THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98
thereof,
Whereas:
(1) Commission Implementing Decision (EU) 2021/2149 of 3 December 2021on unresolved objections regarding the
terms and conditions of the provisional authorisation of a biocidal product containing 5-Chloro-2-methyl-2H-
isothiazol-3-one (C(M)IT) referred by France in accordance with Article 36(1) of Regulation (EU) No 528/2012 of
the European Parliament and of the Council(1)is to be incorporated into the EEA Agreement.
(2) Commission Implementing Decision (EU) 2021/2174 of 3 December 2021on unresolved objections regarding the
terms and conditions of the authorisation of the biocidal product Konservan P40 in accordance with Article 36(1)
of Regulation (EU) No 528/2012 of the European Parliament and of the Council(2)is to be incorporated into the
EEA Agreement.
(3) Annex II to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
The following points are inserted after point 12zzzzzzzr (Commission Implementing Decision (EU) 2021/2148) of Annex
II to the EEA Agreement:
‘12zzzzzzzs. 32021 D 2149: Commission Implementing Decision (EU) 2021/2149 of 3 December 2021on unresolved
objections regarding the terms and conditions of the provisional authorisation of a biocidal product
containing 5-Chloro-2-methyl-2H-isothiazol-3-one (C(M)IT) referred by France in accordance with Article
36(1) of Regulation (EU) No 528/2012 of the European Parliament and of the Council (OJ L 434,
6.12.2021, p. 5).
12zzzzzzzt. 32021 D 2174: Commission Implementing Decision (EU) 2021/2174 of 3 December 2021on unresolved
objections regarding the terms and conditions of the authorisation of the biocidal product Konservan P40 in
accordance with Article 36(1) of Regulation (EU) No 528/2012 of the European Parliament and of the
Council (OJ L 441, 9.12.2021, p. 1).’
Article 2
The texts of Implementing Decisions (EU) 2021/2149 and (EU) 2021/2174 in the Icelandic and Norwegian languages, to be
published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 30 April 2022, provided that all the notifications under Article 103(1) of the EEA
Agreement have been made*.
