और िबदक पूिोय अिजध के भीतर उय प्रारूप जिजनयम की बाबत कोई सझााि या टिप्पजणयां प्राप्त नहीं ुएई ह;ैं अत:, अब, ब् यरू ो, केन्‍द रीय सरकार के पूिा अनझमोदन स े ऊिा ा संरक्षण अजधजनयम, 2001 (2001 का 52), की धारा 13 की उपधारा (2) के खडं (ढ) और धारा 14 के खडं (घ) के साथ पटित धारा 58की उपधारा (2) के खंड (ा) द्वारा प्रदत् त िजयय को प्रयोग करत े ुएए और ऊिा ा दक्षता ब्यूरो (स्ट्ि -बालाजस्ट्िड एलईडी लैम् प के लेबल पर उनके संप्रदिान की जिजिजियां और रीजत) जिजनयम 2017 की उन बात के जसिाय अजधक्रमण करत े ुएए, जिन्‍द ह ऐसे अजधक्रमण से पूि ा दकया गया ह ैया करन े का लोप दकया गया ह,ै जनम्न जलजखत जिजनयम का संिोधन करता ह,ै अथाात् :- 3998 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

1. लघ झ िीषका और प्रारंभ - (1) ये जिजनयम ऊिा ा दक्षता ब्यरू ो (सेल्फ बालास्ट् ि एलईडी लैंप के लेबल पर उनके संप्रदिना करने का जििरण और रीजत), संिोधन जिजनयम 2023 कह ेिाय गे

(2) य ेजिजनयम सरकारी गिि म प्रकाजित होन े की तारीख स ेलाग ूहो िाय गे

2. पटरभाषा –(1) इन जिजनयम म यदद संदभा से अन्‍द यथा अपेजक्षत न हो तो – (क) “अजधजनयम'' से ऊिाा संरक्षण अजधजनयम 2001 (2001 का 52) अजभप्रेत ह;ै (ख) “फैजमली मॉडल'' से िैसे मॉडल का समूह जिनके जलये कायाजनष्पादन के सभी मानक समान ह;ैं (ग) “ प्ररूप'' से इन जिजनयम से सबं ंजधत प्ररूप अजभप्रेत ह;ै (घ) “लेबल'' से सेल्फ बालास्ट् ि लैंप से लगी या इसपर दीख रही दकसी भी प्रकार की जलजखत, छपी, जचजन्‍दहत, मझहर लगी या ग्रादफक सामग्री अजभप्रते ह;ै (ङ) “लेबल अिजध'' से अजधजनयम की धारा 14 के खडं (क) के अधीन केन्‍द रीय सरकार द्वारा अजधसूजचत ऊिा ा उपभोग मानदडं के अंतगात प्रकाि क्षमता की जिजधमान्‍द यता अिजध अजभप्रेत ह;ै (च) परंत झ प्रदीप् त क्षमता की जिजधमान्‍द यता समाप्त होने की अिजध अजधसूजचत नहीं ह ै तो यह केन्‍दर ीय सरकार द्वारा इसके जलये नए मान अजधसूजचत होने तक जिजधमान्‍द य माना िायेगा;

(छ) “अनज्ञझ ाप्धारी'' से ऐसा व्यजय या एि सी जिसे जिजनयम 7 के अधीन लेबल लगाने की अनझज्ञा दी गयी ह ै अजभप्रेत ह;ै (ि) “जिड्यूल'' से इन जिजनयम से संलग्न जनधाारण; (ा) “सेल्फ बालास्ट् ि एलईडी लैंप'' से अजधजनयम की धारा 14 के खंड (क) के अधीन अजधसूचना म यथाजिजनर्दष्ा ि उपस्ट् कर अजभप्रेत ह;ै (ञ) “स्ट्िार रेटिंग'' से अजधजनयम की धारा 14 के खंड (क) के अधीन केन्‍द रीय सरकार द्वारा अजधसूजचत प्रकािन क्षमता मानक के कधार पर सल्े फ बालास्ट् ि एलईडी लपैं के लबे ल पर प्रद्िता ऊिा ा सक्षमता की ्ेणी अजभप्रेत ह;ै (ि) “व्यापारी या जिक्रेता'' से लेबल लगे सेल्फ बालास्ट् ि एलईडी लैंप की जबक्री या जितरण करने िाले अजभप्रेत ह ै और इसम दकझ ानदार, व्यापारी, जनमााता और अनझज्ञाप्धारी कते ह ैं जिन्‍दह सेल्फ बालास्ट् ि एलईडी लैंप पर लेबल लगान े की अनझज्ञा दी गयी ह ै

(2) उन िब्द और पद के, िो इसम प्रयझक् त ह ैं और पटरभाजषत नहीं ह,ैं ककंतझ अजधजनयम म पटरभाजषत ह,ैं िही अथ ा ह ग े िो उस अजधजनयम म ह ैं

3. लबे ल पर प्रद्िता दकया िान े िाला जििरण – (1) प्रत्येक सेल्फ बालास्ट् ि एलईडी लैंप के लेबल पर जन्नलजलजखत जिषय प्रद्िात दकया िायगे ा – (क) ऊिाा दक्षता ब् यरू ो का लोगो; (ख) जिजनमााता या कयातक और ब्ांड का नाम;

(ग) रेड नाम और संख्या; (घ) मॉडल और जिजनमााण या कयात िष;ा[भाग III—खण् ड 4] भारत का रािप् : असाधारण 3 (ङ) जिजिि ्रंखला कोड; (च) िाि म जबिली उपभोग; (छ) ल्यूमेन म ल्यूजमनस फ्लक्स; (ि) एलएम/डबल्यू म प्रकािन प्रभािकाटरता;

(ा) सेल्फ बालास्ट् ि एलईडी लैंप का स्ट्िार लेिल; (ञ) लेबल अिजध; (ि) केडबल्यूएच म जबिली बचत; (ि) केिीसीओ म काबान डायक्साइड उत्सिान म कमी;

(2) लेबल का जडिाइन, रंग, ककार, और जिषयिस्ट्तझ इन जिजनयम म संलग्न अनझसूची म जिजनर्दष्ा ि दकये अनझसार होना चाजहये

4. लबे ल सप्रं द्िता के जलय ेसमय सीमा – (1) जिजनयम 3 म जिजनर्दष्ा ि सभी जििरण के साथ लेबल प्रत्येक सेल्फ बालास्ट्ि एलईडी लपैं पर, इन जिजनयम के लाग ूहोने के बाद, 6 महीने के भीतर लगा ददय ेिाय गे

(2) अजधजनयम की धारा 14 के खंड (क) के अधीन केन्‍द रीय सरकार द्वारा अजधसूजचत संिोजधत ऊिाा उपभोग मानक लागू हो िान े पर, प्रत्येक अनज्ञझ ाप्धारी या व्यापारी या जिक्रेता- (क) पहले के ऊिा ाखपत मानक के साथ सेल्फ बालास्ट् ि एलईडी लपैं नहीं जिक्रय नहीं कर सकेगा;

(ख) संिोजधत ऊिा ा उपभोग मानक और सेल्फ बालास्ट् ि एलईडी लैंप के जिजनमााण िष ा के साथ संिोजधत उपभोग मानक के अनझरूप संिोजधत स्ट्िार लेिल और लेबल अिजध प्रद्िात करेगा; (ग) डीलर , खझदरा जिक्रेताओं की िागरुकता सजहत उनकी िानकारी और उपभोयाओं की सिगता के जलये िरूरी प्रचार सजहत सझजनयोजित और किश्यक अजग्रम उपाय करेगा

5. लबे ल सप्रं द्िता करन ेकी रीजत–

(1) प्रत्येक सेल्फ बालास्ट् ि लाइि एजमटिंग डायोड लैंप पर त् िटरत प्रजतदक्रया कोड के साथ लेबल होगा जिस े जबक्री स्ट्थल पर प्रद्िता दकया िायेगा और ऐसा लेबल जनम्न जलजखत रीजत से सल्े फ बालास्ट् ि लाइि एजमटिंग डायोड लपैं पर जचपकाया िायेगााः- (क) पैकेजिंग पर मझदरत त् िटरत प्रजतदक्रया कोड के साथ स्ट्ियं जचपकने िाला लेबल;

(ख) सेल्फ बालास्ट् ि लाइि एजमटिंग डायोड के कैप पर रेटिंग के अनझसार स्ट्िार मा्कगग अंदकत या छपी होगी; और (ग) लाइि एजमटिंग डायोड लैंप पर स्ट्िार मा्कगग के जलय े स्ट्िैंप का ककार ऊंचाई म 11.5 जम.मी. और चौडाई म 8.5 जम.मी. होना चाजहये और त् िटरत प्रजतदक्रया 8.5 जम.मी.ऊंचा और 8.5 जम.मी.

6. लबे ल सप्रं द्िता करन े के जलय े अनज्ञझ ा – (1) ब्यूरो की पूिा अनझज्ञा के जबना दकसी भी सेल्फ बालास्ट् ि एलईडी लपैं पर स्ट्िार लेबल नहीं लगाया िा सकता4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(2) कंपनी रजिस्ट् रीकरण – ब्यूरो की अनझज्ञा प्राप्त करने के जलय े प्रत्येक ब्ांड को इलेक्रॉजनक भझगतान माध्यम स े भझगतान योग्य एक लाख रुपए की लेबल सझरक्षा फीस के साथ प्ररूप I-(क) म यथाजिजनर्दष्ा ि अलग से रजिस्ट् रीकरत करना होगा, परन्‍द त झ यह उपबंजधत ह ैदक लघझ उयोगोग जलये लेबल सझरक्षा फीस केिल 25 हिार रुपए होगा

(3) मॉडल रजिस्ट् रीकरण – उपजिजनयम 2 के अधीन अनझज्ञाप्धारी के प्रत्येक किेदन – (क) इलेक्रॉजनक भगझ तान माध्यम स ेभझगतान योग्य, प्रजत मॉडल दो हिार रुपए की किेदन फीस और (ख) प्ररूप I म जिजिजनर्दष्ा ि दस्ट्तािेि के साथ होना चाजहए

7. अनज्ञझ ा प्रदान दकया िाना – (1) जिजनयम 6 के अधीन किेदन प्राप्त होन े और सभी अपेक्षाओं के अनपझ ालन से संतिझ होने के बाद, ब्यूरो, मानक और लेबजलगं जनयमािली म जिजनर्दष्ा ि समयािजध के भीतर, जिजनयम 8 म जिजनर्दष्ा ि जनयम और ितों के अधीन – (क) ब्ांड को प्ररूप II – (क) म, इलक्े रॉजनक रूप स ेरजिस्ट्िर कर लते ा ह;ै और (ख) सेल्फ बालास्ट् ि एलईडी लैंप पर लेबल लगान े की अनझज्ञा प्ररूप II म, इलेक्रॉजनक रूप से प्रदान कर देता ह ै

(2) ब्यूरो प्ररूप III म एक रजिस्ट्िर का प्रबंध करेगा और उसम अनज्ञझ ाप्धारी का नाम अजभजलजखत कर लगे ा

(3) उप जिजनयम (1) के अधीन इस प्रकार स्ट्िीकरत मंिरू ी उस अिजध तक जिजधमान्‍द य रहगे ी िबतक केन्‍द रीय सरकार द्वारा धारा 14 के खंड (क) के अधीन अजधसूजचत ऊिा ाउपभोग मानक द्वारा जिजनर्दष्ा ि स्ट्िार लेिल लाग ूरहगे ा

(4) स्ट्िार रेटिंग योिना म संिोधन की जस्ट्थजत म , अनज्ञझ ाप्धारी द्वारा निीकरण की अनझज्ञा के जलये, स्ट्िार रेटिंग की अिजध समाप्त होने के पहले एक महीने के अंदर किेदन दने ा होगा और साथ म ऊिाा दक्षता ब्यूरो, नयी ददल्ली के पक्ष म इलेक्रॉजनक माध्यम से भझगतान योग्य एक हिार रुपए का फीस देना होगा परन्‍द त,झ यह जिजधमान्‍द यता स्ट्िार रेटिंग योिना जिस्ट्ताटरत होन े की जस्ट्थजत म एक हिार रुपए के निीकरण फीस स े छूि दी िायेगी

(5) जिजधमान्‍द यता अिजध समाप्त होने के बाद दकसी भी किदे न पर निीकरण नहीं दकया िायेगा और तब अनज्ञझ ाप्धारी को नया किेदन दने ा होगा

(6) उपजिजनयम (4) के अधीन निीकरण के जलय े किेदन प्राप्त होने पर और सभी अपक्षे ाओं के अनझपालन के प्रजत संतिझ होने पर, ब्यूरो किेदन प्राप्त होने के एक महीने के अंदर ब्यरू ो प्ररूप II म अनज्ञझ ा का निीकरण कर सकता ह ै

(7) िो अनझज्ञाप्धारी, संिोजधत स्ट्िार लेबल लागू हो िाने की तारीख के बाद से सेल्फ बालास्ट् ि एलईडी लैंप के ितामान मॉडल पर लेबल लगाना िारी रखने की अनझजमत चाहता ह,ै उसे केिल प्ररूप IV म घोषणा प्रस्ट् तझत करनी होगी

(8) यदद संिोजधत स्ट्िार लेबल की अनझरूपता म सेल्फ बालास्ट् ि एलईडी लैंप का नया मॉडल िझरू दकये िान े की योिना ह ै तो अनझज्ञाप्धारी को नया लबे ल लगान े की अनझज्ञा लने ी होगी और इस अनझज्ञा के जलय े किेदन संिोजधत स्ट्िार लेिल के लाग ूहोने के 6 महीन े पहल े करना होगा

8. लबे ल पर ब्योरा सप्रं द्िता दकय े िान ेके जनबधं न और ित ें – प्रत्येक अनझज्ञाप्धारी, व्यापारी और जिक्रेता को लेबल पर जििरण प्रस्ट्तझत म जन्नलजलजखत जनबंधन और ितों का अनझपालन करना होगा – (क) प्रत्येक सेल्फ बालास्ट् ि एलईडी लैंप के लेबल पर प्रद्िता दकया िाने िाला स्ट्िार लेिल केन्‍द रीय सरकार द्वारा अजधजनयम की धारा 14 के खंड (क) के अधीन सेल्फ बालास्ट् ि लैंप के जलये अजधसूजचत ऊिा ा उपभोग मानक के अनरूझ प होगा ;[भाग III—खण् ड 4] भारत का रािप् : असाधारण 5 (ख) सेल्फ बालास्ट् ि लैंप के केिल उन मॉडल पर ही लेबल लगाया िा सकेगा जिनके जलये अनझज्ञा दी गयी है;

(ग) सेल्फ बालास्ट् ि लैंप पर लेबल केिल अनझज्ञाप्धारी के व्यय पर ही जप्रंि होगा और लगाया िायेगा (घ) अनझज्ञाप्धारी, व्यापारी और जिक्रेता यह सझजनजित कर गे दक सेल्फ बालास्ट् ि लपैं के लेबल पर प्रद्िात लेबल हर समय बना रह;े (ङ) अनज्ञझ ाप्धारी जिजनयम 9 म जिजनर्दष्ा ि लेबल फीस का भगझ तान करेगा;

(च) अनझज्ञाप्धारी ब्यूरो को एक जििरण प्रस्ट्तझत करेगा जिसम लबे ल ययझ उपस्ट् कर के जनमााण तथा जित्तीय िषा की प्रत्येक जतमाही की समाजप्त के बाद िाल े महीन े म प्रत्येक जतमाही के जलय े बकाया प्रोद्भूत लेबजलगं फीस का ब्योरा होगा ;

(छ) अनझज्ञाप्धारी प्रत्येक िषा के 30 अप्रलै तक अपने लेबलययझ उत्पाद की जबक्री के जलये जनयझय दकये अजधकरत जितरक , डीलर , खझदरा जिक्रेताओं और जिक्रेताओं का जििरण ब्यरू ो को सौंपगे ा; (ि) अनझज्ञाप्धारी, व्यापारी और जिक्रेता ब्यूरो की जनयमािली म मानक और लेबजलंग पर िाजमल जिजनयम सजहत ऐसे अन्‍दय जनयम और ितों का भी अनझपालन कर ग ेजिसे ब्यूरो जिजनर्दष्ा ि करेगा

9. लबे ल फीस – (1) प्रत्येक अनज्ञझ ाप्धारी ब्यरू ो को सेल्फ बालास्ट् ि एलईडी लैंप पर लगन े िाले प्रत्येक लेबल के जलय े ब्यूरो को पांच पैसे प्रजत लेबल की दर स ेलेबल फीस का भगझ तान करेगा

(2) उपजिजनयम (1) के अधीन जिजनर्दष्ा ि लेबल फीस का भझगतान ब्यरू ो को िा्षाक रूप से प्रत्येक जित्तीय िषा की समापन तारीख से एक महीने के अंदर करना होगा परन्‍द त,झ इस प्रकार जिजिजनर्दष्ा ि अिजध के भीतर लेबल फीस का भझगतान नहीं करन े पर ब्यरू ो बकाया रकम की िसूली दस प्रजतित िा्षाक ब्याि के साथ, जिजनयम 6 के उपजिजनयम (3) के अधीन िमा दकये गये लेबल सरझ क्षा फीस स े करेगा, और यदद पूरा लेबजलंग फीस िमा दकये िाने की तारीख के एक िष ा के अंदर िसूल नहीं होता ह ै तो ब्यरू ो अनझज्ञाप्धारी को स्ट्िीकरत दकये गय े सभी लेबल रद्द कर सकता ह ै और अनझज्ञाप्धारी का नाम समाचार प् म जडफॉल्िर के रूप म प्रकाजित कर सकता ह ै

10. लबे ल सरझ क्षा फीस की िापसी – जिजनयम 9 के उपजिजनयम (2) के उपबधं के अधीन अनझज्ञाप्धारी, सेल्फ बालास्ट् ि एलईडी लपैं का जिजनमााण बंद कर देन े पर, लेबल सझरक्षा फीस िापस ले सकेगा

11. ब्यरू ो द्वारा सत्य ापन - (1) ब्यूरो और उसका अजभजहत अजभकरण, या तो स्ट्िताः संज्ञान स े या कोई जिकायत जमलन ेपर, इस बात का सत् यापन करा सकती ह ैदक सेल्फ बालास्ट् ि एलईडी लैंप स्ट्िार लेिल और इसके लेबल पर प्रद्िात ब्योरे के अनझरूप ह ैंऔर य ेअनज्ञझ ा के अन्‍दय जनबंधन और ितों का अनझपालन करत े ह ैं

(2) पझजि के जलय े ब्यूरो या उसका अजभजहत अजभकरण जिजनमााण क र, भंडार, खझदरा जबक्री क र, िहां से भी ि े उजचत समा , अचानक नमून ेउिा सकती ह ै

(3) उपजिजनयम (1) के अधीन जिकायत प्राप्त होने पर ब्यूरो को सेल्फ बालास्ट् ि एलईडी लैंप के परीक्षण की पझजि, परीक्षण और अंिापन प्रयोगिालाओं के जलये राष्ट्रीय प्रत्यायन बोडा द्वारा प्रत्याजयत दकसी स्ट्ितं् प्रयोगिाला म करानी चाजहये यह िांच कराये िाने के बारे म अनझज्ञाप्धारी को प्ररूप V म नोटिस िारी दकया िाना होगा और जिकायतकताा को नमूना लागत, परीक्षण, पटरिहन और अन्‍दय संभाजित व्यय, ब्यूरो द्वारा जनधााटरत समय पर िमा करन े के जलय े कहा िायेगा परंतझक ह ै दक यदद परीक्षण की चझनौती ददया गया सैंपल िांच म जिफल रहता ह ै तो अनझज्ञाप्धारी परीक्षण म लगे सभी व्यय का भझगतान ब्यूरो को करेगा, और ब्यूरो इसे जिकायतकताा को िापस कर देगा और यदद उपस्ट् कर परीक्षण पर खरा उतरता ह ैतो जिकायतकताा द्वारा परीक्षण के जलये िमा करायी गयी रकम ज़ब्त हो िायेगी6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(4) िहा ं स्ट्िताःसंज्ञान परीक्षण या चझनौती परीक्षण के दौरान सेल्फ बालास्ट् ि एलईडी लैंप के नमनू े कसौिी पर खरे नही उतर पात े िहां अनझज्ञाप्धारी को एक मौका और ददया िायेगा ब्यरू ो दसू रा परीक्षण, पहली बार स े दगझ झनी संख्या म सेल्फ बालास्ट् ि एलईडी लपैं लेकर करेगा इस बार यह िाचं , परीक्षण और अंिापन प्रयोगिालाओं के जलये राष्ट्रीय प्रत्यायन बोडा द्वारा प्रत्याजयत दकसी अन्‍दय स्ट्ितं् प्रयोगिाला म , अनझज्ञाप्धारी के व्यय पर करायी िायेगी ब्यरू ो अनझज्ञाप्धारी को उपजिजनयम (3) और दसू रे परीक्षण के जलये उपजिजनयम (4) म संद्भात यह चझनौती परीक्षण देखन े और नमून के उपापन और परीक्षण म लगन े िाल ेव्यय के जलय ेप्ररूप V म सूजचत करेगा

(5) यदद दसू रा परीक्षण भी जिफल हो िाती ह ैतो ब्यूरो – (क) सभी राज्य प्राजधकरत एि जसय को सूचना के अधीन, प्ररूप VI म अनझज्ञाप्धारी को सूजचत करेगा दक िह दो महीने के अदं र –

(i) सेल्फ बालास्ट् ि एलईडी लपैं पर ददया गया स्ट्िार लेिल जििरण सही करा ले या परीक्षण के दौरान पायी गयी ्झटिय और खाजमयो को दरू करे

(ii) ब्यरू ो के जनदेि का अनझपालन करते ुएए बािार से परू ा स्ट्िॉक िापस ल ेले, और

(6) अनझज्ञाप्धारी उपजिजनयम (5) म उजल्लजखत दो महीन े की अिजध पूरी होन े के दस ददन के अदं र --- (क) ब्यूरो को उसके जनदिे के अनझपालन म की गयी कारािाई की टरपोिा प्ररूप VII म भेिेगा, और (ख) यदद खडं (क) म उजल्लजखत अनझपालन टरपोिा जिजनर्दष्ा ि समयसीमा म प्राप्त नहीं होती ह ै या जबना दकसी जनदेि का अनझपालन दकये प्राप्त होती ह ै तो यह ब्यरू ो द्वारा िारी जनदिे और कदिे का गैरअनझपालन माना िायेगा

2. यह अनज्ञझ ा जन्नलांदकत के अधीन ह—ै (क) सेल्फ-बालास्ट् ि एलईडी लैंप के लेबल पर प्रद्िता स्ट्िार स्ट्तर अजधजनयम की धारा 14 के खंड (क) के अधीन अजधसूजचत सेल्फ-बालास्ट् ि एलईडी लैंप के जलए ऊिाा खपत मानक और उपरोय जिजनयम म प्रदान की गई ितों के अनरूझ प होगा;

(ख) केिल सेल्फ-बालास्ट् ि एलईडी लपैं के ऐसे मॉडल पर लेबल की मोहर लगाना जिसके जलए अनज्ञझ ा दी गई ह;ै (ग) अनझज्ञाप्धारक की लागत पर सेल्फ-बालास्ट् ि एलईडी लैंप पर लेबल की जप्रंटिंग और जचपकाना ; (घ) अनझज्ञाप्धारी सझजनजित करेगा दक सेल्फ-बालास्ट् ि एलईडी लैंप पर प्रद्िता स्ट्िार स्ट्तर हर समय बनाए रखा िाएगा;

(ङ) अनझज्ञाप्धारक, ब्यूरो द्वारा जिजनर्दष्ा ि लेबल फीस का भझगतान ; (च) अनझज्ञाप्धारक लेबल यझय उपस्ट् कर के उत्पादन के जििरण और जित्तीय िषा की प्रत्येक जतमाही की समाजप्त के अगल े महीने के भीतर देय प्रोद्भूत लेबल फीस का ब्यौरा ब्यूरो को प्रस्ट्तझत करेगा यही जििरण ब्यरू ो को स्ट्िचाजलत प्रणाली के माध्यम से भी प्रस्ट्ततझ दकया िाएगा;

2. यह अनज्ञझ ा जन्नलांदकत के अधीन ह—ै (क) सेल्फ-बालास्ट् ि एलईडी लैंप के लेबल पर प्रद्िात स्ट्िार स्ट्तर अजधजनयम की धारा 14 के खडं (क) के अधीन अजधसूजचत सल्े फ-बालास्ट् ि एलईडी लैंप के जलए ऊिा ा खपत मानक और उपरोय जिजनयम म उपबंजधत ितों के अनरूझ प होगा;

(ख) केिल सेल्फ-बालास्ट् ि एलईडी लपैं के ऐसे मॉडल पर लेबल लगाना, जिसके जलए अनझज्ञा दी गई ह;ै (ग) अनझज्ञाप्धारक की लागत पर सेल्फ-बालास्ट् ि एलईडी लैंप पर लेबल की जप्रंटिंग और जचपकाना ; (घ) अनझज्ञाप्धारक सझजनजित करेगा दक सेल्फ-बालास्ट् ि एलईडी लैंप पर प्रद्िात स्ट्िार स्ट्तर हर समय बनाए रखा िाएगा;16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ङ) अनझज्ञाप्धारक, प्रजत लेबल पाचं पैसे की लेबल फीस का भझगतान करेगा;

(छ) अनझज्ञाप्धारक अनझज्ञा प्रदान दकए गए सेल्फ-बालास्ट् ि एलईडी लैंप के बारे म ब्यरू ो द्वारा मागं े िाने पर अन्‍दय जििरण उपलब्ध कराएगा

NOTIFICATION New Delhi, the 22nd June, 2023 No. BEE/S&L/LED/52/2023.—Whereas, the draft regulations namely, the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Self-ballasted LED lamps), Regulations 2023, were published vide notification number BEE/S&L/LED/52/2023 as required under sub-section (1) of section 58 of the Energy Conservation Act, 2001 (52 of 2001), inviting objections or suggestions from persons likely to be affected thereby within the specified period of thirty days from the date of publication of the said notification in the Official Gazette;

And whereas copies of the said draft regulation were made available to the public on 31st March, 2023;

And whereas no suggestions or comments have been received with respect to the said draft regulations within the period aforesaid;

Now, therefore, in exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 and clause (d) of section 14 of the Energy Conservation Act, 2001 (52 of

2001), and in supersession of the Bureau of Energy Efficiency (Particulars and Manner of their Display. Labels of Self-ballasted LED lamps) Regulations, 2017, except as respect things done or omitted to be done before such supersession, the Bureau, with the previous approval of the Central Government, hereby amends the following regulations, namely:-[भाग III—खण् ड 4] भारत का रािप् : असाधारण 29

1. Short title and commencement. - (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Self-ballasted LED lamps), Regulations, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definition: - (1) In these regulations, unless the context otherwise requires, —

(a) “Act” means the Energy Conservation Act, 2001(52 of 2001);

(b) “Family of models” means group of models for which all the performance parameters are same;

(c) “Form” means a form appended to these regulations;

(d) “label” means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon the self-ballasted LED lamp;

(e) “label period” means the validity period of the luminous efficacy under energy consumption standard notified by the Central Government under clause (a) of section 14 of the Act:

Provided that if, the end period of the validity period of the luminous efficacy is not notified, it shall be deemed to be valid until new values for the same are notified by the Central Government;

(f) “permittee” means a person or agency to whom permission has been granted to affix label under regulation 7;

(g) “Schedule” means the schedule annexed to these regulations;

(h) “self-ballasted LED lamp” means an appliance as specified in the notification under clause (b) of section 14 of the Act;

(i) “star rating or star level” means the grade of energy efficiency displayed on the label of the self-ballasted LED lamp based on luminous efficacy standard notified by the Central Government under clause (a) of

section 14 of the Act;

(j) “trader or seller” in relation to any labelled self-ballasted LED lamp means a person who sells or distributes such self-ballasted LED lamp and includes shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such self-ballasted LED lamp.

(2) Words and expressions used herein and not defined, but defined in the Act, shall have meanings respectively assigned to them in the Act.

3. Particulars to be displayed on label. - (1) On every self-ballasted LED lamp, the following particulars shall be displayed on its label, namely: —

(a) the logo of the Bureau of Energy Efficiency;

(b) name of manufacturer or importer and brand;

(c) trade name and number;

(d) model and year of manufacturing or import;

(e) unique series code;

(f) power consumption in watts ;

(g) luminous flux in lumens;

(h) luminous efficacy in lm/W;

(i) star level of self-ballasted LED lamp;

(j) label period;

(k) electricity savings in kWh; and

(l) CO emission reduction in KgCO 2 2

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels.— (1) A label containing all the particulars specified in regulation 3 shall be displayed on every self-ballasted LED lamp within a period of six months from the date of coming into force of these regulations.

(2) On and from commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller -30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(a) shall not produce the self-ballasted LED lamp with the previous energy consumption standards;

(b) shall display revised star level and label period with the revised energy consumption standard and the manufacturing year of the self-ballasted LED lamp in synchronisation with revised energy consumption standards;

(c) shall take necessary preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers are well planned and action taken in advance.

5. Manner of display of label. —

(1) There shall be a label on every self-ballasted light emitting diode lamp along with Quick Response code which shall be displayed at the point of sale and such label shall be affixed on the self-ballasted light emitting diode lamp in the following manner, namely:-

(a) self-adhesive label along with Quick Response code printed on packaging;

(b) the star marking as per the rating shall be stamped or printed on the lamp cap of self-ballasted light emitting diode lamp; and

(c) the size of the stamp for star marking shall be 11.5 millimetre height x 8.5 millimetre width and for Quick Response code it shall be 8.5 millimetre height x 8.5 millimetre width on the light emitting diode lamps.

6. Permission for display of label. — (1) No star label shall be affixed on a self-ballasted light emitting diode lamp without obtaining the prior permission of the Bureau.

(2) Company registration. — For the purposes of obtaining permission of the Bureau, every brand shall be registered separately as specified in Form I – (A), accompanied by a label security fee of one lakh rupees, payable by electronic mode of payment:

Provided that in case of small scale industry, the label security fee shall be twenty five thousand rupees only.

(3) Model registration. — Every application of the permittee under sub-regulation (2) shall be accompanied by—

(a) an application fee of two thousand rupees per model, payable by electronic mode of payment; and

(b) documents specified in Form I.

7. Grant of permission.-(1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in its Manual on standards and labelling, subject to such terms and conditions as specified in regulation 8, —

(a) register the brand in Form II-(A) in electronic form; and

(b) grant permission for affixing label on self-ballasted LED lamp in Form II in electronic form.

(2) The Bureau shall maintain a register in Form III and enter the name of the permittee therein.

(3) The permission so granted under sub-regulation (1) shall be valid for such period till which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of

section 14 is in force.

(4) In case of revision of star rating plan, an application for renewal of permission shall be made by the permittee not later than one month before its expiry and shall be accompanied by a fee of rupees one thousand payable in electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.

Provided that in case of extension of star rating plan, the said renewal fee of rupees one thousand shall be exempted.

(5) No application shall be renewed after expiry of validity period, in which case the permittee shall make a fresh application.

(6) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form II.

(7) The permittee who seeks permission for continuance to affix label on the existing model of the self- ballasted LED lamp from the date from which the revised star level comes into force shall submit only a declaration in Form IV.[भाग III—खण् ड 4] भारत का रािप् : असाधारण 31

(8) The permittee shall seek permission to affix label afresh, if new model of the self-ballasted LED lamp is planned to be launched to synchronise with the revised star level and application for such permission shall be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label.- Every permittee, trader and seller shall comply with the following terms and conditions in displaying the particulars on label, namely: —

(a) the star level displayed on the label of self-ballasted LED lamp shall conform to energy consumption standards for self-ballasted LED lamp notified by the Central Government under clause (a) of section 14 of the Act;

(b) the label shall be affixed only on such model of self-ballasted LED lamp for which permission has been granted;

(c) the label shall be printed and affixed on the self-ballasted LED lamp at the cost of permittee;

(d) the permittee, trader and seller shall ensure that the star level displayed on the label of self-ballasted LED lamp shall be maintained at all time;

(e) the permittee shall pay the label fee as specified in regulation 9;

(f) the permittee shall furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labeling fee due for each quarter within the following month of the close of each quarter of the financial year;

(g) the permittee shall furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell their labelled products by 30th day of April of each year; and

(h) the permittee, trader and seller shall comply with such other terms and conditions which the Bureau shall specify including those contained in the Bureau’s Manual on Standard and Labelling.

9. Label fee. — (1) Every permittee shall pay to the Bureau a label fee of five paisa for each label affixed on the Self- ballasted LED lamps.

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of closure

of each financial year:

Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten percent per annum from the label security fee made under clause (b) of sub- regulation (3) of regulation 6, and if complete labeling fees are not recovered within one year of the last date of submission, the Bureau may cancel all labels granted to the permittee and publish the name of the permittee in the newspapers as a defaulter.

10. Refund of label security fee. — Subject to the provisions of sub-regulation (2) of regulation 9, a permittee shall be entitled to a refund of the label security fee, on ceasing to manufacture Self-ballasted LED lamps.

11. Verification by Bureau. — (1) The Bureau or its designated agency may, either suo motu, or on a complaint received by it, carry out verification to ensure that the self-ballasted LED lamp conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission.

(2) For the purpose of verification, samples shall be picked up at random by Bureau or its designated agency from the manufacturing facility, warehouse or the retail outlet as it deems fit.

(3) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the self-ballasted LED lamp in an independent laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories, a notice shall be issued to the permittee in form V for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to sample cost, testing, transportation and other incidental expenses with the Bureau, within such time, as may be determined by Bureau, provided that the sample drawn under challenge testing fails, all expenses towards the cost of sample, transportation of sample and the testing charges, shall be reimbursed by the permittee to the Bureau and the Bureau shall refund the aforesaid expenses to the complainant; and where the equipment passes the challenge test, then, the expenses deposited by the complainant shall stand forfeited.

(4) Where samples of self-ballasted LED lamp used for testing fails the test during suo motu testing or challenge testing, the permittee shall be offer another opportunity and the Bureau shall conduct second test with twice the quantity of self-ballasted LED lamp used in the first test in an independent test laboratory which is different from the lab where the first check testing was conducted and shall be duly accredited by National Accreditation Board for Testing and Calibration Laboratories at the cost of the permittee and the Bureau shall intimate the permittee in Form V to witness the challenge testing referred to in sub-regulation (3) or the second test referred to in sub- regulation (4) and the expenses to be made towards the procurement and testing of sample.32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(5) Where the second test fails, the Bureau shall, —

(a) direct the permittee in Form VI, under intimation to all the State Designated Agencies, that the permittee shall, within a period of two months,-

(i) correct the star level displayed on the label of the self-ballasted LED lamp or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material;

(b) publish for the benefit of the consumers, the name of the concerned permittee, brand name, model name or model number, logo and other specifications in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit, within two months; and

(c) intimate to the concerned State Designated Agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(6) The permittee shall within ten days of the conclusion of the period of two months referred to in sub-regulation (5), —

(a) send the compliance report in Form VII to Bureau with respect to action taken in compliance with the direction; and

(b) in case the compliance report referred to in clause (a) is not received or received without complying to any of the direction within the specified period, it shall be deemed as non-compliance of the direction issued and orders to that effect shall be passed by the Bureau.

(7) The Bureau shall send a copy of the compliance report referred to in clause (a) and orders passed in clause (b) of sub-regulation (6) along with necessary documents to all the State Designated Agencies for the purpose of taking action under section 17 of the Act and enforcement of the orders passed under clause (b) of the said sub-regulation.

(8) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (5), the Bureau under intimation to all State Designated Agencies, shall, —

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, the directions of the Bureau referred to in clause (a) of sub-regulation (6) for consideration and taking action under clause (c) of section 14 of the Act by the Central Government;

(c) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months; and

(d) intimate to the concerned State Designated Agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of permission. — The Bureau may cancel the permission granted under regulation 7, if the permittee,

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(b) fails to pay label fee within the period specified under regulation 9; or

(c) does not comply with the direction issued under regulation 11;

Provided that no application shall be cancelled without giving permittee a reasonable opportunity of being heard in respect of cancellation of permission.

Pursuant to the provisions of regulation 7 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Self-ballasted LED lamps) Regulations, 2023, you were permitted to affix label on the Self-ballasted LED lamps vide Bureau of Energy Efficiency letter No. ..............dated....... subject to the compliance of the terms and conditions specified therein.

2. The Bureau, under Regulation … of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Self-ballasted LED lamps) Regulations, 2023, had purchased a Bureau of Energy Efficiency star labelled Self-ballasted LED lamps from your authorised Distributor, dealer, retailer vide Invoice number .......dated for a price of Rs................ and lifted as a sample dated ……by M/s......................, an agency appointed by the Bureau for verification of the particulars displayed on the label under regulation 3 of the aforesaid regulations, affixed by you on the aforesaid purchased Self-ballasted LED lamps. The sample duly sealed by M/s............... bearing serial number……..was obtained from M/s..........(Name of the Distributor, dealer, retailer) under signatures of the duly authorised representative of the verification Agency.

3. The Bureau through its aforesaid Verification Agency had transported the sample referred to in para 2 to M/s. ..................., a National Accreditation Board for Testing and Calibration Laboratories accredited laboratory for conducting tests in accordance with the test procedure indicated in paragraphs 4 and 5 of S.O. number ……dated the …. for giving Test Report in accordance with the Form ….given in Annexure to S.O.. number…….. dated the ……..

4. The results of the Test Report on the sample bearing Unique Identification serial number is enclosed. The results of the Test Report indicated that the sampled Self-ballasted LED lamps failed to meet the type test at total losses at 50% loading and total loss at 100% etc. and did not conform to the Test details furnished by you in Form 1 annexed to the Application submitted by you for seeking permission to affix label on the Self-ballasted LED lamps manufactured/imported by you. The Test Results were sent to you vide Bureau of Energy Efficiency letter No... .....

dated........in the name of your authorised Contact person. You were also requested to attend and witness the Second Check Verification Test of the samples at the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory M/s....................................................

5.The Sample for second check verification Test were picked up …. dated the …. through our authorised Agency M/s. ............and transported to the National Accreditation Board for Testing and Calibration Laboratories accredited Laboratory transported by our authorised Agency, duly sealed by M/s............... and was given Unique Identification serial number embossed on the said sample obtained from ............... ..........under signatures of the duly authorised representative of the verification Agency as well as your representatives.

6. The Test results of second check testing are enclosed which are dully checked and counter signed by the competent authorised personnel of the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory. The test report is also duly signed by your authorised signatory as witness of 2nd check testing.

The Test Results confirm that they failed to meet the requisite parameters and standards given in S.O. number …. dated, …. and the terms and conditions of the permission given to you for display of particulars on label affixed to the Self-ballasted LED lamps manufactured/imported and sold in the market .

7. Now, therefore in exercise of the power conferred clause (a) of sub-regulation (5) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Self-ballasted LED lamps) Regulations, 2023, the Bureau hereby directs to :-

(i) correct the star level displayed on the label of the Self-ballasted LED lamps or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material.

8. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within 10 days after the expiry of two months i.e. by .............. .In case no compliance report is received by the said date the Bureau shall proceed to take action in terms of46 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] clause (b) of sub-regulation (6) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Self-ballasted LED lamps) Regulations, 2023.

9. The Bureau shall take further follow up action in the matter in terms of regulations (5) (6)(7) and (8) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Self-ballasted LED lamps) Regulations, 2023.
