## Report on the National Commission for Indian System of Medicine Act, 2020: Implementation and Governance Structure
**1. Executive Summary:**
This report analyzes notifications related to the National Commission for Indian System of Medicine (NCISM) Act, 2020, specifically focusing on the commencement of remaining provisions, the repeal of the Indian Medicine Central Council Act, 1970, and the constitution of autonomous boards and the NCISM itself. The core purpose is to fully implement the NCISM Act, replacing the previous regulatory framework and establishing a new governance structure for Indian Systems of Medicine. Key findings include the complete operationalization of the NCISM Act, the dismantling of the former Central Council, and the establishment of key boards and the commission to oversee various aspects of Indian medicine.
**2. Introduction:**
This report aims to provide an informative overview of recent government notifications pertaining to the National Commission for Indian System of Medicine (NCISM) Act, 2020, based solely on the provided policy text. The report focuses on the implementation of the Act, the repealing of previous legislation and the composition and functions of key bodies established under the new framework.
**3. Policy Overview:**
* This report concerns the implementation of the National Commission for Indian System of Medicine Act, 2020 (14 of 2020).
* **Core Objectives (Inferred):**
* To fully implement the NCISM Act, 2020.
* To establish a new regulatory and governance structure for Indian Systems of Medicine.
* To repeal existing legislation deemed inconsistent with the new framework (specifically, the Indian Medicine Central Council Act, 1970).
* To constitute autonomous boards for specific functions and systems within Indian medicine.
**4. Background and Rationale:**
As this is the full implementation of a *new* policy, the background and rationale focuses on the problems that the policy likely addresses. Based on the notifications, the NCISM Act, 2020, addresses the need for a new and comprehensive regulatory framework for Indian Systems of Medicine. The repeal of the Indian Medicine Central Council Act, 1970, suggests that the existing framework was deemed inadequate or in need of significant reform. The establishment of multiple boards indicates a desire for specialized oversight in areas such as Ayurveda, Unani, Siddha, Sowa-Rigpa, medical assessment, rating, ethics, and registration. The Act likely seeks to modernize and streamline the regulation of Indian medicine, address perceived shortcomings of the previous system, and promote the development and standardization of these systems.
**5. Key Provisions / Changes:**
* **Commencement of Remaining Provisions:** All remaining provisions of the NCISM Act, 2020, came into force on June 11, 2021.
* **Repeal of the Indian Medicine Central Council Act, 1970:** The Indian Medicine Central Council Act, 1970 (48 of 1970), was repealed with effect from June 11, 2021.
* **Dissolution of the Central Council for Indian Medicine:** The Central Council for Indian Medicine, constituted under the repealed Act, was dissolved, and the Board of Governors also vacated their offices on the same date.
* **Constitution of Autonomous Boards:** The Central Government constituted the following autonomous boards with effect from June 11, 2021:
* Board of Ayurveda
* Board of Unani, Siddha and Sowa-Rigpa
* Medical Assessment and Rating Board for Indian System of Medicine
* Board of Ethics and Registration for Indian System of Medicine
* **Composition of Autonomous Boards:** The notifications specify the composition of each board, including the President and other members. Some members are named (e.g., Dr. Srineevasa Prasad Budru for the Board of Ayurveda, Dr. K Jagannathan for the Board of Unani, Siddha and SowaRigpa, Dr. Raghuram Bhatta U. for the Medical Assessment and Rating Board, and Prof. Vaidya Rakesh Sharma for the Board of Ethics and Registration), while other positions are currently vacant.
* **Constitution of the National Commission for Indian System of Medicine:** The Central Government also established the National Commission for Indian System of Medicine.
* **Composition of the NCISM:** The NCISM includes a Chairperson (Shri Vaidya Jayant Yeshwant Deopujari), ex-officio members (presidents of the autonomous boards, advisors/Joint Secretaries from the Ministry of AYUSH, Directors of relevant institutes), and vacant part-time members.
* **Term of Office:** The President and Members of each Autonomous Boards, and the Chairperson of the NCISM, shall hold office for a term of four years or until further orders, whichever is earlier, with effect from 11th day of June, 2021.
**6. Target Audience and Stakeholders:**
The primary target audience and stakeholders directly affected by these notifications include:
* Practitioners of Ayurveda, Unani, Siddha, and Sowa-Rigpa.
* Medical institutions and colleges offering courses in Indian Systems of Medicine.
* Students pursuing education in Indian Systems of Medicine.
* Researchers and scientists in the field of Indian Systems of Medicine.
* The Ministry of AYUSH and associated government bodies.
* The general public who utilize or are interested in Indian Systems of Medicine.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Central Government, through the Ministry of AYUSH, is the primary responsible agency for implementing the NCISM Act, 2020. The newly constituted National Commission for Indian System of Medicine and its associated autonomous boards will play a crucial role in regulating and governing Indian Systems of Medicine.
* **Timelines/Procedures:** The notifications specify that the remaining provisions of the NCISM Act, 2020, came into force on June 11, 2021. The repeal of the Indian Medicine Central Council Act, 1970, and the dissolution of the Central Council for Indian Medicine also took effect on the same date. The President and Members of each Autonomous Boards, and the Chairperson of the NCISM, shall hold office for a term of four years or until further orders, whichever is earlier, with effect from 11th day of June, 2021.
**8. Expected Outcomes / Impact of Changes:**
The intended outcomes and impact of these changes are likely to include:
* A modernized and standardized regulatory framework for Indian Systems of Medicine.
* Enhanced quality and accreditation standards for medical institutions and colleges.
* Improved ethical practices and registration procedures for practitioners.
* Greater focus on research and development in Indian Systems of Medicine.
* More effective governance and oversight of the sector.
* Ultimately, an enhanced role of Indian Systems of Medicine within the Indian healthcare system.
**9. Conclusion:**
The notifications analyzed in this report mark a significant step in the implementation of the National Commission for Indian System of Medicine Act, 2020. The complete operationalization of the Act, the dismantling of the former Central Council, and the establishment of key boards and the commission are poised to reshape the landscape of Indian Systems of Medicine. These changes have the potential to modernize the sector, improve quality standards, and promote the development of these traditional systems of medicine. The implementation and effectiveness of these changes will be crucial in achieving the long-term objectives of the NCISM Act, 2020.
