और उय प्रारूप जिजनयम की प्रजतयां जनता को 31 माच,ा 2023 को उपलब्ध करा दी गई थीं; और पूिोय अिजध के भीतर उय प्रारूप जिजनयम के बाबत कोई सुझाि या टटप्पजणयां प्राप्त नहीं हुई ह;ैं अत:, अब, ब् यरू ो के‍ रीय सरकार के पूिा अनुमोदन से ऊजाा संरक्षण अजधजनयम, 2001 (2001 का 52), की धारा 13 की उपधारा (2) के खडं (ढ) और धारा 14 के खडं (घ) के साथ पटित धारा 58 की उपधारा (2) के खंड (झ) द्वारा प्रदत् त िजयय को प्रयोग करत े हुए और ऊजाा दक्षता ब्यरू ो के (यूबूबलर लोलोरोसट ट ल्‍ प के लेबल पर उनके संप्रदिान की जिजिजियां और रीजत) जिजनयम 2018 के अजधक्रमण मट , उन बातो के जसिाए जज‍ ह ट ऐसे अजधक्रमण स े पूिा दकया गया ह ् या करने का लोप दकया गया ह ्जन‍ नजलजखत जिजनयम मट संिोधन करता ह,् अथाात् :-

1. संजक्षप्त नाम और प्रारंभ.- (1) इन जनयम का संजक्षप् त नाम ऊजाा दक्षता ब्यरू ो (यूबूबलर लोलोरोसट ट लैंप के लेबल पर उनके संप्रदिान करन े का जििरण और रीजत), (संिोधन जिजनयम), 2023 ह.्

(2) ि े राजपत्र म ट उनके प्रकािन की तारीख से प्रिृत् त ह गे.

2. पटरभाषा:- (1) इन जिजनयम मट , जब तक दक संदभा स ेअ‍यथा अपेजक्षत न हो,- (क) "अजधजनयम" स ेऊजाा संरक्षण अजधजनयम, 2001 (2001 का 52) अजभप्रेत ह;् (ख) "ब्यूरो" से अजधजनयम की धारा 3 की उप-धारा (1) के अधीन स्ट्थाजपत ऊजाा दक्षता ब्यरू ो अजभप्रेत ह।् (ग) "प्ररूप" स ेइन जनयम से जडु े प्ररूप अजभप्रेत ह;् (घ) "लेबल" से यूबूबलर लोलोरोसट ट लैंप पर जचपकाई गई या ददखाई देन े िाली दकसी भी जलजखत, मुदरत, जचजननत, मुरांदकत या ग्रादफक सामग्री अजभप्रेत ह;् (ड)"लेबल अिजध" से अजधजनयम की धारा 14 के खंड (क) के अधीन के‍ रीय सरकार द्वारा अजधसूजचत ऊजा ा खपत मानक के अधीन चमकदार प्रभािकाटरता की ि्धता अिजध अजभप्रेत ह:् परंतु यदद चमकदार प्रभािकाटरता की ि्धता अिजध अजधसूजचत नहीं की जाती ह्, इसे तब तक ि्ध माना जाएगा जब तक दक के‍ रीय सरकार द्वारा इसके जलए नए मल्ू य अजधसूजचत नहीं दकए जाते। (च)"मॉडल या मॉडल का पटरिार" से एक जििेष ब्ांड के उत्पाद या उत्पाद की श्रेणी ह्, जजसके जलए परीक्षण टरपोटा का एकल सेट लागू होता ह ् और जहां प्रत्येक उत्पाद समान भौजतक जििेषताएं, चमकदार प्रभािकाटरता, स्ट्टार रेटटग स्ट्तर और काय-ा जनष्प ादन जििेषताएं रखता ह;् (छ)"अनुज्ञा पत्र धारक" से िह व्यजय या अजभकरण अजभप्रते ह ् जजसे जिजनयम 7 के अधीन लेबल लगाने की अनुमजत दी गई ह;् (ज)"अनुसूची" से इन जिजनयम के साथ सलं ग् न अनुसूची अजभप्रेत ह;् (झ) "स्ट्टार रेटटग या स्ट्टार स्ट्तर" से अजधजनयम के अधीन के‍ रीय सरकार द्वारा अजधसूजचत ऊजाा खपत मानक के आधार पर यूबूबलर लोलोरोसट ट लैंप के लेबल पर प्रदर्शित ऊजाा दक्षता का ग्रडे ह;् (ट) दकसी लेबल िाले यूबूबलर लोलोरोसट ट लैंप के संबंध मट "व्यापारी या जिक्रेता" से िह व्यजय अजभप्रेत ह ् जो ऐसे यूबूबलर लोलोरोसट ट लैंप को बेचता या जितटरत करता ह ् और इसमट दकु ानदार, व्यापारी, जनमााता और अनुज्ञा पत्र धारक सज‍मजलत ह ैंजज‍ह ट ऐसे यूबूबलर लोलोरोसट ट लैंप पर लेबल लगाने की अनुमजत दी गई ह;् (ि) "यूबूबलर लोलोरोसट ट लैंप" स े अजधजनयम के अधीन के‍र ीय सरकार द्वारा अजधसूजचत एक उपकरण अजभप्रेत ह।्

(2) उन िब् द और पद के जो इनमट प्रयुक् त ह ैं पटरभाजषत नहीं ह ् िंकतु अजधजनयम म ट पटरभाजसत ह ैं िही अथा ह गे जो क्रमि: उस अजधजनयम म ट ह ्

3. लबे ल पर प्रदर्शित दकए जान े िाल े जििरण - (1) प्रत्येक यूबूबलर लोलोरोसट ट लैंप पर, उसके लेबल पर जनम्नजलजखत जििरण प्रदर्शित दकए जाएंग,े अथाात:् - (क) ऊजाा दक्षता ब्यरू ो का लोगो; (ख) जनमााता या आयातक और ब्ांड का नाम;

(ग) यूबूबलर लोलोरोसट ट लपैं का आकार और रंग तापमान; (घ) व्यापार नाम और संख्या; (ड) मॉडल और जिजनमााण अथिा आयात का िष;ा (च) जिजिष्ट श्रृंखला कोड; (छ) िॉट मट रेटेड िजय ; (ज) यूबूबलर लोलोरोसट ट लैंप का स्ट्टार स्ट्तर;

(झ) एलएम / डब्ल्यू म ट चमकदार प्रभािकाटरता; (ट) लेबल अिजध; (ि)केडब्ल्यूएच मट जबजली की बचत; (ड) केजीसीओ2 मट सीओ2 उत्सजान मट कमी[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3

(2) लेबल का जडजाइन, रंग, आकार और सामग्री इन जिजनयम के साथ उपाबद्ध अनुसूची म ट जिजनर्ददि दकए अनुसार होगी।

4. लबे ल प्रदर्शित करन े के जलए समय सीमा.— (1) इन जनयम प्रिृत होने की तारीख से छह महीने की अिजध के भीतर प्रत्येक यूबूबलर लोलोरोसट ट लपैं पर जिजनयम 3 मट जिजनर्ददि सभी जििरण िाला एक लेबल प्रदर्शित दकया जाएगा।

(2) अजधजनयम की धारा 14 के खंड (क) के अधीन के‍ रीय सरकार द्वारा अजधसूजचत संिोजधत ऊजाा खपत मानक के लाग ू होने पर, प्रत्येक अनज्ञु ा-पत्र धारक या व्यापारी या जिक्रेता- (क) जपछले ऊजाा खपत मानक के साथ यूबूबलर लोलोरोसट ट लैंप का उत्पादन नहीं करेगा;

(ख) संिोजधत स्ट्टार स्ट्तर और संिोजधत ऊजाा खपत मानक के साथ लेबल अिजध और संिोजधत ऊजा ा खपत मानक के साथ ससक्रनाइजेिन मट यूबूबलर लोलोरोसट ट लैंप का जनमााण का िषा प्रदर्शित करेगा; (ग) डीलर , खुदरा जिक्रेताओं की जागरूकता, उनकी जिक्षा के साथ-साथ उपभोयाओं की जिक्षा के जलए आिश्यक प्रचार सजहत सुजनयोजजत त्यारी हते ु आिश् यक प्रारंजभक कदम उिाएंगे और अजग्रम रूप से कारािाई करट गे।

5. लबे ल प्रदर्शित करन े की रीजत —(1) प्रत्यके यूबूबलर लोलोरोसट ट लैंप पर एक लेबल होगा जजसे जबक्री के स्ट्थ ान पर प्रदर्शित दकया जाएगा और ऐस ेलेबल को यूबूबलर लोलोरोसट ट लपैं पर जनम्नजलजखत रीजत स ेजचपकाया जाएगा, अथाात:् - (क)16 जमलीमीटर ऊंचाई तक फोटोग्रादफक कम करने के बाद रंग कायाक्रम के साथ लेबल आिरण पर मुदरत दकया जाएगा;

(ख) प्रत्येक जनमााता और आयातक आिरण पर रंग तापमान को जचजननत करेगा; (ग) रेटटग के अनुसार स्ट्टार मार्ककग को यूबूबलर लोलोरोसट ट लपैं पर सप्रट दकया जाएगा, स्ट्टार मार्ककग के जलए स्ट्टैंप का आकार 14.5 जमलीमीटर ऊंचाई x 8.5 जमलीमीटर चौडाई होगी और इस े एक अलग स्ट् तंभ म ट स्ट्ट्‍प दकया जाएगा।

6. लिे ल को प्रदर्शित करन े के जलए अनमु जत. — (1) ब्यूरो की पूिा अनुमजत प्राप्त दकए जबना यूबूबलर लोलोरोसट ट लपैं पर कोई स्ट्टार लेबल नहीं लगाया जाएगा।

(2) कंपनी रजजस्ट् रीकरण- ब्यूरो की अनुमजत प्राप्त करने के प्रयोजन के जलए, प्रत्येक ब्ांड को भुगतान की इलेक्रॉजनक पद्धजत के अधीन दये , एक लाख रुपये के लेबल सुरक्षा फीस के साथ, अलग स े रजजस्ट् रीकृत दकया जाएगा, ज्सा दक प्ररूप I - (क) म ट जिजनर्ददि ह:् परंत ुलघु उद्योग के मामल े म,ट लेबल सुरक्षा फीस पच्चीस हजार रुपय ेही होगा।

(3) मॉडल रजजस्ट् रीकरण - उप-जिजनयम (2) के अधीन अनुज्ञा-पत्र के प्रत्येक आिेदन के साथ संलग् न दकया जाएगा- (क) भुगतान की इलेक्रॉजनक पद्धजत से देय प्रजत मॉडल दो हजार रुपय ेका आिेदन फीस; और (ख) प्ररूप 1 मट जिजिजनर्ददि दस्ट् तािेज.

7. अनमु जत प्रदान करना.- (1) जिजनयम 6 के अधीन एक आिदे न-पत्र प्राप्त होन े पर और सतं िु होन े के बाद दक उसम ट सभी अपेक्षाओं का अनपु ालन दकया गया ह,् ब्यूरो मानक और लेबसलग पर अपन े मन् ुअल मट जिजनर्ददि अिजध के भीतर, और जिजनयम 8 मट जिजनर्ददि ऐसी ितों और जनबंधन जिषयाधीन - (क) इलेक्रॉजनक रूप म ट प्ररूप II- (क) मट ब्ांड को रजजस्ट् रीकृत करेगा; और (ख) प्ररूप II मट इलेक्रॉजनक रूप म ट यूबूबलर लोलोरोसट ट लपैं पर लेबल लगाने के जलए अनुमजत प्रदान करेगा.

(2) ब्यूरो प्ररूप III मट एक रजजस्ट्टर बनाए रखगे ा और उसम ट अनुज्ञा-पत्र धारक का नाम दज ाकरेगा.

(3) उप-जिजनयम (1) के अधीन दी गई अनुमजत उस अिजध के जलए ि्ध होगी, जब तक के‍ रीय सरकार द्वारा धारा 14 के खंड (क) के अधीन अजधसूजचत ऊजाा खपत मानक द्वारा जिजनर्ददि स्ट्टार स्ट्तर लाग ूहोता ह।्

(4) स्ट्टार रेटटग योजना के पुनरीक्षण के मामल े म,ट अनुज्ञा-पत्र धारक द्वारा अनुमजत के निीनीकरण के जलए आिेदन इसकी समाजप्त से अजधकतम एक महीने पहले प्रस्ट् तुत दकया जाएगा और ऊजाा दक्षता ब्यरू ो, नई ददल्ल ी के पक्ष म ट इलेक्रॉजनक पद्धजत मट देय एक हजार रुपय ेका फीस संलग्न दकया जाएगा। परंत ु स्ट्टार रेटटग योजना के जिस्ट्तार के मामल े म,ट एक हजार रुपये के उय निीनीकरण फीस से छूट दी जाएगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(5) ि्धता अिजध समाप्त होन े के बाद दकसी भी आिेदन का निीनीकरण नहीं दकया जाएगा, इस मामल े म ट अनुज्ञा- पत्र धारक नए जसरे से आिेदन करेगा।

(6) उप-जिजनयम (4) के अधीन निीनीकरण के जलए आिेदन प्राप्त होने पर और इस बात से संतुि होन े के बाद दक सभी अपेक्षाओं का अनुपालन दकया गया ह,् ब्यूरो ऐसी प्राजप्त की तारीख से एक महीने की अिजध के भीतर प्ररूप II मट अनुमजत का निीनीकरण कर सकता ह।्

(7) अनुज्ञा-पत्र धारक जो संिोजधत स्ट्टार स्ट्तर लागू होन े की तारीख स े यूबूबलर लोलोरोसट ट लैंप के मौजूदा मॉडल पर लेबल लगान े की जनरंतरता के जलए अनुमजत मांगता ह,् केिल प्ररूप IV मट एक घोषणा प्रस्ट्तुत करेगा।

(8) यदद संिोजधत स्ट्टार स्ट्तर के साथ ससक्रोनाइज करने के जलए यूबूबलर लोलोरोसट ट लपैं के नए मॉडल को लॉ‍च करने की योजना ह,् तो अनुज्ञा-पत्र धारक को नए जसरे से लेबल लगाने की अनुमजत लने ी होगी और ऐसी अनुमजत के जलए आिेदन संिोजधत स्ट्टार स्ट् तर के लागू होन े से छह महीन े पहल े प्रस्ट्त ुत दकया जाएगा।

8. लबे ल पर जििरण प्रदर्शित करन े के जलए जनबधं न एि ं ितें.- प्रत्यके अनुज्ञा-पत्र धारक, व्यापारी और जिक्रेता लेबल पर जििरण प्रदर्शित करने के जलए जनम्नजलजखत जनयम और ितों का पालन करट गे, अथाात:- (क) यूबूबलर लोलोरोसट ट लपैं के लेबल पर प्रदर्शित स्ट्टार स्ट्तर अजधजनयम की धारा 14 के खंड (क) के अधीन कट रीय सरकार द्वारा अजधसूजचत यूबूबलर लोलोरोसट ट लैंप के जलए ऊजाा खपत मानक के अनुरूप होगा;

(ख) लेबल केिल यूबूबलर लोलोरोसट ट लैंप के ऐस ेमॉडल पर लगाया जाएगा जजसके जलए अनुमजत दी गई ह्; (ग) लेबल मुदरत दकया जाएगा और अनज्ञु ा-पत्र धारक की लागत पर यूबूबलर लोलोरोसट ट लैंप पर जचपकाया जाएगा; (घ) अनुज्ञा-पत्र धारक, व्यापारी और जिक्रेता यह सुजनजित करट ग े दक यूबूबलर लोलोरोसट ट लपैं के लेबल पर प्रदर्शित स्ट्टार स्ट्तर हर समय बनाए रखा जाएगा;

(ड) अनुज्ञा-पत्र धारक जिजनयम 9 मट जिजनर्ददि लेबल फीस का भुगतान करेगा; (च) अनुज्ञा-पत्र धारक ब्यूरो को जितीयीय िषा की प्रत्येक जतमाही की समाजप्त के अगले महीन े के भीतर प्रत्येक जतमाही के जलए लेबल दकए गए उपकरण के उत्पादन और अर्शजत लेबसलग फीस के ब् यौरे के साथ एक जििरजणका प्रस्ट्तुत करेगा;

(छ) अनुज्ञा-पत्र धारक प्रत्येक िषा 30 अप्रल् तक अपने लेबल िाले उत्पाद को बेचने के जलए जनयुय प्राजधकृत जितरक , डीलर , खुदरा जिक्रेताओं, जिक्रेताओं की एक अद्यतन सूची ब्यूरो को प्रस्ट्ततु करेगा; और (ज) अनुज्ञा-पत्र धारक, व्यापारी और जिक्रेता ऐस े अ‍य जनयम और ितों का पालन करट गे जज‍ह ट ब्यूरो द्वारा मानक और लेबसलग के बारे मट ब्यूरो के मन् ुअल म ट जनजहत जनयम सजहत जिजनर्ददि दकया जाएगा।

9. लबे ल फीस - (1) प्रत्येक अनुज्ञा-पत्र धारक ब्यरू ो को यूबूबलर लोलोरोसट ट लैंप पर लगाए गए प्रत्येक लेबल के जलए पांच प्से के लेबल फीस का भुगतान करेगा।

(2) उप-जिजनयम (1) के अधीन जिजनर्ददि लेबल फीस का भुगतान प्रत्येक जितीयीय िषा के बदं होने की तारीख स े एक महीने के भीतर दकया जाएगा: परंतु जिजनर्ददि अिजध के भीतर लेबल फीस का भुगतान करने मट जिफल रहने पर, ब्यूरो जिजनयम 6 के उप- जिजनयम (2) के अधीन प्रस्ट् ततु दकए गए लेबल सुरक्षा फीस स े दस प्रजतित प्रजत िषा की दर स े ब्याज सजहत देय रकम की िसूली कर सकता ह,् और यदद संपूणा लेबसलग फीस की प्रस्ट्तुजत की अंजतम तारीख के एक िषा के भीतर िसूली नहीं की जाती ह,् तो ब्यूरो अनुज्ञा-पत्र धारक को ददए गए सभी लेबल को रद्द कर सकता ह ् और अनुज्ञा-पत्र धारक का नाम चूककताा के रूप मट समाचार पत्र मट प्रकाजित कर सकता ह।्

10. लबे ल सरु क्षा फीस की िापसी - जिजनयम 9 के उप-जिजनयम (2) के उपबंध के अधीन, एक अनुज्ञा-पत्र धारक यूबूबलर लोलोरोसट ट लैंप के जनमाणा को बंद करन े पर लेबल सुरक्षा फीस की िापसी का हकदार होगा।

11. ब्यरू ो द्वारा सत्यापन - (1) ब्यूरो या इसका नाजमत अजभकरण, या तो स्ट् ित:, या इसे प्राप्त जिकायत पर, यह सुजनजित करन े के जलए सत्यापन कर सकती ह ् दक यूबूबलर लोलोरोसट ट लैंप स्ट्टार स्ट्तर और इसके लेबल पर प्रदर्शित अ‍य जििरण के अनुरूप ह ्और यह अनुमजत के अ‍य जनयम और ितों की अनुपालना के अनुरूप ह।्[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 5

(2) सत्यापन के प्रयोजन के जलए, ब्यूरो या इसकी नाजमत अजभकरण जनमााण सुजिधा, गोदाम या टरटेल आउटलेट स े क्रमरजहत नमून,े जो भी िह उजचत समझे, ल ेसकती ह.्

(3) जहां, उप-जिजनयम (1) के अधीन जिकायत प्राप् त होने पर, नेिनल एक्रेजडटेिन बोडा फॉर टेसस्ट्टग एंड क्जलब्ेिन ल्बोरेरीज से स‍ यक रूप से मा‍यता प्राप्त एक स्ट्ितंत्र प्रयोगिाला मट यूबूबलर लोलोरोसट ट लपैं के चुनौती परीक्षण के अधीन सत्यापन कराना अपेजक्षत होता ह्, इस तरह के परीक्षण करन े के जलए अनुज्ञा-पत्र धारक को प्ररूप V मट एक नोटटस जारी दकया जाएगा और जिकायतकताा को ब्यरू ो द्वारा जिजहत समय के भीतर नमूना लागत, परीक्षण, पटरिहन और अ‍य प्रासंजगक खचों से संबंजधत खच ा रकम जमा करन े के जलए कहा जाएगा, परंतु यदद चुनौती परीक्षण के अधीन जलया गया नमूना फेल हो जाता ह्, नमूने की लागत, नमूने के पटरिहन और परीक्षण फीस के सभी खचों की प्रजतपूर्शत अनुज्ञा-पत्र धारक द्वारा ब्यूरो को की जाएगी और ब् यूरो उपरोक्त खचों को जिकायतकताा को लौटा देगा; और जहां उपकरण चुनौती परीक्षण म ट पास हो जाता ह,् तब, जिकायतकताा द्वारा जमा दकए गए खचा को जब्त कर जलया जाएगा।

(4) जहां स्ट्ित-परीक्षण या चुनौती परीक्षण के दौरान परीक्षण के जलए उपयोग दकए गए यूबबू लर लोलोरोसट ट लैंप के नमूने फेल हो जाते ह,ैं अनुज्ञा-पत्र धारक को एक और अिसर प्रदान दकया जाएगा और ब्यूरो पहल े परीक्षण म ट उपयोग दकए गए यूबूबलर लोलोरोसट ट लैंप की दोगुनी मात्रा के साथ स्ट् ितंत्र परीक्षण प्रयोगिाला मट अनज्ञु ा-पत्र धारक की लागत पर दसू रा परीक्षण करेगा जो दक उस परीक्षण प्रयोगिाला से जभ‍ न ह ्जहां पहला जांच परीक्षण संचाजलत दकया गया था और यह नेिनल एक्रेजडटेिन बोडा फॉर टेसस्ट्टग एंड क्जलब्ेिन ल्बोरेरीज स े स‍ यक रूप से मा‍यता प्राप्त होगी और ब्यरू ो अनुज्ञा-पत्र धारक को उप-जिजनयम (3) म ट संदर्शभत चुनौती परीक्षण या उप-जिजनयम (4) म ट संदर्शभत दसू रा परीक्षण को देखने और नमून े की खरीद और परीक्षण के जलए दकए जाने िाले खचा के जलए प्ररूप V म ट को सूजचत करेगा।

(5) जहां दसू रा परीक्षण फेल हो जाता ह,् ब्यूरो, — (क) सभी राज्य नाजमत अजभकरण को सूजचत करत े हुए प्ररूप VI म ट अनुज्ञा-पत्र धारक को जनदेि देगा दक अनुज्ञा-पत्र धारक दो महीन े की अिजध के भीतर,-

(i) यूबूबलर लोलोरोसट ट लैंप के लेबल पर प्रदर्शित स्ट्टार स्ट्तर को िीक करट या परीक्षण के दौरान पाए गए दोष और कजमय को दरू करट ;

(ii) ब्यूरो के जनदेि का पालन करने के जलए बाजार से सभी स्ट्टॉक िापस ले लट ; और

(iii) जिज्ञापन सामग्री पर प्रदर्शित जििरण बदल;ट (ख) दो महीने के भीतर, उपभोयाओं के लाभ के जलए दकसी भी अनुज्ञा-पत्र धारक का नाम, ब्ांड नाम, मॉडल का नाम या मॉडल नबं र, लोगो और अ‍य जिजििताओं को दकसी भी राष्ट्रीय या क्षेत्रीय द्जनक समाचार पत्र म ट और दकसी भी इलेक्रॉजनक माध्यम से या दकसी अ‍य रीजत स,े ज्सा दक िह उजचत समझ,े प्रकाजित करट ; और (ग) संबंजधत राज्य नाजमत अजभकरण को अजधजनयम की धारा 27 के अधीन अनुज्ञा-पत्र धारक और व्यापारी के जखलाफ ‍याजयक कायािाही िुरू करने के जलए सूजचत करट .

(6) उप-जिजनयम (5) म ट जिजनर्ददि दो महीने की अिजध के समापन के दस ददन के भीतर अनज्ञु ा-पत्र धारक, - (क) जनदेि के अनुपालन मट की गई कारािाई के संबंध म ट प्ररूप VII मट अनपु ालन टरपोटा ब्यूरो को भेजट ; और (ख) यदद खंड (क) मट जिजनर्ददि अनुपालन टरपोटा जिजनर्ददि अिजध के भीतर दकसी भी जनदेि का पालन दकए जबना प्राप्त या प्राप्त नहीं होती ह्, तो इसे जारी दकए गए जनदेि का पालन नहीं दकया गया माना जाएगा और ब् यूरो द्वारा इस आिय का आदेि पाटरत दकया जाएगा।

(7) ब्यूरो खंड (क) म ट जिजनर्ददि अनुपालन टरपोटा और उप-जिजनयम (6) के खंड (ख म ट पाटरत आदेि की एक प्रजत आिश्यक दस्ट्तािेज के साथ सभी राज्य नाजमत अजभकरण को धारा 17 के अधीन कारािाई करने और उय उप-जिजनयम के खंड (ख) के अधीन पाटरत आदेि के प्रितना के उद्देश् य से भेजगे ा

2. यह अनुमजत जन‍न जलजखत के अधीन रहते हुए ह-् (क) यूबबू लर लोलोरोसट ट लैंप के लेबल पर प्रदर्शित स्ट्टार स्ट्तर अजधजनयम की धारा 14 के खंड (क) के अधीन अजधसूजचत यूबूबलर लोलोरोसट ट लैंप के जलए ऊजाा खपत मानक और उपरोक्त जिजनयम मट उपबंजधत जनबंधन और ितों के अनुरूप ह;् (ख) यूबूबलर लोलोरोसट ट लपैं के केिल ऐसे मॉडल पर लेबल की छपाई होगी जजसके जलए अनुमजत दी गई ह;् (ग) अनुज्ञा-पत्र धारक की लागत पर यूबूबलर लोलोरोसट ट लैंप पर लेबल की छपाई और उसे जचपकाया जाना ह्;

NOTIFICATION New Delhi, the 22nd June, 2023 F. No. BEE/S&L/TFL/22-23.—Whereas the draft regulations namely, the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps), Regulations 2023, were published vide notification number BEE/S&L/TFL/22-23, as required sub-section (1) of section 58 of the Energy Conservation Act, 2001 (52 of 2001), inviting objection or suggestion from persons likely to be affected thereby within the specified period of thirty days from the date of publication of the said notifications in the Official Gazette;

And whereas copies of the said draft regulations were made available to the public on 31st March, 2023;

And whereas no suggestions or comments have been received with respect to the said draft regulations within the period aforesaid;

Now, therefore, in exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 and clause (d) of section 14 of the Energy Conservation Act, 2001 (52 of 2001), and in supersession of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps) Regulations, 2018, except as respect things done or omitted to be done before such supersession, the Bureau, with the previous approval of the Central Government, hereby amends the following regulations, namely:-

1. Short title and commencement.- (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps), (Regulations), 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definition: - (1) In these regulations, unless the context otherwise requires, —

(a) ―Act‖ means the Energy Conservation Act, 2001(52 of 2001);

(b) ―Bureau‖ means the Bureau of Energy Efficiency established under sub-section (1) of section 3 of the Act.

(d) ―label‖ means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon the tubular fluorescent lamp;

(e) ―label period‖ means the validity period of the luminous efficacy under energy consumption standard notified by the Central Government under clause (a) of section 14 of the Act:

Provided that if, the validity period of the luminous efficacy is not notified, it shall be deemed to be valid until new values for the same are notified by the Central Government.

(f) ―models or family of models‖ means the product or range of products of one particular brand, to which a single set of test reports is applicable and where each of the products have the same physical characteristics, luminous efficacy, star rating level and performance characteristics;

(g) ―permittee‖ means a person or agency to whom permission has been granted to affix label under regulation 7;

(h) ―Schedule‖ means the Schedule annexed to these regulations;

(i) ―star rating or star level‖ means the grade of energy efficiency displayed on the label of the tubular fluorescent lamp based on energy consumption standard notified by the Central Government under the Act;

(j) ―trader or seller‖ in relation to any labelled tubular fluorescent lamp means a person who sells or distributes such tubular fluorescent lamp and includes shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such tubular fluorescent lamp;28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(k) ―tubular fluorescent lamps‖ means an appliance notified by the Central Government under the Act.

(2) Words and expressions used herein and not defined, but defined in the Act, shall have meanings respectively assigned to them in the Act.

3. Particulars to be displayed on label. - -(1) On every tubular fluorescent lamp, the following particulars shall be displayed on its label, namely:-

(a) the logo of the Bureau of Energy Efficiency;

(b) name of manufacturer or importer and brand;

(d) trade name and number;

(e) model and year of manufacturing or import;

(f) unique series code;

(g) rated power in Watts ;

(h) star level of the tubular fluorescent lamp;

(i) luminous efficacy in lm/W;

(j) label period;

(k) electricity savings in kWh;

(l) CO emission reduction in KgCO 2 2

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels.— (1) A label containing all the particulars specified in regulation 3 shall be displayed on every tubular fluorescent lamp within a period of six months from the date of coming into force of these regulations.

(2) On and from commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller-

(a) shall not produce the tubular fluorescent lamp with the previous energy consumption standards;

(b) shall display revised star level and label period with the revised energy consumption standard and the manufacturing year of the tubular fluorescent lamp in synchronisation with revised energy consumption standards;

(c) shall take necessary preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers are well planned and action taken in advance.

5. Manner of display of label. —

(1) There shall be a label on every tubular fluorescent lamp which shall be displayed at the point of sale and such label shall be affixed on the tubular fluorescent lamp in the following manner, namely:-

(a) the label with colour programme after photographic reduction to 16 millimetre height shall be printed on the sleeve;

(b) every manufacturer and importer shall mark the colour temperature on the sleeve;

(c) the star marking as per the rating shall be printed on the tubular fluorescent lamp, the size of the stamp for the star marking shall be 14.5 millimetre height x 8.5 millimetre width and the same shall be stamped in a separate column.

6. Permission for display of label. — (1) No star label shall be affixed on a tubular fluorescent lamp without obtaining the prior permission of the Bureau.

(2) Company registration. — For the purposes of obtaining permission of the Bureau, every brand shall be registered separately as specified in Form I – (A), accompanied by a label security fee of one lakh rupees, payable by

electronic mode of payment:

Provided that in case of small scale industry, the label security fee shall be twenty five thousand rupees only.

(3) Model registration. — Every application of the permittee under sub-regulation (2) shall be accompanied by—[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 29

(a) an application fee of two thousand rupees per model, payable by electronic mode of payment; and

(b) documents specified in Form I.

7. Grant of permission.- (1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in its Manual on standards and labelling, subject to such terms and conditions as specified in regulation 8, —

(a) register the brand in Form II-(A) in electronic form; and

(b) grant permission for affixing label on tubular fluorescent lamp in Form II in electronic form.

(2) The Bureau shall maintain a register in Form III and enter the name of the permittee therein.

(3) The permission so granted under sub-regulation (1) shall be valid for such period till which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of

section 14 is in force.

(4) In case of revision of star rating plan, an application for renewal of permission shall be made by the permittee not later than one month before its expiry and shall be accompanied by a fee of rupees one thousand payable in electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.

Provided that in case of extension of star rating plan, the said renewal fee of rupees one thousand shall be exempted.

(5) No application shall be renewed after expiry of validity period, in which case the permittee shall make a fresh application.

(6) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form II.

(7) The permittee who seeks permission for continuance to affix label on the existing model of the tubular fluorescent lamp from the date from which the revised star level comes into force shall submit only a declaration in Form IV.

(8) The permittee shall seek permission to affix label afresh, if new model of the tubular fluorescent lamp is planned to be launched to synchronise with the revised star level and application for such permission shall be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label.- Every permittee, trader and seller shall comply with the following terms and conditions in displaying the particulars on label, namely: —

(a) the star level displayed on the label of tubular fluorescent lamp shall conform to energy consumption standards for tubular fluorescent lamp notified by the Central Government under clause (a) of section 14 of the Act;

(b) the label shall be affixed only on such model of tubular fluorescent lamp for which permission has been granted;

(d) the permittee, trader and seller shall ensure that the star level displayed on the label of tubular fluorescent lamp shall be maintained at all time;

(e) the permittee shall pay the label fee as specified in regulation 9;

(g) the permittee shall furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell their labelled products by 30th day of April of each year; and

(h) the permittee, trader and seller shall comply with such other terms and conditions which the Bureau shall specify including those contained in the Bureau’s Manual on Standard and Labelling.

9. Label fee. — (1) Every permittee shall pay to the Bureau a label fee of five paisa for each label affixed on the Tubular fluorescent lamps.

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of

Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten percent per annum from the label security fee made under sub-regulation

(2) of regulation 6, and if complete labeling fees are not recovered within one year of the last date of submission, the Bureau may cancel all labels granted to the permittee and publish the name of the permittee in the newspapers as a defaulter.

10. Refund of label security fee. — Subject to the provisions of sub-regulation (2) of regulation 9, a permittee shall be entitled to a refund of the label security fee, on ceasing to manufacture Tubular fluorescent lamps.

11. Verification by Bureau. — (1) The Bureau or its designated agency may, either suo motu, or on a complaint received by it, carry out verification to ensure that the tubular fluorescent lamp conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission.

(2) For the purposes of verification, the Bureau or its designated agency may pick up samples at random from the manufacturing facility, warehouse or the retail outlet as it deems fit.

(3) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the tubular fluorescent lamp in an independent laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories, a notice shall be issued to the permittee in form V for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to sample cost, testing, transportation and other incidental expenses with the Bureau, within such time, as may be determined by Bureau, provided that the sample drawn under challenge testing fails, all expenses towards the cost of sample, transportation of sample and the testing charges, shall be reimbursed by the permittee to the Bureau and the Bureau shall refund the aforesaid expenses to the complainant; and where the equipment passes the challenge test, then, the expenses deposited by the complainant shall stand forfeited.

(4) Where samples of tubular fluorescent lamp used for testing fails the test during suo motu testing or challenge testing, the permittee shall be offered another opportunity and the Bureau shall conduct second test with twice the quantity of tubular fluorescent lamp used in the first test in an independent test laboratory which is different from the lab where the first check testing was conducted and shall be duly accredited by National Accreditation Board for Testing and Calibration Laboratories at the cost of the permittee and the Bureau shall intimate the permittee in Form V to witness the challenge testing referred to in sub-regulation (3) or the second test referred to in sub-regulation (4) and the expenses to be made towards the procurement and testing of sample.

(5) Where the second test fails, the Bureau shall, —

(a) direct the permittee in Form VI, under intimation to all the State Designated Agencies, that the permittee shall, within a period of two months,-

(i) correct the star level displayed on the label of the tubular fluorescent lamp or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material;

(b) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specifications in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit, within two months; and

(c) intimate to the concerned State Designated Agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(6) The permittee shall within ten days of the conclusion of the period of two months referred to in sub-regulation

(5), —

(a) send the compliance report in Form VII to Bureau with respect to action taken in compliance with the direction; and

(b) in case the compliance report referred to in clause (a) is not received or received without complying to any of the direction within the specified period, it shall be deemed as non- compliance of the direction issued and orders to that effect shall be passed by the Bureau.

(7) The Bureau shall send a copy of the compliance report referred to in clause (a) and orders passed in clause (b) of sub-regulation (6) along with necessary documents to all the State Designated Agencies for the purpose of taking action under section 17 of the Act and enforcement of the orders passed under clause (b) of the said sub-regulation.

(8) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (5), the Bureau under intimation to all State Designated Agencies, shall, —[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 31

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, the directions of the Bureau referred to in clause (a) of sub-regulation (6) for consideration and taking action under clause (c) of section 14 of the Act by the Central Government;

(c) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months; and

(d) intimate to the concerned State Designated Agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of permission. — The Bureau may cancel the permission granted under regulation 7, if the permittee, –

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(b) fails to pay label fee within the period specified under regulation 9; or

Provided that no application shall be cancelled without giving permittee a reasonable opportunity of being heard in respect of cancellation of permission.

The Bureau, under regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps), (Amendment) Regulations, 2023, had purchased a Bureau of Energy Efficiency star labelled Tubular fluorescent lamps from your authorized distributor/dealer/retailer vide Invoice number .......dated…….. for a price of Rs................ and lifted as a sample dated by ___ for the purpose of suo motu testing or challenge testing. The samples were purchased by M/s , an agency appointed by the Bureau for verification of the particulars displayed on the label under regulation 3 of the aforesaid regulations, affixed by you on the aforesaid purchased Tubular fluorescent lamps. (ii) deposit such cost towards procurement, transportation, testing and other incidental expenses as mentioned in Annexure, within fifteen days from the date of issuance of this letter (the expenses shall be deposited through electronic mode).

6. You may note that the Bureau shall continue the verification by challenge test or second test, even if the aforementioned expenses are not made in time or the officials are not nominated as specified and shall take further follow up action in the matter in terms of sub-regulation (5) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps), (Amendment) Regulations, 2023.

4. The results of the Test Report on the sample bearing Unique Identification serial number is enclosed. The results of the Test Report indicated that the sampled Tubular fluorescent lamps failed to meet the type test at total losses at 50% loading and total loss at 100% etc. and did not conform to the Test details furnished by you in Form 1 annexed to the Application submitted by you for seeking permission to affix label on the Tubular fluorescent lamps manufactured/imported by you. The Test Results were sent to you vide Bureau of Energy Efficiency letter No... .....

You were also requested to attend and witness the Second Check Verification Test of the samples at the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory M/s....................................................

6. The Test results of second check testing are enclosed which are dully checked and counter signed by the competent authorised personnel of the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory. The test report is also duly signed by your authorised signatory as witness of 2nd check testing.

The Test Results confirm that they failed to meet the requisite parameters and standards given in S.O. number …. dated, …. and the terms and conditions of the permission given to you for display of particulars on label affixed to the Tubular fluorescent lamps manufactured/imported and sold in the market .

7. Now, therefore in exercise of the power conferred clause (a) of sub-regulation (5) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent lamps), (Amendment) Regulations, 2023, the Bureau hereby directs to :-

(i) correct the star level displayed on the label of the Tubular fluorescent lamps or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material.

8. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within 10 days after the expiry of two months i.e. by .............. .In case no compliance report is received by the said date the Bureau shall proceed to take action in terms of clause (b) of sub-regulation (6) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps), (Amendment) Regulations, 2023.

9. The Bureau shall take further follow up action in the matter in terms of regulations (5) (6)(7) and (8) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps), (Amendment) Regulations, 2023.
