L.-33004/99 vlk/kj.k EXTRAORDINARY Hkkx III—[k.M 4 PART III—Section 4 izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 231] ubZ fnYyh] c`gLifrokj] ebZ 26] 2016@T;s"B 5] 1938 No. 231] NEW DELHI, THURSDAY, MAY 26, 2016/ JYAISTHA 5 , 1938 ऊऊऊऊजजजजाााा (cid:4)(cid:4) (cid:4)(cid:4)दददद(cid:7)(cid:7)(cid:7)(cid:7)तततताााा (cid:9)(cid:9)(cid:9)(cid:9)यय यय ूूररूूररोोोो अअअअििििधधधधससससचचूूचचूू ननननाााा नई (cid:4)द(cid:6)ल ी, 26 मई, 2016 ससससंं..ं.ं. बबबबीीीीईईईईईईईई ////एएएएसससस एएएए(cid:14)(cid:14)(cid:14)(cid:14)डड डड एएएएलललल////आआआआररररईईईईएएएएफफफफ////77770000////2222000011116666----11117777....———— कितपय िविनयम(cid:16) का िन(cid:18)न िलिखत (cid:20)(cid:21)प, ऊजा(cid:24) संर(cid:28)ण अिधिनयम, 2001 (2001 का 52) क धारा 58 क उपधारा (1) क अपे(cid:28)ानुसार अिधसूचना सं. बीईई /एस ए’ड एल/आरईएफ/70/2015-16. तारीख 5 अ)त ूबर, 2015 के अधीन ऊजा(cid:24) द(cid:28)ता *य ूरो (घरेलू सीधे ठ’ड े(cid:20)शीतक के लेबल(cid:16) पर उनके सं(cid:20)दश(cid:24)न क िविशि.यां और रीित) िविनयम 2015 उन सभी 0य ि1य(cid:16) से िजनके इससे (cid:20)भािवत होने क संभावना ह ै उ)त अिधसूचना के राजप6 म7 (cid:20)काशन क तारीख से प8तालीस (cid:4)दवस क अविध के भीतर आरोप और सुझाव आमंि6त करते <ए (cid:20)कािशत क गई थी ; और उ)त (cid:20)ा(cid:21)प िविनयमन(cid:16) क (cid:20)ितयां जनता को 05 अ)त ूबर, 2015 को उपल*ध करा दी गई थ?। और पूवAवत अविध के भीतर उ)त (cid:20)ा(cid:21)प िविनयमन(cid:16) के संबंध म7 सुझाव (cid:20)ाB त (cid:4)कए गए। अत: अब उ)त अिधिनयम क धारा 13 के उपख’ड (2) के ख’ड (ढ) और धारा 14 के ख’ड (घ) के साथ पCठत धारा 58 क उपधारा (2) के ख’ड (>) Dारा (cid:20)दEत शि1य(cid:16) का (cid:20)योग करते <ए *य ूरो केFG ीय सरकार के पूव(cid:24) अनुमोदन के साथ िन(cid:18)न िलिखत िविनयमन बनाती ह,ै अथा(cid:24)त् :- 1111.... ललललघघघघ ुु ुुशशशशीीीीषषषषकक(cid:4)(cid:4)कक(cid:4)(cid:4) औऔऔऔरररर आआआआररररंंंंभभभभ ::::----(1) इन िविनयम(cid:16) को ऊजा(cid:24) द(cid:28)ता *य ूरो (घरेलू सीधे ठंडे (cid:20)शीतक(cid:16) के लेबल(cid:16) पर उनके सं(cid:20)दश(cid:24)न क िविशि.यां और रीित), िविनयम, 2016 कहा जाए। (2) ये राजप6 म7 उनके अंितम (cid:20)काशन क तारीख को (cid:20)वृEत ह(cid:16)गे। 2222. पपपप(cid:29)(cid:29)(cid:29)(cid:29)ररररभभभभााााषषषषाााा ::::---- (1) इन िविनयम(cid:16) म7, जब तक संदभ(cid:24) म7 अFय था अपेि(cid:28)त न हो,- (क) ''अिधिनयम” से ऊजा(cid:24) संर(cid:28)ण अिधिनयम, 2001 अिभ(cid:20)ेत ह;ै (ख) ''डायरे)ट कूल (cid:20)शीतक'' से ह ैअिधिनयम क धारा 14 के ख’ड (ख) के अधीन अिधसूचना म7 िविनLदMट एक सािध6 अिभ(cid:20)ेत ह;ै 2654 GI/2016 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (ग) “(cid:20)(cid:21)प” से इन िविनयम(cid:16) के साथ संलN न (cid:20)(cid:21)प अिभ(cid:20)ेत ह;ै (घ) “लेबल” से सीधे ठंडे (cid:20)शीतक पर िचपकाया गया अथवा (cid:20)दOशत िलिखत, मु(cid:4)Gत, िचिPनत, मुहर लगी या Qा(cid:4)फक सामQी अिभ(cid:20)ेत है; (ङ) “लेबल अविध” से धारा 14 के ख’ड (क) के अधीन केFG सरकार Dारा िविनLदMट ऊजा(cid:24) खपत मानक के अधीन तुलनाEम क ऊजा(cid:24) खपत क िविधमाFय ता अविध से ह ै और य(cid:4)द तुलनाEम क ऊजा(cid:24) खपत क िविधमाFय ता क अविध क अंितम अविध िविनLदMट नह? क गई है, इस अविध को केFG ीय सरकार Dारा िविनLदMट नए मू(cid:6)य (cid:16) तक िविधमानय् मानी जाएगी; (च) “मॉडल अथवा मॉडल(cid:16) के पCरवार” से (cid:4)कसी िविशMट Tा’ड का मॉडल या मॉडल(cid:16) क Uेणी ह ैिजसके संबंध म7 परी(cid:28)ण CरपोटV का एकल समुWच य लागू ह ैऔर जहां (cid:20)Eय ेक मॉडल के समान भौितक ल(cid:28)ण, वाOषक िवZुत खपत, ऊजा(cid:24) कुशलता [त र और िनMप ादन ल(cid:28)ण समान अिभ(cid:20)ेत ह;8 (छ) “अनु\ाधारक” से ऐसे 0य ि1 या ऐसी एज7सी से ह ैिजसे िविनयम 7 के अधीन लेबल िचपकाने के िलए अनु\ा दी गई अिभ(cid:20)ेत ह;ै (ज) “[ट ार रे^टग अथवा [ट ार [त र” से सीधे ठंड े(cid:20)शीतक क तुलनाEम क िवZुत खपत को दशा(cid:24)न ेके िलए अिधिनयम क धारा 14 के ख’ड (क) के अधीन केFG सरकार Dारा अिधसूिचत ऊजा(cid:24) खपत मानक पर आधाCरत सीधे ठंडे (cid:20)शीतक के लेबल पर (cid:20)दOशत ऊजा(cid:24) कुशलता का Qेड ह;ै (झ) लेबल लगे सीधे ठंडे (cid:20)शीतक के संबंध म7 “0य ापारी अथवा िव_ेता” से उस 0य ि1 से अिभ(cid:20)ेत ह ैजो ऐस ेसीधे ठंडे (cid:20)शीतक क िब_ अथवा िवतरण करता ह ै और इसम7 ऐसे दकु ानदार, 0य ापारी, िविनमा(cid:24)ता और सीधे ठंडे (cid:20)शीतक पर लेबल िचपकाने के िलए अनुमित (cid:20)ाBत अनु\ाधारक शािमल ह।8 (2) यहां इसम7 (cid:20)यु)त जो श*द और अिभ0य ि1यां अपCरभािषत ह 8ले(cid:4)कन अिधिनयम म7 पCरभािषत ह,8 उनका अिधिनयम म7 उFह 7_मश: (cid:4)दया गया अथ(cid:24) ही होगा। 3. लेबल पर (cid:20)दOशत (cid:4)कए जाने वाली िविशि.यां.—(1) (cid:20)Eय ेक सीधे ठंडे (cid:20)शीतक पर, इसके लेबल पर िन(cid:18)न िलिखत िविशि.यां (cid:20)दOशत क जाएगी, अथा(cid:24)त्:- (क) ऊजा(cid:24) द(cid:28)ता *य ूरो का (cid:20)तीक िचPन; (ख) िविनमा(cid:24)ता अथवा आयातक और Tा’ड का नाम; (ग) सािध6 का (cid:20)कार; (घ) िनधा(cid:24)Cरत सकल आयतन; (ङ) िनधा(cid:24)Cरत भ’ड ारण आयतन; (च) िविनमा(cid:24)ण अथवा आयात का मॉडल नंबर और वष(cid:24); (छ) िवशेष Uृंखला कोड; (ज) इकाई (cid:20)ित वष(cid:24) म7 िबजली क खपत; (झ) [ट ार [त र; और (ञ) लेबल क अविध; (2) लेबल का िडजाइन, रंग, आकार और सामQी इन िविनयम(cid:16) के साथ उपांबध अनुसूची म7 यथा: िविनLदMट होगा। 4. लेबल(cid:16) के (cid:20)दश(cid:24)न के िलए समय-सीमा: (1) िविनयम 3 म7 िविनLदMट सभी िविशि.य(cid:16) वाला लेबल इन िविनयमन(cid:16) के लागू होने क तारीख से छह माह क अविध के भीतर (cid:20)Eय ेक सीधे ठंडे (cid:20)शीतक पर (cid:20)दOशत (cid:4)कया जाएगा। (2) क7Gीय सरकार Dारा अिधिनयम क धारा 14 के ख’ड (क) के अधीन लागू संशोिधत ऊजा(cid:24) खपत मानक(cid:16) के (cid:20)ारंभ होने पर और (cid:20)ारंभ होने से, (cid:20)Eय ेक अनु\ाधारक या 0य ापारी या िव_ेता सुि निaत करेगा (cid:4)क-¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3 (क) िब_ के िलए रखे गए सीधे ठंडे (cid:20)शीतक संशोिधत ऊजा(cid:24) खपत मानक(cid:16) के साथ सम_मण कर संशोिधत [ट ार [त र और संशोिधत लेबल अविध भी (cid:20)दOशत कर7गे और सीधे ठंडे (cid:20)शीतक का उEप ादन वष(cid:24) भी संशोिधत ऊजा(cid:24) खपत मानक(cid:16) के साथ सं_मण म7 होगा और पूव(cid:24) ऊजा(cid:24) खपत मानक(cid:16) के आधार पर सीधे ठंडे (cid:20)शीतक(cid:16) का उEप ादन नह? करेगा। (ख) डीलर(cid:16), खुदरा 0य ापाCरय(cid:16) को जानकारी देने के िलए उनक जाग(cid:21)कता के साथ ही उपभो)त ाb को िशि(cid:28)त करने के िलए अपेि(cid:28)त (cid:20)चार-(cid:20)सार सिहत सभी (cid:20)ारंिभक उपाय इन िविनयम(cid:16) के अधीन ऐसे (cid:20)ारंभ क तारीख से छह माह पूव(cid:24) िनयोिजत (cid:4)कए जाएंगे। 5. लेबल (cid:20)दOशत करने क रीित----(1) िब_ [थ ल पर (cid:20)Eय ेक सीधे ठंडे (cid:20)शीतक पर लेबल (cid:20)दOशत (cid:4)कया जाएगा और ऐसे लेबल सीधे ठंडे (cid:20)शीतक पर िन(cid:18)न िविध म7 िचपकाए जाएंगे, अथा(cid:24)त ् - (क) सीधे ठंडे (cid:20)शीतक पर के ऊपरी दाएं िह[स े म7 सामने क ओर िचपकाया <आ [व - आसंजक लेबल; (ख) काट(cid:24)न बॉ)स पर सामने क ओर िचपकाया <आ [व - आसंजक लेबल; (2) (cid:20)दOशत न (cid:4)कए गए सीधे ठंड े(cid:20)शीतक के िलए, लेबल पेdकग के बाहर िचपकाया जाए और जब इसे िब_ के िलए रखा जाए तो यह लेबल इकाई के साथ लगाया जाए। 6. लेबल (cid:20)दOशत करने क अनु\ा-(1) *य ूरो क पूव(cid:24) अनु\ा के िबना सीधे ठंडे (cid:20)शीतक पर कोई [ट ार लेबल नह? िचपकाया जाएगा। (2) उप- िविनयम (1) के तहत *य ूरो क अनु\ा लेने के (cid:20)योजन के िलए, आवेदन (cid:20)(cid:21)प- I म7 और इले)e ॉिनक (cid:20)(cid:21)प म7 (cid:4)कया जाएगा; परंतु सीधे ठंडे (cid:20)शीतक के (cid:20)Eय ेक मॉडल के िलए पृथक आवेदन (cid:4)कया जाए; (3) उप- िविनयम (2) के अधीन (cid:20)Eय ेक आवेदन- प6 के साथ िन(cid:18)न िलिखत संलNन ह(cid:16)गे – (क) ऊजा(cid:24) द(cid:28)ता *य ूरो, नई (cid:4)द(cid:6)ल ी के प(cid:28) म7 दो हजार fपए का आवेदन शु(cid:6)क अथवा भुगतान के (cid:4)कसी (cid:20)ितQाgय इले)e ॉिनक ढंग म7 देय होगा; (ख) ऊजा(cid:24) द(cid:28)ता *य ूरो, नई (cid:4)द(cid:6)ल ी के प(cid:28) म7 देय एक लाख fपए क लेबल (cid:20)ितभूित शु(cid:6)क ; मांग प6 या भुगतान के (cid:4)कसी (cid:20)ितQाgय इले)e ॉिनक ढंग म7। परंतु, लघु उZोग के मामले म7, (cid:20)ितभूित शु(cid:6)क केवल पWच ीस हजार fपए होगी-; और (ग) (cid:20)(cid:21)प-1 म7 ययययथथथथाााा:::: िविनLदMट द[त ावेज ; 7. अनु\ा (cid:20)दान करना---- (1) िविनयम 6 के अधीन कोई आवेदन (cid:20)ाBत होने पर और इससे संतुMट होने पर (cid:4)क इसम7 दी गई सभी अपे(cid:28)ाb का पालन (cid:4)कया गया ह,ै *य ूरो ऐसी (cid:20)ािi क तारीख से एक माह क अविध के भीतर, िविनयम 8 म7 यथा: िविनLदMट िनबंधन(cid:16) एवं शतV के अjय धीन सीधे ठंडे (cid:20)शीतक पर (cid:20)(cid:21)प-II अथवा इले)e ॉिनक (cid:20)(cid:21)प म7 लेबल िचपकाने के िलए अनु\ा (cid:20)दान कर सकता ह।ै (2) *य ूरो, (cid:20)(cid:21)प -III म7 रिज[ट र बनाकर रखेगा और इसम7 अनु\ाधारक के नाम (cid:20)िवMट करेगा; (3) उप- िविनयम (1) के अधीन इस (cid:20)कार (cid:20)दk अनु\ा उस अविध तक िविधमाFय होगी जो केFG ीय सरकार Dारा धारा 14 के ख’ड (क) के अधीन यथा: अिधसूिचत ऊजा(cid:24) खपत मानक Dारा [ट ार [त र के िलए िविनLदMट क गई ह;ै (4) अनु\ाधारक Dारा अनु\ा के नवीकरण के िलए आवेदन छह माह के भीतर dकतु इस अविध क समािi से तीन माह पूव(cid:24) (cid:4)कया जाएगा और इसके साथ ऊजा(cid:24) द(cid:28)ता *य ूरो, नई (cid:4)द(cid:6)ल ी के प(cid:28) म7 मांग प6 के (cid:21)प म7 या इले)e ॉिनक ढंग म7 एक हजार fपए का देय शु(cid:6)क होना चािहए; (5) िविधमाFय ता क अविध समाBत होने के पlच ात् (cid:4)कसी आवेदन का नवीकरण नह? (cid:4)कया जाएगा और ,slh n”kk esa अनु\ाधारक को नया आवेदन प6 (cid:20)[त ुत होगा;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (6) उप- िविनयम (4) के अधीन नवीकरण के िलए आवेदन-प6 िमलने पर और सभी अपे(cid:28)ाb का अनुपालन होने के संबंध म7 संतुMट होने पर, *य ूरो ऐसा आवेदन (cid:20)ाBत होने क तारीख से एक माह क अविध के भीतर (cid:20)(cid:21)प-II म7 अनु\ा का नवीकरण कर सकता ह;ै (7) जो अनु\ाधारक उस तारीख से सीधे ठंडे (cid:20)शीतक के fo|eku मॉडल पर लेबल िचपकाने को जारी रखने क अनु\ा क मांग करता है, िजस तारीख से संशोिधत [ट ार [त र लागू <आ ह,ै केवल (cid:20)(cid:21)प IV म7 एक घोषणा (cid:20)[त ुत करेगा; (8) य(cid:4)द सीधे ठंडे (cid:20)शीतक के नए मॉडल क योजना संशोिधत [ट ार [त र के साथ सम_मण कर शु(cid:21) करने क ह ै तो अनु\ाधारक को नया लेबल िचपकाने क अनु\ा लेगा और ऐसी अनु\ा के िलए आवेदन संशोिधत [ट ार [त र के लागू होने से छह माह पूव(cid:24) (cid:4)कया जाए; 8. लेबल पर िविशि.यां (cid:20)दOशत करने के िलए िनबंधन और शत:m- (cid:20)Eय ेक अनु\ाधारक और 0य ापारी और िव_ेता िन(cid:18)न िलिखत िनबंधन(cid:16) एवं शतV का पालन करेगा, अथा(cid:24)त ्:- (क) सीधे ठंडे (cid:20)शीतक के लेबल पर (cid:20)दOशत [ट ार [त र अिधिनयम क धारा 14 के ख’ड (क) के अधीन क7Gीय सरकार अिधसूिचत सीधे ठंडे (cid:20)शीतक के िलए ऊजा(cid:24) खपत मानक(cid:16) के अनु(cid:21)प ह(cid:16)गे; ; (ख) यह लेबल सीधे ठंडे (cid:20)शीतक के ऐसे मॉडल(cid:16) पर ही िचपकाया जाएगा िजसके िलए अनु\ा (cid:20)दान क गई ह;ै (ग) लेबल को अनु\ाधारक क लागत पर मु(cid:4)Gत और सीधे ठंडे (cid:20)शीतक पर िचपकाया जाएगा; (घ) अनु\ाधारक, 0य ापारी और िव_ेता यह सुिनिaत करेगा (cid:4)क सीधे ठंडे (cid:20)शीतक पर लेबल पर (cid:20)दOशत [ट ार [त र हर समय बना रहगे ा; (ङ) अनु\ाधारक िविनयम 9 म7 यथा: िविनLदMट लेबल शु(cid:6)क का भुगतान करेगा; (च) अनु\ाधारक *य ूरो को िविशि.यां देगा िजसम7 लेबल लगे उप[क र(cid:16) को बनाने का *य ौरा और िवkीय वष(cid:24) क (cid:20)Eय ेक ितमाही के अंत म7 िन(cid:18)न िलिखत मास के भीतर (cid:20)Eय ेक ितमाही के िलए देय (cid:20)ोnभूत ल बे oलग शु(cid:6)क क िविशि.यां हो; (छ) अनु\ाधारक, *य ूरो को अपने लेबल लगे उEप ाद(cid:16) क िब_ के िलए िनयु)त (cid:20)Eय ेक वष(cid:24) 30 अ(cid:20)ैल को अिधकृत िवतरक(cid:16), डीलर(cid:16) और थोक िव_ेताb एवं िव_ेताb क सूची देगा; (ज) अनु\ाधारक, 0य ापारी और िव_ेता ऐसे अFय िनबंधन(cid:16) एवं शतV का पालन कर7गे जो *य ूरो Dारा, मानक और लेबoलग के संबंध म7 *य ूरो क िनदpिशका म7 अंतOवMट िनबंधन(cid:16) और शतV सिहत िविनLदMट (cid:4)कए गए ह(cid:16); 9. लेबल शु(cid:6)क - (1) (cid:20)Eय ेक अनु\ाधारक, *य ूरो को सीधे ठंडे (cid:20)शीतक पर (cid:20)E येक िचपकाए गए लेबल के िलए पांच fपए क फ स का भुगतान करेगा। (2) उप-िविनयम (1) के अधीन िविनLदM ट लेबल शु(cid:6)क , (cid:20)Eय ेक िवkीय वष(cid:24) क अंितम तारीख से एक माह के भीतर वाOषक तौर पर संदk (cid:4)कया जाएगा; परंतु यथा िविनLदMट अविध के भीतर लेबल शु(cid:6)क के भुगतान म7 चूक पर,,,, *य ूरो िविनयम 6 के उप-िविनयम (3) के ख’ड (ख) के अधीन (cid:20)ितभूित शु(cid:6)क से इस पर दस (cid:20)ितशत (cid:20)ित वष(cid:24) क दर से इस पर *य ाज के साथ बकाया रकम वसूल करेगा। य(cid:4)द इसे जमा (cid:4)कए जाने क अंितम तारीख से एक वष(cid:24) के भीतर पूरा लेबoलग शु(cid:6)क वसूल नह? Short title and commencement.-(1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Household Direct Cool Refrigerators) Regulations, 2016. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definition.- (1) In these regulations, unless the context otherwise requires,- (a) “Act” means the Energy Conservation Act, 2001(52 of 2001); (b) “direct cool refrigerators” means an appliance as specified in the notification under clause (b) of section 14 of the Act; (c) “Form” means a form appended to these regulations; (d) “label” means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon, direct cool refrigerator; (e) “label period” means the validity period of the comparative electricity consumption under energy consumption standard notified by the Central Government under clause (a) of section 14 and in case the end period of the validity period of the comparative electricity consumption is not notified, it shall be deemed to be valid until new values for the same are notified by the Central Government; (f) “models or family of models” means the model or range of models of one particular brand, to which a single set of test reports is applicable and where each of the models has the same physical characteristics, annual electricity consumption, energy efficiency level and performance characteristics; (g) “permitee” means a person or agency to whom permission has been granted to affix label under regulation 7; (h) “star rating or star level” means the grade of energy efficiency displayed on the label of the direct cool refrigerator based on energy consumption standard notified by the Central Government under clause (a) of section 14 of the Act to denote the comparative electricity consumption of direct cool refrigerator; (i) “trader or seller” in relation to any labelled direct cool refrigerator means a person who sells or distributes any such direct cool refrigerator and includes the shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such direct cool refrigerator. (2) Words and expressions used herein and not defined, but defined in the Act, shall have meanings respectively assigned to them in the Act. 3. Particulars to be displayed on label.- (1) On every direct cool refrigerator, the following particulars shall be displayed on its label, namely:- (a) the logo of the Bureau of Energy Efficiency; (b) name of manufacturer or importer and brand; (c) appliance type; (d) rated Gross Volume; (e) rated Storage Volume; (f) model number and year of manufacturing or import; (g) unique series code; (h) electricity consumption in units per year; (i) star level; and (j) label period. (2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations. 4. Time limit for display of labels.- (1) A label containing all the particulars specified in regulation 3 shall be displayed on every direct cool refrigerator within a period of six months from the date of coming into force of these regulations. (2) On and from commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller shall ensure that- (a) the direct cool refrigerator put on sale shall display revised star level and revised label period synchronizing with the revised energy consumption standards and the manufacturing year of the direct18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] cool refrigerator shall also be in synchronization with such revised energy consumption standards, and shall not produce the direct cool refrigerator with the previous energy consumption standards; (b) all preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers shall be well planned and taken six months in advance of the date of such commencement, under these regulations. 5. Manner of display of label.-(1) On every direct cool refrigerator, shall be displayed label at the point of sale and such label shall be affixed on the direct cool refrigerator in the following manner, namely:- (a) self-adhesive label affixed on the front side of the upper right portion of direct cool refrigerator; (b) self-adhesive label affixed on the front side of the carton box. (2) For direct cool refrigerators not on display, the label may be affixed to the exterior of the packing and the label may be attached to the unit when put on sale. 6. Permission for display of label.- (1) No star label shall be affixed on a direct cool refrigerator without obtaining the prior permission of the Bureau. (2) For the purpose of obtaining permission of the Bureau under sub-regulation (1), an application shall be made in Form-I and in electronic form: Provided that separate application shall be made for each model of direct cool refrigerator. (3) Every application under sub-regulation (2) shall be accompanied by – (a) an application fee of two thousand rupees, payable by demand draft in favour of Bureau of Energy Efficiency, New Delhi or by any acceptable electronic mode of payment; (b) a label security fee of one lakh rupees, payable by demand draft in favour of the Bureau of Energy Efficiency, New Delhi; or by any acceptable electronic mode of payment: Provided that in case of small scale industry, label security fee shall be only twenty five thousand rupees; and (c) documents specified in Form 1. 7. Grant of permission.- (1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period of one month from the date of such receipt, grant, subject to such terms and conditions as/are specified in regulation 8, permission for affixing label on direct cool refrigerator in Form II or in electronic form. (2) The Bureau shall maintain a register in Form III and enter the name of the permittee therein. (3) The permission so granted under sub-regulation (1) shall be valid for such period till which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of section 14 is in force. (4) An application for renewal of permission shall be made by the permittee from six months but not later than three months before its expiry and shall be accompanied by a fee of one thousand rupees payable in the form of demand draft or electronic mode in favour of the Bureau of Energy Efficiency, New Delhi. (5) No application shall be renewed after expiry of validity period, in which case the permittee shall make a fresh application. (6) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form II. (7) The permittee who seeks permission for continuance to affix label on the existing model of the direct cool refrigerator from the date from which the revised star level comes into force, shall submit only a declaration in Form IV. (8) The permittee shall seek permission to affix label afresh, if new model of the direct cool refrigerator is planned to be launched to synchronize with the revised star level and application for such permission may be made six months in advance of coming into force of the revised star level. 8. Terms and conditions for display of particulars on label.- Every permittee, trader and seller shall comply with the following terms and conditions in displaying the particulars on label, namely:- (a) the star level displayed on the label of direct cool refrigerator shall conform to energy consumption standards for direct cool refrigerator notified by the Central Government under clause (a) of section 14 of the Act; (b) the label shall be affixed only on such model of direct cool refrigerator for which permission has been granted; (c) the label shall be printed and affixed on the direct cool refrigerator at the cost of permittee; (d) the permittee, trader and seller shall ensure that the star level displayed on the label of direct cool refrigerator shall be maintained at all time; (e) the permittee shall pay the label fee as specified in regulation 9; (f) the permittee shall furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labeling fee due for each quarter within the following month of the close of each quarter of the financial year;¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 19 (g) the permittee shall furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell their labelled products by 30th day of April of each year; (h) the permittee, trader and seller shall comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau’s Manual on Standard and Labelling. 9. Label fee.- (1) Every permittee shall pay to the Bureau a label fee of five rupees for each label affixed on the direct cool refrigerator. (2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of closure of each financial year: Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten per cent. per annum from the label security fee made under clause (b) of sub-regulation (3) of regulation 6, and if complete labeling fees are not recovered within one year of the last date of submission, the Bureau may cancel all labels granted to the permittee and publish the name of the permittee in the newspapers as a defaulter. 10. Refund of label security fee.- Subject to the provisions of sub-regulation (2) of regulation 9, a permittee shall be entitled to a refund of the label security fee, on ceasing to manufacture direct cool refrigerator. 11. Verification by Bureau.- (1) The Bureau or its designated agency may, either suo motu, or on a complaint received by it, carry out verification to ensure that the direct cool refrigerator conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission. (2) For the purpose of verification, samples shall be picked up at random by Bureau or its designated agency from the manufacturing facility, warehouse or the retail outlet as it deems fit. (3) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the direct cool refrigerator in an independent laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories, a notice shall be issued to the permittee for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to testing, transportation and other incidental expenses with the Bureau, within such time, as may be determined by Bureau, and if the sample drawn under challenge testing fails, all expenses towards the cost of sample, transportation of sample and the testing charges, shall be reimbursed by the permittee to the Bureau and the Bureau shall refund the aforesaid expenses to the complainant; and where the equipment passes the challenge test, then, the expenses deposited by the complainant shall stand forfeited. (4) Where samples of direct cool refrigerator used for testing fails the test during suo motu testing or challenge testing, the permittee shall be afforded another opportunity and the Bureau shall conduct a second test with twice the quantity of direct cool refrigerator used in the first test in an independent test laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories at the cost of the permittee. (5) Where the second test fails, the Bureau shall,- (a) direct the permittee in Form V, under intimation to all the State Designated Agencies, that the permittee shall, within a period of two months,- (i) correct the star level displayed on the label of the direct cool refrigerator or remove the defects and deficiencies found during testing; (ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and (iii) change the particulars displayed on advertising material; (b) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specifications in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit, within two months; (c) Intimate to the concerned State Designated Agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act. (6) The permittee shall within ten days of the conclusion of the period of two months referred to in sub-regulation (5),- (a) send the compliance report in Form VI to Bureau with respect to action taken in compliance with the direction; and (b) in case the compliance report referred to in clause (a) is not received or received without complying to any of the direction within the specified period, it shall be deemed as non-compliance of the direction issued and orders to that effect shall be passed by the Bureau. (7) The Bureau shall send a copy of the compliance report referred to in clause (a) and orders passed in clause (b) of sub- regulation (6) along with necessary documents to all the State Designated Agencies for the purpose of taking action under section 17 of the Act and enforcement of the orders passed under clause (b) of the said sub-regulation.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (8) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (5), the Bureau under intimation to all State Designated Agencies, shall,- (a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7; (b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, the directions of the Bureau referred to in clause (a) of sub- regulation (6) for consideration and taking action under clause (c) of section 14 of the Act by the Central Government; (c) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months; (d) intimate to the concerned State Designated Agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act. 12. Cancellation of permission.- The Bureau may cancel the permission granted under regulation 7, if the permittee – (a) fails to comply with any of the terms and conditions specified under regulation 8; (b) fails to pay label fee within the period specified under regulation 9; (c) does not comply with the direction issued under regulation 11.
