L.-33004/99 सी.जी.-डी.एल.-अ.-30032025-262130 xxxGIDHxxx CG-DL-E-30032025-262130 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 267] नई दिल्ली, िुक्रिार, माच च28, 2025/ / चैत्र 7, 1947 No. 267] NEW DELHI, FRIDAY, MARCH 28, 2025/ CHAITRA 7, 1947 भारतीय खाद्य सरु क्षा और मानक प्राजधकरण अजधसचू ना नई दिल् ली, 28 माचच, 2025 फा. स.ं स्ट्ट ैंडर्डस/चएसपी-20/टी(रीसाइदकल्ड प्ल ाजस्ट्टक्स -एन).— खाद्य सुरक्षा और मानक (पैकेजिंग) संिोधन जिजनयम, 2022 का प्रारूप खाद्य सुरक्षा और मानक अजधजनयम, 2006 (2006 का 34) की धारा 92 की उपधारा (1) के अधीन यथापेजक्षत भारत के रािपत्र, असाधारण, भाग 3, खंड 4 में भारतीय खाद्य सुरक्षा और मानक प्राजधकरण की अजधसूचना संख्या फा. सं. स्ट् टैंडर्डसच/एसपी-20/टी(रीसाइदकल् डप् लाजस्ट्टक्स -एन) तारीख 17 मई, 2022 द्वारा प्रकाजित दकया गया था, जिसमें उन सभी व्यजियों जिनके उनसे प्रभाजित होने की संभािना ह,ै उस तारीख से, जिसको उि अजधसूचना को अंतर्िचष्ट करने िाली रािपत्र की प्रजतया ं िनता को उपलब्ध करा िी गई थी, साठ दिन की अिजध की समाजि के पहल े आक्षेप और सुझाि आमंजत्रत दकए गए थ;े और उक्त रािपत्र की प्रजतया ाँ24 मई, 2022 को िनता को उपलब् ध करा िी गई थीं; और उक्त प्रारूप जिजनयमों के सम्बन्ध म ें िनता स े प्राप् त आक्षेपों और सुझािों पर भारतीय खाद्य सरु क्षा और मानक प्राजधकरण द्वारा जिचार कर जलया गया ह;ै अत: अब, खाद्य सुरक्षा और मानक अजधजनयम, 2006 (2006 का 34) की धारा 23 के साथ पठठत धारा 92 की उपधारा (2) द्वारा प्रित् त िजियों का प्रयोग करत े हुए भारतीय खाद्य सुरक्षा और मानक प्राजधकरण, खाद्य सुरक्षा और मानक (पैकेजिंग) जिजनयम, 2018 में और संिोधन करन े के जलए जनम् नजलजखत जिजनयम बनाता ह,ै अथाचत,् - 1. सजं क्षि नाम और प्रारंभ – (1) इन जिजनयमों का संजक्षि नाम खाद्य सुरक्षा और मानक (पैकेजिंग) प्रथम संिोधन जिजनयम, 2025 ह।ै (2) िह रािपत्र म ेंइनके प्रकािन की तारीख से प्रिृत होंगे। 2229 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 2. खाद्य सुरक्षा और मानक (पैकेजिंग) जिजनयम, 2018 के जिजनयम 4 के उप-जिजनयम (4) के खंड (ङ) के स्ट्थान पर जनम्न जलजखत खंड रखा िाएगा, अथाचत्,- ‘(ङ) िब भी खाद्य प्राजधकरण द्वारा मानक और मागच ििचक जसद्ांत अजधसूजचत दकए िायेंगे, तब उनके अनुसार पुननचिीनीकरण पॉलीईथाईलीन टरे ेफ्थले ेट (पीईटी) स े बन े उत् पािों का उपयोग, खाद्य उत् पािों की पैकेजिंग, भडं ारण, ले िाने या जितरण के जलए दकया िा सकेगा और ऐसी पैकेजिगं सामग्री, ऐसी सामजग्रयों को यथा लागू राष्‍टर ीय मानकों या जिजनयमों का अनपु ालन करेगी।‘ िी. कमलािधचन राि, मुख्य कायचकारी अजधकारी [जिज्ञापन-III/4/असा./1124/2024-25] ठटप्प ण.- मलू जिजनयम, भारत के रािपत्र, असाधारण, भाग 3, खडं 4 में अजधसूचना स. फा. सं. 1- 95/स्ट् टैंडर्डसच/पैकेजिगं /एसपी(एलएंडसी/ए)/एफ.एस.एस.ए.आई-2017, तारीख 24 दिसंबर, 2018 द्वारा प्रकाजित दकए गए थे और तत्पश्चात जनम्नजलजखत अजधसूचनाओं द्वारा संिोजधत दकए गए थ:े (1) फा.सं. स्ट् टैंडड/चएसपी-08/ए-1.2019/एन-01, तारीख 25 िनिरी, 2022 ; और (2) फा.सं. स्ट् टैंडड/चएसपी-20/टी (माइग्रेिन-एन), तारीख 30 अगस्ट्त, 2022 । FOOD SAFETY AND STANDARDS AUTHORITY OF INDIA NOTIFICATION New Delhi, the 28 March, 2025 F.No. STD/SP-20/T(Recycledplastics-N) – Whereas, the draft of the Food Safety and Standards (Packaging) Amendment Regulations, 2022, were published as required under sub-section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006) vide notification of the Food Safety and Standards Authority of India number, F.No. STD/SP-20/T(Recycledplastics-N), dated the 17th May, 2022 in the Gazette of India, Extraordinary, Part III, Section 4, inviting objections and suggestions from the persons likely to be affected thereby before the expiry of the period of sixty days from the date on which the copies of the Official Gazette containing the said notifications were made available to the public; And, whereas, the copies of the said Gazette were made available to the public on the 24th May, 2022; And, whereas, the objections and suggestions received from the public in respect of the said draft regulations have been considered by the Food Safety and Standards Authority of India; Now, therefore, in exercise of the powers conferred by sub-section (2) of section 92 read with section 23 of the Food Safety and Standards Act, 2006 (34 of 2006), the Food Safety and Standards Authority of India hereby makes the following regulations further to amend the Food Safety and Standards (Packaging) Regulations, 2018, namely: - 1. Short title and commencement - (1) These regulations may be called the Food Safety and Standards (Packaging) First Amendment Regulations, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Food Safety and Standards (Packaging) Regulations, 2018, in regulation 4, in sub-regulation (4), for clause (e), the following clause shall be substituted, namely: – ‘(e) Products made of recycled polyethylene terephthalate (PET) may be used for packaging, storing, carrying or dispensing of food products as and when standards and guidelines are notified by the Food Authority and such packaging materials shall comply with national standards or regulations as applicable to such materials.’ G.
