Executive Summary & Key Takeaways

**Summary:** EEA Joint Committee Decision No. 145/2023, adopted on June 13, 2023, amends Annex II (Technical regulations, standards, testing and certification) to the Agreement on the European Economic Area (EEA). The decision incorporates Commission Delegated Regulation (EU) 2022/545 of January 26, 2022, into the EEA Agreement. Regulation (EU) 2022/545 supplements Regulation (EU) 2019/2144 by establishing detailed rules for type-approval of motor vehicles concerning their event data recorders (EDR), including specific test procedures and technical requirements, and amends Annex II to Regulation (EU) 2019/2144. Article 1 of the Decision modifies Chapter I of Annex II to the EEA Agreement by inserting point 51d, referencing Commission Delegated Regulation (EU) 2022/545 (OJ L 107, 6.4.2022, p. 18), after point 51c and adding an indent to point 52, also referencing the same regulation. Article 2 stipulates that the Icelandic and Norwegian language versions of Delegated Regulation (EU) 2022/545 will be published in the EEA Supplement to the Official Journal of the European Union and are authentic. Article 3 states that the Decision will enter into force on June 14, 2023, provided all notifications under Article 103(1) of the EEA Agreement have been made, or on the day of the entry into force of Decision of the EEA Joint Committee No 49/2022 of 18 March 2022, whichever is later. Article 4 mandates the publication of the Decision in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union. The President of the EEA Joint Committee, Nicolas VON LINGEN, signed the decision in Brussels.
