DECISION OF THE EEA JOINT COMMITTEE No 120/2023

amending Annex XIII (Transport) to the EEA Agreement [2023/2265]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98
thereof,
Whereas:
(1) Commission Implementing Regulation (EU) 2020/469 of 14 February 2020 amending Regulation (EU)
No 923/2012, Regulation (EU) No 139/2014 and Regulation (EU) 2017/373 as regards requirements for air
traffic management/air navigation services, design of airspace structures and data quality, runway safety and
repealing Regulation (EU) No 73/2010(1), as corrected by OJ L 106, 6.4.2020, p. 14and OJ L 108, 7.4.2022, p. 70,
is to be incorporated into the EEA Agreement.
(2) Commission Implementing Regulation (EU) 2020/1177 of 7 August 2020 amending Implementing Regulation
(EU) 2020/469 as regards postponing dates of application of certain measures in the context of the COVID-19
pandemic(2)is to be incorporated into the EEA Agreement.
(3) Commission Implementing Regulation (EU) 2020/469 repeals Commission Regulation (EU) No 73/2010(3), which
is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.
(4) Annex XIII to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
Annex XIII to the EEA Agreement shall be amended as follows:
(1) the following indent and sub-indent are added in points 66nh (Commission Regulation (EU) No 139/2014) and 66wk
(Commission Implementing Regulation (EU) No 923/2012):
‘— 32020 R 0469: Commission Implementing Regulation (EU) 2020/469 of 14 February 2020 (OJ L 104,
3.4.2020, p. 1), as corrected by OJ L 106, 6.4.2020, p. 14and OJ L 108, 7.4.2022, p. 70, as amended by:

10.8.2020, p. 12).’;
(2) the following indent and sub-indent are added in point 66xg (Commission Implementing Regulation (EU) 2017/373):

The texts of Implementing Regulations (EU) 2020/469, as corrected by OJ L 106, 6.4.2020, p. 14and OJ L 108, 7.4.2022,
p. 70, and (EU) 2020/1177 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official
Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 29 April 2023, provided that all the notifications under Article 103(1) of the EEA
Agreement have been made*, or on the day of the entry into force of Decision of the EEA Joint Committee No 114/2023
of 28 April 2023(4), whichever is the later.
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European
Union.
