WHEREAS, vide notification number G.S.R.686(E), dated the 26th September, 1984, the Khadi and Village Industries Commission, with the previous sanction of the Central Government
This notification, S.O. 2691(E), issued by the Ministry of Micro, Small and Medium Enterprises on October 1, 2015, rescinds regulation 15 of the Khadi and Village Industries Commission Employees Pension Regulations, 1984. The rescission is enacted under subsection 3 of section 27 of the Khadi and Village Industries Commission Act, 1956 (61 of 1956). Regulation 15 concerns the counting of service periods under trading establishments or contracts for pension computation. The rationale for this rescission is that the Khadi and Village Industries Commission adopted the New Pension Scheme (now National Pension System) on January 1, 2004. Continuing regulation 15, which pertains to the earlier pension scheme, could create ambiguity and potential disputes regarding the applicability of the National Pension System. NOTIFICATION
New Delhi, the 1st October, 2015
S.O. 2691 (E).—WHEREAS, vide notification number G.S.R.686(E), dated the 26th September,
1984, the Khadi and Village Industries Commission, with the previous sanction of the Central
Government, had published the Khadi and Village Industries Commission Employees (Pension)
Regulations , 1984 (hereinafter referred to as the said regulations), for the employees of Khadi and Village
Industries Commission;
AND WHEREAS, regulation 15 of the said regulations provides for counting of the period of
service rendered under the trading establishment or on contract for the purpose of computing pension;
AND WHEREAS, with effect from the 1st day of January, 2004, the Khadi and Village Industries
Commission has adopted New Pension Scheme now called the National Pension System vide Standing
Order number 1668, dated the 14th March, 2008;
AND WHEREAS, the provisions of regulation 15 relates to earlier pension scheme and continuation
of the said provision may create ambiguity regarding the applicability of the National Pension System and
lead to administrative or legal dispute;
NOW THEREFORE, in exercise of the powers conferred under sub-section (3) of section 27 of the
Khadi and Village Industries Commission Act, 1956 (61 of 1956), the Central Government hereby
rescinds regulation 15 of the Khadi and Village Industries Commission Employees (Pension) Regulations,
1984, except as respects things done or omitted to be done before such rescission.
