DECISION OF THE EEA JOINT COMMITTEE No 128/2019

amending Annex XIII (Transport) to the EEA Agreement [2022/2025]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98
thereof,
Whereas:
(1) Regulation (EU) 2017/352 of the European Parliament and of the Council of 15 February 2017 establishing a
framework for the provision of port services and common rules on the financial transparency of ports(1)is to be
incorporated into the EEA Agreement.
(2) Annex XIII to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
The following is inserted after point 56y (Regulation (EU) 1177/2010 of the European Parliament and of the Council) of
Annex XIII to the EEA Agreement:
‘56z. 32017 R 0352: Regulation (EU) 2017/352 of the European Parliament and of the Council of 15 February 2017
establishing a framework for the provision of port services and common rules on the financial transparency of ports
(OJ L 57, 3.3.2017, p. 1).
The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptation:
The following shall be added to Article 1(4):
“As regards the EFTA States, this Regulation shall apply to the following maritime ports of the trans-European
transport network as shown in Commission Delegated Regulation (EU) 2016/758 amending Regulation (EU)
No 1315/2013 of the European Parliament and of the Council as regards adapting Annex III thereto(2):

Article 2
The text of Regulation (EU) 2017/352 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to
the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 1 June 2019, provided that all the notifications under Article 103(1) of the EEA
Agreement have been made(3)*.
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European
Union.
