“8. अज(cid:6981)न क(cid:7409) बाबत् आपि(cid:7275)यां. – (1) कोई (cid:7390)ि(cid:7334), जो (cid:7408)कसी भूिम म(cid:7286) िजसक(cid:7409) बाबत् क(cid:7409) धारा 7 के अधीन
अिधसूचना िनकाली गई ह,ै िहतब(cid:7373) ह,ै अिधसूचना के िनकाले जाने के तीस (cid:7408)दन(cid:7298) के भीतर स(cid:7013)पूण(cid:6981) भूिम या उसके
(cid:7408)कसी भाग या ऐसी भूिम म(cid:7286) या उस पर के (cid:7408)क(cid:7008)ह(cid:7277) अिधकार(cid:7298) का अजन(cid:6981) (cid:7408)कए जाने के बारे म(cid:7286) आपि(cid:7275) कर सकेगा ।

के िलए (cid:7021)वय ं खनन सं(cid:7408)(cid:7059)याए ँ करना चाहता ह ै और ऐसी सं(cid:7408)(cid:7059)याए ँ के(cid:7008)(cid:7076)ीय सरकार या (cid:7408)कसी अ(cid:7008)य (cid:7390)ि(cid:7334) को नह(cid:7277)
करनी चािहए ।
(2) उप-धारा (1) अधीन (cid:7079)(cid:7004)येक आपि(cid:7275) स(cid:6979)म (cid:7079)िधकारी को िलिखत (cid:7272)प म(cid:7286) क(cid:7409) जाएगी और स(cid:6979)म (cid:7079)ािधकारी
आपि(cid:7275)कता(cid:6981) को (cid:7021)वयं सनु े जाने का या िविध (cid:7390)वसायी (cid:7367)ारा सनु वाई का अवसर दगे ा और ऐसी सभी आपि(cid:7275)य(cid:7298) को
सुनन े के प(cid:7391)ात् और ऐसी अित(cid:7407)र(cid:7334) जांच य(cid:7408)द कोई हो, करन े के प(cid:7391)ात,् जो वह आव(cid:7019)यक समझता ह,ै वह या तो
धारा 7 क(cid:7409) उप-धारा (1) के अधीन अिधसूिचत भूिम के या ऐसी भूिम म(cid:7286) या उस पर के अिधकार(cid:7298) के संबंध म(cid:7286) एक
(cid:7407)रपोट(cid:6981) या ऐसी भूिम के िविभ(cid:7382) टुकड़(cid:7298) या ऐसी भूिम म(cid:7286) या उस पर के अिधकार(cid:7298) के संबंध म(cid:7286) आपि(cid:7275)य(cid:7298) पर अपनी
िसफ़ा(cid:7407)रश(cid:7298) और उसके (cid:7367)ारा क(cid:7409) गई काय(cid:6981)वाही के अिभलेख सिहत िविभ(cid:7382) (cid:7407)रपोट(cid:6981) के(cid:7008)(cid:7076)ीय सरकार को उसके िविन(cid:7391)य
के िलए दगे ा।
(3) इस धारा के (cid:7079)योजन(cid:7298) के िलए वह (cid:7390)ि(cid:7334) (cid:7408)कसी भूिम म(cid:7286) िहतब(cid:7373) समझा जाएगा जो (cid:7079)ितकर म(cid:7286) िहत का दावा
करन े का हकदार होगा, य(cid:7408)द भूिम या (cid:7408)कसी ऐसी भिू म म(cid:7286) या उस पर के अिधकार इस अिधिनयम के अधीन अ(cid:7414)ज(cid:6981)त

NOTIFICATION
New Delhi, the 3rd April, 2017
S.O. 1048(E).—Whereas by the notification of Government of India in the Ministry of Coal number
S.O 591(E), dated the 22nd February, 2016 published in the Gazette of India, Part II, Section 3, Sub-section (ii), dated the
25th February, 2016 and as amended vide notification number S.O. 1875, dated the 08th September 2016, published in the
Gazette of India, Part II, Section 3, Sub-section (ii), dated the 10th September, 2016 issued under sub-section(1) of
section 4 of the Coal Bearing Areas (Acquisition and Development) Act,1957 (20 of 1957) (hereinafter referred to as the4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
said act), the Central Government gave notice of its intention to prospect for coal in 51.54 hectares (approximately) or
127.35 acres (approximately) of the land in the locality specified in the Schedule annexed to that notification;
And whereas, the Central Government is satisfied that coal is obtainable in a part of the said land prescribed in the
Schedule appended to this notification;
Now, therefore, in exercise of powers conferred by sub-section(1) of section 7 of the said Act, the Central
Government hereby gives notice of its intention to acquire the land measuring 51.54 hectares (approximately) or 127.35
acres (approximately) and all rights in or over the said lands described in the Schedule appended hereto:
Note 1: The plan bearing number Rev/02/2017, dated the 6th February, 2017 the area covered by this notification may
be inspected in the office of the Deputy Commissioner, District Latehar, Jharkhand or at the office of the Coal
Controller,1, Council House Street, Kolkata -700 001 or at the office of the General Manager, Magadh - Amrapali Area,
District Latehar, Jharkhand or General Manager (Land and Revenue), Central Coalfields Limited, Darbhanga
House,Ranchi-834001(Jharkhand) or General Manager (Exploration Division), Central Mine Planning and Design
Institute Limited , Gondwana Palace, Kanke Road, Ranchi-834008 (Jharkhand).
Note 2: Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows:-
“8. Objection to Acquisition.-- (1) Any person interested in any land in respect of which a notification under section 7
has been issued, may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part
of the land or any rights in or over such land.
(cid:69)(cid:120)(cid:112)(cid:97)(cid:108)(cid:110)(cid:110)(cid:97)(cid:111)(cid:44)(cid:105)(cid:116)(cid:45)(cid:32) It shall not be an objection within the meaning of this section for any person to say that he himself desires
to undertake mining operation in the land for the production of coal and that such operation should not be undertaken by
the Central Government or by any other person.(cid:32)
(2) Every objection under sub-section (1) shall be made to the competent authority in writing, and the competent
authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall, after
hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either makes a report in
respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land, or make
different reports in respect of different parcels of such land or of rights in or over such land, to the Central Government,
containing his recommendations on the objections, together with the record of the proceedings held by him, for the
decision of the Government.
(3) For the purposes of this section, a person shall be deemed to be interested in land who would be entitled to claim
an interest in compensation if the land or any rights in or over such land were acquired under this Act ”.
Note 3: The Coal Controller, 1, Council House Street, Kolkata-700 001 has been appointed by the Central Government
as the competent authority under section 3 of the said Act, vide notification number S.O. 2518, dated the 27th May,1983
published in part II, section 3, sub-section (ii) of the Gazette of India, dated the 11th June, 1983.
