STATUTORY INSTRUMENTS 1997 No. 1336 FOOD The Novel Foods and Novel Food Ingredients (Fees) Regulations 1997 Made - - - - 22nd May 1997 Laid before Parliament 23rd May 1997 Coming into force - - 16th June 1997 The Minister of Agriculture, Fisheries and Food in exercise of the powers conferred by section 56(1) and (2) of the Finance Act 1973(1) with the consent of the Treasury, hereby makes the following
Regulations:
Title and commencement
1. These Regulations may be cited as the Novel Foods and Novel Food Ingredients (Fees) Regulations 1997 and shall come into force on 16th June 1997.
Interpretation
2. In these Regulationsโ โMinisterโ means the Minister of Agriculture, Fisheries and Food.
Circumstances in which a fee is payable and payment thereof
3. Any person who, pursuant to Article 4.1 of Regulation (EC) No. 258/97 of the European Parliament and of the Council, concerning novel foods and novel food ingredients(2), and regulation 3 (requests relating to novel foods or novel food ingredients and designation of food assessment body) of the Novel Foods and Novel Food Ingredients Regulations 1997(3), submits to the Minister a request relating to a novel food or novel food ingredient, shall, at the time he submits that request, pay to the Minister, in connection with the services provided by him acting jointly with the Secretary of State for Health as the food assessment body for the purposes of that Regulation, the appropriate fee prescribed in regulation 4 below.

Prescribed Fees
4.โ(1) In respect of a request relating to any application involving a genetically modified organism for which an environmental risk assessment is required the fee payable shall be ยฃ6,500.
(2) In respect of a request relating to any other application the fee payable shall be ยฃ4,000.
(3) In respect of a request for an opinion as to substantial equivalence the fee payable shall be ยฃ1,725.

EXPLANATORY NOTE (This note is not part of the Regulations) These Regulations establish a scale of fees to be paid to the Minister of Agriculture, Fisheries and Food when, in accordance with his duties under Council Regulation (EC) No. 258/97 and the Novel Foods and Novel Food Ingredients Regulations 1997 S.I.1997/1335, he processes requests to assess novel foods and novel food ingredients.
A Compliance Cost Assessment has been prepared and a copy has been placed in the library of each House of Parliament. Copies can be obtained from Room 239c, Ergon House, c/o Nobel House, 17 Smith Square, London SW1P 3JR.
These Regulations come into force on 16th June 1997.
