L.-33004/99 सी.जी.-डी.एल.-अ.-02022024-251749 CG-DxLx-xEG-I0D2H0x2x2x0 24-251749 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 417] नई ददल्ली, िुक्रिार, फरिरी 2, 2024/माघ 13, 1945 No. 417] NEW DELHI, FRIDAY, FEBRUARY 2, 2024/MAGHA 13, 1945 जिदेि मत्रं ालय आदेि नई ददल्ली, 2 फरिरी, 2024 का.आ. 445(अ).— केन्द्रीय सरकार संयुक्त राष्ट्र (सुरक्षा पररषद) अजधजनयम, 1947 (1947 का 43) की धारा 2 द्वारा प्रदत्त िजक्तयों का प्रयोग करते हुए, संयक्तु राष्ट्र के चार्रट के अध्याय 7 के अधीन अगं ीकृत संयुक्त राष्ट्र सरु क्षा पररषद के संकल्प 2653 (2022) और 2699 (2023) के कायाटन्द्ियन हते ु जनम्नजलजखत आदिे दते ी है, अर्ाटत्: - 1. सजं क्षप्त नाम और प्रारंभ – (1) इस आदिे का संजक्षप्त नाम हतै ी आदेि, 2023 पर संयुक्त राष्ट्र सुरक्षा पररषद संकल्पों का कायाटन्द्ियन ह।ै (2) यह रािपत्र म ेंइसके प्रकािन की तारीख से प्रिृत्त होगा। 2. पररभाषाएँ - (1) इस आदेि में, िब तक दक संदभट से अन्द्यर्ा अपेजक्षत न हो, - (क) "आजस्ट्त अिरोधन" से संकल्प 2653 (2022) के परै ा 6, 7, 8, 9 और 10 के अनुसरण म ें केंरीय सरकार द्वारा जनजधयों, अन्द्य जित्तीय संसाधनों और आर्र्टक संसाधनों को रोकना या प्रजतबंजधत करना या जिजनयजमत करना अजभप्रते ह;ै (ख) "िस्त्र प्रजतबधं " से संकल्प 2699 (2023) के पैरा 14 के अनुसरण म ें केंरीय सरकार द्वारा छोर्े िस्त्रों, हल्के हजर्यारों और गोला-बारूद की प्रत्यक्ष या अप्रत्यक्ष आपूर्तट, जबक्री अर्िा हस्ट्तांतरण को रोकना अजभप्रेत है; 701 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ग) "सजमजत" से संकल्प 2653 (2022) के परै ा 19 के अनुसरण में संयुक्त राष्ट्र सुरक्षा पररषद द्वारा स्ट्र्ाजपत प्रजतबंध सजमजत अजभप्रेत ह;ै (घ) "संकल्प" से 21 अक्र्ूबर, 2022 को अंगीकृत संयुक्त राष्ट्र सरु क्षा पररषद का संकल्प 2653 (2022) और माली के संबंध में संयक्तु राष्ट्र के चार्टर के अध्याय 7 के अधीन 2अक्र्ूबर, 2023 को सुरक्षा पररषद द्वारा अंगीकृत संकल्प 2699 ( 2023) अजभप्रेत है, िो इस आदेि के सार् क्रमिः उपाबंध I और उपाबंध II के रूप में संलग्न ह;ै (ड.) "यात्रा प्रजतबंध" से संकल्प 2653 (2022) के परै ा 3, 4 और 5 के अनुसरण म ें केंरीय सरकार द्वारा यर्ा अजधरोजपत यात्रा प्रजतबंध या जनबंधन अजभप्रेत ह।ै (2) उन िब्दों और पदों के, िाेे इस आदिे में प्रयक्तु ह ैं दकन्द्त ु पररभाजषत नहीं ह,ै और तत्समय प्रिृत्त दकसी अन्द्य जिधी म ें पररभाजषत ह ैंके क्रमिः िही अर्ट होंग ेिो ऐसी जिजधयों में उनके जलए ददए गय ेह।ैं 3. व्यजक्तयों और अजस्ट्तत्िों पर आदेि का लाग ू होना – (1) संकल्प 2653 (2022) और 2699 (2023), िोदक क्रमिः उपाबंध I और उपाबंध II म ेंददए गए ह,ैं को इस आदेि का भाग माना िाएगा। (2) सजमजत द्वारा नामजनर्दष्टट जनम्नजलजखत व्यजक्त या संस्ट्र्ाए1ं अक्र्ूबर, करत े हुए , यह स्ट्िीकार करत े हुए दक बजहष्करण और असमानता हतै ी से संबंजधत जस्ट्र्जत में गंभीर कारकों के रूप में प्रभाि डालते है, अजस्ट्र्रता और असमानता के दीघटकाजलक कारकों का समाधान करन े के जलए हतै ी सरकार की प्रार्जमक उत्तरदाजयत्ि पर िोर देत े हुए , सुरक्षा जस्ट्र्जतयों तर्ा संभारतत्रं ीय व्यिस्ट्र्ाओं के अनुसार और मजहलाओं की पणू ट, समान और सार्टक भागीदारी तर्ा युिाओं, नागररक समाि एिं अन्द्य सुसंगत जहतधारकों की भागीदारी के सार्, पारदिी रीजत से आयोजित दकए िाने िाल े समािेिी, स्ट्ितंत्र और जनष्पक्ष जिधायी तर्ा राष्ट्रपजत जनिाटचनों के आयोिन की अनुमजत देन े के जलए हतै ी के लोगों के नेतृत्ि म ें एक रािनीजतक प्रदक्रया के जलए एक स्ट्र्ायी, समयबद्ध और सामान्द्य रूप स े स्ट्िीकायट ढांच े पर तत्काल सहमजत पर पहुचं ने की आिश्यकता को दोहराते हुए,और रािनीजतक प्रदक्रया के संबंध में अद्यतन िानकारी अपहरण, व्यजक्तयों की तस्ट्करी और प्रिाजसयों की तस्ट्करी, और हत्याए,ं तर्ा बलात्संग एिं यौन दासता सजहत यौन और प्लंग आधाररत प्हसं ा, सार् ही सार् चल रही अपराजधयों के जलए दण्डमुजक्त, भ्रष्टाचार और जगरोहों द्वारा बालकों की भती और इस क्षेत्र के जलए हतै ी की जस्ट्र्जत के जनजहतार् ट सजम्मजलत है, इस बात पर प्चंता व्यक्त करते हुए दक सभी प्रकार के हजर्यारों और उनसे संबंजधत सामग्री की अिैध तस्ट्करी तर्ा व्यपितनट जिजध के िासन और मानिाजधकारों के सम्मान से िुड़ी व्यिस्ट्र्ा कमिोर होती है, और इसस े मानिीय सहायता के उपबंध में बाधा पहुे ेंचती ह ैऔर इसके व्यापक नकारात्मक मानिीय और सामाजिक-आर्र्टक पररणाम हो सकते ह,ैं हतै ी में सामूजहक प्हसं ा, आपराजधक दक्रयाकलापों या मानिाजधकारों के हनन में लगे या समर्टन करन े िाले गैर-राज्य संगठनों को छोर्े हजर्यारों, हल्के हजर्यारों और गोला-बारूद के हस्ट्तांतरण पर रोक लगाने के सार्-सार् उनकी अिैध तस्ट्करी और व्यपितटन को रोकने की आिश्यकता पर ध्यान देत े हुए ,4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अिैध हजर्यारों की तस्ट्करी और जिचलन को रोकन े के जलए सदस्ट्य राष्ट्रों के बीच सहयोग को प्रोत्साजहत करना, जिसमें अिैध तस्ट्करी के स्रोतों और आपूर्तट श्ृंखलाओं की पहचान करने और उनका मुकाबला करने के जलए समय पर और अद्यतन िानकारी प्रदान करना और आदान-प्रदान करना सजम्मजलत ह,ै हतै ी में अिैध जित्तीय प्रिाह का समाधान करने की तात्काजलक आिश्यकता को स्ट्िीकार करते हुए, िो सिस्त्र जगरोहों के संचालन को सक्षम बनाता ह ै और देि की जस्ट्र्रता के जलए होन े िाले खतरे में बढ़ोतरी करता है, जिसमें रािनीजतक और आर्र्टक सगं ठनों और जगरोहों के बीच संबंधों को तोड़ने को प्रार्जमकता देना भी सजम्मजलत ह ै , हतै ी की नेिनल पुजलस की महत्िपूणट बंदरगाहों तक पहुचं में कमी के बारे में प्चंता व्यक्त करते हुए, िो बड़े पैमाने पर जगरोहों के जनयंत्रण में ह,ैं और सार् ही जगरोहों द्वारा बंदरगाहों और ईंधन र्र्मटनलों पर अिैध कब्िे को रोकन े की मांग करते हुए , सीमा और बंदरगाहों पर जनयंत्रण को बढ़ािा देने, अिैध जित्तीय प्रिाह का पता लगाने, अतं रराष्ट्रीय अपराध, भ्रष्टाचार और निीली दिाओं तर्ा हजर्यारों की तस्ट्करी स े जनपर्न े के जलए अन्द्य देिों स े सहयोग करन े के जलए राष्ट्रीय प्राजधकाररयों की सहायता के जलए ड्रग्स एिं अपराध संेंबंधी संयुक्त राष्ट्र कायालट य (यूएनओडीसी) द्वारा तकनीकी कायटक्रमों के िुभारंभ का स्ट्िागत करते हुए, जिनमें यूएनओडीसी-जिश्व सीमा िुल्क सगं ठन (डब्ल्यूसीओ) के हतै ी में कंर्ेनर जनयंत्रण कायटक्रम और सीमा प्रबंधन कायटक्रम सजम्मजलत ह ैं तर्ा सार् ही आग्नेयास्त्रों की तस्ट्करी से जनपर्ने के जलए कैरेजबयन समुदाय (कैरीकॉम) के क्षेत्रीय रोडमैप का स्ट्िागत करते हुए, कैरीकोम िैसे क्षेत्रीय और उपक्षेत्रीय संगठनों तर्ा अन्द्य अतं राष्ट्रट ीय सहभाजगयों की महत्िपूणट भूजमका को स्ट्िीकार करते हुए , हतै ी में सिस्त्र जगरोहों द्वारा लगातार और अजस्ट्र्र करने िाली आपराजधक दक्रयाकलापों और जगरोह प्हसं ा में संजलप्त या सहयोग करन े िाल े सहभाजगयों को छोर्े तर्ा हल्के हजर्यारों और गोला-बारूद के बरे ोकर्ोक हस्ट्तांतरण पर गहरी प्चंता व्यक्त करते हुए, संयुक्त राष्ट्र कर्मटयों पर हमलों और उनके अपहरण, रािनजयक पररसरों के जिरुद्ध प्हसं ा और मानिीय सहायता को लूर्न े की प्नंदा करत े हुए और यह स्ट्मरण करात े हुए दक संयुक्त राष्ट्र कर्मयट ों की संपजत्तयों की सुरक्षा और संरक्षा का प्रार्जमक दाजयत्ि मेिबान राष्ट्रका ह,ै हतै ी म ें मानिाजधकारों के सभी उल्लंघनों और दव्यु टिहारों पर रोक लगान े के जलए स्ट्पष्ट आदेि िारी करने के जलए सभी सहभाजगयों से आह्िान करत े हुए और सभी सहभाजगयों के जलए मानिीय सगं ठनों द्वारा तत्काल, सरु जक्षत और बाधारजहत पहुचं सुजनजित करन े की आिश्यकता को रेखांदकत करते हुए, इस बात पर िोर दते े हुए दक इस संकल्प द्वारा लगाए गए उपायों का उद्देश्य हतै ी की नागररक आबादी पर प्रजतकूल मानिीय प्रभाि डालना नहीं ह।ै यह स्ट्िीकार करत े हुए दक इस संकल्प के अनुसार नाजमत व्यजक्तयों, समूहों, उपक्रमों और संस्ट्र्ाओं को गैरसूचीबद्ध करने के जलए जनष्पक्ष और स्ट्पष्ट प्रदक्रयाएं मौिूद ह ैंऔर ऐसे गरै सूचीबद्ध अनुरोध प्राप्त करन े के जलए लोकपाल को अजधकृत करन े पर जिचार करने के अपने आिय को व्यक्त करत े हुए, यह जनजित करत े हुए दक हतै ी की जस्ट्र्जत इस क्षेत्र म ेंअतं राटष्ट्रीय िांजत और सुरक्षा के जलए खतरा बनी हुई ह,ै संयुक्त राष्ट्र के चार्रट के अध्याय 7 के अधीन कायट करना , 1. िो प्हसं ा, आपराजधक गजतजिजधयों और मानिाजधकारों के हनन पर तत्काल रोक लगाने की मांग करता ह ैिो हतै ी और इस क्षेत्र की िांजत, जस्ट्र्रता और सुरक्षा को कमिोर करता ह,ै जिसमें अपहरण, यौन और मजहलाओं के प्रजत प्हसं ा, मानि तस्ट्करी और प्रिाजसयों की तस्ट्करी और उनकी हत्याएं, न्द्यायेतर हत्याएं और सिस्त्र समूहों और आपराजधक नेर्िकट द्वारा बालकों की भती सजम्मजलत ह;ै 2. स्ट्र्ानीय सुरक्षा जस्ट्र्जत अनुकूल होते ही समािेिी, स्ट्ितंत्र और जनष्पक्ष जिधायी और राष्ट्रपजत जनिाटचन कराने की अनुमजत दने े के जलए सभी रािनीजतक सहभाजगयों से ितटमान रािनीजतक गजतरोध को दरू करने के जलए सार्टक बातचीत म ें रचनात्मक रूप से सजम्मजलत होने का आग्रह करता ह;ै यात्रा पर प्रजतबधं 3. जिजनिय करता ह ै दक, इस सकं ल्प को अगं ीकार करने की तारीख से एक िषट की आरंजभक अिजध के जलए, सभी सदस्ट्य देिजनम्नजलजखत परै ा 19 के अनुसरण में स्ट्र्ाजपत सजमजत द्वारा नामोददष्ट दकसी भी व्यजक्त के अपन ेभूक्षेत्र में प्रिेि या[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 पारगमन को रोकने के जलए आिश्यक उपाय करेंगे परंत ु दक ितटमान पैरा में कुछ भी दकसी देि को अपन े ही नागररकों को अपन ेभूक्षेत्र में प्रिेि पर रोक लगान े के जलए बाध्य नहीं करेगा; 4. रर्प्पण करता ह ै दक नामोददष्ट व्यजक्तयों के पास कई राष्ट्रीयताएं या पासपोर्ट हो सकते हैं, यह प्चंता व्यक्त करता ह ै दक उन दो देिों के बीच यात्रा प्रजतबंध जिनकी एक नामोददष्ट व्यजक्त की राष्ट्रीयता ह ैयापासपोर्ट ह,ै अनच्ु छेद 3 में लगाए गए यात्रा प्रजतबंध के उद्देश्यों को कमिोर कर सकता ह ै और अनुरोध करता ह ै दक इस संकल्प के अनच्ु छेद 21 म ें स्ट्र्ाजपत जििेषज्ञों पैनल ("जििेषज्ञों पैनल") ऐसी यात्रा के बारे में सजमजत को िानकारी दे; 5. जिजनिय करता ह ैदक ऊपर पैरा 3 द्वारा लगाए गए उपाय जनम्नजलजखत के जलए लागू नहीं होंगे: क. िहां सजमजत मामला-दर-मामला आधार पर यह अिधाररत करती ह ै दक ऐसी यात्रा मानिीय आिश्यकता के जलए उजचत ह ैजिसमें धार्मटक कायट सजम्मजलत है; ख. िहां न्द्याजयक प्रदक्रया की पूर्तट के जलए प्रिेि या पारगमन आिश्यक ह;ै और ग. िहां सजमजत मामला-दर-मामला आधार पर यह अिधाररत करती ह ै दक छूर् स े हतै ी म ें िांजत और जस्ट्र्रता के उद्देश्यों को बढ़ािा जमलगे ा; आजस्ट्तिब्त 6. जिजनिय करता ह ै दक, इस संकल्प िब्तकरेंगे, िो इस संकल्प के अनुबंध म ें सूचीबद्ध या सजमजत द्वारा नाजमत दकसी भीव्यजक्त या संस्ट्र्ाओं द्वारा प्रत्यक्ष या परोक्ष रूप से स्ट्िाजमत्ि या जनयंत्रण में ह ैं या उनकी ओर से या उनके जनदेि पर दकसी भी व्यजक्त या संस्ट्र्ाओं द्वारा, या उनके स्ट्िाजमत्ि या जनयंत्रण िाली सस्ट्ं र्ाओं द्वारा कायटरत ह ैं और आग े यह जिजनिय करता ह ै दक सभी सदस्ट्य देि यह सुजनजित करेंग े दक न तो य े और न ही कोई उपलब्ध कराए िाय;ें 7. जिजनिय करता ह ै दक उपरोक्त पैरा 6 द्वारा लगाए गए उपाय उन जनजधयों, अन्द्य जित्तीय पररसंपजत्तयों या आर्र्टक संसाधनों पर लाग ूनहीं होत े ह ैंिो संबंजधत सदस्ट्य देिों द्वारा अिधाररत दकए गए ह:ैं क. िो बुजनयादी खचट के जलए आिश्यक है, जिसमें खाद्य पदार्ों, दकराया या मोगेि, दिाओं और जचदकत्सा उपचार, करों, बीमा प्रीजमयम और सािटिजनक उपयोजगता िुल्क का भगु तान या जििेष रूप से उजचत पेिेिर िल्ु क का भुगतान सजम्मजलत ह ै और राष्ट्रीय जिजधयों के अनुसार जिजधक सेिाओं के उपबंध से िुड़े खचों की प्रजतपूर्त ट सजम्मजलत है,राष्ट्रीय जिजधयों के अनुसार िब्त धन, अन्द्य जित्तीय पररसंपजत्तयों और आर्र्टक संसाधनों के जनयजमत रखरखाि के जलए िुल्क या सिे ा िुल्क और संबंजधत दिे द्वारा सजमजत को अजधकृत करन े के आिय की अजधसूचना के पिात,िहा ं उजचत हो,ऐसी अजधसूचना के पांच कायट ददिसों के भीतर सजमजत द्वारा इंकार न करने जस्ट्र्जत में ऐस े धन, अन्द्य जित्तीय संपजत्तयों या आर्र्टक संसाधनों तक पहुचं ; ख. आिश्यक असाधारण, परंत ु दक ऐसा जनधाटरण संबंजधत देि या सदस्ट्य देिों द्वारा सजमजत को अजधसूजचत दकया गया हो और सजमजत द्वारा अनुमोददत दकया गया हो; ग. न्द्याजयक, प्रिासजनक या मध्यस्ट्र् ग्रहणाजधकार या जनणटय का जिषय होना, जिस जस्ट्र्जत म ेंधन, अन्द्य जित्तीय संपजत्त और आर्र्टक संसाधनों का उपयोग उस ग्रहणाजधकार या जनणटय को संतष्टु करन े के जलए दकया िा सकता ह,ै परंतु इसे ितटमान सकं ल्प के ग्रहणाजधकार या जनणयट की तारीख से पूिट दि ट दकया गया हो औरयह सजमजत द्वारा नाजमत दकसी व्यजक्त या संस्ट्र्ा के लाभ के जलए नहीं हो और सुसंगत राष्ट्र या सदस्ट्य दिे ों द्वारा सजमजत को सूजचत दकया गया हो; 8. जिजनिय करता ह ै दक सदस्ट्य देि उपरोक्त परै ा 6 के उपबंधों के अनुसार फ्री़ि खातों म ें उन खातों पर ऐस े देय ब्याि या अन्द्य आयको िमा करन े की अनुमजत द े सकत े ह ैं िोइस संकल्प के उपबंधों के अधीन इन खातों को फ्री़ि करन े की तारीख से पहले देय र्,े परंत ु ऐसा कोई भी ब्याि, अन्द्य आय और भुगतान इन उपबंधों के अधीन रहगें ेऔर फ्री़ि रहगें े; 9. जिजनिय करता ह ै दक उपरोक्त पैरा 6 में ददए गए उपाय दकसी नाजमत व्यजक्त या इकाई को ऐसे व्यजक्त या इकाई की सूचीबद्घ से पहले दकए गए अनुबंध के अधीन देय भुगतान करने से नहीं रोकेंगे, परंतु सुसंगत देिों न े यह अिधाररत6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] दकया हो दकउपरोक्त पैरा 6 के अनुसार नाजमत दकसी व्यजष्ट या इकाई द्वारा प्रत्यक्ष या अप्रत्यक्ष रूप स े और संबंजधत देिों द्वारा सजमजत को ऐसे भुगतान करने या प्राप्त करने या अजधकृत करने के आिय की अजधसूचना के पिात, िहां उजचत हो, धन, अन्द्य जित्तीय पररसंपजत्तयों को फ्रीि करना या इस प्रयोिन के जलए आर्र्टक संसाधन, ऐसे प्राजधकरण से 10 काय ट ददिस पहले भगु तान नहीं दकया गया ह।ै ; 10. जिजनिय लेता ह ै दक अन्द्यत्र सचं ाजलत मानिीय सहायता कायटक्रमों पर प्रजतकूल प्रभाि डाल े जबना, इस संकल्प के पैरा 6 द्वारा लगाए गए उपाय तत्काल आिश्यक मानिीय सहायता की समय पर जडलीिरी सुजनजित करन े के जलए संयुक्त राष्ट्र, इसकी जिजिष्ट अजभकरणों या कायटक्रमों, संयुक्त राष्ट्र महासभा में पयटिेक्षक का दिाट रखने िाले मानिीय संगठन िो मानिीय सहायता प्रदान करत े ह,ैं और जद्वपक्षीय या बहुपक्षीय रूप से जित्त पोजषत गैर-सरकारी सजहत उनके कायाटन्द्ियन भागीदारों द्वारा हतै ी म ें बुजनयादी मानि आिश्यकताओं का समर्टन करन े िाली अन्द्य दक्रयाकलापों का समर्टन करत े ह ैं और हतै ी के जलए संयुक्त राष्ट्र मानिीय प्रजतदक्रया योिना में भाग लेन े िाल े संगठन ह ैं पर आिश्यक धन, अन्द्य जित्तीय संपजत्तयों या आर्र्टक संसाधनों के भुगतान पर लागू नहीं होंगे; लजक्षत िस्त्र प्रजतबधं 11. जिजनिय करता ह ै दक इस संकल्प को अंगीकार करन े की तारीख स े एक िष ट की आरंजभक अिजध के जलए सभी सदस्ट्य दिे सजमजत द्वारा नामोददष्ट व्यजष्ट और इकाइयों को या उनके लाभ के जलए अपन े क्षेत्रों स े या अपन े नागररकों द्वारा या अपन े झंडे िाल े िहािों द्वारा प्रत्यक्ष या अप्रत्यक्ष रूप स े हजर्यारों,गोला-बारूद, सैन्द्य िाहनों और उपकरणों, अधटसैजनक उपकरणों और स्ट्पेयर पार्टसट सजहत सभी प्रकार की संबंजधत सामग्री की आपूर्तट, जबक्री या हस्ट्तांतरण को रोकने के जलए और इससे संबंजधत तकनीकी सहायता, प्रजिक्षण, जित्तीय या अन्द्य सहायता, सैन्द्य गजतजिजधयों से संबंजधत या दकसी हजर्यार और संबंजधत सामग्री के उपबधं , रखरखाि या उपयोग, जिसमें सिस्त्र भाड़े के कर्मटयों का उपबंध सजम्मजलत ह,ै चाह े ि े इनके क्षेत्रों से उत्पन्न हो रहहे ैंया नहीं पर रोक लगान े के जलए तत्काल आिश्यक कदम उठाएंगे; 12. सदस्ट्य दिे ों को यह सुजनजित करन े के जलए प्रोत्साजहत करता ह ै दक अंतरराष्ट्रीय और क्षेत्रीय संजधयों जिनके ि े पक्षकार ह,ैं के अनुसार छोर्े और हल्के हजर्यारों सजहत अन्द्य हजर्यारों का पता लगाने के जलए पयाटप्त अंकन और ररकॉड ट रखन े के उपाय दकए िाएं, और िहा ं सुसंगत हो, अनरु ोध करने पर, पड़ोसी देि को इस संकल्प के पैराग्राफ 11 म ें लगाए गए उपायों के उल्लघं न में अिधै तस्ट्करी और डायििटन को रोकने और पता लगान े में सहायता कैसे की िाएपर जिचार दकया िाए; 13. सभी देिों, जििेष रूप स े क्षत्रे ीय देिोंसे, अपन े बंदरगाहों और हिाई अड्डों सजहत उनके क्षेत्र मेंउनके राष्ट्रीय प्राजधकाररयों और जिजध के अनसु ार और अतं रराष्ट्रीय जिजध के अनुरूप, हतै ी के सभी कागो का जनरीक्षण करन े का आह्िान करता ह,ै यदद संबंजधत देि के पास ऐसी िानकारी ह ैिो यह मानने के जलए उजचत आधार प्रदान करती ह ैदक कागो में ऐसी िस्ट्तुएं सजम्मजलत ह ैं जिनकी आपूर्तट, जबक्री, स्ट्र्ानांतरण या जनयाटत सख्त कायाटन्द्ियन सुजनजित करन े के उद्देश्य से इस संकल्प के अनच्ु छेद 11 के उपबधं द्वारा जनजषद्ध ह;ै 14. इस संकल्प के परै ा 11 म ेंअजधरोजपत उपायों के उल्लंघन का पता लगाने और इन पर रोक लगाने के जलए, सार् ही जनम्नजलजखत पैरा 19 के अनुसार स्ट्र्ाजपत सजमजत को उल्लंघन के मामलों की समय पर ररपोर्ट करन े के जलए क्षेत्रीय भूजम, िायु और समुरी सहयोग को प्रोत्साजहत करता है; प्रजतबधं के जलए मानदंड 15. जिजनिय करते ह ै दक पैरा 3 के उपबंध व्यजक्तयों पर लाग ू होंग े और पैरा 6 तर्ा11 के उपबंध ऐसे व्यजक्तयों और संस्ट्र्ाओं पर लाग ू होंगे, िो इस संकल्प के परै ा 19 के अनुसार स्ट्र्ाजपत सजमजत द्वारा ऐस े उपायों के जलए नामोददष्ट ह ैं और िो हतै ी की िांजत, सुरक्षा या जस्ट्र्रता को खतरे में डालने िाल ेकायों में प्रत्यक्ष या अप्रत्यक्ष रूप से सजम्मजलत हैं; 16. जिजनिय लेता ह ै दक ऊपर परै ाग्राफ 15 म ें िर्णटत ऐसी कारटिाइयों में जनम्नजलजखत सजम्मजलत ह,ैं ककंतु य े ही सीजमत नहीं ह:ैं क. प्रत्यक्ष या अप्रत्यक्ष रूप से सिस्त्र समूहों और आपराजधक नेर्िकट से िड़ु ी आपराजधक दक्रयाकलापों को िो प्हसं ा को बढ़ािा देत े ह ैं का समर्टन करना, या सजम्मजलत होना और जिसमें ऐस े समूहों और नेर्िकट द्वारा बच्चों की िबरन भती, अपहरण, व्यजक्तयों की तस्ट्करी और प्रिाजसयों की तस्ट्करी,और हत्याएं तर्ा यौन और मजहलाओं के प्रजत प्हसं ा सजम्मजलत है; ख. हजर्यारों और संबंजधत सामग्री की अिैध तस्ट्करी और पर्ांतर, या उससे संबंजधत अिैध जित्तीय प्रिाह का समर्टन करना;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 ग. उपरोक्त उपपरै ाग्राफ (क) और (ख) में उजल्लजखत दक्रयाकलाप के संबंध में नामोददष्ट दकसी व्यजष्ट या इकाई के जलए या उसकी ओर स े या उसके जनदेि पर या अन्द्यर्ा का समर्टन करना या जित्तपोषण करना, जिसम ें संगरठत अपराध से प्राप्त आय का प्रत्यक्ष या अप्रत्यक्ष उपयोग सजम्मजलत ह,ै जिसमें हतै ी म ें उत्पन्न होन े िाली या उसके माध्यम से पारगमन करने िाली दिाओं और उनके पूिटिर्तटयों के अिैध उत्पादन और तस्ट्करी स े प्राप्त आय, व्यजक्तयों की तस्ट्करी और हतै ी से प्रिाजसयों की तस्ट्करी, या हतै ी से या िहां स े हजर्यारों की तस्ट्करी सजम्मजलत ह;ै घ. इस संकल्प के पैराग्राफ 11 म ें स्ट्र्ाजपत हजर्यार प्रजतबंध के उल्लंघन म ें कायट करना, या हतै ी म ें सिस्त्र समूहों या आपराजधक नेर्िकट को प्रत्यक्ष या अप्रत्यक्ष रूप स े आपूर्तट, जबक्री, या स्ट्र्ानांतररत करना, या हजर्यार या दकसी भी संबंजधत सामग्री को हाजसल करना, या हतै ी में सिस्त्र समूहों या आपराजधक नेर्िकट की प्हसं क दक्रयाकलापों से संबजं धत कोई तकनीकी सलाह, प्रजिक्षण, या जित्तपोषण और जित्तीय सहायता प्रदान करना; ड़ हतै ी में ऐस े कायों की योिना बनाना, जनदेजित करना या करना िो अंतराटष्ट्रीय मानिाजधकार जिजध का उल्लघं न करत े ह ैं या ऐस े कायट िो मानिाजधकारों का हनन करते ह,ैं जिनम ें मजहलाओं और बालकाेेें के सार्-सार् न्द्यायेतर हत्याएं सजम्मजलत ह ैं और प्हसं ा, अपहरण, िबरन गायब करना, या दफरौती के जलए अपहरण िैसे कृत्य सजम्मजलत ह;ैं च. हतै ी में बलात्संग और यौन दासता सजहत यौन और मजहलाओं के जिरुद्ध प्हसं ा से संबंजधत कृत्यों की योिना बनाना, जनदेजित करना या करना; छ. हतै ी को मानिीय सहायता प्रदान करन े में बाधा डालना या हतै ी में मानिीय सहायता की पहुचं या उसके जितरण म ेंबाधा डालना; ि. हतै ी म ें संयुक्त राष्ट्र जमिनों और अजभयानों के कर्मटयों या पररसरों पर हमला करना, ऐस े हमलों के जलए सहायता प्रदान करना; 17. मांग करता ह ै दक राष्ट्र यह सुजनजित करेंग ें दक इस संकल्प को लाग ू करन े के जलए उनके द्वारा उठाए गए सभी उपाय अंतरराष्ट्रीय जिजध के तहत उनके दाजयत्िों का अनुपालन करते हों, जिसम ें अतं रराष्ट्रीय मानिीय कानून, अतं रराष्ट्रीय मानिाजधकार जिजध और अतं रराष्ट्रीय िरणार्ी जिजध, िो लागू हो, सजम्मजलत ह;ैं 18. जिजनिय करता ह ै दक इस संकल्प के अनुबंध में सूचीबद्ध व्यजष्ट ऊपर परै ा 3, 6 और 11 द्वारा अजधरोजपत उपायों के अधीन होगा; प्रजतबधं सजमजत 19. प्रदक्रया के अपन े अनंजतम जनयमों के जनयम 28 के अनुसार, जनम्नजलजखत कायों को करने के जलए, पररषद के सभी सदस्ट्यों (यहां "सजमजत") को सजम्मजलत करते हुए सुरक्षा पररषद की एक सजमजत गरठत करन ेका जिजनिय दकया गया ह ै: क. सदस्ट्य देिों द्वारा इन उपायों के कायाटन्द्ियन को मिबूत बनाना, सुजिधािनक बनाना और इनमें सुधार करने की दजृ ष्ट से उपरोक्त परै ा 3, 6 और 11 म ें अजधरोजपत उपायों के कायाटन्द्ियन की जनगरानी करना और इस संकल्प के पैरा 5 और 7 म ेंजनधाटररत छूर् के अनरु ोधों पर जिचार करना; ख. उन व्यजष्टयों और इकाइयों के संबंध में िानकारी प्राप्त करना और समीक्षा करना िो उपरोक्त परै ा 15 और 16 में िर्णटत कृत्यों में संजलप्त ह;ैं ग. उपरोक्त पैराग्राफ 3, 6 और 11 में दकए गए उपायों के अधीन व्यजष्टयों और इकाइयों को नाजमत करना; घ. ऐसे ददिाजनदेि स्ट्र्ाजपत और प्रख्याजपत करना िो ऊपर लाग ू उपायों के कायाटन्द्ियन को सुजिधािनक बनाने के जलए आिश्यक हों; ङ. सुरक्षा पररषद को अपनी रर्प्पजणयों और जसफाररिों के सार् अपन े काम पर 60 ददनों के भीतर ररपोर् ट करना, जििेष रूप से इस संकल्प के परै ाग्राफ 3, 6 और 11 द्वारा दकए गए उपायों की प्रभाििीलता को मिबूत करन े की रीजतयों पर और उसके बाद िार्षटक आधार पर ररपोर्ट करना;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] च. सजमजत और इच्छुक सदस्ट्य राष्ट्रों, जििेष रूप से क्षेत्र के लोगों के बीच संिाद को प्रोत्साजहत करना, जिसमें उपायों के कायाटन्द्ियन पर चचाट करने के जलए सजमजत के सार् बैठक करने के जलए ऐसे राज्यों के प्रजतजनजधयों को आमंजत्रत करना सजम्मजलत है; छ. लाग ू उपायों को प्रभािी रूप स े कायाटजन्द्ित करन े के जलए उनके द्वारा की गई कारटिाइयों के संबंध म ें सभी राष्ट्रों से िह िानकारी मांगना िो िह उपयोगी समझते ह;ैं ि. पैराग्राफ 3, 6, और 11 में जनजहत उपायों के कजर्त उल्लघं न या गैर-अनुपालन के संबंध में िानकारी की िांच करना और उजचत कारटिाई करना; 20. सजमजत को अन्द्य सगं त सुरक्षा पररषद प्रजतबंध सजमजतयों के सार् सहयोग करन े का जनदेि देता है; ररपोर्ट करना 21. महासजचि से अनुरोध करती ह ै दक सजमजत के परामि ट से 13 महीने की आरंजभक अिजध के जलए, सजमजत के जनदेिन में 4 जििेषज्ञों का एक समूह ("जििेषज्ञों का पनै ल") का गठन करें तर्ा पैनल के कायट का समर्टन करन े के जलए आिश्यक जित्तीय एिं सुरक्षा व्यिस्ट्र्ा करें, और यह जनणटय ल ेंदक पैनल जनम्नजलजखत कायट करेगा: क. इस संकल्प में जनर्दष्टट अपने अजधदेि को पूरा करने म ें सजमजत की सहायता करना, जिसमें दकसी भी समय सजमजत को उन व्यजक्तयों और संस्ट्र्ाओं के संभाजित रूप स े नाजमत दकए िान े से संबंजधत िानकारी प्रदान करना सजम्मजलत ह ैिो उपयक्तुट पैराग्राफ 15 और 16 म ेंउजल्लजखत दक्रयाकलापों से िुड़े हुए ह।ैं ख. इस संकल्प म ें तय दकए गए उपायों के कायाटन्द्ियन के संबंध में राष्ट्रों, सुसंगत संयक्तु राष्ट्र जनकायों, क्षेत्रीय संगठनों और अन्द्य इच्छुक पक्षकारों से, जििेष रूप से हतै ी म ें हजर्यारों की तस्ट्करी के स्रोत एिं मागों तर्ा रािनीजतक पररितटन को कमिोर करन े से संबंजधत घर्नाओं के बारे में िानकारी एकजत्रत करना, उसकी िांच तर्ा जिश्लेषण करना; ग. सजमजत के सार् चचा ट के पिात पररषद को 15 माच ट 2023 तक एक अंतररम ररपोर्ट, 15 जसतंबर 2023 स े पहले एक अंजतम ररपोर्ट और इसके बीच में आिजधक अपडेर् प्रदान करना; घ. इस संकल्प के पैराग्राफ 3, 6 और 11 के अनुसार लागू उपायों के अधीन व्यजष्टयों और इकाइयों की सूची पर िानकारी को पररष्कृत और अद्यतन करन े में सजमजत की सहायता करना, जिसम ें िानकारी की पहचान करना और सािटिजनक रूप से उपलब्ध सूचीबद्ध करने के कारण के सारांि हते ु अजतररक्त िानकारी का उपबंध सजम्मजलत ह;ै 22. अपनी प्रजतबंध सजमजतयों के कायट में सहायता के जलए बीआईएनयूएच, यूएनओडीसी, सीएआरआईसीओएम और सुरक्षा पररषद द्वारा स्ट्र्ाजपत ससु ंगत जििेषज्ञ समूहों के सार् आिश्यकतानुसार सहयोग करने के जलए पैनल को जनदेि देती ह;ै 23. सभी पक्षकारों और सभी सदस्ट्य राष्ट्रों के सार्-सार् अंतराष्ट्रट ीय, क्षेत्रीय और उप-क्षेत्रीय संगठनों से जििेषज्ञों के पैनल के सार् सहयोग सुजनजित करन े का आग्रह करती ह ै और इसमें सजम्मजलत सभी सदस्ट्य राष्ट्रों स े जििेषज्ञों के पैनल के सदस्ट्यों की सुरक्षा और जििेष रूप स े व्यजष्टयों, दस्ट्तािे़िों और साइर्ों तक जनबाटध पहुचं सुजनजित करने का आग्रह करती ह ै जिससे पैनल अपन ेअजधदेि को दक्रयाजन्द्ित कर सके; 24. यह रर्प्पण करती ह ैं दक पैनल में सजम्मजलत होन े िाल े जििेषज्ञों की चयन प्रदक्रया म ें भती प्रदक्रया में क्षेत्रीय और मजहला/पुरुष प्रजतजनजधत्ि के महत्ि को ध्यान म ें रखते हुए ऊपर उजल्लजखत कतटव्यों को पूरा करन े के जलए सबसे मिबूत योग्यता िाले व्यजक्तयों की जनयजु क्त को प्रार्जमकता दी िाएगी; पनु र्िलट ोकन 25. यह पुजष्ट करती ह ैं दक यह हतै ी में जस्ट्र्जत की जनरंतर समीक्षा करेगा और यह इस संकल्प में जनजहत उपायों की उपयुक्तता की समीक्षा करने के जलए तैयार रहगे ा, जिसमें जनम्नजलजखत प्रमुख मानकों पर प्राप्त प्रगजत को देखत े हुए दकसी भी समय आिश्यकतानुसार उपायों को मिबूत करना, उसे संिोजधत, जनलंजबत या उन्नत करना सजम्मजलत ह:ै क. िब हतै ी सरकार ने सिस्त्र समहू ों और अपराध-संबंजधत दक्रयाकलापों को संभालने के जलए पयाटप्त न्द्याजयक और जिजध व्यिस्ट्र्ा की क्षमता जिकजसत कर ली है;अपराध[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 ख. सिस्त्र समूहों और आपराजधक नेर्िकट द्वारा इरादतन हत्याओं, अपहरण तर्ा यौन एि ं प्लंग-आधाररत उत्पीड़न की संख्या सजहत अन्द्य प्रकार की प्हसं ा की मात्रा में उत्तरोत्तर कमी, जिसे इस संकल्प के स्ट्िीकार दकए िाने के बारह महीन े की आरंजभक अिजध से िरूु होकर िार्षटक आधार पर मापा िाता है; ग. महासजचि की 13 िून 2022 की ररपोर्ट जििेषज्ञों के पैनल के सार् जनकर् समन्द्िय में, 15 जसतंबर 2023 से पहल े उपरोक्त पैराग्राफ म ेंस्ट्र्ाजपत प्रमुख मानकों पर हुई प्रगजत का आकलन करने का अनरु ोध करती हैं; 27. यूएनओडीसी को बीआईएनयूएच और जििेषज्ञों के पैनल के सार् आिश्यकतानुसार कायट करने के जलए और हतै ी में अिैध जित्तीय प्रिाह और तस्ट्करी एिं हजर्यारों स े संबंजधत सामजग्रयों की तस्ट्करी को रोकने के जलए जसफाररिों पर सजमजत को ररपोर्ट करन ेके जलए आमंजत्रत करती ह;ैं 28. मामले पर सदक्रय रूप से निर रखने का जिजनिय करती ह।ैं उपाबधं II सयं क्तु राष्ट्र सरु क्षा पररषद सकं ल्प एस/आरईएस/2699 (2023) सुरक्षा पररषद द्वारा 2 अक्तूबर 2023 को हुई उसकी 9430िीं बैठक में अपनाया गया सुरक्षा पररषद, हतै ी की जस्ट्र्जत पर अपने सभी जपछले संकल्पों तर्ा प्रेस िक्तव्यों को याद करते हुए, और सकं ल्प 2692 (2023) की पुनः पुजष्ट करते हुए, हतै ी की संप्रभुता, स्ट्ितंत्रता, क्षत्रे ीय अखंडता और एकता के प्रजत अपनी मिबूत प्रजतबद्धता की पुजष्ट करत े हुए, इस बात पर िोर दते े हुए दक सुरक्षा के उपबंध, जिजध व्यिस्ट्र्ा तर्ा मानिाजधकारों हते ु जस्ट्र्रता और सम्मान सुजनजित करन े और हतै ी के परू े क्षेत्र म ें नागररकों की सुरक्षा सुजनजित करने की प्रार्जमक उत्तरदाजयत्ि हतै ी सरकार की है, और सिस्त्र समूहों तर्ा आपराजधक नेर्िकट द्वारा दकए िान े िाले प्हसं क कृत्यों में िृजद्ध पर गहरी प्चतं ा व्यक्त करत े हुए, पयाटप्त संख्या, संरचना और उपकरणों िाली एक पेिेिर, आत्मजनभटर, परू ी तरह से कायटिील हाईरर्यन राष्ट्रीय पुजलस, िो पुजलस के पणू ट स्ट्पेक्रम का संचालन करन े में सक्षम है, के महत्ि की पुजष्ट करते हुए िो सािटिजनक सुरक्षा बनाए रखने, मानिाजधकारों के प्रजत सम्मान, लोकतंत्र की मिबूती और हतै ी की न्द्याय प्रणाली के पुनरुद्धार और हतै ी को इन संबंधों म ें अपनी योिनाओं को सदक्रय रूप स े आग े बढ़ान े के जलए प्रोत्साजहत करन े के जलए कायट करें, बढ़ती प्हसं ा, आपराजधक दक्रयाकलापों और हतै ी तर्ा उस क्षेत्र की िांजत, जस्ट्र्रता एिं सुरक्षा को कमिोर करने िाल े मानिाजधकारों के हनन एिं उल्लघं न,जिसमें अपहरण, यौन और प्लगं -आधाररत उत्पीड़न, व्यजक्तयों की तस्ट्करी और प्रिाजसयों की तस्ट्करी, हत्याएं, न्द्यायेत्तर हत्याएं और सार् ही हजर्यारों की तस्ट्करी सजम्मजलत है,की कड़े िब्दों म ें प्नंदा करते हुए, हतै ी म ें बालकों के जिरूद्घ होन े िाल े उल्लंघनों तर्ा उत्पीड़न की गंभीरता और संख्या की कड़ी प्नंदा करते हुए और उसपर गहरी प्चंता व्यक्त करत े हुए;और सभी सगं ठनाेेें,जििेष रूप से जगरोहों और आपराजधक नेर्िकों बालकों के जिरूद्घ सभी उल्लघं नों और उत्पीड़न, जिनम ें हत्या और अपंगता, भती और उपयोग, जििेष रूप से लड़दकयों से बलात्संग तर्ा यौन एिं प्लंग-आधाररत उत्पीड़न के अन्द्य प्रकार, स्ट्कूलों तर्ा अस्ट्पतालों पर हमले, अपहरण, और मानिीय सहायता पहुचँ ने से इनकार सजम्मजलत ह,ै को तुरंत समाप्त करने और रोकन े का आग्रह करते हुए, हाईरर्यन जगरोहों और उनके समर्टकों सजहत सभी संगठनों से आग्रह करते हुए दक ि े अपनी अजस्ट्र्र करन े िाली और आपराजधक गजतजिजधयों को बदं करें, और आग े इन जगरोहों को प्रभाजित करन े की क्षमता रखने िालों से भी आग्रह करत े हुए दक िे अन्द्य आपराजधक दक्रयाकलापों के सार्-सार् अिैध हजर्यारों और जित्तीय प्रिाह द्वारा क्षेत्र म ें अंतरराष्ट्रीय िांजत और सुरक्षा के जलए उत्पन्न खतरे के प्रजतउत्तर स्ट्र्ाजपत प्रजतबंध उपाय ह,ै को याद करते हुए और आगे संकल्प 2664 (2022), िो संकल्प 2653 के परै ाग्राफ 10 में जनधाटररत पररसंपजत्त फ्रीि अपिाद को प्रजतस्ट्र्ाजपत करता ह,ैको पुनः याद करते हुए, हतै ी म ें सुरक्षा और मानिीय िरूरतों को पूरा करन े के जलए अंतराष्ट्रट ीय समुदाय की प्रजतबद्धता की पुजष्ट करत े हुए, जिसम ें हतै ी में संयुक्त राष्ट्र एकीकृत कायाटलय (बीआईएनयूएच) को जनरंतर सहयोग प्रदान करना भी सजम्मजलत है, इस बात पर िोर देते हुए दक हतै ी में अजस्ट्र्रता के मलू कारणों का समाधान करने के जलए रािनीजतक समाधान की आिश्यकता ह,ै और इस संबंध में आिश्यक सुरक्षा पररजस्ट्र्जतयों के परू ा होत े ही एक पारदिी, समािेिी एि ं जिश्वसनीय चुनािी प्रदक्रयाओं और स्ट्ितंत्र एिं जनष्पक्ष चनु ाि करान े और लोकतांजत्रक संस्ट्र्ानों को बहाल करन े के उद्देश्य स े रािनीजतक प्रदक्रया में व्यापक भागीदारी को प्रोत्साजहत करन े तर्ा व्यापक संभि आम सहमजत बनान े की तत्काल आिश्यकता पर िोर देते हुए, एक समािेिी अंतर-हाईरर्यन राष्ट्रीय संिाद के माध्यम से मजहलाओं की पणू ट, समान, सार्टक और सुरजक्षत भागीदारी और युिाओं, नागररक समाि और अन्द्य सुसंगत जहतधारकों की भागीदारी के सार् स्ट्ितंत्र और जनष्पक्ष जिधायी और राष्ट्रपजत जनिाटचन आयोजित करन े की अनुमजत देन े के जलए हाईरर्यन के नते ृत्ि िाली, हाईरर्यन के स्ट्िाजमत्ि िाली रािनीजतक प्रदक्रया को िारी रखने के जलए बीएनआईयूएच के समर्टन सजहत सभी हाईरर्यन जहतधारकों की आिश्यकता को दोहरात े हुएऔर आग े सभी हाईरर्यन जहतधारकों स े चुनािों के जलए एक स्ट्र्ायी, समयबद्ध और समान रूप स े स्ट्िीकृत प्रदक्रया पर तत्काल एक करार करने का अनुरोध करत े हुए, कैरेजबयन समुदाय के प्रजतजित व्यजक्तयों के समूह (सीएआरआईसीओएम) की हतै ी की हाल की यात्राओं को ध्यान में रखत े हुए और रािनीजतक संिाद का समर्टन करने के जलए इसकी जनरंतर प्रजतबद्धता का स्ट्िागत करते हुए, इस क्षेत्र के देिों के सार्-सार् कैरेजबयन समुदाय (सीएआरआईसीओएम) िैस े क्षेत्रीय और उप-क्षेत्रीय संगठनों और अन्द्य अंतराष्ट्रट ीय साझेदारों, जििेष रूप से रािनीजतक जस्ट्र्जत पर काबू पान े में हतै ी के प्रयासों के प्रजत प्रजतबद्ध रहन ेका आह्िान करते हुए, उच्च स्ट्तर की सामूजहक प्हसं ा को संबोजधत करने और सुरक्षा को दफर से स्ट्र्ाजपत करने के जलए हाईरर्यन राष्ट्रीय पुजलस के प्रयासों का समर्टन करने हते ु एक जििेष अंतरराष्ट्रीय बल की तैनाती और तकनीकी सहायता के जलए हतै ी की मंजत्रपररषद की 6 अक्र्ूबर 2022 की अपील पर ध्यान दते े हुए, आग े महासजचि के तारीख 8 अक्र्ूबर 2022 (एस/2022/747)के पत्र, महासजचि की तारीख 14 अप्रैल 2023की ररपोर्ट (दस्ट्तािे़ि एस/2023/274), और हाईरर्यन राष्ट्रीय पुजलस का समर्टन करने के जलए उजचत अजधदेि के सार् बहुराष्ट्रीय सुरक्षा प्रयासों को अजधकृत करन े के जलए सुरक्षा पररषद के समक्ष 6 िलु ाई 2023 को कैररकॉम की ओर से िमैका के िक्तव्य को ध्यान देते हुए, हतै ी में व्यजक्तयों के िबरन जिस्ट्र्ापन सजहत मानिीय जस्ट्र्जत की जनरंतर और प्रत्यक्ष जगरािर् पर गंभीर प्चंता व्यक्त करत े हुए, और सभी पक्षकारों से उल्लंघन एिं दव्यु टिहार को तरु ंत रोकने का आग्रह करते हुए, जगरोह और सामुदाजयक प्हसं ा को कम करन े के सार्-सार् मानिाजधकारों के प्रजत सम्मान सुजनजित करन े एि ं बाल संरक्षण क्षमता का जनमाटण करन े के जलए बीआईएनयूएच और यूएनओडीसी के सार् यर्ोजचत समन्द्िय की आिश्यकता, और आग े राष्ट्रीय पुजलस अजधकाररयों की संख्या म ें जिस्ट्तार करने, जनरंतर िांच करने, समुदाय-उन्द्मुख पुजलप्संग कौिल को बढ़ाने, यौन एिं प्लगं -आधाररत प्हसं ा को रोकने और उसपर ििाबी कारटिाई करन े की क्षमता को मिबूत करने, सभी स्ट्तरों पर मजहलाओं की पूण,ट समान एिं सार्टक भागीदारी तर्ा प्रजतजनजधत्ि सुजनजित करने, काननू व्यिस्ट्र्ा के प्रजत सम्मान, तर्ा जगरोह-जनयंजत्रत क्षेत्रों में नष्ट कर ददए गए पुजलस स्ट्र्ेिनों को बहाल करन े सजहत सुरक्षा अजभयानों के अजतररक्त राष्ट्रीय[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 पुजलस की समग्र क्षमताओं का जिस्ट्तार करन े के जलए बीआईएनयूएच और अंतरराष्ट्रीय भागीदारों द्वारा प्रजिक्षण प्रयासों को और मिबूत करने की आिश्यकता पर ध्यान देत े हुए, रािनीजतक, संस्ट्र्ागत और सामाजिक-आर्र्टक अजस्ट्र्रता से उत्पन्न होने िाली जगरोह प्हसं ा के मूल कारणों को स्ट्र्ायी रूप से संबोजधत करने के जलए बहुराष्ट्रीय सुरक्षा सहायता सहायता को बढ़ान े के जलए अंतराष्ट्रट ीय जित्तीय संस्ट्र्ानों सजहत अंतराटष्ट्रीय समुदाय को दकए गए आह्िान को दोहराते हुए, हतै ी में स्ट्ितंत्र एिं जनष्पक्ष जनिाटचन के आयोिन सजहत लोकतांजत्रक संस्ट्र्ानों के पनु र्नटमाटण को बढ़ािा देने के दीघटकाजलक प्रयास में िहाँ लोगों के सार् काम करन ेके जलए अंतराष्ट्रट ीय समदु ाय की आिश्यकता को रेखांदकत करत े हुए, हतै ी के सार् परामि ट और संकल्प 2692 (2023) में सरु क्षा पररषद द्वारा हतै ी को सुरक्षा सहायता के सिटसम्मत रूप स े बढ़ाने के बाद,हतै ी के जनमंत्रण पर एक बहुराष्ट्रीय जमिन का नते ृत्ि करन े पर सकारात्मक रूप से जिचार करने के जलए और संयुक्त राष्ट्र महासजचि की अपील के उत्तर में केन्द्या सरकार द्वारा 29 िलु ाई की घोषणा का स्ट्िागत करते हुए, और कई सदस्ट्य राष्ट्रों द्वारा सहभाजगता के जलए की गई सकारात्मक प्रजतदक्रयाओं का स्ट्िागत करते हुए, सुरक्षा पररषद के अध्यक्ष को संबोजधत महासजचि के 26 जसतंबर 2023 के पत्र (एस/2023/726) को ध्यान में रखते हुए, अध्याय 7के अधीन सुरक्षा पररषद स े प्राजधकार प्राप्त करने की दढ़ृ ता से इच्छा व्यक्त करता ह ै और िो केन्द्याई प्रजतजनजधमंडल के मूल्यांकन दौरे के बाद िो आिा व्यक्त करता ह ै दक बहुराष्ट्रीय सुरक्षा सहायता जमिन देि की महत्िपूण ट अिसंरचना की सुरक्षा सुजनजित करने में मदद करेगा और हतै ी की राष्ट्रीय पुजलस के सार् करीबी सहयोग से लजक्षत संचालन करने म ेंसक्षम होगा। बहुराष्ट्रीय सुरक्षा सहायता जमिन की तनै ाती सजहत अतं रराष्ट्रीय सुरक्षा सहायता के जलए एक सुरजक्षत संचालन िातािरण के जनमाटण के जलए हतै ी म ें हजर्यारों और गोला-बारूद की अिधै तस्ट्करी को रोकन े के महत्ि और तात्काजलकता को पहचानते हुए, 21 जसतंबर 2023 को केन्द्या सरकार द्वारा दकए गए आह्िान पर ध्यान देते हुए संयक्तु राष्ट्र से हतै ी की चुनौजतयों के जलए समग्र प्रजतदक्रया के भाग के रूप म ें बहुराष्ट्रीय सुरक्षा सहायता की तैनाती की सुजिधा के जलए तत्काल एक उजचत रूपरेखा प्रदान करन े का आग्रह दकया गया, सुरक्षा पररषद स े अध्याय 7के अधीन एक संकल्प का अनमु ोदन करन े का आह्िान करत े हुए िो हतै ी और उसके लोगों की जिजिष्ट आिश्यकताओं के जलए सुरक्षा सहायता जमिन तैयार करती है, यह जनधाटररत करत े हुए दक हतै ी की जस्ट्र्जत अतं रराष्ट्रीय िांजत और सुरक्षा तर्ा क्षेत्र में जस्ट्र्रता के जलए खतरा बनी हुई है, संयुक्त राष्ट्र के चार्रट के अध्याय 7के अधीन कायट करते हुए, 1. उन सदस्ट्य राज्यों को अजधकृत करता ह ै जिन्द्होंन े हतै ी सरकार के सार् सहयोग और समन्द्िय में, इस संकल्प को अपनान े के बाद बारह महीने की आरंजभक अिजध के जलए, जिसका इस संकल्प को अपनाने के नौ महीन े बाद समीक्षा दकया िाना ह,ै यह मानते हुए दक इस अस्ट्र्ायी संचालन को लागू करने की लागत स्ट्िैजच्छक योगदान और व्यजक्तगत सदस्ट्य राज्यों और क्षेत्रीय सगं ठनों के समर्टन से िहन की िाएगी तर्ा यर्ालाग ू अतं राटष्ट्रीय मानिाजधकार जिजध सजहत अतं राटष्ट्रीय जिजध के सख्त अनपु ालन के सार् हतै ी में सुरक्षा को पुनस्ट्र्ाटजपत करने और स्ट्ितंत्र एिं जनष्पक्ष चुनाि कराने के जलए अनुकूल सुरक्षा जस्ट्र्जतयों का जनमाटण करने हते ु हतै ी की राष्ट्रीय पुजलस के प्रयासों का समर्टन करन े के जलए एक प्रमुख देि के सार् एक बहुराष्ट्रीय सुरक्षा सहायता (एमएसएस) जमिन बनाने और तैनात करन े के जलए अपनी भागीदारी के बारे म ें महासजचि को सूजचत दकया ह,ै द्वारा (क) हतै ी की राष्ट्रीय पुजलस को पररचालन सहायता प्रदान करते हुए जिसमें संयुक्त सुरक्षा सहायता संचालन की योिना और संचालन के माध्यम स े इसकी क्षमता का जनमाटण करना सजम्मजलत है, क्योंदक यह हतै ी म ें अपहरण, यौन और प्लगं आधाररत प्हसं ा, मानिों की तस्ट्करी तर्ा प्रिाजसयों और हजर्यारों की तस्ट्करी, नरसंहार, न्द्यायेतर हत्याएं, और सिस्त्र समूहों एिं आपराजधक नेर्िकट द्वारा बालकों की भती स े संबंजधत जगरोहों का मुकाबला करने और सुरक्षा जस्ट्र्जतयों म ेंसुधार करने के जलए कायट करता है; तर्ा (ख) हिाई अड्ड,े बंदरगाहों, जिद्यालयों, अस्ट्पतालों और प्रमुख चौराहों िैसे महत्िपूणट अिसंरचना स्ट्र्लों एिं पारगमन स्ट्र्ानों के जलए सरु क्षा के उपबंध के जलए हैती की राष्ट्रीय अपन े पत्र म ें अनुरोध दकया र्ा, हतै ी की राष्ट्रीय पुजलस के सार् समन्द्िय म ें िीिन की हाजन को रोकने तर्ा अपनी क्षमताओं और तैनाती के क्षेत्रों की सीमा के भीतर, असाधारण आधार पर तत्काल अस्ट्र्ायी उपाय अपनाने िो दायरे म ें सीजमत, समयबद्ध, आनुपाजतक और उपरोक्त पैराग्राफ 1 म ें जनधाटररत उद्देश्यों के अनरूु प हों, हतै ी की राष्ट्रीय पुजलस की यर्ा आिश्यक जगरफ्तारी और जहरासत सजहत बुजनयादी जिजध तर्ा व्यिस्ट्र्ा और सािटिजनक सुरक्षा बनाए रखने म ें सहायता करन,े एि ं अतं रराष्ट्रीय मानिाजधकार कानून सजहत यर्ालाग ू अंतरराष्ट्रीय कानून के पूण ट अनपु ालन दकए िान े का जनणटय लते ी ह ै ; तर्ा बहुराष्ट्रीय सुरक्षा सहायता जमिन के नेतृत्ि से इस आधार पर अपनाए िाने िाले दकसी भी उपाय को सरु क्षा पररषद स े अद्यतन करने का अनुरोध करती ह;ै 4. सदस्ट्य राज्यों और क्षेत्रीय संगठनों से बहुराष्ट्रीय सुरक्षा सहायता जमिन की तत्काल िरूरतों के आधार पर कर्मटयों, उपकरणों और आिश्यक जित्तीय एिं रसद संसाधनों का योगदान करने का आह्िान करता ह ैऔर योगदान देन े िाले सदस्ट्य राज्यों से बहुराष्ट्रीय सुरक्षा सहायता जमिन के नेतृत्ि, सुरक्षा पररषद और महासजचि को जमिन में भाग लने े के जलए उनकी इच्छा के जिषय में जलजखत रूप में सूजचत करने के जलए आमंजत्रत करती ह ै तर्ा हतै ी और बहुराष्ट्रीय सुरक्षा सहायता जमिन के नेतृत्ि से सुरक्षा पररषद और महासजचि को संबंजधत कर्मटयों की तैनाती और उपकरण की प्रगजत के बारे में जनयजमत रूप से अद्यजतत करन े का अनुरोध करती ह;ै 5. अंतरराष्ट्रीय मानिाजधकार जिजध सजहत यर्ालाग ू सभी अंतरराष्ट्रीय Definitions.– (1) In this order, unless the context otherwise requires,- (a) “asset Freeze” means freezing or restricting or regulating the funds, other financial resources and economic resources by the Central Government pursuant to paragraphs 6, 7, 8, 9 and 10 of the Resolution 2653 (2022); (b) “arms Embargo” means preventing direct or indirect supply, sale or transfer of small arms, light weapons and ammunition by the Central Government pursuant to paragraph 14 of the Resolution 2699 (2023); (c) “Committee” means the Sanctions Committee established by the Security Council of the United Nations in accordance with paragraph 19 of the Resolution 2653 (2022); (d) “Resolution” means the Resolution 2653 (2022) of the Security Council of the United Nations adopted on the 21st October, 2022 and Resolution 2699 (2023) adopted by the Security Council on the 2nd October, 2023 under Chapter VII of the Charter of the United Nations on Mali appended to this order as Annexure I and Annexure II, respectively; (e) “travel Ban” means travel ban or restrictions as imposed by the Central Government pursuant to paragraphs 3, 4 and 5 of the Resolution 2653 (2022). authorizing the Ombudsperson to receive such delisting requests, Determining that the situation in Haiti continues to constitute a threat to international peace and security in the region, Acting under Chapter VII of the Charter of the United Nations, 1. Demands an immediate cessation of violence, criminal activities, and human rights abuses which undermine the peace, stability and security of Haiti and the region, including kidnappings, sexual and gender-based violence, trafficking in persons and the smuggling of migrants, and homicides, extrajudicial killings and recruitment of children by armed groups and criminal networks; 2. Urges all political actors to constructively engage in meaningful negotiations to overcome the current political stalemate in order to allow the holding of inclusive, free and fair legislative and presidential elections, as soon as the local security situation permits; Travel Ban 3. Decides that, for an initial period of one year from the date of adoption of this resolution, all Member States shall take the necessary measures to prevent the entry into or transit through their territories of any individuals designated by the Committee established pursuant to paragraph 19 below, provided that nothing in the present paragraph shall oblige a State to refuse its own nationals entry into its territory; 4. Notes that designated individuals may have multiple nationalities or passports, expresses its concern that travel between the two States of which a designated individual has nationality or a passport may undermine the objectives of the travel ban imposed in paragraph 3, and requests that the Panel of Experts established in paragraph 21 of this resolution (the “Panel of Experts”) report to the Committee information about such travel; 5. Decides that, for an initial period of one year from the date of adoption of this resolution, all Member States shall freeze without delay all funds, other financial assets and economic resources which are on their territories, which are owned or controlled, directly or indirectly, by any individuals or entities listed in the Annex to this resolution or designated by the Committee, or by any individuals or entities acting on their behalf or at their direction, or by entities owned or controlled by them, and decides further that all Member States shall ensure that neither these nor any other funds, financial assets or economic resources are made available, directly or indirectly, to or for such individuals’ or entities’ benefit, by their nationals or by persons within their territory; 7. Decides that the measures imposed by paragraph 6 above do not apply to funds, other financial assets or economic resources that have been determined by relevant Member States: a. To be necessary for basic expenses, including payment for foodstuffs, rent or mortgage, medicines and medical treatment, taxes, insurance premiums, and public utility charges or exclusively for payment of reasonable professional fees and reimbursement of incurred expenses associated with the provision of legal services in accordance with national laws, or fees or service charges, in accordance with national laws, for routine holding or maintenance of frozen funds, other financial assets and economic resources, after notification by the relevant State to the Committee of the intention to authorize, where appropriate, access to such funds, other financial assets or economic resources and in the absence of a negative decision by the Committee within five working days of such notification; b. To be necessary for extraordinary expenses, provided that such determination has been notified by the relevant State or Member States to the Committee and has been approved by the Committee; c. To be the subject of a judicial, administrative or arbitral lien or judgment, in which case the funds, other financial assets and economic resources may be used to satisfy that lien or judgment provided that the lien or judgment was entered into prior to the date of the present resolution, is not for the benefit of a person or entity designated by the Committee, and has been notified by the relevant State or Member States to the Committee; 8. Decides that Member States may permit the addition to the accounts frozen pursuant to the provisions of paragraph 6 above of interests or other earnings due on those accounts or any payments due under contracts, agreements or obligations that arose prior to the date on which those accounts became subject to the provisions of this resolution, provided that any such interest, other earnings and payments continues to be subject to these provisions and are frozen; 9. Decides that the measures in paragraph 6 above shall not prevent a designated individual or entity from making payment due under a contract entered into prior to the listing of such an individual or entity, provided that the relevant States have determined that the payment is not directly or indirectly received by an individual or entity designated pursuant to paragraph 6 above, and after notification by the relevant States to the Committee of the intention to make or receive such payments or to authorize, where appropriate, the unfreezing of funds, other financial assets or economic resources for this purpose, 10 working days prior to such authorization; 10. Decides that without prejudice to humanitarian assistance programmes conducted elsewhere, the measures imposed by paragraph 6 of this resolution shall not apply to the payment of funds, other financial assets or economic resources necessary to ensure the timely delivery of urgently needed humanitarian assistance or to support other activities that support basic human needs in Haiti, by the United Nations, its specialised agencies or programmes, humanitarian organisations having observer status with the United Nations General Assembly that provide humanitarian assistance, and their implementing partners including bilaterally or multilaterally funded non- governmental organisations participating in the United Nations Humanitarian Response Plan for Haiti; Targeted Arms Embargo 11. Decides that, for an initial period of one year from the date of adoption of this resolution, all Member States shall immediately take the necessary measures to prevent the direct or indirect supply, sale or transfer to, or for the benefit of, the individuals and entities designated by the Committee from or through their territories or by their nationals, or using their flag vessels or aircraft of arms and related materiel of all types, including weapons and ammunition, military vehicles and equipment, paramilitary equipment, and spare parts for the aforementioned, and technical assistance, training, financial or other assistance, related to military activities or the provision, maintenance18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] or use of any arms and related materiel, including the provision of armed mercenary personnel whether or not originating in their territories; 12. Encourages Member States to ensure adequate marking and recordkeeping measures are in place to trace arms, including small arms and light weapons, in accordance with the international and regional instruments to which they are parties, and to consider how best to assist, where relevant and upon their request, neighboring countries in preventing and detecting illicit trafficking and diversion in violation of measures imposed in paragraph 11 of this resolution; 13. Calls upon all States, in particular regional countries, to inspect, in accordance with their national authorities and legislation, and consistent with international law, all cargo to Haiti in their territory, including seaports and airports, if the State concerned has information that provides reasonable grounds to believe the cargo contains items the supply, sale, transfer, or export of which is prohibited by paragraph 11 of this resolution for the purpose of ensuring strict implementation of those provisions; 14. Encourages regional land, air, and maritime cooperation, as applicable, to detect and prevent violations of measures imposed in paragraph 11 of this resolution, as well as to report cases of violations in a timely manner to the Committee established pursuant to paragraph 19 below; Sanctions Designation Criteria 15. Decides that the provisions of paragraph 3 shall apply to individuals, and that the provisions of paragraphs 6 and 11 shall apply to individuals and entities, as designated for such measures by the Committee established pursuant to paragraph 19 of this resolution, as responsible for or complicit in, or having engaged in, directly or indirectly, actions that threaten the peace, security or stability of Haiti; 16. Decides that such actions as described in paragraph 15 above include, but are not limited to: a. Engaging in, directly or indirectly, or supporting criminal activities and violence involving armed groups and criminal networks that promote violence, including forcible recruitment of children by such groups and networks, kidnappings, trafficking in persons and the smuggling of migrants, and homicides and sexual and gender-based violence; b. Supporting illicit trafficking and diversion of arms and related materiel, or illicit financial flows related thereto; c. Acting for or on behalf of or at the direction of or otherwise supporting or financing an individual or entity designated in connection with the activity described in subparagraphs (a) and (b) above, including through the direct or indirect use of the proceeds from organized crime, including proceeds from illicit production and trafficking in drugs and their precursors originating in or transiting through Haiti, the trafficking in persons and the smuggling of migrants from Haiti, or the smuggling and trafficking of arms to or from Haiti; d. Acting in violation of the arms embargo established in paragraph 11 of this resolution, or as having directly or indirectly supplied, sold, or transferred to armed groups or criminal networks in Haiti, or as having been the recipient of, arms or any related materiel, or any technical advice, training, or assistance, including financing and financial assistance, related to violent activities of armed groups or criminal networks in Haiti; e. Planning, directing, or committing acts that violate international human rights law or acts that constitute human rights abuses, including those involving extrajudicial killing, including of women and children, and the commission of acts of violence, abduction, enforced disappearances, or kidnappings for ransom in Haiti; f. Planning, directing or committing acts involving sexual and gender-based violence, including rape and sexual slavery, in Haiti; g. Obstructing delivery of humanitarian assistance to Haiti or access to, or distribution of, humanitarian assistance in Haiti; h. Attacking personnel or premises of United Nations missions and operations in Haiti, providing support for such attacks; 17. Demands that States ensure that all measures taken by them to implement this resolution comply with their obligations under international law, including international humanitarian law, international human rights law and international refugee law, as applicable; 18. Decides that the individual listed in the annex of this resolution shall be subject to the measures imposed by paragraphs 3, 6 and 11 above;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 19 Sanctions Committee 19. Decides to establish, in accordance with rule 28 of its provisional rules of procedure, a Committee of the Security Council consisting of all the members of the Council (herein “the Committee”), to undertake the following tasks: a. To monitor implementation of the measures imposed in paragraphs 3, 6, and 11 above with a view to strengthening, facilitating and improving implementation of these measures by Member States, and to consider and decide upon requests for exemptions set out in paragraph 5 and 7 of this resolution; b. To seek and review information regarding those individuals and entities who may be engaging in the acts described in paragraph 15 and 16 above; c. To designate individuals and entities to be subject to the measures imposed in paragraphs 3, 6, and 11 above; d. To establish and promulgate such guidelines as may be necessary to facilitate the implementation of the measures imposed above; e. To report within 60 days to the Security Council on its work with its observations and recommendations, in particular on ways to strengthen the effectiveness of the measures imposed by paragraphs 3, 6, and 11 of this resolution and thereafter to report on an annual basis; f. To encourage a dialogue between the Committee and interested Member States, in particular those in the region, including by inviting representatives of such States to meet with the Committee to discuss implementation of the measures; g. To seek from all States whatever information it may consider useful regarding the actions taken by them to implement effectively the measures imposed; h. To examine and take appropriate action on information regarding alleged violations or non-compliance with the measures contained in paragraphs 3, 6, and 11; 20. Directs the Committee to cooperate with other relevant Security Council Sanctions Committees; Reporting 21. Requests the Secretary-General to create for an initial period of 13 months, in consultation with the Committee, a group of 4 experts (“Panel of Experts”), under the direction of the Committee and to make the necessary financial and security arrangements to support the work of the Panel, and decides that the Panel shall carry out the following tasks: a. Assist the Committee in carrying out its mandate as specified in this resolution, including through providing the Committee at any time with information relevant to the potential designation at a later stage of individuals and entities who may be engaging in the activities described in paragraphs 15 and 16 above; b. Gather, examine and analyze information from States, relevant UN bodies, regional organizations and other interested parties regarding the implementation of the measures decided in this resolution, in particular incidents regarding the source and routes of arms trafficking to Haiti and incidents of undermining the political transition; c. Provide to the Council, after discussion with the Committee, an interim report by 15 March 2023, a final report no later than 15 September 2023, and periodic updates in between; d. To assist the Committee in refining and updating information on the list of individuals and entities subject to measures imposed pursuant to paragraphs 3, 6, and 11 of this resolution, including through the provision of identifying information and additional information for the publicly available narrative summary of reasons for listing; 22. Directs the Panel to cooperate with BINUH, the UNODC, CARICOM and relevant expert groups established by the Security Council to support the work of its Sanctions Committees, as appropriate; 23. Urges all parties and all Member States, as well as international, regional and subregional organizations to ensure cooperation with the Panel of Experts and further urges all Member States involved to ensure the safety of the members of the Panel of Experts and unhindered access, in particular to persons, documents and sites in order for the Panel to execute its mandate; 24. Notes that the selection process of the experts composing the Panel should prioritize appointing individuals with the strongest qualifications to fulfil the duties described above while paying due regard to the importance of regional and gender representation in the recruitment process;20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Review 25. Affirms that it shall keep the situation in Haiti under continuous review and that it shall be prepared to review the appropriateness of the measures contained in this resolution, including the strengthening, modification, suspension or lifting of the measures, as may be needed at any time in light of progress achieved on the following key benchmarks: a. When the Government of Haiti has developed adequate judicial and rule of law capacity to handle armed groups and criminal-related activities; b. Progressive reduction in the amount of violence committed by armed groups and criminal networks, including the number of intentional homicides, kidnappings and incidents of sexual and gender-based violence, as measured on an annual basis, beginning over the initial period of twelve months from adoption of this resolution; c. Progress on benchmarks 2, 3, 4, and related targets as outlined in the Secretary-General’s report of 13 June 2022 (S/2022/481); d. Progressive decrease in the number of incidents of illicit trafficking and diversion of arms, as well as illicit financial flows there from, including by increasing the number and volume of arms seizures, as measured on an annual basis, beginning over the initial period of twelve months from adoption of this resolution; 26. Requests in this regard the Secretary-General, in close coordination with the Panel of Experts, to conduct, no later than 15 September 2023, an assessment of progress achieved on the key benchmarks established in the paragraph above; 27. Invites the UNODC to work with BINUH and the Panel of Experts, as appropriate, and to report to the Committee on recommendations to stem illicit financial flows and trafficking and diversion of arms related materiel in Haiti; 28. Decides to remain actively seized of the matter. Annexure II United Nations Security Council Resolution S/RES/2699 (2023) Adopted by the Security Council at its 9430th meeting, on 2 October, 2023 The Security Council, Recalling all its previous resolutions and press statements, and reaffirming resolution 2692 (2023), on the situation in Haiti, Reaffirming its strong commitment to the sovereignty, independence, territorial integrity and unity of Haiti, Emphasizing that the Government of Haiti has the primary responsibility for the provision of security, ensuring stability and respect for the rule of law and human rights, and for the protection of civilians across the territory of Haiti, and expressing great concern at the increasingly violent actions taken by armed groups and criminal networks, Reaffirming the importance of a professional, self-sustaining, fully functioning Haitian National Police of adequate size, structure and equipment, able to conduct the full spectrum of police functions, for the maintenance of public safety, respect for human rights, consolidation of democracy and the revitalization of Haiti’s system of justice and encouraging Haiti to pursue actively its plans in these respects, Condemning in the strongest terms the increasing violence, criminal activities, and human rights abuses and violations which undermine the peace, stability, and security of Haiti and the region, including kidnappings, sexual and gender- based violence, trafficking in persons and the smuggling of migrants, homicides, extrajudicial killings, as well as arms smuggling, Strongly condemning and expressing deep concern over the gravity and numbers of violations and abuses committed against children in Haiti; and urging all actors, especially gangs and criminal networks, to immediately end and prevent all violations and abuses against children, including those involving killing and maiming, recruitment and use, rape and other forms of sexual and gender-based violence, particularly against girls, attacks on schools and hospitals, abduction, and denial of humanitarian access, Urging all actors, including Haitian gangs and their supporters, to cease their destabilizing and criminal activities, and further urging those with the ability to influence the gangs to act to stop the blocking of roads required for the supplying of and access to local markets and the damaging of sources of food, including crops supplies, Recalling its resolution 2653 (2022), which established sanctions measures in response to the threat to international peace and security in the region posed by the high levels of gang violence and other criminal activities, as well as of illicit arms and financial flows, and further recalling resolution 2664 (2022) which supersedes the asset freeze exception set forth in paragraph 10 of resolution 2653, Reaffirming the commitment of the international community to address the security and humanitarian needs in Haiti, including through offering continued support to the United Nations Integrated Office in Haiti (BINUH), Stressing that addressing the root causes of instability in Haiti requires political solutions, and in this regard further emphasizing the urgent need to encourage wider participation and forge the broadest possible consensus in the political process, with, as soon as necessary security conditions are met, a view to holding transparent, inclusive, and credible electoral processes and free and fair elections, and restoring democratic institutions, Reiterating the need for all Haitian stakeholders, including with BINUH’s support, to continue to facilitate a Haitian- led, Haitian-owned political process to permit the organization of free and fair legislative and presidential elections, with the full, equal, meaningful, and safe participation of women and the engagement of youth, civil society, and other relevant stakeholders through an inclusive inter-Haitian national dialogue, and further requests all Haitian stakeholders to urgently reach an agreement on a sustainable, time-bound and commonly accepted roadmap for elections, Taking note of the recent visits by the Eminent Persons Group of Caribbean Community (CARICOM) to Haiti and welcoming its continued commitment to supporting the political dialogue, Recognizing the key role of countries in the region, as well as regional and subregional organizations such as the Caribbean Community (CARICOM), and other international partners, in particular the key role of CARICOM and its Eminent Persons Group in facilitating the political dialogue, and calling on the international community to remain committed to Haiti’s efforts in overcoming the ongoing political stalemate and security and humanitarian situation, Taking note of the direct appeal of 6 October 2022 of Haiti’s Council of Ministers for the deployment of a specialized international force and technical assistance to support the Haitian National Police’s efforts to address high levels of gang violence and re-establish security, further taking note of the letter dated 8 October 2022 of the Secretary-General (S/2022/747), the report of the Secretary- General (document S/2023/274) dated 14 April 2023, and Jamaican statement on behalf of CARICOM before the Security Council on 6 July 2023 to authorize multinational security efforts with the appropriate mandate to support the Haitian National Police, Gravely concerned by the continued and significant deterioration of the humanitarian situation in Haiti, including the forced displacement of persons, and urging all parties to immediately cease violations and abuses, Taking note of the need to coordinate, as appropriate, with BINUH and UNODC to reduce gang and community violence, as well as to ensure respect for human rights and build child protection capacity, and the need to further strengthen training efforts by BINUH and international partners to expand the overall capacities of the national police beyond security operations, including expanding the number of national police officers, continued vetting, enhancing community-oriented policing skills, strengthening capacity to prevent and respond to sexual and gender-based violence, ensuring the full, equal, and meaningful involvement and representation of women at all levels, ensuring respect for the rule of law, and restoring police stations that have been destroyed in gang-controlled areas, Underscoring the need for broader efforts beyond the work of the Multinational Security Support (MSS) mission to sustainably address the root causes of gang violence, which Government of Kenya to positively consider leading a multinational mission at the invitation of Haiti and in response to the appeal by the UN Secretary-General, following consultations with Haiti and the unanimous encouragement of security support to Haiti by the Security Council in resolution 2692 (2023), and further welcoming the positive responses to participate made by several Member States, Taking note of the letter dated 26 September 2023 from the Secretary-General addressed to the President of the Security Council (S/2023/726), strongly expressing the desire to obtain authorization from the Security Council under22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Chapter VII, and which expresses hope, following an assessment visit by a Kenyan delegation, that the Multinational Security Support mission would help ensure the security of the country’s critical infrastructure and would be able to carry out targeted operations, in close collaboration with the Haitian National Police, Recognizing the importance and urgency of curbing the illicit trafficking of arms and ammunition to Haiti to the creation of a safe operating environment for international security support, including the deployment of a multinational security support mission, Taking note of the call made by the Government of Kenya on 21 September 2023 urging the United Nations to urgently deliver an appropriate framework to facilitate the deployment of Multinational Security Support as part of a holistic response to Haiti’s challenges, calling on the Security Council to approve a resolution under Chapter VII that tailors the security support mission to the specific needs of Haiti and its people, Determining that the situation in Haiti continues to constitute a threat to international peace and security and to stability in the region, Acting under Chapter VII of the Charter of the United Nations, 1. Authorizes Member States that have notified the Secretary-General of their participation to form and deploy a Multinational Security Support (MSS) mission with a lead country, in close cooperation and coordination with the Government of Haiti, for an initial period of twelve months following the adoption of this resolution, to be reviewed nine months after the adoption of this resolution, on the understanding that the cost of implementing this temporary operation will be borne by voluntary contributions and support from individual Member States and regional organizations, and in strict compliance with international law, including, international human rights law, as applicable, to support the efforts of the Haitian National Police to re -establish security in Haiti and build security conditions conducive to holding free and fair elections, by: (a) providing operational support to the Haitian National Police, including building its capacity through the planning and conduct of joint security support operations, as it works to counter gangs and improve security conditions in Haiti, characterized by kidnappings, sexual and gender-based violence, trafficking in persons and the smuggling of migrants and arms, homicides, extrajudicial killings, and recruitment of children by armed groups and criminal networks; and (b) providing support, to the Haitian National Police, for the provision of security for critical infrastructure sites and transit locations such as the airport, ports, schools, hospitals and key intersections; 2. Calls on the MSS, through its support to the Haitian National Police outlined in paragraph 1, to help ensure unhindered and safe access to humanitarian aid for the population receiving assistance; 3. Decides that the Multinational Security Support mission, as requested by Haiti in its letter dated 22 September 2023, in coordination with the Haitian National Police, may, to prevent the loss of life and within the limits of its capacities and areas of deployment, adopt urgent temporary measures on an exceptional basis, which are limited in scope, time bound, proportionate and consistent with the objectives set forth in paragraph 1 above, to help the Haitian National Police maintain basic law and order and public safety, including through arrest and detention, as necessary and in full compliance with international law, including international human rights law, as applicable; and requests the leadership of the Multinational Security Support mission to update the Security Council any measures that may be adopted on this basis; 4. Calls on Member States and regional organizations to contribute personnel, equipment, and necessary financial and logistic resources based upon the urgent needs of the Multinational Security Support mission and invites contributing Member States to inform in writing the leadership of the Multinational Security Support mission, the Security Council and the Secretary-General of their intent to participate in the mission, and further requests Haiti and the leadership of the Multinational Security Support mission to update regularly the Security Council and the Secretary-General of the progress of deployment of relevant personnel and equipment; 5. Authorizes the Member States participating in the Multinational Security Support mission in Haiti to take all necessary measures to fulfil its mandate, strictly adhering to all international law, including international human rights law, as applicable; 6. Requests the Multinational Security Support mission to take fully into account child protection and the protection of other vulnerable groups as a cross- cutting issue throughout its mandate in all the planning and conduct of its operations; 7. Requests Member States participating in the Multinational Security Support mission in Haiti to include dedicated expertise in anti-gang operations, community-oriented policing, children and women’s protection, and preventing and responding to sexual and gender-based violence in a victim-centred manner, and to take necessary action to ensure appropriate conduct and discipline and to prevent sexual exploitation and abuse, including vetting of all personnel and other safe hiring practices, encouraging women’s representation at all levels of the MSS, and[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 predeployment and in-mission awareness training on human rights, child protection, and sexual and gender based violence, and to detect incidents when they occur and ensure a safe survivor- and victim-centred response in cases of such conduct involving their personnel, including through providing safe and accessible complaint mechanisms and timely investigations of all allegations of misconduct, to hold perpetrators accountable, and to repatriate units when there is credible evidence of misconduct, including widespread or systemic sexual exploitation and abuse, by those units; 8. Requests the leadership of the Multinational Security Support mission, in coordination with the government of Haiti and Member States participating in the MSS, to inform the Council, prior to the mission’s full deployment, on information including but not limited to the concept of operations developed in consultations and cooperation with the government of Haiti and Member States participating in the MSS, sequencing of deployment, mission goals and end state, rules of engagement, as well as indicative financial needs to be funded by voluntary contributions, and number of personnel to be deployed; 9. Reaffirms that the rules of engagement and any directives on the use of force are to be developed by the leadership of the Multinational Security Support mission in consultation with Haiti and other Member States participating in the MSS and should be in full respect of Haiti’s sovereignty and in strict compliance with international law, including, international human rights law, as applicable; 10. Requests the Member States participating in the Multinational Security Support mission in Haiti to ensure the highest standards of transparency, conduct and discipline for their contingents operating in the framework of the Multinational Security Support mission in Haiti, to establish a robust compliance mechanism to prevent, investigate, address and publicly report violations or abuses of human rights related to the Multinational Security Support mission in Haiti; 11. Calls on the Multinational Security Support mission to establish an oversight mechanism to prevent human rights violations or abuses, in particular sexual exploitation and abuse as well as to ensure that the planning and conduct of operations during deployment will be in accordance with applicable international law; 12. Requests Member States participating in the Multinational Security Support mission in Haiti to adopt appropriate wastewater management and other environmental controls to guard against the introduction and spread of water-borne diseases, in accordance with The World Health Organization Water Quality: Guidelines, Standards, and Health publication on Assessment of Risk and Risk Management for Water-related infectious diseases from 2001, and in cooperation with Haitian authorities, which bear shared responsibility for guarding against water-borne disease; 13. Requests the Multinational Security Support mission to cooperate with BINUH and relevant UN agencies, including but not limited to UNODC and the Office of the High Commissioner for Human Rights, to support the efforts of the Haitian National Police to re-establish security in Haiti, including efforts by the Haitian National police to combat illicit trafficking and diversion of arms and related materiel and to enhance management and control of borders and ports; 14. Decides that paragraph 11 of resolution 2653 (2022) shall be replaced by the following: “Decides that, for an initial period of one year from the date of adoption of this resolution, all Member States shall take the necessary measures to prevent the direct or indirect supply, sale, or transfer to Haiti, from or through their territories or by their nationals, or using their flag vessels or aircraft of small arms, light weapons, and ammunition, and further decides that this measure shall not apply to: a. The supply, sale, or transfer of small arms, light weapons, or ammunition to the UN or a UN-authorized mission or to a security unit that operates under the command of the Government of Haiti, intended to be used by or in coordination with those entities and intended solely to further the objectives of peace and stability in Haiti; b. Other supplies, sales, or transfers of small arms, light weapons, and ammunition to Haiti as approved in advance by the Committee established pursuant to resolution 2653 (2022) to further the objectives of peace and stability in Haiti;” 15. Calls on all parties in Haiti to cooperate fully with the Multinational Security Support mission in the execution of its mandate and to respect the security and freedom of movement of the Multinational Security Support mission; 16. Requests the Secretary-General to establish a trust fund as a mechanism that can facilitate voluntary contributions to the Multinational Security Support mission to enable and operationalize the mandate; 17. Affirms the Secretary-General may provide logistical support packages to the MSS, when requested by the MSS and MSS donors, subject to the full financial reimbursement to the United Nations through available voluntary contributions, and in full respect of the United Nations Human Rights Due Diligence Policy (HRDDP);24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 18. Requests the leadership of the Multinational Security Support mission to ensure the highest standards of transparency and conduct, and to report every three months once the MSS is operational on the ground, as a part of regular reporting to the Security Council, through the Secretary-General, on the implementation of the resolution, including but not limited to composition of the mission, measures to ensure appropriate conduct and discipline, and to prevent sexual exploitation and abuse; and on investigations of allegations of misconduct and excessive use of force; 19. Requests the Secretary-General to provide as part of the Secretary- General’s regular reporting to the Security Council, no later than nine months following adoption of this resolution, recommendations on possible adaptation of the mandate of the Multinational Security Support mission or its transformation as needed; 20. Requests the leadership of the Multinational Security Support mission to develop a strategy for mission conclusion and withdrawal and include information on that matter in regular reporting to the Security Council; 21. Emphasizes the need for Member States, United Nations organs, bodies and agencies, and other international organizations, including international financial institutions, to redouble their efforts to promote the institutional, social, and economic development of Haiti, in particular for the long-term, in order to achieve and sustain stability and combat poverty; 22. Strongly urges the Haitian authorities and other stakeholders to cooperate fully with the good offices of CARICOM and BINUH to reach compromise for the broadest possible consensus as soon as possible; 23. Decides to remain actively seized of the matter.
