और पूवोि अवजध के भीतर उि प्रारूप जवजनयम के संबंध म ेंसुझाव प्राप्त हुए ह;ैं और इस संबंध म ेंप्राप्त सुझावों पर जवचार कर जलया गया ह;ै अब, इसजलए, ब्यूरो, केन्‍द रीय सरकार के पूवा अनुमोदन स े ऊिा ा संरक्षण अजधजनयम, 2001 (2001 का 52) की धारा 13 की उप-धारा (2) के खंड (ढ) और धारा 14 के खंड (घ) के साथ पठित धारा 58 की उप-धारा (2) के खडं (झ) द्वारा प्रदि िजियों का प्रयोग करत ेहुए, जनम्नजलजखत जवजनयम बनाता ह,ै अथाात्: - 662 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 1. सजं क्षप्त नाम और प्रारंभ- (1) इन जवजनयमों का संजक्षप्त नाम ऊिाा दक्षता ब्यरू ो (डीप फ्रीिर के लेबलों पर जववरण और उनके प्रदिना की रीजत) जवजनयम, 2023 ह।ै (2) य ेरािपत्र में प्रकािन की तारीख से प्रवृत् त होंगे। 2. पठरभाषाएं - (1) इन जवजनयमों में, िब तक दक संदभ ासे अन्‍दयथा अपेजक्षत न हो, - (क) "अजधजनयम" से ऊिाा संरक्षण अजधजनयम, 2001 (2001 का 52) अजभप्रेत ह;ै (ख) "डीप फ्रीिर" से अजधजनयम की धारा 14 के खंड (ख) के अधीन अजधसूचना म ें यथाजवजनर्दाष् ट साजधत्र अजभप्रेत ह।ै उत्पाद श्रेणी म ें हाडा टॉप और ग्लास टॉप प्रकार के डीप फ्रीिर िाजमल ह;ैं (ग) "प्ररूप" स ेइन जवजनयमों से संलग्न कोई प्ररूप अजभप्रेत ह;ै (घ) "लेबल" स े डीप फ्रीिर पर चस्ट्पा की गई या इस पर प्रदर्िता होन े वाली कोई जलजखत, मदु रत, जचजननत, मुरांदकत या ग्रादिक सामग्री अजभप्रेत ह;ै (ङ) "लेबल अवजध" स े अजधजनयम की धारा 14 के खंड (क) के अधीन केंरीय सरकार द्वारा अजधसूजचत ऊिा ा खपत मानकों की जवजधमान्‍द य अवजध अजभप्रेत ह:ै परंत,ु यदद लेबल जवजधमान्‍द यता अवजध की समाजप्त समय-सीमा तक, अजधजनयम की धारा 14 के खंड (क) के अधीन नए ऊिाा खपत मानकों को अजधसूजचत नहीं दकया िाता ह,ै जवद्यमान मानकों को तब तक जवजधमान्‍दय समझा िाएगा िब तक दक केंरीय सरकार द्वारा उनके जलए नए मान अजधसूजचत नहीं दकए िाते ह;ैं (च) "अनज्ञु ापत्रधारी" स े ऐसा व्यजि या अजभकरण अजभप्रेत ह,ै जिसे जवजनयम 7 के अधीन लेबल चस्ट्पा करने की अनुमजत दी गई ह;ै (छ) "अनुसूची" से इन जवजनयमों से उपाबद्ध अनुसूची अजभप्रेत ह;ै (ि) "स्ट्टार रेटटंग या स्ट्टार लेवल" से अजधजनयम की धारा 14 के खंड (क) के अधीन केंरीय सरकार द्वारा अजधसूजचत वार्षाक ऊिाा खपत पर आधाठरत डीप फ्रीिर के लेबल पर प्रदर्िात ऊिाा दक्षता का ग्रडे अजभप्रेत ह;ै और (झ) दकसी डीप फ्रीिर के संबंध में, "व्यापारी या जवक्रेता", से वह व्यजि अजभप्रेत ह ैिो ऐसे डीप फ्रीिर का जवक्रय या जवतरण करता ह ै और इसमें दकु ानदार, व्यापारी, जवजनमााता और ऐस े अनज्ञु ापत्रधारी सजममजलत ह ैं जिन्‍दह ें ऐसे डीप फ्रीिर पर लेबल लगाने की अनुमजत दी गई ह।ै (2) उन िब्दों और पदों के, िो इसमें प्रयुि ह ैंऔर पठरभाजषत नहीं ह,ैं दकन्‍दतु अजधजनयम म ेंपठरभाजषत ह,ैं वही अथा होंगे, िो उस अजधजनयम म ेंह।ैं 3. लबे ल पर प्रदर्िता दकए िान े वाली जवजिजियां- (1) प्रत्येक डीप फ्रीिर पर, उसके लेबल पर जनम्नजलजखत जवजिजिया ं प्रदर्िात की िाएगं ी, अथाात्:- क) स्ट्टार लेवल; ख) ऊिाा दक्षता ब्यरू ो का प्रतीक जचनन (लोगो); ग) साजधत्र का नाम; घ) जवजनमााता या आयातक और ब्ांड का नाम; ङ) मॉडल और जवजनमााण या आयात का वषा; च) डीप फ्रीिर का प्रकार (हाडा टॉप अथवा ग्लास टॉप चेस्ट्ट फ्रीिर); छ) भंडारण पठरमाण;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 ि) जवद्युत खपत (दकलोवाट-घंटा म ेंयूजनट प्रजत वषा); झ) जवजिि श्रृंखला कोड; और ञ) लेबल अवजध; (2) लेबल का जडिाइन, रंग, आकार और जवषय-वस्ट्त ुइन जवजनयमों से उपाबद्ध अनुसूची म ेंयथाजवजनर्दाष् ट होंगे। 4. लबे लों को प्रदर्िता करन े की समय सीमा - (1) स्ट् वजै छछक से अजनवाया व् यवस्ट्थ ा तक पारगमन - इन जवजनयमों के लाग ू होने की तारीख से छह मास की अवजध के भीतर प्रत्येक डीप फ्रीिर पर जवजनयम 3 में जवजनर्दाष्ट सभी जवजिजियों से युि एक लेबल प्रदर्िता दकया िाएगा। (2) अजनवाय ा ऊिा ा खपत मानकों का पनु रीक्षण.- अजधजनयम की धारा 14 के खडं (क) के अधीन केन्‍द रीय सरकार द्वारा अजधसूजचत पुनरीक्षण ऊिा ा खपत मानकों के प्रारंभ होन े पर, प्रत्येक अनुज्ञापत्रधारी या व्यापारी या जवक्रेता- (क) जपछले ऊिाा खपत मानकों वाले डीप फ्रीिर का उत्पादन नहीं करेगा; (ख) पुनरीजक्षत ऊिा ा खपत मानकों के साथ ससंक्रनाइज़ करत े हुए पुनरीजक्षत ऊिा ा खपत मानक के साथ पुनरीजक्षत स्ट्टार स्ट्तर और लेबल अवजध और डीप फ्रीिर का जवजनमााण वषा प्रदर्िात दकया िाएगा; (ग) व् यवहाठरयों, खुदरा जवक्रेताओं की िागरूकता, उनकी जिक्षा के साथ-साथ उपभोिाओं की जिक्षा के जलए आवश्यक प्रचार सजहत प्रारंजभक कदम सुजनयोजित हों और कारावाई तीन मास पहल े की िाए। 5. लबे ल प्रदर्िता करन े की रीजत - (1) डीप फ्रीिर पर एक लेबल लगाया िाएगा जिसे जवक्रय स्ट्थल पर प्रदर्िात दकया िाएगा और ऐसा लेबल डीप फ्रीिर पर जनम्नजलजखत रीजत से चस्ट्पा दकया िाएगा, अथाात्: - (i) लेबल को प्रत्येक साजधत्र के सामने की ओर ऊपरी दाए ंजहस्ट्से पर दढ़ृ ता से चस्ट्पा दकया िाएगा। (ii) लेबल स्ट्वयं जचपकन े वाली सामग्री का होना चाजहए। अनसु ूची में अपेजक्षत अंकन सुपाठ्य, अजमट और जचरस्ट्थायी होन े चाजहए। (2) जडस्ट् ् ल े रजहत डीप फ्रीिर के जलए, लेबल को पैककंग के बाहरी जहस्ट्स े पर चस्ट् पा दकया िाए और जबक्री के जलए रख े िाने पर लेबल को यूजनट के साथ संलग् न दकया िाए। 6. लबे ल प्रदर्िता करन ेकी अनमु जत - (1) ब्यूरो की पूवाानुमजत प्राप्त दकए जबना डीप फ्रीिर पर कोई स्ट्टार लेबल चस्ट्पा नहीं दकया िाएगा। (2) कंपनी रजिस्ट् रीकरण - उप-जवजनयम (1) के अधीन ब्यूरो की अनुमजत प्राप्त करन े के प्रयोिनों के जलए, रजिस्ट् रीकरण के जलए कोई आवेदन प्ररूप I म ें यथाजवजनर्दाष् ट प्रत्येक ब्ांड के जलए अलग से भगु तान के दकसी भी स्ट्वीकाया इलेक्रॉजनक मोड द्वारा देय एक लाख रूपए के लेबल प्रजतभूजत िमा के साथ प्रस्ट्ततु दकया िाएगा। (3) मॉडल रजिस्ट् रीकरण- उप-जवजनयम (2) के अधीन अनज्ञु ापत्रधारी के प्रत्येक आवेदन के साथ- (क) भुगतान के दकसी भी स्ट्वीकाया इलेक्रॉजनक मोड द्वारा देय प्रजत मॉडल दो हिार रुपय े का आवदे न िीस िमा की िाएगी; (ख) प्ररूप II म ेंजवजनर्दाष् ट दस्ट्तावेि प्रस्ट्तुत दकए िाएंगे। 7. अनमु जत प्रदान करना (1) जवजनयम 6 के अधीन कोई आवदे न प्राप्त होन े पर और यह समाधान हो िान े के पश्चात ् दक इसमें सभी अपेक्षाओं का अनुपालन दकया िाता है, ब्यूरो, घरेलू उपकरणों में स्ट् टार लेबसलगं का प्रसार, ददिा (मानक और लेबसलगं के संबंध में ब्यूरो की काया जनयमावली) में जवजनर्दाष् ट अवजध के भीतर, जवजनयम 8 में यथाजवजनर्दाष् ट ऐस े जनबंधनों और ितों के अध्यधीन, - (क) इलेक्रॉजनक मोड के माध्यम से प्ररूप III में ब्ांड को रजिस्ट् रीकृत कर सकता ह;ै या (ख) इलेक्रॉजनक मोड के माध्यम से प्ररूप IV म ेंडीप फ्रीिर पर लेबल लगाने की अनुमजत प्रदान कर सकता ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (2) ब्यूरो, प्ररूप V में एक रजिस्ट्टर बनाए रखगे ा और उसम ेंअनुज्ञापत्रधारी का नाम दिा करेगा। (3) उप-जवजनयम (1) के अधीन इस प्रकार प्रदान की गई अनुमजत ऐसी अवजध के जलए जवजधमान्‍द य होगी िब तक अजधजनयम की धारा 14 के खडं (क) के अधीन केंरीय सरकार द्वारा यथाअजधसूजचत ऊिा ा खपत मानक द्वारा जवजनर्दाष् ट स्ट्टार लेवल प्रभावी रहत ेह।ैं (4) स्ट्टार रेटटंग योिना के पनु रीक्षण की दिा म,ें अनुज्ञापत्रधारी द्वारा अनज्ञु ा के नवीनीकरण के जलए आवेदन इसकी समाजप्त के एक मास के भीतर दकया िाएगा और इसके साथ ऊिाा दक्षता ब्यूरो, नई ददल्ली के पक्ष म ें इलेक्रॉजनक मोड म ें दये एक हिार रुपए की िीस िमा की िाएगी। परंत,ु स्ट्टार रेटटंग योिना के जवस्ट्तार की दिा म,ें एक हिार रुपये के उि नवीनीकरण िीस से छूट दी िाएगी। (5) ऊिा ा खपत मानक के जलए जवजधमान्‍द यता की प्रभावी अवजध के भीतर नवीकृत न दकए गए आवेदन को उस समय तक समाप्त माना िाएगा िब तक दक नवीनीकरण के जलए आवेदन प्रस्ट्तुत नहीं दकया िाता और ब्यरू ो द्वारा इस े सिलतापूवाक अनुमोददत नहीं दकया िाता ह।ै (6) उप-जवजनयम (4) के अधीन नवीनीकरण के जलए आवेदन प्राप्त होन े पर और यह समाधान हो िाने के पश्चात् दक सभी अपेक्षाओं का अनुपालन दकया गया ह,ै ब्यूरो, ऐसी प्राजप्त की तारीख से एक मास की अवजध के भीतर, प्ररूप IV म ें अनुमजत को नवीकृत कर सकता ह।ै (7) ऐसा अनुज्ञापत्रधारी, िो उस तारीख, जिससे पनु रीजक्षत स्ट्टार लेवल प्रभावी होता ह,ै से डीप फ्रीिर के जवद्यमान मॉडल पर लेबल चस्ट्पा करना िारी रखन े की अनुमजत चाहता है, प्ररूप VI में एक घोषणा प्रस्ट्तुत करेगा। (8) यदद डीप फ्रीिर के नए मॉडल को पुनरीजक्षत स्ट्टार लेवल के साथ समकालीन बनात े हुए आरमभ करन े की योिना ह,ै तो अनुज्ञापत्रधारी को लेबल चस्ट्पा करन े के जलए नए जसरे से अनुमजत प्राप्त करनी होगी, और ऐसी अनुमजत के जलए आवेदन, पुनरीजक्षत स्ट्टार लेवल के प्रभावी होने से छह मास पहले दकया िाएगा। 8. लबे ल पर जवजिजिया ंप्रदर्िता करन े के जनबधं न और ित-ें प्रत्येक अनुज्ञापत्रधारी, व्यापारी और जवक्रेता,- क) अजधजनयम की धारा 14 के खंड (क) के अधीन अजधसूजचत डीप फ्रीिर के जलए ऊिाा खपत मानकों का अनुपालन करेगा; ख) डीप फ्रीिर के केवल ऐस ेमॉडल पर लेबल चस्ट्पा करेगा जिसके जलए अनुमजत दी गई ह;ै ग) डीप फ्रीिर पर लेबल अनुज्ञापत्रधारी की लागत पर चस्ट्पा करेगा; घ) यह सुजनजश्चत करेगा दक डीप फ्रीिर के लेबल पर प्रदर्िता स्ट्टार लेवल हर समय बनाए रखा िाता ह;ै ङ) जवजनयम 9 में यथाजवजनर्दाष् ट लबे ल िीस का भुगतान करेगा; च) ब्यूरो को, जविीय वषा की प्रत्येक जतमाही की समाजप्त के अगले मास के भीतर लेबलीकृत उपस्ट् करों के जवजनमााण और प्रत्येक जतमाही के जलए देय प्रोद्भूत लेबसलंग िीस के ब्यौरों को सजममजलत करते हुए एक जववरण प्रस्ट्तुत करेगा; छ) प्रत्येक वष ा के 30 अप्रलै तक अपन े लेबलीकृत उत्पादों को बेचन े के जलए जनयुि अजधकृत जवतरकों, व् यवहाठरयों, खुदरा जवक्रेताओं, जवक्रेताओं की एक अद्यतन सूची ब्यूरो को प्रस्ट्ततु करेगा; ि) ऐसे अन्‍दय जनबंधनों और ितों का अनुपालन करेगा जिन्‍दह ें ब्यरू ो जवजनर्दाष् ट कर सकती ह,ै जिनमें घरेल ू साजधत्रों में स्ट् टार लेबसलंग का प्रसार, ददिा (मानक और लेबसलगं के संबंध में ब्यरू ो की काया जनयमावली) म ें यथाजनजहत जनबंधन और ित ें भी िाजमल होंगे। 9. लबे ल िीस - (1) प्रत्येक अनज्ञु ापत्रधारी डीप फ्रीिर पर चस्ट्पा दकए गए प्रत्येक लेबल के जलए ब्यूरो को 5/- रुपय े (पांच रुपये मात्र) के लेबल िीस का भुगतान करेगा; (2) उप-जवजनयम (1) के अधीन जवजनर्दाष्ट लेबल िीस का भगु तान वार्षाक रूप से प्रत्येक जविीय वषा के समाप्त होन े की तारीख से एक मास के भीतर दकया िाएगा;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 परंत ु इस प्रकार जवजनर्दाष् ट अवजध के भीतर लेबल िीस का भगु तान करने म ें जविल रहन े पर, ब्यूरो, जवजनयम 6 के उप- जवजनयम (3) के खंड (ख) के अधीन संदि लेबल प्रजतभूजत िमा से प्रजत वष ा दस प्रजतित की दर से ब्याि सजहत देय राजि की वसूली कर सकता ह ै और यदद इसे िमा करने की अंजतम तारीख के एक वष ा के भीतर समपूणा लेबसलगं िीस की वसूली नहीं की िाती ह,ै तो ब्यूरो अनुज्ञापत्रधारी को प्रदान की गई लेबल की अनुमजत को जनरस्ट्त कर सकता ह ै और राष्ट्रीय या क्षेत्रीय दैजनक समाचार पत्रों और इलेक्रॉजनक माध्यमों म ेंउसका नाम चूककताा के रूप में प्रकाजित कर सकता ह।ै 10. लबे ल प्रजतभजू त िमाराजि की वापसी - जवजनयम 9 के उप-जवजनयम (2) के उपबधं ों के अधीन, डीप फ्रीिर का जवजनमााण बंद करन े पर अनुज्ञापत्रधारी लेबल प्रजतभूजत िमाराजि की वापसी का हकदार होगा। 11. ब्यरू ो द्वारा सत्यापन - (1) ब्यूरो या इसकी अजभजहत व् यवहारी, या तो स्ट्वप्रेरणा स,े या उसके द्वारा प्राप्त जिकायत पर, यह सुजनजश्चत करने के जलए सत्यापन कर सकती ह ै दक डीप फ्रीिर, स्ट्टार लेवल और इसके लेबल पर प्रदर्िता अन्‍दय जवजिजियों के अनरूु प ह ैऔर दक यह अनुमजत के अन्‍दय जनबंधनों और ितों का अनुपालन करता ह।ै (2) सत्यापन और आपजि (चैलिें ) परीक्षण के उद्दश्े य से वार्षका ऊिाा खपत, पलु डाउन टाइम और भंडारण पठरमाण परीक्षण सजहत सभी परीक्षण दकए िाएंगे। (3) सत्यापन के प्रयोिनाथ,ा ब्यरू ो या इसकी अजभजहत व् यवहारी द्वारा जवजनमााण सुजवधा, गोदाम या खुदरा आउटलेट, िो वह उजचत समझे, स ेयादजृ छछक रूप स ेनमून े जलए िाएंगे। (4) िहा,ं उप-जवजनयम (1) के अधीन प्राप्त जिकायत पर, ब्यूरो को राष्ट्रीय परीक्षण और अिं ांकन प्रयोगिाला प्रत्यायन बोडा द्वारा सम यक रूप से प्रत्याजयत दकसी स्ट्वतंत्र प्रयोगिाला में डीप फ्रीिर का आपजि (चैलेंि) परीक्षण द्वारा सत्यापन कराना अपेजक्षत ह-ै (क) ब्यूरो ऐसे परीक्षण के संचालन के जलए अनुज्ञापत्रधारी को नोठटस िारी करेगा और जिकायतकताा को नमूना लागत, परीक्षण, पठरवहन स े संबंजधत ऐसे व्यय और अन्‍दय प्रासजं गक व्यय राजि, िो ब्यूरो द्वारा अवधाठरत दकए िाएं, को ब्यरू ो के पास िमा कराने के जलए कहा िाएगा। (ख) यदद आपजि (चलै ेंि) परीक्षण के अधीन जलया गया नमनू ा जविल हो िाता है, तो अनज्ञु ापत्रधारी द्वारा ब्यरू ो को यथाजवजनर्दाष् ट सभी व्यय राजि की प्रजतपूर्ता की िाएगी और ब्यूरो, जिकायतकताा को उपरोि व्यय राजि वापस कर दगे ा; और (ग) िहां साजधत्र आपजि (चलै ेंि) परीक्षण म ें सिल रहता ह,ै तो जिकायतकता ा द्वारा िमा की गई व्यय राजि को िब्त कर जलया िाएगा। (5) िहां, उप-जवजनयम (1) के अधीन प्राप्त जिकायत पर, यदद अनुज्ञापत्रधारी ऐस े समय के भीतर उप-जवजनयम (3) म ें जनर्दाष् ट ऐसी व्यय राजि को िमा करने म ेंजविल रहता ह,ै तो ब्यूरो- (क) उप-जवजनयम (3) म ेंजनर्दाष् ट डीप फ्रीिर का आपजि (चलै ेंि) परीक्षण द्वारा सत्यापन िारी रखगे ा; होगा; (ख) लेबल को केवल डीप फ्रीिर के ऐसे मॉडल पर मुरांदकत दकया िाएगा, जिसके जलए अनुमजत दी गई ह;ै (ग) लेबल को उत्पाद डीप फ्रीिर पर चस्ट्पा दकया िाएगा और अनज्ञु ापत्रधारी की लागत पर उत्पाद पैकेसिंग पर मुदरत/चस्ट्पा दकया िाएगा; (घ) अनुज्ञापत्रधारी यह सुजनजश्चत करेगा दक डीप फ्रीिर पर प्रदर्िता स्ट्टार लेवल हर समय बना रह;े (ङ) अनुज्ञापत्रधारी ब्यूरो द्वारा जवजनर्दाष् ट लेबल िीस का भगु तान करेगा; (च) अनुज्ञापत्रधारी जविीय वषा की प्रत्येक जतमाही की समाजप्त के अगले मास के भीतर ब्यूरो को एक ब् यौरा प्रस्ट्तुत करेगा, प्रत्येक जतमाही के जलए लेबलीकृत उपस्ट् कर के उत्पादन और प्रोद्भतू लेबसलगं िीस का ब्यौरा होगा। ये ब्यौरे स्ट्वचाजलत प्रणाली के माध्यम स ेभी ब्यरू ो को प्रस्ट्तुत दकए िाएंग;े (छ) अनुज्ञापत्रधारी, डीप फ्रीिर, जिसके जलए अनुमजत दी गई है, के ऐसे अन्‍दय ब्यौरे, िो ब्यरू ो द्वारा अपेजक्षत Freezer/128/2022-23.—Whereas the draft regulations namely, the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Deep Freezers) Regulations, 2022, were published vide notification number BEE/S&L/Deep Freezer/128/2022-23 as required under sub-section (1) of section 58 of the Energy Conservation Act, 2001 (52 of 2001), inviting objections or suggestions from persons likely to be affected thereby within the specified period of thirty days from the date of publication of the said notification in the Official Gazette; And whereas copies of the said draft regulations were made available to the public on 29th June, 2022; And whereas suggestions have been received with respect to the said draft regulations within the period aforesaid; And whereas the suggestions received in this regard have been taken into consideration; Now, therefore, in exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 and clause (d) of section 14 of the Energy Conservation Act, 2001 (52 of 2001), the Bureau, with the previous approval of the Central Government, hereby makes the following regulations, namely:- 1. Short title and commencement.– (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Deep Freezers) Regulations, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.- (1) In these regulations, unless the context otherwise requires,- (a) “Act” means the Energy Conservation Act, 2001(52 of 2001); (b) “Deep Freezer” means an appliance as specified in the notification under clause (b) of section 14 of the Act. The product category covers hard top and glass top type deep freezers; (c) “Form” means a form appended to these regulations;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 25 (d) “label” means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon the Deep Freezer (e) “label period” means the validity period of the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, provided that if, by the ending timeline of the label validity period, the new energy consumption standards under clause (a) of section 14 of the Act are not notified, the existing standards shall deemed to be valid until new values for the same are notified by the Central Government; (f) “permittee” means a person or agency to whom permission has been granted to affix label under regulation 7; (g) “Schedule” means the Schedule annexed to these regulations; (h) “star rating or star level” means the grade of energy efficiency displayed on the label of the deep freezer based on annual energy consumption notified by the Central Government under clause (a) of section 14 of the Act; and (i) “trader or seller” in relation to any deep freezer means a person who sells or distributes such deep freezer and includes shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such deep freezer. (2) Words and expressions used herein and not defined, but defined in the Act, shall have meaning respectively assigned to them in the Act. 3. Particulars to be displayed on label.- (1) On every deep freezer, the following particulars shall be displayed on its label, namely:- (a) star level; (b) logo of the Bureau of Energy Efficiency; (c) name of appliance; (d) name of manufacturer or importer and brand; (e) model and year of manufacturing or import; (f) type of deep freezer (hard top or glass top chest freezer); (g) storage volume; (h) electricity consumption (units per year in kWh); (i) unique series code; and (j) label period; (2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations. 4. Time limit for display of labels.- (1) Transition from Voluntary to Mandatory regime.- A label containing all the particulars specified in regulation 3 shall be displayed on every deep freezer within a period of six months from the date of coming into force of these regulations. (2) Revision of Mandatory Energy Consumption Standards.- On and from commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller- (a) shall not produce the deep freezer with the previous energy consumption standards; (b) shall display revised star level and label period with the revised energy consumption standard and the manufacturing year of the deep freezer in synchronization with revised energy consumption standards; (c) shall take necessary preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers are well planned and action taken three months in advance. 5. Manner of display of label.- (1)There shall be a label on deep freezer which shall be displayed at the point of sale and such label shall be affixed on deep freezer in the following manner, namely:- (iii) the label shall be firmly affixed on upper right portion on front side of each appliance; (iv) the label shall be of self- adhesive material. The markings required by the schedule shall be legible, indelible and durable. (2) For deep freezer not on display, the label may be affixed to the exterior of the packing and the label may be attached to the unit when put on sale. 6. Permission for display of label.- (1) No star label shall be affixed on a deep freezer without obtaining the prior permission of the Bureau.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (2) Company registration.- For the purposes of obtaining permission of the Bureau under sub-regulation (1), an application for registration shall be made for every brand separately as specified in Form I, accompanied by a label security deposit of One lakh rupee payable by any acceptable electronic mode of payment. (3) Model registration.- Every application of the permittee under sub-regulation (2) shall be accompanied by— (a) an application fee of two thousand rupees per model, payable by any acceptable electronic mode of payment; (b) documents specified in Form II. 7. Grant of permission.- (1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in Disseminating Star Labeling in Household Appliance, DISHA (Bureau’s Operation Manual on Standards and Labelling) subject to such terms and conditions as specified in regulation 8, – (a) register the brand in Form III via electronic mode; or (b) grant permission for affixing label on deep freezer in Form IV via electronic mode. (2) The Bureau shall maintain a register in Form V and enter the name of the permittee therein. (3) The permission so granted under sub-regulation (1) shall be valid for such period till which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of section 14 of the Act is in force. (4) In case of revision of star rating plan, an application for renewal of permission shall be made by the permittee not later than one month before its expiry and shall be accompanied by a fee of rupees one thousand payable in electronic mode in favour of the Bureau of Energy Efficiency, New Delhi. Provided, in case of extension of star rating plan, the said renewal fee of rupees one thousand shall be exempted. (5) An application not renewed within the effective period of validity for the energy consumption standard shall be treated as expired till the time, application for renewal is submitted and successfully approved by the Bureau. (6) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form IV. (7) The permittee who seeks permission for continuance to affix label on the existing model of the deep freezer from the date from which the revised star level comes into force, shall submit a declaration in Form VI. (8) The permittee shall seek permission to affix label afresh, if new model of the deep freezer is planned to be launched synchronizing with the revised star level, and application for such permission shall be made six months in advance of coming into force of the revised star level. 8. Terms and conditions for display of particulars on label.- Every permittee, trader and seller shall,- (a) comply with the energy consumption standards for deep freezer notified under clause (a) of section 14 of the Act; (b) affix label only on such model of deep freezer for which permission has been granted; (c) affix label on deep freezer at the cost of the permittee; (d) ensure that the star level displayed on the label of deep freezer shall be maintained at all time; (e) pay the label fee as specified in regulation 9; (f) furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labelling fee due for each quarter within the following month of closure of each quarter of the financial year; (g) furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell their labelled products by 30thday of April of each year; and (h) comply with such other terms and conditions which the Bureau may specify including those contained in Disseminating Star Labeling in Household Appliance, DISHA (Bureau’s Operation Manual on Standards and Labelling). 9. Label fee. - (1) Every permittee shall pay to the Bureau a label fee of rupees five only for each label affixed on deep freezer; (2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of closure of each financial year; Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten per cent. per annum from the label security deposit paid under clause (b) of sub- regulation (3) of regulation 6 and if complete labelling fees are not recovered within one year of the last date of submission, the Bureau may cancel the permission to labels granted to the permittee and publish his name in the national or regional daily newspapers and in electronic means as a defaulter.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 27 10. Refund of label security deposit. - Subject to the provisions of sub-regulation (2) of regulation 9, the permittee shall be entitled to a refund of the label security deposit, on ceasing to manufacture deep freezer. 11. Verification by Bureau.- (1) The Bureau or its designated agency may, either suo motu, or on a complaint received by it, carry out verification to ensure that the deep freezer conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission. (2) All tests including the annual energy consumption, pull down time and storage volume tests shall be conducted for the purpose of verification and challenge testing. (3) For the purpose of verification, samples shall be picked up at random by the Bureau or its designated agency from the manufacturing facility, warehouse or the retail outlet as it deems fit. (4) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the deep freezer in an independent laboratory duly accredited by the National Accreditation Board for Testing and Calibration Laboratories,- (a) the Bureau shall issue a notice to the permittee for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to sample cost, testing, transportation and other incidental expenses with the Bureau, within such time, as may be determined by Bureau. (b) if the sample drawn under challenge testing fails, all expenses as specified shall be reimbursed by the permittee to the Bureau and the Bureau shall refund the aforesaid expenses to the complainant; and (c) where the equipment passes the challenge test, then the expenses deposited by the complainant shall be forfeited. (5) Where, upon a complaint received under sub-regulation (1), if the permittee fails to deposit such expenses referred to in sub-regulation (3) within such time, the Bureau shall,- (a) continue the verification by challenge testing the deep freezer referred to in sub-regulation (3); and (b) the processing of application received under regulation 6 may be kept in abeyance till such expense are deposited. (6) Where a sample of deep freezer used for testing fails the test during suo motu testing or challenge testing, the Bureau shall offer the permittee, another opportunity and conduct a second test with twice the quantity of deep freezer used in the first test, in an independent test laboratory which is different from the lab where the first check testing was conducted and shall be duly accredited by the National Accreditation Board for Testing and Calibration Laboratories at the cost of the permittee. (7) Where the second test fails, the Bureau shall,- (a) direct the permittee in Form VII, under intimation to all the State designated agencies, that the permittee within a period of two months shall,- (i) correct the star level displayed on the label of the deep freezer or remove the defects and deficiencies found during testing; (ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and (iii) change the particulars displayed on advertising material. (b) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months; (c) intimate to the concerned State designated agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act. (8) The permittee shall, within ten days of the conclusion of the period of two months referred to in sub- regulation (6),- (a) send the compliance report in Form VIII to the Bureau with respect to action taken in compliance with the direction; and (b) in case the compliance report referred to in clause (a) is not received or received without complying to any of the direction within the specified period, it shall be deemed to be non-compliance of the direction issued and orders to that effect shall be passed by the Bureau. (9) The Bureau shall send the compliance report referred to in clause (a) and orders passed in clause (b) of sub- regulation (7) along with necessary documents to all the State designated agencies for the purpose of taking action under section 17 and enforcement of order passed under clause (b) of said sub-regulation. (10) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (6), the Bureau under intimation to all State Designated Agencies shall,- (a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7; (b) send a report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] Government under clause (a) of section 14, the directions of the Bureau referred to in clause (a) of sub-regulation (7) for consideration and taking action under clause (c) of section 14 of the Act by the Central Government; (c) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months; (d) intimate to the concerned State designated agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act. 12. Cancellation of permission. - The Bureau may cancel the permission granted under regulation 7, if the permittee,- (a) fails to comply with any of the terms and conditions specified under regulation 8; (b) fails to pay label fee within the period specified under regulation 9; (c) fails to comply with the directions issued under regulation 11; and (d) Provided that no permission shall be cancelled without giving an opportunity of being heard to the permittee.
