और, संयु(cid:13) रा(cid:16) सुर(cid:17)ा प(cid:19)रषद ने अपनी 7142व(cid:24) बैठक म(cid:30) संक(cid:6)प 2146 (2014) अंगीकार (cid:4)कया था, िजसम(cid:30) सभी रा,य- से यह अपे(cid:17)ा क. गई थी (cid:4)क वे लीिबया से कYे तेल के अवैध िनया%त को रोकने क. दिृO से आवLयक उपाय कर(cid:30) और ऐसे जलयान- को नामिनZदO करने, जो लीिबया को लदाई, बंक(cid:19)रग सेवाS, तेल प(cid:19)रवहन के िनबंधनानुसार िनब[धन के अ&यधीन ह,\ और अ=य दशे - के पDन- म(cid:30) 9वेश करने के िलए उपबंध करे; और, संयु(cid:13) रा(cid:16) सुर(cid:17)ा प(cid:19)रषद के संक(cid:6)प 2214 (2015) के अंतग%त सद>य रा,य- से यह अपे(cid:17)ा ह ै(cid:4)क वे संक(cid:6)प 1970 (2011), संक(cid:6)प 1973 (2011), संक(cid:6)प 2009 (2011), संक(cid:6)प 2017 (2011), संक(cid:6)प 2040 (2012), संक(cid:6)प 2095 (2013), संक(cid:6)प 2144 (2014), संक(cid:6)प 2146 (2014), संक(cid:6)प 2174 (2014) और संक(cid:6)प 2213 (2015) म(cid:30) अंतGवO उपबंध- को पूण%तः काया%ि=वत कर(cid:30) ; और, क(cid:30)^ीय सरकार ने लीिबया क. एकता, सं9भुता, >वतं1ता और रा,य(cid:17)े1 अखंडता के संर(cid:17)ण हते ु संयु(cid:13) रा(cid:16) के घोषणाप1 के अ&याय 7 के अंतग%त अंगीकृत सुर(cid:17)ा प(cid:19)रषद के उ(cid:13) संक(cid:6)प- को (cid:4)Kयाि=वत करने के िलए संयु(cid:13) रा(cid:16) (सुर(cid:17)ा प(cid:19)रषद) अिधिनयम, 1947 (1947 का 43) के अधीन एक आदशे जारी करना अिनवाय% और स3यक पाया है ; अतः, अब, क(cid:30)^ीय सरकार, संयु(cid:13) रा(cid:16) (सुर(cid:17)ा प(cid:19)रषद) अिधिनयम, 1947 (1947 का 43) के अनु_छेद 2 2ारा 9दD शि(cid:13)य- का 9योग करते aए, उ(cid:13) संक(cid:6)प को 9भावी करने के िलए िनbिलिखत आदशे करती है:- 1. ससससंिंिंिंि(cid:14)(cid:14)(cid:14)(cid:14)(cid:15)(cid:15)(cid:15)(cid:15) ननननाााामममम औऔऔऔरररर (cid:19)(cid:19)(cid:19)(cid:19)ााााररररंंंंभभभभःःःः (1) उ(cid:13) आदशे का संि(cid:17)T नाम संयु(cid:13) रा(cid:16) सुर(cid:17)ा प(cid:19)रषद के लीिबया संबंधी संक(cid:6)प- का (cid:4)Kया=वयन आदशे , 2016 ह।ै (2) यह राजप1 म(cid:30) 9काशन क. तारीख से 9वृD होगा। 2. पपपप(cid:23)(cid:23)(cid:23)(cid:23)ररररभभभभााााषषषषााााःःःः इस आदशे म(cid:30), जब तक संदभ% से अ=यथा अपेि(cid:17)त न हो, -- (क) "संक(cid:6)प" से 26 फरवरी, 2011 को अंगीकृत संयु(cid:13) रा(cid:16) सुर(cid:17)ा प(cid:19)रषद का संक(cid:6)प 2011 का 1970 अिभ9ेत ह ैऔर इसके अंतग%त सुर(cid:17)ा प(cid:19)रषद 2ारा अंगीकृत (cid:4)कए गए संक(cid:6)प 1970 (2011), संक(cid:6)प 1973 (2011), संक(cid:6)प 2009 (2011), संक(cid:6)प 2017 (2011), संक(cid:6)प 2040 (2012), संक(cid:6)प 2095 (2013), संक(cid:6)प 2144 (2014), संक(cid:6)प 2146 (2014), संक(cid:6)प 2174 (2014) और संक(cid:6)प 2213 (2015) और संक(cid:6)प 2214 (2015) भी ह\ ; Nव>था पर, जो सिमित 2ारा अि:म (cid:31)प से अनुमो(cid:4)दत क. जाए [संदभ %1970 (2011) का पैरा 9 (ग)]; (iv) लीिबया 9ािधका(cid:19)रय- क. सुर(cid:17)ा या िनरश6ीकरण के िलए एक मा1 (cid:31)प से आशियत तकनीक. सहायता, 9िश(cid:17)ण, िवDीय और अ=य सहायता सिहत सभी 9कार के श6 और संबंिधत साम:ी (संक(cid:6)प 2009 (2011) का संदभ% पैरा- 13(क) और संक(cid:6)प 2095 (2013) का पैरा 10); (v) लघु अ6, ह(cid:6)के आयुध और संबंिधत साम:ी पर, जो संयु(cid:13) रा(cid:16) के काGमक-, मीिडया 9ितिनिधय- तथा मानवतावादी और िवकास काय%कता%S तथा सहयु(cid:13) काGमक- के केवल िनजी उपयोग हेतु अ>थायी (cid:31)प से लीिबया को िनया%त क. गई हो, िजसे भारत सरकार 2ारा सिमित को अि:म (cid:31)प से सूिचत (cid:4)कया गया था और ऐसी अिधसूचना पर पांच काय%(cid:4)दवस- के अंदर सिमित 2ारा कोई नकाराJमक िनण%य नह(cid:24) िलया गया था [संदभ% संक(cid:6)प 2009 (2011) का पैरा 13 (ख)]। ययययाााा(cid:9)(cid:9)(cid:9)(cid:9)ाााा (cid:19)(cid:19)(cid:19)(cid:19)ििििततततबबबबधधंंधधंं (2) संक(cid:6)प 1970 (2011) के उपबंध म(cid:30) सचू ीब8 या सिमित 2ारा पदािभिहत Nि(cid:13)य- का भारत रा,य(cid:17)े1 पर 9वेश या इसके मा&यम से पारगमन को रोकना, परंतु इस पैरे क. कोई बात भारत सरकार को इसके अपने नाग(cid:19)रक- को इसके अपने रा,य(cid:17)े1 म(cid:30) 9वेश करने से मनाही करने हते ु बा&य नह(cid:24) करेगीः परंतु यह िनbिलिखत दशाS म(cid:30) लागू नह(cid:24) होगाः (i) जहां सिमित मामले-दर-मामले के आधार पर यह अिभिनधा%(cid:19)रत करती ह ै (cid:4)क ऐसी या1ा धाGमक बा&यताS सिहत मानवतावादी आवLयकता के आधार पर औिचJयपूण% ह ै[संदभ% संक(cid:6)प 1970 (2011) का पैरा 16 (क)]; (ii) जहां 9वेश या पारगमन (cid:4)कसी =याियक 9(cid:4)Kया को पूण% करने के िलए अिनवाय% है [संदभ% संक(cid:6)प 2009 (2011) का पैरा 16 (ख)];4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iii) जहां सिमित मामले-दर-मामले के आधार पर यह अिभिनधा%(cid:19)रत करती ह ै (cid:4)क ऐसी छूट, लीिबयाई अरब ज34(cid:19)रया म(cid:30) शांित और रा(cid:16)ीय सुलह के उhLे य- को तथा (cid:17)े1 म(cid:30) ि>थरता को आगे बढाएगी [संदभ% संक(cid:6)प 1970 (2011) का पैरा 16 (ग)]; (iv) जहां सिमित मामले-दर-मामले के आधार पर यह अिभिनधा%(cid:19)रत करती ह ै(cid:4)क ऐसा 9वेश या पारगमन, लीिबयाई अरब ज34(cid:19)रया म(cid:30) शांित और ि>थरता को बढावा दने े के िलए ह ैऔर ऐसा अवधारण करने के पVात् अड़तालीस घंट- के अंदर उसे सिमित को अिधसूिचत करना है [संदभ% संक(cid:6)प 2009 (2011) का पैरा 16 (घ)]। आआआआिििि(cid:31)(cid:31)(cid:31)(cid:31)ततततयययय(cid:29)(cid:29)(cid:29)(cid:29) ककककाााा िििि(cid:31)(cid:31)(cid:31)(cid:31)थथथथररररीीीीककककररररणणणण 3. (क) ऐसी िनिधय-, आय िवDीय अि>तय- और आGथक संसाधन-, जो भारत म(cid:30) ि>थत है, को अिवलंब ि>थर करता है, और जो संक(cid:6)प 1970 (2011) के उपाबंध 2 म(cid:30) सूचीब8 NिOयां या अि>तJव- के >वािमJवाधीन ह \या उनके 9Jय(cid:17)तः या अ9Jय(cid:17)तः िनयं1णाधीन ह \या उनक. ओर से या उनके िनदशे पर काय% करने वाली सिमित 2ारा या NिOय- या अि>तJव- 2ारा उनके >वािमJवाधीन या िनयं1णाधीन अि>तJव- 2ारा पदािभिहत है; (ख) यह सुिनिVत करना (cid:4)क (cid:4)कसी िनिध, िवDीय आि>त या आGथक संसाधन भारतीय राि(cid:16)क- 2ारा या भारत के रा,य(cid:17)े1 के भीतर (cid:4)क=ह(cid:24) NिOय- या अि>तJव- 2ारा सिमित 2ारा पदािभिहत NिOय- या अि>तJव- को उनके फायद ेके िलए उपलXध (cid:4)कए जाने से रोका जा रहा हःै परंतु यह उन िनिधय- और अ=य आGथक उपाय- को लागू नह(cid:24) होगा, िज=ह (cid:30)भारत सरकार 2ारा अवधा(cid:19)रत (cid:4)कया गया है:-- (i) मूलभूत Nय- के िलए, िजनके अंतग%त खाe पदाथ%, (cid:4)कराया या बंधक, औषिध और िच(cid:4)कJसीय उपचार, कर-, बीमा 9ीिमयम और लोक उपयो(cid:13)ा 9भार या अन=य (cid:31)प से युि(cid:13)यु(cid:13) वृिDक फ.स- के संदाय और ऐसी िनिधय-, अ=य िवDीय आि>तय- या आGथक संसाधन- तक पaचं , जहां समुिचत हो, को 9ािधकृत करने के अपने आशय क. भारत सरकार 2ारा सिमित को अिधसूचना के पVात् ि>थर िनिधय-, अ=य िवDीय आि>तय- या आGथक संसाधन- क. नैिJयक पुरोधरण या रखरखाव के िलए रा(cid:16)ीय िविधय- के अनुसार िविधक सेवा या फ.स या सेवा 9भार- के उपबंध से सहयु(cid:13) उपगत Nय- क. 9ितपूGत के िलए और, ऐसी अिधसूचना के पांच काय%(cid:4)दवस- के भीतर सिमित के नकाराJमक िविनVय- के अभाव म(cid:30), आवLयक हो [संदभ% संक(cid:6)प 1970 (2011) का पैरा 19 (क)]। (ii) अिधसूिचत, तथा सिमित 2ारा अनुमो(cid:4)दत असाधारण Nय- के िलए आवLयक हो [संदभ% संक(cid:6)प 1970 (2011) का पैरा 19 (ख)]। (iii) (cid:4)कसी =याियक, 9शासिनक या मा&य>थम् धारणािधकार या िनण%य का िवषय होना, िजस मामले म (cid:30)िनिधयां, अ=य िवDीय आि>तय- और आGथक संसाधन- का उस धारणािधकार या िनण%य को पूरा करने के िलए उपयोग (cid:4)कया जा सके। परंतु धारणािधकार या िनण%य, जो संक(cid:6)प 1970 (2011) 26 फरवरी, 2011 के अंगीकरण क. तारीख से पहले (cid:4)कया गया था, पदािभिहत Nि(cid:13) या अि>तJव के फायद ेके िलए नह(cid:24) ह ैऔर भारत सरकार 2ारा सिमित को अिधसूिचत कर (cid:4)दया गया ह ै [संदभ% संक(cid:6)प 1970 (2011) का पैरा 19 (ग)]। कककक2222 ेे ेेततततललेेललेे ककककाााा अअअअववववधधैैधधैै ििििननननययययाााातत44तत44 4. Nव>था, जैसा (cid:4)क सिमित 2ारा पूव% म(cid:30) अनुमो(cid:4)दत (cid:4)कया जाए; 10. यह िनण%य करती ह ै(cid:4)क लीिबयाई अरब ज34(cid:19)रया सम>त हिथयार- और संबंिधत सामि:य- का िनया%त रोक दगे ी और यह (cid:4)क सम>त सद>य रा,य उनके नाग(cid:19)रक- 2ारा या उनके झंड े लगे जहाज- या िवमान- के उपयोग 2ारा लीिबयाई अरब ज34(cid:19)रया से ऐसी व>तुS क. 9ािT को भी िनिष8 कर(cid:30)गे जो लीिबयाई अरब ज34(cid:19)रया के भूभाग पर िनGमत या िनGमत नह(cid:24) क. गई ह-। 11. सम>त रा,य- से, िवशेषकर लीिबयाई अरब ज34(cid:19)रया के िनकटवतy रा,य- से आ:ह करती ह ै(cid:4)क य(cid:4)द संबंिधत रा,य के पास ऐसी जानकारी हो जो यह िवzास करने का तक%संगत आधार उपलXध कराती हो (cid:4)क काग@ म(cid:30) आपूGत, िबK., >थानांतरण या िनया%त हेतु ऐसी सामि:यां ह \ जो इस 9>ताव के पैरा:ाफ 9 या 10 2ारा िनिष8 ह,\ तो उन 9ावधान- का कठोर (cid:4)Kया=वयन सुिनिVत करने के 9योजन से वे अपने रा(cid:16)ीय 9ािधकार- तथा कानून- के अनु(cid:31)प और अंतरा%(cid:16)ीय कानून, िवशेषकर समु^ी कानून तथा संबंिधत नाग(cid:19)रक उड् डयन अनुबंध- के अनुसार सुसंगत (cid:31)प म(cid:30) लीिबयाई अरब ज34(cid:19)रया से आने-जाने वाले सम>त काग@ का उनके भूभाग पर िनरी(cid:17)ण कर(cid:30) िजनम(cid:30) समु^ी पDन और हवाई अड्ड ेशािमल ह।\ 12. यह िनण%य करती ह ैसम>त सद>य रा,य- को अिधकृत (cid:4)कया जाता ह ैतथा यह (cid:4)क सम>त सद>य रा,य इस 9>ताव के पैरा:ाफ 9 या 10 तहत िनिष8 व>तुS क. बरामदगी होने क. ि>थित म(cid:30) उन व>तुS को जXत और िन>ता(cid:19)रत (जैसे (cid:4)क उसे8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] नO करके, संचािलत या भंडा(cid:19)रत न करने लायक बनाकर या मूल या गंतN रा,य- को छोड़कर (cid:4)कसी अ=य रा,य म(cid:30) िन>तारण हते ु भेजकर) कर दग(cid:30) े िजनक. िबK., >थानांतरण या िनया%त इस 9>ताव के पैरा:ाफ 9 या 10 के तहत िनिष8 हो और यह िनण%य करती ह ै(cid:4)क सम>त सद>य रा,य ऐसे 9यास- म(cid:30) सहयोग कर(cid:30)गे; 13. यह अपेि(cid:17)त ह ै(cid:4)क कोई सद>य रा,य उ(cid:13) अनु_छेद 11 के अनुपालन म(cid:30) एक िनरी(cid:17)ण करने पर तJकाल एक आरंिभक िलिखत (cid:19)रपोट% सिमित के सम(cid:17) 9>तुत करेगा िजसम(cid:30) िवशेष (cid:31)प से िनरी(cid:17)ण के आधार- का, ऐसे िनरी(cid:17)ण के प(cid:19)रणाम- का व इसका उ(cid:6)लेख रहेगा (cid:4)क सहयोग 9दान (cid:4)कया गया या नह(cid:24), और, य(cid:4)द >थानांतरण हते ु िनिष8 व>तुएं पाई गm तो ऐसे सद>य रा,य- से यह अि:म अपेि(cid:17)त ह ै(cid:4)क वह बाद म(cid:30) (cid:4)कसी समय एक प(cid:19)रणामी िलिखत (cid:19)रपोट% सिमित के सम(cid:17) 9>तुत करेगा िजसम(cid:30) िनरी(cid:17)ण, जXती, व िन>तारण के संबंिधत िववरण-, तथा >थानांतरण के संबंिधत िववरण- का उ(cid:6)लेख होगा, िजसम(cid:30) व>तुS का एक िववरण, उनके मूल>थान और गंतN का िजK भी शािमल ह,ै य(cid:4)द यह जानकारी आरंिभक (cid:19)रपोट% म(cid:30) सि3मिलत नह(cid:24) ह।ै 14. सद>य रा,य- को 9ोJसािहत करती ह ै(cid:4)क वे अपने नाग(cid:19)रक- को लीिबयाई 9ािधका(cid:19)रय- क. ओर से ऐसी गितिविधय- म(cid:30) भाग लेने हेतु लीिबयाई अरब ज34(cid:19)रया क. या1ा करने से कड़ाई से हतोJसािहत कर(cid:30), जो मानवािधकार उ(cid:6)लंघन- म(cid:30) तक%संगत ढगं से योगदान कर सकती ह-; ययययाााा(cid:9)(cid:9)(cid:9)(cid:9)ाााा (cid:19)(cid:19)(cid:19)(cid:19)ििििततततबबबबधधंंधधंं 15. यह िनण%य करती ह ै(cid:4)क सम>त सद>य रा,य, इस 9>ताव के के प(cid:19)रिशO I म(cid:30) दज% या िनb पैरा:ाफ 24 के अनुपालन म(cid:30) ग(cid:19)ठत सिमित 2ारा िनZदO Nि(cid:13)य- का अपने भूभाग- पर 9वेश या उसके मा&यम से पारगमन 9ितबंिधत करने के िलए आवLयक उपाय कर(cid:30)गे, शत% यह ह ै(cid:4)क इस पैरा:ाफ का कोई 9ावधान (cid:4)कसी रा,य को इसके अपने नाग(cid:19)रक- को इसके अपने भूभाग पर 9वेश करने से मनाही हते ु बा&य नह(cid:24) करेगा; 16. यह िनण%य करती ह ै(cid:4)क पैरा:ाफ 15 2ारा (cid:4)कए गए उपाय, िनb पर लागू नह(cid:24) ह-गेः (a) जहां सिमित 2ारा 9Jयेक मामले के आधार पर यह िनधा%(cid:19)रत (cid:4)कया जाए (cid:4)क ऐसी या1ा धाGमक दाियJव- सिहत मानवतावादी आवLयकताS के आधार पर औिचJयपूण %होगी; (b) जहां 9वेश या पारगमन, (cid:4)कसी =याियक 9(cid:4)Kया को पूण% करने के िलए अिनवाय% हो; (c) जहां सिमित 2ारा 9Jयेक मामले के आधार पर यह िनधा%(cid:19)रत (cid:4)कया जाए (cid:4)क ऐसी छूट, लीिबयाई अरब ज34(cid:19)रया म(cid:30) शांित तथा रा(cid:16)ीय समाधान के उद द् Lे य- क. पारगमन, लीिबयाई अरब ज34(cid:19)रया म(cid:30) शांित तथा ि>थरता को बढ़ावा दने े के िलए आवLयक ह ैऔर ऐसा िनण%य करने के पVात अड़तालीस घंट- के अंदर इसके 2ारा सिमित को सूिचत (cid:4)कया जाएगा; 2158(E).—Whereas, the Security Council of the United Nations in its 6491st Meeting adopted Resolution 1970 (2011) [appended to this Order as Annexure 1] under Chapter VII of the Charter of the United Nations which required all States to take necessary measures to prevent the direct or indirect supply, sale or transfer to the Libyan Arab Jamahiriya, from or through their territories or by their nationals, or using their flag vessels or aircraft, of arms and related material of all types, including weapons and ammunition, military vehicles and equipment, paramilitary equipment, and spare parts for the aforementioned, and technical assistance, training, financial or other assistance, related to military activities or the provision, maintenance or use of any arms and related material, including the provision of armed mercenary personnel whether or not originating in their territories. States are also required to prohibit the procurement of such items from the Libyan Arab Jamahiriya by their nationals, or using their flagged vessels or aircraft, and whether or not originating in the territory of the Libyan Arab Jamahiriya; And whereas, paragraph 15 of the resolution required all States to take the necessary measures to prevent the entry into or transit through their territories of individuals designated by the Committee established under the resolution and paragraph 17 of the resolution which was further modified by resolution 1973(2011) required (i) all States to freeze without delay all funds, other financial assets and economic resources which are on their territories, which are owned or controlled, directly or indirectly, by Libyan20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] authorities or by individuals or entities listed in the resolution or designated by the Committee established under the resolution or by individuals or entities acting on their behalf or at their direction, or by entities owned or controlled by them; and (ii) to ensure that any funds, financial assets or economic resources are prevented from being made available by their nationals or by any individuals or entities within their territories, to or for the benefit of the Libyan authorities or individuals or entities listed in the resolution or individuals designated by the Committee; And whereas, the Security Council of the United Nations in its 7142nd Meeting adopted Resolution 2146 (2014) which required all States to take necessary measures with a view to prevent illicit export of crude oil from Libya and provides for designation of vessels which are subject to restriction in terms of loading, bunkering services, transporting oil to Libya and from entering the ports of other countries; And whereas, Resolution 2214(2015) of the Security Council of the United Nations requires its Member States to fully implement the provisions contained in Resolutions 1970(2011), 1973(2011), 2009(2011), 2016(2011), 2017(2011), 2040(2012), 2095(2013), 2144(2014), 2146(2014), 2174(2014), 2213(2015); And whereas, the Central Government considers it necessary and expedient to issue an Order under the United Nations (Security Council) Act, 1947 (43 of 1947) to implement the said Resolutions of the Security Council adopted under Chapter VII of the Charter of the United Nations to protect the unity, sovereignty, independence and territorial integrity of Libya; Now, therefore, in exercise of the powers conferred by section 2 of the United Nations (Security Council) Act, 1947 (43 of 1947), the Central Government hereby makes the following Order to give effect to the said Resolutions, namely:- 1. Short title and commencement . - (1) This Order may be called the Implementation of the United Nations Security Council Resolutions on Libya Order, 2016. (2) It shall come into force on the date of its publication in the Official Gazette. 2. Definitions: - (1) In this Order, unless the context otherwise requires, - (a) “Resolution” means the Resolution 1970 of 2011 of the Security Council of the United Nations adopted on 26 February 2011 and includes Resolutions 1970(2011), 1973(2011), 2009(2011), 2016(2011), 2017(2011), 2040(2012), 2095(2013), 2144(2014), 2146(2014), 2174(2014), 2213(2015) and 2214(2015) adopted by the Security Council ; (b) “Schedule” means the Schedule annexed to this Order, drawn on the basis of the determination made by the Security Council in their said Resolutions; (c) “Committee” means the Committee established by the Security Council of the United Nations in accordance with paragraph 24 of Resolution 1970 of 2011. (2) Words and expressions used but not defined in this Order and defined in any law for the time being in force shall have the meanings respectively assigned to them in such laws. 3. Application of Order to individuals, entities and vessels . - (1) The provisions of this Order, as amended from time to time, apply to individuals and entities listed in the Annexures. The term individuals and entities also includes individuals and entities as designated by the Committee from time to time and updated and specified on their website: http://www.un.org/sc/committees/1970/1970.htm (2) The provision of this Order as amended from time to time, also apply to designated vessels. The term “designated vessels” means vessels designated by the Committee from time to time and updated on their website. 4. Powers of the Central Government to give effect to the Resolutions on Libya . - The Central Government shall have all the powers to take necessary measures to: Arms Embargo (1) prevent the direct or indirect supply, sale or transfer to the Libyan authorities, or Libyan Arab Jamahiriya, from or through Indian territory or by Indian nationals, or using Indian flag vessels or aircraft, of arms and related material of all types, including weapons and ammunition, military vehicles and equipment, paramilitary equipment, and spare parts for the aforementioned, and¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 technical assistance, training, financial or other assistance, related to military activities or the provision, maintenance or use of any arms and related material, including the provision of armed mercenary personnel whether or not originating in Indian territory: Provided that it shall not apply to: – (i) Supplies of non-lethal military equipment intended solely for humanitarian or protective use, and related technical assistance or training [Reference paragraph 9(a) of resolution 1970(2011) and paragraph 9 of resolution 2095(2013)]; (ii) Protective clothing, including flak jackets and military helmets, temporarily exported to the Libyan Arab Jamahiriya by United Nations personnel, representatives of the media and humanitarian and development workers and associated personnel, for their personal use only [Reference paragraph 9(b) of resolution 1970(2011)]; (iii) Other sales or supply of arms and related material , or provision of assistance or personnel, as approved in advance by the Committee [Reference paragraph 9(c) of resolution 1970(2011)]; (iv) arms and related material of all types, including technical assistance, training, financial and other assistance, intended solely for security or disarmament assistance to the Libyan authorities [Reference paragraph 13 (a) of resolution 2009(2011) and paragraph 10 of resolution 2095(2013)]; (v) small arms, light weapons and related material, temporarily exported to Libya for the sole use of United Nations personnel, representatives of the media and humanitarian and development workers and associated personnel, which were notified by the Government of India to the Committee in advance and there was no negative decision by the Committee within five working days of such a notification [Reference paragraph 13(b) of resolution 2009(2011)]. Travel Ban (2) Prevent the entry into or transit through the territory of India of individuals listed in the Annex to resolution 1970(2011) or designated by the Committee, provided that nothing in this paragraph shall oblige Government of India to refuse its own nationals entry into its territory: Provided that it shall not apply: - (i) Where the Committee determines on a case-by-case basis that such travel is justified on the grounds of humanitarian need, including religious obligation [Reference paragraph 16(a) of resolution 1970(2011)]; (ii) Where entry or transit is necessary for the fulfilment of a judicial process [Reference paragraph 16(b) of resolution 1970(2011)]; (iii) Where the Committee determines on a case-by-case basis that an exemption would further the objectives of peace and national reconciliation in the Libyan Arab Jamahiriya and stability in the region [Reference paragraph 16(c) of resolution 1970(2011)]; (iv) Where the Government of India determines on a case-by-case basis that such entry or transit is required to advance peace and stability in the Libyan Arab Jamahiriya and notifies it to the Committee within forty-eight hours after making such a determination [Reference paragraph 16(d) of resolution 1970(2011)]. Asset Freeze (3) (a) Freeze without delay all funds, other financial assets and economic resources which are located in India, which are owned or controlled, directly or indirectly, by the individuals or entities listed in annex II of resolution 1970(2011) or designated by the Committee or by individuals or entities acting on their behalf or at their direction, or by entities owned or controlled by them; (b) Ensure that any funds, financial assets or economic resources are prevented from being made available by Indian nationals or by any individuals or entities within territory of India, to or for the benefit of the individuals or entities designated by the Committee:22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Provided that it shall not apply to funds and other economic measures that have been determined by Government of India:- (i) To be necessary for basic expenses, including payment for foodstuffs, rent or mortgage, medicines and medical treatment, taxes, insurance premiums, and public utility charges or exclusively for payment of reasonable professional fees and reimbursement of incurred expenses associated with the provision of legal services or fees or service charges, in accordance with national laws, for routine holding or maintenance of frozen funds, other financial assets and economic resources, after notification to the Committee by the Government of India of its intention to authorize, where appropriate, access to such funds, other financial assets or economic resources and in the absence of a negative decision by the Committee within five working days of such notification [Reference paragraph 19(a) of resolution 1970(2011)]; (ii) To be necessary for extraordinary expenses notified and approved by the Committee [Reference paragraph 19(b) of resolution 1970(2011)]; (iii) To be the subject of a judicial, administrative or arbitral lien or judgment, in which case the funds, other financial assets and economic resources may be used to satisfy that lien or judgment provided that the lien or judgment was entered into prior to the date of the adoption of resolution 1970(2011) (26th February, 2011) is not for the benefit of a person or entity designated and has been notified by the Government of India to the Committee [Reference paragraph 19(c) of resolution 1970(2011)]. Illicit export of crude oil 4. (a) prevent any Indian flag vessel designated by the Committee from loading, transporting or discharging crude oil from Libya aboard the vessel; (b) prevent vessels designated by the Committee from entering Indian ports; (c) prohibit the provision by Indian nationals or from Indian territory of bunkering services, such as provision of fuel or supplies, or other services, to vessels designated by the Committee; (d) prevent Indian nationals and entities and individuals in Indian territory from engaging in any financial transactions with respect to crude oil from Libya aboard vessels designated by the Committee: Provided that it shall not apply:- (i) When entry is necessary for the purpose of an inspection, in the case of emergency or in the case of return to Libya [Reference paragraph 10(b) of resolution 2146(2014)]. (ii) When provision of services under 4(4)(b) is necessary for humanitarian purposes, or in the case of return to Libya, and has been notified by Government of India to the Committee [Reference 10(c) of resolution 2146(2014)]. SCHEDULE [See paragraph 2 (b)] Annexure 1 Resolution 1970 (2011) Adopted by the Security Council at its 6491st meeting, on 26 February, 2011 The Security Council, Expressing grave concern at the situation in the Libyan Arab Jamahiriya and condemning the violence and use of force against civilians,¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23 Deploring the gross and systematic violation of human rights, including the repression of peaceful demonstrators, expressing deep concern at the deaths of civilians, and rejecting unequivocally the incitement to hostility and violence against the civilian population made from the highest level of the Libyan Government, Welcoming the condemnation by the Arab League, the African Union, and the Secretary General of the Organization of the Islamic Conference of the serious violations of human rights and international humanitarian law that are being committed in the Libyan Arab Jamahiriya, Taking note of the letter to the President of the Security Council from the Permanent Representative of the Libyan Arab Jamahiriya dated 26 February 2011, Welcoming the Human Rights Council resolution A/HRC/RES/S-15/1 of 25 February 2011, including the decision to urgently dispatch an independent international commission of inquiry to investigate all alleged violations of international human rights law in the Libyan Arab Jamahiriya, to establish the facts and circumstances of such violations and of the crimes perpetrated, and where possible identify those responsible, Considering that the widespread and systematic attacks currently taking place in the Libyan Arab Jamahiriya against the civilian population may amount to crimes against humanity, Expressing concern at the plight of refugees forced to flee the violence in the Libyan Arab Jamahiriya, Expressing concern also at the reports of shortages of medical supplies to treat the wounded, Recalling the Libyan authorities’ responsibility to protect its population, Underlining the need to respect the freedoms of peaceful assembly and of expression, including freedom of the media, Stressing the need to hold to account those responsible for attacks, including by forces under their control, on civilians, Recalling article 16 of the Rome Statute under which no investigation or prosecution may be commenced or proceeded with by the International Criminal Court for a period of 12 months after a Security Council request to that effect, Expressing concern for the safety of foreign nationals and their rights in the Libyan Arab Jamahiriya, Reaffirming its strong commitment to the sovereignty, independence, territorial integrity and national unity of the Libyan Arab Jamahiriya . Mindful of its primary responsibility for the maintenance of international peace and security under the Charter of the United Nations, Acting under Chapter VII of the Charter of the United Nations, and taking measures under its Article 41, 1. Demands an immediate end to the violence and calls for steps to fulfil the legitimate demands of the population; 2. Urges the Libyan authorities to: (a) Act with the utmost restraint, respect human rights and international humanitarian law, and allow immediate access for international human rights monitors; (b) Ensure the safety of all foreign nationals and their assets and facilitate the departure of those wishing to leave the country; (c) Ensure the safe passage of humanitarian and medical supplies, and humanitarian agencies and workers, into the country; and (d) Immediately lift restrictions on all forms of media; 3. Requests all Member States, to the extent possible, to cooperate in the evacuation of those foreign nationals wishing to leave the country; ICC referral 4. Decides to refer the situation in the Libyan Arab Jamahiriya since 15 February 2011 to the Prosecutor of the International Criminal Court;24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 5. Decides that the Libyan authorities shall cooperate fully with and provide any necessary assistance to the Court and the Prosecutor pursuant to this resolution and, while recognizing that States not party to the Rome Statute have no obligation under the Statute, urges all States and concerned regional and other international organizations to cooperate fully with the Court and the Prosecutor; 6. Decides that nationals, current or former officials or personnel from a State outside the Libyan Arab Jamahiriya which is not a party to the Rome Statute of the International Criminal Court shall be subject to the exclusive jurisdiction of that State for all alleged acts or omissions arising out of or related to operations in the Libyan Arab Jamahiriya established or authorized by the Council, unless such exclusive jurisdiction has been expressly waived by the State; 7. Invites the Prosecutor to address the Security Council within two months of the adoption of this resolution and every six months thereafter on actions taken pursuant to this resolution; 8. Recognizes that none of the expenses incurred in connection with the referral, including expenses related to investigations or prosecutions in connection with that referral, shall be borne by the United Nations and that such costs shall be borne by the parties to the Rome Statute and those States that wish to contribute voluntarily; Arms embargo 9. Decides that all Member States shall immediately take the necessary measures to prevent the direct or indirect supply, sale or transfer to the Libyan Arab Jamahiriya, from or through their territories or by their nationals, or using their flag vessels or aircraft, of arms and related materiel of all types, including weapons and ammunition, military vehicles and equipment, paramilitary equipment, and spare parts for the aforementioned, and technical assistance, training, financial or other assistance, related to military activities or the provision, maintenance or use of any arms and related materiel, including the provision of armed mercenary personnel whether or not originating in their territories, and decides further that this measure shall not apply to: (a) Supplies of non-lethal military equipment intended solely for humanitarian or protective use, and related technical assistance or training, as approved in advance by the Committee established pursuant to paragraph 24 below; (b) Protective clothing, including flak jackets and military helmets, temporarily exported to the Libyan Arab Jamahiriya by United Nations personnel, representatives of the media and humanitarian and development workers and associated personnel, for their personal use only; or (c) Other sales or supply of arms and related materiel, or provision of assistance or personnel, as approved in advance by the Committee; 10. Decides that the Libyan Arab Jamahiriya shall cease the export of all arms and related materiel and that all Member States shall prohibit the procurement of such items from the Libyan Arab Jamahiriya by their nationals, or using their flagged vessels or aircraft, and whether ornot originating in the territory of the Libyan Arab Jamahiriya; 11. Calls upon all States, in particular States neighbouring the Libyan Arab Jamahiriya, to inspect, in accordance with their national authorities and legislation and consistent with international law, in particular the law of the sea and relevant international civil aviation agreements, all cargo to and from the Libyan Arab Jamahiriya, in their territory, including seaports and airports, if the State concerned has information that provides reasonable grounds to believe the cargo contains items the supply, sale, transfer, or export of which is prohibited by paragraphs 9 or 10 of this resolution for the purpose of ensuring strict implementation of those provisions; 12. Decides to authorize all Member States to, and that all Member States shall, upon discovery of items prohibited by paragraph 9 or 10 of this resolution seize and dispose (such as through destruction, rendering inoperable, storage or transferring to a State other than the originating or destination States for disposal) items the supply, sale, transfer or export of which is prohibited by paragraphs 9 or 10 of this resolution and decides further that all Member States shall cooperate in such efforts; 13. Requires any Member State when it undertakes an inspection pursuant to paragraph 11 above, to submit promptly an initial written report to the Committee containing, in particular, explanation of the grounds for the inspections, the results of such inspections, and whether or not cooperation was provided, and, if prohibited¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 25 items for transfer are found, further requires such Member States to submit to the Committee, at a later stage, a subsequent written report containing relevant details on the inspection, seizure, and disposal, and relevant details of the transfer, including a description of the items, their origin and intended destination, if this information is not in the initial report; 14. Encourages Member States to take steps to strongly discourage their nationals from travelling to the Libyan ArabJamahiriya to participate in activities on behalf of the Libyan authorities that could reasonably contribute to the violation of human rights; Travel ban 15. Decides that all Member States shall take the necessary measures to prevent the entry into or transit through their territories of individuals listed in Annex I of this resolution or designated by the Committee established pursuant to paragraph 24 below, provided that nothing in this paragraph shall oblige a State to refuse its own nationals entry into its territory; 16. Decides that the measures imposed by paragraph 15 above shall not apply: (a) Where the Committee determines on a case-by-case basis that such travel is justified on the grounds of humanitarian need, including religious obligation; (b) Where entry or transit is necessary for the fulfilment of a judicial process; (c) Where the Committee determines on a case-by-case basis that an exemption would further the objectives of peace and national reconciliation in the Libyan Arab Jamahiriya and stability in the region; or (d) Where a State determines on a case-by-case basis that such entry or transit is required to advance peace and stabilityin the Libyan Arab Jamahiriya and the States subsequently notifies the Committee within forty- eight hours after making such a determination; Asset freeze 17. Decides that all Member States shall freeze without delay all funds, other financial assets and economic resources which are on their territories, which are owned or controlled, directly or indirectly, by the individuals or entities listed in annex II of this resolution or designated by the Committee established pursuant to paragraph 24 below, or by individuals or entities acting on their behalf or at their direction, or by entities owned or controlled by them, and decides further that all Member States shall ensure that any funds, financial assets or economic resources are prevented from being made available by their nationals or by any individuals or entities within their territories, to or for the benefit of the individuals or entities listed in Annex II of this resolution or individuals designated by the Committee; 18. Expresses its intention to ensure that assets frozen pursuant to paragraph 17 shall at a later stage be made available to and for the benefit of the people of the Libyan Arab Jamahiriya; 19. Decides that the measures imposed by paragraph 17 above do not apply to funds, other financial assets or economic resources that have been determined by relevant Member States: (a) To be necessary for basic expenses, including payment for foodstuffs, rent or mortgage, medicines and medical treatment, taxes, insurance premiums, and public utility charges or exclusively for payment of reasonable professional fees and reimbursement of incurred expenses associated with the provision of legal services in accordance with national laws, or fees or service charges, in accordance with national laws, for routine holding or maintenance of frozen funds, other financial assets and economic resources, after notification by the relevant State to the Committee of the intention to authorize, where appropriate, access to such funds, other financial assets or economic resources and in the absence of a negative decision by the Committee within five working days of such notification; (b) To be necessary for extraordinary expenses, provided that such determination has been notified by the relevant State or Member States to the Committee and has been approved by the Committee; or (c) To be the subject of a judicial, administrative or arbitral lien or judgment, in which case the funds, other financial assets and economic resources may be used to satisfy that lien or judgment provided that the lien or judgment was entered into prior to the date of the present resolution, is not for the benefit of a person or entity26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] designated pursuant to paragraph 17 above, and has been notified by the relevant State or Member States to the Committee; 20. Decides that Member States may permit the addition to the accounts frozen pursuant to the provisions of paragraph 17 above of interests or other earnings due on those accounts or payments due under contracts, agreements or obligations that arose prior to the date on which those accounts became subject to the provisions of this resolution, provided that any such interest, other earnings and payments continue to be subject to these provisions and are frozen; 21. Decides that the measures in paragraph 17 above shall not prevent a designated person or entity from making payment due under a contract entered into prior to the listing of such a person or entity, provided that the relevant States have determined that the payment is not directly or indirectly received by a person or entity designated pursuant to paragraph 17 above, and after notification by the relevant States to the Committee of the intention to make or receive such payments or to authorize, where appropriate, the unfreezing of funds, other financial assets or economic resources for this purpose, 10 working days prior to such authorization; Designation criteria 22. Decides that the measures contained in paragraphs 15 and 17 shall apply to the individuals and entities designated by the Committee, pursuant to paragraph 24 (b) and (c), respectively; (a) Involved in or complicit in ordering, controlling, or otherwise directing, the commission of serious human rights abuses against persons in the Libyan Arab Jamahiriya, including by being involved in or complicit in planning, commanding, ordering or conducting attacks, in violation of international law, including aerial bombardments, on civilian populations and facilities; or (b) Acting for or on behalf of or at the direction of individuals or entities identified in subparagraph (a). 23. Strongly encourages Member States to submit to the Committee names of individuals who meet the criteria set out in paragraph 22 above; New Sanctions Committee 24. Decides to establish, in accordance with rule 28 of its provisional rules of procedure, a Committee of the Security Council consisting of all the members of the Council (herein “the Committee”), to undertake to following tasks: (a) To monitor implementation of the measures imposed in paragraphs 9, 10, 15, and 17; (b) To designate those individuals subject to the measures imposed by paragraphs 15 and to consider requests for exemptions in accordance with paragraph 16 above; (c) To designate those individuals subject to the measures imposed by paragraph 17 above and to consider requests for exemptions in accordance with paragraphs 19 and 20 above; (d) To establish such guidelines as may be necessary to facilitate the implementation of the measures imposed above; (e) To report within thirty days to the Security Council on its work for the first report and thereafter to report as deemed necessary by the Committee; (f) To encourage a dialogue between the Committee and interested Member States, in particular those in the region, including by inviting representatives of such States to meet with the Committee to discuss implementation of the measures; (g) To seek from all States whatever information it may consider useful regarding the actions taken by them to implement effectively the measures imposed above; (h) To examine and take appropriate action on information regarding alleged violations or non-compliance with the measures contained in this resolution; 25.
