amending Annex II (Technical regulations, standards, testing and certification) and Annex IV
(Energy) to the EEA Agreement [2023/2005]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98
thereof,
Whereas:
(1) Commission Delegated Regulation (EU) No 665/2013(1), which is incorporated into the EEA Agreement, was declared
invalid by the General Court of the European Union in its judgment of 8 November 2018, in Case T-544/13(2)and
consequently the reference to Delegated Regulation (EU) No 665/2013 is to be deleted from the EEA Agreement.
(2) Annexes II and IV to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
The text of point 4n (Commission Delegated Regulation (EU) No 665/2013) of Chapter IV of Annex II to the EEA
Agreement is deleted.
Article 2
The text of point 11n (Commission Delegated Regulation (EU) No 665/2013) of Annex IV to the EEA Agreement is deleted.
Article 3
This Decision shall enter into force on 12 December 2020, provided that all the notifications under Article 103(1) of the
EEA Agreement have been made*.
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European
Union.
