STATUTORY INSTRUMENTS 2026 No. 333 TOWN AND COUNTRY PLANNING, ENGLAND The Levelling-up and Regeneration Act 2023 (Commencement No. 11 and Saving and Transitional Provisions) (Amendment) Regulations 2026 Made - - - - 23rd March 2026 Coming into force - - 24th March 2026 The Secretary of State makes these Regulations in exercise of the powers conferred by section 255(12) of the Levelling-up and Regeneration Act 2023(1). Citation and commencement 1.—(1) These Regulations may be cited as the Levelling-up and Regeneration Act 2023 (Commencement No. 11 and Saving and Transitional Provisions) (Amendment) Regulations 2026. (2) These Regulations come into force on the day after the day on which they are made. Amendment of the Levelling-up and Regeneration Act 2023 (Commencement No. 11 and Saving and Transitional Provisions) Regulations 2026 2. In the Levelling-up and Regeneration Act 2023 (Commencement No. 11 and Saving and Transitional Provisions) Regulations 2026(2), at the end of Schedule 1 (plan making saving and transitional provisions) insert— “Savings for the purpose of the Community Infrastructure Levy 8. Despite the commencement of Schedule 7 to the Act to the extent specified in regulation 3, sections 29 and 37 of the PCPA 2004, as they had effect immediately before the commencement date, continue to have effect for the purposes of Part 11 of the Planning Act 2008(3) (Community Infrastructure Levy), until 31st December 2027.”. EXPLANATORY NOTE (This note is not part of the Regulations) These Regulations amend the Levelling-up and Regeneration Act 2023 (Commencement No. 11 and Saving and Transitional Provisions) Regulations 2026 (S. I. 2026/169 (C. 16)) to add in additional savings for sections 29 and 37 of the Planning and Compulsory Purchase Act 2004 (c. 5) (“the PCPA 2004”) for the purposes of Part 11 of the Planning Act 2008 (c. 29), which makes provision in relation to the Community Infrastructure Levy. This is to ensure that the existing references in this Part, to a local planning authority and a joint committee, continue to apply until 31st December 2027. A Regulatory Impact Assessment under the Better Regulation Framework has not been produced for this instrument. The Regulatory Impact Assessment for the Levelling-up and Regeneration Act 2023 provides analysis of the primary legislative measures from which the measures set out in this instrument derive.
