STATUTORY INSTRUMENTS 2025 No. 1312 MENTAL HEALTH, ENGLAND AND WALES The Health and Care Act 2022 (Consequential Amendments) Regulations 2025 Made - - - - 11th December 2025 Coming into force - - 12th December 2025 The Secretary of State makes these Regulations in exercise of the powers conferred by section 182 of the Health and Care Act 2022(1). Citation, commencement and extent 1.—(1) These Regulations may be cited as the Health and Care Act 2022 (Consequential Amendments) Regulations 2025 and come into force on the day after the day on which they are made. (2) These Regulations extend to England and Wales. Amendment of the Down Syndrome Act 2022 2. In paragraph 2(1) (National Health Service) of the Schedule (relevant authorities and relevant functions) to the Down Syndrome Act 2022(2), for paragraphs (a) and (b) substitute— “(a) NHS England, (b) an integrated care board,”. EXPLANATORY NOTE (This note is not part of the Regulations) These Regulations, which apply in relation to National Health Service functions that are exercisable in England only, make consequential amendments to the Down Syndrome Act 2022. Regulation 2 replaces the reference to “the National Health Service Commissioning Board” in the Schedule to the Down Syndrome Act 2022 with a reference to “NHS England”. This amendment is consequential on provision in section 1 of the Health and Care Act 2022, under which the National Health Service Commissioning Board is renamed NHS England. Regulation 2 also replaces the reference in that Schedule to “a clinical commissioning group” with a reference to “an integrated care board”. This amendment is consequential on provision in section 19 of the Health and Care Act 2022 for the establishment of integrated care boards and the abolition of clinical commissioning groups. A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen. 2
