पौधो का 100 % प्रजतपरू क वृक्षारोपण और उनका सात वर्ो तक रिरिाव उपभोगी संस्ट्था द्वारा दकया िायेगा । इस वृक्षारोपण के सफलतापूवचक स्ट्थापना के बाि उपभोगी संस्ट्था द्वारा जनगरानी की िाएगी । 3. 803 वृक्षो के प्रत्यारोपण/ काटे दकए िाने के बिले म े1:10 के अनुपात मे स्ट्वििे ी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाले 8030 पौधो का प्रजतपरू क वृक्षारोपण गरै -वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी िोन े के छः मिीन े के अंिर जनधाचररत की गई भूजम पर अजतररि उपायों के साथ वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा और अजिम सात (7) वर्ों के जलए रिरिाव उसके बाि उनका रिरिाव उपभोगी संस्ट्था द्वारा अपने स्ट्वय ं की लागत पर दकया िाएगा । 4. अनुमजत िारी िोन े के तरु ंत बाि वृक्षो का प्रत्यारोपण उपभोगी संस्ट्था द्वारा िुरू दकया िाएगा और इस े छः मिीन े के अंतराल में पूण च दकया िाएगा । प्रत्यारोपण प्रदक्रया के पणू च िोन े का बाि एक सम्पपूण च ररपोटच संबजन्धत वृक्ष अजधकारी को प्रस्ट्तुत की िायेगी । प्रत्यारोपण स्ट्थल मे प्रत्यारोजपत वृक्षो की िरू ी 4 मीटर (लबंि ुसे लबंि)ु से कम निीं िोनी चाजिए । 5. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजित सभी ितों का पालन दकया िाएगा । 6. यदि उपभोगी संस्ट्था सफलतापवू चक प्रजतपूरक वृक्षारोपण करन े में जवफल रिती ि ै । उपभोगी संस्ट्था द्वारा अजतररि साइट सुधार िचों को िमा दकया िाएगा िो दक सम्पबंजधत वृक्ष अजधकारी द्वारा गणना के अनुसार वृक्षारोपण के जलए उपयिु बनान ेके जलए आवश्यक िो सकती ि ै। 7. िो भूजम प्रजतपरू क वृक्षारोपण/ वृक्ष प्रत्यारोपण के जलए आवंरटत ि,ै उसका उपयोग दकसी अन्य कायो के जलए राज्य सरकार की स्ट्वीकृजत के जबना निीं दकया िाएगा । 8. उपभोगी संस्ट्था द्वारा वृक्षो को काटने/ प्रत्यारोपण का काय च िरूु करन े स े पूव च जवस्ट्तृत वृक्षारोपण अनुसूची को दिल्ली वृक्ष संरक्षण अजधजनयमए 1994 की धारा 12 के अनुपालन में सम्पबंजधत वृक्ष अजधकारी को प्रस्ट्तुत दकया िाएगा । 9. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यिीव जवभाग राष्ट्रीय रािधानी क्षत्रे दिल्ली सरकार को जनधाचररत करेंगी और इसकी एक प्रजत प्रत्येक जवत्तीय वर्च के अतं में वृक्ष अजधकारी (िजक्षण) को प्रस्ट्तुत की िाएगी । 10. उपभोगी संस्ट्था द्वारा वृक्षो को काटने/ प्रत्यारोपण का कायच िरूु करने स े पूवच साइट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्ततृ योिना प्रस्ट्ततु दकया िाएगा । 11. भूजम स्ट्वाजमत्व एिेंसी यि सुजनजित करेगी दक प्रजतपूरक वक्षृ ारोपण के जलए प्रस्ट्ताजवत क्षत्रे में कोई अजतक्रमण न िो । 12. उपभोगी संस्ट्था द्वारा प्रजतपरू क वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृिा नमी संरक्षण कायच की गजतजवजधयों को दकया िाएगा । 13. 803 वृक्षो को प्रत्यारोपणध ् काटने के जलए अनुमजत उनके स्ट्वय ं के िोजिम पर और दकसी भी अन्य व्यजि के िाव े के पक्षपात के जबनाए िो वृक्षो और भूजम पर सिी िो सकती ि,ै िी िा रिी ि ै। 14. उपभोगी संस्ट्था द्वारा 147 वृक्षो को काटने से पूवच प्रत्यारोपण दकया िाएगा । 147 वृक्षो की अनुमजत 656 वृक्षो के सफल प्रत्यारोपण और उप- वन संरक्षक ;िजक्षणद्ध को अनुपालन प्रमाण पत्र प्रस्ट्ततु करने के बाि िी िायेगी । 15. उपभोगी संस्ट्था द्वारा वृक्षो को कटाई/ प्रत्यारोपण का कायच सभी वैधाजनक मंिूररयों को लेने के बाि िी िुरू दकया िाएगा । 16. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तचत निीं दकया िाएगा । 17. प्रजतरोपण/कटाई की प्रगजत ररपोटच जनरीक्षण अजधकारी के माध्यम से संबंजधत वृक्ष अजधकारी को वृक्षों के पणू च जववरण के साथ प्रस्ट्ततु की िाएगी । 18. यदि दकसी वृक्ष में पजक्षयों का घोंसला पाया िाता ि ैतो उसे तब तक निीं काटा / प्रत्यारोपण दकया िाएगा िब तक दक पक्षी उसे छोड़ न िें। 19. उपभोगी संस्ट्था द्वारा 803 वृक्षो के अलावा दकसी भी वृक्ष की कटाई / प्रत्यारोपण दिल्ली वृक्ष संरक्षण अजधजनयम,1994 के अन्तगचत एक अपराध िोगा ।4 DELHI GAZETTE : EXTRAORDINARY PART IV] 20. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए िान े के उपरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उसस े प्राप्त धनराजि को सरकार के िाते म ेरािस्ट्व के रूप में िमा की िाएगी। 21. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िािाओं को काटे िाने के उपरान्त प्राप्त लकजड़यों को मुफ्त में जनकटतम सावचिजनक िविािों में प्रयोग िते ु सौपी िाएगी और इसकी सचू ना वृक्ष अजधकारी (िजक्षण) को भी िी िाएगी । 22. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए िाने के स्ट्थल स े लकजड़यों को ले िान े स े पूव च वृक्ष अजधकारी (िजक्षण) स े ढुलाई अनुमजत प्राप्त करनी िोगी। 23. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण/ कटाई और उसमें पैिा िोने वाली वन उपि को सावचिजनक श्मिान म े 90 दिनों के अंिर परू ा दकया िाएगा । 24. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक वृक्षो की कटाई/ प्रत्यारोपण से पूवच कोई लंजबत मुकिमेबािी या स्ट्थगन आिेि दकसी भी न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ िो । 25. उपभोगी संस्ट्था के द्वारा पयाचवरण मंिूरी म ें और अन्य मंिरू ी में उजल्लजित सभी ितों ितों, यदि कोई िो, का जनष्ठापूवचक पालन दकया िाएगा । यि माननीय पयाचवरण एव ंवन मंत्री राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार No. 5041/TO(S)/TC-Felling/2021-22/12403-10.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of 15.9280 ha. approx. as detailed below for construction of implementation of Delhi- SNB Corridor of Regional Rapid Transit System (RRTS) Corridor, RRTS stabling yard complex at Jangpura comprising Operation and Control Centre, Terminal Station at Jangpura etc. and multistoried towers for operational use including connectivity to the landlocked site form Ring Road and Mathura Road, New Delhi from the provision of sub- section (3) of section 9 of the said Act. (b) Transplantation of 656 no. of trees which are standing on site shall be done by User Agency at NTPC ECO Park, Badarpur, New Delhi in 1.07 ha with their own funds. 2. 100% Compensatory Plantation of 8030 saplings of native species shall be raised and maintained by User Agency for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b) above. 3. 8030 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non-forest land in lieu of felling/ transplantation 803 no. of trees. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within six months of issue of tree removal permission and maintenance for next Seven (7) years shall be carried out there after by User Agency with their own funds. 4. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not later than six (06) months, after which a completion report has to be submitted to the Tree Officer. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site. 5. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User Agency. 6. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also deposit extra site improvement expenses which may be required to make the site suitable for plantation as calculated by Tree Officer concerned (as deposits). 7. The land over which compensatory plantation/ Tree transplantation raised shall not be utilized for other purpose without the approval of the State Government. 8. Detailed plantation schedule shall have to be submitted by User Agency to concerned Tree Officer in compliance with Section 12 of Delhi Preservation of Trees Act, 1994 before initiating felling/ transplantation. 9. User Agency shall be responsible to arrange to maintain plantation journals as prescribed by Department of Forests and Wildlife, Govt. of NCT of Delhi and a copy of the same shall be submitted to the Tree Officer (South) at the end of every financial year. 10. User Agency shall submit a detailed plan for site preparation and plantation before initiating transplantation/ felling.6 DELHI GAZETTE : EXTRAORDINARY PART IV] 11. Land Owning Agency shall ensure that there is no encroachment in area proposed for Compensatory Plantation/ Transplantation sites. 12. The User agency shall implement the improved soil moisture conservation activities on compensatory plantation/ transplantation site. 13. Permission for transplantation/ felling of 803 tress is being granted at their own risk and without prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the trees. 14. The transplantation shall be carried out prior to felling of 147 nos. of trees permitted herein. The 147 trees shall be removed/ felled after successful transplantation of 656 trees and submission of compliance certificate to DCF (South). 15. Before the removal of trees from the site is commenced all requisite statutory clearances shall necessarily be obtained by the User Agency. 16. The User Agency shall ensure that the plan of this proposal shall not be changed. 17. The progress report of transplantation/ felling shall be submitted to Tree Officer concerned by User Agency through inspection officer concerned along with complete details of trees. 18. If any tree is found to have nest of birds it should not be felled/ transplant till the same is abandoned by the birds. 19. Transplantation/ felling of any tree apart from 803 trees by User Agency shall constitute an offence under Delhi Preservation of Trees Act (DPTA), 1994. 20. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the Government account by the User Agency. 21. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same should be reported to DCF (South) by User Agency. 22. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the DCF (South) by User Agency. 23. Transplantation/ felling of trees and transportation of forest produce arising therefrom to the public crematorium shall be completed within 90 days. 24. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/ other authority before undertaking felling/ transplantation of trees. 25. It should be ensured by the user agency that all the conditions mentioned in environmental clearance and other clearances, if any obtained, shall be followed scrupulously.
