Short title and commencement.–(1) These regulations may be called the Competition Commission of India (Procedure for Engagement of Experts and Professionals) Amendment Regulations, 2014. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Competition Commission of India (Procedure for Engagement of Experts and Professionals) Regulations, 2009 (hereinafter referred to as the principal regulations) :— (I) for the words “expert or professional” wherever they occur, the words “experts or professionals including research associates” shall substituted and such other consequential amendments, as the rules of grammar may require shall also be made.; (II) in regulation 8, for sub-regulation (1 ) the following shall be substituted namely :— “(I) the “experts or professionals including research associates” shall ordinarily be engaged by the Commission on contractual basis for not less than one year and not more than three years” . (III) in the principal regulations,— (a) in Schedule I, for the entries in columns relating to ‘Qualification’ and ‘Experience’, against the word “ Law”, the following entries shall be substituted, namely :—¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3 “Essential – Experience in judicial or legal work, in Supreme Court, (i) Degree of LL.B or equivalent from a High Court or any other Court, Government or a recognized University and/or Institute in Regulatory Authority or a Tribunal or any similar forum. India or abroad, recognized by the Bar or, Professor/Reader/Lecturer of Law or any recognized Council of India. University/Professional Institute of India or abroad with (ii) Qualified to be registered as an specialization in teaching competition law, advocate in any State Bar Council or in India in terms of Advocate’s Act, Legal Manager or above in the Corporate sector having 1961, experience or handling acquisitions, mergers and Desirable – amalgamations etc., under competition law:; Specialization in competition law or regulatory laws or laws relating to Intellectual Property Rights or International Trade Laws. (b) in Schedule II of the principal regulations,— in column relating to Preferred experience in years, against level I, for the words “Upto three years” the following shall be substituted, namely :— “One to three years”.
