1. संवक्षप्त नाम और प्रारंभ.-

(1) इन दनयमो ं को पशुओ ं के प्रदत क्रू रता दनवारण (प्रयोग, प्रयोगशािा पशुओ ं के प्रिनन और व्यापार का दनयंत्रण तथा पययवेक्षण) दनयम, 2026 कहा िा िाएगा।

(2) ये दनयम रािपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होगं े।

(3) इन दनयमो ं में वैज्ञादनक या शैदक्षक प्रयोिनो ं के दिए उपयोग दकए िाने वािे पशुओ ं के िंरक्षण के दिए उपाय दकए िाएंगे।

(4) उि प्रयोिन के दिए, इन दनयमो ंमें दनम्नदिक्तखत के दिए दिशादनिेश दनिायररत दकए गए हैं: (क) प्रयोगो ंमें पशुओ ंके उपयोग के प्रदतस्थापन और पशुओ ंकी िंख्या कम करना तथा प्रयोगो ंमें पशुओ ंके प्रिनन, आवाि, िेखभाि और उपयोग में पररष्करण;

(ख) पशुओ ं का उद्गम, प्रिनन, दचह्ांकन, िेखभाि और आवाि तथा मानवीय रूप िे मृत्यु प्रिान करना; (ग) प्रिनको,ं व्यापाररयो ंऔर उपयोगकतायओ ं का िंचािन; (घ) प्रयोगो ंमें पशुओ ं के उपयोग िे िंबंदित पररयोिनाओ ंका मूल्ांकन और प्रादिकरण।

(5) ये दनयम वहां िागू होगं े िहां पशुओ ं का प्रयोगो ं में उपयोग दकया िाता है या उपयोग दकया िाना आशदयत है अथवा पशुओ ं का दवशेि रूप िे इि उद्देश्य िे प्रिनन दकया िाता है दक उनके अंगो ं या ऊतको ं का वैज्ञादनक प्रयोिनो ंके दिए उपयोग दकया िा िके ।

(6) ये दनयम तब तक िागू रहेंगे िब तक प्रयोग पूरा होने के पश्चात् पशुओं को मानवीय रूप िे मृत्यु प्रिान की िाएगी, अथवा उन्हें उपयुि आवाि या पशुपािन प्रणािी में पुनवायदित नही ंकर दिया िाता।

(7) पीड़ा, कष्ट, व्यथा या िीघयकादिक क्षदत का िफितापूवयक दनवारण करने के दिए िंज्ञाहरण, पीड़ाहर औिदि या अन्य दवदियो ंके िफि उपयोग के कारण प्रयोगो ंमें पशु का उपयोग इन दनयमो ंके िायरे िे बाहर नही ंहोगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3

(8) ये दनयम िीदवत गैर-मानव कशेरुकी पशुओ ंपर िागू होगं े, दििमें मछदियो ंके स्वतंत्र रूप िे आहार ग्रहण करने वािे िावीय रूप, भ्रूणयुि अंडे और स्तनिाररयो ं के भ्रूणीय रूप उनके िामान्य दवकाि की अंदतम एक-दतहाई अवस्था िे िागू होगं े;

(9) ये दनयम उन पशुओ ं पर भी िागू होगं े, दिनका प्रयोग उप-दनयम (8) में दनदियष्ट दवकाि की अवस्था िे पहिे की अवस्था में दकया िाता है, यदि उि पशु को दवकाि की उि अवस्था िे आगे िीदवत रहने दिया िाना है और दकए गए प्रयोगो ंके पररणामस्वरूप, दवकाि की उि अवस्था तक पहुंचने के बाि, उिमें पीड़ा, कष्ट, तनाव या स्थायी क्षदत होने की िंभावना है।

(10) ये दनयम दनम्नदिक्तखत पर िागू नही ंहोगं े: (क) गैर-प्रायोदगक कृ दि पद्धदतयां; (ख) गैर-प्रायोदगक नैिादनक पशुदचदकत्सीय पद्धदतयां; (ग) दवदि द्वारा अनुमोदित पशुदचदकत्सीय औििीय उत्पाि के दवपणन प्रादिकरण के दिए अपेदक्षत पशुदचदकत्सीय नैिादनक क्षेत्र परीक्षण, बैच दवदनमायण के दिए परीक्षण बैच तथा गुणवत्ता दनयंत्रण परीक्षण को छोड़कर;

(घ) मान्यता-प्राप्त पशुपािन के प्रयोिनो ंके दिए की िाने वािी पद्धदतयां; (ङ) दकिी पशु की पहचान के प्राथदमक प्रयोिन के दिए की िाने वािी पद्धदतयां; (च) ऐिी पद्धदतयां दिनिे, िुस्थादपत पशुदचदकत्सीय पद्धदत के अनुिार िुई िगाने िे होने वािी पीड़ा, कष्ट, तनाव या स्थायी क्षदत के िमतुल् या उििे अदिक पीड़ा, कष्ट, तनाव या स्थायी क्षदत होने की िंभावना नही ंहै।

2. पररभाषाएं:- इन दनयमो ंमें, िब तक दक िंिभय िे अन्यथा अपेदक्षत न हो,-- (क) “अदिदनयम” िे पशुओ ं के प्रदत क्रू रता दनवारण अदिदनयम, 1960 (1960 का 59) अदभप्रेत है; (ख) “बोडय” िे अदिदनयम की िारा 4 के अिीन स्थादपत और अदिदनयम की िारा 5क के अिीन िमय-िमय पर पुनगयदित भारतीय पशु कल्ाण बोडय अदभप्रेत है;

(ग) “प्रिनक” िे िदमदत के िाथ रदिस्टरीकृ त ऐिा कोई प्राकृ दतक या दवदिक व्यक्ति अदभप्रेत है, िो पशुओ ं का इि अदभप्राय िे प्रिनन करता है दक उनका उपयोग आंतररक प्रयोगो ं के दिए या वैज्ञादनक प्रयोिनो ं के दिए उनके ऊतक या अंगो ंके उपयोग के दिए दकया िा िके अथवा उन्हें िाभ के दिए या िाभ के दबना अन्य रदिस्टरीकृ त िंस्था को आपूदतय दकया िा िके ;

(घ) “िीिीएिईए” िे अदिदनयम की िारा 15 की उपिारा (1) के अिीन स्थादपत पशुओ ं पर प्रयोगो ंिंबंिी दनयंत्रण और पययवेक्षण के दिए िदमदत अदभप्रेत है, दििे इिमें इिके पश्चात् “िदमदत” कहा गया है;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ङ) “अध्यक्ष” िे अदिदनयम की िारा 15 की उपिारा (2) के अिीन नामदनिेदशत अध्यक्ष अदभप्रेत है;

(च) “िहयोगात्मक अनुिंिान” िे मानव या पशु कल्ाण के दिए वैज्ञादनक अनुिंिान की उन्नदत के एकमात्र प्रयोिन िे िो या अदिक अनुिंिान िंस्थानो ंके बीच दकया गया कोई प्रयोग अदभप्रेत है; (छ) “िंदविा अनुिंिान” िे दकिी व्यक्ति, कं पनी, फमय, दनगम या िंस्था की ओर िे, िाभ के दिए या िाभ के दबना, दकिी घरेिू या दविेशी व्यक्ति, कं पनी, फमय, दनगम या िंस्था द्वारा प्रदतफि के दिए दकया गया कोई अनुिंिान अदभप्रेत है;

(ि) "प्रयोग" िे िैदवक, शरीर दक्रयात्मक, िीवपररक्तस्थदतकीय, भौदतक या रािायदनक प्रकृ दत के ज्ञान के अियन के दिए पशुओ ं के उपयोग को अंतवयदित करने वािा कोई काययक्रम या पररयोिना अदभप्रेत है; और दििमें िीवन को बचाने या िीघय बनाने या यातनान्यून करने या िेश के िोगो ंके कल्ाण हेतु महत्वपूणय अदभिाभो ंके प्रयोिन के दिए अदभकमयको ंऔर उत्पािो ंिैिे प्रदतिन और प्रदतदपंड, नैक्तत्यक दनिान, परीक्षण गदतदवदि और टरांििेदनक स्टॉक की स्थापना के उत्पािन में या मनुष्ो ंया पशुओ ंको िगने वािे दकिी रोग की रोखथाम के दिए उपयोगी हो,ं शादमि है;

(झ) “स्थापन” िे कोई िंस्थापन, भवन, भवनो ंका िमूह या अन्य पररिर, दििमें ऐिा स्थान भी शादमि है िो पूणयतः दघरा हुआ या आच्छादित नही ंहै तथा चि िुदविाएं, िहां प्रयोगशािा पशुओ ं का प्रिनन, आवाि, व्यापार या प्रयोगो ं के दिए उपयोग दकया िाता है, अदभप्रेत है;

(ञ) “दिशादनिेश” िे अदिदनयम या उिके अिीन बनाए गए दनयमो ंके कायायन्वयन के प्रयोिन को पूरा करने के दिए िीिीएिईए द्वारा िमय-िमय पर िारी दकए गए कोई िस्तावेि या दनिेश अदभप्रेत हैं; (ट) “मानवीय अंत-दबंिु” िे पूवयदनिायररत ऐिा मानिंड अदभप्रेत है दिििे यह दनिायररत दकया िाता है दक दकिी पशु की पीड़ा, कष्ट, व्यथा या कल्ाण में कमी दकि स्तर तक पहुंच गई है, दिि पर पशु की आगे की पीड़ा को रोकने और प्रयोग को िमाप्त करने के दिए कारयवाई दकया िाना आवश्यक है;

(ि) “िंस्थागत पशुनैदतक िदमदत” िे दकिी स्थापन में िीिीएिईए द्वारा मान्यता प्राप्त और रदिस्टरीकृ त व्यक्तियो ंके िमूह िे गदित ऐिा दनकाय अदभप्रेत है, दििका गिन और िंचािन िदमदत द्वारा इि प्रयोिन के दिए दवदनदियष्ट प्रयोगो ंके अनुिार दकया िाता है, दििे इिमें इिके पश्चात् “आईएईिी” कहा गया है;

(ड) “आक्रामक प्रयोग” िे ऐिी कोई प्रदक्रया अदभप्रेत है दििमें पशु को दनयंदत्रत करना, रि का िंग्रह करना, इंिेक्शन िेना या ऐिा कोई अंतः क्षेपण शादमि है, दिििे िामान्य शारीररक रचना में पररवतयन होता हो या शरीर की प्राकृ दतक अवरोिक िंरचनाओ ंको भेिकर िामान्य शारीररक दक्रयाओ ंमें हस्तक्षेप होता हो। ऐिी प्रदक्रयाओ ंमें शल् प्रदक्रयाएं, िैिे अंग प्रत्यारोपण, िूरदमदत उपकरणो ं या नदिका का प्रत्यारोपण िैिी शल् प्रदक्रयाएं; रि या ऊतक के नमूने िदहत ऐिे नमूनो ं का िंग्रह, दििके दिए दनयदमत पशुदचदकत्सीय पद्धदत िे आगे बढ़कर महत्वपूणय चीरा िगाने या गहरे छेिन की आवश्यकता होती है; तथा बार-बार मुख-निी द्वारा औिदि िेना या गहरे ऊतक में इंिेक्शन िेने िैिी प्रशािन िंबंिी प्रदक्रयाएं शादमि हैं, दकन्तु इन्ही ंतक िीदमत नही ंहैं;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (ढ) “प्रयोगशािा पशु” िे इन दनयमो ंके अिीन दवदनयदमत प्रयोगो ंमें उपयोग दकए गए या उपयोग दकए िाने के दिए आशदयत िभी कशेरुकी पशु अदभप्रेत हैं;

(ण) “ििस्य” िे पशुओ ंपर प्रयोगो ंिंबंिी दनयंत्रण और पययवेक्षण के दिए िदमदत का ििस्य अदभप्रेत है; (त) “ििस्य-िदचव” िे पशुओ ं पर प्रयोगो ं िंबंिी दनयंत्रण और पययवेक्षण के दिए िदमदत का ििस्य-िदचव अदभप्रेत है;

(थ) “नामदनिेदशत” िे िदमदत द्वारा िीिीएिईए के कायों को करने के दिए अपने प्रदतदनदि के रूप में चयदनत व्यक्ति अदभप्रेत है; (ि) “गैर-आक्रामक प्रयोग” िे ऐिे प्रयोग अदभप्रेत हैं दिनमें त्वचा का भेिन या शल् हस्तक्षेप नही ं होता और िहां वैज्ञादनक उद्देश्य आक्रामक प्रदक्रयाओ ं के दबना प्राप्त दकया िा िकता है, वहां ऐिे प्रयोग दकए िाएंगे। ऐिे प्रयोगो ं में, अन्य बातो ंके िाथ, शारीररक या रोग िंबंिी पररवतयनो ंकी दनगरानी के दिए गैर-आक्रामक प्रदतदबंबन तकनीको ं का उपयोग, वैज्ञादनक दवश्लेिण के दिए मि, मूत्र या स्वाभादवक रूप िे झड़े बाि िैिे िैदवक नमूनो ं का िंग्रहण तथा ऐिे अप्रदतबंदित वातावरण में पशुओ ं का व्यवहार िंबंिी अविोकन या दनगरानी शादमि हो िकती है, दिििे पीड़ा, व्यथा या क्षदत न हो;

(ि) “पररयोिना” िे पररभादित वैज्ञादनक उद्देश्य वािा और एक या अदिक प्रयोगो ंिे िंबंदित कायय का कोई काययक्रम अदभप्रेत है; (न) “दवदनदियष्ट प्रारूप” िे िदमदत द्वारा िमय-िमय पर इि प्रयोिन के दिए दवदनदियष्ट प्ररूप अदभप्रेत हैं;

(प) “व्यापारी” िे िदमदत के िाथ रदिस्टरीकृ त ऐिा कोई प्राकृ दतक या दवदिक व्यक्ति अदभप्रेत है िो िदमदत के िाथ रदिस्टरीकृ त स्थापन को पशुओ ंकी आपूदतय करता है, दिनका प्रयोगो ंमें उपयोग दकया िाना है या वैज्ञादनक प्रयोिनो ं के दिए उनके ऊतक या अंगो ंका उपयोग दकया िाना है, चाहे िाभ के दिए हो या िाभ के दबना;

(फ) “उपयोगकताय” िे िदमदत के िाथ रदिस्टरीकृ त ऐिा स्थापन अदभप्रेत है िो प्रयोगो ंमें पशुओ ं का उपयोग करता है, चाहे िाभ के दिए हो या िाभ के दबना; (ब) “पशुदचदकत्सक” िे ऐिा व्यक्ति अदभप्रेत है िो भारतीय पशुदचदकत्सा पररिि या, यथाक्तस्थदत, राज्य पशुदचदकत्सा पररिि के िाथ रदिस्टरीकृ त हो तथा दकिी मान्यताप्राप्त पशुदचदकत्सा िंस्था िे उपादि िाररत करता हो।

3. ररप्लेसमेंट, ररडक्शन एिं ररफाइनमेंट (3Rs):- ररप्लेिमेंट, ररडक्शन एवं ररफाइनमेंट (3Rs) के दिद्धांत के कायायन्वयन के प्रयोिन के दिए, प्रयोग करने वािे रदिस्टरीकृ त स्थापन यह िुदनदश्चत करेंगे दक-

(1) िहां तक िंभव हो, िीदवत पशुओ ं का उपयोग दकए दबना वैज्ञादनक रूप िे िंतोििनक पद्धदत या परीक्षण रणनीदत का प्रयोग के स्थान पर उपयोग दकया िाए;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(2) पररयोिनाओ ं में उपयोग दकए िाने वािे पशुओ ं की िंख्या को वैज्ञादनक रूप िे वैि और िांक्तख्यकीय रूप िे दवश्विनीय पररणाम प्राप्त करने के दिए आवश्यक न्यूनतम िंख्या तक कम दकया िाए, दबना पररयोिना के उद्देश्यो ं िे िमझौता दकए;

(3) प्रिनन, आवाि और िेखभाि तथा प्रयोगो ंमें प्रयुि दवदियो ंका पररष्करण इि प्रकार दकया िाए दक पशुओ ंको होने वािी दकिी भी िंभादवत पीड़ा, कष्ट, व्यथा या िीघयकादिक क्षदत को िमाप्त या न्यूनतम दकया िा िके , पयायप्त पयायवरणीय िमृक्तद्ध प्रिान की िाए, िवोत्तम पशुदचदकत्सकीय पद्धदतयां अपनाई िाएं और मान्यीकृ त मानवीय अंदतम दबंिुओ ंका उपयोग दकया िाए।

4. प्रयोगो ंके प्रयोजन:- प्रयोग के वि दनम्नदिक्तखत प्रयोिनो ंके दिए दकए िा िकें गे:

(1) ज्ञान की उन्नदत के दिए मूिभूत अनुिंिान, दििमें िैदवक, िैव-दचदकत्सीय, व्यवहार िंबंिी या पशुदचदकत्सा दवज्ञान में मौदिक अनुिंिान शादमि है;

(2) दनम्नदिक्तखत में िे एक या अदिक उद्देश्यो ंवािा अनुप्रयुि या अनुवािात्मक अनुिंिान:- (क) मानव, पशु या पौिो ं में रोग, अस्वास्थ्य या अन्य रोगात्मक िशाओ ं अथवा उनके प्रभावो ं का पररहार, दनवारण, दनिान या उपचार;

(ख) मानव, पशु या पौिो ंमें शारीररक िशाओ ं का मूल्ांकन, पता िगाना, दवदनयमन या िंशोिन; या (ग) पशुओ ंके कल्ाण तथा कृ दि प्रयोिनो ंके दिए पािे िाने वािे पशुओ ं की उत्पािन िशाओ ं में िुिार;

(3) उप-दनयम (2) में दनदियष्ट दकिी प्रयोिन के दिए औिदियो,ं खाद्य और पशु आहार तथा अन्य पिाथों या उत्पािो ं की गुणवत्ता, प्रभावकाररता और िुरक्षा के दवकाि, दनमायण या परीक्षण के िंबंि में;

(4) मानव या पशुओ ं के स्वास्थ्य या कल्ाण के दहत में प्राकृ दतक पयायवरण का िंरक्षण;

(5) प्रिादतयो ंके िंरक्षण के उद्देश्य िे अनुिंिान;

(6) व्याविादयक कौशि के अियन, अनुरक्षण या िुिार के दिए उच्च दशक्षा या व्याविादयक प्रदशक्षण;

(7) दवदिक आवश्यकता के अनुिार न्यादयक-दवज्ञान िंबंिी अन्वेिण;

(8) रिस्राव/रि उत्पािो ंकी प्रदक्रया।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7

5. पशुओ ंकी िे श्रेवणयां वजन पर प्रयोग प्रविवषद्ध होगं े:-

(1) वन्यिीव (िंरक्षण) िंशोिन अदिदनयम, 2022 के अिीन िंरदक्षत पशुओ ं के नमूनो ं का प्रयोगो ं में उपयोग नही ं दकया िाएगा, दिवाय उन प्रयोगो ंके िो दनम्नदिक्तखत शतों को पूरा करते हैं:- (क) प्रयोग का कोई एक प्रयोिन इन दनयमो ं के दनयम 4 के उप-दनयम (2) के खंड (क), उप-दनयम (3) या उप- दनयम (5) में दनदियष्ट प्रयोिनो ंमें िे हो;

(ख) वैज्ञादनक औदचत्य हो दक प्रयोग का उद्देश्य िंकटापन्न प्रिादत के अदतररि दकिी अन्य प्रिादत के उपयोग िे प्राप्त नही ंदकया िा िकता; (ग) उप-दनयम (1) दकिी गैर-मानव प्राइमेट की दकिी प्रिादत पर िागू नही ंहोगा;

(घ) िागू दवदि के अनुिार िक्षम प्रादिकाररयो ंिे अनुमदत प्रिान की गई हो।

(2) वन्य िे दिए गए पशु- (क) वन्य िे दिए गए पशुओ ं का प्रयोगो ं में तब तक उपयोग नही ंदकया िाएगा िब तक िंबंदित दवभाग का िक्षम प्रादिकारी वैज्ञादनक औदचत्य के आिार पर यह छू ट प्रिान न करे दक प्रयोग का उद्देश्य प्रयोगो ं में उपयोग के दिए प्रिदनत पशु के उपयोग िे प्राप्त नही ंदकया िा िकता;

(ख) वन्य िे पशुओ ंको पकड़ना के वि प्रादिकृ त िक्षम व्यक्ति द्वारा ऐिी दवदियो ंका उपयोग करते हुए दकया िाएगा दिनिे पशुओ ंको टािी िा िकने वािी पीड़ा, कष्ट, व्यथा या िीघयकादिक क्षदत न हो; (ग) पकड़ने के िौरान या उिके पश्चात् घायि या खराब स्वास्थ्य वािा पाया गया कोई पशु दकिी पशुदचदकत्सक या पशुदचदकत्सक के पययवेक्षण में दकिी अन्य प्रादिकृ त व्यक्ति द्वारा िांचा िाएगा और पशु की पीड़ा को न्यूनतम करने के दिए कारयवाई की िाएगी। िक्षम प्रादिकारी वैज्ञादनक औदचत्य होने पर पशु की पीड़ा को न्यूनतम करने के दिए कारयवाई करने की अपेक्षा िे छू ट प्रिान कर िकते हैं;

(घ) िदमदत िीिीएिईए के दिशादनिेशो ं में पररभादित स्व-िंिारणीय कािोदनयो ं िे गैर-मानव प्राइमेट प्राप्त करने के उपयोग की िमीक्षा करेगी।

(3) घरेिू प्रिादतयो ं के आवारा और िंगिी पशु।— घरेिू प्रिादतयो ं के आवारा और िंगिी पशुओ ं का प्रयोगो ं में उपयोग नही ंदकया िाएगा, बशते दक िक्षम प्रादिकारी दनम्नदिक्तखत शतों के अिीन छू ट प्रिान कर िकते हैं:— (क) पशुओ ं के स्वास्थ्य और कल्ाण िे िंबंदित अध्ययनो ंकी आवश्यक आवश्यकता हो या पयायवरण अथवा मानव या पशु स्वास्थ्य के दिए गंभीर खतरा हो; और (ख) वैज्ञादनक औदचत्य हो दक प्रयोग का उद्देश्य के वि आवारा या िंगिी पशु का उपयोग करके ही प्राप्त दकया िा िकता है।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

6. गैर-मानि प्राइमेट पर प्रयोग:- दनयम 5 के अिीन रहते हुए, गैर-मानव प्राइमेट के नमूनो ंका प्रयोगो ंमें उपयोग नही ंदकया िाएगा, दिवाय उन प्रयोगो ं के िो दनम्नदिक्तखत शतों को पूरा करते हैं:--

(1) प्रयोग का कोई एक प्रयोिन दनम्नदिक्तखत में िे हो-- (क) इन दनयमो ं के दनयम 4 के उप-दनयम (2) के खंड (क) या उप-दनयम (3) में दनदियष्ट प्रयोिन और ऐिा प्रयोग मानव में िुबयिकारी या िंभादवत रूप िे िीवन के दिए खतरा उत्पन्न करने वािी नैिादनक िशाओ ं के पररहार, दनवारण, दनिान या उपचार के उद्देश्य िे दकया िा रहा हो; या (ख) दनयम 4 के उप-दनयम (1) या (5) में दनदियष्ट प्रयोिन; और (ग) वैज्ञादनक औदचत्य हो दक प्रयोग का उद्देश्य गैर-मानव प्राइमेट के अदतररि दकिी अन्य प्रिादत के उपयोग िे प्राप्त नही ंदकया िा िकता। दटप्पण: इन दनयमो ं के प्रयोिनो ं के दिए “िुबयिकारी नैिादनक िशा” िे दकिी व्यक्ति की िामान्य शारीररक या मनोवैज्ञादनक रूप िे कायय करने की क्षमता में कमी अदभप्रेत है।

(2) वन्यिीव (िंरक्षण) िंशोिन अदिदनयम, 2022 में िूचीबद्ध गैर-मानव प्राइमेट के नमूनो ं का प्रयोगो ं में उपयोग नही ंदकया िाएगा।

7. प्रयोगो ंकी गंभीरिा का िगीकरण:-

1) स्थापन प्रयोग की गंभीरता का पािन करेगा, दििे प्रत्येक मामिे के आिार पर ‘अपुनः प्राक्तप्त’, ‘िरि’, ‘मध्यम’ या ‘गंभीर’ के रूप में वगीकृ त दकया िाएगा, िैिा दक अनुिग्नक-I में दवदनदियष्ट है।

(2) स्थापन यह िुदनदश्चत करेंगे दक ऐिा कोई प्रयोग न दकया िाए दििमें गंभीर पीड़ा, कष्ट या व्यथा होने की िंभावना हो, िो िीघय अवदि तक रहने वािी हो और दििे कम नही ंदकया िा िकता हो।

8. प्रजनको,ं व्यापाररयो ंऔर उपयोगकिायओ ंके वलए अपेक्षाएं.—

(1) कोई भी स्थापन प्रयोग के प्रयोिन के दिए पशुओ ंके प्रिनन या व्यापार के दिए पशुओ ंका व्यविाय या आवाि तब तक नही ंकरेगा, िब तक दक वह िीिीएिईए के िाथ रदिस्टरीकृ त न हो।

(2) प्रत्येक प्रिनक, व्यापारी या स्थापन, दनम्नदिक्तखत प्रयोिनो ंके दिए िीिीएिईए द्वारा दवकदित दवद्यमान ऑनिाइन पोटयि के माध्यम िे रदिस्टरीकरण के दिए आवेिन करेगा, अथायत्:—[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9

(i) पशुओ ं का प्रिनन;

(ii) पशुओ ंका व्यापार; और

(iii) पशुओ ं का प्रिनन और व्यापार।

(3) व्यापारी यह िुदनदश्चत करेंगे दक उनके द्वारा प्रिदनत, प्राप्त या रखे गए पशुओ ं का व्यापार के वि िीिीएिईए के िाथ रदिस्टरीकृ त स्थापन को ही दकया िाए और प्राप्तकताय स्थापन की आईएईिी िे अथवा िदमदत के अनुमोिन के पश्चात् ही दकया िाए।

(4) प्रिनक और व्यापारी आईएईिी को त्रैमादिक ररपोटय तथा प्रत्येक दवत्तीय विय के दिए अनुिूची VII में दवदहत प्ररूप में वादियक ररपोटय प्रत्येक विय 31 माचय को या उििे पहिे प्रस्तुत करेंगे।

9. पशुओ ं पर प्रयोग करने अथिा प्रायोवगक प्रयोजनो ंके वलए पशुओ ं को रखने, प्रजनन करने और व्यापार करने िाले स्थापन का रवजस्ट्रीकरण.—

(1) कोई भी स्थापन इन दनयमो ंके अिीन िीिीएिईए के िाथ रदिस्टरीकृ त हुए दबना पशुओ ंपर प्रयोग नही ंकरेगा।

(2) प्रत्येक स्थापन अनुिूची I में दिए गए दवदहत प्ररूप में िीिीएिईए के ऑनिाइन पोटयि के माध्यम िे ििस्य- िदचव को दवदनदियष्ट फीि के िाथ रदिस्टरीकरण के दिए आवेिन करेगा।

10. आिेदनो ंका प्रसंस्करण.—

(1) अनुिूची II में दिए गए िंतोििनक दनरीक्षण ररपोटय और िूचना प्राप्त होने पर ििस्य-िदचव ऐिे स्थापन का रदिस्टरीकरण करेगा।

(2) कोई स्थापन रदिस्टरीकरण की शतों अथवा िदमदत द्वारा दवदनदियष्ट दकिी अन्य शतय का अनुपािन करने के दिए आबद्ध होगा।

(3) िदमदत, प्रशािदनक (पशुओ ं पर प्रयोगो ं के दनयंत्रण और पययवेक्षण िंबंिी िदमदत) दनयम, 2023 में उक्तल्लक्तखत दवदनदियष्ट अवदि के भीतर रदिस्टरीकरण पर दनणयय िेगी।

(4) िदमदत, यदि आवश्यक हो, तो रदिस्टरीकरण िे पहिे िुदविाओ ंमें दकए िाने वािे िंशोिन िे स्थापन को अवगत कराएगी और रदिस्टरीकरण पर अंदतम दनणयय िेगी।

(5) िदमदत के अिीन रदिस्टरीकृ त प्रत्येक स्थापन को प्रत्येक प्रयोिन के दिए एक अदद्वतीय रदिस्टरीकरण कोड और िंख्या प्रिान की िाएगी।

(6) पशुगृह िुदविाओ ंिदहत आईएईिी का रखरखाव करने वािे स्थापन को िारी दकया गया रदिस्टरीकरण प्रमाणपत्र तीन विय की अवदि के दिए दवदिमान्य रहेगा, िब तक दक उिे, यथाक्तस्थदत, स्थापन या िदमदत द्वारा िमाप्त या वापि न िे दिया िाए।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

11. प्रयोग करने के वलए सवमवि की अनुमवि अपेवक्षि है.—

(1) िीिीएिईए के िाथ रदिस्टरीकृ त प्रत्येक स्थापन, प्रयोग करने िे पहिे, यथाक्तस्थदत, िदमदत या िंस्थागत पशुनैदतक िदमदत िे अनुमदत प्राप्त करेगा।

(2) दनयम 7 के अिीन पररभादित गंभीर और अपुनः प्राक्तप्त प्रयोग करने वािा प्रत्येक स्थापन, कृं तक और िैगोमॉफय िे ऊपर की श्रेणी के पशुओ ं पर प्रयोग के दिए, आईएईिी की दिफाररश के पश्चात् अनुिूची III में दववरण िेते हुए ऑनिाइन पोटयि के माध्यम िे िीिीएिईए को आवेिन करेगा। ऐिे आवेिनो ंपर िदमदत द्वारा तीि काययदिवि के भीतर दनणयय दिया िाएगा।

(3) िरि और मध्यम के रूप में पररभादित प्रयोग करने वािा प्रत्येक स्थापन, दििमें िभी पशुओ ंपर दकए िाने वािे ऐिे प्रयोग भी शादमि हैं, अनुिूची III के अनुिार अपना आवेिन आईएईिी के ििस्य-िदचव को प्रयोग पर दनणयय के दिए प्रस्तुत करेगा। ऐिे प्रयोग िदमदत को िंिदभयत नही ंदकए िाएंगे।

(4) िैगोमॉफय िे ऊपर के पशुओ ं पर िरि और मध्यम प्रयोगो ं के अनुमोिन के मामिे में, आईएईिी िदमदत को िमयबद्ध और दनिायररत ररपोटय प्रस्तुत करना िुदनदश्चत करेगी, कम-िे-कम दनम्नदिक्तखत तीन चरणो ंमें, अथायत् अध्ययन का प्रारंभ, अंतररम प्रगदत और अध्ययन की पूणयता, दििमें प्रगदत, यदि कोई हो तो दवचिन और 3Rs (ररप्लेिमेंट, ररडक्शन एवं ररफाइनमेंट) के दिद्धांतो ंके अनुपािन को दवदनदियष्ट रूप िे िक्तिदित दकया िाएगा।

(5) आईएईिी द्वारा प्रस्तुत ररपोटों को िदमदत की अगिी उपिब्ध बैिक में िदमदत के िमक्ष रखा िाएगा।

(6) िदमदत या आईएईिी का ििस्य-िदचव, यथाक्तस्थदत, आवेिन को िदमदत या आईएईिी के िमक्ष अनुमदत के दिए रखवाएगा और िदमदत या आईएईिी, आवेिन की िंवीक्षा करने के पश्चात् यदि िंतुष्ट हो, तो स्थापन को अनुमदत प्रिान कर िके गा, दििमें उि प्रिादत का नाम और उन पशुओ ंकी िंख्या दवदनदियष्ट होगी दिन्हें दवदशष्ट प्रयोग करने के दिए प्राप्त या उपयोग दकया िा िके गा।

(7) िदमदत या आईएईिी, पशुओ ं पर प्रयोग करने की अनुमदत प्रिान करते िमय, ऐिी शतें अदिरोदपत कर िके गी दिन्हें वह पशुओ ं को प्रयोग करने िे पहिे, प्रयोग के िौरान या उिके पश्चात् अनावश्यक पीड़ा या कष्ट िे बचाने के दिए उपयुि िमझे।

(8) िदमदत प्रयोग की िमाक्तप्त पर, दििके दिए अनुमदत प्रिान की गई थी, ऐिी िानकारी मांग िके गी, िैिी वह अपेदक्षत िमझे, परंतु वह िानकारी पशुओ ंके कल्ाण तक िीदमत होगी।

(9) प्रयोग करने वािा प्रिान अन्वेिक अनुिूची IV के अनुिार िूचना का रखरखाव करेगा, दििे प्रयोग की िमाक्तप्त के तुरंत बाि दनिायररत आईएईिी की पहिी बैिक में आईएईिी के ििस्य-िदचव को प्रस्तुत दकया िाएगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11

(10) प्रयोग के दिए उपयोग दकए िाने वािे पशु या पशुओ ं को आईएईिी के पशुदचदकत्सक द्वारा अदनवायय रूप िे प्रमादणत दकया िाएगा दक प्रयोग िरि, गंभीर, मध्यम या गैर-आक्रामक प्रकृ दत का है और पशु वांदछत प्रयोग के दिए स्वस्थ एवं उपयुि है।

(11) आईएईिी, पुनरावती या पाठ्यक्रम-आिाररत दशक्षण के प्रयोगो ंकी दकिी श्रेणी के दिए पांच विय िे अदिक की अवदि के दिए, िदमदत द्वारा दवदनदियष्ट ऐिी शतों और आवदिक िमीक्षाओ ं के अिीन अनुमोिन प्रिान कर िके गी:

परंतु िहां पशुओ ं की प्रिादत, िंख्या, प्रयोग की गंभीरता या प्रयोगात्मक प्रदक्रया में कोई महत्वपूणय पररवतयन हो, वहां नया अनुमोिन प्राप्त करना आवश्यक होगा।

12. कावमयको ंकी दक्षिा.—

(1) प्रभारी व्यक्ति या स्थापन का प्रिान यह िुदनदश्चत करेगा दक प्रत्येक प्रिनक, व्यापारी और उपयोगकताय के पाि स्थि पर पयायप्त कमयचारीवृन्द हो।

(2) दनम्नदिक्तखत में िे कोई भी कृ त्य करने िे पहिे कमयचारी पयायप्त रूप िे दशदक्षत और प्रदशदक्षत होगं े:— (क) पशुओ ंपर प्रयोग करना; (ख) प्रयोगो ंऔर पररयोिनाओ ंका अदभकल्प करना; (ग) पशुओ ंकी िेखभाि करना; या (घ) पशुओ ं को मानवीय रूप िे मृत्यु प्रिान करना। दटप्पणी: स्थापन दशक्षा, अनुभव, पशुदचदकत्सक के रदिस्टरीकरण और प्रदशक्षण के िमथयन में िमुदचत िस्तावेिो ंका रखरखाव करेगा।

(3) खंड (ख) में दनदियष्ट कृ त्य करने वािे व्यक्तियो ंको दकए िा रहे कायय िे िंबंदित वैज्ञादनक दविय में प्रदशक्षण प्राप्त होना चादहए और उन्हें प्रिादत-दवदशष्ट ज्ञान होना चादहए।

(4) खंड (क), (ग) या (घ) में दनदियष्ट कृ त्य करने वािे कमयचाररयो ंको तब तक अपने कायों के दनष्पािन में पययवेक्षण में रखा िाएगा िब तक उन्होनं े अपेदक्षत िक्षता प्रिदशयत न कर िी हो।

(5) स्थापन प्रादिकरण या अन्य िािनो ं के माध्यम िे यह िुदनदश्चत करेगा दक इि पैरा में दनिायररत अपेक्षाएं पूरी की गई हैं।

(6) स्थापन दशक्षा और प्रदशक्षण तथा पैरा 2 में दनिायररत कृ त्यो ंके दिए अपेदक्षत िक्षता प्राप्त करने, बनाए रखने और प्रिदशयत करने के िंबंि में न्यूनतम अपेक्षाएं प्रकादशत करेगा।12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

13. कावमयको ंके वलए विवशष्ट अपेक्षाएं.—

(1) प्रभारी व्यक्ति या स्थापन का प्रिान यह िुदनदश्चत करेगा दक प्रत्येक प्रिनक, व्यापारी और उपयोगकताय के पाि स्थि पर एक या अदिक ऐिे व्यक्ति हो,ं िो— (क) स्थापन में पशुओ ंके कल्ाण और िेखभाि की दनगरानी के दिए उत्तरिायी हो;ं (ख) यह िुदनदश्चत करें दक पशुओ ं के िाथ कायय करने वािे कमयचाररयो ंको स्थापन में रखी गई प्रिादतयो ंिे िंबंदित िूचना उपिब्ध हो;

(ग) यह िुदनदश्चत करने के दिए उत्तरिायी हो ं दक कमयचारी पयायप्त रूप िे दशदक्षत, िक्षम और दनरंतर प्रदशदक्षत हो ं तथा िब तक वे अपेदक्षत िक्षता प्रिदशयत न कर िें तब तक उनका पययवेक्षण दकया िाए।

(2) प्रभारी व्यक्ति या स्थापन का प्रिान यह िुदनदश्चत करेगा दक कादमयक— (क) प्रयोग के िौरान पशु को िी िा रही दकिी अनावश्यक पीड़ा, कष्ट, व्यथा या स्थायी क्षदत को रोकें ; और (ख) यह िुदनदश्चत करें दक पररयोिनाएं, पररयोिना के प्रादिकरण या आईएईिी या िीिीएिईए को भेिे गए आवेिन अथवा आईएईिी या िीिीएिईए द्वारा दिए गए दकिी दनणयय के अनुिार िंचादित की िाएं और अनुपािन न होने की क्तस्थदत में उिे िीक करने के दिए उदचत उपाय दकए िाएं तथा उनका अदभिेख रखा िाए।

14. नावमि पशुवचवकत्सक.—

(1) स्थापन का प्रभारी व्यक्ति यह िुदनदश्चत करेगा दक प्रत्येक प्रिनक और उपयोगकताय ने पशुओ ं के कल्ाण और उपचार के िंबंि में ििाह िेने तथा उिकी दनगरानी करने के दिए एक पशुदचदकत्सक दनयुि दकया है।

(2) िभी प्रयोग पशुदचदकत्सक के पययवेक्षण में दकए िाएंगे।

15. प्रयोगो ंके वलए प्रवियाएं.—

(1) िीिीएिईए िमय-िमय पर पशुओ ं पर प्रयोग, प्रिनन या व्यापार के िंबंि में दवस्तृत आिेश या दिशादनिेश िारी करेगा, तादक प्रयोग िे पहिे, प्रयोग के िौरान और प्रयोग के पश्चात् होने वािी उनकी पीड़ा और कष्ट को कम दकया िा िके , दििमें पुनवायि और पुनः उपयोग भी शादमि हैं।

(2) िीिीएिईए प्रयोग के िौरान और प्रयोग के पश्चात् पशुओ ंको रखने के दिए स्थापन द्वारा अपनाए िाने वािे पशु कल्ाण के दवदशष्ट मानक भी दवदहत करेगा, िो स्थापन पर आबद्धकारी होगं े।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 13

(3) स्थापन ऐिा कोई प्रयोग नही ंकरेगा अथवा ऐिे दकिी रिायन या अदभकताय का उपयोग नही ंकरेगा िो दकिी प्रादिकारी द्वारा प्रदतबंदित हो और परीक्षण के दिए आवश्यक न हो।

(4) िहां तक िंभव हो, प्रयोग के अंदतम दबंिु के रूप में मृत्यु िे बचा िाएगा और इिके स्थान पर प्रारंदभक तथा मानवीय अंदतम दबंिुओ ंको अपनाया िाएगा। यदि अंदतम दबंिु के रूप में मृत्यु को टािना िंभव न हो, तो प्रयोग इि प्रकार अदभकक्तल्पत दकया िाएगा दक—

(a) पशुओ ं की मृत्यु की िंख्या को यथािंभव न्यूनतम दकया िाए; और

(b) पशु के कष्ट की अवदि और तीव्रता को यथािंभव न्यूनतम दकया िाए, तादक पीड़ारदहत मृत्यु िुदनदश्चत हो िके ;

(c) प्रत्येक स्थापन एक पृथक, मानवीय रूप िे मृत्यु प्रिान करने का रदिस्टरी का रखरखाव करेगा, दििमें तारीख, प्रिादत, उपयोग की गई िटीक दवदि/रािायदनक अदभकताय, मात्रा, िमाक्तप्त का कारण तथा कायय दनष्पादित करने वािे अन्वेिक और नादमत पशुदचदकत्सक िोनो ंके िह-हस्ताक्षर का दववरण होगा।

16. संस्थागि पशुनैविक सवमवि (आईएईसी) का गठन.—

(1) प्रत्येक स्थापन प्रयोग, प्रिनन, आवाि और व्यापार के दनयंत्रण तथा पययवेक्षण के दिए अदनवायय रूप िे नौ ििस्यो ं की एक िदमदत गदित करेगा, दििकी वैिता तीन विय की होगी।

(2) आईएईिी के गिन में एक िीवदवज्ञानी, दवदभन्न िैदवक दवियो ंिे िो वैज्ञादनक, पशुओ ंकी िेखभाि में िंिग्न एक पशुदचदकत्सक और िंबंदित स्थापन की पशु िुदविा का प्रभारी वैज्ञादनक शादमि होगं े। िीिीएिईए, आईएईिी में एक मुख्य नामदनिेदशत ििस्य, एक दिंक नामदनिेदशत ििस्य, िंस्थान िे बाहर के एक वैज्ञादनक और एक िामादिक रूप िे िागरूक नामदनिेदशत ििस्य को नामदनिेदशत करेगा।

(3) िीिीएिईए के नामदनिेदशत ििस्यो ंका चयन िीिीएिईए द्वारा िमुदचत प्रदक्रया के पश्चात् चयदनत नामदनिेदशत ििस्यो ंकी िूची में िे दकया िाएगा।

(4) स्थापन, िीिीएिईए द्वारा नामदनिेदशत ििस्यो ंको छोड़कर, आईएईिी के आंतररक ििस्यो ंमें िे अध्यक्ष और ििस्य-िदचव को नामदनिेदशत करेगा।

(5) उपयुयि आईएईिी ििस्यो ंके अदतररि, रेदडयोिमी पिाथों और घातक िूक्ष्मिीवो ंिैिे खतरनाक अदभकतायओ ं का उपयोग करने वािी दवशेि पररयोिनाओ ं की िमीक्षा करते िमय िंबंदित क्षेत्र के एक दवशेिज्ञ को िहयोदित दकया िाएगा। िहयोदित ििस्य आईएईिी के दनणयय िेने का भाग नही ंहोगा, तथादप आईएईिी द्वारा कोई दनणयय िेने िे पहिे उिकी ििाह को गंभीरता िे दिया िाएगा।

(6) ऐिे व्यापाररयो ंके दिए आईएईिी अपेदक्षत नही ंहोगा िो पशुओ ंको प्रिनको ंिे उपयोगकतायओ ंको दबना पशुओ ं को आवाि प्रिान दकए आपूदतय करने का कायय करेंगे ।14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

17. आईएईसी के कारबार का संचालन.—

(1) आईएईिी का अध्यक्ष एक कै िेंडर विय में आईएईिी की कम-िे-कम िो बैिकें बुिाएगा, दििमें कै िेंडर विय के प्रत्येक अियभाग में कम-िे-कम एक बैिक आयोदित की िाएगी।

(2) आईएईिी की बैिक की गणपूदतय छह ििस्यो ंकी होगी, दििमें मुख्य नामदनिेदशत ििस्य और िामादिक रूप िे िागरूक नामदनिेदशत ििस्य की उपक्तस्थदत अदनवायय होगी।

(3) मुख्य नामदनिेदशत ििस्य द्वारा आईएईिी के अध्यक्ष को दिक्तखत रूप में अपनी अनुपिब्धता िे अवगत कराने की क्तस्थदत में दिंक नामदनिेदशत ििस्य दकिी भी आईएईिी बैिक में भाग िे िके गा।

(4) गणपूदतय के दबना आईएईिी की बैिको ंमें दिया गया कोई भी दनणयय अदवदिमान्य माना िाएगा।

(5) अध्यक्ष आईएईिी की बैिक के काययवृत्त को आईएईिी की बैिक की तारीख िे पंद्रह दिनो ं के भीतर अनुिूची V के अनुिार वेब पोटयि के माध्यम िे प्रस्तुत करने के दिए उत्तरिायी होगा।

18. वकए गए प्रयोगो ंका अवभलेख रखना.—

(1) प्रत्येक स्थापन प्रयोगो ं में उपयोग दकए गए पशुओ ं के अदभिेख अनुिूची IV में, प्रयोग के दिए प्रिदनत या प्राप्त पशुओ ंके अदभिेख अनुिूची VI में तथा बेचे या अंतररत दकए गए पशुओ ंके अदभिेख अनुिूची VII में रखेगा।

(2) ऐिे िभी अदभिेख िदमदत या िदमदत द्वारा िमय-िमय पर प्रादिकृ त दकिी अन्य अदिकारी को दनरीक्षण के दिए उपिब्ध कराए िाएंगे।

19. प्रयोगो,ं प्रजनन, आिासन और व्यापार के वलए पशुओ ंका रख-रखाि.—

(1) िदमदत पशुओ ंके रख-रखाव के दिए तकनीकी मानिंड, दििमें उनके आवाि के तकनीकी दवदनिेश भी शादमि हैं, दवदहत करेगी, दििमें दनम्नदिक्तखत व्यापक दिशादनिेश शादमि होगं े, दकं तु इन्ही ंतक िीदमत नही ंहोगं े:—

(a) पशुगृह शांत वातावरण में क्तस्थत होगं े, िहां यातायात िे व्यविान न हो, और पररिर स्वच्छ तथा स्वास्थ्यकर रखा िाएगा तथा पशुओ ं को िूखे तथा चरम मौिम की पररक्तस्थदतयो ंिे िंरक्षण प्रिान दकया िाएगा ।

(b) छोटे पशुओ ं के दिए दपंिरे और बड़े पशुओ ं के दिए अस्तबि इि प्रकार बनाए िाएंगे दक पशुओ ं को आराम दमिे और उनमें अत्यदिक भीड़ न हो।

(c) िहां िदमदत द्वारा मानक दनिायररत दकए गए हो,ं वहां दपंिरे और, यथाक्तस्थदत, अस्तबि उन मानको ं के अनुरूप होगं े।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 15

(d) पशु प्रयोग में उपयोग की िाने वािी दवदभन्न प्रिादतयो ं के आवाि, आहार और रखरखाव के दिए िदमदत द्वारा अदििूदचत दवस्तृत दवदनिेशो ंका रदिस्टरीकृ त स्थापन द्वारा अनुपािन दकया िाएगा।

(e) प्रत्येक स्थापन प्रिादत-दवदशष्ट पयायवरणीय िंवियन और व्यवहारगत आवश्यकताएं उपिब्ध कराएगा।

(f) बड़े पशुओ ंको रखने वािे स्थापन, यथाक्तस्थदत, प्रिादत-दवदशष्ट व्यायाम और पुनवायि क्षेत्र का रखरखाव करेंगे।

(2) िोक्तखम िमूह III या IV के अदभकतायओ ं के िंपकय में आए पशुओ ं को रखने वािे रदिस्टरीकृ त स्थापन प्रमादणत दिशात्मक वायु प्रवाह और ऋणात्मक िाब की अखंडता बनाए रखेंगे, दििके अिीन अदनवायय दडदिटि िॉदगंग और दकिी दवशेिज्ञ िैविुरक्षा अदभयंता द्वारा वादियक ित्यापन दकया िाएगा।

20. स्थापन द्वारा ररपोटय प्रस्तुि करना.— प्रिनक-व्यापारी प्रत्येक विय 31 माचय िे पहिे अनुिूची VII में उक्तल्लक्तखत दवदहत प्ररूप में पशुओ ं के व्यापार िे िंबंदित िूचना प्रस्तुत करेगा या िदमदत द्वारा िमय-िमय पर मांगी गई कोई अन्य िूचना प्रस्तुत करेगा।

21. प्रयोग के वलए पशुओ ंका अंिरण और अवधप्राप्तप्त.—

(1) इन दनयमो ं के अिीन कोई भी रदिस्टरीकृ त प्रिनक, उपयोगकताय या स्थापन के वि िीिीएिईए के िाथ रदिस्टरीकृ त प्रिनक, स्थापन या व्यापारी िे ही दकिी पशु का अंतरण, दवक्रय या अदिप्राक्तप्त करेगा।

(2) दकिी दवदशष्ट प्रकार के पशुिन और कृ दि पशुओ ं (िैगोमॉफय के स्तर िे ऊपर), मछदियो ं और पदक्षयो ं की रदिस्टरीकृ त प्रिनको ंया व्यापाररयो ंिे अनुपिब्धता की क्तस्थदत में, ऐिे पशु आईएईिी के पूवय अनुमोिन और िस्तावेिो ं के रखरखाव के िाथ गैर-रदिस्टरीकृ त स्थापन या खुिे बािार िे प्राप्त दकए िा िकते हैं, परंतु ऐिे पशुओ ंको प्रयोग िे पहिे िीिीएिईए के दिशादनिेशो ं के अनुिार पशुदचदकत्सक द्वारा प्रमादणत अदनवायय िंगरोि और क्तस्थरीकरण अवदि िे गुिरना होगा।

(3) िेश में उपिब्ध न होने वािे पशुओ ंको प्रचदित आयात-दनयायत नीदतयो/ं दिशादनिेशो ंके उपबंिो ंके अनुिार िेश के बाहर िे प्राप्त करने की अनुमदत िी िा िके गी।

22. पशुओ ंपर संविदा अनुसंधान.— इन दनयमो ं में पररभादित न दकए गए कोई अनुिंिान िंस्थान या अदभकरण भी पशुओ ं िे िंबंदित अनुिंिान गदतदवदियो ंको िीिीएिईए के अिीन दवदिवत् रदिस्टरीकृ त स्थापन को आउटिोिय कर िकते हैं।

23. निीकरण.—

(1) िीिीएिईए के िाथ रदिस्टरीकृ त प्रत्येक स्थापन का प्रत्येक तीन विय के पश्चात् आईएईिी के पुनगयिन के िाथ नवीकरण दकया िाना आवश्यक होगा।16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(2) नवीकरण पर दवचार करते िमय िीिीएिईए, स्थापन द्वारा दपछिे तीन विों िे दनयदमत रूप िे प्रस्तुत आईएईिी की बैिको ं के काययवृत्त के िाथ-िाथ अनुिूची VIII में नामदनिेदशत ििस्य द्वारा प्रस्तुत पशुगृह िुदविा की वादियक दनरीक्षण ररपोटों तथा, यथाक्तस्थदत, दपछिे तीन विों के दिए अनुिूची IX में प्रस्तुत बड़े पशुओ ं के उपयोग के वादियक दववरण पर दवचार करेगा।

24. स्थापन का आिवधक वनरीक्षण.—

(1) मुख्य नामदनिेदशत ििस्य और िामादिक रूप िे िागरूक नामदनिेदशत ििस्य के दिए यह आबद्धकारी होगा दक वे बैिक के अदतररि, विय में कम-िे-कम िो बार आवदिक दनरीक्षण करें, तादक पशुगृह का िीिीएिईए के दिशादनिेशो ंके अनुपािन तथा स्थापन में रखे गए पशुओ ंके कल्ाण के िंबंि में दनरीक्षण दकया िा िके ।

(2) मुख्य नामदनिेदशत ििस्य ऐिे दनरीक्षण की ररपोटय इन दनयमो ंके िाथ िंिग्न अनुिूची VIII के प्ररूप के अनुिार प्रस्तुत करेगा।

(3) िीिीएिईए के दनयमो,ं दिशादनिेशो ं या उपबंिो ं के दकिी उल्लंघन की क्तस्थदत में, यथादवदनदियष्ट कारयवाई की िाएगी।

25. रवजस्ट्रीकरण को वनलंवबि या प्रविसंहररि करने की शप्ति.—

(1) दनयम 24 के अनुिार मुख्य नामदनिेदशत ििस्य या िामादिक रूप िे िागरूक नामदनिेदशत ििस्य िे प्राप्त आवदिक दनरीक्षण ररपोटय के आिार पर अथवा दकिी व्यक्ति या िंगिन द्वारा की गई ऐिी दशकायत के आिार पर, दििका दनरीक्षण के माध्यम िे ित्यापन दकया गया हो, यदि यह दवश्वाि करने का कारण हो दक अदिदनयम या दनयमो ं के उपबंिो ंका उल्लंघन दकया गया है, तो िदमदत—

(a) गैर-अनुपािन की प्रकृ दत को दवदनदियष्ट करते हुए और िूचना िारी दकए िाने की तारीख िे 15 दिनो ं के भीतर िुिारात्मक कारयवाई करने की अपेक्षा करते हुए कदमयो ंके िंबंि में िूचना िारी करेगी;

(b) िहां स्थापन 15 दिनो ं के भीतर बताई गई कमी का अनुपािन करने में दवफि रहता है या िहां छह महीने के भीतर उल्लंघन की पुनरावृत्त घटनाएं हुई हैं, वहां िदमदत, स्थापन को िुनवाई का युक्तियुि अविर प्रिान करने के पश्चात्, रदिस्टरीकरण को दनिंदबत या प्रदतिंहररत कर िके गी;

(c) उप-दनयम (1) में दकिी बात के होते हुए भी, िहां िदमदत िंतुष्ट है दक गैर-अनुपािन दकिी दवदशष्ट पररयोिना या प्रोटोकाि या इकाई या िुदविा तक िीदमत है, वहां वह उि स्थापन की ऐिी पररयोिना या प्रोटोकाि या इकाई या िुदविा तक ही दनिंबन या प्रदतिंहरण को िीदमत कर िके गी और अप्रभादवत तथा अनुपािनकारी गदतदवदियो ं को ऐिी शतों और बढ़ी हुई मानीटरी के अिीन चािू रखने की अनुमदत िे िके गी, िैिा दक वह उदचत िमझे;

(d) दनयम 25 की कोई बात िदमदत को, िंपूणय रूप िे या आंदशक रूप िे, तत्काि दनिंबन या प्रदतिंहरण का आिेश िेने िे नही ंरोके गी, िहां वह िंतुष्ट हो दक पशुओ ंके िीवन, स्वास्थ्य या कल्ाण के दिए आिन्न िोक्तखम दवद्यमान है।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 17

26. अपील.—

(1) िदमदत के दकिी दनणयय िे व्यदथत स्थापन, यदि ऐिा चाहे, तो दनणयय प्राप्त होने की तारीख िे तीि दिनो ंके भीतर िीिीएिईए के प्रशािदनक मंत्रािय के िदचव के िमक्ष अपीि िायर कर िके गा।

(2) प्रशािदनक मंत्रािय का िदचव, दशकायत प्राप्त होने पर, यदि ऐिा उदचत िमझे, तो व्यदथत स्थापन को िूचना िेने के पश्चात्, स्वयं या दकिी िदमदत के माध्यम िे दशकायत की िुनवाई करेगा और दिक्तखत रूप में कारणो ं का उल्लेख करते हुए अपीि को अस्वीकार या स्वीकार करने का दनणयय करेगा।

(3) प्रशािदनक मंत्रािय के िदचव का दनणयय दशकायत के िंबंि में अंदतम दनणयय माना िाएगा। [फा. िं. 2. सरल (Mild): ऐिे पशुओ ंपर दकए िाने वािे प्रयोग, दिनमें अल्पकादिक िरि पीड़ा, कष्ट या तनाव अनुभव होने की िंभावना हो, िाथ ही ऐिे प्रयोग दिनमें पशुओ ं के कल्ाण या िामान्य िशा में कोई महत्वपूणय हादन होने की िंभावना न हो, उन्हें ‘िरि’ के रूप में वगीकृ त दकया िाएगा।

3. मध्यम (Moderate): ऐिे पशुओ ं पर दकए िाने वािे प्रयोग, दिनके पररणामस्वरूप पशुओ ं को अल्पकादिक मध्यम पीड़ा, कष्ट या तनाव अथवा िीघयकादिक िरि पीड़ा, कष्ट या तनाव अनुभव होने की िंभावना हो, िाथ ही ऐिे प्रयोग दिनिे पशुओ ं के कल्ाण या िामान्य िशा में मध्यम हादन होने की िंभावना हो, उन्हें ‘मध्यम’ के रूप में वगीकृ त दकया िाएगा।

4. गंभीर (Severe): ऐिे पशुओ ं पर दकए िाने वािे प्रयोग, दिनके पररणामस्वरूप पशुओ ं को गंभीर पीड़ा, कष्ट या तनाव अथवा िीघयकादिक मध्यम पीड़ा, कष्ट या तनाव अनुभव होने की िंभावना हो, िाथ ही ऐिे प्रयोग दिनिे पशुओ ंके कल्ाण या िामान्य िशा में गंभीर हादन होने की िंभावना हो, उन्हें ‘गंभीर’ के रूप में वगीकृ त दकया िाएगा। खंड II : वनधायरण के मानदंड गंभीरता की श्रेणी दनिायररत करते िमय दकिी पररभादित प्रयोग के अंतगयत पशु पर दकए िाने वािे दकिी भी हस्तक्षेप या हेरफे र को ध्यान में रखा िाएगा। यह वगीकरण िभी उपयुि ररफाइनमेंट तकनीको ं को िागू करने के पश्चात् दकिी व्यक्तिगत पशु द्वारा अनुभव दकए िाने वािे िंभादवत िबिे गंभीर प्रभावो ंपर आिाररत होगा। दकिी प्रयोग को दकिी दवशेि श्रेणी में दनिायररत करते िमय प्रयोग के प्रकार तथा कई अन्य कारको ंपर दवचार दकया िाना चादहए। इन िभी कारको ंपर प्रत्येक मामिे के आिार पर दवचार दकया िाएगा। प्रयोग िे िंबंदित कारको ंमें दनम्नदिक्तखत शादमि होगं े:—

(i) दकए िाने वािे हस्तक्षेपो ंतथा पशुओ ं के िाथ दकए िाने वािे हस्त-प्रबंिन एवं व्यवहार का प्रकार;38 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(ii) प्रयोग के िभी घटको ंके कारण होने वािी पीड़ा, कष्ट, तनाव या िीघयकादिक हादन की प्रकृ दत तथा उिकी तीव्रता, अवदि, आवृदत्त और प्रयुि तकनीको ंकी बहुिता;

(iii) दकिी प्रयोग के िौरान होने वािा िंचयी कष्ट;

(iv) प्राकृ दतक व्यवहार व्यि करने िे रोकना, दििमें आवाि, पशुपािन और िेखभाि िंबंिी मानको ं पर प्रदतबंि शादमि हैं। नीचे दवदभन्न प्रकार के प्रयोगो ं के उिाहरण दिए गए हैं। तथादप, प्रयोग की अंदतम गंभीरता श्रेणी दनिायररत करने के प्रयोिन के दिए दनम्नदिक्तखत अदतररि कारको ंपर भी, प्रत्येक मामिे के आिार पर, दवचार दकया िाएगा:—

(v) प्रिादत और िीनोटाइप का प्रकार;

(vi) पशु की पररपक्वता, आयु और दिंग;

(vii) प्रयोग के िंबंि में पशु का प्रदशक्षण अनुभव;

(viii) यदि पशु का पुनः उपयोग दकया िाना है, तो दपछिे प्रयोगो ंकी वास्तदवक गंभीरता;

(ix) पीड़ा, कष्ट और तनाव को कम करने या िमाप्त करने के दिए प्रयुि दवदियां, दििमें आवाि, पशुपािन और िेखभाि की क्तस्थदतयो ंका ररफाइनमेंट शादमि है;

(x) मानवीय अंदतम दबंिु। खंड III : गंभीरिा के िगीकरण के आधार पर विवभन्न प्रयोगो ंके उदाहरण

1. अपुनः प्राप्तप्त: (क) पशुओ ंपर िैप्रोस्कोदपक और रोबोदटक शल् दचदकत्सा का प्रदशक्षण; (ख) उच्च-तकनीकी प्रमुख आक्रामक शल् दचदकत्सा का प्रदशक्षण।

2. सरल: (क) मृत्यु काररत करने के एकमात्र प्रयोिन को छोड़कर दनश्चेतना का प्रशािन;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 39 (ख) फामायकोकाइनेदटक अध्ययन, दििमें एकि खुराक िी िाती है और िीदमत िंख्या में रि के नमूने दिए िाते हैं (पररिंचारी रि की कु ि मात्रा के 10 प्रदतशत िे कम) तथा पिाथय िे दकिी भी ज्ञात प्रदतकू ि प्रभाव की अपेक्षा नही ंहै;

(ग) उपयुि शमन या दनश्चेतना के िाथ पशुओ ंकी गैर-आक्रामक इमेदिंग, िैिे MRI; (घ) प्रेक्षणात्मक अध्ययन (गैर-आक्रामक प्रयोग); (ङ) तनाव उत्पन्न दकए दबना व्यवहार िंबंिी अध्ययन; (च) आहार या पोिण िंबंिी अध्ययन (दनयदमत आहार);

(छ) दबना दकिी अिुदविा के नमूना िेना, िैिे गैर-आक्रामक मानीटरी; (ि) पहिे िे अनुमोदित/बािार में उपिब्ध औिदियो ंका उपयोग (मानक खुराक); (झ) ितही प्रयोग, िैिे कान और पूंछ की बायोप्सी, शल्दक्रया के दबना त्वचा के नीचे दमनी-पंप और टरांिपोडं र का प्रत्यारोपण;

(ञ) बाहरी टेिीमेटरी उपकरणो ंका प्रयोग, दिनिे पशुओ ंको के वि मामूिी हादन या िामान्य गदतदवदि और व्यवहार में मामूिी हस्तक्षेप होता है; (ट) त्वचा के नीचे, अंतः पेशीय, अंतः पेररटोदनयि मागों िे, गैवेि द्वारा तथा ितही रि वादहकाओ ं के माध्यम िे अंतः दशरा पिाथों का प्रशािन, िहां पिाथय का पशु पर िरि िे अदिक प्रभाव न हो तथा मात्रा पशु के आकार और प्रिादत के दिए उपयुि िीमा के भीतर हो;

(ि) आनुवंदशक रूप िे पररवदतयत पशुओ ंका प्रिनन, दिििे िरि प्रभाव वािे फीनोटाइप के उत्पन्न होने की िंभावना हो; (ड) ऐिे िंशोदित आहार का िेना िो पशुओ ं की िभी पोिण िंबंिी आवश्यकताओ ं को पूरा नही ंकरता हो और दिििे अध्ययन की िमयावदि में िरि नैिादनक अिामान्यता उत्पन्न होने की िंभावना हो;

(ढ) चयापचय दपंिरो ंमें अल्पकादिक (24 घंटे िे कम) प्रदतबंि; (ण) िामादिक िहयोदगयो ं िे अल्पकादिक वंचन तथा िामादिक प्रिादतयो ं के वयस्क चूहो ं या मूिको ं को अल्पकादिक एकि दपंिरे में रखना; (त) ऐिे मॉडि दिनमें पशुओ ं को ऐिी हादनकारक उद्दीपनाओ ं के िंपकय में िाया िाता है, िो थोड़े िमय के दिए िरि पीड़ा, कष्ट या तनाव िे िुड़ी हो ंऔर दिनिे पशु बच िकते हो;ं40 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (थ) दनम्नदिक्तखत उिाहरणो ंके िंयोिन या िंचयन के पररणामस्वरूप प्रयोग को ‘िरि’ के रूप में वगीकृ त दकया िा िकता है:—

(i) न्यूनतम प्रदतबंि के िाथ गैर-आक्रामक उपायो ंद्वारा शरीर की िंरचना का आकिन;

(ii) अभ्यस्त पशुओ ं पर न्यूनतम या दबना दकिी प्रदतबंि के गैर-आक्रामक तकनीको ंद्वारा ECG की मानीटरी;

(iii) बाहरी टेिीमेटरी उपकरणो ंका प्रयोग, दिनिे िामादिक रूप िे अनुकू दित पशुओ ंको कोई हादन होने की अपेक्षा न हो तथा िामान्य गदतदवदि और व्यवहार में कोई हस्तक्षेप न हो;

(iv) आनुवंदशक रूप िे पररवदतयत पशुओ ं का प्रिनन, दिनमें दचदकत्सकीय रूप िे पता चिने वािे प्रदतकू ि फीनोटाइप की अपेक्षा न हो;

(v) पचे हुए पिाथय के मागय का पता िगाने के दिए आहार में दनक्तिय माकय र दमिाना;

(vi) वयस्क चूहो ंमें 24 घंटे िे कम अवदि के दिए भोिन रोकना;

(vii) ओपन फील्ड परीक्षण।

3. मध्यम: (क) ऐिे ट्यूमर उत्पन्न करना अथवा स्वतः उत्पन्न होने वािे ट्यूमर, दिनिे िरि रूप िे पता चिने वािे नैिादनक प्रदतकू ि प्रभाव होते हैं, िैिे छोटे, त्वचा के नीचे क्तस्थत, गैर-आक्रामक गांिें; तथा ऐिे ट्यूमर मॉडि दिनिे मध्यम पीड़ा या तनाव अथवा िामान्य व्यवहार में मध्यम हस्तक्षेप होने की िंभावना हो;

(ख) मामूिी आक्रामक तकनीकें :

(i) रि िंग्रह (दनयदमत मात्रा);

(ii) मामूिी शल् प्रयोग (दनश्चेतना के िाथ); (ग) ज्ञात और प्रदतवती प्रभाव वािे अध्ययन; (घ) दनम्नदिक्तखत का परीक्षण:

(i) फाइटो-फॉमुयिेशन;

(ii) स्थादपत फामायकोिॉदिकि यौदगक; (ङ) िोक्तखम िमूह I–II रोगिनको ंिे िंबंदित अध्ययन; (च) अनुमोदित पररक्तस्थदतयो ंमें अल्पकादिक प्रदतबंि;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 41 (छ) प्रदतरक्षा प्रणािी के पुनगयिन के िाथ उप-घातक खुराक अथवा अन्यथा घातक खुराक के िाथ दवदकरण या कीमोथेरेपी। प्रदतकू ि प्रभाव िरि या मध्यम होने तथा अल्पकादिक (5 दिनो ंिे कम) होने की अपेक्षा होगी;

(ि) आनुवंदशक रूप िे पररवदतयत पशुओ ं का प्रिनन, दिििे मध्यम प्रभाव वािे फीनोटाइप के उत्पन्न होने की िंभावना हो; (झ) शल् प्रयोगो ंके माध्यम िे आनुवंदशक रूप िे पररवदतयत पशुओ ं का दनमायण; (ञ) चयापचय दपंिरो ंका उपयोग, दििमें िंबी अवदि (अदिकतम 5 दिन) तक गदत पर मध्यम प्रदतबंि हो;

(ट) ऐिे िंशोदित आहार िे िंबंदित अध्ययन िो पशुओ ं की िभी पोिण िंबंिी आवश्यकताओ ं को पूरा नही ंकरते हो ंऔर दिनिे अध्ययन की िमयावदि में मध्यम नैिादनक अिामान्यता उत्पन्न होने की िंभावना हो; (ि) वयस्क चूहो ंमें 48 घंटे के दिए भोिन रोकना;

(ड) पिायन और बचाव प्रदतदक्रयाएं उत्पन्न करना, िहां पशु उद्दीपन िे बचने या पिायन करने में अिमथय हो और दिििे मध्यम तनाव उत्पन्न होने की िंभावना हो।

4. गंभीर: (क) प्रमुख शल् प्रयोग; (ख) ऐिे प्रयोग दिनिे—

(i) महत्वपूणय या िीघयकादिक पीड़ा/तनाव;

(ii) स्थायी दवकिांगता या अंगो ंकी क्षदत होती है; (ग) दनम्नदिक्तखत का उपयोग—

(i) रेदडयोिमी पिाथय;

(ii) पुनिंयोिक DNA / GMO िीव; (घ) िोक्तखम िमूह III/IV रोगिनको ंिे िंबंदित अध्ययन; (ङ) घातक अंदतम - दबंिु वािे अध्ययन या मानवीय रूप िे मृत्यु प्रिान करना - आिाररत प्रोटोकॉि; (च) प्रथम-पशु प्रयोग या अदनदश्चत-िोक्तखम वािे प्रयोगात्मक मॉडि;

(छ) तीव्र खुराक-िीमा दनिायरण अध्ययन, िीघयकादिक दविािता/कैं िरिन्यता परीक्षण, दिनमें गैर-घातक अंदतम- दबंिु हो;ं42 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ि) ऐिे परीक्षण पिाथों का बार-बार प्रयोग, िो मध्यम नैिादनक प्रभाव उत्पन्न करते हैं, तथा कु छ दिनो ं के भीतर दबना मात्रा प्रदतस्थापन के चेतन पशु िे पररिंचारी रि की 10 प्रदतशत िे अदिक मात्रा में रि के नमूने िेना;

(झ) गंभीर अंदतम-दबंिुओ ं वािे दविािता परीक्षण या ऐिे परीक्षण दिनमें मृत्यु अंदतम-दबंिु हो अथवा मृत्यु होने की िंभावना हो और गंभीर पैथोदफदियोिॉदिकि अवस्थाएं उत्पन्न की िाती हो।ं उिाहरण के दिए, एकि खुराक वािा तीव्र दविािता परीक्षण (OECD परीक्षण दिशादनिेश िेखें);

(ञ) िामान्य दनश्चेतना और उपयुि पीड़ाहर उपचार के अिीन शल्दक्रया, दिििे शल्दक्रया के पश्चात् पीड़ा, कष्ट या िामान्य िशा में हादन होने की िंभावना हो। उिाहरणो ंमें थोराकोटॉमी, क्रे दनयोटॉमी, िैपरोटॉमी, ऑदकय डेक्टॉमी, दिम्फै डेनेक्टॉमी, थायरॉयडेक्टॉमी, प्रभावी क्तस्थरीकरण और घाव प्रबंिन िदहत आथोपेदडक शल्दक्रया, प्रभावी अस्वीकृ दत प्रबंिन िदहत अंग प्रत्यारोपण, कै थेटर या िैव-दचदकत्सीय उपकरणो,ं िैिे टेिीमेटरी टरांिमीटर, दमनी-पंप आदि का शल् प्रत्यारोपण शादमि हैं;

(ट) ऐिे उपकरण का परीक्षण, दििके दवफि होने िे पशु को गंभीर पीड़ा, तनाव या मृत्यु हो िकती है, िैिे कादडययक अदिस्ट उपकरण; (ि) ऐिे टीके की शक्ति का परीक्षण, दििमें पशु की िशा में िगातार हादन, मृत्यु की ओर िे िाने वािा प्रगदतशीि रोग तथा िीघयकादिक मध्यम पीड़ा, तनाव या कष्ट हो;

(ड) प्रदतरक्षा प्रणािी के पुनगयिन के दबना घातक खुराक िे दवदकरण या कीमोथेरेपी, अथवा ग्राफ्ट बनाम होस्ट रोग उत्पन्न करने वािे पुनगयिन के िाथ दवदकरण या कीमोथेरेपी; (ढ) ऐिे ट्यूमर उत्पन्न करने वािे मॉडि या स्वतः उत्पन्न ट्यूमर, दिनिे िीघयकादिक मध्यम पीड़ा, तनाव या कष्ट के िाथ प्रगदतशीि घातक रोग होने की िंभावना हो। उिाहरण के दिए, कै शेक्तक्सया उत्पन्न करने वािे ट्यूमर, आक्रामक अक्तस्थ ट्यूमर, मेटास्टेदटक प्रिार उत्पन्न करने वािे ट्यूमर तथा ऐिे ट्यूमर दिन्हें अल्सरेट होने दिया िाता है;

(ण) िामान्य दनश्चेतना के अिीन पशुओ ंमें दकए िाने वािे शल् तथा अन्य हस्तक्षेप, दिनिे गंभीर या िगातार मध्यम शल्ोत्तर पीड़ा, कष्ट या तनाव अथवा पशुओ ं की िामान्य िशा में गंभीर और िगातार हादन होने की िंभावना हो। अक्तस्थर फ्रै क्चर उत्पन्न करना, पयायप्त पीड़ाहर उपचार के दबना थोराकोटॉमी करना अथवा बहु-अंग दवफिता उत्पन्न करने के दिए आघात करना इिके उिाहरण हैं;

(त) ऐिा अंग प्रत्यारोपण, दििमें अंग के अस्वीकृ त होने िे पशु को गंभीर तनाव या िामान्य िशा में हादन होने की िंभावना हो, िैिे िेनोटरांिप्लांटेशन; (थ) ऐिे आनुवंदशक दवकारो ं वािे पशुओ ं का प्रिनन, दिनमें िामान्य िशा में गंभीर और िगातार हादन होने की िंभावना हो, उिाहरण के दिए हंदटंग्टन रोग, मस्कु िर दडस्टरॉफी और िीघयकादिक पुनरावती न्यूराइदटि मॉडि;

(ि) िंबे िमय तक गदत पर गंभीर प्रदतबंि वािे चयापचय दपंिरो ंका उपयोग;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 43 (ि) अपररहायय दवि्युत आघात का प्रयोग, दिििे पशु बच दनकिने में अिमथय हो (िैिे, िीखी हुई अिहायता उत्पन्न करने के दिए);

(न) िामादिक प्रिादतयो,ं िैिे कु त्तो ंऔर गैर-मानव प्राइमेट्ि को िंबी अवदि तक पूणयतः अिग रखना; (प) चूहो ंमें गैक्तस्टरक अल्सर या हृिय दवफिता उत्पन्न करने के दिए क्तस्थरीकरण तनाव; (फ) अंदतम-दबंिु के रूप में थकावट के िाथ व्यायाम परीक्षण।44 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] MINISTRY OF FISHERIES, ANIMAL HUSBANDRY AND DAIRYING (Department of Animal Husbandry and Dairying) (COMMITTEE FOR CONTROL AND SUPERVISION OF EXPERIMENTS ON ANIMALS)

NOTIFICATION New Delhi, the 30th September, 2026 G.S.R. 864(E).—In exercise of the powers conferred by sub-section (1), 1(A) and (2) of Section 17 of Prevention of Cruelty to Animals Act, 1960 (59 of 1960), the Committee for Control and Supervision of Experiments on Animals (hereinafter referred to as ‘Committee’), in supersession of the Experiments on Animals (Control and Supervision) Rules, 1968 vide Ministry of Food and Agriculture, Community Development and Co-operation (Department of Agriculture) notification no. 5-1/68/INS dated 14th September, 1968 and the Breeding of and Experiments on Animals (Control & Supervision) Rules, 1998 vide Ministry of Social Justice and Empowerment notification No. S.O. 1074 dated 15th December, 1998 published in Extraordinary Gazette of India, hereby decided to amend the aforementioned rules, except as respect things done or omitted to be done before such supersession;

DRAFT RULES

1. Short title and commencement. – (1) These rules may be called the Prevention of Cruelty to Animals (Control and Supervision of Experiment, Breeding and Trading of Laboratory Animals) Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

(3) These Rules will establish measures for the protection of animals used for scientific or educational purposes.

(4) To that end, these rules lays down guidelines for the following:

(a) the replacement and reduction of the use of animals in experiments and the refinement of the breeding, accommodation, care and use of animals in experiments;

(b) the origin, breeding, marking, care and accommodation and euthanasia of animals;

(c) the operation of breeders, traders and users;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 45

(d) the evaluation and authorisation of projects involving the use of animals in experiments

(5) These Rules shall apply where animals are used or intended to be used in experiments or bred specifically so that their organs or tissues may be used for scientific purposes.

(6) These Rules shall apply until the animals have been euthanized, rehabilitated to a suitable habitat or husbandry system upon completion of experimentation.

(7) The elimination of pain, suffering, distress or lasting harm by the successful use of anaesthesia, analgesia or other methods shall not exclude the use of an animal in experiments from the scope of these Rules.

(8) These Rules shall apply to live non-human vertebrate animals, including independent feeding larval forms of fishes, embryonated eggs and foetal forms of mammals as from the last third stage of their normal development;

(9) These Rules shall apply to animals used in experiments, which are at an earlier stage of development than that referred to sub-rule 8, if the animal is to be allowed to live beyond that stage of development and, as a result of the experiments performed, is likely to experience pain, suffering, distress or lasting harm after it has reached that stage of development.

(10) These Rules shall not apply to the following:

(a) non-experimental agricultural practices;

(b) non-experimental clinical veterinary practices;

(c) veterinary clinical field trial required for the marketing authorization of a legally approved veterinary medicinal product except test batch and quality control trial for batch manufacturing;

(d) practices undertaken for the purposes of recognised animal husbandry;

(e) practices undertaken for the primary purpose of identification of an animal;

(f) practices not likely to cause pain, suffering, distress or lasting harm equivalent to, or higher than, that caused by the introduction of a needle in accordance with good veterinary practice.

2. Definitions. - In these rules, unless the context otherwise requires,-

(a) “Act” means the Prevention of Cruelty to Animals Act, 1960 (59 of 1960);

(b) “Board” means the Animal Welfare Board of India established under section 4 and as reconstituted from time to time under section 5A of the Act;

(c) “Breeder" means any natural or legal person registered with Committee breeding animals with a view to their use for in-house experiments or for the use of their tissue or organs for scientific purposes or supplying to other registered establishments whether for profit or not;46 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(d) “CCSEA” means the Committee for Control and Supervision of Experiments on Animals established under sub-section (1) of section 15 of the Act, (hereinafter referred to as “Committee);

(e) “Chairman” means the Chairman nominated under sub-section (2) of section 15 of the Act;

(f) "Collaborative Research" means any experiment undertaken between two or more research institutions solely for the purpose of advancement of scientific research for human or animal welfare;

(g) "Contract Research" means any research undertaken by both domestic as well as foreign individual, company, firm, corporation or institution on behalf of an individual, company, firm, corporation or institution for consideration for profit or not;

(h) “Experimentation” means any programme or project involving use of animal for acquisition of knowledge of a biological, physiological, ethological, physical or chemical nature; and includes the use of animal in the production of reagents and products such as antigens and antibodies, routine diagnostics, testing activity and establishment of transgenic stocks, for the purpose of saving or prolonging life or alleviating suffering or significant gains in wellbeing for people of the country or for combating any disease whether of human beings or animals;

(i) "Establishment” means any installation, building, group of buildings or other premises, including a place that is not wholly enclosed or covered and mobile facilities, where laboratory animals are bred, housed, traded or used for experiments.

(j) “Guidelines” means any documents or direction issued by the CCSEA from time to time to carry out the purpose of implementation of the Act or Rules made thereunder;

(k) “Humane Endpoint” means a predetermined criterion that identifies when an animal's pain, suffering, distress, or impairment of well-being has reached a level at which action must be taken to prevent further suffering of animals and terminate the experiment.

(l) "Institutional Animals Ethics Committee" means a body comprising a group of persons recognised and registered by the CCSEA in an establishment which is constituted and operated in accordance with experiments specified for the purpose by the Committee, (hereinafter referred to as “IAEC”);

(m) “Invasive experiment” means any procedure that involves animal restraint, blood collection, injection or any intervention that alters normal anatomy, or causes physiological interference by breaching the body’s natural barriers. Such procedures include, but are not limited to: Surgical interventions, such as organ transplantation, implantation of telemetry devices or catheters; Sample collection including blood or tissue sampling that requires significant incisions or deep punctures beyond routine veterinary practice; and Administration procedures such as repeated oral gavage or deep-tissue injections.

(n) “Laboratory animals” means all vertebrate animals used or intended to be used in experiments[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 47 regulated under these Rules;

(o) “Member” means a Member of the Committee for Control and Supervision of Experiments on Animals;

(p) “Member-Secretary” means the Member-Secretary to the Committee for Control and Supervision of Experiments on Animals;

(q) “Nominee” means the person selected by the Committee as its representative to carry out the work of CCSEA;

(r) “Non-invasive experiment” mean experiments that do not involve any breach of the skin or surgical intervention and shall be employed wherever the scientific objective can be achieved without invasive procedures. Such experiments may include, inter alia, the use of non-invasive imaging techniques for monitoring physiological or pathological changes, the collection of biological samples such as faeces, urine or naturally shed hair for scientific analysis, and behavioural observation or monitoring of animals in non-restrictive environments without causing pain, distress or injury.

(s) “Project” means a programme of work having a defined scientific objective and involving one or more experiments;

(t) "Specified format" means the forms specified for the purpose by the Committee from time to time;

(u) “Trader” means any natural or legal person registered with the Committee, supplying animals to the establishments registered with the Committee, with a view to their use in experiments or for the use of their tissue or organs for scientific purposes, whether for profit or not;

(v) “User” means an establishment registered with Committee using animals in experiments, whether for profit or not;

(w) “Veterinarian” means a person registered with Veterinary Council of India or State Veterinary Council, as the case may be, holding degree from a recognized Veterinary Institution.

3. Replacement, Reduction and Refinement (3Rs). - For the purpose of implementation of principle of replacement, reduction and refinement (3Rs), the registered establishments carrying out the experiment shall ensure.-

(1) that, wherever possible, a scientifically satisfactory method or testing strategy, not entailing the use of live animals, shall be used instead of an experiment;

(2) that the number of animals used in projects is reduced to a minimum necessary to obtain scientifically valid and statistically reliable results without compromising the objectives of the project;48 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(3) that refinement of breeding, accommodation and care, and of methods used in experiments, eliminating or reducing to the minimum any possible pain, suffering, distress or lasting harm to the animals, adequate environmental enrichment, adoption of best veterinary practices and the use of validated humane endpoints.

4. Purposes of Experiments.- Experiments may be carried out for the following purposes

only:

(1) basic research aimed at the advancement of knowledge, including fundamental research in biological, biomedical, behavioural or veterinary sciences.

(2) translational or applied research with one or more of the following aims:

(a) the avoidance, prevention, diagnosis or treatment of disease, ill-health or other pathological conditions or their effects on human beings, animals or plants;

(b) the assessment, detection, regulation or modification of physiological conditions in human beings, animals or plants; or

(c) the welfare of animals and the improvement of the production conditions for animals reared for agricultural purposes;

(3) for any of the aims in sub-rule (2) in the development, manufacture or testing of the quality, effectiveness and safety of drugs, food and feed stuffs and other substances or products;

(4) protection of the natural environment in the interests of the health or welfare of human beings or animals;

(5) research aimed at preservation of the species;

(6) higher education, or professional training for the acquisition, maintenance or improvement of vocational skills;

(7) forensic investigations in accordance with the legal requirement.

(8) Process of bleeding/blood products

5. Category of animals on which the experiment shall be prohibited.-

(1) Specimens of those animals protected under Wildlife (Protection) Amendment Act, 2022, shall not be used in experiments, with the exceptions of those experiments meeting the following

(a) the experiment has one of the purposes referred to in clause (a) of sub-rule (2), sub-rule

(3) or sub-rule ( 5) of Rule 4 of these Rules; and

(b) there is scientific justification to the effect that the purpose of the experiment cannot be achieved using species other than the endangered species;

(c) sub-rule (1) shall not apply to any species of non-human primates;

(d) permission of competent authorities as per applicable law has been granted.

(2) Animals taken from the wild-

(a) Animals taken from the wild shall not be used in experiments unless the Competent authority of the relevant department grants exemptions based on scientific justification to the effect that the purpose of the experiments cannot be achieved by the use of an animal which has been bred for use in experiments;

(b) The capture of animals in the wild shall be carried out only by authorised competent person using methods which do not cause the animals avoidable pain, suffering, distress or lasting harm;

(c) Any animal found during or after capture, injured or in poor health shall be examined by a veterinarian or any other authorized person under the supervision of a veterinarian, and action shall be taken to minimise the suffering of the animal. Competent authorities may grant exemptions from the requirement of taking action to minimise the suffering of the animal if there is scientific justification;

(d) The Committee shall review the use of sourcing non- human primates from self- sustaining colonies as defined in the guidelines of CCSEA.

(3) Stray and feral animals of domestic species.- Stray and feral animals of domestic species shall not be used in experiments provided; the competent authorities may grant exemptions subject to the following conditions.-

(a) there is an essential need for studies concerning the health and welfare of the animals or serious threats to the environment or to human or animal health; and

(b) there is scientific justification to the effect that the purpose of the experiment can be achieved only by using stray or a feral animal.50 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

6. Experiment on non-human primates. - Subject to Rule 5, specimens of non-human primates shall not be used in experiments, except for those experiments meeting the following conditions.-

(1) the experiment has one of the purposes referred to in-

(a) clause (a) of sub-rule (2) or sub-rule (3) of Rule 4 of these Rules is undertaken with a view to the avoidance, prevention, diagnosis or treatment of debilitating or potentially life- threatening clinical conditions in human beings; or

(b) sub-rule (1) or (5) of Rule 4; and

(c) there is scientific justification to the effect that the purpose of the experiment cannot be achieved by the use of species other than non- human primates.

Note: A debilitating clinical condition for the purposes of these Rules means a reduction in a person’s normal physical or psychological ability to function.

(2) Specimens of non-human primates listed in the Wildlife (Protection) Amendment Act, 2022, shall not be used in experiments.

7. Classification of severity of experiments. -

(1) The establishment shall follow the severity of experiment, classified as ‘non-recovery’, ‘mild’, ‘moderate’, or ‘severe’ on a case-by-case basis as set out in Annexure -I

(2) The establishments shall ensure that an experiment is not performed if it involves severe pain, suffering or distress that is likely to be long period and cannot be ameliorated.

8. Requirements for breeders, traders and users.-

(1) No establishment shall carry out the business or house animals for breeding or trading of animals for the purpose of experiments unless it is registered with the CCSEA;

(2) Every breeder, trader or establishment shall apply for registration through existing online

portal developed by CCSEA for carrying out the business of:

(i) breeding animals for the purpose of experiments

(ii) trading of animals for the purpose of experiments,

(iii) breeding and trading animals for the purpose of experiment

(3) The Traders shall ensure that animals bred, procured and housed by the establishment are traded only to the CCSEA registered establishments on approval of the IAEC of the receiving establishment or Committee, as the case may be.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 51

(4) The breeders and traders shall submit quarterly report to IAEC and annual report for each financial year in the prescribed form at schedule VII on or before 31st March of each year to the Committee.

9. Registration of establishments conducting experiments on animals or housing, breeding and trading of animals for experimental purposes. –

(1) No establishment shall perform any experiment on animals or house, breed and/or trade any animal for experiments unless it is registered with the CCSEA as per the provisions under these rule(s).

(2) Every establishment performing experiments on animal(s) or housing, breeding and trading of animals for experimental purposes shall apply for registration, in prescribed format at schedule I through online portal of CCSEA to the Member Secretary with specified fees.

10. Processing of applications.- (1) All the applications submitted as per Rule 9 in the office of

CCSEA shall be processed as under:

(a) The Member-Secretary shall verify the fact by himself or depute nominee of CCSEA or representative of CCSEA for verification of facts mentioned in the application for registration;

(b) After receiving satisfactory report and information in Schedule II, the Member Secretary shall register such establishment;

(c) An establishment shall be duty-bound to comply with the conditions of registration, or any conditions prescribed by the Committee;

(d) The Committee shall take a decision on the registration within specified period as mentioned in the Administrative (Committee for Control and Supervision of Experiments on Animals) Rules, 2023;

(e) The Committee shall communicate the modification of facilities, if needed, before registration and taking the final decision on registration;

(f) Each establishment registered under Committee shall bear a unique registration code and number for each purpose;

(g) The registration certificate issued to the establishment maintaining Animal House Facilities including the IAEC shall remain valid for three years unless its terminated or withdrawn by the establishment or Committee as the case may be.

11. Permission of the Committee required for conducting experiments. –

(1) Every establishment registered with CCSEA shall obtain permission either from the Committee or the Institutional Animals Ethics Committee before conducting experiment, as the case may be;52 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(2) Every establishment, conducting severe and non-recovery experiments as defined under

Rule 7 on animals above the category of rodent and lagomorph, shall apply to CCSEA by providing details in Schedule III through online portal after recommendation of IAEC. Decision on such applications shall be taken by the Committee within thirty working days.

(3) Every establishment conducting experiments which have been defined as mild and moderate including such experiments on all animals, shall submit their application as per Schedule III to the Member Secretary of IAEC for decision on the experiment. Such experiment shall not be referred to the Committee;

(4) In case of approvals on mild and moderate experiments on animals above lagomorphs, the IAEC shall ensure timely and scheduled reporting to the Committee, at a minimum of three stages namely; study initiation, interim progress, and study completion—covering progress, deviations (if any), and compliance with the principles of the 3Rs (Replacement, Reduction, and Refinement), as specified;

(5) Reports submitted by the IAEC shall be placed before the committee at the next available meeting of the Committee;

(6) The Member Secretary of the Committee or the IAEC, shall cause the application for permission to be brought before the Committee or IAEC as the case may be, and the Committee or IAEC after scrutiny of the application, if satisfied, may grant permission to the establishment stating the name of the species and the number of animals that can be acquired or used for carrying out the specific experiment;

(7) The Committee or IAEC while granting permission for conducting experiments on animals, may prescribe conditions as may deem fit to ensure that animals are not subjected to unnecessary pain or suffering before, during or after the performance of experiments on them;

(8) The Committee may seek such information, as it may require but limited to the welfare of the animals, on completion of experiments for which permission was granted.

(9) The principal investigator carrying out experiments shall maintain the information as per Schedule IV which shall be submitted to Member Secretary of the IAEC in the first meeting fixed immediately after completion of experiment;

(10) The animal(s) to be used for experimentation shall mandatorily be certified by the Veterinarian of the IAEC to the effect that the experiments are mild, severe, moderate or non- invasive in nature and the animal is fit for the desired experiment;

(11) The IAEC may grant approval for class of experiment of repetitive or curriculum-based teaching for a period not exceeding five years subject to such conditions and periodic reviews as may be specified by the committee;

Provided that fresh approval shall be required where there is any material change in species, number[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 53 of animals, severity of experiment or experimental procedure.

12. Competency of personnel.-

(1) Person in-charge or Head of the establishments shall ensure that each breeder, trader and user has sufficient staff on site.

(2) The staff should be adequately educated and trained before they perform any of the following functions

(a) carrying out experiments on animals;

(b) designing experiments and projects;

(c) taking care of animals; or

(d) euthanasia of animals.

Note: The establishment shall maintain proper documents in support of education, experience, registration of veterinarian and training.

(3) Persons carrying out the functions referred to in clause (b) shall have received instruction in a scientific discipline relevant to the work being undertaken and shall have species-specific knowledge.

(4) Staff carrying out functions referred to in clause (a), (c) or (d) shall be supervised in the performance of their tasks until they have demonstrated the requisite competence.

(5) Establishment shall ensure, through authorisation or by other means, that the requirements laid down in this paragraph are fulfilled.

(6) Establishment shall publish minimum requirements with regard to education and training and the requirements for obtaining, maintaining and demonstrating requisite competence for the functions set out in paragraph 2.

13. Specific requirements for personnel.-

(1) the Person in-charge or Head of the establishment shall ensure that each breeder, trader and

user has one or several persons on site who shall:

(a) be responsible for overseeing the welfare and care of the animals in the establishment;54 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(b) ensure that the staff dealing with animals have access to information specific to the species housed in the establishment;

(c) be responsible for ensuring that the staff are adequately educated, competent and continuously trained and that they are supervised until they have demonstrated the requisite competence.

(2) Person in charge or Head of establishments shall ensure that personnel shall:

(a) ensure that any unnecessary pain, suffering, distress or lasting harm that is being inflicted on an animal in the course of an experiment is stopped; and

(b) ensure that the projects are carried out in accordance with the project authorisation or, in accordance with the application sent to the IAEC or CCSEA or any decision taken by the IAEC or CCSEA, and ensure that in the event of non-compliance, the appropriate measures to rectify it are taken and recorded.

14. Designated veterinarian. - (1) The person in charge of establishments shall ensure that each breeder and user has appointed a veterinarian to advise and monitor the well-being and treatment of animals.

(2) All experiments shall be performed under the supervision of a veterinarian.

15. Procedures for experiments. - (1) The CCSEA shall issue detailed order or guidelines for experiments, or breeding or trading of an animal from time to time to minimize their pain and sufferings before, during and after the experimentation including rehabilitation and reuse;

(2) The CCSEA shall also prescribe the specific standards for welfare of animals to be followed by the establishment for housing animals during and after the experiment on animals which shall be binding on the establishments;

(3) The establishment shall not perform any experiment or use any chemical or agents which are banned by any authority and not required for testing.

(4) As far as possible, death as the endpoint of an experiment shall be avoided and replaced by early and humane endpoints. If death as the endpoint is unavoidable, the experiment shall be

designed so as to:

(a) minimize the number of deaths of animals as much as possible; and

(b) minimize as much as possible, the duration and intensity of suffering to the animal to ensure a painless death;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 55

(c) every establishment must maintain a dedicated euthanasia registry detailing the date, species, exact method/chemical agent utilized, dosage, reason for termination, and the co- signatures of both the executing investigator and the Designated Veterinarian.

16. Composition of Institutional Animals Ethics Committee (IAEC). – (1) Every establishment shall mandatorily constitute nine members for control and supervision of experiment, breeding, housing and trading which will be valid for three years.

(2) The constitution of IAEC shall include a biologist, two scientists from different biological disciplines, a veterinarian involved in the care of animals, and the scientist in charge of animal facility from the respective establishments. The CCSEA shall nominate a main nominee, link nominee, scientist from outside the institute and socially aware nominee in the IAEC;

(3) The nominees of CCSEA shall be selected from the list of nominees selected by CCSEA after due process;

(4) The establishment shall nominate Chairperson and Member Secretary from amongst the internal members of IAEC except the nominated members by the CCSEA;

(5) In addition to the above IAEC members, a specialist, in the relevant field, shall be co- opted while reviewing special projects using hazardous agents such as radio-active substances and deadly micro-organisms. Though, the co-opted member shall not be part of the decision making of the IAEC, their advice to be taken seriously before making any decision by IAEC.

(6) IAEC shall not be required for Traders involved in supply of animals from breeders to the users without housing of animals.

17. Conduct of business of IAEC.- (1) The Chairperson of IAEC shall convene minimum of two meetings of IAEC in a calendar year, requiring at least one meeting to be held in each half of a calendar year;

(2) The quorum of the IAEC meeting shall be of six members wherein mandatory presence of Main Nominee and Socially Aware Nominee is must;

(3) Link Nominee can attend any IAEC meeting in case Main Nominee conveys his/ her unavailability in writing to the Chairperson of IAEC.

(4) Any decision taken in the meetings of IAEC without quorum shall be considered invalid;

(5) The Chairperson is responsible for submission of minutes of the meeting of IAEC through the web portal within fifteen days from the date of the IAEC meeting as per Schedule V.

18. Record keeping of experiments conducted. –

(1) Every establishment shall maintain the records of animals utilized for Experiments in the56 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Schedule IV, animals bred or acquired for experimentation in the Schedule VI and record of animal sold or transferred in the Schedule VII.

(2) All such records shall be made available for inspection to the Committee or any other officer authorized by the Committee from time to time.

19. Stocking of animals for experiments, breeding, housing and trading. - (1) The Committee shall prescribe technical parameters for stocking of animals including technical specifications for their housing but not limited to the following broad guidelines.-

(a) Animal houses shall be located in a quiet atmosphere undisturbed by traffic, and the premises kept tidy, hygienic and the animals protected from drought and extremes of weather.

(b) Animal cages for small animals and stables for large animals shall be made in such a manner that provides comfort to animals and not overcrowded.

(c) Where standards have been laid down by the Committee, the cages, the stable, as the case may be, shall conform to those standards.

(d) Detailed specifications for housing, feeding and maintenance of various species to be used in animal experimentation as notified by the Committee, shall be adhered by the registered establishment.

(e) Each establishment shall provide species specific environmental enrichment and ethological needs.

(f) Establishment housing large animals must maintain species-specific exercise and rehabilitation area as the case may be.

(2) Registered establishments housing animals exposed to Risk Group III or IV agents must maintain certified directional airflow and negative pressure integrity, subject to mandatory digital logging and annual verification by a specialized biosecurity engineer.

20. Reporting by establishment.- The breeder-trader shall submit information pertaining to trading of animals in the prescribed format as mentioned in the Schedule VII annually before 31st March of every year; or any other information sought by the Committee from time to time.

21. Transfer and acquisition of animals for experiment. – (1) Any registered breeder, user or establishment under these rules shall transfer or sale or acquire any animal from the CCSEA registered breeder, establishment or trader only;

(2) In the event of non-availability of a particular kind of livestock and farm animals (above level of Lagomorpha), fishes and birds, from the registered breeders or traders, they may be procured from non-registered establishments or open market with prior approval of IAEC and maintenance of documents provided such animals undergo a mandatory veterinarian-certified quarantine and[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 57 stabilization period as prescribed by CCSEA guidelines prior to experimentation.

(3) Animals that are not available in the country shall be permitted for sourcing from outside the country as per the provisions of the extant Import-Export policies/guidelines.

22. Contract research on animals. – Any research institutions or agency not defined under the rules may also outsource research activities involving animals to an establishment duly registered under CCSEA.

23. Renewal. - (1) Every establishment registered with CCSEA is required to be renewed after every three years along with the reconstruction of IAEC.

(2) While considering the renewal, the CCSEA shall consider the minutes of IAEC meetings submitted by the establishment regularly for last three years along with the Annual Inspection Reports of the Animal House Facility by the nominee in the Schedule VIII vis-à-vis Annual statement of large animals use (as the case may be) submitted in Schedule IX for last three years.

24. Periodical inspection of the establishment.- (1) It is binding on the main nominee and socially aware nominee to carry out periodical inspections not less than two times in a years, apart from the meeting, to oversee the animal house with regard to their fulfilment of the CCSEA guidelines, welfare of animals housed in the establishment;

(2) The main nominee shall submit such inspection report as per Schedule VIII format annexed to these Rules;

(3) Any violations of the CCSEA rules, guidelines and prescribed standards observed by the main nominee and socially aware nominee shall be reflected in the Minutes of the IAEC meeting and also reported to the CCSEA;

(4) CCSEA shall also depute the inspection team to verify the compliance by the establishment, with prior intimation and such report shall be submitted as per Schedule II format.

25. Power to suspend or revoke registration. – (1) based on the periodical inspection report received from the main nominee or socially aware nominee in accordance with Rule 24 or any complaints made by any person, organization which have been verified through inspections, if there is a reason to believe that the provisions of the act or rules have been contravened, the committee shall.-

(a) issue a deficiency notice specifying the nature of non-compliance and requiring corrective action within 15 days of issuance of notice;

(b) where the establishment fails to comply with the deficiency noticed within 15 days or where repeated instances of violation occurred within six months, the Committee may, and after giving the establishment a reasonable opportunity of being heard, suspend or revoke the registration.58 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(b) Notwithstanding anything contained in sub-rule (1) where the committee is satisfied that the non-compliance is limited to a specific project or protocol or unit or facility, it may restrict suspension or revocation to such project or protocol or unit or facility of the said establishment and permit the continued operation of unaffected and compliant activities subject to such conditions and enhance monitoring as it may deem fit.

(c) Nothing in Rule 25 shall prevent the Committee from ordering immediate suspension or revocation, in whole or in part, where it is satisfied that there exists an imminent risk to the life, health, or welfare of the animals.

26. Appeal. – (1) Establishment aggrieved with any decision of the committee may, if so desire, file an appeal to the Secretary of the Administrative Ministry of CCSEA, within thirty days of receipt of the decision;

(2) The Secretary of the Administrative Ministry on receipt of the grievance, if so desire, shall after giving notice to the aggrieved establishment, hear the grievance, either by himself or herself or through a Committee and decide on the appeal to reject or allow citing the reasons in writing;

(3) The decision of the Secretary of Administrative Ministry shall be treated as final decision regarding the grievance. [F. Section I: Severity categories.-

1. Non-recovery:

Experiments which are performed entirely under general anaesthesia from which the animal shall not recover consciousness shall be classified as ‘non-recovery’.

2. Mild:

Experiments on animals that are likely to experience short-term mild pain, suffering or distress, as well as experiments with no significant impairment of the well-being or general condition of the animals shall be classified as ‘mild’.

3. Moderate:

Experiments on animals as a result of which the animals are likely to experience short-term moderate pain, suffering or distress, or long-lasting mild pain, suffering or distress as well as experiments that are likely to cause moderate impairment of the well-being or general condition of the animals shall be classified as ‘moderate’.

4. Severe:

Experiments on animals as a result of which the animals are likely to experience severe pain, suffering or distress, or long-lasting moderate pain, suffering or distress as well as experiments, that are likely to cause severe impairment of the well-being, or general condition of the animals shall be classified as ‘severe’.

Section II: Assignment criteria.- The assignment of the severity category shall consider any intervention or manipulation of an animal within a defined experiment. It shall be based on the most severe effects likely to be experienced by an individual animal after applying all appropriate refinement techniques.

When assigning an experiment to a particular category, the type of experiment and several other factors should be considered. All these factors should be considered on a case-by-case basis.

The factors related to the experiment shall include:

(i) type of manipulation, handling,

(ii) nature of pain, suffering, distress or lasting harm caused by (all elements of) the experiment, and its intensity, the duration, frequency and multiplicity of techniques employed,

(iii) cumulative suffering within an experiment,[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 79

(iv) prevention from expressing natural behaviour including restrictions on housing, husbandry and care standards.

Examples are given below for the type of experiments. However, for the purposes of the final severity classification of the experiment, the following additional factors, assessed on a case- by-case basis, shall also be considered:

(v) type of species and genotype,

(vi) maturity, age and gender of the animal,

(vii) training experience of the animal with respect to the experiment,

(viii) if the animal is to be reused, the actual severity of the previous experiments,

(ix) the methods used to reduce or eliminate pain, suffering and distress, including refinement of housing, husbandry and care conditions,

(x) humane end-points.

Section III: List of examples of various experiments based on classification of severity.-

1. Non-recovery:

(a) Laparoscopic and Robotic surgery training on animals,

(b) Hi-tech major invasive surgery training.

2. Mild:

(a) administration of anaesthesia except for the sole purpose of killing;

(b) pharmacokinetic study where a single dose is administered and a limited number of blood samples are taken (totaling less than 10 % of circulating volume) and the substance is not expected to cause any detectable adverse effect;

(c) non-invasive imaging of animals (e.g. MRI) with appropriate sedation or anaesthesia;

(d) observational studies (no intervention)

(e) behavioural studies without stress induction

(f) feeding or nutritional studies (routine diets)

(g) sampling without discomfort (e.g., non-invasive monitoring)

(h) use of already approved/marketed drugs (standard dosing)

(i) superficial experiments, e.g. ear and tail biopsies, non-surgical subcutaneous implantation of mini-pumps and transponders;

(j) application of external telemetry devices that cause only minor impairment to the animals or minor interference with normal activity and behaviour;

(k) administration of substances by subcutaneous, intramuscular, intraperitoneal routes, gavage and intravenously via superficial blood vessels, where the substance has no more than mild impact on the animal, and the volumes are within appropriate limits for the size and species of the animal;

(l) breeding of genetically altered animals, which is expected to result in a phenotype with mild effects;

(m) feeding of modified diets that do not meet all the animals’ nutritional needs and are expected to cause mild clinical abnormality within the timescale of the study;

(n) short-term (less than 24h) restraint in metabolic cages;

(o) studies involving short-term deprivation of social partners, short-term solitary caging of adult rats or mice of sociable strains;

(p) models which expose animals to noxious stimuli which are briefly associated with mild pain, suffering or distress, and which the animals can avoid;80 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(q) a combination or accumulation of the following examples may result in classification as ‘mild’:

(i) assessing body composition by non-invasive measures and with minimal restraint;

(ii) monitoring ECG with non-invasive techniques with minimal or no restraint of habituated animals;

(iii) application of external telemetry devices that are expected to cause no impairment to socially adapted animals and do not interfere with normal activity and behaviour;

(iv) breeding genetically altered animals which are expected to have no clinically detectable adverse phenotype;

(v) adding inert markers in the diet to follow passage of digesta;

(vi) withdrawal of food for < 24h in adult rats;

(vii) open field testing.

3. Moderate:

(a) Induction of tumours, or spontaneous tumours, that cause mild detectable clinical adverse effects (e.g. small, subcutaneous, non-invasive nodules); and models of induction of tumours, or spontaneous tumours, that are expected to cause moderate pain or distress or moderate interference with normal behaviour;

(b) Minor invasive techniques: i. Blood collection (routine volumes) ii. Minor surgical experiments (with anaesthesia)

(c) Studies with known and reversible effects

(d) Testing of: i. Phyto-formulations ii. Established pharmacological compounds

(e) Studies involving Risk Group I–II pathogens

(f) Short-term restraint under approved conditions

(g) irradiation or chemotherapy with a sublethal dose, or with an otherwise lethal dose but with reconstitution of the immune system. Adverse effects would be expected to be mild or moderate and would be short-lived (< 5 days);

(h) breeding of genetically altered animals which are expected to result in a phenotype with moderate effects;

(i) creation of genetically altered animals through surgical experiments;

(j) use of metabolic cages involving moderate restriction of movement over a prolonged period (up to 5 days);

(k) studies with modified diets that do not meet all the animals’ nutritional needs and are expected to cause moderate clinical abnormality within the timescale of the study;

(l) withdrawal of food for 48 hours in adult rats;

h. frequent application of test substances which produce moderate clinical effects, and withdrawal of blood samples (> 10 % of circulating volume) in a conscious animal within a few days without volume replacement;

i. toxicity testing with severe end points or where death is the endpoint, or fatalities are to be expected and severe pathophysiological states are induced. For example, single dose acute toxicity testing (see OECD testing guide- lines);

j. surgery under general anaesthesia and appropriate analgesia, associated with post- surgical pain, suffering or impairment of general condition. Examples include: thoracotomy, craniotomy, laparotomy, orchidectomy, lymphadenectomy, thyroidectomy, orthopaedic surgery with effective stabilisation and wound management, organ transplantation with effective management of rejection, surgical implantation of catheters, or biomedical devices (e.g. telemetry transmitters, minipumps etc.);

k. testing of device where failure may cause severe pain, distress or death of the animal (e.g. cardiac assist devices); l. vaccine potency testing characterised by persistent impairment of the animal’s condition, progressive disease leading to death, associated with long-lasting moderate pain, distress or suffering;

m. irradiation or chemotherapy with a lethal dose without reconstitution of the immune system, or reconstitution with production of graft versus host disease; n. models with induction of tumours, or with spontaneous tumours, that are expected to cause progressive lethal disease associated with long-lasting moderate pain, distress or suffering. For example tumours causing cachexia, invasive bone tumours, tumours resulting in metastatic spread, and tumours that are allowed to ulcerate;

o. surgical and other interventions in animals under general anaesthesia which are expected to result in severe or persistent moderate post- operative pain, suffering or distress or severe and persistent impairment of the general condition of the animals. Production of unstable fractures, thoracotomy without adequate analgesia, or trauma to produce multiple organ failure;

p. organ transplantation where organ rejection is likely to lead to severe distress or impairment of the general condition of the animals (e.g. xenotransplantation);82 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] q. breeding animals with genetic disorders that are expected to experience severe and persistent impairment of general condition, for example Huntington’s disease, Muscular dystrophy, chronic relapsing neuritis models;

r. use of metabolic cages involving severe restriction of movement over a prolonged period; s. inescapable electric shock (e.g. to produce learned helplessness); t. complete isolation for prolonged periods of social species e.g. dogs and non-human primates;

u. immobilisation stress to induce gastric ulcers or cardiac failure in rats; v. exercise tests with exhaustion as the endpoint.
