ीकृत संयुक्त राष्ट्र सरु क्षा पररषद के संकल्प 2347(2017) और 2649(2022) के कायाटन्ियन हते ुजनम्नजलजखत अदिे दते ी ह,ै ऄथाटत् : - 1. सजं क्षप्त नाम और प्रारंभ.- (1) आस अदिे का संजक्षप्त नाम माली अदेि, 2022 पर संयुक्त राष्ट्र सुरक्षा पररषद संकल्पों का कायाटन्ियन ह।ैं (2) यह राजपत्र में आसके प्रकािन की तारीख से प्रिृत्त होगा। 2. पररभाषाएँ - (1) आस अदेि में, जब तक दक संदभट से ऄन्यथा ऄपेजक्षत न हो,- (क) "अजस्ट्त ऄिरोधन" से ईक्त संकल्प 2374 (2017) के 4, 5, 6 और 7 के ऄनुसरण में केंद्रीय सरकार द्वारा जनजधयों, ऄन्य जित्तीय संसाधनों और अर्थथक संसाधनों को रोकना या प्रजतबंजधत करना या जिजनयजमत करना ऄजभप्रेत ह;ै (ख) "सजमजत" से संकल्प 2374 (2017) के पैरा 9 के ऄनुसार संयुक्त राष्ट्र सुरक्षा पररषद द्वारा स्ट्थाजपत प्रजतबंध सजमजत ऄजभप्रेत ह;ै (ग) "संकल्प" से 5 जसतंबर, 2017 को ऄंगीकृत संयुक्त राष्ट्र सुरक्षा पररषद संकल्प 2374 (2017) ऄजनप्रेत ह ै और जजसमे माली पर संयुक्त राष्ट्र के चार्टर के ऄध्याय 7 के ऄधीन सरु क्षा पररषद द्वारा ऄगं ीकृत संकल्प 2432(2018), 2484(2019), 2541(2020), 2590(2021) और भाग रूप म ेंजिचार दकया जाएगा। (घ) "यात्रा प्रजतबंध" से संकल्प 2374 (2017) के पैरा 1, 2 और 3 के ऄनुसरण म ें केंद्रीय सरकार द्वारा यथा: ऄजधरोजपत यात्रा प्रजतबंध या जनबटधनं ऄजभप्रेत ह।ै (2) ईन िब्दों और तीव्रता के बारे म ें ऄपनी गंभीर लचता व्यक्त करत ेहुए , यह जोर दतेे हुए दक माली में सुरक्षा और जस्ट्थरता सहले और पजिम ऄफ्रीका क्षेत्रों के साथ-साथ लीजबया और ईत्तरी ऄफ्रीका क्षेत्र की जस्ट्थजत से ऄर्ूर् तस्ट्करी, प्रिाजसयों की तस्ट्करी, व्यजक्तयों की तस्ट्करी सजहत आसके बढ़ते संपकट, कुछ मामलों म,ें अतंकिाद आन खतरों और चनु ौजतयों से जनपर्ने में क्षेत्र के देिों की जजम्मेदारी को रेखांदकत करत ेहुये, यह देखते हुए दक ईन्मुजक्त भ्रष्टाचार की संस्ट्कृजत को प्रोत्साजहत कर सकती ह ै जजसमें तस्ट्करी और ऄन्य अपराजधक जहत फल-फूल सकत े ह,ैं और आससे अग े ऄजस्ट्थरता और ऄसरु क्षा बढ़ सकत े ह ैं और माली सरकार स े आस संबंध में ईजचत कानून प्रितटन संसाधनों को समर्थपत करने और ऄंतराटष्ट्रीय, क्षेत्रीय और ईप-क्षेत्रीय सहयोग को प्रोत्साजहत करने का अह्िान कर सकते ह।ैं और आस प्रयास म ेंमाजलयान सरकार का सहयोग करने पर जोर दते े हुए माली और साहले क्षेत्र में अतकं िादी संगठनों की गजतजिजधयों की कड़ी लनदा करते हुये, जजसमें मौिेमेंर् पोर ल'यूजनजसर्े एर् ल ेजजहाद एन ऄफ्रीक डे ल'ओएस्ट्र् (एमयूजएे ओ), ऄल-कायदा आन द आस्ट्लाजमक मगरेब (एक्यअू इएम), ऄल- मौराजबर्ौं िाजमल ह ैं। ऄसं ार आडजडन े , और संबद्ध व्यजक्त और जमात जैसे समूह नुसरत ऄल-आस्ट्लाम िाल-मुजस्ट्लजमन (आस्ट्लाम और मुसलमानों के समथटन िाल े समूह), आस्ट्लाजमक स्ट्र्ेर् आन ग्रेर्र सहारा और ऄसं ारौल आस्ट्लाम, जो माली म ें कायटरत ह ैं और आस क्षेत्र में िाजं त और सरु क्षा के जलए खतरा पैदा करते ह ैं तथा साथ ही साथ नागररकों, जििेष रूप से मजहलाओं और बच्चों के मानिाजधकारों का हनन और लहसा करत े ह ै और अतंकिादी समूह माली तथा आस क्षेत्र म ें लहसक कायट को ऄंजाम देत ेह ैं संकल्प 1267 (1999), 1989 (2011) और 2253 (2015) के ऄनुसरण म ें आस्ट्लाजमक मघरीब ऄंसार एडजडनी में ऄल-कायदा के संगठन मुजाओ और आसके नेता आयाद ऄग घाली और अइएसअइएल ( दा'एि ) पर ऄल - मौराजबतून की प्रजतबंध सूची को स्ट्मरण करत ेहुए और ईपयुटक्त िासन के तहत ऄन्य ऐसे व्यजक्तयों, समूहों, ईपक्रमों और संस्ट्थाओं पर स्ट्थाजपत जललस्ट्र्ग मानदडं के ऄनुसार प्रजतबंध लगान े की ऄपनी तत्परता को दोहरात ेहुए , जो अइएसअइएल (दा'एि), ऄल-कायदा और ऄन्य सूचीबद्ध संस्ट्थाओं या व्यजक्तयों से जड़ु े ह,ैं जजनमें एक्यूअइएम, ऄल मौराजबर्ून और ऄंसार एडजडनी िाजमल ह।ैं नागररकों, माली रक्षा और सुरक्षा बलों, माली में संयक्तु राष्ट्र बहुअयामी एकीकृत जस्ट्थरीकरण जमिन (एमअइएनयूएसएमए) और फ्रांसीसी बलों के जिरुद्ध अतकं िादी हमलों की कड़ी लनदा करत ेहुए और ऄपराजधयों, अयोजकों, फाआनेंसरों और प्रायोजकों को न्याय के कर्घरे म ें लाने की अिश्यकता को रेखादंकत करत ेहुय,े अतंकिाद के लनदनीय कृत्य, और माली सरकार से आन हमलों के जलए जजम्मेदार लोगों को जिाबदेह ठहराया जाना सुजनजित करन े के जलए ईपाय करने का अग्रह करते हुय े धन ईगाहन े या राजनीजतक राहत प्राप्त करन े के प्रयोजन से ऄपहरण और बंधक बनाने की घर्नाओं की कड़ी लनदा करते हुए , साहले क्षेत्र में ऄपहरण और बंधक बनान े से रोकने और दफरौती के भुगतान या राजनीजतक राहत के जबना बंधकों की सुरजक्षत ररहाइ सुजनजित करन े के ऄपन े दढ़ृ संकल्प को दोहरात ेहुए , लाग ू ऄंतरराष्ट्रीय कानून के ऄनुसार, ऄपन े संकल्प 2133 (2014), 2253 (2015) और 2368 (2017) को स्ट्मरण करत े हुए और सभी सदस्ट्य देिों स े अतंकिाददयों को प्रत्यक्ष या ऄप्रत्यक्ष रूप स े दफरौती के भगु तान से या राजनीजतक ऄपहरण पर रोक लगान े और ऄस्ट्िीकार करने की बेहतर पररपार्ी पर ऄल्जीयसट मेमोरेंडम" को ध्यान में रखत े हुए माली म ें मानिाजधकारों के सभी प्रकार के हनन और ईल्लघं नों और ऄतं राष्ट्रट ीय मानितािादी कानून के ईल्लघं नों की कड़ी लनदा करत ेहुये, जजसमें न्याजयक प्रदक्रया के जबना हत्या और मनमानी हत्या, मनमानी जगरफ्तारी और जहरासत और ईन लोगों के साथ दव्यु टिहार जजनकी अजादी पर रोक लगाइ गइ ह,ै मजहलाओं के जिरुद्ध यौन लहसा और आसके साथ- साथ बच्चों की हत्या, जिकलांगता, ईनको भती करना और स्ट्कूलों तथा ऄस्ट्पतालों के जखलाफ हमल े िाजमल ह ैं और सभी पक्षों स ेअह्िान करत ेह ैं दक ि े ऄंतरराष्ट्रीय मानिीय कानून के ऄनुसार स्ट्कूलों के नागररक चररत्र का सम्मान करें और सभी बच्चों की गैरकानूनी और मनमानी जहरासत पर रोक लगाएँ और सभी पक्षकारों पर आस तरह के ईल्लंघनों और दव्यु टिहारों को बंद करन े और लाग ूऄतं रराष्ट्रीय कानून के तहत ऄपन ेदाजयत्िों का पालन करने का अिाहन करते हुये6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सभी पक्षकारों को मानिता, तर्स्ट्थता, जनष्पक्षता और स्ट्ितंत्रता के मानिीय जसद्धांतों को बनाए रखने और सम्मान करने की अिश्यकतापर जोर देत ेहुए तादक मानिीय सहायता के जलए जनरंतर प्रािधान सुजनजित दकए जायें और सहायता लेन े िाल े नागररकों और माली में कायटरत मानिीय कर्थमयों की सुरक्षा और जहफाजत सुजनजित दकए जाय,ें अिश्यकता के अधार पर दी जा रही मानिीय सहायता के महत्ि पर जोर दते ेहुए और यह दोहरात ेहुए दक, दक सभी पक्षकारों को माली में सभी जरूरतमंद लोगों को समय पर सहायता प्रदान करने के जलए पणू ,ट सुरजक्षत और ऄबाध ऄनुमजत और सुजिधा प्रदान करनी चाजहए, सांस्ट्कृजतक जिरासत को नष्ट करने और सांस्ट्कृजतक संपजत्त की तस्ट्करी और संबंजधत ऄपराधों म ें गरै -सरकारी व्यजक्तयों, जििेष रूप से अतंकिादी समूहों की भागीदारी को गंभीर लचता के साथ नोर् करते हुए और अगे आस तथ्य पर ध्यान रखते हुए दक 27 जसतंबर 2016 को अइसीसी ने श्री ऄल महदी को रर्म्बकर्ू में धार्थमक और ऐजतहाजसक स्ट्मारकों पर जानबूझकर हमल ेकरन े के युद्ध ऄपराध का दोषी पाया ह,ै माली के ईत्तर में अतंकिाद के खतरे को रोकन े के जलए, माली के ऄजधकाररयों के ऄनुरोध और ईनके समथटन म ें फ्रांसीसी सेना द्वारा जारी कारटिाइ का स्ट्िागत करत ेहुए, जी 5 सहले दिे ों की संयुक्त सने ा (एफसी-जी5एस) की तनै ाती का स्ट्िागत करते हुए, माली को जस्ट्थर करने हते ु मीनूसमा के ऄजधदेि को पूरा करने के जलए सहयोग करन े की दजृ ष्ट से साहले क्षेत्र में ऄजधक सुरजक्षत िातािरण बनान े म ें योगदान देने के जलए एफ़सी-जी5 के अतंकिादी समूहों और ऄन्य संगरठत अपराजधक समूहों की गजतजिजधयों से जनपर्ने के प्रयास रेखांदकत करत े हुए माजलयाइ रक्षा और सुरक्षा बलों के जलए प्रजिक्षण और सलाह प्रदान करने म ें माली म ें यरू ोपीय संघ प्रजिक्षण जमिन (इयूर्ीएम माली) की भजू मका की प्रिंसा करते हुये, जजसमें नागररक ऄजधकार और मानिाजधकारों के प्रजत सम्मान को मजबूत बनान े और माली में पुजलस, जेंडरमेरी और गाडे राष्ट्र के जलए रणनीजतक सलाह और प्रजिक्षण प्रदान करन े में यूरोपीय सघं क्षमता जनमाटण जमिन (इयूसीएपी सहले माली) म ेंयोगदान िाजमल ह,ै संकल्प 2364 (2017) में ईजल्लजखत मीनूसमा के ऄजधदेि को स्ट्मरण करते हुए, माली के महासजचि के जििेष प्रजतजनजध के जलए ऄपने मजबतू समथटन को दोहरात े हुए और मीनूसमा के जलए माली के ऄजधकाररयों और माली के लोगों को स्ट्थायी िांजत लाने के ईनके प्रयासों में सहायता करन े और देि के जलए जस्ट्थरता, जनसंख्या की रक्षा के जलए माली के ऄजधकाररयों की प्राथजमक जजम्मेदारी को ध्यान में रखते हुए और माली म ें ऄतं राटष्ट्रीय ईपजस्ट्थजत जजसमें मीनूसमा िाजमल ह,ै के जस्ट्थर प्रभाि का स्ट्िागत करते हुए, आस करार के ईपबंधों का स्ट्मरण करत ेहुये और आसके कायाटन्ियन की बारीकी से जनगरानी करन े और, यदद अिश्यक हो, तो आसम ें जनजहत प्रजतबद्धताओं के कायाटन्ियन में बाधा डालन े िाले या आसके ईद्देश्यों की प्राजप्त में बाधा डालन े िाले दकसी भी व्यजक्त के जखलाफ ईपाय करने का अह्िान करने के जलए सुरक्षा पररषद से करार को ऄपना पूण ट समथटन देन े का अिाहन करते हुय,े सुरक्षा पररषद के संकल्प 2364 (2017) के ईन प्रािधानों को स्ट् मरण करते हुए जो ईन लोगों के जिरुद्ध लजक्षत प्रजतबंधों पर जिचार करने के जलए जो आस करार के कायाटन्ियन में बाधा डालने या धमकी दने े का कायट करते ह,ैं जो दफर स े ित्रुता पणू ट अचरण करत े ह ैं और सघं ष ट जिराम का ईल्लंघन करत े ह,ैं जो मीनूसमा को जोजखम म ें डालन े के जलए और ऄन्य ऄंतराष्ट्रट ीय ईपजस्ट्थजतयों के साथ-साथ हमला करत े ह ैंऔर हमल ेकी कारटिाइ करत े ह ैं ऐसे हमलों और कारटिाआयों को समथटन प्रदान करते ह ैं सुरक्षा पररषद के ऄध्यक्ष को माली सरकार के 9 ऄगस्ट्त 2017 के पत्र को ध्यान में रखते हुए जजसमें जून 2017 की िुरुअत से संघष ट जिराम के बार-बार ईल्लंघन के मसले को रेखांदकत दकया गया ह,ै जििेष रूप से जो दकडल क्षेत्र में आस करार को लागू करने के जलए दकए गए लाभ के जलए गंभीर खतरा पैदा करते ह ैंऔर आस प्रकार से सुरक्षा पररषद से ऄनरु ोध करता ह ै की आस करार के कायाटन्ियन में अइ बाधाओं को दरू दकया जाए तादक आस करार के कायाटन्ियन में बाधा डालने के जलए जजम्मेदार लोगों के जखलाफ लजक्षत प्रजतबंधों का एक िासन स्ट्थाजपत दकया जाए, यह जनधाटररत करत ेहुए दक माली की जस्ट्थजत क्षेत्र में ऄंतराटष्ट्रीय िांजत और सुरक्षा के जलए खतरा बनी हुइ ह,ै संयुक्त राष्ट्र चार्टर के ऄध्याय 7 के ऄधीन कायट करते हुये,[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 7 यात्रा पर प्रजतबधं 1. यह जनणटय करता ह ै दक, आस संकल्प को ऄंगीकार करने की तारीख से एक िषट की प्रारंजभक ऄिजध के जलए, सभी सदस्ट्य राष्र जनम्न जलजखत पैरा 9 के ऄनुसरण म ें स्ट्थाजपत सजमजत द्वारा नामजनर्ददष्ट व्यजक्तयों के ऄपन े क्षेत्रों में प्रिेि या पारगमन को रोकने के जलए अिश्यक ईपाय करेंग,े परंतु आस पैरा में कुछ भी राष्र को ऄपने नागररकों को ऄपने क्षेत्र म ें प्रिेि करन े से मना करन ेके जलए बाध्य नहीं करेगा; 2. यह जिजनिय दकया गया ह ै दक ईपरोक्त पैरा 1 में ऄजधरोजपत ईपाय जनम्नजलजखत के सम्बन्ध म ेलागू नहीं होंग े: (क) जहां सजमजत मामला-दर-मामला अधार पर जनधाटररत करती ह ै दक धार्थमक दाजयत्ि सजहत मानिीय अिश्यकता के अधार पर ऐसी यात्रा न् यायसंगत ह;ै (ख) जहा ंन्याजयक प्रदक्रया की पूर्थत के जलए प्रिेि या पारगमन अिश्यक ह;ै (ग) जहां सजमजत मामला-दर-मामला अधार पर यह जनधाटररत करती ह ै दक यह छूर् माली में िांजत और राष्ट्रीय सुलह और क्षेत्र म ेंजस्ट्थरता के ईद्देश्यों को अग ेबढ़ाएगी; 3. आस बात पर बल देत ेहुए दक आस यात्रा प्रजतबंध का ईल्लंघन माली की िांजत, जस्ट्थरता या सुरक्षा को कमजोर कर सकता ह,ै नजर रखता ह ै दक यात्रा प्रजतबंध के ईल्लंघन में दकसी सूचीबद्ध व्यजक्त की यात्रा को जानबूझकर सुजिधा प्रदान करन े िाल े व्यजक्तयों को सजमजत द्वारा पदनाम मानदंडों को पूरा करन े के जलए जनधाटररत दकया जा सकता ह ै और सभी पक्षकारों और सभी सदस्ट्य राष्ट्रों से यात्रा प्रजतबधं के कायाटन्ियन के जलए जनम्नजलजखत पैरा 11 के ऄनुसार स्ट्थाजपत सजमजत के साथ-साथ जििेषज्ञों के पैनल के साथ सहयोग करन े का अह्िान करता ह;ै अजस्ट्त ऄिरोधन 4. यह जिजनिय दकया गया ह ैदक, आस संकल्प को ऄगं ीकार करन े की तारीख स े एक िष ट की प्रारंजभक ऄिजध के जलए सभी सदस्ट्य राष्र ऄजिलंब सभी जनजधयों, ऄन्य जित्तीय संपजत्तयों और अर्थथक संसाधनों का ऄिरोधन करेंगे, जो ईनके क्षेत्र में ह,ैं जो, प्रत्यक्ष या परोक्ष रूप से, सजमजत द्वारा नाजमत व्यजक्तयों या संस्ट्थाओं द्वारा, या ईनकी ओर स े या ईनके जनदेि पर कायट करन े िाले व्यजक्तयों या संस्ट्थाओं के स्ट्िाजमत्ि या जनयंत्रणाधीन ह,ैं और आसके ऄजतररक्त यह जिजनिय दकया गया ह ैदक सभी सदस्ट्य राष्र यह सुजनजित करेंग े दक कोइ भी धन, जित्तीय संपजत्त या अर्थथक संसाधनों को ईनके नागररकों द्वारा या ईनके क्षेत्र के भीतर दकसी भी व्यजक्त या संस्ट्थाओं द्वारा प्रत्यक्ष या ऄप्रत्यक्ष रूप से या सजमजत द्वारा नाजमत व्यजक्तयों या संस्ट्थाओं के लाभ के जलए ईपलब्ध कराने से रोका जाए; 5. यह जिजनिय दकया गया है दक ईपरोक्त परै ा 4 द्वारा लगाए गए ईपाय जनजधयों, ऄन्य जित्तीय संपजत्तयों या अर्थथक संसाधनों पर लागू नहीं होते ह ैंजो संबंजधत सदस्ट्य राष्ट्रों द्वारा जनधाटररत दकए गए ह:ैं (क) सजमजत द्वारा संबंजधत राष्र को जहां ईपयक्तु हो, ऐसी जनजधयों, ऄन्य जित्तीय संपजत्तयों या अर्थथक संसाधनों तक पहुचं करने के जलए ऄजधकृत करन े की ऄजधसूचना के बाद और ऐसी ऄजधसूचना जारी होने के पांच कायट ददिसों के भीतर सजमजत के नकारात्मक जनणटय के ऄभाि में अिश्यक बुजनयादी खचों के जलए प्रािधान करना, जजसमें खाद्य पदाथट, दकराया या मोरगेज, दिाओं और जचदकत्सा ईपचार, कर, बीमा प्रीजमयम और सािटजजनक ईपयोजगता िल्ु क भुगतान या जििेष रूप से युजक्तसगं त पेिेिर िल्ु क के जलए भुगतान और राष्ट्रीय कानूनों के ऄनुसार कानूनी सेिाओं से जुड़े खचों की प्रजतपूर्थत या िल्ु क या सेिा िुल्क, फ्रीज जनजध, ऄन्य जित्तीय संपजत्तयों और अर्थथक संसाधनों का जनयजमत रूप स ेरखरखाि करना िाजमल ह;ै (ख) ऄसाधारण खचों के जलए अिश्यक होना, बित े दक आस तरह के जनधाटरण को संबंजधत राष्ट्र या सदस्ट्य राष्ट्रों द्वारा सजमजत को ऄजधसूजचत दकया गया हो और सजमजत द्वारा ऄनुमोददत दकया गया हो; (ग) दकसी न्याजयक प्रिासजनक ऄथिा मध्यस्ट्थता और जनणटय का जिषय होना जजस मामले म ें राजि, ऄन्य जिजत्तय पररसंपजत्तयाँ और अर्थथक संसाधनों का प्रयोग जलयेन ऄथिा जनणटय को सुजनजित करन े हते ु दकया जाए बिते की यह जलयेन ऄथिा जनणटय ितटमान संकल्प की तारीख से पहल े प्रभािी हुअ हो तथा यह सजमजत द्वारा नाजमत दकसी व्यजक्त ऄथिा जनकाय के लाभ के जलए न हो तथा सजमजत से संबंजधत राष्ट्र ऄथिा सदस्ट्य क्षत्रे में जस्ट्थरता के ईद्देश्यों को अगे बढ़ाएगी; 6. यह जिजनिय दकया गया ह ै दक सदस्ट्य राष्ट्र उपर ददए गए पैरा 4 के ईपबंधों के ऄनुसार रोक लगाए गए खातों में ब्याज या ईन खातों पर देय ऄन्य अय या ऄनुबंधों के ऄधीन देय भुगतानों को जोड़ने की ऄनुमजत द े सकते हैं, करार या दाजयत्ि जो ईस जतजथ से पहले ईत्पन्न हुए थे जजस पर िे खाते आस संकल्प के प्रािधानों के ऄधीन हो गए थ,े बित े दक ऐसा कोइ भी ब्याज, ऄन्य अय और आन प्रािधानों के ऄधीन दकये गए भगु तान दकए गए हों और रुके हुए हों ; 7. यह जिजनिय दकया गया ह ै दक ईपयुटक्त पैरा 4 म ें ददए गए ईपाय दकसी नामजनर्ददष्ट व्यजक्त या संस्ट्था को ऐस े व्यजक्त या संस्ट्था की जललस्ट्र्ग से पहल े दकए गए ऄनुबंध के तहत देय भगु तान करन े से नहीं रोकेगा,बिते दक संबंजधत राष्ट्रों ने यह जनधाटररत दकया हो,भुगतान प्रत्यक्ष या ऄप्रत्यक्ष रूप से ईपरोक्त ऄनुच्छेद 4 के गया ह ै दक परै ा 1 म ें जनजहत ईपाय व्यजक्तयों पर लागू होंगे, और यह दक पैरा 4 में जनजहत ईपाय व्यजक्तयों और संस्ट्थाओं पर लागू होंगे, जैसा दक सजमजत द्वारा ऐसे ईपायों के जलए नामजनर्ददष्ट दकया गया है, जो प्रत्यक्ष या ऄप्रत्यक्ष रूप से आसमें िाजमल होन े के जलए ऄजभजहत या सहभागी हैं,जनम्नजलजखत कारटिाआयां या नीजतयां जो माली की िांजत, सरु क्षा या जस्ट्थरता के जलए खतरा हैं: (क) करार के ईल्लघं न में ित्रुता में संलग्न होना; (ख) की गइ कारटिाआयाँ जो बाधा डालती ह,ैं या जो लंबे समय से बाजधत होती ह,ैं या जो करार के कायाटन्ियन को में बाधा डालती ह;ैं (ग) ईपयक्तुट ईप-पैरा (क) और (ख) म ें ऄजभज्ञात व्यजक्तयों और जनकायों की ओर से ऄथिा ईनके जनदेि पर काय ट करना ऄथिा ईनका समथटन और जित्त पोषण करना जजसमें माली म ें ऄिजस्ट्थत ऄथिा पारगमन करने िाले मादक द्रव्यों के ईत्पादन ि ईनकी तस्ट्करी करने िाल े तस्ट्करों सजहत संगरठत ऄपराधों स े प्राप्त राजि भी िाजमल ह,ै स े प्राप्त राजि, मानि तस्ट्करी ऄथिा ऄिैध प्रिास तथा िस्त्रों की तस्ट्करी के साथ साथ सांस्ट्कृजतक पररसंपजत्तयों की तस्ट्करी भी िाजमल ह;ै (घ) योजना, जनदिे न, प्रायोजन, या जनम्नजलजखत के जखलाफ हमलों का संचालन करन े म ें िाजमल होना: (i) करार में संदर्थभत जिजभन्न संस्ट्थाएं, जजनमें स्ट्थानीय, क्षेत्रीय और राज्य संस्ट्थान, संयुक्त गश्त और माजलयन सुरक्षा और रक्षा बल िाजमल ह;ैं (ii) एमअइएनयूएसएमए िांजत सैजनक और ऄन्य संयुक्त राष्ट्र और संबद्ध कमी, जजनमें जििेषज्ञों के पैनल के सदस्ट्य िाजमल ह;ैं (iii) ऄतं राष्ट्रट ीय सुरक्षा ईपजस्ट्थजत जजनम ें एफसी-जी5एस, यूरोपीय सघं जमिनों और फ्रांसीसी बल िाजमल ह ैं; (ङ) माली को मानिीय सहायता प्रदान करन े में बाधा डालना, या माली में मानिीय सहायता तक पहुचँ , या ईनका जितरण करना; (च) माली म ें योजना बनाना, जनदेिन करना या कायट करना जो ऄंतरराष्ट्रीय मानिाजधकार कानून या ऄंतरराष्ट्रीय मानितािादी कानून का ईल्लघं न करता है, जसै ा लागू हो, या जो मानिाजधकारों के हनन या ईल्लघं न का गठन करता ह,ै जजनमें नागररकों को लजक्षत करने िाल े ,मजहलाओं और बच्चों सजहत, लहसा के कृत्यों (हत्या, ऄपंगता, यातना, या बलात्कार या ऄन्य यौन लहसा सजहत), ऄपहरण, जबरन गुमिुदगी, जबरन जिस्ट्थापन, या स्ट्कूलों, ऄस्ट्पतालों, धार्थमक स्ट्थलों, या ईन स्ट्थानों पर हमले जहा ंनागररक हैं, के माध्यम से िरण मांग रह ेह ैंिाजमल ह;ैं (छ) माली में सिस्त्र संघष ट के सदं भट में लाग ूऄंतरराष्ट्रीय कानून के ईल्लंघन में सिस्त्र समूहों या सिस्त्र बलों द्वारा बच्चों का ईपयोग या भती;[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 9 नइ प्रजतबधं सजमजत 9. प्रदक्रया के ऄपन े ऄनंजतम जनयमों के जनयम 28 के ऄनुसार, सरु क्षा पररषद की एक सजमजत जजसमें पररषद के सभी सदस्ट्य (आसमे "सजमजत") िाजमल ह,ैं जनम्नजलजखत कायों को करन े के जलए, स्ट्थाजपत करन े का जिजनिय दकया गया ह ै: (क) ईपरोक्त पैरा 1 और 4 म ेंईजल्लजखत ईपायों के कायाटन्ियन की जनगरानी करना; (ख)ईन व्यजक्तयों के बारे म ें जानकारी की समीक्षा करन े के जलए, और ईपरोक्त परै ा 5 के ऄनसु ार छूर् के ऄनुरोधों पर जिचार करने हते ु ऄनुच्छेद 4 द्वारा ईजल्लजखत ईपायों के ऄधीन ईन व्यजक्तयों और संस्ट्थाओं को नामोदद्दष्ट करना; (ग) ईन व्यजक्तयों के बारे म ेंजानकारी की समीक्षा करन े के जलए, और ईपरोक्त परै ा 2 के ऄनसु ार छूर् के ऄनुरोधों पर जिचार करन े हते ु ऄनच्ु छेद 1 द्वारा ईजल्लजखत ईपायों के ऄधीन ईन व्यजक्तयों को नामोदद्दष्ट करना ; (घ). उपर ईजल्लजखत ईपायों के कायाटन्ियन की सुजिधा हते ु अिश्यक ददिा-जनदेि स्ट्थाजपत करना; (ङ). सजमजत और आच्छुक सदस्ट्य राष्ट्रों और ऄंतरराष्ट्रीय, क्षेत्रीय और ईप क्षेत्रीय सगं ठनों के बीच एक संिाद को प्रोत्साजहत करने के जलए, जििेष रूप से ईन क्षेत्र म,ें जजसमें ईपायों के कायाटन्ियन पर चचाट करने के जलए ऐसे राष्ट्रों या संगठनों के प्रजतजनजधयों को सजमजत से जमलन ेके जलए अमंजत्रत करना िाजमल ह;ै (च) .ईपरोक्त ईपायों को प्रभािी ढंग से लाग ू करन े के जलए सभी राष्ट्रों और ऄंतरराष्ट्रीय, क्षेत्रीय और ईप-क्षेत्रीय संगठनों से ईनके द्वारा की गइ कारटिाआयों के संबंध में ईपयोगी जानकारी प्राप्त करना; (छ) आस संकल्प में िाजमल ईपायों के कजथत ईल्लंघन या गैर-ऄनुपालन के संबंध में जानकारी की जांच करने और ईजचत कारटिाइ करना; 10. ईपरोक्त पैरा 9 में ईजल्लजखत कायों को करन े के जलए सजमजत को सक्षम करने हते ु अिश्यक जित्तीय व्यिस्ट्था करन े के जलए महासजचि से ऄनुरोध करती ह;ै जििषे ज्ञों का पनै ल 11. महासजचि स ेऄनुरोध करते हुए दक आस संकल्प के पाररत होन े स े तेरह महीन े की प्रारंजभक ऄिजध के जलए सजमजत के परामिट से सजमजत के जनदेिन में पाँच जििेषज्ञों ("जििेषज्ञों का पैनल") का एक समूह स्ट्थाजपत दकया जाए और पैनल के काम का समथटन करन े के जलए अिश्यक जित्तीय और सरु क्षा व्यिस्ट्था की जाए, आस संकल्प को पाररत करने के 12 महीने के बाद आस ऄजधदेि के निीकरण पर जिचार करन े का अिय व्यक्त करते हुए, और यह जनणयट लेती ह ैदक पैनल जनम्नजलजखत कायट करेगा: (क) आस संकल्प म ें जनर्ददष्ट के ऄनुसार सजमजत को ऄपन े ऄजधदेि को परू ा करन े में सहायता करना जजसमें सजमजत को बाद के चरण म ें संभाजित पदनाम से संबंजधत जानकारी प्रदान करना िाजमल ह,ै जो ईपरोक्त पैरा 8 म ें िर्थणत गजतजिजधयों में िाजमल हो सकते ह;ैं (ख) जििेष रूप से गरै -ऄनुपालन की घर्नाओं के संबंध में आस संकल्प में तय दकए गए ईपायों के कायाटन्ियन के संबंध में राज्यों, प्रासंजगक संयुक्त राष्ट्र जनकायों, क्षेत्रीय संगठनों और ऄन्य आच्छुक पक्षकारों से जानकारी आकट्ठा करना, जांच और जिश्लेषण करना; (ग) सजमजत के साथ चचाट के बाद पररषद को 1 माचट, 2018 तक एक ऄतं ररम ऄद्यतन ररपोर्ट और 1 जसतंबर, 2018 तक एक ऄंजतम ररपोर्ट और बीच में अिजधक ऄद्यतन ररपोर्ट प्रदान करना; (घ) बायोमेररक जानकारी के प्रािधान के माध्यम स े और सूचीबद्ध करने के कारणों के सािटजजनक रूप से ईपलब्ध सारांि के जलए ऄजतररक्त जानकारी सजहत ईपरोक्त पैराग्राफ 1 और 4 द्वारा लगाए गए ईपायों के ऄधीन व्यजक्तयों की सूची पर सूचना को पररष्कृत और ऄद्यतन करने म ेंसजमजत की सहायता करना; (ङ) आंर्रपोल तथा ड्रग्स और ऄपराध पर संयक्तु राष्ट्र कायाटलय (यूएनओडीसी) के साथ जमलकर सहयोग करना, जहा ँईपयुक्त हो; 12. जििेषज्ञों के पैनल के पास संकल्प 2242 (2015) के पैरा 6 के ऄनुरूप ऄपेजक्षत मजहला-पुरुष जििेषज्ञता रखने का ऄनुरोध करती है;10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 13. यह नोर् दकया गया है दक भती प्रदक्रया म ें क्षेत्रीय और मजहला-पुरुष प्रजतजनजधत्ि के महत्ि को ध्यान म ें रखत े हुए पैनल बनान े िाल े जििेषज्ञों की चयन प्रदक्रया में ईपरोक्त कतटव्यों को पूरा करने के जलए सबसे ऄजधक योग्यता िाल े व्यजक्तयों को जनयुक्त करन े को प्राथजमकता दी जानी चाजहए; 14. सुरक्षा पररषद द्वारा आसकी प्रजतबंध सजमजतयों के कायट में सहायता के जलए स्ट्थाजपत ऄन्य प्रासंजगक जििेषज्ञ समूहों के साथ सहयोग करने के जलए जििेषज्ञों के पनै ल को जनदेजित करते हुए, जजसमें लीजबया से संबंजधत संकल्प 1973 (2011) द्वारा स्ट्थाजपत जििेषज्ञों का पैनल और अइएसअइएल (दा'एि), ऄल-कायदा और ताजलबान और व्यजक्तयों एिं सगं ठनों से संबंजधत संकल्पों 1526 (2004) और 2368 (2017) के ऄनुसरण म ें जिश्लेषणात्मक समथटन और प्रजतबंध जनगरानी दल सजम्मजलत ह;ैं 15. जििेषज्ञों के पैनल के साथ सहयोग सुजनजित करने के जलए सभी पक्षकारों और सभी सदस्ट्य राष्ट्रों, साथ ही ऄंतरराष्ट्रीय, क्षेत्रीय और ईप-क्षेत्रीय संगठनों से अग्रह करत ेहुए और और आसमें िाजमल सभी सदस्ट्य राष्ट्रों स े जििेषज्ञों के पैनल के सदस्ट्यों की सुरक्षा और जििेष रूप से व्यजक्तयों, दस्ट्तािेजों और साआर्ों तक जनबाटध पहुचं सुजनजित करन े का अग्रह करत ेहुए तादक जििेषज्ञों का पैनल ऄपन ेऄजधदिे को जनष्पाददत कर सके; एमअइएनयएू सएमए की भजू मका 16. एमअइएनयूएसएमए और जििेषज्ञों के पैनल के बीच समय पर सूचनाओं के अदान-प्रदान को प्रोत्साजहत करता है, और एमअइएनयूएसएमए को ऄपने जनादिे और क्षमताओं के ऄनुसार सजमजत तथा जििेषज्ञों के पैनल की सहायता करने का ऄनरुोध करती ह;ै ररपोर्टर्ग और समीक्षा 17.सभी राष्ट्रों से, जििेष रूप से ईन क्षेंत्रों को राष्ट्रों से आस संकल्प म ेंजनजहत ईपायों को सदक्रय रूप स ेलागू करने और ईपयुटक्त परै ा 1 और 4 द्वारा लगाए गए ईपायों को लाग ू करने के जलए ईनके द्वारा की गइ कारटिाइ के बारे म ें जनयजमत रूप से सजमजत को ररपोर्ट करन ेका अह्िान; 18.सजमजत से ऄनरुोध करते हुए दक िह ऄपन े ऄध्यक्ष के माध्यम से प्रजत िषट कम से कम एक बार पररषद को सजमजत के समग्र कायट की जस्ट्थजत पर ररपोर्ट करे, जजसमें माली की जस्ट्थजत पर महासजचि के जििेष प्रजतजनजध के साथ-साथ माली की जस्ट्थजत भी िाजमल हो और जो ऄध्यक्ष को सभी आच्छुक सदस्ट्य राष्ट्रों के जलए जनयजमत ब्रीफफग अयोजजत करने के जलए प्रोत्साजहत करता ह;ै 19. बच् चौं और सिस्त्र संघषट संबंधी महासजचि और युद्ध में यौन लहसा संबंधी महासजचि के जििेष प्रजतजनजध स े ऄनुरोध करते हुए ि े संकल्प 1960 (2010) के परै ा 7 और संकल्प 1998 (2011) के परै ाग्राफ 9 के ऄनुसरण में सजमजत के साथ प्रासंजगक जानकारी साझा करें; 20. यह पुजष्ट करत ेहुए दक िह माली में जस्ट्थजत की जनरंतर समीक्षा करती रहगे ी और आस संकल्प में जनजहत ईपायों की ईपयुक्तता की समीक्षा करने के जलए तैयार रहगे ी, जजसमें ऄजतररक्त ईपायों, संिोधन, जनलंबन या ईपायों को हर्ाने के माध्यम से सिजक्तकरण िाजमल ह,ै जो दकसी भी समय देि के जस्ट्थरीकरण और आस संकल्प के ऄनुपालन में हुइ प्रगजत के अलोक म ेंअिश्यक हो सकती ह;ै 21. आस मामले को सदक्रय रूप से समझकर कायट करत ेरहने का जिजनिय दकया गया ह।ै ईपाबधं II सयं क्तु राष्ट्र सरु क्षा पररषद सकं ल्प एस/अरइएस/2649 (2022) 30 ऄगस्ट्त 2022 को सुरक्षा पररषद की 9119 िीं बैठक में पाररत दकया सुरक्षा पररषद, माली की जस्ट्थजत पर ऄपन ेजपछले सभी संकल्पों, ऄपन ेराष्ट्रपजत के िक्तव्यों और प्रेस िक्तव्यों को याद करत ेहुए, माली की संप्रभुता, एकता और क्षेत्रीय ऄखंडता के प्रजत ऄपनी मजबूत प्रजतबद्धता की पुजष्ट करते हुए, आस बात पर जोर देत े हुए दक माली के परू े क्षेत्र में जस्ट्थरता और सुरक्षा के प्रािधान हते ु माली के प्राजधकाररयों की प्राथजमक जजम्मेदारी ह,ै और[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 11 िांजत एिं सुरक्षा-संबंजधत पहल के राष्ट्रीय स्ट्िाजमत्ि को प्राप्त करने के महत्ि को रेखांदकत करता ह,ै माली म ें िांजत और सुलह पर करार ("करार") के प्रािधानों को याद करत े हुए सरु क्षा पररषद से करार को ऄपना पणू ट समथटन देन,े आसके कायाटन्ियन की करीबी जनगरानी करन े और, यदद अिश्यक हो, ईसमें जनजहत प्रजतबद्धताओं के कायाटन्ियन या आसके ईद्देश्यों की प्राजप्त में बाधा डालन े िाल ेदकसी व्यजक्त के जखलाफ ईपाय करने का अह्िान करते हुए, यह दोहराते हुए दक संयक्तु राष्ट्र, ऄफ्रीकी संघ, पजिम ऄफ्रीकी राज्यों का अर्थथक समुदाय (आकोिास) और ऄन्य ऄंतराटष्ट्रीय भागीदार माली में दीघटकाजलक िांजत और जस्ट्थरता प्राप्त करन े के साधन के रूप म ें आस करार के कायाटन्ियन के जलए दढ़ृ ता से प्रजतबद्ध ह,ैं आस करार के कायाटन्ियन हते ु बमाको में 1 से 5 ऄगस्ट्त 2022 तक एक ईच्च-स्ट्तरीय जनणटयन बैठक के अयोजन और ईस बैठक में जलए गए जनणटयों का स्ट्िागत करत े हुए, परंत ु आन जनणटयों पर कारटिाइ की अिश्यकता पर जोर देते हुए, आस बात पर खेद व्यक्त करते हुए दक कॉजमर्े डे सजु ि डे एल’ऄकोड ट (सीएएस) न े ऄक्र्ूबर 2021 स े ऄब तक मुलाकात नहीं की ह,ै समग्र करार के कायाटन्ियन में लगातार जिलंब, जो माले की जस्ट्थरता और जिकास को खतरे में डालत े हुए राजनीजतक और सुरक्षा ररक्तता ईत्पन्न करता ह,ै पर पक्षकारों के साथ ऄत्यजधक ऄधीरता व्यक्त करते हुए, करार के कायाटन्ियन में स्ट्िाजमत्ि और प्राथजमकता बढ़ाने की अिश्यकता पर बल दते े हुए, और करार द्वारा आसके कायाटन्ियन का समथटन और जनगरानी करन े के जलए स्ट्थाजपत सभी तंत्रों म ें मजहलाओं की पणू ट, समान और साथटक भागीदारी के महत्ि पर जोर देत े हुए, करार को लागू करने के जलए माली की पक्षकारों की सहायता के जलए ऄल्जीररया और ऄंतरराष्ट्रीय मध्यस्ट्थता दल के ऄन्य सदस्ट्यों द्वारा जनभाइ गइ भूजमका की सराहना करत े हुए, करार के कायाटन्ियन के जलए ऄतं रराष्ट्रीय मध्यस्ट्थता दल के सदस्ट्यों द्वारा िर्थधत िचनबद्धता की अिश्यकता पर जोर देत े हुए, और अग े केंद्रीय भूजमका को रेखांदकत करते हुए माल े के जलए महासजचि के जििेष प्रजतजनजध को करार में माली के पक्षकारों द्वारा करार के कायाटन्ियन का समथटन करने और ईसकी जनगरानी करने के जलए खेलना जारी रखना चाजहए,\ 3 जुलाइ 2022 को ऄकरा म ें अयोजजत इसीओडबल्यूएएस जिखर सम्मेलन के माली पर जनणटयों को स्ट्िीकार करत े हुए, और चुनािों पर संकल्प 2640 (2022) के प्रािधानों और संिैधाजनक व्यिस्ट्था को पुनः लागू करने को याद करत े हुए, माली म ें गैर-सरकारी सगं ठनों द्वारा राष्ट्र प्राजधकरण और बुजनयादी सामाजजक सेिाओं की िापसी में बाधा डालन े िाली लहसक और एकतरफा कारटिाआयों पर ऄत्यजधक लचता व्यक्त करते हुए, माली और अइएसअइएल (दा'एि) के साहले क्षेत्र और ऄल-कायदा से जुड़े अतंकिादी संगठनों की गजतजिजधयों की कड़ी लनदा करते हुए, और आन सगं ठनों द्वारा नागररकों, स्ट्थानीय, क्षेत्रीय और राष्ट्र संस्ट्थानों के प्रजतजनजधयों, राष्ट्रीय और ऄंतराष्ट्रट ीय बलों के साथ-साथ माली म ें संयुक्त राष्ट्र बहुअयामी एकीकृत जस्ट्थरीकरण जमिन (एमअइएनयूएसएमए) के जखलाफ जारी हमलों की कड़े िब्दों में लनदा करत े हुए माली म ें मानिाजधकारों के हनन और ईल्लघं नों तथा ऄंतरराष्ट्रीय मानितािादी कानून के ईल्लंघनों, जजसमें संघष ट के दौरान यौन लहसा और सिस्त्र संघषट म ें बच्चों की भती और ईपयोग िाजमल ह,ैं की कड़ी लनदा करते हुए, माली म ें सभी पक्षकारों स े आस तरह के ईल्लंघनों और हनन को समाप्त करन े और लाग ू ऄतं रराष्ट्रीय कानून के तहत ऄपन े दाजयत्िों का पालन करन े का अह्िान करते हुए, आस बात पर जोर देत े हुए दक आस संकल्प द्वारा लगाए गए ईपायों का अिय माली की नागररक अबादी पर प्रजतकूल मानिीय पररणाम डालना नहीं ह,ै सदस्ट्य राष्ट्रों को यह सुजनजित करने की अिश्यकता का स्ट्मरण करात े हुए दक आस प्रस्ट्ताि को लाग ूकरन े के जलए ईनके द्वारा दकए गए सभी ईपाय यथालाग ू ऄतं राटष्ट्रीय मानितािादी काननू , ऄतं राटष्ट्रीय मानिाजधकार कानून और ऄंतराटष्ट्रीय िरणाथी कानून सजहत ऄंतराष्ट्रट ीय कानून के तहत ईनके दाजयत्िों के ऄनरूु प होना चाजहए, करार के ऄिरुद्ध कायाटन्ियन पर लचता व्यक्त करत े हुए, आस बात पर जोर देत े हुए दक करार के कायाटन्ियन में जनरंतर प्रगजत आसके सभी पक्षकारों की प्राथजमक जजम्मेदारी ह,ै और संकल्प 2374 (2017) के ऄनुसरण में दकए गए ईपायों के ऄनुसार कारटिाइ करन े की तत्परता को स्ट्मरण करत े हुए दक क्या पक्षकार राष्ट्र करार के ईल्लघं न में युद्ध म ें संलग्न ह,ै जो ऐसी कारटिाइ कर रह े ह ैं जो करार के कायाटन्ियन में बाधा डालती ह,ै या जजनसे कायाटन्ियन में जिलंब होता ह ै ऄथिा जो करार के कायाटन्ियन के जलए खतरा ह,ैं 20 ददसंबर 2018 और 10 जलु ाइ 2019 के माली (“सजमजत”) के संबंध म ें संकल्प 2374(2017) के ऄनुसरण में स्ट्थाजपत सुरक्षा पररषद सजमजत के जनणयट ों को ध्यान म ें रखत े हुए दक कइ व्यजक्तयों को संकल्प 2374 (2017) ("2374 प्रजतबंध12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सूची") के ऄनुसरण में ईपायों के ऄध्यधीन व्यजक्तयों और संगठनों की सूची में रखा जाए और 2374 प्रजतबंध सूची से आन व्यजक्तयों को हर्ान े पर जिचार करने के जलए सजमजत के आरादे को ध्यान में रखत े हुए, यदद 2584 संकल्प (2021) के पैरा 4 में सूचीबद्ध प्राथजमकता ईपाय पूरी तरह स े लाग ू ह ैं और जनर्ददष्ट व्यजक्त सभी ऄिैध गजतजिजधयों को बंद कर देत े ह,ैं जजसम ें मामले के िक्तव्य म ें सूचीबद्ध गजतजिजधयां भी िाजमल ह,ैं जबदक आस बात पर जोर देत े हुए ह ै दक सुरक्षा पररषद न े ऄभी तक आस तरह के मामलों पर जिचार के जलए पयाटप्त प्रगजत नहीं देखी ह,ै आस संकल्प म ें जनजहत ईपायों को सदक्रय रूप से लाग ू करन े के जलए सभी राष्ट्रों, जििेष रूप से माली और क्षेत्र के राष्ट्रों के जलए ऄपने अह्िान को दोहराते हुए, यह दोहराते हुए दक 2374 प्रजतबंध सूची में रखे गए व्यजक्तयों या संगठनों को माली में तैनात संयुक्त राष्ट्र की संस्ट्थाओं स े दकसी भी प्रकार का जित्तीय, पररचालनात्मक या रसद सहायता Practices on Preventing and Denying the Benefits of Kidnapping for Ransom by Terrorists”, Strongly condemning all abuses and violations of human rights and violations of international humanitarian law in Mali, including those involving extrajudicial and summary executions, arbitrary arrests and detentions and ill -treatment of persons whose liberty has been restricted, sexual and gender-based violence, as well as killing, maiming, recruitment and use of children, attacks against schools and hospitals, calling on all parties to respect the civilian character of schools as such in accordance with international humanitarian law and to cease unlawful and arbitrary detention of all children, and calling upon all parties to bring an end to such violations and abuses and to comply with their obligations under applicable international law, Emphasizing the need for all parties to uphold and respect the humanitarian principles of humanity, neutrality, impartiality and independence in order to ensure the continued provision of humanitarian assistance, the safety and protection of civilians receiving assistance and the security of humanitarian personnel operating in Mali, stressing the importance of humanitarian assistance being delivered on the basis of need, reiterating that all parties must allow and facilitate full, safe, and unhindered access for the timely delivery of aid to all persons in need across Mali, Noting with grave concern the involvement of non-state actors, notably terrorist groups, in the destruction of cultural heritage and the trafficking in cultural property and related offences and further taking note of the fact that on 27 September 2016 the ICC found Mr Al Mahdi guilty of the war crime of intentionally directing attacks against religious and historical monuments in Timbuktu, Welcoming the continued action by the French forces, at the request and in support of the Malian authorities, to deter the terrorist threat in the North of Mali, Welcoming the deployment of the Force Conjointe des Etats du G 5 Sahel (FC-G5S), underlining that the FC- G5S efforts to counter the activities of terrorist groups and other organized criminal groups will contribute to create a more secure environment in the Sahel region, with a view to supporting MINUSMA fulfil its mandate to stabilize Mali, Commending the role of the European Union Training Mission (EUTM Mali) in Mali in providing training and advice for the Malian Defence and Security Forces, including contributing to the strengthening of civilian authority and respect for human rights, and of the European Union Capacity Building Mission (EUCAP Sahel Mali) in providing strategic advice and training for the Police, Gendarmerie and Garde nationale in Mali, Recalling the mandate of Decides that, for an initial period of one year from the date of the adoption of this resolution, all Member States shall take the necessary measures to prevent the entry into or transit through their territories of individuals designated by the Committee established pursuant to paragraph 9 below, provided that nothing in this paragraph shall oblige a State to refuse its own nationals entry into its territory; 2. Decides that the measures imposed by paragraph 1 above shall not apply: (a) Where the Committee determines on a case-by-case basis that such travel is justified on the grounds of humanitarian need, including religious obligation; (b) Where entry or transit is necessary for the fulfilment of a judicial process; (c) Where the Committee determines on a case-by-case basis that an exemption would further the objectives of peace and national reconciliation in Mali and stability in the region; 3. Emphasizes that violations of the travel ban can undermine the peace, stability or security of Mali, observes that individuals who knowingly facilitate the travel of a listed individual in violation of the travel ban may be determined by the Committee to have met the designation criteria provided for in this resolution and calls upon all parties and all Member States to cooperate with the Committee as well as the Panel of experts established pursuant to paragraph 11 below on the implementation of the travel ban; Asset freeze 4. Decides that, for an initial period of one year from the date of the adoption of this resolution, all Member States shall freeze without delay all funds, other financial assets and economic resources which are on their territories, which are owned or controlled, directly or indirectly, by the individuals or entities designated by the Committee, or by individuals or entities acting on their behalf or at their direction, or by entities owned or controlled by them, and decides further that all Member States shall ensure that any funds, financial assets or economic resources are prevented from being made available by their nationals or by any individuals or entities within their territories, directly or indirectly to or for the benefit of the individuals or entities designated by the Committee; 5. Decides that the measures imposed by paragraph 4 above do not apply to funds, other financial assets or economic resources that have been determined by relevant Member States: (a) To be necessary for basic expenses, including payment for foodstuffs, rent or mortgage, medicines and medical treatment, taxes, insurance premiums, and public utility charges or exclusively for payment of reasonable professional fees and reimbursement of incurred expenses associated with the provision of legal services in accordance with national laws, or fees or service charges, in accordance with national laws, for routine holding or maintenance of frozen funds, other financial assets and economic resources, after notification by the relevant State to the Committee of the intention to authorize, where appropriate, access to such funds, other financial assets or economic resources and in the absence of a negative decision by the Committee within five working days of such notification;18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (b) To be necessary for extraordinary expenses, provided that such determination has been notified by the relevant State or Member States to the Committee and has been approved by the Committee; (c) To be the subject of a judicial, administrative or arbitral lien or judgment, in which case the funds, other financial assets and economic resources may be used to satisfy that lien or judgment provided that the lien or judgment was entered into effect prior to the date of the present resolution, is not for the benefit of a person or entity designated by the Committee, and has been notified by the relevant State or Member States to the Committee; (d) Where the Committee determines on a case-by-case basis that an exemption would further the objectives of peace and national reconciliation in Mali and stability in the region; 6. Decides that Member States may permit the addition to the accounts frozen pursuant to the provisions of paragraph 4 above of interests or other earnings due on those accounts or payments due under contracts, agreements or obligations that arose prior to the date on which those accounts became subject to the provisions of this resolution, provided that any such interest, other earnings and payments continue to be subject to these provisions and are frozen; 7. Decides that the measures in paragraph 4 above shall not prevent a designated person or entity from making payment due under a contract entered into prior to the listing of such a person or entity, provided that the relevant States have determined that the payment is not directly or indirectly received by a person or entity designated pursuant to paragraph 4 above, and after notification by the relevant States to the Committee of the intention to make or receive such payments or to authorize, where appropriate, the unfreezing of funds, other financial assets or economic resources for this purpose, 10 working days prior to such authorization; Designation criteria 8. Decides that the measures contained in paragraph 1 shall apply to individuals, and that the measures contained in paragraph 4 shall apply to individuals and entities, as designated for such measures by the Committee as responsible for or complicit in, or having engaged in, directly or indirectly, the following actions or policies that threaten the peace, security, or stability of Mali: (a) Engaging in hostilities in violation of the Agreement; (b) Actions taken that obstruct, or that obstruct by prolonged delay, or that threaten the implementation of the Agreement; (c) Acting for or on behalf of or at the direction of or otherwise supporting or financing individuals and entities identified in subparagraphs (a) and (b) above, including through the proceeds from organized crime, including the production and trafficking of narcotic drugs and their precursors originating in or transiting through Mali, the trafficking in persons and the smuggling of migrants, the smuggling and trafficking of arms as well as the trafficking in cultural property; (d) Involvement in planning, directing, sponsoring, or conducting attacks against: (i) the various entities referenced in the Agreement, including local, regional and state institutions, joint patrols and the Malian Security and Defense forces; (ii) MINUSMA peacekeepers and other UN and associated personnel, including members of the Panel of experts; (iii) international security presences, including the FC-G5S, European Union Missions and French forces; (e) Obstructing the delivery of humanitarian assistance to Mali, or access to, or distribution of, humanitarian assistance in Mali; (f) Planning, directing, or committing acts in Mali that violate international human rights law or international humanitarian law, as applicable, or that constitute human rights abuses or violations, including those involving the targeting of civilians, including women and children, through the commission of acts of violence (including killing, maiming, torture, or rape or other sexual violence), abduction, enforced disappearance, forced displacement, or attacks on schools, hospitals, religious sites, or locations where civilians are seeking refuge; (g) The use or recruitment of children by armed groups or armed forces in violation of applicable international law, in the context of the armed conflict in Mali; New Sanctions Committee 9. Decides to establish, in accordance with rule 28 of its provisional rules of procedure, a Committee of the Security Council consisting of all the members of the Council (herein “the Committee”), to undertake to following tasks: (a) To monitor implementation of the measures imposed in paragraphs 1 and 4 above;[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 19 (b) To designate those individuals and entities subject to the measures imposed by paragraph 4, to review information regarding those individuals, and to consider requests for exemptions in accordance with paragraph 5 above; (c) To designate those individuals subject to the measures imposed by paragraph 1, to review information regarding those individuals, and to consider requests for exemptions in accordance with paragraph 2 above; (d) To establish such guidelines as may be necessary to facilitate the implementation of the measures imposed above; (e) To encourage a dialogue between the Committee and interested Member States and international, regional and subregional organizations, in particular those in the region, including by inviting representatives of such States or organizations to meet with the Committee to discuss implementation of the measures; (f) To seek from all States and international, regional and sub-regional organizations whatever information it may consider useful regarding the actions taken by them to implement effectively the measures imposed above; (g) To examine and take appropriate action on information regarding alleged violations or non-compliance with the measures contained in this resolution; 10. Requests the Secretary-General to make the necessary financial arrangements to enable the Committee to undertake the tasks mentioned in paragraph 9 above; Panel of experts 11. Requests the Secretary-General to create, for an initial period of thirteen months from the adoption of this resolution, in consultation with the Committee, a group of up to five experts (“Panel of experts”), under the direction of the Committee, and to make the necessary financial and security arrangements to support the work of the Panel, expresses its intent to consider the renewal of this mandate no later than 12 months after the adoption of this resolution, and decides that the Panel shall carry out the following tasks: (a) Assist the Committee in carrying out its mandate as specified in this resolution, including through providing the Committee with information relevant to the potential designation at a later stage of individuals who may be engaging in the activities described in paragraph 8 above; (b) Gather, examine and analyse information from States, relevant United Nations bodies, regional organizations and other interested parties regarding the implementation of the measures decided in this resolution, in particular incidents of non-compliance; (c) Provide to the Council, after discussion with the Committee, an interim update by March, 1, 2018, and a final report by September, 1, 2018, and periodic updates in between; (d) To assist the Committee in refining and updating information on the list of individuals subject to measures imposed by paragraphs 1 and 4 above, including through the provision of biometric information and additional information for the publicly-available narrative summary of reasons for listing; (e) To cooperate closely with INTERPOL and the United Nations Office on Drugs and Crime (UNODC), as appropriate; 12. Requests that the Panel of experts has the necessary gender expertise, in line with paragraph 6 of resolution 2242 (2015); 13. Notes that the selection process of the experts composing the Panel should prioritize appointing individuals with the strongest qualifications to fulfil the duties described above while paying due regard to the importance of regional and gender representation in the recruitment process; 14. Directs the Panel of experts to cooperate with other relevant expert groups established by the Security Council to support the work of its Sanctions Committees, including the Panel of experts established by resolution 1973 (2011) concerning Libya and the Analytical Support and Sanctions Monitoring Team pursuant to resolutions 1526 (2004) and 2368 (2017) concerning ISIL (Da’esh), Al-Qaida and the Taliban and associated individuals and entities; 15. Urges all parties and all Member States, as well as international, regional and subregional organizations to ensure cooperation with the Panel of experts and further urges all Member States involved to ensure the20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] safety of the members of the Panel of experts and unhindered access, in particular to persons, documents and sites in order for the Panel of experts to execute its mandate; Role of MINUSMA 16. Encourages timely information exchange between MINUSMA and the Panel of experts, and requests MINUSMA to assist the Committee and the Panel of experts, within its mandate and capabilities; Reporting and review 17. Calls upon all States, particularly those in the region, to actively implement the measures contained in this resolution and to regularly report to the Committee on the actions they have taken to implement the measures imposed by paragraphs 1 and 4 above; 18. Requests the Committee to report orally, through its Chair, at least once per year to the Council, on the state of the overall work of the Committee, including alongside the Special Representative of the Secretary- General for Mali on the situation in Mali as appropriate, and encourages the Chair to hold regular briefings for all interested Member States; 19. Requests the Special Representative of the Secretary-General for Children and Armed Conflict and the Special Representative for Sexual Violence in Conflict to share relevant information with the Committee in accordance with paragraph 7 of resolution 1960 (2010) and paragraph 9 of resolution 1998 (2011); 20. Affirms that it shall keep the situation in Mali under continuous review and that it shall be prepared to review the appropriateness of the measures contained in this resolution, including the strengthening through additional measures, modification, suspension or lifting of the measures, as may be needed at any time in light of the progress achieved in the stabilization of the country and compliance with this resolution; 21. Decides to remain actively seized of the matter. Annexure II United Nations Security Council Resolution S/RES/2649 (2022) Adopted by the Security Council at its 9119th meeting, on 30 August 2022 The Security Council, Recalling all its previous resolutions, statements of its President and press statements on the situation in Mali, Reaffirming its strong commitment to the sovereignty, unity and territorial integrity of Mali, emphasizing that the Malian authorities have primary responsibility for the provision of stability and security throughout the territory of Mali, and underscoring the importance of achieving national ownership of peace- and security- related initiatives, Recalling the provisions of the Agreement on Peace and Reconciliation in Mali (“the Agreement”) calling upon the Security Council to give its full support to the Agreement, to closely monitor its implementation and, if necessary, to take measures against anyone hindering the implementation of the commitments contained therein or the realization of its objectives, Reiterating that the United Nations, the African Union, the Economic Community of West African States (ECOWAS) and other international partners remain firmly committed to the implementation of the Agreement as a means to achieve long-term peace and stability in Mali, welcoming the holding in Bamako from 1 to 5 August 2022 of a high- level decision-making meeting on the implementation of the Agreement and decisions made at that meeting, but stressing the need for action on these decisions, expressing regret that the Comité de suivi de l’Accord (CSA) has not met since October 2021, further expressing a significant impatience with parties over the persistent delays in the implementation of the overall Agreement, which contribute to a political and security vacuum jeopardizing the stability and development of Mali, stressing the need for increased ownership and prioritization in the implementation of the Agreement, and further stressing the importance of the full, equal and meaningful participation of women in all the mechanisms established by the Agreement to support and monitor its implementation, Commending the role played by Algeria and other members of the international mediation team to assist the Malian parties to implement the Agreement, emphasizing the need for increased engagement by the members of the international mediation team for the consequences for the civilian population of Mali, Recalling the need for Member States to ensure that all measures taken by them to implement this resolution comply with their obligations under international law, including international humanitarian law, international human rights law and international refugee law, as applicable, Expressing concern at the stalled implementation of the Agreement, stressing that all parties to the Agreement share the primary responsibility to make steadfast progress in its implementation, and recalling its readiness to respond with measures pursuant
