09 मई, 1987 को अजधसूजचत ककया था, और जबकक, केंद्र सरकार ने जेपीएम अजधजनयम की धारा 3 के अनुसार, उसे प्रदत्त अजधकारों का प्रयोग करत े हुए, जनधााररत जवजनदेि की जूट पैकेजजग सामग्री म,ें जैसा कक आदेि म ेंजनधााररत ककया जाए, इसके आपूर्तत या जवतरण के उद्देश्य से पैक ककए जानेवाले वस्ट्तुओं या वस्ट्तुओं का वग ाया उसका ऐसा प्रजतित, जो आदेि म ेंजनधााररत ककया जाए. अजधसूजचत ककया ि,ै और इसके अलावा, जबकक जूट आयुक्त को जेपीएम अजधजनयम 1987 और केंद्र सरकार के ककसी अन्य जनदेि के कायाान्वयन के उद्देश्य से जूट और जूट वस्त्र जनयंरण आदेि 2016 की धारा 4(2) के तित इस तरि के कायाान्वयन के 689 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] जलए ककन्िीं आयातकों, प्रोसेसरों, कच्चे जूट और जूट वस्त्र के व्यापाररयों को, ऐसे जवजनदेिों के ऐस ेपररमाण को जचजननत करन ेके जलए या मुकद्रत करने के जलए या जूट वस्त्रों को ब्ांड करने के जलए, जो आदेि म ेंजनर्ददष्ट ककए जाएं, आदेि जारी करन ेका अजधकार कदया गया ि,ै इसजलए, 1987 के जेपीएम अजधजनयम और केंद्र सरकार द्वारा इसके अधीन जारी ककए गए आदेिों/ अजधसूचनाओं का समुजचत कायाान्वयन सुजनजित करन े के जलए, और जनर्ददष्ट वग ा या वगों की वस्ट्तुओं और समय-समय पर केंद्र सरकार द्वारा यथा अजधसूजचत उनके प्रजतित के पैकेजजग के जलए जूट बैग की गैर-योग्य श्रेणी के उपयोग पर जनरोध और प्रजतबंध के उपाय के रूप म ें पटसन आयक्तु जूट और जूट वस्त्र जनयंरण आदेि 2016 के खंड 4(2) के अनुसरण म ेंऔर अजधसूचना संखया एस.ओ. 1724(ई) कदनांक 23.5.2017 का अजधक्रमण करते हुए, एतद्द्वारा जूट और जूट वस्त्र के सभी जवजनमााताओं, आयातकों, प्रोसेसरों, व्यापाररयों को नीच े दी गई ताजलका के स्ट्तंभ (2) म ें उजल्लजखत जूट और जूट वस्त्रों को स्ट्तंभ (3) के संगत िब्दों के अनुसार जचजननत करन/े मुकद्रत करन/े ब्ांड करन ेका जनदेि देत ेि।ै क्रमांक जूट कपड़ा का वणान जचजननत/ मुकद्रत/ ब्ांड ककए जाने वाले िब्द (1) (2) (3) 1 भारतीय जूट स े पूरी तरि जनर्तमत प्रत्येक जूट (ए) जटू बैग/ बोरा के बॉडी पर "भारत म ेंजनर्तमत" बैग/ बोरी 2 पूरी तरि से भारतीय जूट स े जनर्तमत भारतीय (ए) गांठ के पैक िीट पर "भारत म ें जनर्तमत" और जूट उत्पादों की िर पैक्ड गांठ जनमााता का नाम 3 िर आयाजतत जूट बैग/ बोरी (ए) " जूट बैग/ बोरी (जैसा प्रयोज्य िो) …………..( मूल देि) म ेंजनर्तमत" 4 आयाजतत जूट का बोरा कपड़ा/ कपड़ा (लट या (ए) " …………..( मूल दिे ) म ें जनर्तमत" कपड़ा, रोल रूप म)ें वस्त्र/तंत ुकी लंबाई पर िर छि फीट पर कच्चे जूट या जूट उत्पादों स े युक्त िर आयाजतत (ए) " ---------(मूल दिे ) म ेंजनर्तमत" पैक्ड गांठ (बी) आयातक का नाम और पता 6 आयाजतत जूट का धागा ((ए) " ---------(मूल दिे ) म ेंजनर्तमत" (बी) बािर के कवर पर आयातक का नाम और पता 7 आयाजतत जूट स े पूरी तरि या आंजिक रूप स े (ए) जूट बैग/ बोरी के एक तरफ " भारत म ेंजनर्तमत भारत म ेंजनर्तमत िर बैग, (आयाजतत जूट स)े " 8 पूरी तरि स ेया आंजिक रूप स ेआयाजतत जूट स े " भारत म ें जनर्तमत (आयाजतत जूट स)े " वस्त्र/ तंतु की भारत म ेंजनर्तमत जूट बोरी कपड़ा लंबाई पर िर छि फीट पर पटसन आयुक्त आग ेसभी जनमााताओं/ आपूर्ततकताओंा / व्यापाररयों/जूट और जूट के वस्त्र के आयातकों को जनम्नजलजखत अनुबंधों का पालन करन ेका जनदेि देत ेि ैं (क) मुद्रण अजमट स्ट्यािी स ेककया जाएगा और संपूणा अंकन/मुद्रण/ब्ांजडग का आकार कम स ेकम 2 इंच प्रजत अक्षर िोगा। (ख) 25 इंच से कम चौड़ाई वाल े प्रत्येक आयाजतत जूट बैग/ बोरी/ कपड़े में, जूट बैग/बोरी/ कपड़े के एक ककनारे स े करीब 150 जममी की दरू ी पर चार लगातार लाल ताना धाग े और जूट बैग/बोरी/ कपड़े के दसू रे ककनारे स े लगभग 30 सेमी की दरू ी पर चार लगातार िरा ताना धागे िोने चाजिए। (ग) उपरोक्त अंकन/ मुद्रण/ ब्ांजडग जूट और जूट कपड़ा के प्रत्येक स्ट्पेक्रम व्यवसाय पर लाग ू िोगी, लेककन सभी क्षेरों म ेंआयात, उत्पादन, व्यापार और जवपणन तक सीजमत निीं िोगी। (घ) प्रत्येक बैग या बोरी या जूट वस्त्र कपड़ा या तंत ु पर अंकन/मुद्रण/ब्ांजडग मूल स्ट्थान पर अथाात ् उत्पदन चरण म ेंककया जाएगा जबकक कच्चे जूट के जलए, अंकन/मुद्रण/ब्ांजडग गांठ बनाने के चरण म ेंककया जाएगा। (ड़) जूट और जूट वस्त्र जनयंरण आदेि, 2016 के प्रावधान के अनुसार इस आदेि का उल्लंघन करनेवाल े जनमााताओं/व्यापाररयों/आपूर्ततकतााओं/आयातकों या कच्चे जूट और जूट वस्त्र के व्यवसाय स े जुड़ े ककन्िीं अन्य व्यजक्त (यों) के जखलाफ उपयुक्त कारावाई की जाएगी। (च) उपरोक्त मुद्रण/अंकन /ब्ांजडग का जनदिे जनयाात उद्देश्यों के जलए प्रयुक्त जूट बैग के जलए लाग ू निीं िोंगे; अथाात जोकक भारत के सीमा के बािर उपयोग के जलए ि।ै िालाकक जनमााता प्रोसेसर व्यापारी, आपूर्ततकता,ा जनयाातक या बैग की आपूर्तत श्रखृं ला में जड़ू े ककसी अन्य व्यजक्त/व्यजक्तयों को यि सुजनजित करना िोगा कक इन बैगों का भारत के सीमा के अन्दर/ आपूर्तत िते ु उपयोग ना ककया जाए। असफल िोने पर ऐसे व्यजक्त/व्यजक्तयों,भाग II खण् ड (ii) भारत का राजपर : असाधारण 3 फामा/फमों/, कंपजनयों या ककसी अन्य एजेंजसयों के जखलाफ उपयुक्त कारावाई आवश्यक वस्ट्तु अजधजनयम, 1955 (1955 का 10) की धारा 7 के तित प्रावधानों के अनुसार की जाएगी। उपरोक्त आदेि, अगला आदिे तक लागू रिगे ा। [फा. सं.- जूट टी-6/1/178/जीएन/2019-I] मलय चंदन चक्रवती, पटसन आयुक्त MINISTRY OF TEXTILES (OFFICE OF THE JUTE COMMISSIONER) NOTIFICATION Kolkata, the 15th January, 2020 S.O. 533(E).—Whereas the Central Government has notified the Jute Packaging Materials (JPM) (Compulsory Use In Packing Commodities) Act, 1987 (No. 10 of 1987), dated 9th May 1987; to provide for the compulsory use of jute packaging material in the supply and distribution of certain commodities in the interests of production of raw jute and jute packaging material, and of persons engaged in the production thereof, and for matters connected therewith. And whereas, the Central Government, in exercise of powers conferred upon it vide Section 3 of the JPM Act, notifies the commodity or class of commodities or such percentage thereof, as may be specified in the order, to be packed for the purposes of its supply or distribution, in jute packaging material of required specification, as may be specified in the order. And further whereas, the Jute Commissioner has been empowered to issue orders under Section 4 (2) of the Jute & Jute Textiles Control Order 2016, with an objective of implementation of the JPM Act 1987 and any other directive of the Central Government; to direct any importers, processors, traders of raw jute and jute textiles to mark or print or brand such quantities of such specifications of jute textiles as may be specified in the order for such implementation. In view of the above and to ensure proper implementation of the JPM Act of 1987, and as a counter measure to impose checks and restrictions on use of non-eligible category of jute bags for packaging of specified class or classes of commodities and percentage thereof, as notified by the Central Government from time to time; the Jute Commissioner in pursuant to Clause 4 (2) of the Jute & Jute Textiles Control Order 2016 and in supersession of Notification No. S.O. 1724 (E) dated 23-05-2017, hereby directs all the manufacturers, importers, processors, traders of jute and jute textiles to mark/ print/ brand the items of jute and jute textiles as mentioned under Column (2) of the table below with the corresponding words as specified under Column (3):- Sl. Description of Jute Textiles Words to be marked / printed / branded No. (1) (2) (3) 1. Every jute bag/sacking manufactured fully from (a) ―Manufactured in India‖ on the body of the jute Indian jute bag / sacking. 2. Every packed bale of Indian jute products (a) ―Manufactured in India‖ and name of the manufactured fully from Indian jute. manufacturer on the pack sheet of the bale 3. Every imported jute bag /sacking (a) ―Jute Bag / sacking (as may be applicable) made in ------- (Country of Origin)‖ 4. Imported jute sacking cloth/fabric (in cut or roll (a) ―Cloth made in – (Country of Origin)‖, every six form) feet along the length on the cloth / fabric. 5. Every imported packed bale containing raw jute (a) ―Made in ---------- (Country of Origin)‖ or jute products (b) Name & Address of the Importer 6. Imported jute yarn. (a) ―Made in --------- Country of Origin‖ (b) Name & Address of the Importer on the outside covers. 7. Every bag manufactured in India, fully or (a) ―Manufactured in India (from imported jute)‖ on partially from imported jute one side of the jute bag / sacking. 8. Jute Sacking Cloth manufactured in India, fully ―Manufactured in India (From IMPORTED Jute)‖ or partially from imported Jute. every six feet along the length on the cloth / fabric.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Jute Commissioner further directs all the manufacturers / suppliers / traders / importers of jute and jute textiles to abide by the following stipulations:- (a) Printing shall be made with indelible ink and total Marking/ Printing / branding size shall be at least 2 inches per letter, (b) In every imported jute bag / sacking/cloth of below 25 inches in width, there should be four consecutive RED warp threads, at a distance of about 150 mm from one of the edge of the jute bag / sacking / cloth, and four consecutive GREEN warp threads at a distance of about 30 cm from the other edge of the jute bag / sacking / cloth. (c) The above marking/ printing/ branding shall be applicable to every spectrum starting from Import, production, Trading, and Marketing across all the sectors. (d) Every bag or sacking or jute textile cloth or fabric shall be branded at the point of origin i.e. in production stage, whereas for raw jute, the marking/ printing /branding shall be made at the baling stage. (e) Suitable action as per provision of Jute and Jute Textiles Control Order, 2016 will be taken against manufacturers / traders / suppliers or any other person(s) associated with the business of raw jute and jute textiles for any violations of this order. (f) The aforesaid printing /marking/branding instructions shall not be applicable for jute bags meant for export purposes; i.e. for use/meant for use outside the territory of India. However, the manufacturers, processors, traders, suppliers, exporters or any other person(s) associated in the supply chain of such bags, should ensure that these bags are not used /meant to be used/supplied for use inside the territory of India, failing which suitable action against such person(s) / firm(s)/companies or any other agencies involved will be taken as per provisions under Section 7 of the Essential Commodities Act, 1955 (10 of 1955).
