2. प`रभाषाए.ं—(1) इस अ(cid:22)ध"नयम म7, जब तक 'क संदभ 9 से अUयथा अपे]@त न हो,--

3. सामािजक समाघात "नधा9रण अ\ययन.—(1) सम(cid:22)ु चत सरकार, इस अ(cid:22)ध"नयम के >योजन के (cid:17)लए, सामािजक
समाघात "नधा9रण के संबधं म7 इन "नयमD के >Oप 1 के भाग आ के अनसु ार सामािजक समाघात "नधा9रण करने
के (cid:17)लए अ(cid:22)धसचू ना जार(cid:28) करेगी और उसे (cid:30)थानीय भाषा म7, यथाि(cid:30)थ"त, पंचायत, नगरपा(cid:17)लका या नगर "नगम को
और िजला कलCट र, उप खंड मिज(cid:30)fेट और तहसील म7 कायाल9 यD म7 उपलJध कराएगी तथा >भा(cid:7)वत @े(cid:12) म7
पो(cid:30) टरD और पिु (cid:30)तकाओ ं के Oप म7 >का(cid:17)शत करेगी और >भा(cid:7)वत @(cid:12)े D म7

(2) सामािजक समाघात "नधा9रण, संबं(cid:22)धत पंचायत, नगरपा(cid:17)लका या नगर "नगम के साथ परामश 9 से अ(cid:22)ध"नयम
क* धारा 4 के >योजनD के (cid:17)लए >भा(cid:7)वत @े(cid:12)D म7 (cid:1)ामीण (cid:30)तर या वाड 9 (cid:30)तर पर 'कया जाएगा। इसके उपरांत
>भा(cid:7)वत @(cid:12)े D म7 जन सनु वाई क* तार(cid:28)ख और समय तथा (cid:30)थान का <य ापक >चार करके जन सनु वाई क* जाएगी

के भीतर >(cid:30)ततु 'कया जाएगा और इसम7 >भा(cid:7)वत कुटुंबD के सिYम(cid:17)लत अ(cid:17)भ(cid:17)लZखत

>ोUन"त कारक उपायD को सचू ीबk करने वाल(cid:28) सामािजक समाघात >बधं न योजना, सामािजक समाघात "नधा9रण
`रपोट9 के साथ >Oप 3 म7 >(cid:30)ततु क* जाएगी ।
(5) सामािजक समाघात "नधा9रण `रपोट9 और सामािजक समाघात >बधं न योजना, संब(cid:22)ं धत पंचायत, नगरपा(cid:17)लका
या नगर "नगम क* (cid:30)थानीय भाषा म7, >भा(cid:7)वत @(cid:12)े D म7 (cid:1)ामीण (cid:30)तर या वाड 9 (cid:30)तर पर और िजला कलCट र, उप

4. सा(cid:30)ं था"नक सहायता और सामािजक समाघात "नधा9रण को सकु र बनाना.—(1) सम(cid:22)ु चत सरकार एक (cid:30)वत(cid:12)ं
सगं ठन क* पहचान करेगी या (cid:30)थ ापना करेगी, जो यह स"ु निhचत करने के (cid:17)लए उKतरदायी होगा 'क सामािजक
समाघात "नधा9रणD का गठन और सचं ालन, अ(cid:22)ध"नयम के उपबधं D के अनसु ार अपे@क "नकाय से (cid:17)भUन <य िCत
या "नकायD 2वारा 'कया जाता है ।
(2) सामािजक समाघात "नधा9रण इकाई "नYन(cid:17)लZखत कायm को करेगा, अथात9 :्-
(क) अ(cid:25)हत9 सामािजक समाघात "नधा9रण, nोत भागीदारD और <यवसा"ययD का एक डटे ाबेस तयै ार करेगा और
उसका सतत ् Oप से (cid:7)व(cid:30)तार करेगा, जो 'क भ(cid:17)ू म अजन9 और पनु वास9 न और पनु (cid:30)थ ाप9 न के (cid:17)लए सामािजक
समाघात "नधा9रण संचा(cid:17)लत करने के (cid:17)लए अपे]@त कौशलD और @मताओं के <यिFटकD और स(cid:30)ं थानD के नेटवक9
के Oप म7 काय 9 करेगा ;
(ख) प`रयोजना (cid:7)व"न(cid:25)द9Fट "नदpश-"नबधं न तैयार करके सामािजक समाघात "नधा9रण 2वारा संचा(cid:17)लत 'कए जाने के
(cid:17)लए सम(cid:22)ु चत सरकार के अनरु ोधD पर तरु ंत कार9वाई करेगा ;
(ग) सामािजक समाघात "नधा9रण दल और सामदु ा"यक सवp@कD के (cid:17)लए >(cid:17)श@ण और स@मतावधन9 कायd9 मD
का सचं ालन करेगा तथा (cid:7)वhलेषण के (cid:17)लए अपे]@त मनै ुअलD, औजारD, तलु नाKमक मामला अ\ययन `रपोटm और
अUय साम(cid:22)(cid:1)यD को उपलJध कराएगा ;
(घ) सामािजक समाघात "नधा9रण >'dयाओं के दौरान यथा अप]े @त सतत ् सहायता और सशं ोधनकार(cid:28) कार9वाई
का उपबधं करेगा ;
(ड.) यह स"ु निhचत करेगा 'क भ(cid:17)ू म अजन9 और पनु वास9 न और पनु (cid:30)थ ाप9 न के (cid:17)लए सामािजक समाघात "नधा9रण
और >बधं न सचू ना >णाल(cid:28) के (cid:17)लए स<ं यवहार आधा`रत वेब आधा`रत वक9qलो का "नयम 13 म7 यथा (cid:7)व"न(cid:25)द9Fट
अनसु ार अनरु @ण 'कया जाता है तथा अ(cid:22)ध"नयम के उपबधं D के अनसु ार सभी ससु गं त द(cid:30)तावेजD का >कटन
'कया जाता है ;
(च) सभी सामािजक समाघात "नधा9रण और सहबk >ाइमर(cid:28) साम(cid:22)(cid:1)यD के कैटालॉग को रखेगा ; और
(छ) सामािजक समाघात "नधा9रण और संपणू 9 राsय या संघ राsय @(cid:12)े , जसै ा भी मामला हो, म7 उसके संचालन के
(cid:17)लए उपलJध स@मताओं के (cid:17)लए tवा(cid:17)लट(cid:28) का लगातार पनु र(cid:28)@ण करेगा, म(cid:27)ू यांकन करेगा और उसको सn ु `ढ
बनाएगा ।
5. प`रयोजना (cid:7)व"न(cid:25)द9Fट "नदpश-"नबधं न तथा सामािजक समाघात "नधा9रण के (cid:17)लए >स(cid:30)ं क रण फ*स – (1) जहा ं
सम(cid:22)ु चत सरकार भ(cid:17)ू म अजन9 का आशय रखती है, ऐस े भ(cid:17)ू म अजन9 के (cid:17)लए >(cid:30)ताव को ससु गं त द(cid:30)तावेजD के साथ
सामािजक समाघात "नधा9रण इकाई को भेजा जाएगा, जो 'क –
(क) सम(cid:22)ु चत दल आकार (और फ*(cid:27)ड दलD क* सं1या) तथा दल के सद(cid:30)यD के >ोफाइल को उपद(cid:17)शत9 करते हुए
उन सभी कायक9 लापD को सचू ीबk करते हुए जो अ"नवायत9 : 'कए जाने ह,c >Kयेक भ(cid:17)ू म अजन9 >(cid:30)ताव के (cid:17)लए4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
"नदpश "नबधं न (cid:7)व"न(cid:25)द9Fट प`रयोजना के Jयौरे तयै ार करेगा और इन "नयमD के >Oप 1 के भाग अ म7 यथा (cid:25)दए
अनसु ार सामािजक समाघात "नधा9रण के (cid:17)लए म1ु य सुपदु 9(cid:22)गयD के (cid:17)लए अनसु चू ी और अं"तम तार(cid:28)ख "निhचत
करेगा ;
(ख) >Kयेक मद या कायक9 लापD के (cid:17)लए "नदpश-"नबधं न के आधार पर स(cid:30)ु प Fट लागत (cid:7)वभाजन के साथ
सामािजक समाघात "नधा9रण के (cid:17)लए अनमु ानत: फ*स का अवधारण । फ*स क* रकम सम(cid:22)ु चत सरकार 2वारा
"निhचत 'कए गए पैरामीटरD, िजनके अंतगत9 @े(cid:12), प`रयोजना क* 'क(cid:30)म और >भा(cid:7)वत कुटुंबD क* सं1या है, पर
आधा`रत होगी।
(2) सामािजक समाघात "नधा9रण फ*स का दस >"तशत सामािजक समाघात "नधा9रण इकाई को "नदpश-"नबधं न
तयै ार करने के (cid:17)लए >शास"नक <यय और समु(cid:22)चत सरकार को अनमु ा"नत सामािजक समाघात "नधा9रण फ*स
`रपोट9 >(cid:30)ततु करने के (cid:17)लए आब(cid:25)ं टत 'कया जाएगा ।

6. सामािजक समाघात "नधा9रण दल का चयन.—(1) सामािजक समाघात "नधार9 ण इकाई, >Kयेक प`रयोजना के
(cid:17)लए अ(cid:25)हत9 सामािजक समाघात "नधा9रण संसाधन भागीदारD और <यवसा"ययD के डाटा बसे म7 रिज(cid:30)f(cid:28)कॄत या
पैनल(cid:28)कृत <यिFटकD और सं(cid:30)थाओं म7 से सामािजक समाघात "नधा9रण दल का चयन करने के (cid:17)लए उKतरदायी
होगी ।
(2) अपे@क "नकाय 'कसी भी >कार से सामािजक समाघात "नधार9 ण करने के (cid:17)लए "नयCु त सामािजक समाघात
"नधा9रण दल क* "नयिु Cत म7 शा(cid:17)मल नह(cid:28)ं होगा ।
(3) सामािजक समाघात "नधा9रण दल के आकार और चयन के मापदंड राsय सामािजक समाघात "नधा9रण इकाई
2वारा (cid:7)वक(cid:17)सत "नदpश-"नबधं न (cid:7)व"न(cid:25)द9Fट प`रयोजना के अनसु ार हDगे ।
(4) सामािजक समाघात "नधा9रण दल का गठन सामािजक समाघात "नधा9रण संचालन का या संब(cid:22)ं धत फ*(cid:27)ड
आधा`रत "नधार9 ण अनभु व रखने वाले <यिFटकD या संगठनD क* "नयुिCत करके 'कया जाएगा और दल म7
"नYन(cid:17)लZखत शा(cid:17)मल हो सक7ग—े
(क) (cid:30)वत(cid:12)ं <यवसा"ययD, अ(cid:25)हत9 सामािजक कायक9 ताओ9 ,ं (cid:17)श@ा(cid:7)वदD, तकनीक* (cid:7)वशेषwD का संयोजन, जो >Kय@ Oप
से अपे]@त "नकाय के साथ संबk नह(cid:28)ं है ; और
(ख) कम से कम एक म(cid:25)हला सद(cid:30)य;
(5) सामािजक समाघात "नधा9रण इकाई के साथ "नधा9रण अव(cid:22)ध के दौरान संपक9 करने के (cid:17)लए सामािजक
समाघात "नधा9रण दल म7 से एक दल नेता क* "नयुिCत क* जाएगी ।
(6) सामािजक समाघात "नधा9रण दल का चयन करते समय यह स"ु निhचत 'कया जाना है 'क संब(cid:22)ं धत प`रयोजना
का "नधा9रण करने के (cid:17)लए "नयकु ् त दल के सद(cid:30)यD म7 कोई (cid:25)हत का 2वंद नह(cid:28)ं है ।
(7) (i) य(cid:25)द 'कसी समय यह पाया जाता है 'क दल का कोई सद(cid:30)य या दल के सद(cid:30)य के कुटुंब का कोई सद(cid:30)य
>Kय@त: या अ>Kय@त: अपे@क "नकाय से या प`रयोजना म7 'कसी अUय पणधार(cid:28) से कोई >Kय@ या अ>Kय@
फायदा >ाEत करता है तो उCत सद(cid:30)य "नर(cid:25)हत9 हो जाएगा।
(ii) सामािजक समाघात "नधा9रण के सभी सद(cid:30)य इस आशय का वचन द7गे 'क दल का कोई सद(cid:30)य या दल के
सद(cid:30) य के कुटुY ब का कोई सद(cid:30) य >Kय @त: या अ>Kय @त: अपे@क "नकाय या प`रयोजना म7 अUय 'कसी भी

7. सामािजक समाघात सचं ा(cid:17)लत करने क* >'dया.—(1) सामािजक समाघात "नधा9रण दल स1ं याKमक और
मा(cid:12)ाKमक डाटा के एक र7ज का सं(cid:1)हण और (cid:7)वhलेषण करेगा, (cid:7)व(cid:30)तॄत (cid:30)थल xमण करेगा, केिUVत समहू (cid:7)वचार-
(cid:7)वमश,9 सहभागी (cid:1)ामीण म(cid:27)ू याकं न तकनीकD तथा सूचक सा@ाKकारD जसै ी सहभागी (cid:7)व(cid:22)धयD का सामािजक
समाघात "नधा9रण `रपोट9 तयै ार करने म7 उपयोग करेगा ।
(2) सभी ससु गं त प`रयोजना `रपोटm और सा\यता अ\ययनD को सामािजक समाघात "नधा9रण दल को सामािजक
समाघात "नधा9रण >'dयाओ ं म7 यथा अपे]@त अनसु ार उपलJध कराया जाएगा । सामािजक समाघात "नधा9रण
दल से सचू ना के (cid:17)लए 'कसी अनरु ोध को यथाशीy 'कंतु दस (cid:25)दन से पवू 9 परू ा 'कया जाएगा । िजला कलेtटर
सामािजक समाघात "नधा9रण दल 2वारा मागं ी गई सचू ना को उपलJध कराने के (cid:17)लए उKतरदायी होगा ।
(3) सामािजक समाघात "नधा9रण दल 2वारा सभी ससु ंगत भ(cid:17)ू म अ(cid:17)भलेखD और डाटा, फ*(cid:27)ड सKय ापन, समान

प`रयोजनाओ ं के पनु र(cid:28)@ण और तलु ना पर आधा`रत गहन (cid:7)वhलेषणD के मा\यम से एक "नधा9रण का
संचालन 'कया जाएगा । "नधा9रण "नYन(cid:17)लZखत का अवधारण करेगा, अथात9 ् :-
(क) >(cid:30)ता(cid:7)वत प`रयोजना के अधीन समाघात का @(cid:12)े , िजसके अतं गत9 अिजत9 क* जाने वाल(cid:28) भ(cid:17)ू म तथा वह @े(cid:12)
भी है जो प`रयोजना के पया9वरण, सामािजक या अUय समाघातD से >भा(cid:7)वत हDगे ;
(ख) प`रयोजना के (cid:17)लए अिजत9 क* जाने वाल(cid:28) >(cid:30)ता(cid:7)वत भ(cid:17)ू म क* मा(cid:12)ा और अवि(cid:30)थ"त;
(ग) अजन9 के (cid:17)लए >(cid:30)ता(cid:7)वत भ(cid:17)ू म अपे]@त का केवल Uयनू तम है ;
(घ) प`रयोजना के (cid:17)लए संभा(cid:7)वत वैकि(cid:27)पक (cid:30)थान और उनक* सा\यता ;
(ङ) Cय ा अजन9 के (cid:17)लए अनसु (cid:22)ू चत @े(cid:12) म7 >(cid:30)ता(cid:7)वत भ(cid:17)ू म >Kय@ अ"ं तम (cid:7)वक(cid:27)प है ;
(च) भ(cid:17)ू म, य(cid:25)द कोई है, पहले से ह(cid:28) dय क* गई, अलग क* गई, पzे पर द(cid:28) गई या अिजत9 क* गई तथा प`रयोजना
के (cid:17)लए अपे]@त भ(cid:17)ू म के >Kयेक आश"यत Eलाट का उपयोग ;
(छ) प`रयोजना के (cid:17)लए 'कसी सावज9 "नक, उपयोग न क* जा रह(cid:28) भ(cid:17)ू म क* सभं ावना तथा Cय ा ऐसी कोई भ(cid:17)ू म
कJजे के अधीन है ;
(ज) भ(cid:17)ू म क* >कृ"त, भ(cid:17)ू म का (cid:7)व2यमान उपयोग और वग{करण तथा य(cid:25)द यह कृ(cid:7)ष भ(cid:17)ू म है तो उCत भ(cid:17)ू म पर
(cid:17)सचं ाई क* मा(cid:12)ा तथा उगने वाल(cid:28) फसलD का पटै न 9 ;
(झ) >(cid:30)ता(cid:7)वत भ(cid:17)ू म अजन9 म7 खा2य सरु @ा क* बाबत (cid:7)वशेष उपबधं D का पालन 'कया गया है ;
(ञ) ध"ृत का आकार, (cid:30)वा(cid:17)मKव पैटन,9 भ(cid:17)ू म (cid:7)वतरण, आवासीय मकानD क* स1ं या, और लोक और "नजी
अवसंरचना और आि(cid:30)तया;ं और
(ट) भ(cid:17)ू म क* क*मत7 और (cid:30)वा(cid:17)मKव म7 नए प`रवतन9 , (cid:7)पछले तीन वषm म7 भ(cid:17)ू मयD का अंतरण और उपयोग ।
(4) भ(cid:17)ू म "नधा9रण, भ(cid:17)ू म अ(cid:17)भलेख और @े(cid:12) सKय ापन पर आधा`रत सामािजक समाघात "नधा9रण >भा(cid:7)वत
कुटुंबD क* स1ं या और उनम7 से (cid:7)व(cid:30)थ ा(cid:7)पत कुटुंबD क* स1ं या का एक सह(cid:28) >ाCक लन देगा और जहां तक सभं व
हो, यह स"ु निhचत करेगा 'क सामािजक समाघात "नधा9रण दल सभी >भा(cid:7)वत कुटुंबD क* गणना करेगा :
परंत ु जहां पर गणना सभं व नह(cid:28)ं है, सामािजक समाघात "नधा9रण इकाई 2वारा एक >"त"न(cid:22)ध नमनू ा
तयै ार 'कया जाएगा ।
(5) >भा(cid:7)वत @े(cid:12) क*, उपलJ ध आंकड़D और सांि1य'कयD, @े(cid:12) "नर(cid:28)@णD और परामशm पर आधा`रत एक
सामािजक, आ(cid:22)थक9 और सा(cid:30)ं कृ"तक Oपरेखा >Oप 2 के अनसु ार तैयार क* जानी चा(cid:25)हए :6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
परंत ु उन प`रयोजनाओं म7 जहां पनु <य व9 (cid:30)थ ापन अपे]@त है, पहचान 'कए गए पनु <य व9 (cid:30)थ ापन (cid:30)थलD का
"नर(cid:28)@ण 'कया जाएगा और भ(cid:17)ू म और उसके वतम9 ान "नवासी जनस1ं या क* एक स]ं @Eत सामािजक, आ(cid:22)थक9
Oपरेखा उपद(cid:17)शत9 क* जाएगी ।
(6) ऊपर सू(cid:22)चत >'dयाओं म7 एकM(cid:12)त आंकड़D के आधार पर और >भा(cid:7)वत समदु ायD और >मखु पण से परामश 9
करके सामािजक समाघात "नधा9रण, >Oप 2 के अनसु ार >(cid:30)ता(cid:7)वत प`रयोजना और भ(cid:17)ू म अजन9 से सहयुCत
सकाराKमक और नकाराKमक सामािजक समाघातD क* >कृ"त, (cid:7)व(cid:30)तार और गहनता क* पहचान और उसका
"नधा9रण करेगा ।
(7) (i) सामािजक समाघात "नधा9रण >'dया के अतं गत9 सामािजक समाघात >बधं योजना को तयै ार करना भी है
जो "नधा9रण के >dम पर पहचान 'कए गए सामािजक समाघातD पर \यान देने के (cid:17)लए 'कए जाने वाले बेहतर
उपायD को >(cid:30)ततु करेगी।
(ii) सामािजक समाघात "नधा9रण दल 2वारा लागत, साम"यकता और @मता के (cid:30)प Fट उपदशन9 स(cid:25)हत समाघात
शमन और >बंध यिु CतयD क* <य वहायत9 ा को "नधा`9 रत 'कया जाना चा(cid:25)हए ।
(iii) सामािजक समाघात >बंध योजना के अतं गत9 "नYन(cid:17)लZखत उपाय हDगे -
(क) जो अ(cid:22)ध"नयम म7 यथावZणत9 >भा(cid:7)वत कुटुंबD के सभी वगm के (cid:17)लए पनु वा9सन और पनु <य व9 (cid:30)थ ापन तथा
>"तकर के "नबंधनानसु ार (cid:7)व"न(cid:25)द9F ट 'कए गए ह c ;
(ख) 'क अपे@क "नकाय ने यह कथन 'कया है 'क वह प`रयोजना >(cid:30)ताव और अUय ससु गं त प`रयोजना
द(cid:30)तावेजD का िजYमा लेगी ;
(ग) अपे@क "नकाय 2वारा 'कए जाने वाले वे अ"त`रCत उपाय, जो इसके 2वारा सामािजक समाघात "नधा9रण
>'dया के "नFकषm और जन सनु वाई क* >"त'dया म7 'कए गए ह।c
(8) सामािजक समाघात "नधा9रण 2वारा >(cid:30)ता(cid:7)वत प`रयोजना और भ(cid:17)ू म अजन9 के >"तकूल सामािजक समाघातD
और सामािजक लागतD और लाभD के संतलु न और (cid:7)वतरण का "नhचायक "नधा9रण उपलJध कराना चा(cid:25)हए िजसके
अंतगत9 शमन उपाय भी हc और यह "नधा9रण उपलJध कराना चा(cid:25)हए 'क Cय ा >(cid:30)ता(cid:7)वत प`रयोजना से फायदे उन
सामािजक लागतD और >"तकूल सामािजक समाघातD से अ(cid:22)धक हc िजनके >भा(cid:7)वत कुटुंबD 2वारा अनभु तू 'कए
जाने क* सभं ावना है या >(cid:30)ता(cid:7)वत शमन उपायD के पhच ात ् भी >भा(cid:7)वत कुटुंब उCत भ(cid:17)ू म अजन9 और
पनु <य व9 (cid:30) थापन के प`रणाम(cid:30) वOप आ(cid:22)थक9 Oप से और सामािजक Oप से बदतर होने क* जोZखम म7 रहे ।
8. जन सनु वाईयां करने के (cid:17)लए >'dया -- (1) जन सनु वाईयां सामािजक समाघात "नधार9 ण के म1ु य "नFकषm को
(cid:30) पF ट करन,े "नFकषm क* >"तपिु Fट चाहने और उUह7 अं"तम द(cid:30)तावेजD म7 सिYम(cid:17)लत करने के (cid:17)लए अ"त`रCत
सचू ना और (cid:7)वचार लेने के (cid:17)लए >भा(cid:7)वत @े(cid:12)D म7 क* जानी चा(cid:25)हए ।
(2) जन सनु वाईयां ऐसी सभी (cid:1)ाम सभाओं म7 क* जाएगं ी जहां सद(cid:30)य भ(cid:17)ू म के अजन9 से >Kय@ Oप से या
अ>Kय@ Oप से >भा(cid:7)वत ह c ।
(3) जन सनु वाई क* तार(cid:28)ख और (cid:30)थान क* घोषणा और >चार, लोक अ(cid:22)धसचू नाओ ं तथा इhतहारD और अिजत9 क*
जाने वाल(cid:28) >(cid:30)ता(cid:7)वत भ(cid:17)ू म के पांच 'कलोमीटर के घेरे के भीतर सभी गांवD म7 (cid:30)थानीय समाचार-प(cid:12)D, रे(cid:127)डयो के
मा\यम से, और (cid:1)ाम पचं ायत या नगरपा(cid:17)लका वाड 9 के >"त"न(cid:22)धयD को >Kय@ ससं ूचना के मा\यम से और
सम(cid:22)ु चत सरकार क* वेबसाइट पर सचू ना डालकर तीन सEताह पहले 'कए जाएगं े ।
(4) (i) सामािजक समाघात "नधा9रण `रपोट9 और सामािजक समाघात >बंध योजना का >ाOप जन सनु वाई से तीन
सEताह पहले (cid:30)थानीय भाषा म7 >का(cid:17)शत 'कया जाएगा और सभी >भा(cid:7)वत (cid:1)ाम पंचायतD और नगरपा(cid:17)लका¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 7
कायाल9 यD म7 (cid:7)वत`रत 'कया जाएगा। >ाOप `रपोट9 क* एक >"त िजला कलCट र के कायाल9 य को उपलJध करवाई
जाएगी।
(ii) अपे@क "नकाय को भी >ाOप `रपोट9 क* एक >"त तामील क* जा सकेगी। `रपोट9 और साराशं क* पयाE9 त
>"तया ं जन सनु वाई के (cid:25)दन उपलJध कराई जाएगी। सामािजक समाघात "नधा9रण `रपोट9 के "नFकषm म7 सहभागी
होने के (cid:17)लए सगु म >दशन9 और अUय €िFटगत साधन का उपयोग 'कया जाएगा ।
(5) (i) सामािजक समाघात "नधा9रण दल का सद(cid:30)य जन सनु वाई को सकु र बनाएगा िजसे सम(cid:22)ु चत (cid:30)तर के
पदा(cid:17)भ(cid:25)हत सरकार(cid:28) अ(cid:22)धका`रयD के साथ (cid:30)थानीय >शासन के मा\यम से आयोिजत 'कया जाएगा।
(ii) (cid:1)ाम पंचायत और नगरपा(cid:17)लका वाड 9 के >"त"न(cid:22)धयD को भी उनके d(cid:17)मक @े(cid:12)D म7 जन सनु वाई के (cid:17)लए
इंतजामD क* बाबत सभी (cid:7)व"नhचयD म7 सिYम(cid:17)लत 'कया जाएगा ।
(6) यह स"ु निhचत करने के (cid:17)लए 'क सभी सहभागी कायव9 ा(cid:25)हयD को समझ सक7 और अपने (cid:7)वचार <य Cत कर
सक7, सभी कायव9 ा(cid:25)हया ं >भावी और (cid:7)वhवसनीय अनुवादकD स(cid:25)हत (cid:30)थानीय भाषा म7 क* जाएगं ी ।
(7) अपे@क "नकाय और पदा(cid:17)भ(cid:25)हत भ(cid:17)ू म अजन9 और पनु वास9 न तथा पनु <य व9 (cid:30)थ ापन कृKयका`रयD के >"त"न(cid:22)ध भी
जन सनु वाई म7 हािजर रह7गे और >भा(cid:7)वत प@कारD 2वारा उठाए गए >hनD और >सगं D पर \यान द7गे ।
(8) जन सनु वाईयD म7 हािजर होने के (cid:17)लए जन >"त"न(cid:22)धयD, (cid:30)थानीय (cid:30)व िै (cid:129)छक सगं ठनD और मी(cid:127)डया को भी
आमंM(cid:12)त 'कया जाएगा ।
(9) जन सनु वाई क* कार9वाईयD क* वी(cid:127)डयो `रका(cid:127)डग‚ क* जाएगी और तदनसु ार उसक* नकल तैयार क* जाएगी ।
इस `रका(cid:127)डग‚ और नकल को अं"तम सामािजक समाघात "नधा9रण `रपोट9 और सामािजक समाघात >बधं योजना
के साथ >(cid:30)ततु 'कया जाएगा ।
(10) जन सनु वाईयD क* समािEत के पhच ात ् सामािजक समाघात "नधा9रण दल लोक अ(cid:22)धवशे नD म7 >ाEत संपणू 9
>"तपिु Fट और एकM(cid:12)त सचू ना का (cid:7)वhलेषण करेगा और तदनसु ार उसे अपने (cid:7)वhलेषण स(cid:25)हत पनु र(cid:28)]@त सामािजक
समाघात "नधा9रण `रपोट9 म7 सिYम(cid:17)लत करेगा ।
(11) लोक अ(cid:22)धवेशन म7 उठाए गए >Kयेक आ@ेप को अ(cid:17)भ(cid:17)लZखत 'कया जाएगा और सामािजक समाघात "नधा9रण
दल यह स"ु निhचत करेगा 'क सामािजक समाघात "नधा9रण `रपोट9 म7 >Kयेक आ@पे पर (cid:7)वचार 'कया जाएगा ।
9. सामािजक समाघात "नधा9रण `रपोट9 और सामािजक समाघात >बंध योजना का >(cid:30)ततु 'कया जाना -- अं"तम
सामािजक समाघात "नधा9रण `रपोट9 और सामािजक समाघात >बंध योजना (cid:30)थानीय भाषा म7 तैयार क* जाएगी
और, यथाि(cid:30)थ"त, पंचायत नगरपा(cid:17)लका या नगर "नगम को और िजला कलCट र, उपखंड मिज(cid:30)fेट और तहसील के
कायाल9 यD म7 उपलJध कराई जाएगी और उसका >भा(cid:7)वत @े(cid:12)D म7 सहज€hय (cid:30)थानD पर इhतहार (cid:22)चपकाकर
प`रचा(cid:17)लत इhतहारD के Oप म7 >चार 'कया जाएगा तथा सम(cid:22)ु चत सरकार क* वेबसाइट पर भी डाला जाएगा ।
10. सामािजक समाघात "नधा9रण `रपोट9 और सामािजक समाघात >बंध योजना-- सामािजक समाघात "नधा9रण
`रपोट9 और सामािजक समाघात >बधं योजना को एकल द(cid:30)तावेज म7 सभी ससु ंगत सचू ना और (cid:7)वhलेषण को
\यान म7 रखते हुए बनाया जाएगा और ऐसे Oप म7 लेखबk 'कया जाएगा जो (cid:7)व(cid:17)शFट Oप से >भा(cid:7)वत समदु ायD
के सद(cid:30)यD के (cid:17)लए (cid:30)प F ट, सं]@Eत और सगु म हो ।
11. 'कसी (cid:7)वशेषw समहू 2वारा सामािजक समाघात "नधा9रण `रपोट9 का अकं न-- (1) अ(cid:22)ध"नयम क* धारा 7 क*
उपधारा (1) के अधीन ग(cid:25)ठत (cid:7)वशेषw समहू सामािजक समाघात "नधा9रण `रपोट9 का म(cid:27)ू याकं न करेगा और इसके
गठन क* तार(cid:28)ख से दो मास क* अव(cid:22)ध के भीतर उस >भाव क* अपनी (cid:17)सफा`रश करेगा ।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(2) (cid:7)वशेषw समूह क* (cid:17)सफा`रशD को >भा(cid:7)वत @े(cid:12)D म7 (cid:1)ाम (cid:30)तर पर या वाड 9 (cid:30)तर पर संब(cid:22)ं धत पचं ायत,
नगरपा(cid:17)लका या नगर "नगम और िजला कलCट र, उप खंड मिज(cid:30)fेट और तहसील के कायाल9 यD म7 (cid:30)थानीय
भाषा म7 उपलJ ध कराया जाएगा और >भा(cid:7)वत @(cid:12)े D म7 सहज€hय (cid:30)थानD पर इhतहार (cid:22)चपकाकर >भा(cid:7)वत @े(cid:12)D
म7 प`रचा(cid:17)लत इhतहारD के Oप म7 >का(cid:17)शत 'कया जाएगा और सम(cid:22)ु चत सरकार क* वेबसाइट पर डाला जाएगा ।
12. सामािजक समाघात "नधार9 ण `रपोट9, (cid:7)वशेषw समूह क* (cid:17)सफा`रशD, आ(cid:25)द पर (cid:7)वचार-- (1) सम(cid:22)ु चत सरकार,
सामािजक समाघात "नधा9रण `रपोट9, (cid:7)वशेषw समूह क* (cid:17)सफा`रशD, कलCट र क* `रपोट9, य(cid:25)द कोई हो, क* पर(cid:28)@ा
करेगी और अजन9 के (cid:17)लए ऐसे @(cid:12)े D क* (cid:17)सफा`रश करेगी िजससे जनता के Uयनू तम (cid:7)व(cid:30)थ ापन, अवसंरचना,
पा`रि(cid:30)थ"तक* म7 Uयनू तम (cid:7)वƒन और >भा(cid:7)वत <य िFटकD पर Uयनू तम >"तकूल समाघात स"ु निhचत हो ।
(2) उपधारा (1) के अधीन सम(cid:22)ु चत सरकार क* (cid:17)सफा`रशD को >भा(cid:7)वत @(cid:12)े D म7 (cid:1)ाम (cid:30)तर पर या वाड 9 (cid:30)तर पर
संबं(cid:22)धत पचं ायत, नगरपा(cid:17)लका या नगर "नगम और िजला कलCट र, उप खंड मिज(cid:30)fेट और तहसील के कायाल9 यD
म7 (cid:30)थानीय भाषा म7 उपलJध कराया जाएगा और >भा(cid:7)वत @(cid:12)े D म7 सहज€hय (cid:30)थानD पर इhतहार (cid:22)चपकाकर

16. सहम"त अपे@ाए ं -- (1) सम(cid:22)ु चत सरकार, संब(cid:22)ं धत िजला कलCट र के मा\यम से सामािजक समाघात "नधा9रण
अ\ययन स(cid:25)हत >भा(cid:7)वत भ-ू (cid:30)वा(cid:17)मयD क* पवू 9 सहम"त >Oप 4 के भाग अ म7 अ(cid:17)भ>ाEत करेगी ।
(2) सहम"त अ(cid:17)भ>ाEत करने क* कवायद का िजYमा सम(cid:22)ु चत सरकार 2वारा संब(cid:22)ं धत िजला कलCट र के मा\यम
से (cid:17)लया जाएगा जो पवू 9 सहम"त अ(cid:17)भ>ाEत करने क* >'dया म7 उसक* सहायता करने के (cid:17)लए उसके
"नय(cid:12)ं णाधीन अ(cid:22)धकार(cid:28) "नयtु त कर सकेगा ।
(3) सम(cid:22)ु चत सरकार >भा(cid:7)वत @(cid:12)े D म7 भ(cid:17)ू म अ(cid:22)धकारD, भ(cid:17)ू म म7 हक और अUय राज(cid:30)व अ(cid:17)भलेखD से सबं (cid:22)ं धत
अ(cid:17)भलेखD को अ2यतन करने के (cid:17)लए आवhयक कदम उठाएगी िजससे पवू 9 सहम"त >'dया और भ(cid:17)ू म अजन9

17. (cid:1)ाम सभा क* सहम"त -- (1) िजला कलCट र (cid:1)ाम पचं ायतD या (cid:30)वायKत िजला प`रषदD के >"त"न(cid:22)धयD स े
परामश 9 करके >भा(cid:7)वत @े(cid:12)D म7 तीन सEताह पहले (cid:7)वशेष (cid:1)ाम सभाए ं आयोिजत करने के (cid:17)लए तार(cid:28)ख, समय और
(cid:30)थान अ(cid:22)धस(cid:22)ू चत करेगा और (cid:1)ाम सभाओं म7 भाग लेने के (cid:17)लए (cid:1)ाम सभा के सद(cid:30)यD को >े`रत करने के (cid:17)लए
जन-चेतना अ(cid:17)भयान चलाएगा ।
(2) ऐसे सभी < यिCतयD के, जो (cid:1)ाम सभा के अ(cid:22)धवशे न म7 हािजर थे, नाम और ह(cid:30)ता@र (cid:17)लए जाएगं े और उसका
अ(cid:17)भलेख रखा जाएगा ।
(3) सहम"त को (cid:7)व(cid:22)धमाUय मानने के (cid:17)लए गणप"ू त,9 (cid:1)ाम सभा के कुल सद(cid:30)यD के कम से कम पचास >"तशत से
होगी :
परंत ु (cid:1)ाम सभा के अ(cid:22)धवेशन म7 (cid:1)ाम सभा क* कुल म(cid:25)हला सद(cid:30)यD के एक-"तहाई म(cid:25)हला सद(cid:30)य
उपि(cid:30)थत हDगे ।

अ(cid:22)धवशे न के कम से कम तीन सEताह पवू 9 (cid:30)थानीय भाषा म7 उपलJध कराई जाएगी ।
(5) (i) लोक "नजी भागीदार(cid:28) प`रयोजनाओं और "नजी कंप"नयD 2वारा प`रयोजनाओं के (cid:17)लए अपे@क "नकाय के
ऐसे >"त"न(cid:22)ध जो (cid:7)व"नhचय करने और पनु वास9 न तथा पनु <य व9 (cid:30)थ ापन और >"तकर के "नबंधनD पर बातचीत
करने के (cid:17)लए सम@ ह,c ऐसे सभी (cid:1)ाम सभा अ(cid:22)धवशे नD म7 उपि(cid:30)थत रह7गे और (cid:1)ाम सभा सद(cid:30)यD 2वारा उठाए
गए >hनD का जवाब द7गे।
(ii) "नबधं न और शत,„ पनु वा9सन और पनु <य व9 (cid:30)थ ापन, >"तकर और अपे@क "नकाय 2वारा >"तबk अUय उपाय
(cid:1)ाम सभा सद(cid:30)यD को (cid:30)थानीय भाषा म7 (cid:30) पFट 'कए जाएंगे और ऐसे "नबंधन और शतm पर सद(cid:30)यD के साथ ह(cid:28)
साथ अप@े क "नकाय के >"त"न(cid:22)धयD के ह(cid:30)ता@र अ(cid:17)भ>ाEत 'कए जाएगं े ।
(6) (i) (cid:7)वचार - (cid:7)वमश 9 के पh चात (cid:1)ाम सभा >(cid:30)ता(cid:7)वत अजन9 के (cid:17)लए सहम"त देते या रोकते हुए >Oप 4 के भाग
आ म7 बहुमत से एक सकं (cid:27) प पा`रत करेगी और उस संक(cid:27)प म7 पनु वास9 न और पनु <य व9 (cid:30)थ ापन के (cid:17)लए बातचीत
के पh चात "नबंधन और शत,„ >"तकर, समाघात >बधं और शमन अतं (cid:7)वF9 ट हDगे िजसके (cid:17)लए अपे@क "नकाय
>"तबk है और िजस पर िजला कलC टर या पदा(cid:17)भ(cid:25)हत िजल े के अ(cid:22)धकार(cid:28) और अपे@क "नकाय के >"त"न(cid:22)ध के
ह(cid:30)ता@र 'कए गए हc ।
(ii) एक बार >ाEत (cid:1)ाम सभा सकं (cid:27) प पर िजला कलCट र या पदा(cid:17)भ(cid:25)हत िजले के अ(cid:22)धकार(cid:28) के >"त ह(cid:30)ता@`रत
हDगे और ह(cid:30)ता@`रत एक >"त सभी पंचायत >"त"न(cid:22)धयD को स…पी जाएगी ।
(7) कोई भी संक(cid:27) प, िजसम7 प`रयोजना के (cid:17)लए सहम"त का एक (cid:30)प Fट (cid:7)ववरण, >"तकर और पनु वास9 न तथा
पनु <य व9 (cid:30) थापन के बातचीत 'कए गए "नबंधनD का (cid:7)ववरण अतं (cid:7)वF9 ट नह(cid:28)ं है, अ(cid:7)व(cid:22)धमाUय होगा ।
(8) (cid:1)ाम सभा क* सभी कायव9 ा(cid:25)हयD क* वी(cid:127)डयो `रका(cid:127)डग‚ क* जाएगी, लेखबk 'कए गए द(cid:30)तावेज को d(cid:17)मक
पंचायत कायाल9 यD म7 उपलJध कराया जाएगा और सम(cid:22)ु चत सरकार क* वेबसाइट पर डाला जाएगा ।
(9) सामािजक समाघात "नधा9रण दल के सद(cid:30)य (cid:1)ाम सभा अ(cid:22)धवेशनD म7 सहायता करने के (cid:17)लए उपि(cid:30)थत हDगे ।
18. >भा(cid:7)वत भ-ू (cid:30)वा(cid:17)मयD क* सहम"त -- (1) (i) िजले के अ(cid:22)धका`रयD 2वारा, लोक "नजी भागीदार(cid:28) प`रयोजनाओ ं
और "नजी कंप"नयD 2वारा प`रयोजनाओं म7 उन सभी >भा(cid:7)वत भ-ू (cid:30)वा(cid:17)मयD क* एक सचू ी, िजनसे सहम"त
अ(cid:17)भ>ाEत 'कया जाना आवhयक है, सामािजक समाघात "नधा9रण दल के परामश 9 से तयै ार क* जाएगी ।
(ii) सहम"त अ(cid:17)भ>ाEत करने से कम से कम दस (cid:25)दन पवू 9 >भा(cid:7)वत @े(cid:12)D म7 सचू ी को इhतहारD और पचm के Oप

से परामश 9 करके (cid:1)ाम या वाड 9 (cid:30)तर पर >भा(cid:7)वत भ-ू (cid:30)वा(cid:17)मयD का अ(cid:22)धवेशन आयोिजत करने के (cid:17)लए कम से कम
तीन सEताह पवू 9 उसक* तार(cid:28)ख, समय और (cid:30)थान अ(cid:22)धस(cid:22)ू चत करेगा ।
(4) अपे@क "नकाय 2वारा सहमत >(cid:30)ता(cid:7)वत "नबधं न और शतm को >भा(cid:7)वत भ-ू (cid:30)वा(cid:17)मयD के अ(cid:22)धवेशन के कम से
कम तीन सEताह पवू 9 (cid:30)थानीय भाषा म7 >Kयेक >भा(cid:7)वत भ-ू (cid:30)वामी को भी उपलJध कराया जाएगा ।
(5) (i) लोक "नजी भागीदार(cid:28) प`रयोजनाओं और "नजी कंप"नयD 2वारा प`रयोजनाओं के (cid:17)लए अपे@क "नकाय के
ऐसे >"त"न(cid:22)ध जो (cid:7)व"नhचय करने और पनु वास9 न तथा पनु <य व9 (cid:30)थ ापन और >"तकर के "नबंधनD पर बातचीत
करने के (cid:17)लए सम@ ह,c ऐस े सभी (cid:1)ाम सभा अ(cid:22)धवशे नD म7 उपि(cid:30)थत रह7गे और >भा(cid:7)वत भ-ू (cid:30)वा(cid:17)मयD 2वारा उठाए
गए >hनD का जवाब द7गे ।
(ii) "नबधं न और शत,„ पनु वा9सन और पनु <य व9 (cid:30)थ ापन, >"तकर और अपे@क "नकाय 2वारा >"तबk अUय उपाय
सद(cid:30)यD को (cid:30)थानीय भाषा म7 (cid:30) पF ट 'कए जाएगं े और ऐसे "नबंधन और शतm पर सद(cid:30)यD के साथ ह(cid:28) साथ
अपे@क "नकाय के >"त"न(cid:22)धयD के ह(cid:30)ता@र अ(cid:17)भ>ाEत 'कए जाएगं े ।
(6) (i) अ(cid:22)धवशे न क* समािEत पर >Kयेक <य िFटक भ-ू (cid:30)वामी से ह(cid:30)ता@`रत घोषणा म7 यह उपद(cid:17)शत9 करने के
(cid:17)लए कहा जाएगा 'क Cय ा वह अंतव(cid:17)9लत भ(cid:17)ू म के अजन9 के (cid:17)लए अपनी सहम"त देता/देती है या रोकता/रोकती है
।
(ii) इस घोषणा क* एक >"त संलbन "नबंधनD और शतm स(cid:25)हत संब(cid:22)ं धत भ-ू धारक को द(cid:28) जाएगी । घोषणा क*
>ािEत पर िजला कलCट र या िजले के अ(cid:22)धका`रयD 2वारा >"त ह(cid:30)ता@र 'कए जाएंगे ।
(7) (i) उन भ-ू (cid:30)वा(cid:17)मयD को, जो अ(cid:22)धवशे न म7 हािजर नह(cid:28)ं हो सके, भ-ू (cid:30)वा(cid:17)मयD के अ(cid:22)धवेशन क* तार(cid:28)ख से इCक *स
(cid:25)दन के भीतर पदा(cid:17)भ(cid:25)हत िजले के अ(cid:22)धका`रयD को अपनी ह(cid:30)ता@`रत घोषणाओं को >(cid:30)ततु करने म7 समथ 9 बनाने
के (cid:17)लए इतं जाम 'कया जाएगा ।
(ii) घोषणा >Oप >ाEत होने पर, िजला कलCट र या पदा(cid:17)भ(cid:25)हत अ(cid:22)धकार(cid:28) 2वारा >"त ह(cid:30)ता@र 'कए जाएगं े और
घोषणा क* एक >"त सलं bन "नबधं नD और शतm स(cid:25)हत >भा(cid:7)वत भ-ू (cid:30)वामी को स…पी जाएगी ।
(8) सहम"त >'dया भ-ू (cid:30)वा(cid:17)मयD के ह(cid:30)ता@`रत अथवा अंगठू े के "नशान वाल(cid:28), (cid:17)लZखत घोषणाओं के आधार पर
अवधा`रत क* जाएगी ।
(9) (i) भ-ू (cid:30)वा(cid:17)मयD के अ(cid:22)धवेशन के दौरान >भा(cid:7)वत भ-ू (cid:30)वा(cid:17)मयD क* सहम"त लेने क* सभी कायव9 ा(cid:25)हयD क*
वी(cid:127)डयो `रका(cid:127)डग‚ क* जाएगी और सभी कायव9 ा(cid:25)हयD को (cid:17)लZखत द(cid:30)तावेज म7 होना चा(cid:25)हए ।
(ii) सहम"त >'dया का प`रणाम पचं ायत कायाल9 यD म7 और सम(cid:22)ु चत सरकार क* वेबसाइट पर उपलJध कराया
जाएगा ।
(10) सामािजक समाघात "नधा9रण दल के सद(cid:30)य >भा(cid:7)वत भ-ू (cid:30)वा(cid:17)मयD के अ(cid:22)धवेशन म7 सहायता करने के (cid:17)लए
उपि(cid:30)थत हDगे ।
19. सहम"त >'dया के (cid:17)लए समु(cid:22)चत सरकार क* भ(cid:17)ू मका और उKत रदा"यKव -- (1) सम(cid:22)ु चत सरकार, सहम"त
अ(cid:17)भ>ाEत करने के (cid:17)लए (cid:1)ाम सभाओ,ं पंचायतD या (cid:30)वायKत िजला प`रषद अ(cid:22)धवशे न (उस दशा म7 जहा ं (cid:1)ाम

भागीदार(cid:28) को >ोKसा(cid:25)हत करने के (cid:17)लए जन चेतना अ(cid:17)भयान आयोिजत करेगी ।
(2) सम(cid:22)ु चत सरकार यह स"ु निhचत करेगी 'क उस >Kयेक सद(cid:30)य को, िजससे सहम"त चाह(cid:28) गई है, (cid:30)थानीय भाषा
म7 कम से कम तीन सEताह पवू 9 "नYन(cid:17)लZखत उपलJध करा (cid:25)दए गए ह,c अथात9 :--
(क) (cid:30)थानीय भाषा म7 सामािजक समाघात "नधा9रण `रपोट9 के >ाOप क* एक >"त (य(cid:25)द तयै ार हो);
(ख) >"तकर और पनु वास9 न तथा पनु < यव9 (cid:30)थ ापन के (cid:17)लए >(cid:30)ता(cid:7)वत 'कया गया >ारं(cid:17)भक पैकेज;
(ग) (cid:1)ाम और इसके "नवा(cid:17)सयD 2वारा राज(cid:30)व (cid:7)व(cid:22)धयD, वन अ(cid:22)धकार अ(cid:22)ध"नयम और अUय (cid:7)वधानD के अधीन
वतम9 ान म7 उपभोग 'कए जा रहे अ(cid:22)धकारD क* सचू ी ;

'कए जाने वाले अ(cid:22)धकार(cid:28) या >ा(cid:22)धकार(cid:28) का कायाल9 य दरू भाष नYबर स(cid:25)हत उसके संपक9 Jयौरे ।
(3) िजला कलCट र या िजला कलC टर 2वारा "नयtु त कोई पदधार(cid:28) (cid:1)ाम सभा, पंचायत या (cid:30)वायKत िजला प`रषद
(उस दशा म7 जहां (cid:1)ाम सभा (cid:7)व2यमान नह(cid:28)ं है या उसका गठन नह(cid:28)ं 'कया गया है) और भ-ू (cid:30)वा(cid:17)मयD के
अ(cid:22)धवशे न म7 उपि(cid:30)थत होगा ।
(4) सम(cid:22)ु चत सरकार यह स"ु निhचत करेगी 'क >भा(cid:7)वत भ-ू (cid:30)वा(cid:17)मयD को सामािजक समाघात "नधा9रण से सबं ं(cid:22)धत
सभी द(cid:30)तावेज उपलJ ध करा (cid:25)दए गए हc और सचू ना के (cid:17)लए सभी "नवेदन सात (cid:25)दन के भीतर दे (cid:25)दए गए हc ।
20. (1) सहम"त >'dयाओ ं के (cid:17)लए अपे@क "नकाय क* भ(cid:17)ू मका और उKतरदा"यKव -- अपे@क "नकाय, >"तकर
और पनु वास9 न तथा पनु <य व9 (cid:30) थापन के "नबंधनD और शतm पर (cid:7)व"नhच य करने और बातचीत करने के (cid:17)लए स@म
>"त"न(cid:22)धयD क* "नयुिCत करेगी जो सहम"त अ(cid:17)भ>ाEत करने के (cid:17)लए >भा(cid:7)वत भ-ू (cid:30)वा(cid:17)मयD के अ(cid:22)धवेशन म7
उपि(cid:30)थत हDगे और भ-ू (cid:30)वा(cid:17)मयD 2वारा उठाए गए >hनD का उKतर द7गे ।
(2) अपे@क "नकाय, सहम"त लेने के पवू 9 प`रयोजना पर सभी सचू ना के साथ ह(cid:28) साथ अ"त`रCत सचू ना, य(cid:25)द
अपे]@त हो, उपलJध कराएगी ।

(i) सामािजक समाघात "नधा9रण सबं धं ी इकाई समु(cid:22)चत सरकार 2वारा भेजे गए भ(cid:17)ू म अजन9 के >(cid:30)ताव का
पनु (cid:7)वल9 ोकन करेगी और (cid:7)व"न(cid:25)द9Fट प`रयोजना के "नदpश "नबधं न और बजट >(cid:30)ततु करेगी । "नदpश "नबधं न और
बजट के आधार पर >'dया संबंधी फ*स का अवधारण 'कया जाएगा, िजसे अपे@क "नकाय 2वारा, सामािजक
समाघात "नधा9रण संबधं ी अ(cid:22)धसचू ना जार(cid:28) होने से पहले जमा करना होगा ।
(ii) "नदpश "नबधं न म7 "नYन(cid:17)लZखत जानकार(cid:28) सिYम(cid:17)लत होगी,--
(क) प`रयोजना का स]ं @Eत वणन9 , प`रयोजना @(cid:12)े और अजन9 के (cid:17)लए >(cid:30)ता(cid:7)वत भ(cid:17)ू म का (cid:7)व(cid:30)तार ।
(ख) सामािजक समाघात "नधा9रण के उ‡ेhय और ऐसे सभी 'dयाकलाप, जो सामािजक समाघात "नधा9रण

(घ) (cid:7)व"न(cid:25)द9F ट प`रयोजना का सामािजक समाघात "नधा9रण करने के (cid:17)लए अपे]@त सामािजक समाघात

NOTIFICATION
New Delhi, the 8th August, 2014
G.S.R. 574(E).—Whereas certain draft rules, namely the Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and Consent)
Rules, 2014 were published as required under section 112 of the Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013), vide notification
of the Government of India in the Ministry of Rural Development (Department of Land Resources), number
G.S.R. 101(E), dated the 20th February, 2014 in the Gazette of India, Extraordinary, Part II, Section 3,
Sub-section (i) dated the 20th February, 2014 for inviting objections and suggestions from all persons likely to
be affected thereby before the expiry of a period of thirty days from the date on which copies of the Gazette
containing the notification were made available to the public;
And whereas, the copies of the Gazette containing the said notification were made available to the
public on the 7th March, 2014;
And whereas, the objections and the suggestions received from the public on the said draft rules have
been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by clauses (a), (c), (d), (t) and (u) of Sub-section
(2) of Section 109 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation
and Resettlement Act, 2013 (30 of 2013), the Central Government hereby makes the following rules, namely:-
Chapter I
GENERAL
1. Short title and commencement.—(1) These rules may be called the Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and Consent)
Rules, 2014.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions.— (1) In these rules, unless the context otherwise requires,—
(a) “Act” means the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation
and Resettlement Act, 2013 (30 of 2013);
(b) “Form” means the Form appended to these rules;
(c) “Social Impact Assessment” means an assessment made under sub-section (1) of Section 4 of the Act;
(d) “Social Impact Management Plan” means the plan prepared as part of Social Impact Assessment
process under Sub-section (6) of Section 4 of the Act;
(e) “Section” means section of the Act.
(2) Words and expressions used and not defined in these rules but defined in the Act, shall have the
meanings respectively assigned to them in the Act.
Chapter II
SOCIAL IMPACT ASSESSMENT
3. Social Impact Assessment study.—(1) The appropriate Government shall, for the purpose of the Act, issue
a notification for carrying out Social Impact Assessment in accordance with Part-B of FORM-I of these rules
regarding the commencement of Social Impact Assessment and the same shall be made available in the local
language to the Panchayat, Municipality or Municipal Corporation, as the case may be, and in the offices of
the District Collector, the Sub-Divisional Magistrate and the Tehsil and shall be published in the form of
posters and pamphlets circulated in the affected area, and by affixing the posters at conspicuous places in the
affected areas and shall be uploaded on the website of the appropriate Government:
Provided that such notification shall be issued within thirty days after the deposit of the processing
fee for carrying Social Impact Assessment by the Requiring Body, which shall be determined under sub-rule
(1) of rule 5.
(2) The Social Impact Assessment shall be conducted in consultation with concerned Panchayat,
Municipality or Municipal Corporation, at village level or ward level in the affected areas, for the purposes of
section 4 of the Act, followed by a public hearing at the affected areas by giving adequate publicity about the
date and time and venue for the public hearing to ascertain the views of the affected families which shall be

(3) The Social Impact Assessment Report shall be submitted in FORM-II to the appropriate
Government within a period of six months from the date of its commencement and shall include the views of
the affected families recorded in writing.
(4) The Social Impact Management Plan listing the ameliorative measures required to be undertaken
for addressing the impact of the project under sub-section (6) of section 4 of the Act shall be submitted in
FORM-III along with the Social Impact Assessment Report.
(5) The Social Impact Assessment Report and the Social Impact Management Plan shall be made
available in the local language of the concerned Panchayat, Municipality or Municipal Corporation, at village
level or ward level in the affected areas and in the Offices of the District Collector, the Sub-Divisional
Magistrate and shall be uploaded on the website of the appropriate Government.
4. Institutional support and facilitation for Social Impact Assessment.—(1) The appropriate Government
shall identify or establish an independent organisation which shall be responsible for ensuring that Social
Impact Assessments are commissioned and conducted by such person or bodies other than the Requiring Body
as per the provisions of the Act.
(2) The Social Impact Assessment Unit shall undertake the following tasks namely:-
(a) build and continuously expand a Database of Qualified Social Impact Assessment Resource
Partners and Practitioners, which will serve as a network of individuals and institutions with
the required skills and capacities to conduct Social Impact Assessments for land acquisition
and Rehabilitation and Resettlement;
(b) respond immediately to the appropriate Government’s request for a Social Impact Assessment
to be conducted by preparing a project-specific Terms of Reference;
(c) conduct training and capacity building programmes for the Social Impact Assessment team
and community surveyors and make available manuals, tools, comparative case study reports
and other materials required for the analysis;
(d) provide ongoing support and corrective action, as required during the Social Impact
Assessment process;
(e) ensure that the transaction based web-based workflow for Social Impact Assessments and
Management Information System for Land Acquisition and Rehabilitation and Resettlement
as specified in rule 13 is maintained and that all relevant documents are disclosed as per the
provisions of the Act;
(f) maintain, catalogue of all Social Impact Assessments and associated primary material; and
(g) continuously review, evaluate and strengthen the quality of Social Impact Assessments and
the capacities available to conduct them across the State or Union Territory as the case may
be.
5. Project-specific Terms of Reference and Processing Fee for the Social Impact Assessment.—
(1) Where the appropriate Government intends to acquire land, the proposal for such land acquisition shall be
sent along with all the relevant documents to the Social Impact Assessment Unit, which shall —
(a) prepare a detailed project-specific Terms of Reference for each proposal of land acquisition,
listing all the activities that must be carried out indicating the appropriate team size (and
number of field teams) and profile of the team members, and stipulate the schedule and
deadlines for key deliverables for the Social Impact Assessment as detailed in Part-A of
FORM-I to these rules;
(b) determine an estimated Social Impact Assessment fee based on the Terms of Reference with
clear break-up of costs for each item or activity. The fee amount shall be based on the
parameters defined by the appropriate government including area, type of project and number
of affected families.
(2) Ten per cent. of the Social Impact Assessment fee shall be allocated to Social Impact Assessment
Unit as administrative expenses for preparing the Terms of Reference and estimated Social Impact
Assessment fee report and to submit the same to the appropriate Government.
(3) The Requiring Body shall deposit the Social Impact Assessment fee in the Scheduled Bank
account of the appropriate Government for the purpose.
6. Selection of the Social Impact Assessment team.— (1) The Social Impact Assessment Unit shall be
responsible for selecting the Social Impact Assessment team for each project from the individuals and
institutions registered or empanelled in the Database of Qualified Social Impact Assessment Resource

(2) The Requiring Body shall not be involved in any way in the appointment of the Social Impact
Assessment team being appointed to carry out the Social Impact Assessment.
(3) The size and selection criteria for the Social Impact Assessment team shall be as per the project-
specific Terms of Reference developed by the Social Impact Assessment Unit.
(4) The Social Impact Assessment team may be constituted by appointing individuals or an
organisation with experience in conducting Social Impact Assessments or related field-based assessments and
the team may include—
(a) a combination of independent practitioners, qualified social activists, academics, technical
experts, who are not directly connected with the requiring body; and
(b) at least one woman member;
(5) A team leader shall be appointed from amongst the Social Impact Assessment team to liaison with
the Social Impact Assessment Unit throughout the assessment period.
(6) While selecting the Social Impact Assessment team, it is to be ensured that there is no conflict of
interest involving the team members appointed to assess the concerned project.
(7) (i) If at any stage, it is found that any team member or any family member of the team member
directly or indirectly receives any benefit from the Requiring Body or any other stakeholder in the project, the
said member shall be disqualified.
(ii) All the members of Social Impact Assessment team shall give an undertaking that any team
member or any family member of the team member directly or indirectly shall not receive any benefit from
the Requiring Body or any other stakeholder in the project.
7. Process of conducting the Social Impact Assessment.— (1) The Social Impact Assessment team shall
collect and analyse a range of quantitative and qualitative data, undertake detailed site visits, use participatory
methods such as focused group discussions, participatory rural appraisal techniques and informant interviews
in preparing the Social Impact Assessment report.
(2) All relevant project reports and feasibility studies shall be made available to the Social Impact
Assessment team throughout the Social Impact Assessment process, as required. Any request for information
from Social Impact Assessment team shall be met at the earliest but not exceeding ten days. The District
Collector shall be responsible for providing the information requisitioned by the Social Impact Assessment
team.
(3) A detailed assessment based on a thorough analysis of all relevant land records and data, field
verification, review and comparison with similar projects shall be conducted by the Social Impact Assessment
team. The assessment shall determine the following, namely:-
(a) area of impact under the proposed project, including both land to be acquired and areas that
will be affected by environmental, social or other impacts of the project;
(b) quantity and location of land proposed to be acquired for the project;
(c) the land proposed for acquisition is the bare minimum required;
(d) possible alternative sites for the project and their feasibility;
(e) whether, the land proposed for acquisition in Scheduled Area is a demonstrable last resort;
(f) land, if any, already purchased, alienated, leased or acquired, and the intended use for each
plot of land required for the project;
(g) the possibility of use of any public, unutilised land for the project and whether any of such
land is under occupation;
(h) nature of the land, present use and classification of land and if it is an agricultural land, the
irrigation coverage for the said land and the cropping pattern;
(i) the special provisions with respect to food security have been adhered to in the proposed land
acquisition;
(j) size of holdings, ownership patterns, land distribution, number of residential houses, and
public and private infrastructure and assets; and
(k) land prices and recent changes in ownership, transfer and use of lands over the last three
years.
(4) Based on the land assessment, land records and field verification, the Social Impact Assessment
shall provide an accurate estimate of the number of affected families and the number of displaced families
among them and ensure that, as far as possible, the Social Impact Assessment team shall enumerate all
affected families:
Provided that where enumeration is not possible, a representative sample shall be done by the Social

(5) A socio-economic and cultural profile of the affected area must be prepared, based on available
data and statistics, field visits and consultations as per FORM-II:
Provided that in projects where resettlement is required, the identified resettlement sites shall be visited
and a brief socio-economic profile of the land and its current resident population shall be indicated.
(6) Basing on the data collected in processes listed above and in consultation with the affected
communities and key stakeholders, the Social Impact Assessment shall identify and assess the nature, extent
and intensity of the positive and negative social impacts associated with the proposed project and land
acquisition as per FORM-II.
(7) (i) The Social Impact Assessment process includes the preparation of a Social Impact
Management Plan, which will present the ameliorative measures to be undertaken to address the social
impacts identified in the course of the assessment.
(ii) The Social Impact Assessment team must assess the viability of impact mitigation and
management strategies with clear indication of costs, timelines and capacities.
(iii) The Social Impact Management Plan shall include the following measures:-
(a) that have been specified in the terms of Rehabilitation and Resettlement and
compensation for all the categories of affected families as outlined in the Act;
(b) that the Requiring Body has stated that it will undertake in the project proposal and other
relevant project documents; and
(c) that additional measures being undertaken by the Requiring Body, which has been
undertaken by it in response to the findings of the Social Impact Assessment process and
public hearings.
(8) The Social Impact Assessment must provide a conclusive assessment of the balance and
distribution of the adverse social impacts and social costs and benefits of the proposed project and land
acquisition, including the mitigation measures, and provide an assessment as to whether the benefits from the
proposed project exceed the social costs and adverse social impacts that are likely to be experienced by the
affected families or even after the proposed mitigation measures, the affected families remained at risk of
being economically or socially worse, as a result of the said land acquisition and resettlement.
8. Process for conducting public hearings.— (1) Public hearings shall be held in the affected areas to bring
out the main findings of the Social Impact Assessment, seeking feedback on the findings and to seek
additional information and views for incorporating the same in the final documents.
(2) Public hearings shall be conducted in all Gram Sabhas where members are directly or indirectly
affected by the acquisition of the land:
(3) The date and venue of the public hearing must be announced and publicised three weeks in
advance through public notifications and posters in all the villages within a radius of five kilometres of the
land proposed to be acquired, advertisement in local newspapers, radio, and through direct communication
with Gram Panchayat or Municipal Ward representatives and by uploading the information on the website of
the appropriate Government.
(4) (i) The draft Social Impact Assessment report and Social Impact Management Plan shall be
published in the local language three weeks prior to the public hearing and distributed to all affected Gram
Panchayats and Municipal offices. One copy of the draft report shall be made available in the District
Collector’s office.
(ii) The Requiring Body may also be served with a copy of the draft report. Adequate copies of the
report and summaries shall be made available on the day of the public hearing. Accessible displays and other
visual shall be used to share the findings of the Social Impact Assessment report.
(5) (i) A member of the Social Impact Assessment team shall facilitate the public hearing which shall
be organised through the local administration with the designated government officers of appropriate level.
(ii) The Gram Panchayat or Municipal Ward representatives shall also be included in all the decisions
regarding the arrangements for the public hearings in their respective areas.
(6) All the proceedings shall be held in the local language with effective and credible translators to
ensure that all the participants could understand and express their views.
(7) Representatives from the Requiring Body and designated land acquisition and Rehabilitation and
Resettlement functionaries shall also attend the public hearing and address the questions and concerns raised

(8) Public representatives, local voluntary Organisations and media shall also be invited to attend the
public hearings.
(9) The proceedings of the public hearing shall be video recorded and transcribed accordingly. This
recording and transcription shall be submitted along with the final Social Impact Assessment Report and
Social Impact Management Plan.
(10) After the conclusion of the public hearings, the Social Impact Assessment team shall analyse the
entire feedback received and information gathered in the public meetings and incorporate the same along with
their analysis, in the revised Social Impact Assessment Report accordingly.
(11) Every objection raised in the public meeting shall be recorded and the Social Impact Assessment
team shall ensure that the every objection shall be considered in the Social Impact Assessment Report.
9. Submission of Social Impact Assessment Report and Social Impact Management Plan.— The final
Social Impact Assessment Report and Social Impact Management Plan shall be prepared in the local
language and shall be made available to Panchayat, Municipality or Municipal Corporation, as the case may
be, and the offices of the District Collector, the Sub-Divisional Magistrate and the Tehsil and shall be
propagated in the form of posters circulated in the affected areas by affixing the posters in conspicuous places
and shall also be uploaded on the website of the appropriate Government.
10. Social Impact Assessment Report and Social Impact Management Plan.—The Social Impact
Assessment Report and Social Impact Management Plan shall be formulated keeping in view all the relevant
information and analysis in a single document and reduced to writing that is clear, concise and accessible, in
particular to the members of the affected communities.
11. Appraisal of Social Impact Assessment Report by an Expert Group.—(1)The Expert Group
constituted under Sub-section (1) of Section 7 of the Act shall evaluate the Social Impact Assessment Report
and shall make its recommendation to that effect within a period of two months from the date of its
constitution.
(2) The recommendations of the Expert Group shall be made available in the local language to the
concerned Panchayat, Municipality or Municipal Corporation, at village level or ward level in the affected
areas and in the Offices of the District Collector, the Sub-Divisional Magistrate and the Tehsil and shall be
published in the form of posters circulated in the affected areas and by affixing them in conspicuous places in
the affected areas and shall be uploaded on the website of the appropriate Government.
12. Consideration of the Social Impact Assessment Report, recommendations of the Expert Group
etc..—(1) The appropriate Government shall examine the Social Impact Assessment Report, the
recommendations of the Expert Group, report of the Collector, if any, and recommend such area for
acquisition which would ensure minimum displacement of people, minimum disturbance to the infrastructure,
ecology and minimum adverse impact on the individuals affected.
(2) The recommendation of the appropriate Government under sub-section (1) shall be made
available in the local language to the concerned Panchayat, Municipality or Municipal Corporation at village
level or ward level in the affected areas and in the Offices of the District Collector, the Sub-Divisional
Magistrate and the Tehsil and shall be propagated in the form of posters circulated in the affected areas and by
affixing the posters in conspicuous places and shall also be uploaded on the website of the appropriate
Government.
13. Web-based Work Flow and Management Information System for Land Acquisition and
Rehabilitation & Resettlement.—The appropriate Government shall create a dedicated, user-friendly
website that may serve as a public platform on which the entire work flow of each acquisition case will be
hosted, beginning with the notification of the Social Impact Assessment and tracking each step of decision-
making, implementation and audit.
14. Additional Norms with regard to the Social Impact Assessment Process.—Parameters and a table of
contents for the Social Impact Assessment Study and the Social Impact Management Plan are given in
FORM-II.
15. Inventory of Waste, Barren and Unutilised Land.—To ensure acquisition of minimum amount of land
and to facilitate the utilisation of unutilised public lands, the appropriate Government shall prepare a district-
level inventory report of waste, barren and unutilised public land, and land available in the Government land
bank and shall be made available to the Social Impact Assessment team and Expert group. The inventory

Chapter III
CONSENT
16. Consent Requirements.—(1) The appropriate Government, through the concerned District Collector,
shall obtain prior consent of the affected land owners in PART-A of FORM-IV along with the Social Impact
Assessment study.
(2) The exercise of obtaining the consent shall be undertaken by the appropriate Government, through
the concerned District Collector, who may appoint officers under his control to assist him in the process of
obtaining the prior consent.
(3) The appropriate Government shall take necessary steps for updating the records relating to land
rights, title in the land and other revenue records in the affected areas, so that the names of land owners,
occupants of the land and individuals be identified for initiating the prior consent process and land
acquisition.
17. Consent of the Gram Sabha.—(1) The District Collector shall in consultation with the representatives of
the Gram Panchayats or Autonomous District Councils notify the date, timing and venue for holding special
Gram Sabhas in the affected areas three weeks in advance and conduct public awareness campaigns to
motivate members of the Gram Sabhas to participate in the Gram Sabhas.
(2) The names and signatures of all the members who attended the meeting of the Gram Sabha shall
be taken and kept in the records.
(3) The quorum shall be at least fifty per cent of the total members of the Gram Sabha for considering
the consent as valid:
Provided that one third of the total women members of the Gram Sabha shall also be present in the
Gram Sabha meeting.
(4) Printed copies with the proposed terms and conditions for compensation, rehabilitation and
resettlement shall be made available in the local language at least three weeks prior to the Gram Sabha
meeting.
(5) (i) For public private partnership projects and projects by private companies, representatives of
the Requiring Body, who are competent to take decision and negotiate terms of Rehabilitation and
Resettlement and compensation shall be present at all such Gram Sabha meetings and respond to the queries
raised by the Gram Sabha members.
(ii) The terms and conditions, Rehabilitation and Resettlement, compensation committed by the
Requiring Body shall be explained to the Gram Sabha members in the local language and signatures of the
members as well as the representative of Requiring Body shall be obtained on such terms and conditions.
(6) (i) After deliberations, the Gram Sabha shall pass a resolution with majority in PART-B of
FORM-IV giving or withholding consent for the proposed acquisition and the resolution shall contain the
negotiated terms and conditions for Rehabilitation and Resettlement, compensation, impact management and
mitigation that the Requiring Body has committed and which have been signed by the District Collector or
designated district officer and the representative of the Requiring Body.
(ii) The Gram Sabha resolution once received shall be counter signed by the District Collector or a
designated District Officer and a signed copy shall be handed over to all the panchayat representatives.
(7) Any resolution that does not explicitly contain a statement of consent to the project, a statement of
the negotiated terms of compensation and Rehabilitation and Resettlement shall be invalid.
(8) All the proceedings of the Gram Sabha shall be video recorded, documented in writing and shall
be made available in the respective panchayat offices and uploaded on the website of the appropriate
Government.
(9) Members of the Social Impact Assessment team shall be present to assist the Gram Sabha
meetings.
18. Consent of the Affected Land owners.—(1) (i) In Public Private Partnership projects and projects by
private companies, a list of all affected land owners from whom consent is required to be obtained shall be
drawn up by district officers in consultation with the Social Impact Assessment team.
(ii) The list shall be made available in the affected area, in the form of posters and handouts and by
displaying the list in conspicuous places of the affected areas for at least ten days before obtaining consent.
(2) In case of any objection, the views of the objector shall also be taken, and the reasons for doing so
shall be recorded in writing and conveyed to the concerned person within ten days.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(3) The District Collector shall in consultation with the representatives of Gram Panchayats,
Autonomous District Councils, municipality, municipal corporations, as the case may be, notify the date, time
and venue at least three weeks in advance, for holding the affected land owners meetings at the village or
ward level.
(4) The proposed terms and conditions agreed to by the Requiring Body shall also be made available
in local language at least three weeks in advance of the meeting of the affected land owners to each and every
affected land owner.
(5) (i) For public private partnership projects and projects by private companies, representatives of
the Requiring Body, who are competent to take decision and negotiate terms of Rehabilitation and
Resettlement and compensation shall be present at all such affected land owners meetings and respond to the
queries raised by the affected land owners .
(ii) The terms and conditions, Rehabilitation and Resettlement, compensation committed by the
Requiring Body shall be explained to the members in the local language and signatures of the members as
well as the representative of Requiring Body shall be obtained on such terms and conditions.
(6) (i) At the conclusion of the meeting, each individual land owner shall be asked to indicate in the
signed declaration whether he or she gives or withholds consent for the acquisition of land involved.
(ii) A copy of this declaration with the attached terms and conditions shall be given to the land holder
concerned. The declaration shall be countersigned by the District Collector or district officers on its receipt.
(7) (i) Arrangements shall be made for those who could not attend the land owners meeting for
enabling them to submit their signed declarations to the designated district officer within twenty one days
from the date of land owners meeting.
(ii) The declaration form shall be counter-signed by the District Collector or designated officer on its
receipt and a copy of the declaration, with the attached terms and conditions shall be handed over to the
affected landowner.
(8) Consent procedure shall be determined on the basis of the signed or thumb impression, written
declarations of land owners.
(9) (i) All proceedings of taking affected land owners’ consent during land owners meetings shall be
recorded in video and all the proceedings must be documented in writing.
(ii) The outcome of the consent process shall be made available in panchayat offices and on the web
site of the appropriate Government.
(10) Members of the Social Impact Assessment team shall be present to assist the affected land
owners meeting.
19. Roles and responsibilities of the appropriate Government for consent processes.— (1) The
appropriate government shall notify and publish the date, time and venue of Gram Sabhas, Panchayats or
Autonomous District Council meetings (in cases where Gram Sabha does not exist or has not been
constituted) and affected land owners meetings for obtaining the consent and organise public awareness
campaigns to encourage participation of the affected land owners in the consent processes.
(2) The appropriate Government shall ensure that the following are provided at least three weeks in
advance to every member from whom consent is sought, in the local language, namely:—
(a) a copy of the draft Social Impact Assessment report (if readily available) in the local language;
(b) initial package being offered for compensation and Rehabilitation and Resettlement;
(c) a list of the rights currently enjoyed by the village and its residents under revenue laws, Forest
Rights Act and other legislations;
(d) a written statement signed by the District Collector, certifying that there will be no consequences,
if consent is denied for a project and stating that any attempt to coerce or intimidate in order to
obtain consent shall be illegal; and
(e) contact details of the officer or authority along with official telephone number to be contacted in
case of any attempt to coerce for signing the declaration of consent process.
(3) The District Collector or any official appointed by the District Collector shall attend the Gram
Sabhas, Panchayats or Autonomous District Councils (in cases where Gram Sabha does not exist or has not
been constituted) and land owners meetings.
(4) The appropriate Government shall ensure that all the documents relating to Social Impact
Assessment are made available to the affected land owners and all requests for information are provided

20. Roles and responsibilities of the Requiring Body for consent processes.—(1) The Requiring Body
shall appoint representatives competent to take decisions and negotiate terms and condition of compensation
and Rehabilitation and Resettlement, who shall be present in the meetings of affected land owners for
obtaining the consent and reply to the queries raised by the land owners.
(2) The Requiring Body shall provide all the information on the project, prior to the taking of consent as well
as any additional information, if required.
FORM–I
Part -A. Terms of Reference and Processing Fee for the Social Impact Assessment
[See sub-rule (1) of rule 5]
(i) The Social Impact Assessment Unit will review the proposal for land acquisition sent by the appropriate
Government and produce a project-specific Terms of Reference and budget. Based on the Terms of Reference
and budget, a processing fee will be determined, which must be deposited by the Requiring Body before the
notification of the Social Impact Assessment can be issued.
(ii) The Terms of Reference shall include the following information:-
(a) A brief description of the project, project area and the extent of lands proposed for acquisition.
(b) The objectives of the Social Impact Assessment and all the activities that must be carried out by
the Social Impact Assessment team.
(c) Sequencing, schedule and deadlines for deliverables with dates for the Social Impact Assessment
process, based on the size and complexity of the project and land acquisition, and whether
consent of Gram Sabhas and/or land owners is required to be sought.
(d) The appropriate size and profile of the Social Impact Assessment team required (including field
surveyors if needed) to conduct the Social Impact Assessment for the specific project.
(e) A project-specific budget based on the Terms of Reference, with a clear break-up of costs for
each item or activity.
(f) The schedule for the disbursement of funds to the Social Impact Assessment team tied to clearly-
defined deliverables in the Social Impact Assessment process.
(iii) The processing fee will be determined based on the Terms of Reference and budget developed for each
specific project and will be based on the type, size, location, and sensitivity of the project and the land
proposed for acquisition. Information regarding the processing fee bands and the cost for separate components
or line items must be made consistent and easily accessible, so that the Requiring Body can factor this into its
costs in advance. These rates must be reviewed and revised from time to time. A fixed proportion of the fee
will go towards meeting the costs of the Social Impact Assessment Unit.
Part-B. Notification of the Social Impact Assessment
[See sub-rule (1) of rule 3]
The notification of the Social Impact Assessment must include:-
(a) Name of project developer, a brief description of the proposed project and the extent of the lands proposed
for acquisition, the project area and the affected areas to be covered by the Social Impact Assessment.
(b) The main objectives of the Social Impact Assessment and key activities including (i) consultations (ii)
survey (iii) public hearing/s.
(c) If consent of Gram Sabhas and/or land owners is required, the notification must state this.
(d) The timeline for the Social Impact Assessment and the final deliverables (Social Impact Assessment
Report and Social Impact Management Plan) along with the manner of their disclosure must be specified.
(e) Statement that any attempt at coercion or threat during this period will render the exercise null and void.
(f) Contact information of the Social Impact Assessment Unit.

PART-B. FORMAT FOR GRAM SABHA RESOLUTION
[See sub-rule (6) of rule 17]
We, the undersigned members of the Gram Sabha of ___________ within ______________ panchayat of
__________ tehsil/taluka in ___________district wishes to state that the following certification is based on
the information supplied by the administration and officials. If this information is incomplete or incorrect or
if any consent has been obtained through any use of threats, fraud or misrepresentation, it is null and void. On
this basis, this Gram Sabha hereby certifies that it CONSENTS / REFUSES TO CONSENT to the proposed
_________ project, which will involve:
 acquisition of _________ acres of private land.
 transfer of ___________ acres of government land to the project.
 transfer of ___________ acres of forest land to the project.
The terms and conditions of compensation, rehabilitation and resettlements benefits and social impact
mitigation measures agreed to by the Requiring Body (state the name) are attached.
The Gram Sabha also states that any consent is subject to all of its residents receiving title to all of their
individual and community rights over forests and forest lands, including their titles for forest land that they
have been cultivating, ownership titles for all forms of minor forest produce that they use, and titles to protect
and manage their community forests. [Note: This will have to be certified by this Gram Sabha separately.]
