Article 2 states that the Icelandic and Norwegian language texts of Regulation (EU) No 611/2013, to be published in the EEA Supplement to the Official Journal of the European Union, will be authentic.
The Decision entered into force on July 9, 2016, contingent upon the completion of notifications under Article 103(1) of the EEA Agreement, or on the entry into force of the Decision of the EEA Joint Committee incorporating Regulation (EC) No 1211/2009, whichever was later. The Decision was published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

DECISION OF THE EEA JOINT COMMITTEE

amending Annex XI (Electronic communication, audiovisual services and information society) to the
EEA Agreement [2018/376]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98
thereof,
Whereas:
(1) Commission Regulation (EU) No 611/2013 of 24 June 2013 on the measures applicable to the notification of
personal data breaches under Directive 2002/58/EC on the European Parliament and of the Council on privacy and
electronic communications (1) is to be incorporated into the EEA Agreement.
(2) Annex XI to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
The following point is inserted after point 5ha (Directive 2002/58/EC of the European Parliament and of the Council) of
Annex XI to the EEA Agreement:
‘5haa. 32013 R 0611: Commission Regulation (EU) No 611/2013 of 24 June 2013 on the measures applicable to
the notification of personal data breaches under Directive 2002/58/EC on the European Parliament and of the
Council on privacy and electronic communications (OJ L 173, 26.6.2013, p. 2).’
Article 2
The text of Regulation (EU) No 611/2013 in the Icelandic and Norwegian languages, to be published in the EEA
Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 9 July 2016, provided that all the notifications under Article 103(1) of the EEA
Agreement have been made (*), or on the day of the entry into force of the Decision of the EEA Joint Committee
incorporating Regulation (EC) No 1211/2009 of the European Parliament and of the Council (2) into the EEA Agreement,
whichever is the later.
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European
Union.
