S T A T U T O R Y I N S T R U M E N T S 2013 No. 293 ROAD TRAFFIC The A64 Trunk Road (Steelmoor Lane to Chestnut Avenue) (Temporary Restriction and Prohibition of Traffic) Order 2013 Made - - - - 31st January 2013 Coming into force - - 10th February 2013

WHEREAS, the Secretary of State for Transport, being the traffic authority for the A64 Trunk Road, in the District of Ryedale, in the County of North Yorkshire, is satisfied that traffic on that trunk road should be restricted and prohibited because carriageway resurfacing, signing improvements and

routine maintenance works are proposed to be executed thereon:

NOW, THEREFORE, the Secretary of State, in exercise of the powers conferred by section 14(1)(a) of the Road Traffic Regulation Act 1984(a), makes the following Order: -

1.This Order may be cited as the A64 Trunk Road (Steelmoor Lane to Chestnut Avenue) (Temporary Restriction and Prohibition of Traffic) Order 2013 and shall come into force on 10th February 2013.

2. In this Order; – “the A64” means the A64 Trunk Road; “the trunk road” means the A64 eastbound and westbound carriageways between a point 370 metres west of the centreline of its junction with Steelmoor Lane and a point 140 metres west of the centreline of its junction with Chestnut Avenue, a distance of 5500 metres;

“the central reservation” means that part of the A64 which separates its carriageways for the safety and guidance of traffic using that road; “bus stop area” means any area of carriageway on a side of the A64, intended for the waiting of buses, which is comprised within and indicated by a road marking complying with diagrams

1025.1, 1025.3 or 1025.4 in schedule 6 to the Traffic Signs Regulations and General Directions 2002(b); “the works period” means a period of 10 hours starting at 20:00 hours on Monday 11th February 2013 or any subsequent night thereafter until the said works have been completed;

and a reference to an article followed by a number is a reference to the article in this Order which bears that number.

3. Subject as mentioned in article 7 no person shall, during the works period, cause or permit any

vehicle to be driven in the trunk road at a speed exceeding:

(a) 10 miles per hour whilst traffic signs of a character authorised under Section 64 of the Road Traffic Regulation Act 1984 indicating “convoy working” on that road are displayed; or

(b) 50 miles per hour whilst such traffic signs in relation to that road are not displayed.

vehicle to enter or proceed through a gap in the central reservation:

(i) 470 metres or 680 metres east of Foston Lane;

(ii) opposite Barton Lane (Barton Hill Crossroads); or

(iii) 330 metres or 750 metres east of Barton Lane.

5. Subject as mentioned in article 7 no person shall, during the works period, cause or permit any vehicle to enter or wait in the bus stop area situated adjacent to the A64:

(i) eastbound carriageway approximately 55 metres east of its junction Mains Lane; or

(ii) westbound carriageway approximately 45 metres east of its junction Barton Lane.

6. Subject as mentioned in article 7 no person shall, during the works period, cause or permit any vehicle to enter or leave the A64 at its junctions with:

(i) Mains Lane;

(ii) Barton Lane; or

(iii) the unclassified road (Slingsby Hovingham) approximately 325 metres east of Mains Lane.

7. The provisions of articles 3, 4, 5 and 6 shall apply only during such times and to such extent as shall, from time to time, be indicated by traffic signs. Nothing in articles 4, 5 and 6 shall apply to:

(a) a vehicle being used for police, fire and rescue authority or ambulance purposes;

(b) a vehicle being used for, or in connection with, the said works, or for winter maintenance or traffic officer purposes; or

(c) anything done at the direction of, or with the permission of, a constable or traffic officer in uniform; and nothing in article 3 shall apply to any vehicle being used for a purpose specified in paragraph (a) of this article.

8. No speed limit imposed by this Order applies to vehicles falling within regulation 3(4) of the Road Traffic Exemptions (Special Forces) (Variation and Amendment) Regulations 2011(a) when usedin accordance with regulation 3(5) of those Regulations.
