए जबना नहीं की िाएगी। (13) िहां न् यायजनणगयन अजधकारी, जलजखत प्रस्ट्तुजतयों, गिाहों या िस्ट्तािेिों, िैसा भी मामला हो, की िांच करन े और उजचत समझे िाने िाल े तरीके से पुछताछ करन े के बाि संतष्टु हो िाता ह ै दक ऐसे व्यजि ने अजधजनयम के दकसी उपबंध का उल्लघं न नहीं दकया ह,ै तो िह जलजखत आिेि द्वारा आरोप हटा िेगा और जिकायत खाटरि कर िेगा। (14) यदि उप-जनयम (12) के अधीन िाजस्ट्त अजधरोजपत दकए गए व् यजि िह धारा 33ग के अधीन जनर्िगष्ट अिजध के भीतर िाजस्ट्त का भुगतान करन े म ें जिफल रहता है, तो भारतीय पिु कल्याण बोड ग उि िाजस्ट्त की िसूली के जलए आिश्यक कारगिाई करेगा। (15) इस जनयम के अधीन दिए गए आिेि की एक प्रजत, जिस पर न् यायजनणगयन अजधकारी के जिजधित हस्ट्त ाक्षर होंग,े जिकायतकताग या अजधकृत अजधकारी को, िैसा भी मामला हो, जन:िुल् क उपलब् ध कराई िाएगी। 10. जनणगय की समय-सीमा - न्य ायजनणगयन अजधकारी यिािीघ्र कायगिाही पूरी करेगा और दकसी भी मामले में जिकायत प्राप्त होने की तारीख से छह महीने की अिजध के भीतर कायगिाही पूरी करेगा। 11. अपील का प्ररूप और रीजत - (1) जनयम 9 के उप-जनयम (12) या उप-जनयम (13) के अधीन न् यायजनणगयन अजधकारी द्वारा दिए गए आिेि के जिरूद्ध अपील प्ररूप प्ररूप-9 में फाइल की िा सकती ह।ै (2) अपील के साि न् यायजनणयग न अजधकारी के आिेि की एक प्रजत, अपील दकए गए तथ्यों का जििरण और अपील के आधार संलग् न होन े चाजहए। (3) अपीलकताग स्ट् ियं या अपने अजधकृत प्रजतजनजध द्वारा जलजखत रूप से या इलेक्रॉजनक माध्यम से अपील फाइल कर सकता ह।ै (4) अपील को उस दिन फाइल मानी िाएगी जिस दिन िह अपीलीय प्राजधकारी को प्राप्त होती ह।ै (5) अपीलीय प्राजधकारी न् यायजनणगयन अजधकारी स ेजिकायत और िांच से संबंजधत अजभलेख मंगिाएगा। (6) यदि िांच करन े पर अपील में कोई त्रुटट पाई िाती ह,ै तो अपीलीय प्राजधकारी अपीलकताग को त्रुटट की सूचना िगे ा और उसे पंद्रह दिनों की अिजध के भीतर त्रुटट सुधारने का अिसर िेगा और यदि अपीलकताग जनधागटरत समय के भीतर त्रुटट सुधारने में जिफल रहता ह,ै तो अपीलीय प्राजधकारी जलजखत रूप से कारण बताते हुए आिेि द्वारा त्रुटटपूणग अपील को पंिीकृत करने से इनकार कर सकता ह ै और त्रुटट सुधारने के जलए जनधागथ् रत समय से सात दिनों के भीतर अपीलकताग को इस अस्ट् िीकृजत की सूचना िेगा। (7) यदि िांच करने पर अपील सही पाई िाती है, तो इसे अपीलीय प्राजधकारी उसे स्ट्िीकार करेगा। (8) अपील स्ट्िीकार होने पर, अपीलीय प्राजधकारी प्ररूप-10 में प्रत्स यिी को अपील की एक प्रजत सजहत नोटटस िारी करेगा, जिसमें उसे उस अिजध म ें िो तीस दिन से अजधक नहीं होगी, िैसा दक िह उक्त नोटटस में जनर्िगष्ट करें, अपना उत्स तर प्रस्ट् ततु करने के जलए कहा िाएगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (9) अपीलीय प्राजधकारी द्वारा इस जनयम के अधीन यह नोटटस िारी दकया िाएगा, - (i) इस ेप्रत्स यिी या उसके अजधकृत प्रजतजनजध को सौंपकर या िेकर;या (ii) इस े इलेक्रॉजनक माध्यम स े या त्स िटरत डाक द्वारा प्रत्स यिी के जनिास स्ट्िान या उसके अंजतम ज्ञात जनिास स्ट्िान या उस स्ट्िान के पते पर भेिकर िहां िह कारबार करता ह ैया अंजतम बार कारबार दकया िा; या (iii) यदि इसे खंड (i) या (ii) के अधीन जनर्िष्टग रीजत से तामील नहीं दकया िा सकता है, तो इसे उस पटरसर के बाहरी द्वार या दकसी अन्य प्रमुख भाग पर जचपकाकर, िहां प्रत्स यिी रहता ह ै या अंजतम बार रहा िा या कारबार करता ह ै या अंजतम बार कारबार दकया िा। (10) अपीलीय प्राजधकारी सभी पक्षों कोव्यजिगत रूप से या उनके अजधकृत जिजधक प्रजतजनजधयों के माध्यम से,सुनिाई का उजचत अिसर प्रिान करेगा और ऐसी सुनिाई इलेक्रॉजनक माध्यमों या माध् यमों स ेभी आयोजित की िा सकती ह।ै (11) अपीलीय प्राजधकारी,न् यायजनणगयन अजधकारी के आििे की पुजष्ट, उसम ें संिोधन या जनरस्ट् त करेगा, िैसा भी मामला हो और तिनुसार आिेि िेगा। (12) अपीलीय प्राजधकारी यिािीघ्र कायगिाही पूरी करेगा और अपील प्राप्त होने की तारीख से छह महीने की अिजध के भीतर कायगिाही के जनपटान करने का प्रयास दकया िाएगा। (13) यदि अपीलीय प्राजधकारी िाजस्ट्त लगान े के संबंध में न्यायजनणागयन अजधकारी के आििे की पुजष्ट करता है, और िाजस्ट्त का भुगतान करन े के जलए उत्स तरिायी व् यजि धारा 33ग के अधीन जनर्िगष् ट अिधी के भीतर इसका भुगतान नहीं करता ह,ै तो भारतीय पिु कल्याण बोड गउि िाजस्ट्त की िसूली के जलए आिश्यक कारगिाई करेगा। (14) इस जनयम के अधीन दिए गए आिेि की एक प्रजत, जिस पर अपीलीय प्राजधकारी के जिजधित हस्ट्ताक्षर हों, अपीलकता गया अजधकृत अजधकारी को जन:िुल् क उपलब् ध कराई िाएगी। 12. िाजस्ट्त की रकम का उपयोग - (1) धारा 33 घ के उपबंधों के अनुसार भारतीय पिु कल्याण बोडग के कोि में िमा की गई िाजस्ट्त की रकम का उपयोग राज्य बोडों के माध्यम से जनम्न जलजखत के जलए दकया िाएगा, - (क) पिुस्ट्िास्ट्थ्य प्रबधं न, अच्छी पिुपालन प्रिाओं संबंधी प्रजिक्षण और अनुसूजचत रोगों की रोकिाम और जनयंत्रण के जलए; और (ख)अनुसूजचत रोगों के प्रसार को रोकने और जनयंजत्रत करने के जलए, िैसा आिश्यक हो, दकसी राज्य या संघ राज्य क्षत्रे के भीतर चेक पोस्ट्ट और क्वारंटाइन कैंपों को मिबूत या स्ट्िाजपत करने के जलए । (2) भारतीय पिु कल्याण बोड गिाजस्ट्त के माध्यम से प्राप् त रकम के जलए अलग खाता रखेगा। (3) भारतीय पिु कल्याण बोड ग और राज्य बोडग उप-जनयम (1) में उजल्लजखत उद्देश्यों New Delhi, the 11th August, 2026 G.S.R. 723(E).— The following draft rules, which the Central Government proposes to make in exercise of the powers conferred by section 42 of the Prevention and Control of Infectious and Contagious Diseases in Animals Act, 2009 (27 of 2009), is hereby published for information of persons likely to be affected thereby; after supersession of the Prevention and Control of Infectious and Contagious Diseases in Animals (Form of Vaccination Certificate, Manner of Post Mortem Examination and Disposal of Carcass) Rules, 2010; except as respects things done or omitted to be done before such supersession; and notice is hereby given that the said draft rules shall be taken into24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] consideration after the expiry of a period of thirty days from the date on which the copies of this notification as published in the Official Gazette, are made available to the public; Objections and suggestions to these Draft Rules. 1. Short title and commencement. - (1) These rules may be called the Prevention and Control of Infectious and Contagious Diseases in Animals Rules, 2026. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. Definitions. - (1) In these rules, unless the context otherwise requires, - (a) ‘Act’ means the Prevention and Control of Infectious and Contagious Diseases in Animals Act, 2009 (27 of 2009); (b) ‘authorised officer’ means an officer of the Central Government, the State Government, the Union territory administration, the local authority or the Animal Welfare Board of India associated with the implementation of the provisions of the Act; (c) ‘Board’ means the Animal Welfare Board of India constituted under sub-section (1) of section 4 of the Prevention of Cruelty to Animals Act, 1960 (59 of 1960); (d) ‘Form’ means the Form annexed to these rules; and (e) ‘section’ means section of the Act. (2) Words and expressions used in these rules and not defined, but defined in the Act, shall have the meanings respectively assigned to them in the Act. 3. Report of animals infective of scheduled disease. – (1) The Village Officer on receipt of an information about outbreak of a scheduled disease or of any animal infective of such scheduled disease in the area falling within his jurisdiction shall report the factas expeditiously as possible to the Veterinarian in Form-1. (2)The Veterinarian, on receipt of a report under sub-rule (1) from the Village Officer orat his own knowledge, shall submit a reportabout outbreak of a scheduled disease or of any animal infective of such scheduled disease in the area falling within his jurisdiction to the State Government and Central Government as expeditiously as possiblethrough Bharat Pashudhan portal in Form-2. 4. Report of administration of vaccination and vaccinated animals. – The Director shall submit,areport regarding administration of vaccination and vaccinated animal in Form-3, along with particulars of controlled area, name and address of owner of animals, declaration of control and free area, the nature of marking of vaccinated animals, specification of vaccination referred to in sub-section (3) of section 8 including certification of vaccinated animals through Bharat Pashudhan portal. 5. Vaccination certificate. – The Veterinarian empowered under sub-section (1) of section 8 shall issue a certificate for administration of vaccination to animals, other than poultry inForm-4 and for poultry in Form-5, indicating therein the process of administration of vaccination, name and address of the owner, species of animals, the authority and competency of the person to vaccinate and issue certificate through Bharat Pashudhan portal. 6. Disposal of carcass of animal infected with scheduled disease. — (1) The carcass of an animal, which died due to infection of a scheduled disease or which was suspected to have been infected of the scheduled disease or which was euthanized in the manner referred to in section 25, shall be disposed of by the owner or theperson in-charge of the animal by burial, incineration or rendering in the manner referred to in sub-rule (2). (2) Where the disposal of carcass is done in any manner referred to in sub-rule (1), the Veterinarian shall ensure that,- (a) where the disposal is by burial, - (i) the size of the pit for the burial is made bigger than the size of the carcass of animal that allows all parts of carcass to be buried in the pit; (ii) a layer of five-centimeter lime is put at the bottom of the burial pit and again over the carcass before filling the soil; (iii) the pit for burial is made at least twenty meters away from watercourse and two hundred and fifty meters away from well, bore-well or water spring used as a source of drinking water;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 25 (iv) the pit for burial is not made in a seasonal water-logged or flood prone area; (v) a layer of at least one meter of covering soil is used to cap the pit; and (vi) for mass burial, the site is at least two hundred fifty meters away from human habitat, (b) where the disposal is by incineration, - (i) it is performed till the animal carcass is reduced to ashes; and (ii) the site for incineration is at least two hundred fifty meters away from human habitat, (c) where the disposal is by rendering,- (i) it is performed only on-site by the agency or institute having trained manpower for operating the rendering plant; (ii) the agency or the institute using rendering as a method for infected animal carcass disposal is maintaining proper record of each rendering cycle; and (iii) the rendered product is not used as ingredient of animal feed. (3) The Veterinarian shall supervise the burial or incineration or rendering, which shall be performed preferably at the premises of the owner or incharge of the animal or the nearest location, as considered appropriate by him. (4) The Veterinarian, if required, shall arrange transportation of the carcass of the infected animal in a secured vehicle to the site of the disposal and ensure that the vehicle used for transportation of the dead animal is properly cleaned and disinfected by the vehicle owner. (5) The charges for vehicle and its cleaning and disinfection shall be paid by the owner or incharge of the animal. 7. Manner of conducting post-mortem examination. - (1) For conducting the post- mortem examination of the carcass of an animal which died due to infection of a scheduled disease or which was suspected to have been infected of the scheduled disease, the Veterinarian shall, - (a) ensure that the condition of the premises, equipment and facilities are hygienic and adequate for the purpose of post-mortem examination; (b) conduct the post-mortem examination at a secluded place either at the owner's premises or the nearest location, as considered appropriate by him; (c) collect representative tissues and fluid samples for laboratory testing; (d) keep the head, organs, viscera and other parts of the carcass required for post-mortem examination and inspection in such identifiable position that the same match with the carcass from which they were removed until completion of the inspection; (e) examine the carcass first externally followed by opening the body cavities; (f) arrange disposal of carcass and waste in either of the manners referred to in rule 6; (g) arrange disinfection of premises where the carcass and waste was kept and the place of conducting post- mortem examination; (h) not allow removal of any part or organ or any viscera of the carcass from the post-mortem examination and inspection area; (i) ensure thorough cleaning and decontamination of instruments, equipments and thearea post-mortem examination and inspection area; and (j) record findings of post-mortem examination in Form-6. (2) On completion of the post-mortem examination referred to in sub-rule (1), the Veterinarian shall,- (a) provide a copy of the post-mortem examination report to the owner or in- charge of the animal; and (b) submit a report of the said post-mortem examination in the said Form-6 to the Central Government and the State Government throughBharat Pashudhan portal, as expeditiously as possible and in any case within twelve hours from the post-mortem examination and inspection. (3) The Veterinarian shall not conduct post-mortem examination when from the symptom of the carcass it appears, or the cause of death is suspected, to be anthrax. (4) Where the Veterinarian deems it appropriate not to conduct the post-mortem examination for the reason referred to in sub-rule (3), he shall submit a report of his observations to the Central Government and the State Government through Bharat Pashudhan portalin the aforesaid Form-6.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 8. Procedure for making complaint.- Any person or his authorised representative or any authorised officer may make a complaint for contravention of the provisions of the Act to the adjudicating officer in writing or through electronic means in Form-7. 9. Manner of holding inquiry. -(1) The adjudicating officer, before adjudicating upon any complaint received under rule 8, shall issue a notice in Form-8, within a period of fifteen days from the date of receipt of the complaint, to the person against whom such complaint has been made, requiring him to show cause, within a maximum period of thirty days from the date of service of the same, as to why an inquiry should not be conducted against him. (2) The adjudicating officer shall have the power to summon and enforce the attendance of any person acquainted with the facts and circumstances of the complaint to give evidence or to produce any document or report which, in the opinion of the adjudicating officer, may be useful for,or relevant to, thesubject-matter of the inquiry. (3) A notice issued under sub-rule (1) shall,- (a) state the contravention alleged to be committed and the provision of the Act and the rules made there under alleged to be contravened; and (b) be accompanied by a copy of the complaint. (4) The adjudicating officer may, for reasons to be recorded in writing, extend the period of reply specified under sub- rule (1) by a further period of not exceeding fifteen days, if the person to whom a notice is issued satisfies the adjudicating officer that he had sufficient cause for not complying with the notice within such period. (5) A notice issued under these rules shall be served, in any of the following manner,- (i) by delivering or tendering it to the person or his authorised representative; or (ii) by sending it to the person through electronic means or speed post to the address of his place of residence or his last known place of residence or the place where he carries on business or last carried on business; or (iii) if it cannot be served in the manner specified under clauses (i) or (ii), by affixing it on the outer door or some other conspicuous part of the premises in which that person resides or last resided or carries on business or last carried on business. (6) On receipt of the reply to the notice issued under sub-rule (1), the adjudicating officer shall issue a notice of hearing on such date as may be fixed in the notice, to the person against whom such complaint has been made, requiring the appearance of that person personally or through a legal representative duly authorised by him and the complainant or the authorised officer, as the case may be. (7) Where the person against whom the notice has been issued under sub-rule (1), fails or refuses or neglects to reply within the specified period of time of such notice, the adjudicating officer may proceed with the hearing in the absence of such person after recording the reasons in such manner as he may deem fit. (8) Where the person against whom a complaint has been made admits the contravention in the reply received under sub- rule (6), the adjudicating officer shall record the admission and by an order impose penalty in accordance with the provisions of the Act. (9) Where the person against whom a complaint has been made does not admit the contravention, the adjudicating officer shall, on the date fixed for hearing, explain to the person proceeded against or his authorised legal representative, the contravention made and the provisions of the Act or the rules made there under relating thereto. (10) On the date fixed for hearing, after affording a reasonable opportunity of being heard to such person, the complainant or the authorised officer, as the case may be, the adjudicating officer may grant an opportunity to file written submission on such further issues, as may arise or to submit a written brief in support of their respective claims. (11) The person alleged to have committed the contravention, the complainant or the authorised officer, as the case may be, may submit a list of witnesses or documents in addition to their written reply, which they want to be examined by the adjudicating officer. (12) Where the adjudicating officer, after examining the written submissions, witnesses or documents, as the case may be, and making inquiry in such manner as he may deem fit, is satisfied that such person has contravened the provisions of the Act, he shall, by an order for reasons to be recorded in writing impose penalty in accordance with the provisions of the Act, specifying therein the time limit for depositing the penalty: Provided that no such penalty shall be imposed without giving the person concern a reasonable opportunity of being heard.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 27 (13) Where the adjudicating officer, after examining the written submissions, witnesses or documents, as the case may be, and on making inquiry in such manner as he may deem fit, is satisfied that such person has not contravened any provision of the Act,he shall drop the charges and dismiss the complaint by an order in writing. (14) Where the person on whom penalty has been imposed under sub-rule (12) fails to pay the same within the period specified under section 33C, the Animal Welfare Board of India shall take necessary action for recovery of said penalty. (15) A copy of the order made under this rule duly signed by the adjudicating officer shall be supplied free of cost to the person against whom the complaint was made, the complainant or the authorised officer, as the case may be. 10. Adjudication time-limit. - The adjudicating officer shall conclude the adjudication proceedings as expeditiously as possible and endeavor shall be made to dispose of the proceedings within a period of six months from the date of receipt of the complaint. 11. Form and manner of appeal. - (1) An appeal against the order of the adjudicating officer made under sub-rule (12) or sub-rule (13) of rule 9 may be filed in Form-9. (2) The appeal shall be accompanied by a copy of the order of adjudicating officer, statement of facts appealed against and grounds for appeal. (3) The appeal may be filed by the appellant in person or by his authorised representative in writing or through electronic means. (4) The appeal shall be deemed to have been filed on the day it is received by the appellate authority. (5) The appellate authority shall call for the records relating to complaint and inquiry from the adjudicating officer. (6) If on scrutiny, the appeal is found to be defective, the appellate authority shall intimate the appellant about the defect and allow him to rectify the defect within a period of fifteen days and if the appellant fails to rectify such defect within the specified time limit, the appellate authority may by an order and for reasons to be recorded in writing, refuse to register defective appeal and communicate such refusal to the appellant within a period of seven days from the last day of time specified for rectification. (7) If on scrutiny, the appeal is found to be in order, it shall be admitted by the appellate authority. (8) On admission of the appeal, the appellate authority shall serve a notice in Form-10 along with a copy of appeal to the respondent requiring him to submit his reply thereto, within such period, not exceeding thirty days, as may be specified by him in the said notice. (9) The notice shall be served under this rule by the appellate authority, - (i) by delivering or tendering it to the respondent or his authorised representative; or (ii) by sending it to the respondent through electronic means or by speed post to the address of his place of residence or his last known place of residence or the place where he carries on business or last carried on business; or (iii) if it cannot be served in the manner specified under clauses (i) or (ii), by affixing it on the outer door or some other conspicuous part of the premises in which respondent resides or last resided or carries on business or last carried on business. (10) The appellate authority shall provide a reasonable opportunity of hearing to all parties, either in person or through their authorised legal representatives and such hearing may be conducted through electronic meansor otherwise. (11) The appellate authority, shall confirm, vary or set aside the order of the adjudicating officer, as the case may be, and make an order accordingly. (12) The appellate authority shall conclude the appeal proceedings as expeditiously as possible and endeavor shall be made to dispose of the proceedings within a period of six months from the date of receipt of the appeal. (13) Where the appellate authority confirms the order of adjudicating officer regarding imposition of penalty and the person liable to pay the same, does not pay it within the period specified under section 33C, the adjudicating officer and the Animal Welfare Board of India shall take necessary action for the recovery of said penalty. (14) A copy of the order made under this rule duly signed by the appellate authority shall be supplied free of cost to the person against whom the appeal was made, the appellant or the authorised officer, as the case may be 12.Utilisation of penalty amount. - (1) The penalty amount credited to the Fund of the Animal Welfare Board of India in accordance with the provisions of section 33D shall be utilised through State Boards for, -28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (a) animal health management, training on good animal husbandry practices and prevention and control of scheduled diseases; and (b) strengthen or establish check posts and quarantine camps within a State or Union territory, as may be required to prevent and control spread of scheduled diseases. (2) The Animal Welfare Board of India shall maintain a separate account of the amount realised through penalties. (3) The Animal Welfare Board of India and the State Boardutilising the penalty amount for the purposes referred to in sub-rule (1) shall submit a report regarding utilisation of said penalty amount to the Central Government and the State Government.
