## Policy Analysis Report: Prevention and Suppression of Terrorism Implementation of Security Council Resolutions Second Amendment Order, 2021
**1. Executive Summary:**
This report analyzes the Prevention and Suppression of Terrorism Implementation of Security Council Resolutions Second Amendment Order, 2021, as published in the Gazette of India. This amendment modifies the 2007 Order to incorporate updates to the United Nations Security Council's ISIL (Daesh) and Al-Qaida sanctions list. The key change involves the addition of an individual, Mohammad Ali Al Habbo, to Annexure 1 of the 2007 Order, subjecting him to asset freeze, travel ban and arms embargo as outlined in relevant UN Security Council resolutions. This report details the amendment's provisions, target audience, inferred implementation aspects, and expected outcomes based solely on the provided text.
**2. Introduction:**
This report aims to provide a comprehensive overview of the Prevention and Suppression of Terrorism Implementation of Security Council Resolutions Second Amendment Order, 2021, based on the official text published in the Gazette of India. The analysis focuses on understanding the purpose, key changes, and potential impact of this amendment.
**3. Policy Overview:**
* **Original Policy Being Amended:** Prevention and Suppression of Terrorism Implementation of Security Council Resolutions Order, 2007.
* **Core Objective(s) as stated or inferred from the provided text:** The core objective, inferred from the text, is to implement United Nations Security Council resolutions related to the prevention and suppression of terrorism, specifically those concerning ISIL (Daesh), Al-Qaida, and associated individuals and entities, by updating the sanctions list.
**4. Background and Rationale:**
* **Explanation for this specific amendment:** The amendment is enacted because the Security Council of the United Nations Committee pursuant to resolutions 1267 (1999), 1989 (2011) and 2253 (2015) made amendments to its ISIL (Daesh) and Al-Qaida Sanctions List. The Government of India considers it necessary and expedient to revise the Schedule to the Order issued under the United Nations Security Council Act, 1947 to give effect to the said amendments
**5. Key Provisions / Changes:**
* **Specific part of the original policy being changed:** Annexure 1, under the heading A. Individuals, of the Prevention and Suppression of Terrorism Implementation of Security Council Resolutions Order, 2007.
* **New rule/provision:** The amendment adds a new entry (QDi.429) to the list of designated individuals in Annexure 1. This entry pertains to:
* Name: MOHAMMAD ALI AL HABBO
* Details include variations of his name, date and place of birth, nationality (Syrian Arab Republic), passport and national identification numbers, address (Turkey/Syria), and the date he was listed by the UN (17 June 2021).
* Other information: He is identified as a Turkey-based facilitator providing financial services to or in support of the Islamic State in Iraq and the Levant.
* **Difference/Effect of this change:** By adding Mohammad Ali Al Habbo to Annexure 1, he is now subject to the asset freeze, travel ban, and arms embargo stipulated in paragraph 1 of Security Council resolution 2368 (2017). This subjects him to restrictions and potential legal action within India's jurisdiction to comply with UN sanctions.
**6. Target Audience and Stakeholders:**
The primary target audience and stakeholders directly affected by this amendment include:
* **Mohammad Ali Al Habbo:** The individual specifically named in the amendment.
* **Financial institutions and businesses operating within India:** They are obligated to freeze any assets held by Mohammad Ali Al Habbo and prevent any transactions with him.
* **Immigration and law enforcement agencies in India:** They are required to enforce the travel ban and arms embargo against Mohammad Ali Al Habbo.
* **The UN Security Council 1267 Committee:** The entity that maintains the ISIL (Daesh) and Al-Qaida Sanctions List, influencing this and similar national implementations.
* **The Ministry of External Affairs:** the ministry enacting the order.
**7. Implementation Aspects (Inferred):**
* **Responsible agency/bodies mentioned:** The Ministry of External Affairs is responsible for issuing the order. Financial institutions, law enforcement, and immigration agencies are implicitly responsible for implementing the sanctions.
* **Timelines or procedures specified in the text:** The amendment comes into force on the date of its publication in the Official Gazette (July 27, 2021). No specific procedures are detailed, but existing procedures for implementing UN sanctions would likely apply.
* **Focus on implementation aspects related specifically to the changes:** The implementation focuses on ensuring that all relevant agencies and institutions are aware of the addition of Mohammad Ali Al Habbo to the sanctions list and take the necessary steps to enforce the asset freeze, travel ban, and arms embargo.
**8. Expected Outcomes / Impact of Changes:**
* **Likely intended outcome of these specific changes:** The intended outcome is to align India's domestic legal framework with the UN Security Council's sanctions regime against ISIL (Daesh) and Al-Qaida. This aims to:
* Restrict Mohammad Ali Al Habbo's ability to provide financial support to terrorist organizations.
* Prevent him from traveling internationally, limiting his operational capabilities.
* Comply with international obligations related to counter-terrorism.
**9. Conclusion:**
The Prevention and Suppression of Terrorism Implementation of Security Council Resolutions Second Amendment Order, 2021, is a significant step in aligning India's domestic laws with international efforts to combat terrorism. By incorporating the latest updates to the UN Security Council's sanctions list, the amendment aims to restrict the activities and resources of individuals associated with ISIL (Daesh) and Al-Qaida. The successful implementation of this amendment requires coordinated efforts from financial institutions, law enforcement agencies, and other relevant stakeholders. The amendment reflects India's commitment to upholding international obligations and contributing to the global fight against terrorism.
