voLFkk dk gkxs kA lh- oys eq:xu] lfpo DELHI LEGISLATIVE ASSEMBLY SECRETARIATS NOTIFICATION Delhi, the 2nd December, 2019 F.No. 21(48)/Sports uni,/2019/LAS-VI/Leg./2720.—The Following is published for general information.— BILL NO. 05 OF 2019 THE DELHI SPORTS UNIVERSITY BILL -2019 (As introducted in the Legislative Assembly of the National Capital Territory of Delhi on 02 December, 2019) A BILL to establish and incorporate a Sports University at Delhi to facilitate and promote the Sports Studies, research and extension work in emerging areas of Sports Education with focus on liberal sports activities and science, for example promote the world class sports persons, trainers, sporting professional and to promote health care among masses through physical education & the spirit of sporting & also to achieve excellence in these and connected fields and other matter connecting therewith or incidental thereto. Be it enacted by the legislative assembly of the National Capital Territory of Delhi in the Seventieth year of the Republic of India as follows:- 1. Short Title, Extent and Commencement :- (i) This Act may be called the Delhi Sports University Act, 2019. (ii) It shall come into force on such date as the Government of the National Capital Territory may, by notification in the Official Gazette, appoint. 2. Definitions: - In this Act, unless the context otherwise requires, (i) “Academic staff” means such categories of staff as are designated by the Statutes of the University to be the academic staff of the University; (ii) “Board” means the Board of Management of the University; (iii) “Board of Sports Studies” means the Board of Sports Studies as may be constituted under the Statutes of the University; (iv) “Campus” means the one or multiple units established or constituted by the University for imparting instructions, conducting training or research, or all of these; (v) “Centre for Community Outreach and Extension Services” means the Centre for Community Outreach and Extension Services of the University; (vi) “Centre for Professional Excellence in Sports” means the Centre for Professional Excellence in Sports of the University; (vii) “Chancellor”, “Vice-Chancellor” and “Pro Vice-Chancellor” mean, respectively the Chancellor, the Vice-Chancellor and the Pro Vice-Chancellor of the University; (viii) “Controller of Examinations” means Controller of Examinations of the University; (ix) “Controller of Finance” means Controller of Finance of the University ; (x) “Court” means the Court of the University; (xi) “Council of Sports and Academics” means the Council of Sports and Academics of the University;26 DELHI GAZETTE : EXTRAORDINARY PART IV] (xii) “Dean” means the Dean of the University. (xiii) “Delhi” means the National Capital Territory of Delhi. (xiv) “Delhi Sports School” means the Delhi Sports School established, controlled and administered by the University. (xv) “Department” means Sports Academic Department within a Faculty; (xvi) “Employee” means any person appointed by the University; (xvii) “Finance Committee” means the Finance Committee of the University; (xviii) “Government” means Lieutenant Governor of the National Capital Territory of Delhi appointed by the President under article 239 and designated as such under article 239 AA of the constitution; (xix) “Lieutenant Governor” means the Lieutenant Governor of the National Capital Territory of Delhi appointed by the President of India under Article 239 and designated as such under Article 239 AA of the Constitution; (xx) “Misconduct” means a misconduct prescribed by the Statutes and the Ordinance; (xxi) “Notification” means a notification published in the Official Gazette; (xxii) “Prescribed” means prescribed by the Statutes made under this Act; (xxiii) “Principal” means the Principal of the Delhi Sports School and includes, where there is no Principal, the person who is for the time being duly appointed to act as the Principal, and in the absence of the Principal or the acting Principal, as the case may be, a Vice-Principal duly appointed as such; (xxiv) “Registrar” means the Registrar of the University; (xxv) “School” means the Delhi Sports School established and administered by the University; (xxvi) “Senate” means the Senate of the University; (xxvii) “Staff” means all teaching and non-teaching staff of the University; (xxviii) “Statutes”, “Ordinances” and “Regulations” mean respectively the Statutes, Ordinances and Regulations as made under this Act and as applicable for the time being in force; (xxix) “University” means the Delhi Sports University as incorporated under this Act; (xxx) “University Schools of Studies” mean University Schools of Studies as set up by the University (xxxi) “University teachers” means such persons as may be appointed for imparting instruction, doing research in any area of academics or sports or conducting training or coaching in one or other area of sports in the University 3. Incorporation of the University:- (i) With effect from such date as the Government may, by notification in the official Gazette, appoint, there shall be established in the National Capital Territory of Delhi, a university by the name of the “Delhi Sports University”. (ii) The Delhi Sports University shall be a body corporate having perpetual succession and a common seal with power, subject to the provisions of this Act, to acquire, hold and dispose of property and to contract, and may by the said name sue or be sued. Provided that the land acquired and building constructed with the assistance of the Government shall not be disposed without the prior approval of the Government. (iii) The Chancellor, the first Vice-Chancellor, the first members of the Board of Management, the first members of the Council of Sports and Academics and the first Registrar of the University so long as they continue to hold such office or membership and all such persons as may hereafter be appointed at such office or as members are hereby constituted a body corporate by the name of ‘Delhi Sports University’. 4. University Open to All:- (i) The enrolment, employment and such other facilities or the privileges of the University shall be open to all eligible persons of either sex without any discrimination on the basis of race, religion, region, creed, caste, class.[PART IV DELHI GAZETTE : EXTRAORDINARY 27 (ii) Nothing in this section shall be deemed to prevent the University from making any special provision in the nature of affirmative action for the benefit of women or of persons belonging to the weaker sections of the society. 5. Objectives of the University:- (i) The Delhi Sports University shall be a University dedicated to promotion of sports, academics and research in various aspects of sports and the allied disciplines like health & exercise sciences. It shall seek to promote professional excellence in sports and allied disciplines. It shall promote knowledge, academics, research and professional activities in sports, sports related areas, health and exercise sciences. (ii) Without prejudice to the general objectives of the University as stated in Sub Section(i) above, the University shall have the following objectives namely; (a) To develop an institutional framework i.e. to develop a eco-system for promotion of sports in the National Capital Territory of Delhi and for the nation as a whole. (b) To promote the research, knowledge development and dissemination, academics with professional activity orientation in sports. (c) To inculcate multi-disciplinarity in sports and related disciplines to enhance the employability of the sports professionals. (d) To popularize sports through various community outreach and extension programme so as to promote general health of the masses through the sports and related disciplines like physical education and exercise sciences. (e) To promote quality sports education, develop centre of excellence and promote sports as a full time career. (f) To setup systems for talent scouting and mentoring at the grassroots level. (g) To develop systems for efficient sports event organization, and promotion of Sports Event. (h) To develop processes for strengthening and professionalizing the Sports Federations in the country. (i) To develop mechanisms for State - Industry interface. (j) To develop academic processes for development of world class sports infrastructure development. (k) To provide for instruction in such branches of learning as the University may, from time to time, determine and to make provision for research and for the advancement and dissemination of knowledge and skills; (l) To provide training and coaching in such areas of sports as the University may, from time to time, determine and to create facilities for the professional excellence and skill acquisition; 6. Powers and Functions of the University:- The University shall have the following powers and perform the following functions, namely:- (i) The University shall have all such powers and shall perform all such functions which are required to achieve its objectives and are integral to the functioning of a dedicated institution of higher learning for holistic promotion of sports, academics and research in various aspects of sports and allied disciplines including promotion of professional excellence in sports, promotion of research, academics and training in various areas of sports and its allied disciplines. (ii) Without prejudice to the generality of powers and functions as stated in Sub Section (i) above, the University shall have following powers and functions; (a) To create and institute systems and processes for teaching, learning, research, training, professional development and excellence or the community outreach and extension services in the area of sports, sports related areas or the allied disciplines. (b) To award, subject to such conditions as the University may determine, diplomas and certificates to, and confer degrees and other academic distinctions on the basis of examinations, evaluation or any other method of testing on, persons; (c) To confer honorary degrees or other distinctions in the manner prescribed by the Statutes;28 DELHI GAZETTE : EXTRAORDINARY PART IV] (d) To receive benefactions, donations and gifts from persons and to name after them such chairs, institutions, buildings and the like as the University may determine, whose gift or donation to the University is worth such amount as the University may decide; (e) To create academic, sports-professional, administrative, ministerial and other posts in the University and to make appointments thereto in accordance with the statutes of University; (f) To provide for the terms and conditions of service of— i) teachers, researchers and the sports-professionals appointed by the University; ii) other employees appointed by the University; With the prior approval of Board of Management (BOM) (g) To appoint persons working in any other university or organization as teachers, trainers or sports professional of the University for a specified period; (h) To co-operate or collaborate or associate with any other university, authority or sports related organization or institution of higher learning in such manner and for such purpose as the University may determine; (i) To approve persons working in any institution co-operating, collaborating or associating with the University, for imparting instruction or supervising research, conducting sports training or such other activities falling within the domain of the University, and to withdraw such approval; (j) To approve an institution of higher learning or institutions of specialized sports training and to withdraw such approval; (k) To approve persons working in any approved institution for imparting instruction or supervising research, or imparting sports training and to withdraw such approval; with the prior approval of Board of Management (BOM). (l) To build a body of academia to perform academic functions, and to pay them remuneration in the manner prescribed; (m) To build a body of sports trainers to train sports professionals and to pay them remuneration in the manner as prescribed; (n) To set up facilities for sports, academics, research, training or coaching etc; (o) To set up facilities for regular and specialized training in various kinds of sports, and health related exercise sciences (p) To set up curriculum development centres for various academic subjects and sports training modules for various sports and games; (q) To establish and maintain sports training centers and facilities and such other centers of education, research, training and extension as deemed appropriate by the University; (r) To make provision for research, advisory and training services and, for that purpose, to enter into such arrangements with other organizations, or bodies as the University may deem necessary; (s) To determine academic and sports based professional standards for admission to the University which may include examination, evaluation or any other methods of selection; (t) To institute and award fellowships, scholarships, studentships, medals and prizes; (u) To demand and receive payment of fees and other charges; (v) To supervise the residence of the students of the University and to make arrangements for promoting their health and general welfare; (w) To make such special arrangements in respect of women students as the University may consider desirable; (x) To regulate the conduct of the students of the University; (y) To regulate the work and conduct of the employees of the University; (z) To regulate and enforce discipline among the employees and the students of the University and take such disciplinary measures in this regard as may be deemed necessary;[PART IV DELHI GAZETTE : EXTRAORDINARY 29 (aa) To make arrangements for promoting the health and general welfare of the employees of the University; (bb) To acquire, hold, manage and dispose of any property, movable or immovable, including trust and endowment properties, for the purposes of the University; with the prior approval of the Board of Management (BoM). (cc) To borrow, with the approval of the Government, on security of the property of the University, moneys for the purposes of the University; (dd) To assess the needs of the students in terms of subjects, fields of specialization, levels of education and training of technical manpower, both on short and long term basis, and to initiate necessary programmes to meet these needs; (ee) To initiate measures to enlist the co-operation of the sports industry and sports professionals to promote the professional excellence in sports, the academia and research in sports; (ff) To provide for instruction through “distance learning” and “open approach” and for mobility of students from the non-formal (open learning) stream to the formal stream and vice-versa; (gg) To evolve an operational scheme for enforcing the accountability of the teachers and other employees to the University system; (hh) To prescribe a Code of Ethics for the teachers, Code of Conduct for other employees and Code of Discipline for the students; and (ii) To do all such other acts and things as may be necessary or incidental to the exercise of all or any of the powers of the University or necessary for conducive to the attainment of all or any of the objects of the University. 7. Distinctive Features of the University:- (i) It shall be a State University established by and maintained and administered under the auspices of the Government of the National Capital Territory of Delhi. (ii) The University shall endeavor to operate on sports facilities sharing model, where in the University shall share the existing sports facilities and infrastructure under the command of Government of Delhi and its agencies. (iii) It shall conduct academic programmes similar to formal education system of the University however, it shall multiple entry point for the sports persons, who may do the prescribed bridge courses and join the formal education system. (iv) It shall have a comprehensive physical and academic infrastructure for development and research in methodology, equipment, physical fitness, sports medicine etc. (v) It shall have distinct Sports Excellence Centres to tap talents and promote excellence in various sporting and gaming fields. The Centres for Excellence shall have mentor based modules, where in established sports persons shall be invited to join the institute for mentoring of prospective sports persons. (vi) It shall have University Schools of Studies and offer courses in various disciplines of study to impart specialized training in Sports Medicine, Sports Technology, Sports Businesses & Sports Events and Media Management and such other courses as may be considered needful. (vii) The University shall be established by the initial grant of the Delhi Government, however, it shall be encouraged to evolve and develop its own revenue generation models for its recurring expenditures. (viii) The University shall endeavor to participate in various kinds of community outreach and extension programmes for promotion of sports, sporting spirit, healthy life styles, sports recreation and physical exercises etc. with special emphasis on women and persons with special needs like physically challenged, senior citizens, etc. (ix) For promotion of sports and sports based training and talent mentoring the University shall endeavor to collaborate with similar national and international institutions. (x) The University shall focus on identification of sports talent in the National Capital Territory of Delhi in particular and the nation in general, training and nurturing of these talents for their all-round development and the educational knowledge impartment to these persons so that they can transit to normal society after the end of their sports career.30 DELHI GAZETTE : EXTRAORDINARY PART IV] (xi) The University shall promote, maintain and administer a specialized boarding school for school level education and promotion of sports excellence and sports talent alongside the formal school education. (xii) The University shall have multiple entry points to encourage aspirants, students and the professionals to engage in one or other aspects of sports. (xiii) The university shall have an equal quota for the students of sports school, Vasant Kunj, at par with the sports school within the University for Admission in the university at the appropriate entry point. 8. Authorities of the University: The following shall be the authorities of the University namely:- (i) The Board of Management; (ii) The Court (iii) The Senate (iv) The Council of Sports and Academics; (v) The Board of Sports Studies; (vi) The Finance Committee; and (vii) Such other authority as may be declared as an authority of the University and its functions defined by the Statutes of the University. 9. The Visitor (i) The President of the Republic of India shall be the visitor of the University. (ii) Any dispute arising between the University and any other University established by law in Delhi may be referred to the Visitor, whose decision shall be final and binding on the parties. 10. The Chancellor (i) The Lieutenant Governor of Delhi shall be the Chancellor of the University. (ii) The Chancellor shall be the highest authority of the University and shall, if present, preside over the convocation of the University for conferring degrees. (iii) The Chancellor shall, subject to the provisions of this Act, exercise such powers as may be prescribed. (iv) Without prejudice to the powers as may be prescribed, the Chancellor shall, subject to the provisions of this Act have the following power: (a) The Chancellor shall have the power to cause an inspection, to be made by such person or persons as he may direct, of the University, sports centres or divisions maintained by the University, the buildings, the laboratories and equipment, sports infrastructure and facilities and also of the teaching, professional training and the examination or assessment and other work conducted or done by the University, its centres of divisions as the case may be, and to cause an inquiry to be made in the like manner in respect of any matter connected with the administration or finances of the University, its centres or division as the case may be. (b) The Chancellor shall, in every case, give notice to the University of his intention to cause an inspection or inquiry to be made and the University shall, on receipt of such notice, have the right to make such representation to the Chancellor, as it may consider necessary, within such period as specified in the notice. (c) After considering the representation , if any, made by the University, the Chancellor may cause to be made such inspection or inquiry as is referred to in sub-section(3). (d) Where an inspection or inquiry has been caused to be made by the Chancellor, the University shall be entitled to appoint a representative who shall have the right to be present and be heard at such inspection or inquiry. (e) The Chancellor may address the Vice-Chancellor with reference to the result of such inspection or inquiry as is referred to in sub-section (3) and the Vice-Chancellor shall communicate to the Board of Management the views of the Chancellor with such advice as the Chancellor may be pleased to offer upon the action to be taken thereon.[PART IV DELHI GAZETTE : EXTRAORDINARY 31 (f) The Board of Management shall communicate through the Vice-Chancellor to the Chancellor on action, if any, as it proposes to take or has been taken by it upon the result of such inspection or inquiry. (g) Where the Board of Management does not, within a reasonable time, take action to the satisfaction of the Chancellor, the Chancellor may issue such directions as he may think fit and the Board of Management shall comply with such directions. (h) Without prejudice to the foregoing provisions of this section, the Chancellor may, by order in writing, annul any proceeding of the University which is not in conformity with this Act, the Statutes or the Ordinances: (i) Provided that before making any such order, the Chancellor shall call upon the University to show cause why such an order should not be made and shall consider the cause shown, if any, within the time-limit specified by him. 11. The Board of Management (i) The Board of Management shall be the principal executive body of the University and shall meet at least two times in an academic year. (ii) The constitution of the Board of Management, the term of office of its members and its powers and functions shall be such as may be prescribed. (iii) The Vice Chancellor of the University shall be the Chairperson of the Board of Management (iv) The Board of Management shall consist of the following persons, namely – (a) Vice-Chancellor : Chairperson (ex-officio); (b) Pro Vice-Chancellors (ex-officio); (c) Minimum four to maximum six eminent persons from the disciplines of sports, technology, science, humanities, social sciences and management to be nominated by the Government (on the recommendations of the Vice-Chancellor). Out of nominated eminent persons, one person will, compulsorily, be from the discipline of sports. (d) Two eminent persons from the Industries or Organizations associated with sports to be nominated by the Government (on the recommendations of the Vice-Chancellor), (e) A representative of University Grants Commission (UGC); (f) A representative of Sports Academy of India, Govt. of India; (g) Principal Secretary/Secretary (Training and Technical Education) of the Government (ex-officio); (h) Principal Secretary or Secretary, Finance of the Government (ex-officio); (i) Principal Secretary or Secretary, Higher Education of the Government (ex-officio); (j) Director, Education of the Government (ex-officio); (k) Four Deans of the Sports University as nominated by the Vice-Chancellor; (l) Two Heads of Departments of Sports as nominated by the Vice-Chancellor; (m) Registrar – Member-Secretary (ex-officio); (v) Where a person has become a member of the Board by reason of the office or appointment he holds, his membership shall terminate when he ceases to hold that office or appointment; (vi) The term of office of the nominated members of the Board, other than ex-officio members, shall be three years but they are eligible for re-nomination for maximum of total two tenures; (vii) A member of the Board shall cease to be a member, if he resigns or becomes of unsound mind, or becomes insolvent or is convicted of a criminal offence involving moral turpitude; A member, who is employee of the University shall also cease to be member, if he accepts a full time appointment in32 DELHI GAZETTE : EXTRAORDINARY PART IV] another University or if he not being an ex-officio member, fails to attend three consecutive meetings of the Board without taking prior approval of the Vice-Chancellor; (viii) A member of the Board, other than an ex-officio member may resign from his office by a letter addressed to the Chairperson, Board of Management and such resignation shall take effect, as soon as, it has been accepted by him; (ix) Any vacancy in the Board shall be filled by nomination by the respective nominating authority and on expiry of the period of the vacancy such nomination shall cease to be effective; 12. Powers, functions and meetings of the Board of Management- (i) The Board shall have the following powers and functions, namely:- (a) to consider and pass resolutions on the annual report and the annual accounts of the University and the report of its auditors on such accounts; (b) to exercise all financial powers and manage and regulate the finances, accounts, investment, properties, business and all other administrative affairs of the University and for the purpose, constitute committees and delegate the powers to such committees or such officers of the University as it may deem fit; (c) to invest any money belonging to the University, including any unapplied income in securities as it may, from time to time, think fit, on the advice of Finance Committee, except land acquired or buildings constructed with the assistance of the Government, in which cases, the prior approval of the Government shall be required; (d) to enter into, vary, carryout and cancel contracts on behalf of the University and for that purpose to appoint such officers as it may think fit; (e) to provide the buildings, premises, furniture, computers and apparatus and other means needed for carrying on the work of the University; (f) to entertain, adjudicate upon, and if it thinks fit, to redress any grievances of the officers, the teachers, the students and the employees of the University; (g) to create posts of all Groups on the recommendation of Senate and appoint persons to academic as well as other posts in the University; (h) to select a common seal for the University; (i) to lay down policy guidelines for admitting “Foreign students, Persons of Indian Origin (PIOs), the Non-Resident Indians (NRIs) and sponsored students” as supernumerary against higher fee prescribed by it from time to time; (j) to exercise such other powers and to perform such other duties as may be considered necessary or imposed on it by or under this Act; (ii) (a) The Board shall meet at least, two times in a year and not less than fifteen days notice shall be given for such meetings. (b) The meetings of the Board shall be called by the Registrar under instructions of the Vice-Chancellor or at the request of not less than eight members of the Board. (c) One half of the members of the Board shall form the quorum at any meeting. (d) In case of difference of opinion among the members, the opinion of the majority shall prevail; (e) Each member of the Board shall have one vote and if there be equality of votes on any question to be determined by the Board, the Chairperson of the Board or, as the case may be, the member presiding over that meeting shall, in addition, have a casting vote. (f) Every meeting of the Board shall be presided over by the Chairperson, Board of Management, who shall be the Vice-Chancellor of the University. In the absence of the Vice-Chancellor, a senior-most Pro-Vice-Chancellor shall preside over the meeting of Board of Management, and if there is no Pro-Vice-Chancellor in the University, senior-most Dean shall preside over the meeting. (g) In emergent cases, the Chairperson may exercise the powers of the Board of Management and inform the Board of the action taken by him in good faith for its ratification in the next meeting of the Board and the Board may either ratify the decision of the Chairperson or accept it with modifications or reject it and in the event of modification or rejection of the decision of the Chairperson by the Board,[PART IV DELHI GAZETTE : EXTRAORDINARY 33 such decision shall stand modified or rejected, as the case may be, retrospectively i.e., from the date of implementation of such decision of the Chairperson. (h) If urgent action by the Board becomes necessary, the Chairperson, Board of Management, may permit the business to be transacted by circulation of papers to the members of the Board, and the action so proposed to be taken shall not be taken unless agreed to by a majority of members of the Board and the action so taken shall be forthwith intimated to all the members of the Board and in case the authority concerned fails to take a decision, the matter shall be referred to the Chancellor, whose decision shall be final. 13. The Senate- (i) The Senate shall be the principal academic body of the University and shall, subject to the provisions of this Act, the Statutes and the Ordinances, have the control and regulations of, and be responsible for, the maintenance of standards of instruction, education, research and examination within the University and shall exercise such other powers and perform such other duties as may be conferred or imposed upon it by the Statutes. (ii) The Senate shall have the right to advise the Board on all academic matters. (iii) The Senate shall consist of the following persons, namely:- (a) Chairperson: Vice-Chancellor of the University (ex-officio) ; (b) Pro Vice-Chancellors (ex-officio); (c) Four persons, who are not employees of the University to be co-opted by the Senate on the recommendations of the Vice-Chancellor from amongst sports eminence, educationists, scientists or engineers of repute; (d) A nominee of the University Grants Commission; (e) A nominee of the Sport Academy of India; (f) A representative of Sports Industries, as nominated by the Vice-Chancellor; (g) All Deans of the University ; (h) Four Heads of Departments as nominated by the Vice-Chancellor; (i) Four Professors of the University as nominated by the Vice-Chancellor; (j) One Associate Professor and one Assistant Professor as nominated by the Vice-Chancellor; (k) Controller of Examinations; (l) One person of eminence who is alumni, as nominated by the Vice-Chancellor; (m) Two Student representatives as nominated by the Vice-Chancellor; and (n) Registrar - Member- Secretary (ex-officio). (iv) The term of the members of the Senate, other than ex-officio members, shall be years except the student representative, in which case the tenure will be for one year; 14. Powers, Functions and Meetings of the Senate- (i) subject to the provisions of this Act, Statutes, Ordinances and Regulations and overall supervision of the Board, the Senate shall manage the academic affairs and matters in the University and in particular shall have the following powers and functions, namely:- (a) to report on any matter referred or delegated to it by the Board; (b) to make recommendations to the Board with regard to the creation, abolition or classification of teaching posts in the University and the emoluments payable and the duties attached thereto; (c) to make recommendations to the Board with regard to the creations and abolition of various faculties of studies and academic Departments; (d) to promote research within the University and to require from time to time, report on such research; (e) to consider proposals submitted by the teachers on the academic activities; (f) to lay down policies for admissions to the University;34 DELHI GAZETTE : EXTRAORDINARY PART IV] (g) to recognize diplomas and degrees of other Universities and Institutions and to determine their equivalence in relation to the diplomas and degrees of the Universities; (h) to fix, subject to any conditions accepted by the Board, the time, mode and conditions of the competition for Fellowship, Scholarship and other prizes and to recommend for award of the same; (i) to appoint examiners and moderators, and if necessary to remove them and to fix their fees, emoluments, traveling and other allowances and expenses; (j) to recommend arrangements for the conduct of examinations and the dates for holding them; (l) to declare and review the result of the various examinations or to appoint committees or officers to do so, and to make recommendations regarding the conferment or grant of degrees, honors, diplomas, licenses, titles and marks of honor; (k) to recommend stipends, scholarships, medals and prizes and to make other awards in accordance with the regulations and such other conditions as may be attached to the awards; (m) to approve or revise the syllabus for the prescribed courses of study and lists of prescribed or recommended text books and to decide for publishing of books by the University; (n) to approve such forms and registers as are from time to time, required by the ordinances and regulations; (o) to formulate, from time to time, the desired standards of education to be adhered in drawing up the curriculum and syllabi for being taught in the University; (p) to perform, in relation to academic matters, all such duties and to do all such acts as may be necessary for the proper carrying out of the provisions of this Act and the Ordinances and Regulations made there under; (ii) (a) The Senate shall meet as often as may be necessary, but not less than three times, during an academic year; (b) One half of the existing members of the Senate shall form the quorum for a meeting of the Senate; (c) In case of difference of opinion among the members, the opinion of the majority shall prevail; (d) Each member of the Senate, including the Chairperson of the Senate, shall have one vote and if there be an equality of votes on any matter to be determined by the Senate, the Chairperson shall in addition, have a casting vote; (e) Every meeting of the Senate shall be presided over by the Vice-Chancellor and in the absence of Vice- Chancellor, the Pro-Vice Chancellor as nominated by the Vice-Chancellor, will preside the meeting and in his absence, senior most Dean will preside over the meeting; If urgent action by the Senate becomes necessary, the Chairperson of the Senate may permit the business to the transacted by circulation of papers to the members of the Senate and the action proposed to be taken shall not be taken unless agreed to, by a majority of the members of the Senate, and the action as taken shall forthwith be intimated to all the members of the Senate, and in case the authority concerned fails to take a decision, the matter shall be referred to the Chancellor whose decision shall be final. 15. The Court – (i) The Court shall be the supreme authority of the University and shall consist of the following persons namely:- (a) Chancellor, who shall be the chairperson; (b) Minister of Education of the Government (ex-officio); (c) Vice-Chancellor (ex-officio); (d) Pro Vice-Chancellors (ex-officio); (e) Principal Secretary/Secretary (Training and Technical Education) of the Government (ex-officio); (f) Principal Secretary/Secretary (Higher Education) of the Government (ex-officio); (g) Principal Secretary/Secretary (Finance) of the Government (ex-officio); (h) Director, Education of the Government (ex-officio); (i) Four eminent persons from the disciplines of sports, technology, science, humanities, social sciences and management to be nominated by the Government on the recommendations of the Vice-[PART IV DELHI GAZETTE : EXTRAORDINARY 35 Chancellor. Out of nominated eminent persons, one person will, compulsorily, be from the discipline of sports. (j) One representative of alumni of the University to be nominated by the Vice-Chancellor for a period of two years; (k) Four Deans of the University as nominated by the Vice-Chancellor; (l) Two Heads of Departments as nominated by the Vice-Chancellor; (m) A member of non-teaching staff to be nominated by Vice-Chancellor by rotation for a tenure of one year; (n) Registrar - Member-Secretary (ex-officio). (ii) The term of office of the nominated members of the Court, other than ex-officio members, shall be three years. (iii) Where a person has become a member of Court by reason of the office or appointment he holds, his membership shall terminate when he ceases to hold that office or appointment. (iv) A member of the Court shall cease to be a member if he resigns or becomes of unsound mind, or becomes insolvent or is convicted of a criminal offence involving moral turpitude. (v) A member shall also cease to be member if he accepts a full time appointment in another University, or if he not being an ex-officio member fails to attend three consecutive meetings of the Court. (vi) A member of the Court, other than an ex-officio member, may resign his office by a letter addressed to the Chancellor and such resignation shall take effect as soon as it has been accepted by him. (vii) Any vacancy in the Court shall be filled by nomination by the respective nominating authority and on expiry of the period of the vacancy such nomination shall cease to be effective. 16. Powers, functions and meetings of the Court- (i) Subject to the provisions of this Act, the Court shall review, from time to time, the broad policies and programmes of the University and suggest measures for improvement and development of the University, the Court shall have the following other powers and functions namely:- (a) to consider the broad policies or any proposed modification thereof by the Board of Management; (b) to advice the Chancellor in respect of any matter which may be referred to it for advice; and (c) to perform such other functions as may be prescribed. (ii) The Court shall ordinarily meet at least once in every calendar year, and that meeting of the Court shall be called by the Registrar with the approval of the Chancellor; (iii) For every meeting of the Court, normally fifteen days notice shall be given; (iv) One half of the members existing on the rolls of the Court shall form the quorum; (v) Each member shall have one vote and if there be equality of votes on any question to be determined by the Court, Chairperson of the Court shall, in addition, have a casting vote; (vi) In case of difference of opinion among the members, the opinion of the majority shall prevail; 17. The Council of Sports and Academics (i) The Council of Sports and Academics shall be the principal advisory body to the advice the Board of Management on the sports, academic, research and other professional domains of the University. (ii) It shall, subject to the provisions of this Act, the Statues and the Ordinances, have the control and regulation of, and be responsible for, the maintenance of standards of instruction, training, education in various areas of academics and the sports and that of the examination and assessment system within the University and shall exercise such other powers and perform such other duties as may be conferred or imposed upon it by the Statutes. (iii) The constitution of the Council of Sports and Academics and the term of office of its members shall be such as may be prescribed. (iv) The Council of sports and academics shall consist of the following persons, namely:- (a) The Vice-Chancellor who shall be the chairman;36 DELHI GAZETTE : EXTRAORDINARY PART IV] (b) Five persons from amongst sports person, educationists of repute or men of letters or eminent public men, who are not in the service of the University, and nominated by the Government; (c) A nominee of the University Grants Commission or its successors; (d) Five professors nominated by the Vice-Chancellor with the prior approval of the Chancellor; (e) all Heads of the schools; (f) two members of the teaching staff, one each respectively representing by the Vice-Chancellor, with the prior approval of the Chancellor; (g) Such other member as may be prescribed by the Statutes. (v) The term of the members of the Academic Council, other than ex-officio members, shall be three years. 18. Powers, functions and meetings of the Council of Sports and Academics. (i) Subject to the provisions of this Act, Statutes and Regulations and overall supervision of the Board of Management, the Council of sports and academic shall manage the academic affairs and matters in the University and in particular shall have t he following powers and functions, namely:- (a) to report on any matter referred or delegated to it by the Governing Body or the Board of Management; (b) to make recommendations to the Board of Management with regard to the creation, abolition or classification of trainer and teaching posts in the University and the emoluments payable and the duties attached thereto; (c) to formulate and modify or revise schemes for the organization of the faculties, and to assign to such faculties their respective subjects and also to report to the Board of Management as to the expediency of the abolition or sub-division of any faculty or the combination of one faculty with another; (d) to recommend arrangements for the instruction and examination of persons other than those enrolled in the University; (e) to promote research within the University and to require from time to time, reports on such research; (f) to consider proposals submitted by the faculties; (g) to lay down policies for admissions to the University; (h) to recommend recognized diplomas and degrees of other University and institutions and to determine their equivalence in relation to the certificates, diplomas and degrees of the University; (i) to fix, subject to any conditions accepted by the Court, the time, mode and conditions of the competition for Fellowships, Scholarships and other prizes and to recommend for award of the same; (j) to make recommendations to the Board of Management with regard to the appointment of examiners and, if necessary, their removal and fixations of their fees, emoluments and traveling and other expenses; (k) to recommend arrangements for the conduct of examinations and the dates for holding them; (l) to declare or review the result of the various examinations or to appoint committees or officers to do so, and to make recommendations regarding the conferment or grant of degrees, honours, diplomas licences, titles and marks of honour; (m) to recommend stipends, scholarships, medals and prizes and to make other awards in accordance with regulations and such other conditions as may be attached to the awards; (n) to approve the syllabus for the prescribed courses of study and to approve or revise lists of prescribed or recommended text books and to publish the same; (o) to approve such forms and registers as are, from time to time, required by the regulations; (p) to formulate, from time to time, the desired standards of sports education to be adhered in drawing up the curriculum and syllabi for being taught in the University;[PART IV DELHI GAZETTE : EXTRAORDINARY 37 (q) to perform, in relation to academic matters, all such duties and to do all such acts as may be necessary for the proper carrying out of the provisions of this Act and the regulations made there under. (ii) (a) The Council of Sports and Academic shall meet as often as may be necessary, but not less than two times, during an academic year. (b) One half of the existing members of the Council of Sports and Academic shall form the quorum for a meeting of the Council of Sports and Academic. (c) In case of difference of opinion among the members, the opinion of the majority shall prevail. (d) Each member of the Council of Sports and Academic, including the Chairman of the Council of Sports and Academic, shall have one vote and if there be an equality of votes on any question to be determined by the Council of Sports and Academic, the Chairman of the Council of Sports and Academic, or, as the case may be, the member presiding over that meeting, shall in addition, have a casting vote. (e) Every meeting of the Council of Sports and Academic shall be presided over by the Vice- Chancellor and in his absence by a member chosen in the meeting to preside on the occasion. (f) If urgent action by the Council of Sports and Academic becomes necessary, the Chairman of the Council of Sports and Academic may permit the business to be transacted by circulation of the papers to the members of the Council of Sports and Academic. The action proposed to be taken shall not be taken unless agreed to, by a majority of the members of the Council of Sports and Academic. The action so taken shall forthwith be intimated to all the members of the Council of Sports and Academic. In case the authority concerned fails to take a decision, the matter shall be referred to the Chancellor, whose decision shall be final. 19. The Planning Board (i) There shall be constituted a Planning Board of the University which shall be the principal advisory body to advice the Board of Management on the planning, growth and the development of the University and shall also be responsible for monitoring the planned development and the growth of the University in terms of the decisions of the Board of the Management on such issues. (ii) The constitution of the Planning Board, the term of office of its members and its powers and functions shall be such as may be prescribed. 20. The Finance Committee (i) There shall be constituted a Finance Committee of the University which shall be the principal advisory body to advice the Board of Management on the resource generation, financial prudence, expenditure control and accounting management of the University shall also be responsible for monitoring the implementing the decisions of the Board of Management on such issues. (ii) It shall be responsible for overall financial stability of the University and terms of its resource generation, expenditure control, accounting integrity. (iii) The constitution of the Finance Committee, the term of office of its members and its powers and functions shall be such as may be prescribed. (iv) There shall be a Finance Committee consisting of the following; (a) Vice-Chancellor : Chairperson (ex-officio); (b) Principal Secretary/Secretary (Training & Technical Education) of the Government or his nominee (ex-officio); (c) Principal Secretary/Secretary (Finance) of the Government or his nominee, (ex-officio); (d) Principal Secretary or Secretary (Planning)/Director Planning of the Government or his nominee, (ex-officio); (e) Principal Secretary or Secretary (Higher Education) of the Government or his nominee; (f) Pro-Vice Chancellors (ex-officio); (g) Registrar (ex-officio); (h) Two other members nominated by the Board from amongst its members of whom at least one should not be an employee of the University;38 DELHI GAZETTE : EXTRAORDINARY PART IV] (i) Controller of Finance - Member-Secretary (ex-officio); (v) The term of the members of the Finance Committee other than the ex- officio members, shall be three years; (vi) The functions and duties of the Finance Committee shall be as follows:- (a) to examine and scrutinize the annual budget of the University and to make recommendations on financial matters to the Board of Management; (b) to consider proposals for new expenditure and to make recommendations to the Board of Management; (c) all proposals relating to revision of grades, up gradation of the pay-scales and those items which are not included in the budget, shall be examined by the Finance Committee before they are considered by the Board of Management; (d) to consider the annual accounts and the financial estimates of the University prepared by the Controller of Finance and laid before the Finance Committee for approval and thereafter submitted to the Board of Management; (e) the Finance Committee shall fix the limits for the total recurring and non-recurring expenditure for the year, based on income and resources of the University, and no expenditure shall be incurred by the University in excess of the limits so fixed, without the approval of the Finance Committee; (f) to give its views and to make recommendations to the Board of Management on any financial question affecting the University either on its own initiative or on reference from the Board of Management; (g) to recommend the investment of any money belonging to the University, including any unapplied income, in such securities as it may, from time to time, think fit, or in the purchase or immovable property in India, with the like power of varying such investments from time to time. (vii) The Finance Committee shall meet, at least, four times in a year; five members of the Finance Committee shall form the quorum at any meeting; (viii) In case of difference of opinion among the members, the opinion of the majority of the members present shall prevail; 21. The Building and Works Committee- (i) There shall be constituted a Building and Works Committee of the University to be the principal planning body of the University which shall also be responsible for construction, maintenance and monitoring the development of infrastructure of the University; (ii) The constitution of the Building and Works Committee, the term of office of its members and its powers and functions shall be such as may be prescribed; 22. Other Authorities: - The constitution, powers and functions of the other authorities which may be declared by the Statutes to be the authorities of the University, shall be such as may be prescribed; 23. Disputes as to the Constitution of the University Authorities If any question arises as to whether any person has been duly elected or appointed as, or is entitled to be, a member of any authority of the University, the matter shall be referred to the Chancellor whose decision thereon shall be the final. 24. The quorum of the University Authorities The quorum of the multi member University authorities shall be not less than one third of the total membership excluding the vacancies, if any, participating in the meeting. 25. Officers of the University The following shall be the officers of the University:- (i) the Vice-Chancellor; (ii) the Pro Vice-Chancellor;[PART IV DELHI GAZETTE : EXTRAORDINARY 39 (iii) the Deans; (iv) the Directors (v) the Registrar; (vi) the Controller of Finance; (vii) the Controller of Examination (viii) the Administrator of Sports Facilities (ix) the Librarian (x) the Proctor (xi) the Principal and (xii) Such other officers as may be declared by the Statutes to be the officers of the University. 26. The Vice- Chancellor (i) The Vice-Chancellor shall be a Sports scholar or a sports person of international eminence. (ii) The Vice-Chancellor shall be appointed by the Chancellor in such manner, for such term and on such emoluments and other conditions of service as may be prescribed. (iii) The Vice-Chancellor shall be the principal executive officer of the University and shall exercise the supervision and control over the affairs of the University. (iv) Subject to the provisions of this Act, Statutes and Ordinances as may be applicable, the Vice Chancellor shall give effect to the decisions of all the authorities of the University. (v) The Vice-Chancellor may, if he is of the opinion that immediate action is necessary on any matter, exercise any power conferred on any authority of the University by or under this Act and shall report the Board of Management by or under this act and shall report to Board of Management and action taken by him on such matter. Provided that if the Board of Management is of the opinion that such action ought not to have been taken, it may refer the matter to the Chancellor whose decision thereon shall be final. Provided further that any person in the service of the University who is aggrieved by the action taken by the Vice -Chancellor under this sub-section, shall, have the right to appeal against such action to the Board of Management within ninety days from the date on which such action is communicated to him and thereupon the Board of Management may confirm, modify or reverse the action taken by the Vice-Chancellor. (vi) The Vice-Chancellor may, if he is of the opinion that immediate action is necessary on any matter, exercise any power conferred on the Board of Management by or under this Act and shall report to the Board of Management the action taken by him on such matter. Provided that if the Board of Management is of the opinion that such action ought not to have been taken, it may refer the matter to the Chancellor whose decision thereon shall be final. Provided further that any person in the service of the University who is aggrieved by the action taken by the Vice -Chancellor under this sub-section, shall, have the right to appeal against such action to the Board of Management within ninety days from the date on which such action is communicated to him and thereupon the Board of Management may confirm, modify or reverse the action taken by the Vice-Chancellor. (vii) The Vice-Chancellor shall exercise such other powers and perform such other functions as may be prescribed by the Statutes and the Ordinances. Provided further that any person in the service of the University who is aggrieved by the action taken by the Vice -Chancellor under this sub-section, shall, have the right to appeal against such action to the Board of Management within ninety days from the date on which such action is communicated to him and thereupon the Board of Management may confirm, modify or reverse the action taken by the Vice- Chancellor. 27. The Pro Vice-Chancellor The Pro Vice-Chancellor shall be appointed in such manner, on such emoluments and other conditions of service, and shall exercise such powers and perform such functions, as may be prescribed.40 DELHI GAZETTE : EXTRAORDINARY PART IV] 28. The Deans Every Dean shall be appointed in such manner, and shall exercise such powers and perform such duties as may be prescribed. 29. The Registrar (i) The Registrar shall be appointed in such manner, on such emoluments and other conditions of service, and shall exercise such powers and perform such functions, as may be prescribed. (ii) The Registrar shall be the custodian of the properties, the records and the common seal of the University and shall have the powers to authenticate records on behalf of the University. (iii) The Registrar shall be the Member Secretary of all the multi member authorities of the University, and shall in his capacity as the Member Secretary notify the minutes of the meeting and the decisions of such authorities not later than three weeks from the date of the meeting. (iv) Subject to the provisions of this Act, Statutes and Ordinances, the Registrar shall have the power to enter into and sign agreements on behalf of the University. (v) The Registrar shall have the power to engage advocates, sign vakaltnama, give affidavit on behalf of the University in a legal or court proceeding. 30. The Controller of Finance The Controller of Finance shall be appointed in such manner, on such emoluments, and other conditions of service and shall exercise such powers and perform such duties as may be prescribed. 31. The Directors Every Director shall be appointed in such manner, and shall exercise such powers and perform such duties as may be prescribed. 32. The Controller of Examination The Controller of Examination shall be appointed in such manner, and shall exercise such powers and perform such duties as may be prescribed. 33. The Administrator of Sports Facilities The Administrator of Sports Facilities shall be appointed in such manner, and shall exercise such powers and perform such duties as may be prescribed. 34. The Proctor (i) Proctor shall be the head of the Proctorial Board of the University vested with the responsibility to maintain discipline among the students. (ii) The Proctorial Board shall be constituted in such manner as may be prescribed. (iii) Proctor shall be appointed in such manner and shall exercise such powers and perform such duties as may be prescribed. 35. The Principal The Principal of Delhi Sports School shall be appointed in such manner, and shall exercise such powers and perform such duties as may be prescribed. 36. Other officers The manner of appointment, emoluments, powers and duties of the other officers of the University shall be such as may be prescribed. 37. Academics and Research (i) Academics and Research in various disciplines of study related to Sports and allied disciplines shall be the core academic functional domain of the University. (ii) Without prejudice to the power of the University Authorities to establish and wind up a University School of Studies, the University shall have the following University School of Studies to conduct its academic and research activities in various disciplines of study at graduate, undergraduate and research levels; (a) University School of Sports Technology (b) University School of Sports Health Sciences[PART IV DELHI GAZETTE : EXTRAORDINARY 41 (c) University School of Sports Ethics, Humanities and Social Sciences (d) University School of Sports Economics and Management (e) University School of Sports Architecture (f) University School of Physical Education and Teachers’ Training (iii) University shall develop its undergraduate, post graduate and research degree courses and shall be introduced as a programme of study only after the approval of the Council for Sports and Academics. (iv) These courses shall be taught by the teachers or the professionals of the respective disciplines of study employed by the University. (v) Each of the University Schools of Studies shall be headed by a Dean who shall have the responsibilities to manage the day to day academic affairs of the school. The programmes of studies, the course content and the overall academic and research of a University School shall be administered by the Dean under the policy framework and supervision of the following school level bodies; (a) Board of Studies: i) It shall be the principal academic body within the University School of Study and shall supervise and plan the academic activities of the School. ii) The composition of the Board of Studies shall be as prescribed. (b) School Research Committee: i) It shall be the principal research body within a University School of Study and be responsible for the research activities therein. ii) The composition of the Board of Studies shall be as prescribed. 38. Skill Development, Sports Recreation, Community Outreach and Extension Services (i) The University will have a Centre for Community Outreach and Extension Services which shall undertake activities for the promotion of skill development, sports recreation, community outreach and extension services. (ii) Without prejudice to the power of the University Authorities to introduce one or other academic and professional courses on short term basis for promotion of sports in the community, the Centre may conduct following kinds of short term courses (a) Short term courses on skill development in sports for amateurs and para sports personnel. (b) Job oriented certificate and diploma courses in sports related vocations. (c) Bridge Courses for educational empowerment of sports persons and sports personnel who may have been deprived of formal education system and wants to re-enter the formal education system and obtain one or other formal academic degree. (iii) The Centre shall engage in various other kinds of sports recreation and sports related community outreach and extension activities to enhance sporting skills, sports participation and sports appreciation among the common people. (iv) The Centre shall be headed by a Director designated as Director (Community Outreach and Extension Services). (v) The course content, the programme structure, methodologies, duration and the entry levels of the regular certificate and diploma courses may be developed by the sub Committee constituted by the Council of Sports and Academics of the University. (vi) The Vice Chancellor shall constitute a Centre Coordination Committee consisting of three professors of the University Schools of Studies and three professionals from the Centres for Professional Excellence in Sports who are generally associated with this Centre for a term of two years to overall supervise, frame policy guidelines and oversee the activities of the Centre from time to time. (vii) The Director of the Centre shall be the Chairperson of the Centre Coordination Committee. 39. Professional Development and Excellence in Sports (i) The University will have a Centre for Professional Excellence in Sports which shall administer and manage the sports specific training and coaching divisions to prepare sports persons for national and international sporting events.42 DELHI GAZETTE : EXTRAORDINARY PART IV] (ii) The Sports Specific Divisions administered and managed by the Centre for Professional Excellence in Sports shall be the institutional framework for grooming the talent and honing the sporting skills of the prospective sports persons. (iii) Without prejudice to the power of the University Authorities to establish and wind up any specific sports division, the Centre shall have the following sports divisions (a) Athletics Division (b) Field Sports Division (c) Aquatic Games Division (d) Indoor Games Division (e) Indigenous Sports Division (f) Adventure Sports Division (iv) It shall be imperative for all the Sports Division of the Centre for Professional Excellence in Sports to maintain quality driven training facilities and infrastructure in its area of Sports for imparting world class training to the aspirant sports persons. (v) Each division under the Centre shall maintain a pool of resource persons drawn from established sports persons at the national and international level for imparting specialised coaching to the admitted trainees. The resource persons willing to have long term association with the Centre for Professional Excellence in Sports may be formally associated with the University as adjunct Professors. Besides the pool of resource persons drawn from the set of established sports persons of the country, the University shall create its own pool of trained professionals for imparting training and coaching to the admitted trainees in various Divisions of the Centre for Professional Excellence in Sports. (vi) The primary aim of the Sports Divisions of the Centre for Professional Excellence in Sports shall be the identification of sporting talents at early age and grooming their talent, honing their skills and mentoring them to pick up a successful career as sports persons. (vii) As the basic objective of the Centre is Professional Excellence in Sports, appropriate systems shall be developed to ensure the full commitment of the trainees to the sports coaching and also alongside ensure their educational empowerment in a manner that sports excellence remains their focus. To this end provision shall be made for liberalised academics to ensure that a standard degree of academic proficiency is obtained by the trainees without compromising on the imperatives of the professional proficiencies in sports. (viii) Each Sports Division shall make appropriate provision for ‘multiple entry system’ and ‘special induction program’ for persons exhibiting or possessing sporting talents for their admission in the Divisions. (ix) A sports trainee on the successful completion of the training /coaching programme at one or other Division may be awarded the generic degree of BA(Sports)/B.Sc.(Sports) subject to the fulfillment of the objective and measurable performance index laid down by the University. (x) The trainees who join these Divisions at early age because of their exhibited natural talents in sports shall be allowed to take advantage of the bridge courses/ programmes of the University to continue the formal education. (xi) The Divisions of the Centre shall develop mechanisms and processes for facilitating the participation of their trainees in one or other national and international sporting events from time to time. (xii) The Divisions of the Centre would also design programs and modules for producing qualified trainers, experts, coaches for the specific sports /games coming under their domain. (xiii) The Centre for Professional Excellence in Sports shall be headed by a Director who shall be responsible for overall conduct of the affairs of the Centre for Professional Development and Excellence in Sports and various sports divisions established under it. (xiv) Each Sports Division shall be headed by a Professional Head, who shall report to the Director (centre for Professional Development and Excellence in Sports). The Professional Heads shall be responsible for day to day affairs of the respective Sports Divisions. The Professional Heads of the Sports Division shall be a person with established sports credentials. (xv) The overall policy making body of the Centre for Professional Excellence in Sports will be the Council for Professional Sports Excellence (equivalent to the Board of Studies of the University Schools of[PART IV DELHI GAZETTE : EXTRAORDINARY 43 Studies). The Council shall be composed of the Professional Heads of the Sports Division, eminent sports personalities (one each from the area of expertise of each sports division). The Council shall be chaired by the Director of the Centre for Professional Excellence in Sports who shall also be a member of the Council. 40. Early Sports-Talent Scouting and Grooming (i) The University shall establish, administer and manage a boarding school for scouting and grooming sporting talent from early ages. (ii) The School shall identify and admit students with sporting talents at sixth standard onwards and train them for a successful professional career in sports. (iii) The school shall serve as the specialized feeder institution for the University and the students passing out from the School shall be encouraged to continue with the Delhi Sports University. (iv) The course structure, course curricula and content of the School shall be in the nature of liberal academics and rigorous sports training. The academic content of the course curriculum may be based on the institutions administering liberalized schooling system like the National Open Schooling System (NIOS) or Delhi Patrachar Vidhyalaya and the corresponding content of the Sports Training module shall be developed by the School and approved by the Sports and Academic Council of the University. (v) The school may be affiliated to the Central Board of Secondary Education or a board of Physical Education established by the Govt. Of National Capital Territory of Delhi if it is not possible to get such affiliation from CBSE because of its stated objectives of the liberalized academics and rigorous sports training module. (vi) The day to day functioning, administration and management of the school shall be under the control of the Principal of the School. The position of the Principal of the School shall be equivalent to the position of the Director, Community Outreach and Extension Services. (vii) The overall supervision and the administration of the school shall vest in the Vice Chancellor of the University. However, with a view to promote it as a professionally managed institution for sports, the school shall have an autonomous character. (viii) The school shall endeavor to develop its own academic and sports infrastructure and facilities in tune with the requirements of the school children. The school will have University appointed teachers and sports professionals for imparting day to day teaching and the sports training to its students. 41. Statutes:- Subject to the provisions of this Act, the Statutes may provide for all or any of the following matters, namely:- (i) the constitution, powers and functions of the authorities and other bodies of the University, as may be found necessary to be constituted from time to time; (ii) the election and continuance in office of the members of the authorities and bodies of the University, the filling up of vacancies of members and all other matters relating thereto which the University may deem necessary or desirable to provide; (iii) the manner of appointment of the officers of the University, terms and conditions of their service, their powers and duties and emoluments; (iv) the manner of appointment of the teachers, sports professionals and the sports trainers of the University, other academic staff, and other employees and their emoluments; (v) the manner of appointment of teachers and other academic staff working in any other university for a specified period for undertaking a joint project, their terms and conditions of service and emoluments; (vi) the terms and conditions of service of the- (vii) teachers and other members of the academic staff appointed by the University; and (viii) other employees whether appointed by the University; (ix) the constitution of the pension or the provident fund and the establishment of an insurance scheme for the benefit of the employees of the University; (x) the principles governing the seniority of employees of the University; (xi) the procedure for any appeal by an employee or a student of the University; (xii) conferment of honorary degrees;44 DELHI GAZETTE : EXTRAORDINARY PART IV] (xiii) institution of fellowships, scholarships, studentships, medals and prizes and other incentives ; (xiv) maintenance of discipline among the employees of the University; (xv) establishment of chairs, university schools of studies, Centres and Sports Divisions; (xvi) the delegation of powers vested in the authorities or the officers of the University; and; (xvii) all other matters which, by or under this Act, are to be, or may be, provided for by the Statutes. 42. Making of the Statutes (i) The first Statutes shall be those made by the Government with the prior approval of the Chancellor within thirty days of the notification of this Act. (ii) The Board of Management may, from time to time, make new or additional Statutes or may amend or repeal the Statutes referred to in sub-section(1): Provided that the Board of Management shall not make, amend or repeal any Statutes affecting the status, powers or constitution of any authority of the University until such authority has been given a reasonable opportunity of expressing its opinion in writing on the proposed change and any opinion so expressed within the time specified by the Board of Management has been considered by the Board of Management. (iii) Every new Statute or addition to the Statutes or any amendment or repeal thereof shall require the approval of the Chancellor, who may assent thereto or withhold his assent or remit it to the Board of Management for reconsideration in the light of the observations, if any, made by him. (iv) A new Statute or a Statute amending or repealing an existing Statute shall not be valid unless it has received the assent of the Chancellor: (v) Notwithstanding anything contained in the foregoing sub-sections, the Chancellor may make new or additional Statutes or amend or repeal the Statutes referred to in sub-section (1), during the period of three years immediately after the commencement of this Act. 43. Publication of the Statutes in the Official Gazette of the Government:- (i) Every Statute made under this Act shall be published in the official Gazette of the Government. (ii) Every Statutes made under this Act shall be laid, as soon as may be after it is made, before the House of the Legislative Assembly of Delhi while it is in session for a total period of thirty days which may be comprised in one session or two or more successive sessions, and if, before the expiry of the session immediately following the session or the successive sessions aforesaid, the House agrees in making any modification in the Statute or the House agrees that the Statute should not be made, the Statute shall thereafter have effect only in such modified form or be of no effect, as the case may be; however, any such modification or annulment, as the case may be, shall be without prejudice to the validity of anything previously done under that Statute. (iii) Any modification in or annulment so made to the Statutes shall be notified in the official gazette of the Government. 44. Ordinances (i) Subject to the provisions of the Act and the Statutes, the Ordinances may provide for all or any of the following matters, namely:- (a) the admission of students, the courses of study and the fees therefore, the qualifications pertaining to the award of degrees, diplomas, certificates and other academic and professional distinctions, the conditions for the grant of fellowships and awards and the like; (b) the conduct of examinations and assessment, including the terms and conditions of office and appointment of examiners and assessors for sporting activities ; (c) the conditions of residence of students and their general discipline; (d) the procedures for the settlement of disputes between the employees and the University, or between the students and the University; (e) maintenance of discipline among the students of the University; (f) Regulation of the conduct and duties of the employees of the University, and regulation of the conduct of the students of the University;[PART IV DELHI GAZETTE : EXTRAORDINARY 45 (g) the categories of misconduct for which action may be taken under this Act or the Statutes or the Ordinances; and (h) any other matter which, by or under this Act or the Statutes, is to be, or may be, provided for by the Ordinances. (ii) The first Ordinances shall be made by the Vice-Chancellor with the prior approval of the Government and the Ordinances so made may be amended, repealed or added to at any time by the Board of Management in such manner as may be prescribed. (iii) Subject to the provisions of this Act or the Statutes made hereunder, any new Ordinance or an amendment to an existing Ordinance shall be made by the Board of Management. 45. Notification of the Ordinances (i) Every Ordinance approved for making or amendment shall be sent to the Chancellor within three weeks from the date of its approval by the Board of Management. (ii) The Chancellor may alter, annul or make such changes to the proposed Ordinances or proposed amendment to an existing Ordinance as it deems fit. (iii) The Ordinance as approved by the Board of Management or as amended, altered or changed by the Chancellor, as the case may be, shall be notified by the Registrar under his hand and seal. The new or amended Ordinances shall come into effect on and from the date of its approval. (iv) The notified Ordinances shall be laid before the Board of Management in its forthcoming meeting in the form of the Action Taken Report. 46. Regulations (i) The authorities, the academic and the administrative departments of the University may make Regulations consistent with this Act, the Statutes and the Ordinances, in the manner prescribed by the Statutes for the conduct of their own business and that of the committees, if any, appointed by them and not provided for by this Act, the Statutes or the Ordinances. (ii) All the Regulations made by the academic and the administrative departments shall be placed before the Vice Chancellor for its approval. The Vice Chancellor may approve it with such changes as it deems fit or approve it without any changes. (iii) The Regulations as made by the authorities of the University or as approved by the Vice Chancellor shall be notified by the Registrar within three weeks from the date of its making or approval as the case may be. (iv) Every Regulation shall come into effect on and after the notification by the Registrar. 47. Annual Report (i) The annual report of the University shall be prepared under the directions of the Board of Management which shall include, among other matters, the steps taken by the University towards the fulfillment of its objects. (ii) The annual report so prepared shall be submitted to the Chancellor by such date as may be prescribed. (iii) A copy of the annual report, as prepared under sub-section(1), shall also be submitted to the Government which shall, as soon as may be, cause the same to be laid before the Legislative Assembly of Delhi. 48. Annual Accounts (i) The annual accounts and the balance sheet of the University shall be prepared under the direction of the Board of Management and shall at least once every year at intervals of not more than fifteen months, be audited by the Comptroller and Auditor General of India or such person or persons as he may authorize in this behalf. (ii) A copy of the accounts together with the audit report shall be submitted to the Chancellor along with the observations, if any, of the Board of Management. (iii) Any observation made by the Chancellor on the annual accounts shall be brought to the notice of the Board of Management, and comments of the Board of Management shall be resubmitted to the Chancellor.46 DELHI GAZETTE : EXTRAORDINARY PART IV] (iv) A copy of the accounts together with the audit report, as submitted to the Chancellor, shall also be submitted to the Government, which shall, as soon as may be, cause the same to be laid before the Legislative Assembly of Delhi. 49. Withdrawal of degree or diploma (i) The Board may either on its own motion or on the recommendation of the Senate, withdraw any distinction, degree, diploma or privilege conferred on, or granted to, any person, by a resolution passed by the majority of the total membership of the Board present and voting at the meeting, if such person has been convicted by a court of law for an offence, which, in the opinion of the Board, involves moral turpitude or if he has been guilty of gross misconduct. (ii) No action under sub-section (1) shall be taken against any person unless he has been given an opportunity to show cause against the action proposed to be taken. (iii) A copy of the resolution passed by the Board of Management shall be immediately sent to the person concerned. (iv) Any person aggrieved by the decision taken by the Board of Management may appeal to the Chancellor within thirty days from the date of receipt of such resolution. (v) The decision of the Chancellor in such appeal shall be final. 50. Conditions of Service of Employees (i) The University shall enter into a written contract of service with every employee of the University appointed on regular basis or otherwise and the terms and conditions of the contract shall not be inconsistent with the provisions of this Act, the Statutes and the Ordinances/Regulation. (ii) A copy of the contract referred to in sub –section (i) shall be lodged with the University and a copy thereof shall also be furnished to the employee concerned. 51. Tribunal Arbitration (i) Any dispute arising out of a contract of employment referred to in Section 50 between the University and the employee shall be referred to a Tribunal of Arbitration which shall consist of one member nominated by the Board of Management, one member nominated by the employee concerned and an umpire to be nominated by the Chancellor. (ii) Every such reference shall be deemed to be a submission to arbitration on the terms of this section within the meaning of the Law of Arbitration as in force, and all the provisions of that Law to the extent such provisions may be applicable, shall apply accordingly. (iii) The procedure for regulating the work of the Tribunal of Arbitration shall be such as may be prescribed. (iv) The decision of the Tribunal of Arbitration shall be final and binding on the parties, and no suit shall lie in any court in respect of any matter decided by the Tribunal 52. Provident and Pension Funds The University shall constitute for the benefit of its employees such provident fund or pension fund or provide such insurance schemes as it may deem fit in such manner and subject to such conditions as may be prescribed. 53. Filling of Casual Vacancies All the casual vacancies among the member (other than ex-officio members) of any authority or other body of the University shall be filled, as soon as may be convenient, by the person or body who appoints, elects or co- opts the members whose place has become vacant and any person appointed, elected or co -opted to a casual vacancy shall be a member of such authority or body for the residue of the term for which the person whose place he fills, would have been a member.[PART IV DELHI GAZETTE : EXTRAORDINARY 47 54. Protection of Action Taken in Good Faith No suit or other legal proceeding shall lie in any court against the University or against any authority, officer or employee of the University or against any person or body of persons acting under the order or direction of any authority or officer or other employee of the University for anything which is in good faith done or intended to be done in pursuance of the provisions of this Act or the Statutes or the Ordinances. 55. Mode of Proof of University Record A copy of any receipt, application, notice, order, proceedings, resolution of any authority or committee of the University, or other documents in the possession of the University, or any entry in any register duly maintained by the University, if certified by the Registrar so designated shall, notwithstanding anything contained in the Indian Evidence Act, 1872 or in any other law for the time being in force, shall be admitted as evidence of the matters and transactions specified therein, where the original thereof would, if produced, have been admissible in evidence. 56. Power to Remove Difficulties If any difficulty arises in giving effect to the provisions of this Act, the Government may, by order, published in the official Gazette, make such provisions, not inconsistent with the provisions of this Act, as appear to it to be necessary or expedient for removing the difficulty: Provided that no order shall be made under this section after the expiry of three years from the commencement of this Act. 57. Transitional Provisions Notwithstanding anything contained in this Act and the Statutes, (i) The first Vice-Chancellor and the first Registrar shall be appointed by the Chancellor and they shall be governed by the terms and conditions of service specified by the Statutes ; (ii) The Registrar and the Controller of Finance in Delhi Sports University shall be appointed by the Government. (iii) The first Board of Management shall consist of not more than fifteen members and not less than nine members respectively who shall be nominated by the Chancellor and shall hold office for a term of three years. (iv) Till such time statutes, ordinance and regulations are made by the designated authority, the statutes, ordinances and regulations of Guru Gobind Singh Indraprastha University, Delhi, to the extent they are relevant and have been adopted by the Board of Management by a notification, shall be applicable for Delhi Sports University. Salient Features of Delhi Sports University Bill, 2019 The Delhi Sports University shall be established by an Act of the State Assembly of the National Capital Territory of Delhi. The Chancellor of University will be the Lt. Governor of Delhi and the President of India shall be the Visitor of the University. The Vice-Chancellor, who should be a scholar or a sports person of International eminence with administrative experience in a national level institution of sports is to be appointed for a period of five years and he/she would be selected by a Committee of three members. Composition, powers and manner of functioning of the authorities of the University, namely, the Court, the Senate, the Board of Management, Council of sports and Academics and Finance Committee are included in the draft legislation. Provisions for framing of statutes and regulations, a provision for submission of Annual Report of the University to the Government and placing of the same before the Legislative Assembly has also been provided. All staff and faculty members of the University would be engaged on Contract basis, on the pattern of the University of Guru Govind Singh Inderprastha University, and the manner of their permanent engagement could be laid down in the University’s statutes subsequently. Statement Of Objects and Reasons The Delhi Sports University was conceptualized with the ultimate goal of becoming a university. As per the vision document of Delhi Sports University “Profile of Growth”, the Delhi Sports University has been envisioned with the following sharply defined goals, to become:48 DELHI GAZETTE : EXTRAORDINARY PART IV] 1 A sports University recognize the serious national need to produce, nurture, groom, support and promote the world class sports persons, trainers, supporting professionals and to promote health care among masses through physical education and the spirit of sporting. 2 A sports university/institution for the promotion of sports school and undergraduate education, continuing education, in Sports. The divisions in Delhi Sports University develop training module and methodologies for imparting rigorous, competitive and professional training in the respective sports area and the suitable assessment parameter for the trainees. training and research in Sports area with multi-level entry vertically and a system of flexible migration in the various disciplines horizontally within or beyond the University; 3 A facilitator for the promotion of a co-operative program of sports education with industry and Research and Development organizations for offering bridge courses keeping in view societal needs; 4 A hub for integrated school, undergraduate, postgraduate and research degree programs in various area of sports with sports business and event management, sports medicines, sports physiotherapy, sports psychology, sports architecture, sports engineering, sports costumes and footwear technologies, sports kits, equipments and material technologies, sports media, ethics, law and policies. 5 As a supporting agency for the sports, sports technology and sports technology business incubator that would help to nucleate the " Sports Technology Transfer" programme; The distinctive roles of this Sports University were envisaged as steps needed to fill the gaps in the system of sports education in the country and at the same time to offer adequate opportunities to the students of Delhi to meet squarely the burgeoning challenges of the sports based society. By virtue of its distinctive roles, the University so formed will be distinct in terms of its ambitious functional domains seeking to cater to all aspects of a wholesome sports eco-system in the country. The first and foremost functional domain of the University shall be the promotion of professional excellence in sports. The University shall have a thoroughly equipped Centre for Professional Excellence in Sports. Within the auspices of the Centre for Professional Excellence in Sports there shall be sports-specific divisions to promote sporting excellence in the respective sports. These Sport Divisions shall be thoroughly equipped to impart world class training and coaching for the persons aspiring to be the sports persons. Each sport divisions shall scout, groom, promote and sponsor the sport persons in various national and international sporting events. The proposed establishment of Delhi Sports University into a State University shall help in building a highly skilled and globally competitive sports persons and sports technological workforce. The early-stage-sports-talent scouting and grooming is the other major area of the functional domain of the University. To this end the University shall establish and maintain a full-fledged Delhi Sports School affiliated to the Central Board of Secondary Education for imparting school level teaching with emphasis on sports and orientation towards grooming the pupils for a career in Sports. The young students exhibiting potentials of sporting talent shall be the target group for admission in the Delhi Sports School. The experience of granting administrative autonomy to Delhi Sports University has been largely responsible for the faster growth of this institute compared to other such institutes and accordingly a state sports university status shall go a long way to provide plethora of opportunities for students aspiring for Sports, Sports business and event Management education in Delhi. The change in status of this institute to university shall equip this institute to overcome the challenges posed by the modern day sports education where only constant is change. The dynamic University system shall facilitate higher sports education in correct perspective. This Bill seeks to achieve the aforesaid objectives. Financial Memorandum Clause 3 of the Bill contemplates the establishment of a State Sports University in the National Capital of Delhi in the name of “Delhi Sports University”, Clause 6 of the Bill specifies the various powers of the University, Clause 8 specifies the authorities of the University and Clause 25 mentions the various officers of the University. The University will be non-affiliating teaching and research university to promote studies, research and extension work in the core and allied field of Sports, Sports business and event Management, Sports Medicines, Sports Physiotherapy, Sports Psychology, Sports Architecture, Sports Engineering, Sports Costumes and Footwear Technologies, Sports Kits, Equipments and material technologies, Sports Media, Ethics, Law and Policies and connected fields. It will not be necessary to make provision for acquisition of land for the proposed Delhi Sports University as adequate land (around 90 Acres.) has been identified at Ghevra More, Rohtak Road, Delhi for establishment of Delhi Sports University. The Delhi Sports University is 100% funded by the Government and the same model shall continue for the University;[PART IV DELHI GAZETTE : EXTRAORDINARY 49 It will be necessary to incur expenditure directly on the University in the beginning for such purposes as development of additional physical and academic infrastructure, and appointment of new teacher and staff. No additional financial assistance is required from the Central Government for establishment of this University. Memorandum Regarding Delegated Legislation Clause 41 read with Clause 42 of the Bill empowers the Government to make Statutes; while the Government with the approval of the Chancellor shall make the first Statutes, the Board of Management will make subsequent new or additional Statutes; Clause 42 of the Bill empowers the Vice-Chancellor, with the approval of the Government, to make the first Ordinances with respect to matter enumerated in the sub-clause (1) of the said clause; Subsequently, these Ordinances can be amended, repealed or added by the Board of Management; Clause 46 of the Bill empowers the authorities of the University to make Regulations for the conduct of their own business and that of the Committees, if any, appointed by them and not provided for by the Bill, the Statutes, or the Ordinances; The matters in respect of which Statutes, Ordinances and Regulations may be made are matters of administrative detail and procedure and, as such, the delegation of legislative power is of a normal character.
