(cid:7079)माण-प(cid:7074) का जारी िकया जाना) िविनयम, 2016 भारत के राजप(cid:7074), भाग 3, खंड 4 म(cid:7286) अिधसूचना संख् यांक एम- 18012/03/2008-आईएनएस-III, तारीख 12 िदसंबर, 2016 (cid:7367)ारा (cid:7079)कािशत िकए गए थे िजसम(cid:7286) उन सभी व् यिक् तय(cid:7298) से, िजनके उससे (cid:7079)भािवत होने की संभावना थी, उस तारीख से िजसको राजप(cid:7074) की (cid:7079)ितयां जनता को उपलब् ध करा दी गई थी, प(cid:7289)तालीस िदन की अविध की समािप् त के पूवर् आक्षेप और सुझाव मांगे गए थे ; और जनता से (cid:7079)ाप् त आक्षेप और सुझाव(cid:7298) पर भारतीय बीमांकक संस्थान पिरषद ्(cid:7367)ारा िवचार कर िलया गया है । अत: भारतीय बीमांकक संस्थान पिरषद,् क(cid:7286)(cid:7076)ीय सरकार के पूवर् अनुमोदन से, बीमांकक अिधिनयम, 2006 (2006 का 35) की धारा 56 की उपधारा (2) के खंड (क), खंड (ख), खंड (ग), खंड (घ), खंड (ड), खंड (च), और खंड (छ) (cid:7367)ारा (cid:7079)द(cid:7275) शि(cid:7334)य(cid:7298) का (cid:7079)योग करते हुए िन(cid:7388)िलिखत िविनयम बनाती ह,ै अथार्त् :-- 1. सिं क्ष(cid:7385) नाम और (cid:7079)ारंभ— (1) इन िविनयम(cid:7298) का संिक्ष(cid:7385) नाम भारतीय बीमांकक संस्थान (सदस् य(cid:7298) के रूप म(cid:7286) (cid:7079)वेश और व् यवसाय (cid:7079)माणप(cid:7074) का जारी िकया जाना) िविनयम, 2017 ह ै। (2) ये राजप(cid:7074) म(cid:7286) उनके (cid:7079)काशन की तारीख से (cid:7079)वृ(cid:7275) ह(cid:7298)गे । 3076 GI/2017 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] 2. पिरभाषाए-ं इन िनयम(cid:7298) म(cid:7286), जब तक िक संदभर् से अन्यथा अपेिक्षत न हो,-- (1) (क) ''अिधिनयम'' से बीमांकक अिधिनयम, 2006 (2006 का 35) अिभ(cid:7079)ेत ह;ै (ख) ''व् यवसाय (cid:7079)माणप(cid:7074)'' से िकसी ऐसे व् यिक् त को, जो इस अिधिनयम के अधीन बीमांकक के रूप म(cid:7286) व् यवसाय करने के िलए का हकदार ह,ै जारी व् यवसाय (cid:7079)माणप(cid:7074) अिभ(cid:7079)ेत ह;ै (ग) ''अवैतिनक सिचव'' से भारतीय बीमांकक संस् थान पिरषद ्का अवैतिनक सिचव अिभ(cid:7079)ेत ह;ै (घ) ''संस् थान'' से अिधिनयम की धारा 3 के अधीन गिठत भारतीय बीमांकक संस् थान अिभ(cid:7079)ेत ह।ै (2) उन शब् द(cid:7298) और पद(cid:7298) के जो इसम(cid:7286) (cid:7079)युक् त ह ै और पिरभािषत नह(cid:7277) ह ै िकन् तु अिधिनयम या उसके अधीन बनाए गए िकसी िनयम या िविनयम म(cid:7286) पिरभािषत ह (cid:7289)वही अथर् ह(cid:7298)गे जो, यथािस् थित, अिधिनयम या ऐसे िनयम या िविनयम म(cid:7286) उनका ह ै। 3. सस्ं थ ान की सदस् यता के िलए अहतर् ाए-ं - (1) (क) कोई व् यिक् त, जो इस िविनयम म(cid:7286) िविन(cid:7416)दष्र् ट परीक्षा म(cid:7286) अिहतर् होता ह,ै संस्थ ान के संब(cid:7373) या अध् येता सदस् य के रूप म(cid:7286) अपना नाम रिजस् टर म(cid:7286) (cid:7079)िवष् ट करने का हकदार ह।ै (ख) संस् थान, अपने सदस् य(cid:7298) के िलए सुगम रीित म(cid:7286), उपिविनयम (1) म(cid:7286) िन(cid:7416)दर्ष् ट परीक्षा के िलए पा(cid:7353) िववरण अपनी वेबसाइट पर अपलोड करेगा : परंतु िकसी अध् ययन प(cid:7074) या परीक्षा के िलए पा(cid:7353) िववरण म(cid:7286) कोई संशोधन, पिरवतर्न या फेरफार संस् थान की वेबसाइट पर अिधसूचना की तारीख के पश् चात् कम से कम तीन मास तक (cid:7079)भावी रहगे ा । (2) (क) परीक्षा का आयोजन ऐसी रीित म(cid:7286) और ऐसे समय और स् थान पर होगा जैसा पिरषद ् या पिरषद ् (cid:7367)ारा (cid:7079)ािधकृत सिमित या व् यिक् तय(cid:7298) का समूह समय-समय पर िविनश् चय करे । (ख) सिमित या सिमित (cid:7367)ारा िनयुक् त व् यिक् त इस िविनयम के अधीन परीक्षा(cid:7312) के (cid:7079)योजन के िलए अनुमोिदत परीक्षक(cid:7298) की एक सूची बनाए रखेगा । (3) (क) िकसी परीक्षा म(cid:7286) (cid:7079)वेश के िलए कोई आवेदन ऑनलाइन या अनुसूची 'ज' के (cid:7079)ारूप ङ म(cid:7286) िकया जाएगा । (ख) खंड (क) के अधीन (cid:7079)त् येक आवेदन के साथ िविनयम 6 के उपिविनयम (2) म(cid:7286) िविन(cid:7416)दर्ष् ट ऐसी फीस संलग् न होगी िजससे वह समय से और पिरषद ् (cid:7367)ारा समय-समय पर िदए गए िनदशे (cid:7298) के अनुसार संस् थान म(cid:7286) पहुचं जाए और संस् थान, परीक्षा म(cid:7286) सिम्म िलत होने के िलए (cid:7079)त् येक अभ् यथ(cid:7278) को अनसु ूची झ के (cid:7079)रूप ट म(cid:7286) परीक्षा (cid:7079)वेशप(cid:7074) जारी करेगा । 4(क) पिरषद ्या पिरषद ्(cid:7367)ारा इस (cid:7079)योजन के िलए (cid:7079)ािधकृत सिमित या व् यिक् त लेखब(cid:7373) िकए जाने वाले िकसी पयार्प् त कारण से िकसी अभ् यथ(cid:7278) को परीक्षा म(cid:7286) (cid:7079)वेश करने से इंकार कर सकेगा या उसे, ऐसी शत(cid:7300) के अधीन रहते हुए जो मामले की पिरिस् थितय(cid:7298) म(cid:7286) युिक् त युक् त समझी जाएं िकसी परीक्षा म(cid:7286) (cid:7079)वेश द े सकेगा अन् यथा लेखब(cid:7373) िकए जाने वाले िकसी पयार्प् त कारण से िकसी अभ् यथ(cid:7278) को परीक्षा भवन म(cid:7286) (cid:7079)वेश दने े से इंकार कर सकेगा या सामान् य अनु(cid:7059)म म(cid:7286) परीक्षा भवन म(cid:7286) उसके (cid:7079)वेश करने के पश् चात् उसे वहां से िनष् कािसत कर सकेगा: परंतु िकसी अभ् यथ(cid:7278) को, सुनवाई का अवसर िदए िबना परीक्षा म(cid:7286) (cid:7079)वेश करने से इंकार या परीक्षा भवन से िनष् कािसत नह(cid:7277) िकया जाएगा । (ख) यिद िकसी अभ् यथ(cid:7278) की परीक्षा भवन म(cid:7286) या उसके पास िवच् छृखल व् यवहार की िरपोटर् की जाती ह ै या िकसी परीक्षा म(cid:7286) उत् तीणर् होने या उसम(cid:7286) िवघ् न डालने के (cid:7079)योजन के िलए अनुिचत साधन(cid:7298) का सहारा लेने या सहारा लेने का (cid:7079)यत् न करने के बारे म(cid:7286) िरपोटर् की जाती ह ै तो पिरषद ् या उसके (cid:7367)ारा (cid:7079)ािधकृत सिमित या व् यिक् त, इस (cid:7079)भाव की िरपोटर् (cid:7079)ाप् त होने पर और ऐसा अन् वेषण करने के पश् चात् जो वह अभ् यथ(cid:7278) का परीक्षा (cid:7079)माणप(cid:7074) र(cid:7374) िकया जाना या उसकी िव(cid:7378)ाथ(cid:7278) सदस् यता र(cid:7374) करना अन् यथा दोन(cid:7298), सिहत ऐसी अनुशासनात् मक कारर्वाई करने के िलए आवश् यक समझे, ऐसी अनुशासनात् मक कारर्वाई जो वह ठीक समझे कर सकेगा, परंतु अभ् यथ(cid:7278) को (cid:7079)भािवत करने वाला कोई आदशे पािरत करने के पूवर् उसे सुनवाई का अवसर िदया जाएगा । (ग) पिरषद ् या पिरषद ् (cid:7367)ारा (cid:7079)ािधकृत सिमित या व् यिक् त (cid:7367)ारा पािरत िकसी आदशे का, (cid:7079)भािवत अभ् यथ(cid:7278) (cid:7367)ारा िकए गए अभ् यावेदन पर पिरषद ्(cid:7367)ारा पुनिवर्लोकन िकया जा सकेगा और पिरषद ्का िविनश् चय अंितम और सभी संबंिधत व् यिक् तय(cid:7298) पर आब(cid:7373)कारी होगा । (घ) िकसी अभ् यथ(cid:7278) (cid:7367)ारा संदत् त परीक्षा फीस का, पिरषद ् या उसके (cid:7367)ारा (cid:7079)ािधकृत सिमित या व् यिक् त (cid:7367)ारा जारी मागदशर्क िस(cid:7373)ांतो के अनुसार कितपय पिरिस् थितय(cid:7298) म(cid:7286) (cid:7079)ितदाय िकया जा सकेगा । (5) (क) (cid:7079)त् येक परीक्षा म(cid:7286) घोिषत सफल अभ् यिथर्य(cid:7298) की सूची, (cid:7079)ािधकृत व् यिक्त (cid:7367)ारा सम् यक् रूप से हस् ताक्षर िकए जाने के¹Hkkx IIIμ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3 पश् चात् संस् थान की वेबसाइट पर (cid:7079)कािशत की जाएगी: परंतु संस् थान अभ् यिथर्य(cid:7298) को भी व् यिक् तगत रूप से उनके पिरणाम की सूचना द ेसकेगा । (ख) पिरषद ् या उसके (cid:7367)ारा (cid:7079)ािधकृत सिमित, अपवािदक पिरिस् थितय(cid:7298) म(cid:7286) और (cid:7079)ाियक (cid:7074)ुिटयां उद्भूत होने से िकसी िविशष् ट (cid:7079)श् नप(cid:7074) या (cid:7079)श् नप(cid:7074)(cid:7298) म(cid:7286) उत् तीणर् होने वाले मानक(cid:7298) को बनाए रखने के िलए, सभी अभ् यिथर्य(cid:7298) या अभ् यिथर्य(cid:7298) के िकसी वगर् (cid:7367)ारा अिभ(cid:7079)ाप् त अंक(cid:7298) या (cid:7061)ेड(cid:7298) को पुनिरिक्षत कर सकेगी या ऐसी रीित से जो वह आवश् यक समझे, संकिलत कर सकेगी । स् पष् टीकरण – इस खंड के (cid:7079)योजन(cid:7298) के िलए ''वगर्'' पद ऐसे अभ् यिथर्य(cid:7298) के (cid:7079)वगर् के (cid:7079)ितिनदश(cid:7287) ह ैजो पिरषद ्(cid:7367)ारा यथा उपविणर्त कितपय मानदडं(cid:7298) को पूरा करते ह (cid:7289)। (6) इस िविनयम म(cid:7286) अंतिवर्ष् ट िकसी बात के होते हुए भी जहां यह पाया जाता ह ै िक िकसी परीक्षा का पिरणाम गलती अनाचार, कपट, अनुिचत आचरण या िकसी (cid:7079)कृित की अन् य िवषय वस् तु से (cid:7367)ारा (cid:7079)मािवत िकया गया ह ैवहां पिरषद ्या उसके (cid:7367)ारा (cid:7079)ािधकृत सिमित को ऐसे परीक्षा पिरणाम का ऐसी रीित म(cid:7286) जो िस् थित के अनुसार सही हो और ऐसी घोषणा करने के िलए जैसा पिरषद ्इस िनिमत् त आवश् यक समझे, संशोधन करने की शिक् त होगी: परंतु िकसी अभ् यथ(cid:7278) को सुनवाई का अवसर िदए िबना ऐसा कोई संशोधन नह(cid:7277) िकया जाएगा िजसका उस पर (cid:7079)ितकूल (cid:7079)भाव पड़े: परंतु यह और िक िकसी ऐसी गलती की दशा म(cid:7286), जो िकसी अभ् यथ(cid:7278) की ओर से िकए गए िकसी कायर् या व् यित(cid:7059)म से उदभूत नह(cid:7277) हुई ह,ै अभ् यथ(cid:7278) को (cid:7079)ितकूल रूप से (cid:7079)भािवत करने वाली संशोधन संबंधी कायर्वािहयां पिरणाम की घोषणा की तारीख से एक मास की अविध की समािप् त के पश् चात् आरंभ नह(cid:7277) की जाएंगी । (7) (cid:7079)त् येक अभ् यथ(cid:7278) िजसने इस िविनयम के अधीन कोई परीक्षा उत् तीणर् की ह,ै अनुसूची क के (cid:7079)रूप छ म (cid:7286) इस (cid:7079)भाव की एक पालन िरपोटर् दगे ा । 4. अध् यते ा सदस्य के रूप म (cid:7286)रिजस्(cid:7069) ीकरण के िलए अहतर् ा-- (1) िकसी व् यिक् त को अध् येता सदस् य के रूप म(cid:7286) रिजस् (cid:7069)ीकृत िकया जा सकेगा यिद-- (क) उसने िविनयम 3 के अधीन अध् येता सदस् यता के िलए परीक्षा उत् तीणर् की ह;ै (ख) उसने ऐसा वृि(cid:7074)क या अन् य पा(cid:7353)(cid:7059)म या (cid:7079)िशक्षण पूरा कर िलया ह ैजो पिरषद ्(cid:7367)ारा समय समय पर बताए जाएं; और (ग) उसके पास ऐसा सुसंगत कायर् अनुभव हो जो पिरषद ्(cid:7367)ारा समय-समय पर बताया जाए । (2) संस् थान (cid:7367)ारा भारत के बाहर अविस् थत अन् य बीमांकक िनकाय(cid:7298) के साथ िकए गए पारस् पिरक मान् यता करार (एमआरए) के अधीन अध् येता सदस् य के रूप म(cid:7286) (cid:7079)वेश की ईप् सा करने वाले िकसी व् यिक् त के िलए िविनयम 3 म(cid:7286) िन(cid:7416)दष्र् ट परीक्षा को अिधत् यक् त कर िदया जाएगा यिद,-- (क) संस् थान की अध् येता सदस् यता के िलए आवेदन की तारीख को व् यिक् त ऐसे बीमांकक िनकाय का, िजसका संस् थान के साथ पारस् पिरक मान् यता करार ह,ै सदस् य बना हुआ ह;ै (ख) संस् थान की अध् येता सदस् यता के िलए आवेदन की तारीख को व् यिक् त ने संबंिधत बीमांकक िनकाय के साथ पारस् पिरक मान् यता करार की सुसंगत अपेक्षाएं पूरी कर ली ह:ै परंतु पिरषद ् संस् थान की वेबसाइट पर ऐसे सभी संबंिधत बीमांकक िनकाय(cid:7298) की िजनके साथ संस् थान ने पारस् पिरक मान् यता करार िकया ह ैजानकारी उपलब् ध करवाएगी । (3) कोई व् यिक् त जो अध् येता सदस् य के रूप म(cid:7286) (cid:7079)वेश लेने की वांछा रखता ह,ै अनुसूची 'ग' के (cid:7079)रूप 'घ' म(cid:7286) अध् येता के रूप म(cid:7286) (cid:7079)वेश के िलए अपनी पा(cid:7074)ता के बारे म(cid:7286) दस् तावेजी सा(cid:7023) य और िविनयम 6 के उपिविनयम (1) म(cid:7286) िविन(cid:7416)दर्ष् ट फीस के साथ आवेदन करेगा : परंतु आवेदक ऐसी अन् य जानकारी दगे ा िजसकी पिरषद ्अपेक्षा करे । (4) अध् येता सदस् यता का (cid:7079)माणप(cid:7074) अनुसूची 'छ' के (cid:7079)रूप 'झ' म(cid:7286) जारी िकया जाएगा । 5. सहयक्ु त सदस्य के रूप म (cid:7286)रिजस्(cid:7069) ीकरण के िलए अहतर् ा – (1) िकसी व् यिक् त को सहयुक् त सदस् य के रूप म(cid:7286) तभी (cid:7079)वेश िदया जाएगा, यिद— (क) उसने िविनयम 3 के अधीन सहयुक् त सदस् यता के िलए परीक्षा उत् तीणर् की ह;ै और (ख) उसने ऐसी वृित् तक या अन् य पा(cid:7353)(cid:7059)म या (cid:7079)िशक्षण पूरा कर िलया ह ै जैसा पिरषद ्(cid:7367)ारा समय-समय पर िनयत िकया जाए; और4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (ग) उसके पास ऐसा सुसंगत कायर् अनुभव ह ैजो पिरषद ्(cid:7367)ारा समय-समय पर िनयत िकया जाए । (2) िकसी ऐसे व् यिक् त की दशा म(cid:7286), िजसने िकसी अन् य बीमांिकक िनकाय या शैक्षिणक संस् थान से संस् थान की तत् स् थानी परीक्षा के समतुल् य समझी जाने वाली ऐसी परीक्षा उत् तीणर् की ह ैजैसी पिरषद ्(cid:7367)ारा समय-समय पर िनयत की जाए, िविनयम 3 म(cid:7286) िन(cid:7416)दष्र् ट परीक्षा से अिभमुिक् त दी जा सकेगी । (3) कोई व् यिक् त जो सहयुक् त सदस् य के रूप म(cid:7286) (cid:7079)वेश लेने की वांछा रखता ह ैअनुसूची 'ख' के (cid:7079)रूप ख म(cid:7286) सदस्य ता के िलए अपनी पा(cid:7074)ता के बारे म(cid:7286) दस् तावेजी सा(cid:7023) य और िविनयम 6 के उपिविनयम (1) म (cid:7286)िविन(cid:7416)दर्ष् ट फीस के साथ आवेदन करेगा; परंतु आवेदक ऐसी अन् य जानकारी दगे ा िजसकी पिरषद ्अपेक्षा करे । (4) सहयुक् त सदस् यता का (cid:7079)माणप(cid:7074) अनुसूची च के (cid:7079)रूप ज म(cid:7286) जारी िकया जाएगा । 6. फीस-- (1) िविनयम 4 और िविनयम 5 के अधीन रिजस् टर म(cid:7286) नाम (cid:7079)िवष् ट करवाने के िलए (cid:7079)त् येक आवेदन के साथ पच् चीस हजार रूपए से अनिधक रािश की ऐसी फीस संलग् न होगी जैसी पिरषद ्(cid:7367)ारा समय-समय पर अवधािरत की जाए । (2) िविनयम 3 के उपिविनयम (3) के अधीन िकसी परीक्षा म(cid:7286) (cid:7079)वेश करने के िलए (cid:7079)त् येक आवेदन के साथ, भारत म(cid:7286) िजसके अंतगर्त दिक्षण एिशयाई क्ष(cid:7074)े ीय सहयोग संगठन (साकर्) दशे भी ह (cid:7289) िव(cid:7378)ािथर्य(cid:7298) के िलए (cid:7079)ित िवषय एक लाख रुपए से अनिधक रकम की ऐसी फीस संलग् न होगी जैसी पिरषद ्(cid:7367)ारा समय-समय पर अवधािरत की जाए: परंतु भारत और साकर् दशे (cid:7298) के बाहर के परीक्षा केन् (cid:7076) के िलए व् यिक् तय(cid:7298) के बाहर के परीक्षा केन् (cid:7076) के िलए व् यिक् तय(cid:7298) (cid:7367)ारा संदये परीक्षा फीस (cid:7079)ित िवषय दो लाख रूपए से अनिधक की ऐसी रकम होगी जैसी पिरषद ् (cid:7367)ारा समय-समय पर अवधािरत की जाए । (3) (cid:7079)त् येक सदस् य एक लाख रुपए से अनिधक की वािषर्क सदस्य ता फीस की ऐसी रकम का संदाय करेगा जैसी पिरषद ् (cid:7367)ारा समय-समय पर अवधािरत की जाए: परंतु ऐसे सदस् य, िजनका सदस् य(cid:7298) के रिजस् टर म(cid:7286) प(cid:7074)ाचार का पता भारत के बाहर का ह,ै दो लाख रुपए से अनिधक की वािषर्क सदस् यता फीस की ऐसी रकम का संदाय कर(cid:7286)गे जैसी पिरषद ्(cid:7367)ारा समय-समय पर अवधािरत की जाए । (4) पिरषद ्पा(cid:7353)(cid:7059)म साम(cid:7061)ी, कोिचंग, काउंसिलंग, (cid:7079)िशक्षण और अन् य (cid:7079)योजन(cid:7298) के िलए फीस का अवधारण करेगी : परंतु ऐसी फीस, जो पिरषद ्(cid:7367)ारा समय-समय पर अवधािरत की जाए (cid:7079)ित िवषय पचास हजार रुपए से अिधक नह(cid:7277) होगी । परंतु यह और िक ऐसे व् यिक् त िजनका प(cid:7074)ाचार का पता भारत के बाहर का ह,ै (cid:7079)ित िवषय एक लाख रुपए से अनिधक ऐसी फीस का संदाय कर(cid:7286)गे जैसा पिरषद ्समय-समय पर अवधािरत करे । 7. रीित िजसम (cid:7286)अवतै िनक सदस्य का चयन िकया जा सकेगा-- पिरषद ् अपने सभी सदस् य(cid:7298) के कम से कम पांच चौथाई मत (cid:7367)ारा िकसी ऐसे व् यिक् त को अिधिनयम की धारा 8 की उपधारा (1) के अधीन अवतै िनक सदस्य के रूप (cid:7079)वशे द े सकेगी िजस े वह बीमांकक के व्य वसाय स े सबं िं धत िवषय(cid:7298) म (cid:7286) उसकी (cid:7079)ितष्ठ ा और उसके अनुभव के कारण संस् थान के उ(cid:7374)ेश् य(cid:7298) के संवधर्न सहायता OF INDIA NOTIFICATION Mumbai, the 11th May, 2017 F. No. M-18012/03/2008-Ins.III—whereas, the draft of certain regulations, namely, the Institute of Actuaries of India (Entry of Names in Register of Members, Fees Payable, Honorary Members, Affiliate Members, Student Members and Issuance of Certificate of Practice) Regulations, 2016 were published in the Gazette of India, Part III, Section 4, vide notification number M-18012/03/2008-Ins.III dated the 2nd December, 2016, inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of forty-five days from the date on which the copies of the Gazette were made available to the public; and whereas, copies of the Gazette were made available to the public on the 2nd December, 2016; And, whereas, objections and suggestions received from the public have been considered by the Council of the Instutute of Actuaries of India. Now, therefore, in exercise of the powers conferred by clauses (a), (b), ( c), (d), (e), (f) and (g) of sub-section (2) of section 56 of the Actuaries Act, 2006 (35 of 2006), the Council of the Institute of Actuaries of India, with the previous approval of the Central Government, hereby makes the following regulations, namely:- 1. Short title and commencement.— (1) These regulations may be called the Institute of Actuaries of India (Admission as Member and Issuance of Certificate of Practice) Regulations, 2017.¹Hkkx IIIμ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 31 (2) They shall come into force from the date of their publication in the Official Gazette. 2. Definitions.— In these regulations, unless the context otherwise requires, (1) (a) “Act” means the Actuaries Act, 2006 (35 of 2006); (b) “certificate of practice” means the certificate of practice issued to a person who is entitled to practice as an Actuary under the Act; (c) “Honorary Secretary” means Honorary Secretary to the Council of the Institute of Actuaries of India; (d) “Institute” means the Institute of Actuaries of India constituted under section 3 of the Act. (2) All words and expressions used herein and not defined but defined in the Act, or any rule or regulation made thereunder shall have the meanings respectively assigned to them in the Act or such rule or regulation, as the case may be. 3. Qualification for membership of Institute.— (1) (a)Any person who qualifies the examination specified in this regulation shall be entitled to have his name entered in the register as an associate or a fellow member of the Institute. (b) The Institute shall upload on its website in a manner accessible to its members the syllabi for the examination referred to in sub-regulation (1) : Provided that any amendment, alteration or variation in the syllabi for any paper of study or examination shall take effect not less than three months after the date of notification on the website of the Institute. (2) (a) The examination shall be conducted in such manner and at such time and place as the Council, or a committee or a group of persons authorised by the Council, may decide, from time to time. (b) The committee or person appointed by the Council shall maintain a list of approved examiners for the purpose of the examinations under this regulation. (3) (a) An application for admission to an examination shall be made online or in Form E of Schedule H. (b) Every application under clause (a) shall be accompanied by such fees specified in sub-regulation (2) of regulation 6 so as to reach the Institute in time and in accordance with the directions given by the Council from time to time and the Institute shall issue an examination admit card in Form K of Schedule I to each candidate appearing in the examination. (4) (a) The Council, or a committee or persons authorised by the Council for this purpose, may, for any sufficient reason to be recorded in writing, refuse to admit a candidate to an examination or admit him to an examination subject to such conditions considered to be reasonable in the circumstances of the case or may for any sufficient reason to be recorded in writing , refuse a candidate admission to an examination hall or expel him from an examination hall, after he has been admitted to it in the usual course : Provided that no candidate shall be refused admission to an examination or be expelled from an examination hall without giving him an opportunity of being heard. (b) If a candidate is reported to have behaved in a disorderly manner in or near an examination hall or is reported to have resorted to or attempted to have resorted to unfair means for the purpose of passing or disturbing an examination, the Council or a committee or a person authorised by it, may, on receipt of a report to that effect and after such investigation as it may deem necessary take such disciplinary action including cancellation of candidate’s examination result or cancellation or suspension of his student membership or both , as it may think fit, provided that an opportunity shall be given to the candidate of being heard before an order affecting him is passed. (c) Any order passed by the Council, or the committee or the person authorised by the Council, may be reviewed by the Council on a representation made by the affected candidate and that the decision of the Council shall be final and binding on all concerned. (d) The examination fee paid by a candidate may be refunded under certain circumstances as per the guidelines issued by the Council or the committee or the person authorised by it. (5) (a) A list of candidates declared successful at each examination shall be published on the website of the Institute after it is duly signed by an authorised person: Provided that the Institute may also intimate the candidates of their results individually. (b) The Council or the committee authorised by it may, under exceptional circumstances and arising out of systemic error, revise the marks or grades obtained by all candidates or a section of candidates in any particular32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] paper or papers or in the aggregate in such manner as it may consider necessary, for maintaining the pass standards. Explanation.— For the purposes of this clause, the term “section” refers to a category of the candidates who meet certain criteria as set out by the Council. (6) Notwithstanding anything contained in this regulation, where it is found that the result of an examination has been affected by error, malpractice, fraud, improper conduct or other matter, of whatever nature, the Council or the committee authorised by it shall have the power to amend such result, in such manner as shall be in accordance with the true position and to make such declaration as the Council shall consider necessary in that behalf: Provided that no such amendment shall be made which adversely affects a candidate, without giving him an opportunity of being heard: Provided further that in the event of an error not arising out of any act or default on the part of a candidate, proceedings for amendment adversely affecting the candidate shall not be initiated after the expiry of a period of one month from the date of the declaration of result. (7) Every candidate who has passed an examination under this regulation shall be given a performance report to that effect in Form G of Schedule A. 4. Qualification for registration as a fellow member.— (1) A person may be registered as a fellow member if he - (a) has passed the examination for fellow membership under regulation 3; (b) has completed such professional or other course or training as stipulated by the Council from time to time; and (c) has relevant work experience as stipulated by the Council from time to time. (2) The examination referred to in regulation 3 shall stand waived for a person seeking admission as a fellow member under the Mutual Recognition Agreement (MRA) entered into by the Institute with other actuarial bodies located outside India if -- (a) on the date of application for fellow membership of the Institute, the person continues to be a member of the actuarial body which has the MRA with the Institute; (b) on the date of application for fellow membership of the Institute , the person satisfies the relevant requirements of MRA with the concerned actuarial body : Provided that the Council shall provide the information of all concerned actuarial bodies with whom the Institute has entered in MRA on the website of the Institute. (3) A person who desires to be admitted as a fellow member shall make an application to the Institute in Form D of Schedule C together with documentary evidence as to his eligibility for admission as a fellow and the fee specified in sub-regulation(1) of regulation 6: Provided that the applicant shall provide such other information as the Council may require. (4) A certificate of fellow membership shall be issued in Form I of Schedule G. 5. Qualification for registration as an associate member.— (1) A person shall be admitted as an associate member if he - (a) has passed the examination for associate membership under regulation 3; and (b) has completed such professional or other course or training as stipulated by the Council from time to time; and (c) has relevant work experience as stipulated by Council from time to time. (2) The examination referred to in regulation 3 may be dispensed with in the case of a person who has passed such examination as stipulated by the Council from time to time from another actuarial body or an academic institution deemed to be equivalent to the corresponding examination of the Institute. (3) A person who desires to be admitted as an associate member shall make an application to the Institute in Form B of Schedule B, together with documentary evidence as to his eligibility for membership and the fee specified in sub- regulation (1) of regulation 6; Provided that the applicant shall furnish such other information as the council may require. (4) A Certificate of an associate membership shall be issued in Form H of Schedule F.¹Hkkx IIIμ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 33 6. Fees .— (1) Every application for entry of names in the register under regulation 4 and regulation 5 shall be accompanied with a fee of an amount not exceeding twenty-five thousand rupees, as the Council may determine from time to time. (2) Every application for admission to an examination under sub-regulation (3) of regulation 3 shall be accompanied with a fee of an amount not exceeding one lakh rupees per subject for students in India including South Asian Association for Regional Cooperation (SAARC) countries, as the Council may determine from time to time: Provided that the examination fees payable by persons with examination centre outside India and SAARC countries shall be such amount not exceeding two lakh rupees per subject, as the council may determine from time to time. (3) Every member shall pay annual membership fee of such amount not exceeding one lakh rupees, as the Council may determine, from time to time : Provided that the members whose address for correspondence is located outside India in the register of members, shall pay such annual membership fee of an amount not exceeding two lakh rupees, as the Council may determine from time to time. (4) The Council shall determine fees for course material, coaching, counselling, training and other purposes: Provided that such fee shall not exceed fifty thousand rupees per subject, as the Council may determine from time to time. Provided further that persons with address for correspondence outside India shall pay such fees not exceeding one lakh rupees per subject, as the Council may determine from time to time. 7. The manner in which honorary members may be chosen.— The Council may, by a vote of not less than four-fifths of all its members, admit as an honorary member under sub- section (1) of section 8 of the Act, a person who, on account of his eminence and his experience in matters related to the profession of actuary is considered to be able to render assistance in promoting the objects of the Institute provided that he is not practicing as an Actuary : Provided that the person to be considered for such admission shall satisfy all the requirements stipulated by the Council from time to time. 8. Admission as an affiliate member of the Institute.— (1) Any person who possesses a qualification from another actuarial body deemed by the Council as equivalent to the fellow membership of the Institute and who is not less than twenty-one years of age shall be entitled to be admitted as an affiliate member of the Institute under sub-section (2) of section 8 of the Act. (2) Any person referred to in sub-regulation (1) who desires to be admitted as an affiliate member of the Institute shall make an application to the Institute in Form C of Schedule E together with documentary evidence about his eligibility for membership and on payment of a fee specified in sub-regulation (1) of regulation 6: Provided that the Institute has a reciprocity agreement with such actuarial body through the signing of a mutual recognition agreement or the like as duly authorised by the Council. (3) The determination as to whether an actuarial qualification referred to in sub-regulation (1) from another actuarial body is deemed as equivalent to fellow membership of the Institute shall be as per the norms laid down by the Council from time to time in this regard. 9. Admission as a student member of the Institute.— (1) Any person who has passed 10 plus 2 or equivalent and has cleared Actuarial Common Entrance Test (ACET) conducted by the Institute shall be entitled to be admitted as a student member of the Institute under sub-section (3) of section 8 of the Act. (2) Any person who desires to enroll himself as a student member of the Institute shall make an application to the Institute in Form A of Schedule D together with documentary evidence as to his eligibility for membership and accompanied by a fee specified in sub-regulation (1) of regulation 6. 10. Qualification, form and fee for certificate of practice.— (1) A fellow member of the Institute whose name is entered in the register maintained by the Institute under section 6 of the Act and who possesses the experience and the norms laid down by the Council from time to time, shall be entitled to apply for a certificate of practice under this regulation. (2) An Application for certificate of practice shall be made in Form F of Schedule J accompanied by such fee as may be determined by the Council from time to time but which shall not exceed one lakh rupees in any case.34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (3)Notwithstanding anything contained in this regulation, a certificate of practice held by a member under section 9 of the Act shall be deemed to have been issued under this regulation and shall continue to be valid until it is cancelled. (4) A certificate of practice shall be issued in Form J of Schedule K. 11. Cancellation of certificate of practice.— (1) A certificate of practice issued under regulation 10 shall be liable for cancellation if - (i) the name of the holder of the certificate is removed from the register under section 24 of the Act; or (ii) the Council is satisfied, after giving an opportunity of being heard to the person concerned, that such certificate was issued on the basis of incorrect, misleading or false information, or by mistake or inadvertence; or (iii) a member has applied for cancellation as he has ceased to practice; or (iv) a member has not paid annual fee for certificate of practice on or before the first day of April, of the relevant year, or any other dues are pending for more than ninety days; or (v) a member has not fulfilled the experience or the norms laid down by the Council; or (vi) a member has not paid annual membership fee till the 30th day of June of the relevant year; or (vii) any other criteria which the Council may notify, for cancellation of certificate of practice. (2) The cancellation of a certificate shall be effective - (a) in a case falling under clause (i) of sub-regulation (1), on the date on which and during the period for which, the name of the holder of the certificate was removed from the register; (b) in a case falling under clauses (iv), (v) and (vi) of sub-regulation (1), from the 15th day following the date of issue of notice by the Institute ; (c) in any other case, from such date and for such period, as may be decided by the Council. (3) Where a certificate is cancelled, the date from which the certificate shall stand cancelled shall be communicated to the member and published on the website of Institute: Provided that the Council may, on an application made in the approved form and on payment of such fee and subject to fulfilling of such requirements as may be necessary for the compliance of these regulations, restore the certificate of practice with effect from the date on which it was cancelled, to a member whose certificate has been cancelled due to non-payment of the annual fee or non-fulfillment of the requirements for the certificate of practice and whose application, complete in all respects, together with the fee, is received by the Institute before the expiry of the relevant year. 12. Council to issue clarifications.— In order to remove any doubt or difficulty that may arise in the application or interpretation of any of the provisions of these regulations, the Council of the Institute of Actuaries of India may issue appropriate clarifications or guidelines consistent with the provisions of these regulations.
