औ िबदक उक्त 06 , 2019 लए उ ल कराई गई थीं; औ उपरोक्त अंद उक्त प्रारूप जि स स हुए ह;ैं अत: अब ऊिाा संरक्षण अजधजनयम 2001 (2001 का 52) की धारा 58 की उपधारा (2) के खंड (झ) और धारा 13 की उपधारा (2) के खडं (ढ) के साथ पठित धारा 14 के खडं (घ) द्वारा प्रदत् त िजययों का प्रयोग करत े हुए ब् यरू ो, केन्‍द रीय सरकार के पूि ा अनुमोदन स े ऊिाा दक्षता ब् यरू ो (ट्यूबलु र फ्लोरसेंट लपैं के लेबलों पर उनके प्रदिना की जिजिजियां और रीजत) अजधजनयम, 2018 को संिोजधत करके जनम्न जलजखत जिजनयम बनाती ह,ै अथाात ् :- (1) इन जिजनयमों का संजक्षप् त नाम ऊिा ा दक्षता ब्यरू ो (ट्यूबुलर फ्लोरसेंट लैम्पों के लेबलों पर उनके प्रदिान की जिजिजियां और रीजत), संिोधन जिजनयमन, 2020 ह।ै (2) ये रािपि में उनके प्रकािन की तारीख को प्रिृत् त होंगे।. 2643 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] 2. ऊिाा दक्षता ब् यूरो (ट्यूबलु र फ्लोरसेंट लैम्पों पर उनके प्रदिना की जिजिजियां और रीजत) जिजनयम 2018 (जिसे इसके पश् चात ् उक्त जिजनयम कहा गया) के जिजनयम 6 में, - (i) उप जिजनयम (2) के स्ट्थ ान पर जनम्न जलजखत रखा िाएगा, अथाात् :- “(2) उप-जिजनयम (1) के अधीन ब्यूरो की अनुमजत अजभप्राप्त करन े के प्रयोिन के जलए, अनुज्ञाधारक को हर ब्ांड के जलए अलग स े पंिीकरण कराने के जलए प्ररूप 1 के अनुसार ऑनलाइन आिेदन करना होगा, जिसके साथ एक लाख रुपए की लेबल प्रजतभूजत फीस दये होगी, िो केिल भुगतान के दकसी भी स्ट्िीकाय ा इलेक्रॉजनक मोड द्वारा देय होगी। परंत ुलघु उद्योग के जलए लेबल प्रजत भूजत िल्ु क पच् चीस हिार रुपए होगा; " (ii) उप-जिजनयम (3) म ें खंड (क) और (ख) के स्ट् थान पर जनम्न जलजखत खंड रख ेिाएंग,े अथाात ् :- “(क) भुगतान के दकसी भी स्ट्िीकाय ा इलेक्रॉजनक मोड द्वारा दये प्रजत मॉडल दो हिार रुपए की आिेदन फीस; और “ख) ऑनलाइन आिेदन िमा करते समय पोटाल पर प्ररूप 1 म ें जिजनर्ददि दस्ट्तािेिों को सम् यक सीलबंद रूप म ेंऔर मुहर लगाकर अपलोड दकया िाएगा; परंत,ु ऑनलाइन आिेदन की कोई हाडा कॉपी, प्ररूप 1 और अन्‍दय दस्ट्तािेिों को ऊिाा दक्षता ब् यूरो के कायाालय को भेिने की आिश् यकता नहीं ह।ै '' (3) उक्त जिजनयमों के जिजनयम (7) म,ें उप जिजनयम (4) के स्ट् थान पर जनम्न जलजखत उपजिजनयम रखा िाएगा, अथाात ् :- “(4) निीकरण अनुमजत के जलए अनुज्ञाधारक इसके समाप् त होने के हह महीन े स े पहले, लदे कन इसकी समाजप्त स े तीन महीने पहल े नहीं, आिेदन करेगा, और दकसी भी स्ट्िीकाय ा इलेक्रॉजनक मोड द्वारा दये एक हिार रुपए की फीस के साथ होगा। ” (4) उक्त जिजनयमों की अनुसूची म,ें - (क) परै ा (1) म,ें - (I) उप पैरा (झ) के,- (i) खंड (क) लोप दकया िाएगा; खंड (ख) के स्ट्थ ान पर जनम्न जलजखत रखा िाएगा, अथाता ् :- (i) बाहरी आिरण या स्ट् लीि पर लगाए िाने िाले लेबल के आयाम ठटप्प ण : बाहरी आिरण के आकार के अनुसार लेबल के आयाम अपेक्षाकृत कम हो सकत ेहैं, बिते दक लेबल के पहलू अनुपात समान बन ेरह।ें[भाग III—खण् ड 4] भारत का रािपि : असाधारण 3 (ii) ट्यूबुलर फ्लोरसेंट लैंप पर मुरांकन करन े के जलए लेबल का आकार ठटप्प ण : लबेल के आयामों को ट्यूबुलर फ्लोरसेंट लपैं के व्यास के अनुसार अपक्षे ाकृत कम दकया िा सकता है, बिते दक लेबल के पहलू अनुपात समान बन ेरह।ें (II) उप परै ा (ii) में , - (i) खंड (क) लोप दकया िाएगा; (ii) खंड (ख) के स्ट्थ ान पर जनम्न जलजखत रखा िाएगा, अथाता ् :- (ख) उपाबंध के प्ररूप II म,ें परै ा 3 में उप-पैरा (1) के, - (i) खंड (क) लोप दकया िाएगा; (ii) खंड (ख) के स्ट्थ ान पर जनम न् जलजखत रखा िाएगा, अथाात ् :- पि म ें प्रदान दकए गए अजद्वतीय लेबल श्ृंखला कोड को ट्यूबुलर फ्लोरोसेंट लैंप के बाहरी आिरण / स्ट्ल ीि पर जचपकाए गए लेबल म ें उजल्लजखत दकया िाना ह।ै अभय बाकरे, महाजनदेिक, ऊिा ा दक्षता ब्यरू ो [जिज्ञापन-III/4/असा./78/2020-21] ठटप्प ण : ऊिाा दक्षता ब्यरू ो (ट्यूबुलर फ्लोरसेंट लैम्पों के लबे लों पर उनके प्रदिान की जिजिजियां और रीजत) जिजनयम, 2018 भारत के रािपि असाधारण भाग III खंड 4 में अजधसूचना संख् या बीईई/एसएण् डएल/टीएफएल/ 63/2017-18 तारीख 09 माच,ा 2018 के द्वारा प्रकाजित दकए गए थे।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] THE BUREAU OF ENERGY EFFICIENCY NOTIFICATION New Delhi, the 18th June, 2020 No. BEE/S&L/TFL/63/2020-21.—Whereas the draft regulations namely, the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps) Amendment Regulations, 2019, were pre-published vide notification number No. BEE/S&L/TFL/63/2019-20, dated the 6th November, 2019, as required under sub-section (1) of section 58 of the Energy Conservation Act, 2001 (52 of 2001), inviting objections or suggestions from persons likely to be affected thereby within the period of thirty days from the date on which the said notification containing the said draft regulations as published in the Official Gazette was made available to the public; And whereas copies of the said Official Gazette were made available to the public on the 6th November, 2019; And whereas no suggestions have been received with respect to the said draft regulations within the aforesaid period; Now, therefore, in exercise of the powers conferred by clause (d) of section 14 read with clause (i) of sub-section (2) of section 58 and clause (n) of sub-section (2) of section 13 of the Energy Conservation Act, 2001 (52 of 2001), the Bureau, with the previous approval of the Central Government, hereby makes the following regulations to amend the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps) Regulations, 2018, namely:- 1. (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps) Amendment Regulations, 2020. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps) Regulations, 2018 (hereinafter referred to as the said regulations), in regulation 6,- (i) for sub-regulation (2), the following shall be substituted, namely:- “(2) For the purposes of obtaining permission of the Bureau under sub-regulation (1), the permittee shall make online application as per Form I to register himself for every brand separately, accompanied by a label security fee of one lakh rupees, payable by any acceptable electronic mode of payment: Provided that the label security fee for small scale industry shall be twenty-five thousand rupees.”; (ii) in sub-regulation (3), for clauses (a) and (b), the following clauses shall be substituted, namely:- “(a) an application fee of two thousand rupees per model, payable by any acceptable electronic mode of payment; and “(b) the documents specified in Form I shall be duly sealed and stamped and uploaded on the portal while submitting application online: Provided that no hard copy of such online application, Form I and other documents are required to be send to the office of Bureau.”. 3. In regulation 7 of the said regulations, for sub-regulation (4), the following sub-regulation shall be substituted, namely:- “(4) The permittee shall apply for renewal of permission before six months but not later than three months before its expiry and shall be accompanied by a fee of one thousand rupees payable by any acceptable electronic mode of payment.”. 4. In the Schedule to the said regulations,- (A) in paragraph (1),- (I) in sub-paragraph (i),-[भाग III—खण् ड 4] भारत का रािपि : असाधारण 5 (i) clause (a) shall be omitted; (ii) for clause (b), the following shall be substituted, namely:- “(i) Dimension of the label to be affixed on outer casing or sleeve Note: The dimensions of label may be relatively reduced in accordance with the size of the outer casing, provided the aspect ratio of the label shall remain the same. (ii) Dimension of the label to be stamped on the tubular fluorescent lamp Note: The dimensions of label may be relatively reduced in accordance with the diameter of the tubular fluorescent lamp, provided the aspect ratio of the label shall remain the same.”; (II) in sub-paragraph (ii),- (i) clause (a) shall be omitted; (ii) for clause (b), the following shall be substituted, namely:- “ ”; (B) in Form II, in the Annexure, in paragraph 3, in sub-paragraph (1),- (i) clause (a) shall be omitted; (ii) for clause (b) the following shall be substituted, namely:- “6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] The unique label series code provided in the letter has to be mentioned in the label affixed on the outer casing/ sleeve of the tubular fluorescent lamp.”.
