The Local Government (Structural and Boundary Changes)
(Control of Disposals etc.) (Amendment) Order 2026

The Secretary of State makes this Order in exercise of the powers conferred by section 29 of the
Local Government and Public Involvement in Health Act 2007(1).
Citation, commencement and extent
1.—(1) This Order may be cited as the Local Government (Structural and Boundary Changes)
(Control of Disposals etc.) (Amendment) Order 2026.
(2) This Order comes into force on the day after the day on which it is made.
(3) This Order extends to England and Wales.
Amendment of the Local Government and Public Involvement in Health Act 2007
2. In the Local Government and Public Involvement in Health Act 2007, in section 27(1) and (3)
(consideration to be taken into account for purposes of direction), for “31 December 2006” substitute
“31 March 2025”.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends a provision in the Local Government and Public Involvement in Health Act 2007
(c. 28) (“the 2007 Act”) relating to the control of property disposals and contractual dealings that
local authorities that are to be dissolved pursuant to an Order made under section 7 (implementation
of proposals by order) or section 10 (implementation of recommendations by order) of the 2007 Act
may make or enter into without the consent of specified persons.
Section 24 of the 2007 Act enables the Secretary of State to issue directions to local authorities that
are to be dissolved under a section 7 order or a section 10 order, specifying that before entering into
contracts for the disposal of land or for capital or non-capital purposes involving consideration of
specified values, the local authority is required to obtain the written consent of a specified person.
Section 27 of the 2007 Act specifies that in calculating the consideration value of such a contract, the
consideration value of any other disposal of land or relevant capital or non-capital contracts made
or entered into after 31st December 2006 should be taken into account.
This Order amends the dates specified in section 27, replacing 31st December 2006 with 31st March
2025.
A full impact assessment has not been produced for this instrument as no, or no significant, impact
on the private, voluntary or public sector is foreseen.
