S T A T U T O R Y I N S T R U M E N T S 2025 No. 314 CIVIL AVIATION The Air Navigation (Restriction of Flying) (North West Transit Corridor) (Restricted Area EGR323) (Amendment) Regulations 2025 Made - - - - 10th March 2025 Coming into force - - 11th March 2025 The Secretary of State has decided that it is necessary to amend the restrictions imposed on flying in the Air Navigation (Restriction of Flying) (North West Transit Corridor) (Restricted Area EGR323) Regulations 2024(a).

The Secretary of State makes the following Regulations in exercise of the powers conferred by article 239 of the Air Navigation Order 2016(b).

Citation and commencement

1. These Regulations may be cited as the Air Navigation (Restriction of Flying) (North West Transit Corridor) (Restricted Area EGR323) (Amendment) Regulations 2025 and they come into force on 11th March 2025.

Amendment of the Regulations

2.—(1) The Air Navigation (Restriction of Flying) (North West Transit Corridor) (Restricted Area EGR323) Regulations 2024 are amended as follows.

(2) For regulation 2(2), substitute— “(2) Subject to paragraph (3), paragraph (1) does not apply to any—

(a) aircraft flying in accordance with the following criteria—

(i) at a speed which according to its airspeed indicator is 140 knots or less,

(ii) with in-flight visibility of 5 kilometres or more,

(iii) mandatory use of the Manchester or Liverpool atmospheric pressure setting

(QNH), and

(iv) maximum certificated take-off mass (MTOM)(c) of up to 40,000 kilogrammes,

(b) S.I. 2016/765, as amended by S.I. 2024/990; there are other amending instruments, but none is relevant.

(c) The maximum take-off mass (MTOM), often referred to as maximum take-off weight (MTOW), of an aircraft is a value defined by the aircraft manufacturer. It is the maximum mass at which the aircraft is certified for take-off due to structural or other limits. MTOW is usually specified in units of kilograms or pounds. The mass is a fixed value and does not vary with changes in temperature, altitude, or runway available.(b) unmanned aerial systems flying in accordance with visual line of sight below 400 feet above ground level or those operating with the authorisation of the Civil Aviation Authority, or

(c) aircraft insofar as flying is already prohibited by the Air Navigation (Restriction of Flying) (Prisons and Young Offender Institutions) (England and Wales) Regulations 2023(a).” Revocation of Regulations

3. The Air Navigation (Restriction of Flying) (North West Transit Corridor) (Restricted Zone EGR353) (Amendment) Regulations 2025(b) are revoked.

Signed by authority of the Secretary of State for Transport David J Best Grade 7 10th March 2025 Department for Transport EXPLANATORY NOTE (This note is not part of the Regulations) These Regulations amend the Air Navigation (Restriction of Flying) (North West Transit Corridor) (Restricted Area EGR323) Regulations 2024 (S.I. 2024/1199) which impose restrictions on flying in the vicinity of North West England by adding an exemption from the Regulations for unmanned aircraft.

These Regulations also revoke the Air Navigation (Restriction of Flying) (North West Transit Corridor) (Restricted Zone EGR353) (Amendment) Regulations 2025 (S.I. 2025/290) as there was an error in their title.

These Regulations apply except insofar as flying is already prohibited by the Air Navigation (Restriction of Flying) (Prisons and Young Offender Institutions) (England and Wales) Regulations 2023 (S.I. 2023/1101).
