अिधसूचना िनकाले जान े स े तीस (cid:4)दन< के भीतर सA पूण (cid:22) भिू म या उसके (cid:4)कसी भाग या ऐसी भिू म म (cid:30) या उस पर के
(cid:4)क(cid:11)ह N अिधकार< का अजन(cid:22) (cid:4)कए जान ेके बारे म (cid:30)आपि; त कर सकेगा ।

चािहए।
(2) उपधारा (1) के अधीन ,;य ेक आपि; त स(cid:18)म अिधकारी को िलिखत Pप म(cid:30) क(cid:27) जाएगी और स(cid:18)म अिधकारी,
आपि;त कता (cid:22)को )व यं सुन ेजान,े िविध K यवसायी ’ारा सुनवाई का अवसर दगे ा और ऐसी सभी आपि; तय< को सुनन ेके
प च ात् और ऐसी अित5र%त जांच, य(cid:4)द कोई हो, करने के प चात् जो वह आव यक समझता ह,ै वह या तो धारा 7 क(cid:27)
उपधारा (1) के अधीन अिधसिू चत भूिम के या ऐसी भिू म म(cid:30) या उस पर के अिधकार< के संबधं म(cid:30) एक 5रपोट(cid:22) या ऐसी

MINISTRY OF COAL
NOTIFICATION
New Delhi, the 14th January, 2016
S.O. 122(E).—Whereas by the notification of the Government of India in the Ministry of Coal,
dated the 26th August, 2015, issued under sub-section (1) of section 4 of the Coal Bearing Areas
(Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act) and
published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number
S.O. 2360(E), dated the 28th August, 2015, the Central Government gave notice of its intention to prospect
for coal in 189.33 hectares (approximately) or 467.83 acres (approximately) of the lands in the locality
specified in the Schedule annexed to that notification ;
And whereas, the Central Government is satisfied that coal is obtainable in a part of said lands
prescribed in the Schedules appended hereto;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act,
the Central Government hereby gives notice of its intention to acquire the land measuring 183.66 hectares
(approximately) or 453.82 acres (approximately) the all rights as described in Schedule appended hereto;
Note 1: The plan bearing number C-1(E) III/FR/924-1115, dated the 26th November, 2015 of the area
covered by this notification may be inspected in the Office of the Collector, District Nagpur
(Maharashtra) or in the Office of the Coal Controller, 1, Council House Street, Kolkata - 700001
or in the Office of the General Manager, Western Coalfields Limited (Revenue Department),
Coal Estate, Civil Lines, Nagpur – 440 001 (Maharashtra).
Note 2: Attention is hereby invited to the provisions of section 8 of the said Act which provides as
follows:-
Objections to Acquisition.-
“8.(1) Any person interested in any land in respect of which a notification under section 7 has been
issued, may, within thirty days of the issue of the notification, object to the acquisition of the whole or
any part of the land or of any rights in or over such land.
Explanation.- It shall not be an objection within the meaning of this section for any person to say that
he himself desires to undertake mining operations in the land for the production of coal and that such
operations should not be undertaken by the Central Government or by any other person.
(2) Every objection under sub-section (1) shall be made to the competent authority in writing, and
the competent authority shall give the objector an opportunity of being heard either in person or by a
legal practitioner and shall, after hearing all such objections and after making such further inquiry, if
any, as he thinks necessary, either make a report in respect of the land which has been notified under
sub-section (1) of section 7 or of rights in or over such land, or make different reports in respect of
different parcels of such land or of rights in or over such land, to the Central Government, containing
his recommendations on the objections, together with the record of proceedings held by him, for the

(3) For the purpose of this section, a person shall be deemed to be interested in land who would be
entitled to claim an interest in compensation if the land or any rights in or over such land were
acquired under this Act.”
Note 3: The Coal Controller, 1, Council House Street, Kolkata- 700 001 has been appointed by the Central
Government as the competent authority under section 3 of the said Act, vide notification number
S.O. 2519, dated the 27th May, 1983, published in Part II, Section 3, Sub-section (ii) of the Gazette of
India, dated the 11th June, 1983.
