DECISION OF THE EEA JOINT COMMITTEENo 162/2025

amending Annex XIII (Transport) to the EEA Agreement [2025/1856]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98
thereof,
Whereas:
(1) Commission Implementing Regulation (EU) 2023/1771 of 12 September 2023 amending Implementing Regulation
(EU) 2017/373 as regards air traffic management and air navigation services systems and constituents and repealing
Regulations (EC) No 1032/2006, (EC) No 633/2007 and (EC) No 262/2009(1) is to be incorporated into the EEA
Agreement.
(2) Implementing Regulation (EU) 2023/1771 repeals Commission Regulations (EC) No 1032/2006(2), (EC)
No 633/2007(3) and (EC) No 262/2009(4), which are incorporated into the EEA Agreement and which are
consequently to be repealed under the EEA Agreement.
(3) Annex XIII to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
Annex XIII to the EEA Agreement is amended as follows:
(1) the following indent is added in point 66xg (Commission Implementing Regulation (EU) 2017/373):
‘— 32023 R 1771: Commission Implementing Regulation (EU) 2023/1771 of 12 September 2023 (OJ L 228,
15.9.2023, p. 49).’;
(2) the texts of points 66wb (Commission Regulation (EC) No 1032/2006), 66wba (Commission Regulation (EC)
No 633/2007) and 66wh (Commission Regulation (EC) No 262/2009) are deleted.
Article 2
The text of Implementing Regulation (EU) 2023/1771 in the Icelandic and Norwegian languages, to be published in the
EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 14 June 2025, provided that all the notifications under Article 103(1) of the EEA
Agreement have been made(*), or on the day of the entry into force of Decision of the EEA Joint Committee No 147/2025
of 13 June 2025(5), or on the day of the entry into force of Decision of the EEA Joint Committee No 161/2025 of 13 June
2025(6), whichever is the later.
