Decision of the EEA Joint Committee No 192/2020 of 11 December 2020 amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2023/1994]
This EEA Joint Committee Decision No. 192/2020, dated 11 December 2020, amends Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement. The decision incorporates Commission Regulations (EU) 2020/268 and 2020/279 into the EEA Agreement, specifically addressing the use of sorbic acid (E 200) in liquid color preparations for eggshells and soybean hemicellulose (E 426) in foodstuffs, respectively. This decision does not apply to Liechtenstein due to its agreement with the Swiss Confederation on trade in agricultural products. The regulations are added to point 54zzzzr of Regulation (EC) No 1333/2008 within Chapter XII of Annex II to the EEA Agreement. The authentic texts of Regulations (EU) 2020/268 and (EU) 2020/279 in Icelandic and Norwegian languages will be published in the EEA Supplement to the Official Journal of the European Union. The decision entered into force on 12 December 2020, following the notifications under Article 103(1) of the EEA Agreement. The decision was published in the EEA Section of, and the EEA Supplement to, the Official Journal of the European Union. amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98
thereof,
Whereas:
(1) Commission Regulation (EU) 2020/268 of 26 February 2020 amending Annex III to Regulation (EC)
No 1333/2008 of the European Parliament and of the Council as regards the use of sorbic acid (E 200) in liquid
colour preparations for the decorative colouring of egg shells(1)is to be incorporated into the EEA Agreement.
(2) Commission Regulation (EU) 2020/279 of 27 February 2020amending Annex II to Regulation (EC) No 1333/2008
of the European Parliament and of the Council as regards the use of soybean hemicellulose (E 426)(2) is to be
incorporated into the EEA Agreement.
(3) This Decision concerns legislation regarding foodstuffs. Legislation regarding foodstuffs shall not apply to
Liechtenstein as long as the application of the Agreement between the European Community and the Swiss
Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to
Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.
(4) Annex II to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
The following indents are added in point 54zzzzr (Regulation (EC) No 1333/2008 of the European Parliament and of the
Council) of Chapter XII of Annex II to the EEA Agreement:
‘— 32020 R 0268: Commission Regulation (EU) 2020/268 of 26 February 2020(OJ L 56, 27.2.2020, p. 4),
— 32020 R 0279: Commission Regulation (EU) 2020/279 of 27 February 2020(OJ L 59, 28.2.2020, p. 6).’
Article 2
The texts of Regulations (EU) 2020/268 and (EU) 2020/279 in the Icelandic and Norwegian languages, to be published in
the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 12 December 2020, provided that all the notifications under Article 103(1) of the
EEA Agreement have been made*.
