Official Journal EN of the European Union L series 2024/1558 27.6.2024 DECISION OF THE EEA JOINT COMMITTEE No 12/2024 of 2 February 2024 amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2024/1558] THE EEA JOINT COMMITTEE, Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof, Whereas: (1) Commission Implementing Regulation (EU) 2022/1426 of 5 August 2022laying down rules for the application of Regulation (EU) 2019/2144 of the European Parliament and of the Council as regards uniform procedures and technical specifications for the type-approval of the automated driving system (ADS) of fully automated vehicles(1) is to be incorporated into the EEA Agreement. (2) Annex II to the EEA Agreement should therefore be amended accordingly, HAS ADOPTED THIS DECISION: Article 1 The following is inserted after point 52d (Commission Delegated Regulation (EU) 2021/1341) of Chapter I of Annex II to the EEA Agreement: ‘52e. 32022 R 1426: Commission Implementing Regulation (EU) 2022/1426 of 5 August 2022laying down rules for the application of Regulation (EU) 2019/2144 of the European Parliament and of the Council as regards uniform procedures and technical specifications for the type-approval of the automated driving system (ADS) of fully automated vehicles (OJ L 221, 26.8.2022, p. 1). The provisions of the Regulation shall, for the purpose of the EEA Agreement, be read with the following adaptation: Notwithstanding the provisions of Protocol 1 to this Agreement, in point 5.4. of Part 2 of Annex III, the words “or the EFTA Surveillance Authority as regards manufacturers established in the EFTA States” shall be inserted after the words “the Commission”.’ Article 2 The text of Implementing Regulation (EU) 2022/1426 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic. Article 3 This Decision shall enter into force on 3 February 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made(*), or on the day of the entry into force of Decision of the EEA Joint Committee No 49/2022 of 18 March 2022(2), whichever is the later.
