## Policy Analysis Report: The Union Territory of Ladakh Reservation Amendment Regulation, 2025 **1. Executive Summary:** This report analyzes the Union Territory of Ladakh Reservation Amendment Regulation, 2025 (No. 1 of 2025), based solely on the provided text. This amendment modifies the Jammu and Kashmir Reservation Act, 2004, as it applies to the Union Territory of Ladakh. The core purpose of the amendment is to adjust reservation percentages, specifically excluding Economically Weaker Sections (EWS) from the overall reservation cap and removing a potentially conflicting proviso related to reservation within Section 5 of the original act. Key findings highlight changes to Sections 3, 5, 6, and 9 of the principal Act, focusing on reservation limits and the treatment of EWS. **2. Introduction:** This report aims to provide a comprehensive overview of the Union Territory of Ladakh Reservation Amendment Regulation, 2025 (No. 1 of 2025). The analysis is based exclusively on the text provided, offering insights into the amendments made to the Jammu and Kashmir Reservation Act, 2004, as applicable to the Union Territory of Ladakh. **3. Policy Overview:** * **Original Policy:** The Jammu and Kashmir Reservation Act, 2004 (XIV of 2004). * **Core Objective(s):** While the complete objectives of the original Act cannot be determined from this excerpt, the *amendment* suggests the original act aimed to provide reservations in certain areas. The core objective of *this amendment* appears to be modifying the percentage limits and clarifying the treatment of reservations for Economically Weaker Sections (EWS) within the existing reservation framework in Ladakh. **4. Background and Rationale:** This is an amendment to an existing Act. The amendment appears to be driven by a need to clarify the applicability of reservation percentages and to explicitly address the inclusion/exclusion of Economically Weaker Sections (EWS) from reservation caps. The removal of the second proviso in Section 5(1) of the original act suggests that this provision created conflict or confusion, which the amendment seeks to resolve. The amendment appears to modify reservation percentages for different categories while ensuring the inclusion or consideration of Economically Weaker Sections is separate from the broader calculation of total reservation limits. **5. Key Provisions / Changes:** The Union Territory of Ladakh Reservation Amendment Regulation, 2025 introduces the following changes to the Jammu and Kashmir Reservation Act, 2004: * **Amendment of Section 3:** The first proviso in subsection 1 of Section 3 is replaced with a new proviso stating: "Provided that the total percentage of reservation shall in no case exceed 85, excluding reservation for Economically Weaker Sections:". * **Effect of Change:** This change caps the total reservation percentage at 85%, *excluding* reservations for EWS. This means reservations for EWS will be considered *separately* and *above* the 85% cap. * **Amendment of Section 5:** * **(a)** The second proviso in subsection 1 of Section 5 is omitted. * **Effect of Change:** This removes the original proviso completely. Without access to the original act, the exact effect is difficult to assess; however, the removal suggests the proviso was problematic or redundant. * **(b)** A new subsection 5 is inserted after subsection 4: "Nothing contained in this section shall apply to Economically Weaker Sections and filling up of vacancies for such Sections shall be in such manner as may be prescribed.". * **Effect of Change:** This explicitly states that Section 5 *does not apply* to EWS, and the process for filling vacancies for EWS will be determined separately as prescribed. This provides clarity and potentially creates a distinct process for EWS reservations. * **Amendment of Section 6:** The first proviso in Section 6 is replaced with a new proviso stating: "Provided that the total percentage of reservation shall in no case exceed 85 of the available vacancies, excluding reservation for Economically Weaker Sections:". * **Effect of Change:** Similar to the change in Section 3, this caps the total reservation percentage for available vacancies at 85%, *excluding* reservations for EWS. * **Amendment of Section 9:** The first proviso in subsection 1 of Section 9 is replaced with a new proviso stating: "Provided that the total percentage of reservation shall in no case exceed 85, excluding reservation for Economically Weaker Sections:". * **Effect of Change:** Similar to the changes in Sections 3 and 6, this caps the total reservation percentage at 85%, *excluding* reservations for EWS. **6. Target Audience and Stakeholders:** Based on the provided text, the primary target audience and stakeholders are: * Residents of the Union Territory of Ladakh who are eligible for reservations under the Jammu and Kashmir Reservation Act, 2004, *including* Economically Weaker Sections (EWS). * Government bodies and institutions responsible for implementing reservation policies in Ladakh, specifically those involved in employment and educational opportunities. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The "Central Government" is responsible for appointing the date on which the regulation comes into force by notification in the Official Gazette. Other bodies involved would include those who prescribe the manner of filling up vacancies for Economically Weaker Sections as per Section 5(5). * **Timelines/Procedures:** The amendment comes into force on a date to be determined by the Central Government and published in the Official Gazette. Specific procedures for filling vacancies for EWS will be prescribed separately. **8. Expected Outcomes / Impact of Changes:** The likely intended outcomes of these specific changes are: * **Clarity in Reservation Limits:** Providing a clearer and more consistent framework for reservation percentages, specifically limiting them to a maximum of 85% *excluding* EWS. * **Separate Consideration of EWS:** Ensuring that reservations for EWS are treated distinctly and do not impact the overall reservation cap. This might lead to increased opportunities for EWS candidates. * **Reduced Legal Ambiguity:** The removal of the previous second proviso in Section 5(1) likely aims to eliminate potential legal challenges or misinterpretations of the original act. **9. Conclusion:** The Union Territory of Ladakh Reservation Amendment Regulation, 2025 introduces crucial modifications to the Jammu and Kashmir Reservation Act, 2004, as it applies to Ladakh. The amendments primarily focus on clarifying reservation limits, explicitly excluding EWS from the general reservation cap of 85%, and streamlining related procedures. These changes are likely intended to provide a clearer and potentially more equitable framework for reservations within the Union Territory. This implies that any further changes or additions of policies regarding reservation should specifically include and consider the separation of EWS from the original Reservation Act.
