अिधिनयम 2001 (2001 का 52) की धारा 58 की उपधारा (i) के अधीन अपेक्षानुसार ऐसे सभी व् यि(cid:7334)य(cid:7298) से िजनके उससे

और उपरोक् त अविध के भीतर उक् त (cid:7079)ारूप िविनयम(cid:7298) के संबंध म(cid:7286) कोई भी आपि(cid:7275) या सुझाव (cid:7079)ाप् त नह(cid:7277) हुए ह;(cid:7289)
अब ऊजार् संरक्षण अिधिनयम 2001 (2001 का 52) की धारा 9 की उपधारा 6 के साथ पिठत धारा 58 की उप-
धारा (2) के खण् ड (ग) (cid:7367)ारा (cid:7079)दत् त शि(cid:7334)य(cid:7298) का (cid:7079)योग करते हुए, केन् (cid:7076)ीय सरकार के पूवर् अनुमोदन से ऊजार् दक्षता ब् यूरो
िनम् निलिखत िविनयम बनाता ह ैअथार्त् :-
1. सिं क्षप्त नाम और (cid:7079)ारंभ : -(1) इन िविनयम(cid:7298) का संिक्षप् त नाम ऊजार् दक्षता ब्यूरो (ब्यूरो के महािनदेशक की शि(cid:7334)यां
और क(cid:7275)र्(cid:7390)), िविनयम, 2017 ह।ै
(2) ये िविनयम राजप(cid:7074) म(cid:7286) इनके (cid:7079)काशन की तारीख को (cid:7079)वृत् त ह(cid:7298)गे।
2. पिरभाषाएं :- (1) इन िविनयम(cid:7298) म(cid:7286), जब तक संदभर् से अन् यथा अपेिक्षत न हो,-

(क) ''अिधिनयम” से ऊजार् संरक्षण अिधिनयम, 2001 (2001 का 52) अिभ(cid:7079)ेत ह;ै
(ख) "ब्यूरो" से उक् त अिधिनयम की धारा 3 की उपधारा (1) के अधीन स्थािपत ऊजार् दक्षता ब्यूरो अिभ(cid:7079)ेत ह;ै
(ग) "अध्यक्ष" से उक् त अिधिनयम की धारा 4 की उपधारा (2) के खंड (क) म(cid:7286) िविन(cid:7416)दर्ष् ट शासी पिरषद के पदने

गए िनयम(cid:7298) म(cid:7286) पिरभािषत ह,(cid:7289) उनका (cid:7059)मश: वही अथर् होगा जो उस अिधिनयम या उसके अधीन बनाए गए िनयम(cid:7298) म(cid:7286) ह।ै
3. ब् यरूो के महािनदेशक की शि(cid:7334)य(cid:7298) और काय(cid:7300) का (cid:7079)त् यायोजन – (1) शासी पिरषद (cid:7367)ारा कायर्कलाप(cid:7298) के साधारण
अधीक्षण, िनदेशन और (cid:7079)बंध के अधीन रहते हुए, ब् यूरो का महािनदशे क मुख् य कायर्पालक (cid:7079)ािधकारी के रूप म(cid:7286) अिधिनयम के
उपबंध(cid:7298) के अनुसार नीचे िविन(cid:7416)दष्र् ट ब् यूरो की शि(cid:7334)य(cid:7298) का (cid:7079)योग और कृत् य(cid:7298) का िनवर्हन कर(cid:7286)गे, अथार्त् :
(क) अिधिनयम की धारा 3 की उपधारा (2) के अधीन यथा उपबंिधत ब् यूरो के नाम से उस पर वाद लाया
जाएगा या वह वाद लाएगा और उसे संिवदा करने और जंगम और स् थावर दोन(cid:7298) (cid:7079)कार की संपि(cid:7275) का
अजर्न, धारण और व् ययन करने की शि(cid:7334) होगी;
(ख) अिधिनयम की धारा 8 की उपधारा (3) के अधीन यथा उपबंिधत उपस् कर(cid:7298) या (cid:7079)ि(cid:7059)या(cid:7312) की बाबत ऊजार्
संरक्षण के मानक या मानक िविनिमर्त करने के िलए उतनी संख् या म(cid:7286) िवशेषज्ञ(cid:7298) की तकनीकी सिमितय(cid:7298) का
गठन कर सकेगा िजतनी वह आवश् यक समझे;
(ग) अिधिनयम की धारा 10 की उपधारा (1) के अधीन ब् यूरो म(cid:7286) उतने अन् य अिधकािरय(cid:7298) (सिचव से िभन् न)
और कमर्चािरय(cid:7298) को िनयुक् त कर सकेगा, िजतने वह ब् यूरो के कृत् य(cid:7298) के दक्षतापूणर् िनवर्हन के िलए आवश् यक
समझे;
(घ) अिधिनयम की धारा 13 की उपधारा (1) के अधीन यथा उपबंिधत इस अिधिनयम (cid:7367)ारा या इसके अधीन
ब् यूरो को समनुदिे शत कृत् य(cid:7298) का िनवर्हन करने म(cid:7286) िव(cid:7378)मान संसाधन(cid:7298) और अवसंरचना को मान् यता दगे ा और
उसका उपयोग करेगा, अिभिहत उपभोक् ता(cid:7312) अिभिहत अिभकरण(cid:7298) और अन् य अिभकरण(cid:7298) के साथ (cid:7079)भावी
रूप से समन् वय करना;
(ड.) अिधिनयम की धारा 13 के खण् ड (क) के अधीन सरकार (cid:7367)ारा अिधसूिचत िकए जाने के िलए अपेिक्षत
(cid:7079)ि(cid:7059)या के िलए मानक और ऊजार् उपभोग सि(cid:7382)यम के िलए केन् (cid:7076)ीय सरकार से िसफािरश करना;
(च) अिधिनयम की धारा 14क के अधीन अिभिहत उपभोक् ता(cid:7312) को ऊजार् बचत (cid:7079)माण-प(cid:7074) जारी करने के िलए
केन् (cid:7076)ीय सरकार स ेिसफािरश करना;
(छ) अिधिनयम की धारा 14 के खण् ड (घ) के अधीन उपकरण(cid:7298) या उपस् कर(cid:7298) के लेबल पर (cid:7079)दिशर्त िकए गए
िववरण(cid:7298) या इनके (cid:7079)दशर्न की रीित के बारे म(cid:7286) केन् (cid:7076)ीय सरकार से िसफािरश करना;
(ज) अिधिनयम की धारा 14 के खण्ड (ड.) के अधीन एक अिभिहत उपभोक् ता के रूप म (cid:7286)ऊजा र्के िकसी (cid:7079)योक्त ा
या (cid:7079)योक् ता(cid:7312) के वगर् को अिधसूिचत करने के िलए केन् (cid:7076)ीय सरकार से िसफािरश करना;
(झ) अिधिनयम की धारा 14 के खण् ड (त) के अधीन ऊजार् संरक्षण भवन संिहता के िलए मागर्दशर्क िस(cid:7373)ांत
िविहत करने हते ु उपयुक् त उपाय करना;
(ञ) ऊजार् के दक्ष उपयोग और इसके संरक्षण के िलए जागरूकता पैदा करने और जानकारी का (cid:7079)सार करने के

(ट) ऊजा र् के दक्ष उपयोग और इसके सरं क्षण की तकनीक(cid:7298) म (cid:7286) कािमकर् (cid:7298) और िवशषे ज्ञ(cid:7298) के (cid:7079)िशक्षण की व्य वस्थ ा
और उसका आयोजन करना;
(ठ) ऊजार् संरक्षण के क्षे(cid:7074) म(cid:7286) परामशर् सेवा(cid:7312) को सुदढ़ृ बनाना;
(ड) ऊजार् संरक्षण के क्षे(cid:7074) म(cid:7286) अनुसंधान और िवकास को बढ़ावा देना;
(ढ) परीक्षण और (cid:7079)माणीकरण (cid:7079)ि(cid:7059)या का िवकास और उपकरण(cid:7298) तथा उपस् कर(cid:7298) की ऊजार् की खपत के िलए
(cid:7079)माणन और परीक्षण के िलए परीक्षण सुिवधा(cid:7312) को बढ़ावा दने ा;
(ण) ऊजार् के दक्ष उपयोग और इसके संरक्षण को बढ़ावा दने े के िलए (cid:7079)ायोिगक पिरयोजना(cid:7312) तथा (cid:7079)दशर्न
पिरयोजना(cid:7312) के कायार्न् वयन की सुिवधा और सू(cid:7074)ण;
(त) ऊजार् दक्षता (cid:7079)(cid:7059)म, उपस् कर, युि(cid:7334)य(cid:7298) और (cid:7079)णािलय(cid:7298) के उपयोग को बढ़ावा देना;
(थ) ऊजार् दक्षता पिरयोजना(cid:7312) के नवाचारी िव(cid:7275) पोषण को बढ़ावा दने ा;
(द) ऊजार् के दक्ष उपयोग और इसके संरक्षण को बढ़ावा दने े के िलए संस्थान(cid:7298) को िव(cid:7275)ीय सहायता देना;
(ध) ऊजार् के दक्ष उपयोग और इसके संरक्षण को बढ़ावा दने े के िलए शैिक्षक संस् थान(cid:7298), बोडर्, िवश् विव(cid:7378)ालय(cid:7298) या
स् वाय(cid:7275) िनकाय(cid:7298) के िलए शैिक्षक पा(cid:7353)चयार् तैयार करना और उनकी पा(cid:7353)चयार् म(cid:7286) उक् त पा(cid:7353)(cid:7059)म के
समावेश के िलए समन् वय करना;
(न) ऊजार् (cid:7079)बंधक(cid:7298) और ऊजार् लेखा परीक्षक(cid:7298) के (cid:7079)माणन ऊजार् संरक्षण के क्षे(cid:7074) म(cid:7286) क्षमता िनमार्ण के िलए परीक्षा
आयोिजत करना और सेवा(cid:7312) को सुदढ़ृ बनाना;
(प) केन् (cid:7076)ीय सरकार (cid:7367)ारा ब् यूरो को स(cid:7301)पे गए ऊजार् के दक्ष उपयोग और इसके संरक्षण को बढ़ावा दने े के िलए
अंतरराष् (cid:7069)ीय सहयोग कायर्(cid:7059)म(cid:7298) को कायार्िन्वत करना;
(2) अिधिनयम की धारा 52 के अधीन महािनदशे क को ब् यूरो के िलए यथा अपेिक्षत आवश् यक सूचना पाने की शि(cid:7334)
होगी।
(3) महािनदशे क, ब् यूरो के कृत् य(cid:7298) के िनवर्हन और शि(cid:7334)य(cid:7298) के (cid:7079)योग के अितिरक् त, इन िविनयम(cid:7298) म(cid:7286) यथा िविन(cid:7416)दष्र् ट, ऐसे
अन् य कतर्व् य(cid:7298) का पालन और शि(cid:7334)य(cid:7298) का जो ब् यूरो की शासी पिरषद (cid:7367)ारा, समय-समय पर अिधिनयम की धारा 51 के अधीन
यथा उपबंिधत (cid:7079)त् यायोिजत की जा सकेगी, (cid:7079)योग कर(cid:7286)गे।

NOTIFICATION
New Delhi, the 21st July, 2017
No. 2/11(3)/13-BEE.—Whereas certain draft regulations, namely, the Bureau of Energy Efficiency (Powers
and Duties of Director-General of the Bureau) Regulations, 2017, were published via Bureau of Energy Efficiency
notification No. 2/11(3)/13-BEE, dated the 13th February, 2017 in the Gazette of India, Extraordinary, Part III, section 4,
dated the 23rd February, 2017, as required under sub-section (1) of section 58 of the Energy Conservation Act, 2001 (52
of 2001) inviting objections and suggestions from all persons likely to be affected thereby within a period of thirty days
from the date on which copies of the Official Gazette in which the said notification is published are made available to
the public;
And whereas the said draft regulations were made available to the public on the 23rd February, 2017;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]
And whereas no objection or suggestions has been received in respect of the said draft regulations within the
aforesaid period;
Now, therefore, in exercise of the powers conferred by clause (c) of sub-section (2) of section 58 read with sub-
section (6) of section 9 of the Energy Conservation Act, 2001 (52 of 2001), the Bureau of Energy Efficiency, with the
previous approval of the Central Government, hereby makes the following regulations, namely:-
1. Short title and commencement.– (1) These regulations may be called the Bureau of Energy Efficiency
(Powers and Duties of Director-General of the Bureau) Regulations, 2017.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions.- (1) In these regulations, unless the context otherwise requires,--
(a) “Act” means the Energy Conservation Act, 2001 (52 of 2001);
(b) “Bureau” means the Bureau of Energy Efficiency established under sub-section (1) of section 3 of the
Act;
(c) “Chairperson” means the ex-officio Chairperson of the Governing Council specified in clause (a) of
sub-section (2) of section 4 of the Act;
(d) “Chief Executive Authority” means the Director-General of the Bureau;
(e) “Secretary” means the Secretary of the Bureau.
(2) Words and expressions used in these regulations and not defined, but defined in the Act, or the rules
framed thereunder shall have the meanings respectively assigned to them in the Act and the rules made thereunder.
3. Delegation of powers and functions of Bureau to Director-General.– (1) Subject to general superintendence,
direction and management of the affairs by the Governing Council, the Director-General shall, as the Chief Executive
Authority of the Bureau, discharge the functions and exercise the powers of the Bureau as are specified below in
accordance with the provisions of the Act, namely:-
(a) acquire, hold and dispose of property, both movable and immovable, and to contract, and shall, sue or
be sued in the name of the Bureau as provided under sub-section (2) of section 3 of the Act;
(b) constitute such number of technical committees of experts for the formulation of energy consumption
standards or norms in respect of equipment or processes, as considered necessary as provided under
sub-section (3) of section 8 of the Act;
(c) appoint officers (other than Secretary) and other employees in the Bureau as are considered necessary
for the efficient discharge of functions of the Bureau under sub-section (1) of section 10 of the Act;
(d) co-ordinate effectively with designated consumers, designated agencies and other agencies, recognise
and utilise the existing resources and infrastructure, in performing the functions assigned to Bureau by
or under the Act, as provided under sub-section (1) of section 13 of the Act;
(e) recommend to the Central Government the norms for processes and energy consumption standards,
required to be notified by that Government under clause (a) of section 13 of the Act;
(f) recommend to the Central Government for issue of energy saving certificates to the designated
consumers under section 14A of the Act;
(g) recommend to the Central Government the particulars required to be displayed on label on equipment
or on appliances and the manner of their display under clause (d) of section 14 of the Act;
(h) recommend to the Central Government for notifying any user or class of users of energy as a
designated consumer under clause (e) of section 14 of the Act;
(i) take suitable steps to prescribe guidelines for energy conservation building codes under clause (p) of
section 14 of the Act;
(j) take all measures necessary to create awareness and disseminate information for efficient use of

(k) arrange and organise training of personnel and specialists in the techniques for efficient use of energy
and its conservation;
(l) strengthen consultancy services in the field of energy conservation;
(m) promote research and development in the field of energy conservation;
(n) develop testing and certification procedure and promote testing facilities for certification and testing
for energy consumption of equipment and appliances;
(o) formulate and facilitate implementation of pilot projects and demonstration projects for promotion of
efficient use of energy and its conservation;
(p) promote use of energy efficient process, equipment, devices and systems;
(q) promote innovative financing of energy efficiency projects;
(r) give financial assistance to institutions for promoting efficient use of energy and its conservation;
(s) prepare educational curriculum on efficient use of energy and its conservation for educational
institutions, boards, universities or autonomous bodies and coordinate with them for inclusion of such
curriculum in their syllabus;
(t) conduct examination for capacity building and strengthening of services in the field of energy
conservation including certification of energy mangers and energy auditors;
(u) implement international co-operation programmes relating to efficient use of energy and its
conservation as may be assigned to the Bureau by the Central Government.
(2) The Director-General shall have power to obtain information as may be required by the Bureau under section
52 of the Act.
(3) The Director-General shall, in addition to discharging the functions and exercising the powers of the Bureau, as
are specified in these regulations, perform such other duties and exercise powers as may be delegated to him from time
to time by the Governing Council of the Bureau as provided under section 51 of the Act.
