संख्या 33/7/97-PI.I ददनांक 29 अगस्ट्त 1997 के तहत की गई थी, तादक दर्ाओं/जर्जनर्ममजतयों की कीमतों को तय/संिोजधत, जनगरानी तथा औषजध (मूल्य जनयंत्रण) आदिे (डीपीसीओ) के कायावन्र्यन की जनगरानी की जा सके और जबदक भारत सरकार के का.आ. 1394(अ) ददनांक 30 मई 2013 और का.आ. 1249(अ) ददनांक 6 अप्रैल, 2020 द्वारा राष्ट्रीय औषध मूल्य जनधावरण प्राजधकरण (एनपीपीए) को केंद्र सरकार के कायों का प्रयोग करने के जलए आर्श्यक र्स्ट्तु अजधजनयम, 1955 (1955 का 10) की धारा 3 और 5 द्वारा प्रदत्त िजियों का प्रयोग करते हुए डीपीसीओ, 2013 के पैराग्राफ 19 सजहत जर्जभन्न पैराग्राफों के संबंध में िजियों को प्रत्यायोजजत दकया गया ह;ै 2. और जबदक आर्श्यक र्स्ट्तु अजधजनयम, 1955 की धारा 3 के तहत जारी डीपीसीओ, 2013 का उद्देश्य यह सुजनजित करना ह ैदक आर्श्यक दर्ाए ं सभी के जलए र्हनीय कीमतों पर उपलब्ध हों। 3. और जबदक, स्ट्र्ास्ट््य और पररर्ार कल्याण मंत्रालय ने का. आ. 648 (अ) ददनांक 11.02.2020 के जररये अजधसूजचत दकया ह ैदक मानर् या जानर्रों में उपयोग के जलए इजछछत सभी जचदकत्सा उपकरणों को ड्रग्स एंड कॉस्ट्मेरटक्स एक्ट 1940 के तहत 01.04.2020 से ड्रग्स के रूप में माना जाना ह।ै और जबदक, एनपीपीए न े तदनुसार का.आ. 1232(अ) ददनांक 31.03.2020 के जररये अजधसूजचत दकया ह ै दक सभी जचदकत्सा उपकरण (ऑक्सीजन सांद्रक सजहत) 01.04.2020 से डीपीसीओ 2013 के प्रार्धानों के तहत िाजसत होंगे। 2996 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 4. और जबदक, मेजडकल ऑक्सीजन एक आर्श्यक जीर्न रक्षक दर्ा ह ै और कोजर्ड प्रबंधन के जलए महत्र्पूणव ह।ै इसके अलार्ा, दजु नया भर में नैदाजनक प्रोटोकॉल कोजर्ड -19 के मध्यम और गंभीर मामलों के नैदाजनक प्रबंधन में एक आर्श्यक जचदकत्सा उपचार के रूप में मेजडकल ऑक्सीजन की भूजमका को मान्यता दते े ह।ैं दिे में कोजर्ड 2.0 महामारी के मामलों में अचानक आई तेजी से मेजडकल ऑक्सीजन की मांग काफी बढ़ गई ह।ै 5. और जबदक, मेजडकल ऑक्सीजन की मांग में र्ृजि के साथ, दिे में ऑक्सीजन सांद्रता की मांग में र्ृजि हुई ह।ै र्ैजिक मांग-आपूर्मत बेमेल और संबंजधत मुद्दों के कारण, ऑक्सीजन सांद्रक की कीमतों में पयावप्त अजस्ट्थरता ददखाई दते ी ह।ै इसके पररणामस्ट्र्रूप इसकी कीमत के जनयमन के जलए दिे भर के जर्जभन्न न्यायालयों में जर्जभन्न याजचकाओं और जनजहत याजचकाओं (पीआईएल) को दायर दकया गया ह ै तादक सार्वजजनक स्ट्र्ास्ट््य आपातकाल के इस महत्र्पूणव समय में र्हनीय कीमत पर इसकी उपलब्धता सुजनजित की जा सके। 6. और जबदक माननीय ददल्ली उच्च न्यायालय ने अपने आदिे ददनांक 17.05.2021 में प्राथी के याजचका के पहल ु को ध्य ान म ें रखते हुए सरकार को यह कहा था दक "यदद उि सूत्र को अपनाकर एक सूत्र जनधावररत दकया जाना ह,ै तो अजधकतम मूल्य या खुदरा मूल्य पर काम दकया जा सकता ह ैऔर ग्राहकों को लूटन े से बचाया जा सकता ह”ै । 7. स्ट्र्ास्ट््य और पररर्ार कल्याण मंत्रालय, भारत सरकार ने औषध जर्भाग, भारत सरकार को संबोजधत करते हुए, ददनांक 17.05.2021 के आदिे ों से संबंजधत माननीय ददल्ली उच्च न्यायालय की रटप्पजणयों का उल्लेख दकया और एनपीपीए से व्यापक जनजहत में उि आदिे को लाग ू करने में तजे ी लान े का अनुरोध दकया ह।ै 8. और जबदक, ऑक्सीजन सांद्रक एक गैर-अनुसूजचत दर्ा ह ै और र्तवमान में केंद्रीय औषजध मानक जनयंत्रण संगठन (सीडीएससीओ) के स्ट्र्ेछछा से लाइसेंससग ढांचे के तहत ह।ै डीपीसीओ 2013 के प्रार्धानों के तहत इसकी कीमत की जनगरानी की जा रही ह।ै हालांदक, कोजर्ड महामारी के कारण उत्पन्न होने र्ाली असाधारण पररजस्ट्थजतयों को दखे ते हुए, जजसके पररणामस्ट्र्रूप ऑक्सीजन सांद्रता की अजधकतम खुदरा कीमतों में महत्र्पूणव उतार-चढ़ार् हुआ ह ै और स्ट्र्ास्ट््य और पररर्ार कल्याण मंत्रालय, भारत सरकार से प्राप्त जसफाररि के मद्देनजर, ऑक्सीजन सांद्रक की कीमत को जर्जनयजमत करने के जलए आर्श्यक महसूस की गयी ह।ै 9. और जबदक, एनपीपीए ने पहल े अपनी अजधसूचना का.आ. 1041 (अ) ददनांक 27.02.2019 के जररये 'व्यापार मार्मजन युजिकरण दजृ िकोण' के माध्यम से चुसनदा कैंसर जर्रोधी दर्ाओं की कीमतों को सीजमत कर ददया, जजसके पररणामस्ट्र्रूप उपभोिा को महत्र्पूणव बचत हुई और उन दर्ाओं की कीमत में युजिकरण हुआ। 10. इसजलए, अब, भारत सरकार द्वारा जनजहत िजियों का प्रयोग करते हुए, रसायन और उर्वरक मंत्रालय, इस बात से संतुि होकर दक सार्वजजनक जहत में असाधारण पररजस्ट्थजतयों को दखे ते हुए, जैसा दक ऊपर बताया गया ह,ै सरकार "व्यापार मार्मजन युजिकरण दजृ िकोण" के तहत ऑक्सीजन सांद्रक की कीमत को सीजमत करने के जलए डीपीसीओ, 2013 के पैराग्राफ 19 के प्रार्धानों को लागू करती ह।ै 11. और जबदक, डीपीसीओ, 2013 के पैराग्राफ 19 को लाग ू करते हुए, सरकार इसके द्वारा गैर-अनुसूजचत ड्रग ऑक्सीजन सांद्रक के व्यापार मार्मजन को सीजमत करती ह ै और जनमावताओं को उत्पाद की जबक्री के पहल े सबद ु (इसके बाद जर्तरक को मूल्य के रूप म ें संदर्मभत) पर अपना अजधकतम खुदरा मूल्य तय करने का जनदिे दते ी ह,ै जैसा दक ताजलका-ए म ें नीच े दिावया गया ह।ै ताजलका-ए अजधकतम खुदरा मूल्य = जर्तरक का मूल्य (पीटीडी) + (पीटीडी x टीएम) + लाग ू जीएसटी जहा ं टीएम = रेड मार्मजन 70 % से अजधक न हो 12. इसके अलार्ा, डीपीसीओ, 2013 के पैरा 9 (2) के तहत रसायन और उर्वरक मंत्रालय में भारत सरकार द्वारा जनजहत िजियों का प्रयोग करते हुए, एनपीपीए जर्जनमावताओं को 7 जून, 2021 तक संग्लग्नक-I में जानकारी जजसम ें पीटीडी, खुदरा मूल्य, र्तवमान और संिोजधत अजधकतम खुदरा मूल्य का ब्यौरा, ताजलका-ए में जनधावररत फामूवले का उपयोग करके, ऑक्सीजन सांद्रक का जर्र्रण प्रस्ट्तुत करने का जनदिे ददया जाता ह।ै[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 3 रटप्पजणयााँ: क) जर्तरक का मल्ू य (पीटीडी) = जनमावता द्वारा उत्पाद की िुि जबक्री प्राजप्त का योग जैसा भी मामला हो र्तवमान माह में / मई 2021 के महीन े में जबक्री के जलए) ऐसे उत्पाद की कुल मात्रा जो र्तवमान माह में / मई 2021 के महीने में बेची गई। ख) जर्तरक / स्ट्टॉदकस्ट्ट / संस्ट्थागत / अस्ट्पताल / सरकारी / ई-कॉमस व / ई-फामेसी / जन:िुल्क नमूनों (रोगी सहायता कायवक्रम के अंतगवत सजहत) की सभी जबक्री के औसत पर जर्चार करके िुि जबक्री की गणना की जानी ह।ै ग) यदद मौजूदा जनमावता के जलए मई 2021 के महीन े के दौरान कोई जबक्री नहीं होती ह,ै तो पीटीडी गणना के जलए जर्चार दकया जान े र्ाला महीना मई 2021 से ठीक पहल े का महीना हो सकता ह ैजजसमें जबक्री दज व की गई थी। घ) यदद कोई जनमावता इस अजधसूचना के जारी होने के बाद ऑक्सीजन सांद्रक को बाजार में उतारने का इरादा रखता हो, तो अजधकतम खुदरा मूल्य र्तवमान पीटीडी के आधार पर ताजलका ए में सूत्र के अनुसार तय दकया जाएगा। (ङ) संिोजधत कीमतें 09 जून, 2021 से लाग ू होंगी। च) ताजलका-ए के अनुसार गणना दकए गए अजधकतम खुदरा मूल्य से अजधक कीमत पर जबक्री करने र्ाल े ऑक्सीजन सांद्रक के जनमावता, ऐस े ऑक्सीजन सान्द्रकों की कीमतों को नीच े की ओर संिोजधत करेंगे, उपरोि सूत्र द्वारा गणना दकए गए अजधकतम खुदरा मूल्य से अजधक नहीं होंगे। छ) ताजलका-ए के अनुसार गणना की गई अजधकतम खुदरा मूल्य से कम अजधकतम खुदरा मूल्य र्ाल े ऑक्सीजन सांद्रक के सभी मौजूदा जनमावता मौजूदा अजधकतम खुदरा मूल्य को बनाए रखेंगे बित ें दक र्ह डीपीसीओ, 2013 के पैरा 20 के प्रार्धानों के अधीन हों, और ताजलका-ए के अनुसार सूत्र के आधार पर कीमत में र्ृजि नहीं हों। ज) जनमावता डीपीसीओ, 2013 के पैराग्राफ 25 के अनुसार फॉमव-v में एक मूल्य सूची जारी करेगा और राज्य औषजध जनयंत्रक और डीलरों को 07 जून, 2021 तक दगे ा और उसकी एक प्रजत एनपीपीए को भी प्रस्ट्तुत करेगा। झ) डीपीसीओ 2013 के पैरा 25(3) के अनुसार, प्रत्येक खुदरा जर्क्रेता, डीलर, अस्ट्पताल और संस्ट्थान, मूल्य सूची और पूरक मूल्य सूची, जैसा दक जनमावता द्वारा प्रस्ट्तुत दकया गया ह,ै व्यर्साय पररसर के एक जर्जिि जहस्ट्से पर इस तरह से प्रदर्मित करेगा जैस े दक परामिव करने के इछछुक दकसी भी व्यजि के जलए आसानी से सुलभ हो। ञ) जो जनमावता ताजलका-ए के अनुसार गणना की गई अजधकतम खुदरा मूल्य और यहां ऊपर जर्जनर्ददि रटप्पजणयों का अनुपालन नहीं करते ह,ैं र्े औषध (मूल्य जनयंत्रण) आदिे , 2013 के प्रार्धानों के तहत आर्श्यक र्स्ट्त ु अजधजनयम, 1955 के साथ परठत अजधक प्रभाररत राजि के 100% तक जुमावने के अजतररि मूल्य में र्ृजि की जतजथ से 15% र्ार्मषक ब्याज के साथ अजधभाररत राजि जमा करने के जलए उत्तरदायी होंगे। ट) कोई भी जनमावता, जर्तरक, खुदरा जर्क्रेता दकसी भी उपभोिा को मौजूदा संिोजधत मूल्य सूची में जनर्ददि मूल्य या कंटेनर या उसके पैक के लेबल पर अंदकत मूल्य, जो भी कम हो जैसा दक फॉमव-V में प्रस्ट् ततु दकया गया , से अजधक कीमत पर ऑक्सीजन सांद्रक नहीं बेचेंगे। ठ) इस आदिे से तय की गई कीमत 30 नर्ंबर 2021 तक या अगल े आदिे तक, जो भी पहल े हो, लाग ू रहगें ी। ड) राज्य औषजध जनयंत्रक इस आदिे का अनुपालन करेंगे। जर्जनमावता / जर्क्रेता / अस्ट्पताल / जचदकत्सा संस्ट्थान इस आदिे के अनुपालन को सत्याजपत करने म ें राज्य औषजध जनयंत्रकों की सहायता करेंगे। इस आदिे के दकसी भी उल्लंघन को एनपीपीए के संज्ञान में लाया जाना आर्श्यक ह।ै ढ) ऑक्सीजन सांद्रक के जर्जनमावता जर्जनर्ममत/आयाजतत, बेच े और जनयावत दकए गए उत्पादों, यदद कोई हों, का माजसक जर्र्रण जनधावररत And whereas the aim of the DPCO, 2013 issued under section 3 of Essential Commodities Act, 1955, is to ensure that Essential Drugs are available to All at affordable prices. 3. And whereas, Ministry of Health and Family Welfare vide SO. 648(E) dated 11.02.2020 notified all the medical devices intended for use in human beings or animals as Drugs under the Drugs and Cosmetics Act 1940 w.e.f 01.04.2020. And whereas, NPPA has accordingly vide SO. 1232(E) dated 31.03.2020 notified all medical devices (including Oxygen Concentrator) shall be governed under the provisions of DPCO 2013 w.e.f 01.04.2020. 4. And whereas, Medical Oxygen is an essential life saving drug and is critical for COVID management. Further, the clinical protocols all over the world recognize the role of Medical Oxygen as an essential medical therapy in clinical management of moderate and severe cases of COVID-19. With the sudden spurt in cases under COVID 2.0 pandemic in the country, demand for Medical Oxygen has gone up considerably. 5. And whereas, with the increase in demand for Medical Oxygen, there is a surge in demand for Oxygen Concentrators in the country. Due to global demand–supply mismatch and related issues, the prices of the Oxygen Concentrators have recently shown substantial volatility in domestic market. This has resulted in petitions and Public Interest Litigations (PIL) filed in various Courts across the country for regulation of its price so as to ensure its availability at affordable price at this critical time of public health emergency. 6. And whereas the Hon‘ble High Court of Delhi vide its Order dated 17.05.2021 directed the Government to consider the aspect as stated by the petitioners that “The ceiling price or retail price may not be fixed in absolute terms i.e. Rupee or Paisa, however, if a formula were to be prescribed by adopting the said formula, the ceiling price or retail price could be worked out and save the customers from being fleeced‖. 7. And whereas, Ministry of Health and Family Welfare (MoH&FW), Government of India thereupon requested Department of Pharmaceuticals (DoP) to advise NPPA to expeditiously facilitate in implementing the said Order in larger public interest. 8. And whereas, Oxygen Concentrator is a Non-Scheduled Drug and presently under the voluntarily licensing framework of the Central Drugs Standard Control Organization (CDSCO). In view of the extraordinary circumstances arising due to COVID pandemic that has resulted in significant volatility in Maximum Retail Prices of Oxygen Concentrators and recommendation received from MoH&FW, Government of India, it is felt necessary to regulate the price of Oxygen Concentrators. 9. And whereas, NPPA has earlier vide its Notification SO. 1041(E) dated 27.02.2019, capped the prices of select Anti-cancer drugs through ‗Trade Margin Rationalisation Approach‘ which has resulted in significant savings to the consumer and rationalization in the price of those drugs. 10. Now, therefore, in the exercise of the powers vested by the Government of India in the Ministry of Chemicals and Fertilizers, having been satisfied that in view of the extraordinary circumstances in public interest, as explained above, the Government hereby invokes the provisions of Paragraph 19 of the DPCO, 2013 to regulate the price of Oxygen Concentrators under ―Trade Margin Rationalisation Approach‖. 11. And whereas, by invoking Paragraph 19 of DPCO, 2013, the Government hereby puts a cap on trade margin of Oxygen Concentrator at first point of sale of product (hereinafter referred as Price to Distributor) and directs manufacturers to fix the Maximum Retail Price of the non-scheduled Drug Oxygen Concentrators, as formulated in Table-A below: Table-A Maximum Retail Price = Price to Distributor (PTD) + (PTD x TM) + Applicable GST Where TM = Trade Margin not exceeding 70%. 12. Further, in the exercise of the powers vested by the Government of India in the Ministry of Chemicals and Fertilizers under Paragraph 9(2) of the DPCO, 2013, hereby directs manufacturers to submit the information in Annexure-I containing details of PTD, Retail Price, existing and revised MRP, by using the formula prescribed in Table-A, and other details for Oxygen Concentrator to NPPA by 7th June, 2021.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Notes: a) Price to Distributors (PTD) = Sum of Net sales realization of product by the manufacturer as the case may be for the sales in the Current Month / May 2021 Total Quantity of such product sold in the Current Month / May 2021 b) Net sales are to be worked out considering average of all sales namely Distributors / Stockiest / Institutional / Hospital / Government / E-commerce / E-Pharmacy / Free Samples (incl. under Patient Aid Programme). c) In case there is no sale during the month of May 2021 for an existing manufacturer, the month to be considered for PTD calculation may be immediate prior month to May 2021 in which sales were recorded. d) In case a manufacturer is intending to launch Oxygen Concentrator after issuance of this notification, MRP will be fixed as per the formula at Table-A based on current PTD. e) The revised prices shall come into effect from 9th June, 2021. f) The manufacturers of Oxygen Concentrator selling at price higher than the Maximum Retail Price so computed as per Table-A, shall revise the prices of such Oxygen Concentrator downward not exceeding the Maximum Retail Price computed by above formula. g) All the existing manufacturers of Oxygen Concentrator having MRP lower than the Maximum Retail Price so computed as per Table-A, shall maintain the existing MRP, subject to the provisions of Para 20 of the DPCO, 2013 and not increase the price on the basis of formula as per Table-A. h) The manufacturer shall issue a price list in Form–V as per Paragraph 25 of the DPCO, 2013 to NPPA and submit a copy to State Drug Controller and Dealers by 7th June 2021. i) As per Para 25(3) of DPCO 2013, every retailer, dealer, hospital and institution shall display price list and the supplementary price list, as furnished by the manufacturer, on a conspicuous part of the business premises in a manner so as to be easily accessible to any person wishing to consult the same. j) The manufacturers not complying with the Maximum Retail Price so computed as per Table-A and notes specified hereinabove shall be liable to deposit the overcharged amount along with 15% interest p.a. from the date of increase in price in addition to penalty upto 100% of the overcharged amount under the provisions of the Drugs (Prices Control) Order, 2013 read with Essential Commodities Act, 1955. k) No manufacturer, distributer, retailer shall sell Oxygen Concentrators to any consumer at a price exceeding the revised price, as submitted in Form-V, or price indicated on the label of the container or pack thereof, whichever is less. l) The price so fixed shall remain in force upto 30th November 2021 or until further orders, whichever is earlier. m) State Drug Controllers shall ensure compliance of this Order. The manufacturers / Dealers / Hospitals / Medical Institutions shall assist the State Drug Controllers in verifying the compliance to this Order.
